Beginning with Kant and German idealism, including the German responses to Kant in the work of Hölderlin, Fichte, Schelling, and Hegel, this book then carefully draws out the ways that Bergson, Sartre, Merleau-Ponty, Derrida, Foucault, and Deleuze all work against this understanding of thinking as judging by showing how our experience and our thought precede the categories of judgment.In chapter 1, Somers-Hall carefully sets out Kant's model of thinking and shows how the categories of philosophical thought are fundamentally based on how we judge our sensible intuitions. Judgment is at the center of Kant's thought, and this is apparent in the Critique of Pure Reason, including the famous Transcendental Deduction. Our knowledge has a legislative function in relation to objects, and conscious synthesis takes the form of a judgment. Despite their criticisms of Kant, later German idealists do not fundamentally depart from this modality of judgment that takes place at the center of their philosophy. Even though they put Kant's concepts in motion, it remains a structure of judgment that is understood as dynamic.Chapter 2 turns to Bergson, to show how his emphasis on immediate experience precedes categorical judgement. Bergson distinguishes between temporal and spatial multiplicities, and argues that temporal multiplicities that are expressed in terms of duration underlie the spatial ones that contribute to judgment. Duration is a deeper experience of time that is associated with life. Somers-Hall in chapter 3 examines Sartre's writings on imagination to show how consciousness is a pure relation and an affective mode of thinking that underlies the categorial mode of judgment.Most of these French philosophers develop their accounts of noncategorial sense in either explicit or implicit relation to Kant's philosophy. Merleau-Ponty is no exception, and in chapter 4 we see how it is the organization of perception that gives sense to the world, and this precedes and generates "our reflective categories of judgement." Judgment emerges out of perception, although Merleau-Ponty grounds perception in the embodied person. Derrida does not ground sense or [End Page 365] thinking in a body, but looks for noncategorial grounds that make possible "surface structures of thinking." In chapter 5, Somers-Hall elaborates Derrida's famous nonconcept of différance, which underlies and makes possible our concepts of voice and writing that appear to be oppositions but in fact are not because they rely on each other. Différance is not a concept; it is prior to conceptual determination, and it "operates as an 'origin' that has none of the traits of the structure of judgement."Foucault relies on Kant for his three epistemes of resemblance, representation, and the human being, modern man. Chapter 6 shows how Foucault is concerned in both his archaeology and his genealogy with opening up the structures of power that make any juridical ordering possible. This article investigates the role of the body in Jean-Luc Nancy’s powerful essay Corpus, and critiques it from the standpoint of Agamben’s biopolitics. For Nancy, the body becomes the privileged site of both existence and sense in a way that threatens to obscure the logic of exceptional decision that Agamben takes from Carl Schmitt. As an alternative to Nancy’s understanding of the body, we can see in Deleuze a series of bodies that works in parallel to a series of sense (...) or language, where sense and body do not get collapsed into each other. At the same time, contemporary continental philosophy resists the idealistic separation of thinking and embodiment. Deleuze calls this relation between sense and body a cut, but we could also consider a parallax, following Slavoj Zizek. Finally, African-American historian of religion Charles H. Long’s work complements some of Deleuze’s insights in a more explicitly postcolonial context. (shrink)

Ralph Ellis discusses inspiration in important philosophical and psychological ways, and this response to his essay both appreciates and amplifies his discussion and its conclusions by framing them in terms of sublimation and speech, using insights from the work of Jacques Lacan, Jacques Derrida, and Gilles Deleuze. Inspiration is not derived from another plane of existence, but refers to tbe creation of human meaning and value. Inspiration as a form of sublimation conceives sublimation as a process of substitution that avoids (...) elevating a phenomenon from a lower material to a higher spiritual level, and speech can be seen as a complex form of inspiration that forms along what Deleuze calls a plateau. Speech as inspiration is both physiological breath and productive of cognitive and emotional significance. I conclude with abrief consideration of inspiration as speech in Cormac McCarthey’s novel The Road. (shrink)

