Definition of the problem: Compromise is an ethical category. During the last 20 years it has rarely been considered, although there are many controversial ethical issues in medicine with no willingness for consensus. In the process of ethics consultation, dissatisfaction with the consultation or afterwards with the decision to act was also noticed.Arguments: Ethics consultation must take into account the anti-ethical implications. Therefore, it must consider the meaning of ethical compromise (1) as an existential option, (2) as a moment in (...) moral development, and (3) as a presupposition for medical interactions.Conclusion: Compromise means to act competently to mediate between morals and situational challenges. Thus, moral optimalism could easily become fundamentalism, which is the horizon of ethics consultation. (shrink)

In contemporary Anglo-American political philosophy, perfectionism is widely understood as the idea that the state may, or should, promote valuable conceptions of the good life and discourage conceptions that are worthless or bad. As such, debates over perfectionism occupy a central place in contemporary political philosophy because political philosophers are deeply concerned about whether or not a liberal state is permitted to promote any particular ethical or religious doctrine or impose it on its citizens. -/- In general, contemporary perfectionists do (...) not argue for the state’s pursuit of any religious doctrine. They only maintain that the state is permitted to make a wide range of public policies with the aim of promoting the good life. These policies, commonly found in liberal democratic societies, may include subsidizing museums and art galleries, preserving cultural heritage, setting up public libraries and providing free access to reading materials, encouraging athletic excellence, conserving nature and biodiversity, and educating citizens about the harm of recreational drugs. Nevertheless, perfectionism remains controversial among philosophers and political scientists. -/- It might be beneficial to take a sympathetic view of perfectionism and consider how perfectionists might defend their position against some of the common objections. These objections mainly include: (a) that the state does not possess legitimate authority to make decisions about the good life and seek to promote it; (b) that perfectionist policies are generally illiberal and paternalistic; and (c) that conceptions of the good life are objects of reasonable disagreement and hence cannot legitimately be promoted by the state. The roots of the Lvov-Warsaw School can be traced back to Aristotle himself. But in later times we better put them into thinking GW Leibniz and who somehow inherited many of these ways of thinking, such as the philosopher and mathematician Bernhard Bolzano. Since he would pass the key figure of Franz Brentano, who had as one of his disciples to Kazimierz Twardowski, which starts with the brilliant Polish school of mathematics and philosophy dealt with. Among them, one of (...) the most interesting thinkers must be Jan Lukasiewicz, the father of many-valued logic.Jan Łukasiewicz began teaching at the University of Lvov, and then at Warsaw, but after World War II must to continue in Dublin. Some questions may be very astonishing in the CV of Łukasiewicz. For instance, that a firstly Polish Minister of Education in Paderewski cabinet, into the new Polish Republic, and also Rector for two times at Warsaw University, was awarded with a Doctorate ‘Honoris Causa’ in spring 1936, at University of Münster, into the maximum of effervescency of Nazism in Germany. The explanation must be their good relation with a very good friend, the former theologian, and then logician, Heinrich Schölz, who was the first Chairman of Mathematical Logic in German universities.Łukasiewicz firstly studied Law, and then Mathematics and Philosophy in Lvov. His doctoral supervisor was Kazimierz Twardowski, and in 1902 he obtain his Ph. D. title with a very special mention: ‘sub auspiciis Imperatoris’. Also he received a doctorate ring with diamonds from the Kaiser of the Austro-Hungarian Empire, Franz Joseph I.From 1902, Łukasiewicz was employed as a private teacher, and also as a desk in the Universitary Library of Lvov. So it was until 1904 when he obtained a scholarship to study abroad. He defends his ‘Habilitationschrift’ in 1906, entitled “Analysis and construction of the concept of cause”. This permits to give university courses. His first lectures were on the Algebra of Logic, according to the recent translation to Polish of this book of the French logician Louis Couturat.Between 1902 and 1906, Lukasiewicz continued his studies in the universities of Berlin and Leuwen. In 1906, by his ‘Habilitationschrift’, he obtain the qualification as university professor at Lvov. And the, in 1911, he was appointed as associate professor in his ‘alma mater’.Jan Łukasiewicz was also very active in historical research on logic, giving a new and up-to-date interpretation of Aristotle’s syllogism and of the Stoics’ propositional calculus. According to Scholz, the better pages on history of logic are due to him. And also, as Arianna Betti says, “Jan Lukasiewicz is first and foremost associated with the rejection of the Principle of Bivalence and the discovery of Many-Valued Logic.”The discovery of MVL by Lukasiewicz was in 1918, a little earlier than Emil Leon Post. According to Jan Wolenski, “although Post’s remarks were parenthetical and extremely condensed, Lukasiewicz explained his intuitions and motivations carefully and at length. He was guided by considerations about future contingents and the concept of possibility”. So, he introduces, firstly, three-valued logic, then four-valued logic, generalized to logics with an arbitrary finite number of veritative values, and finally, to logics with a countably infinite-valued number of such values.Very noteworthy is his treatment of the history of logic in the light of the new formal logic. Thus, not only he addressed the issue of future contingents departing from Aristotle, but also put in value logic of the Stoics, at least so far taken. In fact, Heinrich Scholz said, rightly, that Lukasiewicz had written the most lucid pages on the history of logic. (shrink)

