Legal precedent, professional‐society statements, and even many medical ethicists agree that some situations may call for a clinician to engage in an act of lying or nonlying deception of a patient or patient's family member. Still, the moral terrain of clinical deception is largely uncharted, and when it comes to practical guidance for clinicians, many might think that ethicists offer nothing more than the rule never to deceive. This guidance is insufficient to meet the real‐world demands of clinical practice, and (...) this article endeavors to articulate a framework to help clinicians better navigate the ethics of clinical deceit. The framework articulates four morally relevant dimensions of a potential deceptive act that should be examined to better determine the moral justification that might be required: the target of the act, the nature of the information, the nature of the act, and the context of the act. Frank Ramsey was the greatest of the remarkable generation of Cambridge philosophers and logicians which included G. E. Moore, Bertrand Russell, Ludwig Wittgenstein and Maynard Keynes. Before his tragically early death in 1930 at the age of twenty-six, he had done seminal work in mathematics and economics as well as in logic and philosophy. In accordance with standards published by the American Society for Bioethics and Humanities (ASBH), ethics consultants are expected to provide recommendations that align with scholarly literature, professional society statements, law, and policy. However, there are no studies to date that characterize the specific references that ethics consultants and educators use to inform their work. To address this gap, a convenience sample of clinical ethics consultants and educators was surveyed online through two major listservs for clinical ethics, the ASBH Clinical Ethics (...) Consultation Affinity Group (CECAG) and the Association of Bioethics Program Directors (ABPD). Ninety-five ethics consultants and/or educators with diverse educational background, credentials, and experience provided responses. In total, 451 references, 315 of which were unique, were reported. These references were broken into 6 categories after analysis: bioethics literature (divided into articles and books), professional society documents (divided into professional society statements and codes of ethics), federal/state/uniform/case law, hospital/health system policies, official religious teachings, and other. We found extensive variation and minimal overlap in the references respondents used for ethics consultation and education, even when referring to the same topics. Future research directions should include conducting more systematic efforts to characterize the references used by ethics consultants across the US; determining whether demographic characteristics of consultants influence the references used; and ascertaining whether the variation in references used reflects genuine disagreements in consultants’ and educators’ bioethical analysis or recommendations. Frank Palmeri sees the conjectural histories of Rousseau, Hume, Herder, and other Enlightenment philosophers as a template for the development of the social sciences in the nineteenth and early twentieth centuries. Without documents or memorials, these thinkers, he argues, employed conjecture to formulate a naturalistic account of society's commercial and secular progression. This approach can be traced in the work of political economists, anthropologists, sociologists, and sociologists of religion, and its speculative framework creates a surprising ambivalence toward modernity in (...) these disciplines. Ethnic nepotism theory predicts that even in times of communal peace altruism is more pronounced within than between ethnic groups. The present study tested the hypothesis that altruism in the form of alms giving would be greater within than between ethnic groups, and greater between more closely related groups than between more distant groups. The three groups chosen for study were ethnic Russians, Moldavians, and Gypsies. Russians are genetically closer to Moldavians than to Gypsies. Observations were made of 128 ethnic (...) Russian, 25 Moldavian, and 25 Gypsy beggars receiving gifts from ethnic Russians in Moscow trains. The Gypsies were mainly girls, contrary to the Russian sample. Multivariate analysis identified three main strategies: active, personified, and appeasing-undirected. Russian strategies were most variable. Gypsies presented strong charity releasers: 84% were children who played music and sang and showed appeasing-undirected behavior. The few adults were highly submissive or friendly. Nevertheless, their success was limited compared with that of ethnic Russians despite the latter’s demanding behavior and their being mostly mature or elderly persons. Moldavians received an intermediate amount of charity. The hypothesis was supported. (shrink)

This essay focuses on the historical text as a whole. It does so by conceiving of the historical text as representation - in the way the we may say of a photo or a painting that it represents the person depicted on it. It is argued that representation cannot be properly understood by modelling it on true description. So all the central questions asked since the days of Frege with regard to how the true statement relates to the world must (...) be asked anew, if we wish to understand how a historical representation relates to what it is about. Three claims are made. In the first place, representation is not a two-place but a three-place operator: apart from a representation (say, a book on Napoleon) and what the representation represents (Napoleon himself), a representation also indicates an aspect of represented reality (an aspect of Napoleon). The second claim is that this notion of the aspect is crucial for a proper understanding of (historical) representation. Thirdly, it is argued that traditional theories of reference cannot account for the relationship between a representation and the aspect indicated by it. (shrink)

The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Nous essayons ici de presenter les éléments fondamentaux de l'ontologie de l'aš‘arisme classique. Pour quelques expressions, il a fallu examiner la lexicographie et ordinaire et technique pour bien comprendre leur emploi et leur signification. This chapter considers the establishment freedom, concentrating on three aspects where recent European Court of Justice decisions have appeared to enlarge its scope but have also left unsolved questions on particular aspects. First, it looks at the nature of the establishment freedom, distinguishing it from the other freedoms, in particular the right to provide services and free movement of capital. Second, the chapter examines who are the beneficiaries of the right of establishment and, in particular, the position of legal persons, (...) companies, where harmonization of member states' company laws has achieved results but has not solved all problems. Finally, it addresses the question of which parties are obliged by the treaty to respect the right of establishment and considers a 2007 judgment, Viking, which, with the Laval decision concerning services, caused much criticism. Summary In the science-religion debate, both scientific and theological approaches suffer from an abstract conception of time and history. This is epitomised by evolution theory and by theological trends trying to match it with biblical and Christian doctrines. On the one hand, thinking in millions of years voids time of any sensible meaning; on the other hand, thinking Darwin and the Bible together compromises both in regards to history. The notion of the “imaginary”, drawn from Charles Taylor’s A Secular Age, (...) helps to circumscribe some of the hermeneutical gaps involved, and enables a more nuanced assessment of the respective claims made in the debate. The “Imaginary” points to the necessity of reflecting on the status of one’s own thought in regard to the past. In that sense, both evolution theory and evolution theology are confined to what one may call the “modern imaginary”. An example of the mismatch between evolution theory and Christian doctrine is found in Alvin Plantinga. As the debate largely hinges on hermeneutics, this contribution is part of a broader endeavour to redefine hermeneutics as an ethics. (shrink)

Working on a biography of his predecessor Erwin Rohde, Otto Crusius approached historical theologian Franz Overbeck, who was one of Rohde’s best friends. Overbeck sent Crusius copies of most of the letters he had received from Rohde, and Crusius used them for his book, which was published early 1902 and still is the best biographical work on Rohde. In the spring of 1902 Crusius visited Overbeck in Basel, and Overbeck in particular came to value their acquaintance. Their correspondence, stretching from (...) 1901 until Overbeck’s death in 1905, contains important personal and substantial views on Rohde, his relationship with Nietzsche, as well as on philological and literary topics, including Overbeck’s feud with Elisabeth Förster-Nietzsche, Nietzsche’s sister.
