It is argued that Adam Smith criticizes David Hume's account of the origin of and continuing adherence to the rule of law for being not sufficiently Humean. Hume explained that adherence to the rule of law originated in the self-interest to restrain self-interest. According to Smith, Hume does not pay enough attention to the passions of resentment and admiration, which have their source in the imagination. Smith's offers a more naturalistic and evolutionary account of the psychological pre-conditions of the establishment (...) and morality of justice than Hume had. Yet, Smith's account also makes room for a thin conception of Lockean natural right to property, while rejecting the contractualist and rationalistic elements in Locke. It emerges that Smith severs the intimate connection that Hobbes and Hume made between justice and property. (shrink)

There is no justice, only talk of justice, in Shakespeare’s Measure for Measure. Characters invoke the symbolic balance scales but live at the unbalanced legalistic and merciful extremes. Equity, often suggested as a central theme, matters mostly for its loud absence. Indeed, if we separate equity, which recommends judicial leniency as the means to a just squaring of accounts, from mercy, which exceeds justice, we see that the play frustrates the Duke’s aspiration to virtuous rule by insisting that we must (...) have, and also that we cannot have, both justice and mercy. Lukacher uses these conventions and (...) methods to argue that conscience, properly understood, poses uncomfortable questions about the origins of self-knowledge, and leads to a mysterious but presumably enriching encounter with the limits of our certainty. Shakespeare enters the argument as the supreme example of a poet who discovers, through sensitivity to the ambiguities of language, how to peer without flinching into the Heideggerian abyss. Although the book relies too heavily on Heidegger’s unforgiving idiom, and pauses too seldom to justify suggestive but tenuous claims, at its heart lie hard, interesting questions about what having a conscience means.Lukacher wishes to restore to the idea of conscience all its paradoxical force. As a silent inner voice carrying a moral imperative from elsewhere, conscience immediately suggests an internally divided self. And although, according to Lukacher, Christian tradition locates the source of the imperative in God, and classical tradition in natural law, conscience remains irreducibly “uncanny,” because “the most intimate site of human habitation [i.e., the self] is also the strangest of places, for it is there that the (unfamiliar) god comes to presence through the language of moral judgment that tells us that we are and that because we are what we are we should act thus” (p. 7). For Lukacher, then, the question of conscience is the question of being, a question without an answer because it involves the unthinkable idea of something prior to and beyond being. The book argues that whatever speaks to us under the name of conscience must be both within and without any categories we have to explain it.Hence “daemonic figures”: drawing on the Greek notion of a realm of daimones dwelling between the human and divine worlds, Lukacher claims that the “daemon is the cipher, the name, and the figure for the incontrovertible [End Page 240] ghostliness, the familiar strangeness, that dwells between the perceptions and reflections of consciousness and the enigmatic ground of Being itself” (p. 2), or “the medium in which we come to ourselves as precisely that which is divided from itself... from the outset” (p. 6). And because, in Lukacher’s scheme, language articulates this daemonic mediation, we must seek in literary works which explore conscience—like Hamlet and Macbeth—traces of uncanniness welling up through ostensibly coherent words. Literary value accordingly involves “giving us the words with which to bring that enigmatic lack to presence” (p. 92). Simultaneously ubiquitous and inscrutable, conscience both calls to and evades us, and literature makes its home in such paradoxical territory.It follows that Lukacher seeks in texts brief flashes of something else in the midst of what’s apparently going on, a procedure which constantly risks arbitrary idiosyncrasy. For instance, in his chapter on Hamlet, Lukacher notes that the Player’s description of Priam’s death includes a line—“and with a hideous crash / Takes prisoner Pyrrhus’ ear”—whose sequence of sounds produces a ghostly authorial signature: sh... akes... Pyr... ear. And because this “countersignature” appears fragmented, in a context of hesitation, destruction and decline, Lukacher claims it creates an allegory of the “nonrelation at the heart of self-revelation” (p. 135). That is, it (and the larger drama of Hamlet’s revenge to which it obliquely gestures) reveals that at the heart of authorship, of authorized speech, of the moral law of conscience, lies “the silent play of the letter” (p. 135), the “daemonic figure” of dissolution in the midst of self-assertion, which unsettles all authorization. In a large and impressive body of published work, Quayshawn Spencer has meticulously articulated and defended a metaphysical project aimed at resuscitating a biological conception of race—one free from many of the pitfalls of biological essentialism. If successful, such a project would be highly rewarding, since it would provide a compelling response to philosophers who have denied the genuine existence of race while avoiding the very dangers that they sought to avoid. This paper, which is a homage to the life and work of Stephen Gaukroger, explores competing receptions of Spencer’s programmatic synthetic philosophy. In so doing, I show how T.H Huxley and C.S. Peirce reconfigured a familiar, long-standing debate about cosmogeny and cosmology in the early modern period.