Within any adversarial rule-governed system, it often takes time for strategically motivated agents to discover effective exploits. Once discovered, these strategies will soon be copied by all other participants. Unless it is possible to adjust the rules to preclude them, the result will be a degradation of the performance of the system. This is essentially what has happened to public political discourse in democratic states. Political actors have discovered, not just that the norm of truth can be violated in specific (...) ways, but that many of the norms governing rational deliberation can also be violated, not just without penalty, but often for significant political gain. As a result, the level of noise has come to drown out the signal. The post-truth political condition is the cumulative result of innovations developed by actors who adopt an essentially strategic orientation toward political communications. (shrink)

ABSTRACT Many recent articles argue that participants who seroconvert during HIV prevention trials deserve treatment when they develop AIDS, and there is a general consensus that the participants in HIV/aids treatment trials should have continuing post‐trial access. As a result, the primary concern of many ethicists and activists has shifted from justifying an obligation to treat trial participants, to working out mechanisms through which treatment could be provided. In this paper I argue that this shift frequently conceals an important (...) assumption: that if there is an obligation to supply treatment, then any party who could provide it may be prevailed upon to discharge the obligation. This assumption is false. The reasons why trial participants should get ART affect who has the duty to provide it. We should not burden governments with the obligations of sponsors, nor researchers with the obligations of the international community. And we should not deprive a group of treatment because their need is less salient than that of research participants. Insisting otherwise may lead to people being wrongfully deprived of access to antiretrovirals. (shrink)

Patient narratives from two investigational deep brain stimulation trials for traumatic brain injury and obsessive‐compulsive disorder reveal that injury and illness rob individuals of personal identity and that neuromodulation can restore it. The early success of these interventions makes a compelling case for continued post‐trial access to these technologies. Given the centrality of personal identity to respect for persons, a failure to provide continued access can be understood to represent a metaphorical identity theft. Such a loss recapitulates the pain (...) of an individual's initial injury or illness and becomes especially tragic because it could be prevented by robust policy. A failure to fulfill this normative obligation constitutes a breach of disability law, which would view post‐trial access as a means to achieve social reintegration through this neurotechnological accommodation. This article presents Franz Rosenzweig’s concept of redemption as a vehicle for raising some important questions for confronting the contemporary movement of Transhumanism. The upshot of our discussion is located in the existential questions asked, following a philosophical comparison of Rosenzweig’s religious and philosophical commitment to human life in its most robust form, with Transhumanism’s scientistic vision. To do so, the article first discusses some techno-scientistic assumptions of Transhumanism, showing that it presumes what was once a core principle of (...) German Idealism, the identity of reason and being, against which Rosenzweig rebelled. Then, the article turns to examine Rosenzweig’s humanistic redemptive vision and its emphasis on the corporeal, the temporal, and the worldly. The conclusion makes explicit the ways in which Rosenzweig’s redemptive vision provides a contrasting model to the one set forth by Transhumanism. (shrink)

