This article explores the construction of offences as ‘accidental’ in police-suspect interactions. The data comprise audio-recorded investigative interviews, which were analysed using conversation analysis. In these interviews, suspects often do not explicitly state the nature of their defence when answering police officers’ questions; instead, suspects’ defensive practices or techniques are embedded in the narrative accounts they give of what happened, thus exhibiting rather claiming their ‘innocence’. My focus here is on a particular type of defence, namely, one in which suspects (...) portray an event as having been ‘accidental’. I show that this defence of ‘accident’ is associated with several discourse features including: building a plausible and trivial context in which the untoward incident occurred, describing the untoward action or series of actions, using impersonal or agentless constructions, and representing the disproportionality between the putative victim’s reaction and the aggressor’s untoward conduct. The accountability of these descriptions, however, does not rely on one unique feature, but rather on suspects’ ability to combine these features in such a way that each establishes the grounds for others. ABSTRACT I present a new model of the self-regulation of virtue that integrates perspectives on emotion, cognition, and motivation. Across three vignette-based studies in US/uk (N = 1,540), I developed through exploratory and confirmatory factor analysis a multi-item measure of broadening and defensive responses, the Self-Regulation of Virtue Inventory (SRVI). I applied that measurement model to two new scenarios portraying prototypical moral exemplars (selected from a set of 12) and fitted structural models that identify key antecedents: motivational dispositions (regulatory focus (...) and hedonic orientation) and moral comparisons (opinion- and ability-based). The findings were consistent with network analysis, providing initial evidence of their robustness. By integrating literatures on motivation, emotion, social cognition and comparison within a self-regulation framework, I provide initial evidence to advance theory on moral self-regulation and moral education, with practical implications on how to maximise the upsides of virtue while mitigating or channelling its possible drawbacks. BackgroundDefinition and concept of the ‘beginning of human life’ are weakened by co-existing contrasting hypotheses based on humanistic or religious beliefs rather than scientific foundations. This plethora of conceptually distant views have important common concerns in different fields of science and shape, in turn, several societal aspects including laws related, for instance, to inheritance eligibility or abortion, end-of-life care and euthanasia, and reproductive technology. Also, they are fundamental to evaluate opportunity for resuscitation vs. palliative care in extremely preterm infants. In (...) this article, we address one of the most common tenets in medicine: the acceptance that human life starts with first breath, even though several events are well-documented to take place before its occurrence.Main textSeveral studies show how pivotal physiological events take place before first breath. Evidence of a number of neurological events occurring before first breath opens the way to the primacy of the Central Nervous System, given its immediate extra-uterine activation at birth. This activation eventually sets specific physiological conditions that allow the complex sequence of events determining the muscle activity associated with the influx of air in the lung and the settling of a continuous and successful extra-uterine respiration. We would like to invite the scientific community to endorse a clear-cut position against the paradigm of ‘first breath’ as the beginning of life. Herein, we also assume how, a still undefined, yet possibly specific quid in the external environment triggers further physiological response in newborns. Better understanding of the critical events that occur at the beginning of human life is likely to cause great concern and expectations in scientists, researchers and physicians working in the domain of brain, and its physiology, and mental health.ConclusionsThe comparison between beliefs and evidence-based observations generates confusion, misperceptions and false expectations in society, hence, in the scientific and medical community. Different and more solid alternatives about the carachterization of the ‘beginning of human life’ are indeed available and require to be explored and defined. (shrink)

