"Diversität" soll gefördert und in den Strukturen von Staat und Gesellschaft verwirklicht werden. Der Be¬griff "Diversität" transportiert - und das macht ihn für die Staatswissenschaften besonders interessant - eine komplexe, überwiegend noch diffuse Demokratietheorie, in der sich Gesellschafts- und Verfassungstheorie treffen. Der Autor zeigt die theoretischen und dogmatischen Folgen für den modernen Verfassungsstaat auf. Die These lautet, dass eine diverse Gesellschaft notwendig mit Identitätspolitik einhergehe, in deren Folge identitäre Gruppen nach einem "exklusionsfreien Konsens" verlangen. So belegt z. B. die Entpolitisierung (...) gesellschaftlicher Konflikte, dass die Politik gegenüber Diversitätsansprüchen aus der Gesellschaft aufgeschlossen ist. Nicht mehr nur politische Minderheiten begreifen sich als identitäre Gruppen, auch Mehrheiten haben begonnen, diesen Schritt zu gehen. Wir sehen die Rückkehr des Hasses in die politische Auseinandersetzung. Das Diversitätskonzept sollte deshalb für die liberale Demokratie freiheitsgerecht gedacht werden. (shrink)

Authority arguments generate support for claims by appealing to an agent’s authority status, rather than to reasons independent of it. With few exceptions, the current literature on argument schemes acknowledges two basic authority types. The _epistemic_ type grounds in knowledge, the_ deontic_ type grounds in power. We review how historically earlier scholarship acknowledged an_ attractiveness-based_ and a _majority-based_ authority type as equally basic type. Crossing these with basic speech act types thus yields authority argument sub-schemes. Focusing on the_ epistemic-assertive_ sub-scheme (...) (‘an epistemic authority _A_ _E_ asserts a proposition _P_’), we apply a meta-level approach to specifying critical questions. Results improve the evaluation of this sub-scheme and show how similar improvements are obtainable for other schemes. (shrink)

The common cause principle states that correlations have prior common causes which screen off those correlations. I argue that the common cause principle is false in many circumstances, some of which are very general. I then suggest that more restricted versions of the common cause principle might hold, and I prove such a restricted version.

Nearly a decade ago, Ingrid Robeyns formulated a distributive justice doctrine known as economic limitarianism. This article posits that Robeyns’ limitarianism is a politically plausible, practically feasible and morally justifiable doctrine. The doctrine effectively addresses concerns regarding incentives, efficacy and unequal opportunities. The article identifies a problem of scope or extensity, which it refers to as an asymmetric argument. The article proposes that this issue can be resolved by fully extending limitarianism to non-democratic states. This extension is justified by the (...) relationship between surplus money and political inequality, which can be explained through various avenues, including causal and constitutive explanations, structural injustice and systemic causation. While this list of avenues is not exhaustive, it is representative of the possible avenues that can be explored. Fully extending the doctrine to non-democratic states would enhance its robustness. Moral puzzles about actions which bring about very small or what are said to be imperceptible harms or benefits for each of a large number of people are well known. Less well known is an argument by Warren Quinn that standard theories of rationality can lead an agent to end up torturing himself or herself in a completely foreseeable way, and that this shows that standard theories of rationality need to be revised. The two envelope paradox can be dissolved by looking closely at the connection between conditional and unconditional expectation and by being careful when summing an infinite series of positive and negative terms. The two envelope paradox is not another St. Petersburg paradox and that one does not need to ban talk of infinite expectation values in order to dissolve it. The article ends by posing a new puzzle to do with infinite expectations.

The frequencies with which photons pass through half-silvered mirrors in the forward direction of time is always approximately 1/2, whereas the frequencies with which photons pass through mirrors in the backward direction in time can be highly time-dependent. I argue that whether one should infer from this time-asymmetric phenomenon that time has an objective direction will depend on one's interpretation of quantum mechanics.

According to Michael Rescorla’s recent defense of dialectical egalitarianism reasoned discourse lacks a foundational structure, but saves the foundational intuition that some propositions are basic. On this view, I may select the reasons forwarded in support of a claim according to their being accepted by particular communities/audiences. I discuss the epistemic risk of doing so, and clarify if Rescorla’s is an epistemic approach in disguise.

This paper discusses an example of social policy argumentation from an opinion of the 2007 majority among the German National Ethics Council. It is employed to problematize argument reconstruction with respect to the Informal Logic quality criteria relevance, sufficiency, acceptability. The main thesis is conditional and rather weak: If the RSA criteria are sub-stitutes for the notion of soundness, then—next to premise-truth and validity—they also substitute recon-structive charity.

