Although Philippe Ariès’s claims that death has been replaced by illness as our main obsession, I argue that illness is being replaced by wellness, an approach to living that encourages preemptive behavior. I review various critiques of “survivalism,” a view that both insists on our vulnerability and welcomes professional intervention in personal life. The resulting sense of anxiety, critics maintain, extends even to the “minutiae of human behavior,” including diet and fitness. I follow Jackson Lears in tracing these therapeutic commitments (...) to the late nineteenth and early twentieth centuries, and examine a novel set in that period: T. C. Boyle’s The Road to Wellville, a satire about the perils of healthy living. I conclude by adapting Michael Sandel’s arguments against genetic enhancement to the issue of health. (shrink)

MacKinnon IN "WRITING AFTER AUSCHWITZ," Günter Grass describes how at the age of seventeen he stubbornly refused to believe the evidence arrayed before him and his classmates of Nazi atrocities, the photographs showing piles of eyeglasses, shoes, hair, and bones. "Germans never could have done, never did do a thing like (...) that," he recalls thinking. And "when the Never collapsed," he and other young Germans were assured that they were free of responsibility. "It took several more years," Grass reports, "before I began to realize: This will not go away; our shame cannot be repressed or come to terms with." Later, he confesses that those of his age "belonged to the Auschwitz generation—not as criminals, to be sure, but in the camp of the criminals." 1Although one would be hard-pressed to find a novel more dramatically different in style and narrative development than Grass's own dark, audacious fables, Bernhard Schlink's The Reader 2 nonetheless shares this fascination with the notion of collective guilt, in particular the burden of inheritance endured by Germany's "second generation." Set in a university town in the late 1950s, the novel tells the story of a high school student, Michael Berg, who falls in love with Hanna Schmitz, a woman twenty years his senior. Though capable of genuine concern and deep affection, Hanna is oddly secretive, often brusque and officious, occasionally given to cruelty and sarcasm, and prone to unpredictable fits of pique. She also has an endearing quirk: she likes Michael to read to her. Eventually, and without explanation, she vanishes from Michael's life. It is seven years before he sees her again, when, as a law student, he attends a trial of concentration-camp guards, one of whom is Hanna. On campuses across the country in recent years, speech codes have been introduced, the “re-education” of professors (...) urged, visiting speakers on controversial subjects silenced, and classes monitored by administrators eager to do the bidding of various special interest groups. As universities have come more and more to see their role as that of some sort of multipurpose social project, education itself has become less pressing a priority. Thus, while money is found to hire sexual harassment officers, employment equity advisors and “wellness” mavens, academic posts disappear. Those that remain are frequently filled in accordance with crass gender and race-based quotas, and when that fails to guarantee positions for members of bureaucratically favored groups, contrived “schools” and pseudodisciplines proliferate. Many of these developments, however, are simply the manifestation of trickle-down deconstruction, trickle-down Rortyism, trickle-down “politics of difference,” of the sort that Charles Taylor is prone to rhapsodize. Notions of value, nature and merit, of equality, universality and objectivity are dismissed as mere inventions, “imperial” notions designed to favor the powerful and oppress the disenfranchised. For instance, Smith writes: “The textuality of public text-mediated discourse is essential to its peculiar temporal and spatial properties of ubiquity and constancy of replication across multiple and various actual situations of watching, reading, or hearing” (p. 25). Translation? The more one sees, reads or hears a view expressed, the more one tends to believe it’s true. Her concern here, of course, is to establish that whoever controls the means of public debate controls its terms as well, that those means happen to be controlled by neo-conservative interests bent on retarding social progress, and that growing public disquiet about educational reform simply confirms the success of that neo-conservative strategy. But the failure of Smith’s account goes far beyond the thoroughly rebarbative nature of her expression.According to Smith, the very term, “political correctness,” is shorthand for an “ideological code” that has been expressly designed by “neo-conservatives” to caricature the good works of the visionary left. An ideological code, she says, operates as a “free-floating form of control,” which, once established, is “self-reproducing” (p. 27). The consistent histories reformulation of quantum mechanics was developed by Robert Griffiths, given a formal logical systematization by Roland Omn\`{e}s, and under the label `decoherent histories', was independently developed by Murray Gell-Mann and James Hartle and extended to quantum cosmology. Criticisms of CH involve issues of meaning, truth, objectivity, and coherence, a mixture of philosophy and physics. We will briefly consider the original formulation of CH and some basic objections. The reply to these objections, like the objections themselves, involves a (...) mixture of physics and philosophy. The revolt against logical positivism within