Clinical ethics consultation is largely outside the scope of regulation and oversight, despite its importance. For decades, the bioethics community has been unable to reach a consensus on whether there should be accountability in this work, as there is for other clinical activities that influence the care of patients. The American Society for Bioethics and Humanities, the primary society of bioethicists and scholars in the medical humanities and the organizational home for individuals who perform CEC in the United States, has (...) initiated a two‐step quality attestation process as a means to assess clinical ethics consultants and help identify individuals who are qualified to perform this role. In the philosophy of climate science, debate surrounding the issue of variety of evidence has mostly taken the form of attempting to connect these issues in climate science and climate modeling with philosophical accounts of what has come to be known as “robustness analysis.” I argue that an “explanatory” conception of robustness is the best candidate for understanding variety of evidence in climate science. I apply the analysis to both examples of model agreement, as well at to the convergence of (...) evidence from both model and non-model sources. (shrink)

Simulations (both digital and analog) and experiments share many features. But what essential features distinguish them? I discuss two proposals in the literature. On one proposal, experiments investigate nature directly, while simulations merely investigate models. On another proposal, simulations differ from experiments in that simulationists manipulate objects that bear only a formal (rather than material) similarity to the targets of their investigations. Both of these proposals are rejected. I argue that simulations fundamentally differ from experiments with regard to the background (...) knowledge that is invoked to argue for the “external validity” of the investigation. (shrink)

Violations of the Bell inequalities in EPR-Bohm type experiments have set the literature on the metaphysics of microscopic systems to flirting with some sort of metaphysical holism regarding spatially separated, entangled systems. The rationale for this behavior comes in two parts. The first part relies on the proof, due to Jon Jarrett [2] that the experimentally observed violations of the Bell inequalities entail violations of the conjunction of two probabilistic constraints. Jarrett called these two constraints locality and completeness. We prefer (...) the terminology of locality and factorizability.[3] The first part of the rationale for metaphysical holism urges that only Jarrett’s locality allows for “peaceful coexistence” between any model of EPR-Bohm type experiments and special relativity. Should philosophers of science be paying attention to developments in "nanoscience"? Undoubtedly, it is too early to tell for sure. The goal of this paper is to take a preliminary look. In particular, I look at the use of computational models in the study of nano-sized solid-state materials. What I find is that there are features of these models that appear on their face to be at odds with some basic philosophical intuitions about the relationships between different theories and between (...) theories and their models. My conclusion is that developments in nanoscience are not an unlikely place for novel insights in the philosophy of science to emerge. (shrink)

Standard animalists are committed to a stringent form of restricted composition, thereby denying the existence of brains, hands, and other proper parts of an organism . One reason for positing this near-nihilistic ontology comes from various challenges to animalism such as the Thinking Parts Argument, the Unity Argument, and the Argument from the Problem of the Many. In this paper, I show that these putatively distinct arguments are all instances of a more general problem, which I call the ‘Too Many (...) Candidates Problem’ . Given my formulation of the problem, it is evident that standard animalists are mistaken in believing that restricting composition is the only solution. I show that there is another option for solving the TMC. The advantage of such a position, which I call ‘unrestricted animalism’, is that it is compatible with unrestricted composition and the existence of brains and other proper parts of an organism. I conclude by sketching several strategies one can take regarding this latter solution to the TMC. (shrink)

Woodward's long awaited book is an attempt to construct a comprehensive account of causation explanation that applies to a wide variety of causal and explanatory claims in different areas of science and everyday life. The book engages some of the relevant literature from other disciplines, as Woodward weaves together examples, counterexamples, criticisms, defences, objections, and replies into a convincing defence of the core of his theory, which is that we can analyse causation by appeal to the notion of manipulation.

Statistical mechanics involves probabilities. At the same time, most approaches to the foundations of statistical mechanics--programs whose goal is to understand the macroscopic laws of thermal physics from the point of view of microphysics--are classical; they begin with the assumption that the underlying dynamical laws that govern the microscopic furniture of the world are deterministic. This raises some potential puzzles about the proper interpretation of these probabilities.