Denna tänkta gemenskap av lärda är central för vår förståelse av den tidigmoderna epokens idé-, kultur- och vetenskapshistoria. In the West panentheism is known as the view that the world is contained within the divine, though God is also more than the world. I trace the history of this school of philosophy in both Eastern and Western traditions. Although the term is not widely known, the position in fact draws together a broad range of important positions in 20th and 21st century metaphysics, theology, and philosophy of religion. Media, politicians, and the courts portray college campuses as divided over diversity and affirmative action. But what do students and faculty really think? This book uses a novel technique to elicit honest opinions from students and faculty and measure preferences for diversity in undergraduate admissions and faculty recruitment at seven major universities, breaking out attitudes by participants' race, ethnicity, gender, socio-economic status, and political partisanship. Scholarly excellence is a top priority everywhere, but the authors show that when students consider individual (...) candidates, they favor members of all traditionally underrepresented groups - by race, ethnicity, gender, and socio-economic background. Moreover, there is little evidence of polarization in the attitudes of different student groups. The book reveals that campus communities are less deeply divided than they are often portrayed to be; although affirmative action remains controversial in the abstract, there is broad support for prioritizing diversity in practice. Screen time has become a hot button issue in psychology with researchers fiercely debating its mental effects. If we want to understand the psychological dynamics of technology use, however, a numerical conceptualization of screen time will lead us to gloss over crucial distinctions. To make this point, the present article takes a hermeneutic approach to a negative form of screen time known as ‘phubbing’, which is the practice of snubbing conversational partners in favor of one’s phone. Using interview data, it (...) is demonstrated that whether or not phone use amounts to phubbing, that is, whether or not it tips over and becomes harmful, depends on a host of contextual factors such as relation (who), content (what), purpose (why), timing (when), and communication (how). These findings demonstrate that not all screen time is created equal: what is harmful and inappropriate in one context is benign in another, and vice versa. Simply put, screen time is not a numerical entity whose causal effects we can measure and explain, but a meaningful activity that we must try to understand. (shrink)

