Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. Talking of “medieval aesthetics” is historiographically disputable. During the Middle Ages, in fact, there is no discipline comparable with the aesthetics as from the eighteenth century we know it. In the medieval period, aesthetic considerations mostly occur in spurious contexts, and are all, so to say, pre-theoretical. They refer to different insights on what is the beautiful and what relationship holds between the beauty and its artistic expression. In the Middle Ages, that is, one can frequently encounters forms we would (...) nowadays call of descriptive aesthetics, occasionally forms of normative aesthetics, rather sporadically meta-aesthetic considerations. Not even a privileged attention is reserved to aesthetics understood as the description of the conditions of pleasure that follow from the perception of the beautiful, despite the theme of dilectum is important in the aesthetic meditations of medieval masters. Aesthetic discussions predominantly concern the relationships between the artist, an object and its representation. In this essay, I reconsider these relationships by discussing a key point of Thomas Aquinas’s reflection on the beauty: the role played by of the notion of representation in the explanation of the artistic process. The purpose of this paper is to analyze the structure and the defeasibility conditions of argument from analogy, addressing the issues of determining the nature of the comparison underlying the analogy and the types of inferences justifying the conclusion. In the dialectical tradition, different forms of similarity were distinguished and related to the possible inferences that can be drawn from them. The kinds of similarity can be divided into four categories, depending on whether they represent fundamental semantic features of the (...) terms of the comparison or non-semantic ones, indicating possible characteristics of the referents. Such distinct types of similarity characterize different kinds of analogical arguments, all based on a similar general structure, in which a common genus is abstracted. Depending on the nature of the abstracted common feature, different rules of inference will apply, guaranteeing the attribution of the analogical predicate to the genus and to the primary subject. This analysis of similarity and the relationship thereof with the rules of inference allows a deeper investigation of the defeasibility conditions. (shrink)

The fields of linguistic pragmatics and legal interpretation are deeply interrelated. The purpose of this paper is to show how pragmatics and the developments in argumentation theory can contribute to the debate on legal interpretation. The relation between the pragmatic maxims and the presumptions underlying the legal canons are brought to light, unveiling the principles that underlie the types of argument usually used to justify a construction. The Gricean maxims and the arguments of legal interpretation are regarded as presumptions subject (...) to default used to justify an interpretation. This approach can allow one to trace the different legal interpretive arguments back to their basic underlying presumptions, so that they can be compared, ordered, and assessed according to their defeasibility conditions. This approach allows one to understand the difference between various types of interpretive canons, and their strength in justifying an interpretation. (shrink)

Modus ponens is the argument from premises of the form If A, then B and A to the conclusion B. Nearly all participants agree that the modus ponens conclusion logically follows when the argument appears in this Basic form. However, adding a further premise can lower participants’ rate of agreement—an effect called suppression. We propose a theory of suppression that draws on contemporary ideas about conditional sentences in linguistics and philosophy. Semantically, the theory assumes that people interpret an indicative conditional (...) as a context-sensitive strict conditional: true if and only if its consequent is true in each of a contextually determined set of situations in which its antecedent is true. Pragmatically, the theory claims that context changes in response to new assertions, including new conditional premises. Thus, the conclusion of a modus ponens argument may no longer be accepted in the changed context. Psychologically, the theory describes people as capable of reasoning about broad classes of possible situations, ordered by typicality, without having to reason about individual possible worlds. The theory accounts for the main suppression phenomena, and it generates some novel predictions that new experiments confirm. (shrink)

The representation and classification of the structure of natural arguments has been one of the most important aspects of Aristotelian and medieval dialectical and rhetorical theories. This traditional approach is represented nowadays in models of argumentation schemes. The purpose of this article is to show how arguments are characterized by a complex combination of two levels of abstraction, namely, semantic relations and types of reasoning, and to provide an effective and comprehensive classification system for this matrix of semantic and quasilogical (...) connections. To this purpose, we propose a dichotomous criterion of classification, transcending both levels of abstraction and representing not what an argument is but how it is understood and interpreted. The schemes are grouped according to an end-means criterion, which is strictly bound to the ontological structure of the conclusion and the premises. On this view, a scheme can be selected according to the intended or reconstructed purpose of an argument and the possible strategies that can be used to achieve it. (shrink)

In this study I aim at providing a new assessment of Ockham’s proof for God’s existence. After reconstructing Ockham’s views of the relationship between philosophy and theology , I move to examining Ockham’s criticism to some traditional arguments , before to scrutinizing closely Ockham’s argument. My main conclusion is that Ockham did not want to elaborate a new proof but to qualify the proof stemming from efficient causality, which he considers the only available way of demonstrating God’s existence.

