Judge Edwin Cameron (South African Supreme Court of Appeal) makes a plea for a radical change of approach and of formal health policy in relation to HIV/AIDS in South Africa. Cameron delivered this lecture at the University of KwaZulu-Natal Forum on 4 May 2006 as part of the Ronald Louw Memorial Campaign, 'Get Tested, Get Treated'. Ronald Louw was a Professor of Law at the University of KwaZulu-Natal, an AIDS treatment activist and co-founder of the Durban Gay (...) and Lesbian Community Centre. He died of AIDS in 2005. Cameron, who was appointed by Nelson Mandela to the high court in 1994, is a high profile AIDS activist and gay rights advocate. He has written about the experience of his decision to make public his own HIV positive status in the book, Witness to AIDS (Tafelberg). (shrink)

Since the Restitution of Land Rights Act 22 of 1994 came into operation, courts have come to attach considerable significance to historian expert testimony when ruling on land claims that made it to court. Therefore, a universal approach had to be adopted. Over the years the Supreme Court of Appeal and Constitutional Court have developed tried and tested methodologies to aid the courts in determining the weight and admissibility of a witness' testimony. In the Salem Commonage case, both the Land (...) Claims Court and the majority of the Supreme Court of Appeal deviated from these precedents by adopting arguably a broader interpretation of the Act than intended. The case is unique in the sense that the dispute involves a commonage that was subdivided via a court order in 1940, resulting in the removal of the remaining black African population from that land. The question therefore was whether or not this group of people fulfilled the requirements for a valid claim as set out in the Act. The Land Claims Court and Supreme Court of Appeal felt that it had. The landowners applied for leave to appeal to the Constitutional Court. The application was granted, but in his judgment, Edwin Cameron agreed with the rationale of both courts, and held that there was a valid claim. This was despite the fact that the testimony of the claimants' 'star witness', Msile Nondzube, was heavily criticised by the landowners as well as a Supreme Court of Appeal judge. The Constitutional Court emphasised that the Act was an extraordinary piece of legislation and had to be interpreted in such a way so as to address the injustices of the past. This included provisions of the Act which dealt with how oral and expert evidence would be dealt with. (shrink)

In this book, Yagisawa defends a type of realism about merely possible worlds and individuals.1 The view defended is much closer to David Lewis’s genuine modal realism than it is to any kind of actualist or ersatzist modal realism, and I think the best way of understanding Yagisawa’s view will be to see where it differs from Lewis’s. To that end, let’s briefly remind ourselves of Lewis’s theory.

The Logic R4 is obtained by adding the axiom □(A v B) → (◇A v □B) to the modal relevant logic NR. We produce a model theory for this logic and show completeness. We also show that there is a natural embedding of a Kripke model for S4 in each R4 model structure.

This paper presents ConR (Conditional R), a logic of conditionals based on Anderson and Belnap''s system R. A Routley-Meyer-style semantics for ConR is given for the system (the completeness of ConR over this semantics is proved in E. Mares and A. Fuhrmann, A Relevant Theory of Conditionals (unpublished MS)). Moreover, it is argued that adopting a relevant theory of conditionals will improve certain theories that utilize conditionals, i.e. Lewis'' theory of causation, Lewis'' dyadic deontic logic, and Chellas'' dyadic deontic logic.

This paper uses an "admissible set semantics" to treat quantification in quantified modal logics. The truth condition for the universal quantifier states that a universally quantified statement (x)A(x) is true at a world w if and only if there is some proposition true at that world that entails every instance of A(x). It is shown that, for any canonical propositional modal logic the corresponding admissible set semantics characterises the quantified version of that modal logic.

This doctoral dissertation is a study of Nietzsche's views on morality in order to assess his contribution to moral philosophy. Towards this end, it examines Nietzsche's understanding of morality as well as the scope of his attack. I then offer a reading of Nietzsche's critique of morality, arguing that he rejects morality insofar as it functions within society to preserve the 'herd' at the expense of 'higher types' whose flourishing resides elsewhere. In short, I claim that Nietzsche rejects morality insofar (...) as it proves inimical to the flourishing of these 'higher types'. I also claim that Nietzsche is more than a mere critic of morality, and that his fundamental 'ethical' preoccupation with exemplary individuals is what motives his critique, and forms the basis of his affirmative ethic of human flourishing. Moreover, I contend that Nietzsche defends his positive morality by presenting the character of Zarathustra , and later himself as exemplars of human excellence who must rely on their ability to convince others performatively, rather than by means of discourse, or argumentation. Ultimately, I conclude that Nietzsche's ethics does not fit comfortably within the moral tradition as he is an opponent of deontological ethics, utilitarianism, and virtue ethics despite certain affinities with the latter. This fact does not detract from the rich contribution that Nietzsche makes to moral philosophy as bode critic and champion of an affirmative ethic. (shrink)

RGLis a version of the modal logic GLbased on the relevant logic R. It is shown that the class of RKframes that verify all theorems of RGLalso verify a scheme that we call (!). If RGLhas (!) as a theorem, however, it is not a relevant logic. I go on to show that not all instances of (!) are theorems of RGL, hence this logic is not complete over any class of RKframes.

A main thrust of much of Quine's work is that meaning, belief, desire, motive and other so-called “intentional phenomena” are under-determined by all possible evidence: the totality of possible evidence could not determine whether two persons meant, believed, desired, or had as motives the same thing. One way to identify a person's beliefs, desires and motives is to frame a theory of his meanings, for then we could ask him what he believed and desired; this will be a theory of (...) translation for his language. But such a theory of meaning, according to Quine, is also not uniquely determined by all the evidence. ThusTo accept intentional usage at face value is … to postulate translation relations as somehow objectively valid though indeterminate in principle relative to the totality of speech dispositions… Such postulation promises little gain in scientific insight …. Locke is often credited with having refuted the Cartesian account of the identity of persons, which locates their identity in the identity of immaterial substance. J. L. Mackie speaks for many when he writes that “Locke makes out a strong case for both his negative theses, that personal identity is to be equated neither with the identity of a soul-substance nor with that of a man …”. I will argue here that Locke’s attack on the immaterial substance theory is, if (...) viewed in the standard way, not only unsuccessful against the Cartesian theory but also unsuccessful even in its own terms. We will see, however, that Locke mingles this line of argument with another one which has not to my knowledge been remarked in the literature on Locke on personal identity; this line of argument is based on a deep agnosticism about the nature of thinking substance, and of substance generally, and it does succeed against a wide range of immaterial substance theories, but not, still, the Cartesian one. At the end of the paper I will make use of these results to sketch how two quite distinct strains of seventeenth-century thought about immaterial substance may be disentangled from each other. This should make us wary of the rather perfunctory characterizations of dualism, and particularly Cartesian dualism, which have been popular recently. (shrink)

This collection of twenty essays, of which five are in French, written by leading English and French literary and historical scholars, deconstructs the ethical and political framework supporting and circumscribing the actions of a powerful elite in France between the early 1600s and the final years of Louis XIV's reign. Reflecting a diversity of individual concerns, the essays, which offer a radical double questioning of the absolute values in which were founded the authority of Church, King and nobility, have been (...) divided into two interrelated parts in acknowledgement of the complex tensions between codes of behaviour and political practice in the different theatrical spaces of government in the real and imaginary world. The dual political and moral theme of this study is not new, but it is one which has always been highly regarded by historians and literary specialists alike. It is in fact one of the 'classics' of seventeenth-century studies, the one to which critics must always return, and to which students must always address themselves, if they are to comprehend the intellectual core of seventeenth-century French studies.