Biomedical research has always relied on access to human biological materials and clinical information, resources that when combined form biobanks. In the past, it appears that investigators sometimes used these resources with relatively little oversight, and without the consent of the individuals from whom these materials and information were obtained. Several developments in the last ten to fifteen years have converged to place greater emphasis on the role of individual consent in the creation and use of biobanks. The most important (...) by far is the power of information technology, which has transformed our lives in almost every domain. In the research setting, it is now easy to abstract information from electronic medical records. Computers make it possible to analyze enormous datasets and have contributed in essential ways to the dramatic increases in our understanding of genomics and other areas of biomedical science. Any discussion of the possibility of ‘science and religion’ as a distinct field of study represented a clear step forward from the dominant prejudice of an earlier age. By contrast, it seems hard to deny that a new area of study has emerged, one devoted to the study of the complex and multifaceted relationships between science and religion. The text in this book testifies to the existence of a distinct field of inquiry. One can hope that carefully studying how differently (...) the various religions conceive their relationship with the sciences will help to overcome the tendency, until recently dominant in Western scholarship, to equate ‘religion and science’ with ‘Christianity and science’. In a recent and provocative paper, Matthew Fisher, Mariel Goddu and Frank Keil (2015) have argued, on the basis of experimental evidence, that ‘searching the internet leads people to conflate information that can be found online with knowledge “in the head”’ (2015, 675), specifically, by inclining us to conflate mere access to information for personal knowledge (2015, 674). This chapter has three central aims. First, we briefly detail Fisher et al.’s results and show how, on the basis of recent work (...) in virtue epistemology (e.g., Tiberius and Walker 1998; Roberts and Wood 2007; Tanesini 2016), their interpretation of the data supports the thesis that searching the internet is conducive to the vice of intellectual arrogance. Second, we argue that this arrogance interpretation of the data rests on an implicit commitment to cognitive internalism. Thirdly, we show how the data can be given a very different explanation in light of the hypothesis of extended cognition (e.g., Clark and Chalmers 1998; Clark 2008) – one which challenges the extent to which Fisher et al. are entitled to insist that subjects are actually conflating access to knowledge for personal knowledge in the first place. We conclude by suggesting how, against the background of extended cognition rather than cognitive internalism, we have some reason to think that searching the internet might actually foster (in certain circumstances) virtuous intellectual humility. Christopher Southgate has made important contributions to theodicy and the theory of divine action in light of the contingency in evolution and the suffering of creation. What happens then when one thinks through the implications of contingency for Christology? One can admit that aesthetic and moral judgments are products of a contingent history and yet affirm that they really are valid. Similarly, we argue, one can acknowledge the contingency of Jesus’ existence, actions, and subsequent impact and still maintain that his (...) will was uniquely united with the divine will. Following a critical engagement with the recent work of Keith Ward, we argue that a high Christology is compatible with the actual contingencies of evolutionary and social history, without the necessity of interventionist divine action. Recent literature suggests that intellectual humility is valuable to its possessor not only morally, but also epistemically-viz., from a point of view where epistemic aims such as true belief, knowledge and understanding are what matters. Perhaps unsurprisingly, epistemologists working on intellectual humility have focused almost exclusively on its ramifications for how we go about forming, maintaining and evaluating our own beliefs, and by extension, ourselves as inquirers. Less explored by contrast is how intellectual humility might have implications for how we (...) should conduct our practice of asserting. The present entry aims to rectify this oversight by connecting these two topics in a way that sharpens how it is that intellectual humility places several distinctive kinds of demands on assertion, and more generally, on how we communicate what we believe and know. In this chapter we outline the need to develop ethical frameworks to guide research on the role of animal-orientated health, therapeutic, and service interventions. We discuss findings from our research on uses of animals in therapeutic settings and benefits of human–canine interactions for human health. These stories from the field reveal that current ethics review processes do not recognise the animal as an equal partner in the potential reciprocal benefits and risks of therapeutic human–animal relationships. We explore how these review (...) processes frame research on the relationships between humans and non-human animals and use the ethical review system of Aotearoa/New Zealand as an example. We propose an ethical framework that goes beyond animal welfare legislation and recognises a range of non-human animal capacities. (shrink)

What do we mean by theory in the arts, and what role does it play in that sense? Theory appears as an active, transformative, fluid, and communicative element of art practices, and research in the arts in particular. Theory is the fluid that perfuses and connects the territory of fine art and design, as well as other art forms such as music, architecture, writing, moving images, dance, and theatre. At the heart of this publication is the new field of research (...) in theory and the way the ArtEZ Theory in the Arts research group investigates its possibilities and extends its boundaries. We agree with Vaesen that there is evidence for cognitive differences between humans and other primates. However, it is too early to draw firm conclusions about the uniqueness of the cognitive mechanisms underlying human tool use. Tests of causal understanding are in their infancy, as is the study of animals more distantly related to humans.

On what bases should childrearing rights and resources be allocated to different individuals? Criticising child-centred responses to this question, this chapter sets out a dual interest conception that takes into account the interests of parents as well as children. First, it offers a liberal defence of accommodating the interests of parents when deciding who should rear children. Dworkin’s hypothetical insurance scheme is extended to defend a conception of justice in childrearing in which resources are diverted to those who lack valuable (...) parenting assets, or to parents whose children are difficult or costly to raise. The use of hypothetical insurance to theorize childrearing issues is defended against several objections. Finally, more detail is provided with respect to the nature of the rights that issue from the particular dual interest conception of childrearing that is defended. (shrink)

