Les normes au sens le plus large sont issues des interactions entre les individus et sont interprétées au sein de ces interactions, même si la complexité des interactions tient aussi à l'intervention des institutions et des Etats. Il s'agit de partir du micronormatif pour aller vers le macronormatif (notamment les lois et les traités) et non l'inverse, de manière à rendre compte de phénomènes comme la responsabilité sociale des entreprises, le droit souple et la prise en compte de l'éthique pour (...) prendre des décisions (au plan national et international, en matière environnementale et médicale, etc.). Le constat de départ est qu'une masse colossale de normes de toute origine s'applique à des individus, personnes physiques ou morales, qui à leur tour participent de l'élaboration de normes. L'inflation et la diversification des normes engendrent notamment une crise du droit (en quête d'identité), mais aussi une crise des institutions et des professions judiciaires. Une façon de rendre compte de ces crises consiste à établir une sorte de cartographie des interactionnismes au regard des normes. Emergent ainsi des interactionnismes philosophiques, sociologiques, anthropologiques, psychologiques, éthiques ou juridiques. Les différents interactionnismes peuvent apparaître critiquables au regard des normes (notamment en raison de leur caractère descriptif et non institutionnel) et il serait fort utile de dégager des voies alternatives. L'introduction met en place cette problématique (E Picavet et E Jeuland). Après une recherche théorique et pratique menée par des juristes (E Jeuland et L Champain), un sociologue des professions (F Champy) nous permet de penser l'évolution des professions judiciaires entre statut et adaptation. Une philosophe spécialisée dans l'interactionnisme (C Bonicco) ainsi qu'une psychanalyste (H Tessier) s'interrogent sur les normes implicites, non dites et les rapports de domination sous-jacents aux interactions. Un philosophe spécialisé dans la justice climatique et le nucléaire ouvre un nouveau champ de réflexion particulièrement nécessaire aujourd'hui en incluant la nature au sein des interactions humaines (F P Piguet). Deux ingénieurs nous présentent une approche des interactionnismes et de l'innovation technologique (J F Omhover et C Bouchard) qui n'est pas sans lien avec la nature et le droit. Un anthropologue estime que le droit tel qu'il est connu depuis deux ou trois siècles dans une version très étatique est en plein bouleversement et revient à des formes microjuridiques (Etienne le Roy). Un juriste essaie enfin de faire la synthèse des articulations entre les normes et les interactions (J Moret-Bailly). Derrière un seul et même mot – l’« esthétisation » – se cachent des constats que tout ou presque sépare. Peu étonnant que les différents débats autour de cette notion, en France, en Allemagne ou aux États-Unis, aient souvent engendré des incompréhensions mutuelles. Avant même de savoir si l’esthétisation du monde est un phénomène désirable ou condamnable, il faut éclairer les arrière-plans conceptuels qui orientent ce diagnostic, et qui lui confèrent un sens parfois diamétralement opposé. Bernard Matolino argues that the communal foundation of classical African communitarianism should be discarded if communitarian theories would be of any use to modern African political theory. He sets out to propose a theory of communitarianism that not only suits modern African realities but would also be useful to any people including non-Africans. I argue that what he ends up doing is proposing cosmopolitanism, calling into question the “Afro” designation of the title of his theory. I also argue that his (...) position on the relationship between the individual and the community is technically not communitarianism of any sort, calling into question the “communitarian” appellation in his theory. His attempt to divorce communitarianism from communalism is unsuccessful, making communitarianism as unsuitable as a theory of world relations as Matolino claims it is unsuitable for contemporary multiethnic African societies. There have been two parallel views regarding the role of voting in deliberation. The first is that deliberation before the fabrication of balloting was completely devoid of voting. The second is that voting is, not just part of deliberation, but is standard to deliberation. I argue in this article that neither of these views is correct. Implicit voting has always existed across time and space but only as a last resort in the event of a failure of natural unanimity. What (...) is relatively modern is the establishment of what I call explicit voting, namely, balloting, outside deliberation and often without deliberation. I also distinguish between natural and artificial unanimities, and clarify that artificial unanimities are products of implicit voting. I demonstrate these clarifications with some examples of deliberation. I deploy these clarifications to rid a certain debate of confusion regarding the precise role of voting in consensual deliberation. (shrink)