According to German theorists historicism was the result of a dynamization of the static world-view of the Enlightenment. According to contemporary Anglo-Saxon theorists historicism resulted from a de-rhetoricization of Enlightenment historical writing. It is argued that, contrary to appearances, these two views do not exclude but support each other. This can be explained if the account of change implicit in Enlightenment historical writing is compared to that suggested by historicism and, more specifically, by the historicist notion of the "historical idea." Motivated by Hoff and Stiglitz’s :753–763, 2004) theory, we examine empirically how the creation of “rules of the game” affect the behavior of economic agents in a transition economy. Using a sample of Chinese state-owned enterprises in which controlling ownership was transferred to private acquirers between 1994 and 2006, we find that the post-privatization performance of firms depends on institutional factors. Before 2003, we observe severe post-privatization tunneling behaviors by acquirers and worse PPP. However, from 2003, when the State issued (...) regulations against tunneling and strengthened enforcement, the incidence of tunneling behaviors declined, and PPP improved. We find that better implementation of ownership transfer and longer prior experience of private acquirers are key factors that contribute to the improvement. (shrink)

O'Keeffe, Frank A recent report tabled in the Victorian Parliament has proposed that the Victorian Crimes Act 1958 be amended, allowing Victoria to become the only Australian state where euthanasia would be legal. Against this proposed legislation, this article contends the suggested amendments pose a threat to the fiduciary obligations that medical professionals owe to their patients. Moreover, that the parliamentary recommendation poses a considerable risk to the sick and dying, while creating tension within existing, currently overburdened, palliative care (...) services. Any reforms that seek to treat dying patients in a more holistic manner, incorporating their emotional equilibrium, will instead make further provision for expanding the provision of palliative care services. Im Medizin- und Care-Diskurs zielt die Frage, wie mit Patientinnen zu kommunizieren sei, oft auf eine normativ-ethische Ebene. Dementgegen soll hier eine eher auf die epistemologische Ebene gerichtete Untersuchung der Gesprächssituation in der Diagnosestellung geleistet werden. Die Erörterung verläuft entlang der existenziellen Philosophien von Gabriel Marcel und Martin Buber. Dabei zeigt sich, dass es drei Ebenen gibt, die das Arztgespräch bestimmen. Auf der ersten Ebene befindet sich die meist asymmetrische sachliche Kommunikationssituation über medizinische und biochemische Zusammenhänge. Hier tritt die Ärztin (...) als Expertin auf. Als zweite Ebene kann man die existenziell-dialogische Situation der Begegnung zweier Menschen ausmachen. Hier besteht eine völlige Symmetrie, da die Begegnung bei Buber und Marcel nicht an besondere Einrichtungen, wie zum Beispiel Fürsorge, gebunden ist. Die dritte Ebene kehrt das ‚Machtverhältnis‘ – so man diesen Begriff nutzen will – um: Die Patientin hat, indem sie sich in einer Grenzsituation befindet, einen Wissens- und Handlungsraum, der dem der Ärztin überlegen ist. Als Betroffene kann sie beispielsweise eine mögliche Therapie ablehnen, während die Ärztin eine indizierte Therapie nicht verweigern darf. Die genaueren Lektüren Marcels und Bubers lassen weiterhin deutlich werden, wie tiefgreifend die Vorbehalte der Dialogphilosophie gegenüber Institutionen und deren Normen sind. Die Idee des informierten Einverständnisses, welche die medizinethische Debatte dominiert, erweist sich aus Bubers Perspektive als brüchig, wo affektive Innerlichkeit lediglich ein Spiegel der äußerlichen Einrichtungen ist. Der Begriff der Hoffnung wird schließlich herangezogen, um den besonderen Handlungsraum der Ärztin aus der Perspektive der Dialogphilosophie zu konkretisieren. (shrink)

Saadya ben Joseph al-Fayyumi, gaon of the rabbinic academy at Sura and one of the preeminent Jewish thinkers of the medieval period, attempted to create a complete statement of Jewish religious philosophy in which all strands of philosophical thought were to be knit into a unified system. In _The Book of Doctrines and Beliefs_, Saadya sought to rescue believers from "a sea of doubt and the waters of confusion" into which they had been cast by Christianity, Islam, and other faiths. (...) By employing philosophical--or kalamic--argumentation to examine and defend traditional Jewish beliefs, Saadya hoped to turn blind faith into conviction based on rational understanding. First published in 1946, and reprinted here without alteration, Alexander Altmann’s judicious abridgment of his own translation has remained the standard edition of this influential work.