This chapter offers an account of political or citizenship education. It argues that a central feature of citizenship education in a liberal society is the development of a sense of justice, and the virtues of civility and reciprocity that are constitutive of that sense. The discussion begins with the analysis of Brighouse’s consent-based objections to the shaping of political motivations. An alternative political motivation model is defended, which draws on Rawls’s account of the natural duty of justice. The aims of (...) political education, with respect to the skills, attitudes and values of liberal citizens, are briefly discussed. Education for justice rejects the view that political education should seek to cultivate a sense of nationality. The aims of political education in the context of questions about global justice are considered. Certain educational issues that arise in the non-ideal world from the point of view of developing a sense of justice are addressed. (shrink)

Policy-makers must allocate scarce resources to support constituents’ health needs. This requires policy-makers to be able to evaluate health states and allocate resources according to some principle of allocation. The most prominent approach to evaluating health states is to appeal to the strength of people’s preferences to avoid occupying them, which we refer to as decision utility metrics. Another approach, experienced utility metrics, evaluates health states based on their hedonic quality. In this article, we argue that although decision utility metrics (...) face a number of significant problems, the appropriate response to these problems is not to replace them with experienced utility metrics. Rather, decision utility metrics should be employed in conjunction with experienced utility metrics. Specifically, respondents to decision utility surveys should be provided with the results of experienced utility metrics in an effort to make their decisions better informed and more robust to the deficiencies of decision utility metrics. Ultimately, this approach would improve quality-adjusted life year calculations and enhance the decision-making of policy-makers in allocating resources to support constituents’ health needs. This chapter introduces the central questions addressed in the book and states the main positions to be defended. The focus of the book is briefly discussed, which includes the choices of parents as well as the policies of governments.

The term duty is used in philosophy and law to de scribe the obligation one person owes to another. Yet what these two disciplines mean by duty often differs. Perhaps even more important, a determination by the law that a duty exists has different social consequences than does a similar assessment by philosophy Moral or ethical obligations between individuals make living in society possible, but breach of these obligations usually results only in social opprobrium, personal guilt, or shame. A legal (...) duty, by contrast, enables a person to use the power of the state to enforce claims against another, either by injunction to make the duty-ower fulfill his/her responsibilities or more commonly by award of damages in the event the duty-ower fails to meet these obligations. In some cases, society itself chooses to impose criminal penalties on those who fail to meet certain important obligations.The use of the term duty in both disciplines creates the temptation to extend a definition formulated in one setting to the other discourse. Ronald Green does not bite this apple, but his efforts to draw on the law to support his moral arguments, while not clearly identifying the distinctions between legal and moral obligations, may make it easier for others to see moral and legal duties as the same. Yielding to the enticement to equate moral and legal duties can lead to a host of difficulties. My purpose here is to demonstrate why the duties and privileges proposed by Professor Green are not and should not be adopted and enforced by the law. (shrink)

This article responds to certain objections Jeffrey Morgan raises against the theory of liberal education defended in Justice and Legitimacy in Upbringing. First, it replies to his claim that the theory is too individualistic and pays insufficient attention to considerations of ‘care’. Second, it recapitulates and clarifies the argument that the ideal of autonomy supports the conclusion that it is illegitimate for parents to enrol their children into controversial conceptions of the good life, and seeks to rebut Morgan's criticisms of (...) that argument. It is good to spot young German philosophers working unapologetically in the tradition of Hegel, when it is done as well as this; such spottings are rarer on this side of the Atlantic. In this monograph, based on his dissertation written under Béla Weissmahr at the Jesuit Hochschule für Philosophie in München, Burkhardt examines Hegel’s critique of Kant’s theoretical philosophy, focussing on the three themes of traditional metaphysica specialis: the world, the self, and God; or, in Kant’s critique, the antinomies, (...) the paralogisms, and the transcendental ideal. But the book is not just a treatment of specific passages in Hegel, nor even a summary of Hegel’s critique as a whole; it is an attempt to rethink the fundamental moves of the Transcendental Dialectic in light of the sorts of concerns that Hegel has raised, to speculate first with Kant and then beyond him. If one accepts, as I do, that the Kantian critique of reason remains the most fundamental opponent to speculative philosophy, then the urgency of assessing the strength of Hegel’s answer to Kant is clear.