In his plea for consensual democracy in Africa, Kwasi Wiredu recommends unanimity about what is to be done, not what ought to be done, or unanimity on action rather than unanimity of values, beliefs and opinion. I caution the use of this procedural instrument by showing that some issues are so value-laden that a group decision cannot be value-neutral. It may sometimes be more productive to entertain value differences to keep them from going underground and becoming dangerous. Kant’s emphasis on the immorality of lying even to a murderer at the door who is asking about a victim hidden inside has drawn criticism ever since. The example originally given by Constant has been read as the thread of morality by totalitarian ruthlessness. In order to defend the importance of Kant’s moral philosophy, many critics have tried to update his position by taking into account the threat of modern totalitarianism. Nonetheless, this article tries to argue that Kant is right, (...) especially since the rise of post-truth politics. The paper takes heed of the fact that, when evaluating normative issues through the semantics of visibility and invisibility, a transfer takes place from optical to political semantics which is not without consequences. The paper attempts a typology of the extremely diverse functions (in)visibility takes in current discourses, moving from the characterization of situations of discrimination to that of the resistance to it. In a first step, it analyses the affirmative uses of the notion of political visibilisation, whether of individuals, (...) groups or concerns, that fashion themselves as targeted answers to discrimination. In a second step, it looks at the politics of invisibilisation, stealth, and opaqueness, claiming emancipatory and critical potential in resisting the limelight of public space. Specifically, it assesses whether the traditional connect of politicization and public visibility still holds true in all cases. In a third part, the paper suggests a possible reorganization of the polarity of visibility and invisibility as one that runs along the continuum between determinacy and indeterminacy, indicating its effects for patterns of discrimination as well as for practices of resistance. Emmanuel Chiwetalu Ossai and Lloyd Strickland argue that the African philosophy of ubuntu, with its emphasis on community, interconnectedness, and practical application of ethical principles, offers a compelling alternative.

The notion of ‘phenomenotechnique’ which Gaston Bachelard introduced in the 1930’s has enjoyed popularity among historians of science who used it in order to insist upon the technical and social mediateness of scientific facts. In the wake of the current triumphal return to epistemological ‘realism,’ the idea of phenomenotechnique has been dismissed as an alleged relic of ‘constructivism.’ The article advocates for a different reading of ‘phenomenotechnique,’ which, rather than insisting on the fabrication of the scientific fact, highlights the intrinsic (...) connection of phenomenality and technicality. Phenomena are not simply given, they must be brought to visibility. While philosophies of technique have mostly stressed that technicity consists in overlooking the process (the ‘anesthesia’ of the medium), the paper argues for a conception of technicity that makes space for its productive, aestheticizing capacity. Pourtant, bien avant de publier ses premières monographies, Merleau-Ponty est l’auteur d’un livre écrit pour le compte (...) d’un autre : Nord. Récit de l’arctique, paru en 1928 chez Grasset. Le roman qui traite de la vie d’un explorateur dans le grand nord canadien, entre commerce de fourrures entre rencontre avec les Inuits, n’est qu’un travail de commande, que Merleau-Ponty ne revendiquera jamais. On trouve cependant dans cet écrit de jeunesse quelques motifs intéressants qui préfigurent sa pensée à venir. In recent years, the claim of the unrepresentability of the Shoah has stirred vivid debates, especially following the strong positions taken by the French filmmaker Claude Lanzmann and author of Shoah (1986). This claim of unrepresentability, it can be shown, draws part of its attraction from the fact that it oscillates undecidedly between a claim of logical impossibility (“the Shoah can’t be represented”) and a normative demand (“the Shoah shouldn’t be represented”). This essay analyzes the argumentative structure of the advocates (...) of the unrepresentability and shows why the often made connection to Kant is flawed. Although his Critique of the Power of Judgment affirms indeed that the prohibition of representation is the “perhaps most sublime passage in the Jewish Law”, turning the prohibition of representation into a supposedly Kantian claim does not hold grounds. The essay reconstructs the political framework of the debate, situates the Kantian passage in its precise philosophical context and then successively assesses the main arguments put forward by Jean-Luc Nancy, Jacques Rancière and Georges Didi-Huberman in their critique of Lanzmann’s categorical imperative. While showing why the rhetoric of the “unrepresentable” bear troubling structural analogies to what they want to fight (i.e. the politics of erasure, which always also include the erasure of the traces of erasure), a certain notion of the “unrepresentable” is rescued nevertheless at the end of the essay. Representation, so it is argued by returning to a Kantian distinction, is not a matter of Kanon, but a matter of Organon, which then puts the debate about the Sublime (which took place between Lyotard and Rancière in the 90’s) into a new perspective. Building on prior research related to impact of information communication technology and operational risk management in the context of medium and small enterprises, the focus of this study was to investigate the relationship between ICT operational risk management and performances of MSEs. To achieve the focus, the research investigated evaluating models for understanding the value of ICT ORM in MSEs. Multiple regression, Repeated-Measures Analysis of Variance and Repeated-Measures Multivariate Analysis of Variance were performed. The findings of the distribution revealed that (...) only one variable made a significant percentage contribution to the level of ICT operation in MSEs, the Payback method. It may thus be inferred that the Payback method is the prominent variable, explaining the variation in level of evaluation models affecting ICT adoption within MSEs. Conclusively, in answering the two questions degree of variability explained and predictors, the results revealed that the variable contributed approximately 88.4% of the variations in evaluation models affecting ICT adoption within MSEs. The analysis of variance also revealed that the regression coefficients were real and did not occur by chance. (shrink)