Part I of this essay supports the anti-egalitarian conclusion that individuals may readily become entitled to substantially unequal extra-personal holdings by criticizing end-state and pattern theories of distributive justice and defending the historical entitlement doctrine of justice in holdings. Part II of this essay focuses on a second route to the anti-egalitarian conclusion. This route combines the self-ownership thesis with a contention that is especially advanced by G.A. Cohen. This is the contention that the anti-egalitarian conclusion can be inferred from (...) the self-ownership thesis without the aid of additional controversial premises. Cohen advances this contention, not because he wants to support the anti-egalitarian conclusion, but rather because he wants to emphasize the need for one to reject the self-ownership thesis if one is to reject the anti-egalitarian conclusion. In Part II of this essay, I support this second route to the anti-egalitarian conclusion by reinforcing Cohen's special contention while rejecting his challenges to the self-ownership thesis. Cohen's special contention is reinforced by way of an explanation of why the redistributive state must trench upon some people's self-ownership rights. One important challenge to the self-ownership thesis is answered through the articulation of a new and improved Lockean proviso. Another challenge offered by Cohen is answered by arguing that the philosophical costs of denying the self-ownership thesis are as great as the self-ownership libertarian maintains. Thus, I defend both of the key elements of self-ownership libertarianism, the self-ownership thesis and the anti-egalitarian conclusion. (shrink)

To date, emotion research has primarily focused on the experience and display of the emoter. However, of equal, if not more, importance is how such displays impact and guide the behavior of an observer. We incorporate a functionalist framework of emotion to examine the development of differential responding to discrete emotion, theorize on what may facilitate its development, and hypothesize the functions that may underlie such behavioral responses. Although our review is focused primarily on development, the theoretical and methodological ideas (...) laid out are relevant for researchers of emotion at all ages. (shrink)

This paper proposes a solution to David Miller's Minnesotan-Arizonan demonstration of the language dependence of truthlikeness (Miller 1974), along with Miller's first-order demonstration of the same (Miller 1978). It is assumed, with Peter Urbach, that the implication of these demonstrations is that the very notion of truthlikeness is intrinsically language dependent and thus non-objective. As such, truthlikeness cannot supply a basis for an objective account of scientific progress. I argue that, while Miller is correct in arguing that the number of (...) true atomic sentences of a false theory is language dependent, the number of known sentences (under certain straightforward assumptions) is conserved by translation; degree of knowledge, unlike truthlikeness, is thus a linguistically invariant notion. It is concluded that the objectivity of scientific progress must be grounded on the fact (noted in Cohen 1980) that knowledge, not mere truth, is the aim of science. (shrink)

With the originality and energy that have marked his earlier works, Eric Wolf now explores the historical relationship of ideas, power, and culture. Responding to anthropology's long reliance on a concept of culture that takes little account of power, Wolf argues that power is crucial in shaping the circumstances of cultural production. Responding to social-science notions of ideology that incorporate power but disregard the ways ideas respond to cultural promptings, he demonstrates how power and ideas connect through the medium (...) of culture. Wolf advances his argument by examining three very different societies, each remarkable for its flamboyant ideological expressions: the Kwakiutl Indians of the Northwest Pacific Coast, the Aztecs of pre-Hispanic Mexico, and National Socialist Germany. Tracing the history of each case, he shows how these societies faced tensions posed by ecological, social, political, or psychological crises, prompting ideological responses that drew on distinctive, historically rooted cultural understandings. In each case study, Wolf analyzes how the regnant ideology intertwines with power around the pivotal relationships that govern social labor. We investigate properties of propositional modal logic over the classof finite structures. In particular, we show that certain knownpreservation theorems remain true over this class. We prove that aclass of finite models is defined by a first-order sentence and closedunder bisimulations if and only if it is definable by a modal formula.We also prove that a class of finite models defined by a modal formulais closed under extensions if and only if it is defined by a -modal formula.