This paper makes the two following claims: 1) The legal dimension of loyalty within organizations goes beyond duties. The governance design aimed at ensuring loyalty may strongly affect standards that characterize each layer of the organization. The interaction between standards of duty and the governance dimension of loyalty should, therefore, be more tailored to specific legal forms and their functional correlation with ownership and financing. 2) There is a greater divergence than has so far been acknowledged between the function of (...) loyalty in vertically integrated firms and in networks of small firms. This difference, created by the relationship between the duty and the governance dimensions, should have repercussions on the definitions of legal standards. In particular, it should reflect the different relationships between hierarchy, monitoring, and loyalty and the choice between prohibitory, authorization-based, and compensatory rules. The analysis concentrates on the key variables that may affect the choice between vertical and horizontal monitoring to ensure compliance with loyal behavior in two polar models: hierarchical firms and networks of small firms. It reveals the importance of considering the governance design when defining duties of loyalty and related standards to evaluate party-related transactions in both cases but, at the same time, the necessity of using different interpretive categories. Haptic object recognition is usually an efficient process although slower and less accurate than its visual counterpart. The early loss of vision imposes a greater reliance on haptic perception for recognition compared to the sighted. Therefore, we may expect that congenitally blind persons could recognize objects through touch more quickly and accurately than late blind or sighted people. However, the literature provided mixed results. Furthermore, most of the studies on haptic object recognition focused on performance, devoting little attention to the (...) exploration procedures that conducted to that performance. In this study, we used iCube, an instrumented cube recording its orientation in space as well as the location of the points of contact on its faces. Three groups of congenitally blind, late blind and age and gender-matched blindfolded sighted participants were asked to explore the cube faces where little pins were positioned in varying number. Participants were required to explore the cube twice, reporting whether the cube was the same or it differed in pins disposition. Results showed that recognition accuracy was not modulated by the level of visual ability. However, congenitally blind touched more cells simultaneously while exploring the faces and changed more the pattern of touched cells from one recording sample to the next than late blind and sighted. Furthermore, the number of simultaneously touched cells negatively correlated with exploration duration. These findings indicate that early blindness shapes haptic exploration of objects that can be held in hands. (shrink)

Every discipline poses its research questions in specific ways and thus uses concepts that are suited to find answers in its well defined disciplinary frameworks. Accordingly, the idea of cultural trait has been used and developed in several disciplines, often without any reference to each other. The result has often been non-communicability across different fields. We first show, by means of two examples, that the lack of deep interdisciplinary dialogue and reciprocal understanding has generated some harsh controversies. We argue that (...) our book Understanding Cultural Traits: A Multidisciplinary Perspective on Cultural Diversity tries to overcome not only the gap between cultural traits specialists and other scientists, but also the barriers among the researchers who are not specialists on cultural traits but that nevertheless directly or indirectly use cultural traits in their different disciplines. This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. This paper motivates and develops a novel semantic framework for deontic modals. The framework is designed to shed light on two things: the relationship between deontic modals and substantive theories of practical rationality and the interaction of deontic modals with conditionals, epistemic modals and probability operators. I argue that, in order to model inferential connections between deontic modals and probability operators, we need more structure than is provided by classical intensional theories. In particular, we need probabilistic structure that interacts directly (...) with the compositional semantics of deontic modals. However, I reject theories that provide this probabilistic structure by claiming that the semantics of deontic modals is linked to the Bayesian notion of expectation. I offer a probabilistic premise semantics that explains all the data that create trouble for the rival theories. (shrink)

Contrastivists view ought-sentences as expressing comparisons among alternatives. Deontic actualists believe that the value of each alternative in such a comparison is determined by what would actually happen if that alternative were to be the case. One of the arguments that motivates actualism is a challenge to the principle of agglomeration over conjunction—the principle according to which if you ought to run and you ought to jump, then you ought to run and jump. I argue that there is no way (...) of developing the actualist insight into a logic that invalidates the agglomeration principle without also invalidating other desirable patterns of inference. After doing this, I extend the analysis to other contrastive views that challenge agglomeration in the way that the actualist does. This motivates skepticism about the actualist’s way of challenging agglomeration. (shrink)

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. In contemporary discussions of abortion, both sides argue well-worn positions, particularly concerning the question, When does human life begin? Though often invoked by the Catholic Church for support, Thomas Aquinas in fact held that human life begins after conception, not at the moment of union. But his overall thinking on questions of how humans come into being, and cease to be, is more subtle than either side in this polarized debate imagines. Fabrizio Amerini--an internationally renowned scholar of medieval philosophy--does (...) justice to Aquinas's views on these controversial issues. Some pro-life proponents hold that Aquinas's position is simply due to faulty biological knowledge, and if he knew what we know today about embryology, he would agree that human life begins at conception. Others argue that nothing Aquinas could learn from modern biology would have changed his mind. Amerini follows the twists and turns of Aquinas's thinking to reach a nuanced and detailed solution in the final chapters that will unsettle familiar assumptions and arguments. Systematically examining all the pertinent texts and placing each in historical context, Amerini provides an accurate reconstruction of Aquinas's account of the beginning and end of human life and assesses its bioethical implications for today. This major contribution is available to an English-speaking audience through translation by Mark Henninger, himself a noted scholar of medieval philosophy. (shrink)