Gareth Evans was first to express the idea that our perceptual experience is more detailed than what our concepts possess and this brings in the idea of nonconceptualism. The nonconceptualist claims that creatures without conceptual ability can be in a content-bearing state since they do not possess concept, memory or linguistic ability. Concepts are the constituents of those intentional contents that are the complete truth-evaluable contents of judgment and belief. This paper examines the possibility of nonconceptual content in human perception (...) and considers the complementarism of conceptualism and nonconceptualism as a more viable basis for explaining human perception. This synthesis, the paper suggests, overcomes the epistemological deficiencies inherent in any unilateral approach to understanding the nature, character, and process of cognition thereby providing a more comprehensive understanding of the human cognitive process. ArgumentWhen the New Deal administration attained power in the United States, it was confronted with two different problems that could be linked to one another. On the one hand, there was a huge problem of unemployment, affecting everybody including the white-collar workers. And, on the other hand, the administration suffered from a very serious lack of data to illuminate its politics. One idea that came out of this situation was to use the abundant unemployed white-collar workers as enumerators of statistical (...) studies. This paper describes this experiment, shows how it paradoxically affected the professionalization of statistics, and explains why it did not affect expert democracy despite its Deweysian participationist aspect. Some of the traditions and cultural beliefs and practices of the Idoma people of Nigeria have been influenced both positively and negatively as a result of the advent of Christianity in the area. The aim of this research is to investigate some of the cultural beliefs and practices of the Idoma people before the advent of Christianity, the people’s response to the new faith and the propelling factors behind the responses of the people. In doing so, a comparative study on (...) these beliefs and practices after the advent of Christianity in Idoma traditional society was done. The study adopts a qualitative phenomenological research design and descriptive method for data analysis. Personal interviews form a primary source of data collection, while the secondary source includes library sources. This method of study was chosen to allow the data collected to speak for themselves without any interference from the researchers. The study unveils that the advent of Christianity in the Idoma traditional society had some impact and consequences on the traditional and cultural practices of the people, such as death and burial ceremonies, the Aje-alekwu festival and widowhood practices among others. The study recommends that there should be a synergy between Idoma traditional beliefs and practices and Christianity for peaceful co-existence, progress and development in the area. Contribution: It is erroneously believed that in the contemporary society, traditional religious practices are going to die and become a thing of the past. However, one would observe from this study that Idoma people still hold their traditional beliefs and practices in high esteem despite the influence of Christianity in the area. (shrink)