This paper raises a challenge for those who assume that corporate social responsibility and good corporate governance naturally go hand-in-hand. The recent spate of corporate scandals in the United States and elsewhere has dramatized, once again, the severity of the agency problems that may arise between managers and shareholders. These scandals remind us that even if we adopt an extremely narrow concept of managerial responsibility – such that we recognize no social responsibility beyond the obligation to maximize shareholder value – (...) there may still be very serious difficulties associated with the effective institutionalization of this obligation. It also suggests that if we broaden managerial responsibility, in order to include extensive responsibilities to various other stakeholder groups, we may seriously exacerbate these agency problems, making it even more difficult to impose effective discipline upon managers. Hence, our central question: is a strong commitment to corporate social responsibility institutionally feasible? In searching for an answer, we revisit the history of public management, and in particular, the experience of social-democratic governments during the 1960s and 1970s, and their attempts to impose social responsibility upon the managers of nationalized industries. The results of this inquiry are less than encouraging for proponents of corporate social responsibility. In fact, the history of public-sector management presents a number of stark warnings, which we would do well to heed if we wish to reconcile robust social responsibility with effective corporate governance. While ordinary decision theory focuses on empirical uncertainty, real decision-makers also face normative uncertainty: uncertainty about value itself. From a purely formal perspective, normative uncertainty is comparable to (Harsanyian or Rawlsian) identity uncertainty in the 'original position', where one's future values are unknown. A comprehensive decision theory must address twofold uncertainty -- normative and empirical. We present a simple model of twofold uncertainty, and show that the most popular decision principle -- maximising expected value (`Expectationalism') -- has different formulations, namely (...) Ex-Ante Expectationalism, Ex-Post Expectationalism, and hybrid theories. These alternative theories recommend different decisions, reasoning modes, and attitudes to risk. But they converge under an interesting (necessary and sufficient) condition. (shrink)

The aim of this article is to fill a certain gap in the assessment of relativism by drawing on Joseph Ratzinger’s (1927–2022) criticism of the normative transformation since Kant. During the Enlightenment, Natural Law was doubted as a cultural feature of Christianity that had no bearing on pluralist society. Consequently, this jurisprudential tradition underwent de-Hellenization and branched out in radical directions, the most decisive of which was Kant’s post-metaphysical system of natural values. Positivism and German Idealism attempted to (...) restore the unity of philosophy that Kant’s philosophy had disrupted. Yet even more influentially, in the nineteenth and twentieth centuries it was Marxism that relativized the doxological aspect of normativity by emphasizing the importance of praxis. Since philosophy became neither an exact science as Kant had conceived it to be, nor a practical programme for social justice as Marxism had promised, the Existentialists, and particularly Sartre, advocated a more radical philosophy of freedom. Ratzinger argues that despite the nuances of post-Kantian philosophy, Positivism, Existentialism, and Marxism failed to comprehend the human condition and that the positivist method resulted in an overwhelming relativism that has reduced normativity to a matter of correct procedures rather than regarding it as the foundation of the inviolable dignity of the human being. Abstract and Introduction. This essay is an attempt to dispense with the negative aspects of Romanticism and examine whatever positive it has to offer--in the light of ideas scattered through diverse writings of Ernest Gellner.

Does pre-voting group deliberation improve majority outcomes? To address this question, we develop a probabilistic model of opinion formation and deliberation. Two new jury theorems, one pre-deliberation and one post-deliberation, suggest that deliberation is beneficial. Successful deliberation mitigates three voting failures: (1) overcounting widespread evidence, (2) neglecting evidential inequality, and (3) neglecting evidential complementarity. Formal results and simulations confirm this. But we identify four systematic exceptions where deliberation reduces majority competence, always by increasing Failure 1. Our analysis recommends deliberation (...) that is 'participatory', 'neutral', but not necessarily 'equal', i.e., that involves substantive sharing, privileges no evidences, but might privilege some persons. Does all conscious experience essentially involve self-consciousness? In his Subjectivity and Selfhood: Investigating the First-Person, Dan Zahavi answers “yes”. I criticize three core arguments offered in support of this answer—a well-known regress argument, what I call the “interview argument,” and a phenomenological argument. Drawing on Sartre, I introduce a phenomenological contrast between plain experience and self-conscious experience. The contrast challenges the thesis that conscious experience entails self-consciousness.