In 1682, Nehemiah Grew included An Idea of a Philosophical History of Plants as the first text in his Anatomy of Plants. The former consists of a broad programme to study vegetation from a material standpoint. In addition to the mechanical and chymical investigation of plants, generally supported by microscopic observations—a core methodology of the Royal Society—in the text Grew engaged with some more philosophical and theoretical issues. Still, despite Grew's creditable attempt to produce a coherent and comprehensive science of (...) plants, the absence of a definition of vegetable life has an impact on his ability to understand plants in their own right. For instance, a few questions that emerged as Grew addressed zoophytes and other bodies blurred the line between vegetables and animals. Only in the Cosmologia sacra (1701) did Grew propound a definition of vegetable life with a more complete schema. Is the philosophy of plants a bridge between Grew's works? In this article, I contextualize his philosophical approach, explore the features of his text, and advance the possibility of answering this question positively, although the significant distance between Grew's experimental study of plants in the Anatomy and the physico-theology of the Cosmologia makes a connection between the two texts difficult. In the end, this unbridgeable gulf broadly shaped early modern botanical studies. (shrink)

In the history of ideas, innumerable attempts to explain life and to define living activities have invoked the notion of the soul. Yet this theoretical entity seems to be an unfathomable thing. Difficulties beset the mere definition of it, and controversies span from whether the soul is a material body or an immaterial form, an immortal or a mortal thing, a subject of experiential or of theoretical knowledge, to the question of whether it is the subject of a specific discipline (...) or rather of a scientia de anima that, in the Aristotelian tradition, was also regarded as a part of natural philosophy—the field of philosophy that deals with natural particulars. Not only was the soul thought, from a theological angle, to define the unity and unicity of living beings, but it was also seen as the source of several bodily activities such as nutrition and growth in living beings. And since some of the beings that grow and nourish themselves also sense and think, the relation of the origin of vegetative powers to the origin of perceptual and intellectual powers has always been an object of debate. In this sense, the soul has not just been a topic of one specific field, but has rather drawn upon many disciplines, combining the work of philosophers, religious thinkers, physicians, naturalists, chymists, and so on, thereby blurring the boundaries between different fields of knowledge. Botanical treatises of the Renaissance, for example, begin with the definition of the soul of plants and its primary role in bringing forth vegetal activities. Indeed, the presence of the soul was thought to be involved also in the life of animals, human beings, and, in some cases, it was even ascribed to minerals and stones, not to speak of the world-soul, the latent idea that the entire cosmos is animated with a soul. Furthermore, the theory of the materiality of the soul was developed since Antiquity and found new momentum in early modern times, in the reappraisal of Epicurean ideas by thinkers such as Guillaume Lamy, Pierre Gassendi, and Julian Offray de La Mettrie. Yet, with the Cartesian Henricus Regius, the understanding of vegetative, sensitive, and rational souls as material importantly surfaces as a peculiar attempt to mechanize the living functions of bodies. Per la prima volta gli inni sono sistematicamente tradotti, introdotti e annotati dallo stesso filologo curatore dell'edizione critica, e la medesima unità di intenti guida anche la compilazione dell'apparato delle varianti, rendendo al lettore un servigio inestimabile». Ma (...) poiché la prematura scomparsa dello studioso, al quale Maisano riconosce «appassionata adesione alla materia» e «signorile onestà intellettuale» (I, p. 75), impedì che l'opera venisse portata a termine, la presente risulta essere la prima edizione criticamente rivista, tradotta e commentata in modo completo: oltre ai 59 contaci di sicura attribuzione, essa comprende in appendice anche alcuni carmina dubia (83, 84, 87 Maas-Trypanis), nonché l'Inno acatisto, che sicuramente non può essere assegnato al Melodo (II, p. 580), ma del quale è ristampata la traduzione di Carlo Del Grande (Firenze 1948), proprio per documentare «la differenza anche stilistica fra questo componimento e i cantici di Romano» (II, p. 581). Mathematical modeling can ground communication and reciprocal enrichment among fields of knowledge whose domains are very different. We propose a new mathematical model applicable in biology, specified into ecology and evolutionary biology, and in cultural transmission studies, considered as a branch of economics. Main inspiration for the model are some biological concepts we call “eco-phenotypic” such as development, plasticity, reaction norm, phenotypic heritability, epigenetics, and niche construction. “Physiology” is a core concept we introduce and translate differently in the biological and (...) cultural domains. The model is ecological in that it aims at describing and studying organisms and populations that perform living, intended as a thermodynamic, matter-energy process concerning resources gathering, usage, and depletion in a spatiotemporal context with given characteristics, as well as with multiplication and space occupation. The model also supports evolution, intended as a dynamics including cumulative change in the features of unique organisms that are connected into breeding populations. The model is then applicable to the economics of cultural transmission in which individuals form their attitudes and patterns of behavior under a complex system of influences derived from their “cultural parents”, other members of the society, and the environment. On the side of biology, an innovative goal is to integrate in a single model all the eco-phenotypic concepts as well as both evolution and ecology. On the side of cultural transmission, eco-phenotypic modeling seems more appropriate in capturing some aspects of cultural systems which are modeled away in the earlier framework based on Mendelian population genetics. Reasoning from negative evidence takes place where an expected outcome is tested for, and when it is not found, a conclusion is drawn based on the significance of the failure to find it. By using Gricean maxims and implicatures, we show how a set of alternatives, which we call a paradigm, provides the deep inferential structure on which reasoning from lack of evidence is based. We show that the strength of reasoning from negative evidence depends on how the arguer defines (...) his conclusion and what he considers to be in the paradigm of negated alternatives. If we negate only two of the several possible alternatives, even if they are the most probable, the conclusion will be weak. However, if we deny all possible alternatives, the reasoning will be strong, and even in some cases deductively valid. (shrink)