Kwasi Wiredu proposed a democracy by consensus, inspired by the consensual practices of the traditional Akan of Africa. But his presentation of the traditional consensual practices has been criticized for inaccurateness. Helen Lauer embarks on what she sees as cleaning the debate of the misreading of Wiredu’s presentation of traditional consensual practices by his critics. This is commendable. However, we claim that she does not succeed in the task that she set out to do. We argue that her failure partly (...) has to do with her subscribing to a one-sided assessment of such a history, which influenced the manner she evaluated the debate and some of the fallacies that crept into analysis. Kwasi Wiredu has proposed a democracy by consensus as an alternative to the majoritarian model of democracy many African countries inherited from their colonial masters. As part of his proposal, Wiredu made a number of claims about traditional African consensus democracy that appear to be personal conjectures rather than information obtained from proper empirical investigation. These apparent conjectures have led to confusion and disagreements regarding what actually happened in these traditional societies. In this article, I outline the dangers of such (...) an approach to scholarship. I show that Bernard Matolino’s attempt to defend this methodological laxity is not successful. I argue that inaccurate claims can lead to inaccurate values, and to the designing of mistaken social and political systems. (shrink)

This research exposes the connection between economic inequality and racism. The central argument is that racism is predicated on the economic superiority of the racist. The corollary argument is that conceptions of skin colour are consequences rather than causes of racism: racism does not arise because of skin colour, but because different skin colours have become associated with certain economic conditions for a very long period of time in history. The argument is in fact extended to posit that the topography (...) of the racist relationship would be reversed if the economic tables were also reversed. The conclusion is that the relationship between racism and economic inequality is, therefore, more significant than the relationship between racism and skin colour. This conclusion has consequences regarding how races at the receiving end of racism should respond to racism. (shrink)

In decrying the evils of supernaturalism, African philosopher Kwasi Wiredu proposes humanism, by making concern for human well-being the basis for morality. However, the presentation of humanism as a simple replacement of supernaturalism is objectionable. Wiredu’s notion of supernaturalism is too narrow, since it is only a variant of supernaturalism. His reference to humanism is too broad, since humanism is an umbrella of very conflicting worldviews, such as that between secular and theistic humanism. Although Wiredu does not specify which variant (...) of humanism he means, and although he acknowledges that the Akan believe in a Supreme Being, his general ontology shows that he is closer to the secular than the theistic variant. This article explores the ideological extensions of the two and argues that theistic humanism provides the compatibility needed for being religious and at the same time basing morality on humanistic/naturalistic concerns. In doing so, it distinguishes supernaturalism per se from its ethical and cosmological variants. As a corrective to Wiredu, this article blames these two variants of supernaturalism, rather than supernaturalism per se, for the evils that Wiredu adduces. The conclusion is that in theistic humanism, humanism escapes the dangers of ethical and cosmological supernaturalism without necessarily adopting the antisupernaturalist connotations currently popular with modern secular humanism. Resumo: Este artigo procura responder à pergunta se Marx possui de fato um método dialético próprio. A argumentação está dividida em três partes. Na primeira, procura-se mostrar que as críticas de Marx ao método absoluto de Hegel poderiam ser tomadas por este como meras explicações sobre o seu próprio método. Na segunda parte, tecem-se algumas considerações sobre o que é o método dialético de Hegel, a partir das figuras da imediaticidade e da imediaticidade mediada. Na última parte, apresentam-se três exemplos (...) de como Marx pratica, em sua crítica à Economia Política, exatamente aquilo que criticou no método dialético de Hegel.: This paper attempts to answer the question whether Marx really has an own dialectic method. My argument is divided into three parts. In the first, I try to show that Marx’s criticism of Hegel’s absolute method could be taken by Hegel as mere explanations of his own method. In the second part, I offer some considerations about what Hegel’s dialectical method is based on the figures of immediacy and mediated immediacy. This paper examines whether Sherlock Holmes’ “Science of Deduction and Analysis,” as reconstructed by Hintikka and Hintikka The sign of three: Peirce, Dupin, Holmes, Indiana University Press, Bloomington, 1983), exemplifies a logic of discovery. While the Hintikkas claimed it does, their approach remained largely programmatic, and ultimately unsuccessful. Their reconstruction must thus be expanded, in particular to account for the role of memory in inquiry. Pending this expansion, the Hintikkas’ claim is vindicated. However, a tension between the naturalistic aspirations of (...) their model and the formal apparatus they built it on is identified. The paper concludes on suggestions for easing this tension without losing the normative component of the Hintikkas’ epistemological model. (shrink)