Anthony Weston has criticized the place of “inttinsic value” in the development of an environmental ethic, and he has urged a “pragmatic shift” toward a plurality of values based on human desires and experiences. I argue that Weston is mistaken for two reasons: (1) his view of the methodology of environmental ethics is distorted: the intrinsic value of natural entities is not the ground of all moral obligations regarding the environment; and (2) his pragmatic theory of value is too anthropocentric (...) and subjective for the development of a secure and reliable environmental ethic. The obligation to protect the natural environment should not be based on certain “correct” experiences of humans as they interact with wild nature. (shrink)

This paper explores some connections between competing conceptions of scientific laws on the one hand, and a problem in the foundations of statistical mechanics on the other. I examine two proposals for understanding the time asymmetry of thermodynamic phenomenal: David Albert's recent proposal and a proposal that I outline based on Hans Reichenbach's “branch systems”. I sketch an argument against the former, and mount a defense of the latter by showing how to accommodate statistical mechanics to recent developments in the (...) philosophy of scientific laws. We present a new technique for changing the cofinality of large cardinals using homogeneous forcing. As an application we show that many singular cardinals in [Formula: see text] can be measurable in HOD. We also answer a related question of Cummings, Friedman and Golshani by producing a model in which every regular uncountable cardinal [Formula: see text] in [Formula: see text] is [Formula: see text]-supercompact in HOD.

There have been several recent attempts to refute objective consequentialism on the grounds that it implies the absurd conclusion that even the best of us act wrongly. Some have argued that we act wrongly from time to time; others have argued that we act wrongly regularly. Here I seek to strengthen reductio arguments against objective consequentialism by showing that objective consequentialism implies that we almost never act rightly. I show that no matter what you do, there is almost certainly something (...) else you could do that would have even better consequences. If objective consequentialism is true, the ratio of the number of your right actions to the number of your wrong actions is very close to zero. (shrink)

The capability approach to distributive justice, as defended by Amartya Sen and Martha Nussbaum, represents perhaps the most influential recent attempt to reconcile the competing demands of liberty and equality. Specifically, capability theorists have claimed that their insistence on the universal cultivation of a set of capabilities for basic human "functionings" is fully consistent with a liberal neutrality commitment. Their reason is that these capabilities are, like Rawls's primary goods, rational to want "whatever else one wants." This article suggests, in (...) contrast, that the capability approach fails to satisfy the neutrality requirement endorsed by both Sen and Nussbaum. It further suggests that the non-neutral character of the approach reflects its Rawlsian lineage, and raises serious doubts about the coherence of Rawls's account of primary goods. (shrink)

Climate science evaluates hypotheses about the climate using computer simulations and complex models. The models that drive these simulations, moreover, represent the efforts of many different agents, and they arise from a compounding set of methodological choices whose effects are epistemically inscrutable. These facts, I argue in this chapter, make it extremely difficult for climate scientists to estimate the degrees of uncertainty associated with these hypotheses that are free from the influences of past preferences—preferences both with regard to importance of (...) one prediction over another and with regard to avoidance of false positive over false negatives and vice versa. This leaves an imprint of non-epistemic values in the nooks and crannies of climate science. (shrink)

International borders concentrate opportunities in some societies while limiting them in others. Borders also prevent those in the less favored societies from gaining access to opportunities available in the more favored ones. Both distributive effects of borders are treated here within a comprehensive framework. I argue that each state should have broad discretion under international law to grant or deny entry to immigration seekers; but more favored countries that find themselves under immigration pressure should be legally obligated to fund development (...) assistance for countries that generate immigration pressure. Funding should be subject to conditions of fair and effective use in recipient countries, and should aim at a near-term target of immigration-pressure equilibrium. Equilibrium obtains between two countries when, given appropriate background circumstances, the same proportion of individuals in each manifests a preference to migrate to the other. If meeting the equilibrium target in the short term would be to the long-term disadvantage of the worst-off countries, then a Pareto-superior alternative target supersedes. It mandates development assistance at the level that yields the most favorable human development projections for the worstoff countries. An implementable set of institutions is described that can achieve the equilibrium goal in the long term without unduly sacrificing other important ends, including economic growth, political stability, cultural integrity, the political autonomy of distinct societies, and their proper accountability for policy choices. This paper is a logical study of valid uses of symmetry in deductive reasoning, of what underlying principles make some appeals to symmetry legitimate but others illegitimate. The issue is first motivated informally. A framework is then given covering a fairly broad range of symmetry arguments, and the formulation of symmetry provided is shown to be a valid principle of reasoning, as is a slightly stronger principle of reasoning, one that is shown to be in some sense as strong as (...) possible. The relationship between symmetry and isomorphism is discussed, and finally the framework is extended to a more general model-theoretic setting. (shrink)