Riassunto: In una prospettiva naturalistica, lo studio della religione presenta subito un punto problematico: se essa è così diffusa, tanto da apparire un tratto inscritto nella natura umana, ciò significa che la religione comporta dei vantaggi adattivi o, quantomeno, significa che essa non comporta svantaggi tali da ostacolare la sopravvivenza di chi la pratica. Nel primo caso, si tratta di individuare la possibile funzione della religione, ovvero una qualche utilità che ne giustificherebbe il suo permanere nella storia umana. Alla luce (...) di un modello antropologico che vede l’identità soggettiva segnata da una fragilità ontologica, in questo articolo offriremo una particolare versione della tesi che assegna alla religione, quale byproduct, una funzione positiva, ipotizzando quella che potrebbe essere una sua utilità nella difesa dell’unità dell’autocoscienza. Sarà dunque sulla religione quale insieme di tecniche difensive del self che concentreremo la nostra indagine. In the former case, we need to understand the function of religion, viz. a utility it confers that may justify its persistence across human history. Against the backdrop of an anthropological model that considers subjectivity identity to be characterized by ontological fragility, this article will offer a special version of the claim that religion, viewed as a byproduct, has a positive function: we will make the hypothesis that it contributes to the defense of the unity of self-consciousness. Thus our focus will be on religion construed as a repertoire of strategies designed to protect the self. Desde los remotos tiempos de la tragedia Ática en Grecia, el teatro es y ha sido siempre movimiento, siendo este una característica esencial de los seres orgánicos, es decir, de los dotados de vida. No obstante, se corre el riesgo de reemplazar su mecánica natural con metafísica, cuando ello no es coherente ni siquiera en hipótesis. Cabe demostrar las disimilitudes del teatro con las doctrinas escolásticas, idealistas, o hinduistas, y su compatibilidad con los átomos, electrones y las leyes de la (...) física, sometiendo sus conceptos al rigor epistemológico. La creación artística nace del psiquismo humano, aun no siendo material en primera instancia, pero ya luego cobra su forma cualitativa definitiva. Para ello atraviesa por varios tipos de censura, tanto física como psicológica, buscando expresarse mediante el lenguaje en que se comunican los distintos géneros dramáticos, dando a conocer su situación de crisis sin retorno, esa que se debate entre crueldad y violencia. Antonin Artaud intrinca al teatro las ideas cabalísticas y no busca contrastarlas con argumentación lógica. La evidencia demuestra que, si es que hay una unidad, esa es la del teatro con lo físico. Lo físico es su verdadero “doble”. Un sucinto pero conciso repaso histórico, bien prodigado de documentación y basado en los preceptos erigidos por el materialismo dialectico, nos dará la certeza de que el teatro pertenece exclusivamente al mundo físico, no solo en la práctica, sino también en esencia, y esta es la materia, siendo solo la metafísica un estadio improbable dentro de ella. Alejandro Tomasini ha indicado, muy lúcidamente, la necesidad de pensar los problemas filosóficos en lengua castellana. Más aún, ha sugerido que es posible tratar los problemas propios de la filosofía analítica por medio de la lengua castellana y que, por otra parte, es necesario en nuestro continente pensar los problemas y enfrentarlos analíticamente. Independientemente de su alcance teórico, el mérito del libro que presentamos, Lecturas analíticas: una introducción a temas y problemas de la filosofía analítica, apunta a esa dirección.

For three decades Frank Cioffi has been at the center of the debate over Freud's legacy and the legitimacy of psychoanalysis.

In hisStudy of War, Q. Wright considered a model for the probability of warP during a period ofn crises, and proposed the equationP=1– n, wherep is the probability of war escalating at each individual crisis. This probability measure was formally derived recently by Cioffi -Revilla, using the general theory of political reliability and an interpretation of the n-crises problem as a branching process. Two new, alternate solutions are presented here, one using D. Bernoulli''s St. Petersburg Paradox as an analogue, (...) the other based on the logic of conditional probabilities. Analysis shows that, while Wright''s solution is robust with regard to the general overall behavior ofp andn, some significant qualitative and quantitative differences emerge from the alternative solutions. What is it that troubles and preoccupies us about the anxieties and anguishes of social and private life? Have advances in the disciplines of psychoanalysis, psychology or the social sciences in general ministered to our needs in these areas? In this forcefully argued collection of essays, Frank Cioffi examines Wittgenstein's reflections on the comparative claims of clarification and empirical enquiry. Though writing out of admiration and indebtedness, he expresses reservations as to the limits Wittgenstein places on the relevance and (...) desirability of empirical knowledge. His discusssions extend from Wittgenstein's reflections on human sacrifice and other ritual practices dealt with by Frazer to Freud's account of the sources of anxiety, depression, dreams and laughter. He asks both whether it is empirical investigation or more lucid reflection that these phenomena demand, and what kind of question this itself is. (shrink)