The demand for more transparency is hardly ever questioned. When it is, it is generally questioned in the name of a protection of privacy. In a traditional liberal understanding, there is a non-alienable “right to privacy” (Warren/Brandeis, 1890). Many political struggles, however, involved ignoring such boundaries, and making public things that were meant to remain private (domestic violence, gender oppression, child abuse etc.). While holding that the distinction between private and public is necessary, it must remain mobile and subject to (...) renegotiation. Civil inattention highlights the importance of disregarding: disregarding what others we share the same public space with do, as long as it is not of public relevance; and disregarding such rules of privacy if a violation of basic human rights is taking place, in order to make such behaviour public. BackgroundThe safety of sleeping pills has increased dramatically during the last 100 years, from barbiturates to bensodiazepines to modern day so-called Z-drugs.MethodsThe circumstances of prescribing sleeping pills in the early 20th century are illustrated by summarizing the main storyline of a novel by Swedish writer Vilhelm Moberg. This is followed by a thought experiment and a theoretical discussion.ResultsIn his 1937 novel Sömnlös (Swedish for sleepless) Vilhelm Moberg portrayed existential and relational distress in relation to insomnia. In a thought experiment, past (...) progresses in sleeping pills safety are projected into the future. Thereby, it is claimed that important issues in the area of philosophy of medicine come to the fore. This leads to a theoretical discussion about broader questions concerning the role of the physician, the goals of medicine (as described by Lennart Nordenfelt), the concept of pharmaceuticalisation (as described notably by sociologist of sleep Simon J. Williams and co-workers), and health enhancement (c.f. Carl Elliott and the alleged wish to be better than well).ConclusionInsomnia is a prism through which important philosophical and sociological questions related to the practice of medicine can be asked. The article focuses on a controversy between historians and psychoanalysts around the testimonial value of a Holocaust survivor (Serena N.). The survivor’s account of the Auschwitz uprising includes factual exaggerations, which has led historians to discard it. Psychoanalysts on the contrary stressed that the testimony accounted for something else: the possibility of resistance in the concentration camp, which gave the inmates hope in their struggle for survival. Survivors’ testimonies, so the argument, have both an epistemological and an ethical content. While (...) philosophy’s insistence on the epistemological dimension of testimony has long generated a disregard for this ethical dimension, it would be equally wrong to construe a pure ethicality of testimony. Testimony is, first and foremost, an entangled social practice, which has tobe acknowledged in its agonal, its aporetic and its performative implications. (shrink)

In Wason’s Selection Task, subjects: process information from the instructions and build a mental representation of the problem, then: select a course of action to solve the problem,under the constraints imposed by the instructions. We analyze both aspects as part of a constraint satisfaction problem without assuming Wason’s ‘logical’ solution to be the correct one. We show that outcome of step may induce mutually inconsistent constraints, causing subjects to select at step solutions that violate some of them. Our analysis explains (...) why inconsistent constraints are less likely disrupt non-abstract versions of the tasks, but unlike Bayesians does not posit different mechanisms in abstract and thematic variants. We then assess the logicality of the task, and conclude on cognitive tasks as coordination problems. (shrink)

Instructions in Wason’s Selection Task underdetermine empirical subjects’ representation of the underlying problem, and its admissible solutions. We model the Selection Task as an interrogative learning problem, and reasoning to solutions as: selection of a representation of the problem; and: strategic planning from that representation. We argue that recovering Wason’s ‘normative’ selection is possible only if both stages are constrained further than they are by Wason’s formulation.