This paper explores two non-standard supermajority rules in the context of judgment aggregation over multiple logically connected issues. These rules set the supermajority threshold in a local, context sensitive way—partly as a function of the input profile of opinions. To motivate the interest of these rules, I prove two results. First, I characterize each rule in terms of a condition I call ‘Block Preservation’. Block preservation says that if a majority of group members accept a judgment set, then so should (...) the group. Second, I show that one of these rules is, in a precise sense, a judgment aggregation analogue of a rule for connecting qualitative and quantitative belief that has been recently defended by Hannes Leitgeb. The structural analogy is due to the fact that Leitgeb sets thresholds for qualitative beliefs in a local, context sensitive way—partly as a function of the given credence function. (shrink)

The theology of Pier Damiani († 1072) is still an understudied theme in his scholarship, in particular, for what it concerns his Trinitarian and Christological doctrines. The aim of this study is to reconstruct and discuss especially Damiani’s Christological views as formulated in Letter 81, better known as his De fide catholica. It is argued that Damiani’s approach is mostly exegetical, as he mainly points to and comments on Biblical passages in support of Catholic doctrines. Still, he assumes a peculiar (...) method of investigation, as he devotes the main body of the Letter to the question of the correct understanding (recta intelligentia) of the Catholic interpretation of Christology, and reserves only the final summary to a discussion of Biblical authorities. Eventually, it is argued that despite Damiani’s attempts at clarifying the matter, he acknowledges an inherent difficulty in explaining how it is possible that God became man without truly assuming the person of man, and, if He did so, how this did not give rise to two, however indistinct, persons or hypostases. The concept of ‘co-union’ of human and divine natures, introduced by Damiani, makes the simultaneous unity and distinction of the two natures intuitively clear, but it remains a concept that is not clarified in all its details and implications. In this paper we present an analysis of persuasive definition based on argumentation schemes. Using the medieval notion of differentia and the traditional approach to topics, we explain the persuasiveness of emotive terms in persuasive definitions by applying the argumentation schemes for argument from classification and argument from values. Persuasive definitions, we hold, are persuasive because their goal is to modify the emotive meaning denotation of a persuasive term in a way that contains an implicit argument from values. However, our (...) theory is different from Stevenson’s, a positivistic view that sees emotive meaning as subjective, and defines it as a behavioral effect. Our proposal is to treat the persuasiveness produced by the use of emotive words and persuasive definitions as due to implicit arguments that an interlocutor may not be aware of. We use congruence theory to provide the linguistic framework for connecting a term with the function it is supposed to play in a text. Our account allows us to distinguish between conflicts of values and conflicts of classifications. (shrink)

Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. This book will appeal to scholars in the fields of political communication, communication in general, argumentation theory, rhetoric and pragmatics, as well as to people working in public speech, speech writing, and discourse analysis. There are emotively powerful words that can modify our judgment, arouse our emotions and influence our decisions. This paper shows how the use of emotive meaning in argumentation can be explained by showing how their logical dimension, which can be analysed using argumentation schemes, combines with heuristic processes triggered by emotions. Arguing with emotive words is shown to use value-based practical reasoning grounded on hierarchies of values and maxims of experience for evaluative classification.