Fábio Alves dos Santos (1954-2013) cursou Pedagogia, Ciências Sociais e Teologia, era Especialista em Filosofia da Religião (PUC Minas), Advogado (PUC Minas) e Mestre em Direito Constitucional (UFMG). Lecionou na PUC Minas como professor de Cultura Religiosa e depois como professor no Curso de Direito, atuando principalmente no Serviço de Assistência Judiciária – SAJ, especialmente cuidado de causas populares como as da ASMARE (Associação dos Catadores de Papel, Papelão e Material Reaproveitável de Belo Horizonte), da Pastoral de Rua, da Pastoral (...) Carcerária, de movimentos de “Sem Casa”, de ocupações e tantos outros grupos. Fábio sofria de grave problema de visão há mais de 15 anos. Quase ficou cego depois de diversas cirurgias de miopia. Isso, porém, não o impedia de seguir seu constante compromisso com as lutas populares. Na última entrevista que concedeu, menos de um mês antes de sua morte (19 de outubro de 2013), depois de duro sofrimento de quase dois anos, no tratamento de um câncer no pâncreas, conta um pouco de sua vida, sua luta e sua percepção de várias realidades, especialmente da Igreja e da pastoral. Militante formado na Teologia da Libertação, de profunda espiritualidade, marcada por traços da religiosidade popular nordestina e comprometida com a libertação, Fábio Alves também buscou em sua vida abrir-se à teologia do pluralismo religioso, especialmente com o Santo Daime, em cuja tradição religiosa chegou a ser “fardado”, mantendo uma profunda atitude espiritual aberta ao diálogo inter-religioso. Sua primeira publicação foi “Começo de mundo novo: sofrimento, luta e vitória dos posseiros de Santana dos Frades”, Sergipe, numa versão popular em 1981 e outra pela Editora Vozes (1990). Fruto de sua dissertação de mestrado, publicou o livro “Direito Agrário: política fundiária no Brasil (1995). Em 2001 saiu seu último livro, uma coletânea de artigos publicados em diversos jornais: “Em defesa da vida”. Num artigo em Horizonte (2004), juntamente com o advogado, amigo e colega Prof. Cristiano de Melo Bastos, discutiu “A prática jurídica na missão da PUC Minas”. Focused on city-scale automation, and using self-driving cars (SDCs) as a case study, this article reflects on the role of AI—and in particular, computer vision systems used for mapping and navigation—as a catalyst for urban transformation. Urban research commonly presents AI and cities as having a one-way cause-and-effect relationship, giving undue weight to AI’s impact on cities and overlooking the role of cities in shaping AI. Working at the intersection of data science and social research, this paper aims to counter (...) this trend by exploring the reverse perspective: how do cities affect the development, and expose the present limits, of SDCs? The contribution of this paper is threefold. First, by comparing urban and nonurban environments and thoroughly examining the relationship between computer vision and city-specific sociality and form, it defines machine autonomy/automation as a function of the sociotechnical milieu in which an AI system operates. Second, and related, the paper problematizes the notion of SDCs as autonomous technologies and the role it plays in envisioning contending policy arrangements and technical solutions for achieving full driving automation. Finally, the article offers insight into a materialist and spatialized understanding of AI—namely, not as an abstract quality susceptible to replication within discrete machines, but rather as a distributed property emerging through embodied interactions among a multiplicity of agents (human, non-human, and technological) within/with their environments. The manuscript Chisianus VII 240 (K) is an important witness for A. Donatus’ Commentum on Terence, unfortunately discovered only after the