The paper argues that a prevalent conception of power in the educational sciences is detrimental to pedagogy both as a field of practice and as a discipline and inept as a scientific concept from an epistemological standpoint. The designation of this power concept as ‘aethereal’ can provide the education theoretical discourses with a means to analyze and criticize positions and arguments that have undermined the autonomy of education since the establishment of Foucauldian thinking in the educational sciences. First, this article (...) argues that the pedagogical notion of the educable child depends on the concepts of individuality, plasticity, and autonomy within the framework of a negative ontology. Second, it problematizes the effects of the substitution of these concepts in the postmodern power-critical educational sciences for pedagogy in general and the child as its key concept in particular. The politicized child is conceived of as subjugated, passive, vulnerable, and what is crucial: as a thing-like, i.e. pedagogically ineducable but only powerfully moldable identity. Third, it analyses the philosophical basis of this shift towards the politicization of the child by introducing the concept of ‘aethereal power’. The article concludes with a sociological reflection on the societal dimension of this fundamental transformation of education and hints at the emerging post-critical pedagogy as a possible remedy. Confucian scholars should satisfy two conditions insofar as they think their theories enable Confucianism to make contributions to liberal politics and social policy. The liberal accommodation condition stipulates that the theory in question should accommodate as many reasonable conceptions of the good and religious doctrines as possible while the intelligibility condition stipulates that the theory must have a recognizable Confucian character. By and large, Joseph Chan’s Confucian perfectionism is able to satisfy the above two conditions. However, contrary to Chan (...) and many other Confucian scholars, I argue that any active promotion of Confucianism will violate the liberal accommodation condition. I propose the “wide view of moderate perfectionism,” which enables Confucianism to shed light on a wide range of political and social issues without promoting Confucianism actively. Thus, I present a new approach to the long-standing question of how Confucianism may improve political and social development in a liberal society. (shrink)

Metaphors that compare the computer to a human brain are common in computer science and can be traced back to a fertile period of research that unfolded after the Second World War. To conceptualize the emerging “intelligent” properties of computing machines, researchers of the era created a series of virtual objects that served as interpretive devices for representing the immaterial functions of the computer. This paper analyses the use of the terms “artificial” and “virtual” in scientific papers, textbooks, and popular (...) articles of the time, and examines how, together, they shaped models in computer science used to conceptualize computer processes. What role, if any, should Confucianism play in the politics of our time? In some of my previous works, I claimed that modern liberal states are not permitted to promote Confucian values on the basis of their intrinsic merits. Yet, drawing insights from Joseph Chan’s moderate state perfectionism and John Rawls’s wide view of public political culture, I proposed the “wide view of moderate perfectionism.” According to this view, in public political discussion, citizens should be allowed to deliberate whether (...) and how Confucianism, among other reasonable moral doctrines, can make positive contributions to their social and political thinking and public policymaking, provided that certain conditions are met. This view has been criticized by some scholars, in particular Zhuoyao Li. Li argues that the practice of the wide view of moderate perfectionism would inevitably harm civility. In this article, I clarify and develop the wide view and respond to Li’s criticisms. (shrink)