editorial work of P. Wessner. K was demonstrated to follow different sources in different sections of the Commentary, but, for the section containing the commentary on Andria, it derives from the Carnotensis, a codex deperditus with a good Donatian text. In this paper I pay attention to significant errors that join the Chisianus VII 240 with Λ, a group of (...) manuscripts that come from the Maguntinus, in order to demostrate that the most probable way of explaining these Bindefehler is the assumption of a deep process of contamination, probably due to Λ. Enthymemes are traditionally defined as arguments in which some elements are left unstated. It is an empirical fact that enthymemes are both enormously frequent and appropriately understood in everyday argumentation. Why is it so? We outline an answer that dispenses with the so called "principle of charity", which is the standard notion underlying most works on enthymemes. In contrast, we suggest that a different force drives enthymematic argumentation—namely, parsimony, i.e. the tendency to optimize resource consumption, in light of the agent's (...) goals. On this view, the frequent use of enthymemes does not indicate sub-optimal performance of arguers, requiring appeals to charity for their redemption. On the contrary, it is seen as a highly adaptive argumentation strategy, given the need of everyday reasoners to optimize their cognitive resources. Considerations of parsimony also affect enthymeme reconstruction, i.e. the process by which the interpreter makes sense of the speaker's enthymemes. Far from being driven by any pro-social cooperative instinct, interpretative efforts are aimed at extracting valuable information at reasonable costs from available sources. Thus, there is a tension between parsimony and charity, insofar as the former is a non-social constraint for self-regulation of one's behaviour, whereas the latter implies a pro-social attitude. We will argue that some versions of charity are untenable for enthymeme interpretation, while others are compatible with the view defended here, but still require parsimony to expose the ultimate reasons upon which a presumption of fair treatment in enthymeme reconstruction is founded. Those who are interested in Freud and psychoanalysis will be familiar with questions such as ‘Is Freudian psychology pseudo-scientific?’ ‘Is Freudian psychology falsifiable?’ ’Is unfalsifiability an adequate criterion of pseudo-science?’, and they might naturally suppose that it is these questions of which Erwin has attempted a ‘final accounting’. Surprisingly, these questions hardly feature in Erwin's book. Though at the outset Peter Medawar's notorious judgment that psychoanalysis is ‘the most stupendous intellectual confidence trick of the twentieth century’ is cited, Erwin does (...) not seem to think it is part of his final accounting to say either whether he thinks it justified or, if not, why someone of Medawar's distinction should nevertheless have thought so. The material is organized in four sections: (i) the nature of events, with emphasis on the opposition between events as particulars and events as universals; (ii) identity and indeterminacy, with emphasis on the unifier/multiplier controversy; (iii) events and logical form, with emphasis on Davidson’s treatment of the form of action sentences; (iv) linguistic applications, with emphasis on issues concerning aspectual phenomena, the (...) telicity/atelicity distinction, the treatment of statives, and temporal quantification. We present a new puzzle about logical truth, necessity, and moral responsibility. We defend one solution to the puzzle. A corollary of our preferred solution is that prominent arguments for the incompatibility of determinism and moral responsibility are invalid.

The aim of this paper is to give, using the Kripke semantics for intuitionism, a representation of finitely generated free Heyting algebras. By means of the representation we determine in a constructive way some set of "special elements" of such algebras. Furthermore, we show that many algebraic properties which are satisfied by the free algebra on one generator are not satisfied by free algebras on more than one generator.

This paper wants to demonstrate the not casual similarity between Plautus’Asinaria 205 and Terence’s Andria 545 arguing for the possibility that Plautus’Asinaria 205 was interpolated.

This paper approaches legal argumentation from a rhetorical perspective. It discusses the nature of the audiences that are targeted by judges in the legal process. Judicial opinions reach diverse groups of people with very different attitudes and expectations: other judges, lawyers, litigants, concerned citizens, etc. One important way in which these groups differ is that some of them are more likely to be persuaded by legalistic, precedent or statute-based arguments, while others expect judges to decide on grounds of justice or (...) equity. So, judges face the challenge of determining whether they should select particular groups for special attention, or whether they have alternative rhetorical means to approach the problem of audience diversity. One strategy that is likely to be recommended by rhetorical scholars is that judges should not try to accommodate the various preferences of their actual readership, but that they should rather invoke an idealized audience or some version of Chaïm Perelman’s universal audience. However, the paper tries to show that the universal audience is of limited value for a discussion about how judges ought to proceed in the face of audience diversity. In particular, the idea of a universal audience does not help judges to make the choice between a legalistic or an equity-based approach to legal decision-making. By showing that this is so, the paper also raises doubts about the common thought that to invoke the universal audience in law is to appeal to natural law. (shrink)

A partir disso, indagamos sobre a possibilidade da linguagem e da história auxiliarem na busca pela verdade. Para tal, o texto reconstrói o pensamento de Nietzsche contido em dois escritos de 1873 3 1874. Por fim, contrapormos a concepção de Nietzsche, ainda que brevemente, com a visão de Habermas para demonstrar que a história, expressa pela linguagem, deve ser crítica e, (...) com isso, conduzir a verdade. This paper analyzes concepts of independence and assumptions of convexity in the theory of sets of probability distributions. The starting point is Kyburg and Pittarelli’s discussion of “convex Bayesianism” (in particular their proposals concerning E-admissibility, independence, and convexity). The paper offers an organized review of the literature on independence for sets of probability distributions; new results on graphoid properties and on the justification of “strong independence” (using exchangeability) are presented. Finally, the connection between Kyburg and Pittarelli’s results and recent developments (...) on the axiomatization of non-binary preferences, and its impact on “complete” independence, are described. La complessità dei rapporti tra oggetto mentale, realtà storica e rappresentazione storiografica appare evidente, quando taluni film di fantascienza ripropongono discussioni teoriche, alcune delle quali dal forte sapore medievale, in atmosfere medievali collocate nel futuro.

This article highlights the impasses of anti-racist struggles that understand racism as an opinion or a prejudice and use education as their only means for addressing it. Racism should rather be understood as a socio-historical subjective structure rooted in the process of constitution of the division of labour on a global scale through colonialism, a process that was crucial to the institution of capitalism. This is why we will put forth the importance of rejecting the narrations that camouflage colonization with (...) the idea of civilization, and the necessity to produce decolonial counter-histories. We will thus claim that such an endeavor should start from the struggles of racialized peoples against the different forms of coloniality—that is, from the refusal by racialized peoples of the representations that are imposed on them, and from their repositioning on the basis of their alterity. Only the position of a powerful alterity can in fact make possible a real equality.Cet article met en évidence les impasses des luttes antiracistes qui conçoivent le racisme comme une opinion ou un préjugé et utilisent l’éducation comme le seul moyen d’y remédier. Le racisme devrait plutôt être compris comme une structure socio-historique subjective qui s’enracine dans le procès de constitution de la division mondiale du travail par le colonialisme, un procès qui a été décisif pour l’institution du capitalisme. C’est pourquoi nous mettrons en avant le caractère problématique des récits qui recouvrent la colonisation de l’idée de civilisation et la nécessité de produire des contre-histoires décoloniales. Il s’agira alors de montrer que, pour ce faire, il faut partir des luttes des racisés contre les différentes formes de colonialité—c’est-à-dire du refus par les racisés des représentations qui leur sont adressées et de leur repositionnement à partir de leur altérité. Seule la position d’une altérité puissante peut, en effet, rendre possible une égalité réelle. (shrink)