Toward a Metaphysics of Culture provides an initial, minimal, and original analysis of the concept of uniquely enlanguaged cultures of the human world and of the distinctive metaphysical features of whatever belongs to the things of that world: preeminently, persons, language, actions, artworks, products, history, practices, institutions, and norms. Emphasis is placed on the artifactual and hybrid nature of persons, naturalistic and post-Darwinian evolutionary considerations, and the bearing of the account on a range of disputed inquiries largely centered on (...) the relationship between physical nature and human culture and between the natural and human sciences. The schema offered lays a foundation for a closer analysis of the human mind, cognition, interpretation, nomologicality, normativity, intentionality, realism, and related matters. The central thesis advances the heterodox notion, congruent with post-Darwinian studies in paleoanthropology, that the human person is a natural artifact, a functional transform of the primate members of Homo sapiens, by way of a complexly intertwined biological and encultured evolution, primarily dependent on the invention, transmission, and mastery of true language and the novel hybrid abilities that that makes possible. In Ontological Catastrophe, Joseph Carew takes up the central question guiding Slavoj Žižek’s philosophy: How could something like phenomenal reality emerge out of the meaninglessness of the Real? Carefully reconstructing and expanding upon his controversial reactualization of German Idealism, Carew argues that Žižek offers us an original, but perhaps terrifying, response: experience is possible only if we presuppose a prior moment of breakdown as the ontogenetic basis of subjectivity. Drawing upon resources found in Žižek, Lacanian psychoanalysis, and post-Kantian (...) philosophy, Carew thus develops a new critical metaphysics—a metaphysics which is a variation upon the late German Idealist theme of balancing system and freedom, realism and idealism, in a single, self-reflexive theoretical construct—that challenges our understanding of nature, culture, and the ultimate structure of reality. This book is the first to trace the origins and significance of positivism on a global scale. Taking their cues from Auguste Comte and John Stuart Mill, positivists pioneered a universal, experience-based culture of scientific inquiry for studying nature and society—a new science that would enlighten all of humankind. Positivists envisaged one world united by science, but their efforts spawned many. Uncovering these worlds of positivism, the volume ranges from India, the Ottoman Empire, and the Iberian Peninsula to Central Europe, (...) Russia, and Brazil, examining positivism’s impact as one of the most far-reaching intellectual movements of the modern world. Positivists reinvented science, claiming it to be distinct from and superior to the humanities. They predicated political governance on their refashioned science of society, and as political activists, they sought and often failed to reconcile their universalism with the values of multiculturalism. Providing a genealogy of scientific governance that is sorely needed in an age of post-truth politics, this volume breaks new ground in the fields of intellectual and global history, the history of science, and philosophy. The concept of autonomy is of crucial importance not only for philosophical but also for theological ethics. Referring to the contemporary debate on the universality or particularity of moral judgments the idea of universal moral principles is defended by reconstructing the fundamental similarities between J. Rawls's liberal theory of social justice and Aquinas's understanding of natural law. Despite this plea for a cognitivist approach in normative ethics and a strong concept of practical reason the communitarian movement has to be taken (...) seriously especially from a theological perspective. As both the concepts of happiness or human fulfillment and that of virtue need to be rehabilitated in post-Kantian ethics communitarianism could help us to overcome a too narrow and therefore partly blind understanding of moral theory. (Winner of The Res Publica Essay Prize) This article defends a moderate version of state perfectionism by using Gerald Gaus’s argument for liberal neutrality as a starting point of discussion. Many liberal neutralists reject perfectionism on the grounds of respect for persons, but Gaus has explained more clearly than most neutralists how respect for persons justifies neutrality. Against neutralists, I first argue that the state may promote the good life by appealing to what can be called “the qualified judgments about (...) the good life,” which have not been considered by liberal perfectionists including Joseph Chan and Steven Wall. Then I clear up several possible misunderstandings of these judgments, and argue that: (a) moderate perfectionism does not rely on controversial rankings of values and is committed to promoting different valuable ways of life by pluralistic promotion; and (b) moderate perfectionism requires only an indirect form of coercion in using tax money to support certain moderate perfectionist measures, which is justifiable on the grounds of citizens’ welfare. Thus, I maintain that moderate perfectionism does not disrespect citizens, and is not necessarily unfair to any particular group of people. It is, in fact, plausible and morally important. The defence of moderate perfectionism has practical implications for the state’s policies regarding art development, drug abuse, public education, and so on. (shrink)

This book explores the ways in which poetic inspiration came to be associated with madness in early nineteenth-century Britain. By examining the works of poets such as Barrett, Browning, Clare, Tennyson, Townshend, and the Spasmodics in relation to the burgeoning asylum system and shifting medical discourses of the period, it investigates the ways in which Britain’s post-Romantic poets understood their own poetic vocations within a cultural context that insistently linked poetic talent with illness and insanity. Joseph Crawford examines (...) the popularity of mesmerism among the writers of the era, as an alternative system of medicine that provided a more sympathetic account of the nature of poetic genius, and investigates the persistent tension, found throughout the literary and medical writings of the period, between the Romantic ideal of the poet as a transcendent visionary genius and the ‘medico-psychological’ conception of poets as mere case studies in abnormal neurological development. Directional deep brain stimulation contacts provide greater spatial flexibility for therapy than traditional ring-shaped electrodes, but little is known about longitudinal changes of impedance and orientation. We measured monopolar and bipolar impedance of DBS contacts in 31 patients who underwent unilateral subthalamic nucleus deep brain stimulation as part of a randomized study. At different follow-up visits, patients were assigned new stimulation configurations and impedance was measured. Additionally, we measured the orientation of the directional lead during surgery, immediately after surgery, and (...) 1 year later. Here we contrast impedances in directional versus ring contacts with respect to local anatomy, active stimulation contact, and over time. Directional contacts display larger impedances than ring contacts. Impedances generally increase slightly over the first year of therapy, save for a transient decrease immediately post-surgery under general anesthesia during pulse generator placement. Local impedances decrease at active stimulation sites, and contacts in closest proximity to internal capsule display higher impedances than other anatomic sites. DBS leads rotate slightly in the immediate postoperative period but otherwise remain stable over the following year. These data provide useful information for setting clinical stimulation parameters over time. (shrink)