the philosophy of science has now lasted long enough to produce something of a counter-revolution. As the more strident charges (positivistic analyses misrepresent the most fundamental features of the scientific enterprise and have contributed little or nothing to its clarification) and counter-charges (any attempt to induce a philosophy of science from studies in the history of science rests on a massive genetic fallacy) gradually subside, critical interest is focussing on the presuppositions that guide and (...) structure various interpretations of science. Here epistemological positions, often implicitly assumed, play a pivotal role. In the present article we shall try to make different positions and presuppositions explicit by examining some current developments in the philosophy of science. This article argues that the Universal Declaration of Human Rights (UDHR), by claiming certain inheritances from eighteenth-century American and French rights declarations, simultaneously disavowed others, reshaping the genre of the rights declaration in ways amenable to forms of imperial and racial domination. I begin by considering the rights declaration as genre, arguing that later participants can both inherit and disavow aspects of what came before. Then, drawing on original archival research, I consider the drafting of the UDHR, using as an (...) entry point the reception of the NAACP’s Appeal to the World petition, edited by W.E.B. DuBois. I reconstruct conversations within the drafting committee about the right to petition, self-determination, and the right to rebellion, and the separation of the Declaration from the rights covenants, to illustrate the allegiances between US racial politics and French imperial politics, and their legacies for our contemporary conceptions of human rights. It is assumed that the motion of a particle in spacetime does not depend on the motion relative to it of any observer or of any frame of reference. Thus if the particle has an internal vibration of the type hypothesized by de Broglie, the phase of that vibration at any point in spacetime must appear to be the same to all observers, i.e., the same in all frames of reference. Each observer or reference frame will have its own de (...) Broglie wave for the particle. The phase of the particle's vibration must, by definition, be the same as that of all possible de Broglie waves at the point where the particle is. By superimposing all these possible de Broglie waves, a wave packet is formed centered in space on the particle. The formation of such a packet is discussed with the help of spacetime diagrams; the packet does not spread with time. Joseph Sheban attempts to prove that there is neither an Aryan nor a Semitic race, but rather one white race. He tells us that, according to the Bible, Abraham told his servant "Thou shalt go to my country and to my kindred, and take a wife unto my son Isaac." The servant went to Nahor in Mesopotamia. Now archaeologists have not found Nahor but they have found Ur, the inhabitants of which were Aryan Sumerians. Sheban concludes, "Therefore Abraham must have (...) been of the same race of his city. If the inhabitants of Ur were Aryans, Abraham must have been an Aryan boy." The Jewish people are not distinct as belonging to a Semitic race but only as a religious group, a group which includes diverse members of the single white race. Sheban first discusses the origin of the white race; it was located in the mountains east of the Mediterranean. This single race was a mixture of people with differing physical characteristics, with blond hair, black hair, brown eyes, blue eyes, etc. They had a religion, gods and a code of laws, much of which we still use. Sheban traces the migration of the white race by considering the movement of their gods. Sheban also argues that the Phoenicians are the original discoverers of America, that the Phoenicians did business with Solomon, which enabled Solomon to acquire the silver from America that made him one of the richest men of his age, that Columbus set out to rediscover America, not to go to India. Catharine MacKinnon's investigation of the role of sexuality in the subordination of women is a logical culmination of radical feminist thought. If this is correct, the position of her work relative to radical feminism is analogous to the place Parmenides's work occupied in ancient Greek philosophy. Critics of MacKinnon's work have missed their target completely and must engage her work in a different way if feminist theory is to progress past its current stalemated malaise.

Much feminist literature in general and Catharine MacKinnon's work in particular seeks to do just this. Hare and Vlastos write on Plato, Anscombe, Ackrill, MacKinnon, Owen, and Bambrough on Aristotle, while Ryle gives some of the history of "Dialectic in the Academy." All of the essays were written especially for this volume, and most show a disappointing lack of polish. Vlastos' "Degrees of Reality in Plato" is an exception, and his thesis is an interesting reworking of a familiar criticism. Bambrough has the best offering on Aristotle: an approving assessment of Aristotle's doctrine and method of (...) employment of equivocal terms, an employment which Bambrough praises as "A Paradigm of Philosophy," and compares favorably with the Wittgensteinian doctrine of family resemblances.—E. Within feminist commentary, there has been increasing disillusionment with the radical feminist thesis commonly associated with the work of Catharine MacKinnon. Set against the backdrop of this disillusionment, this article traces the development of an emerging genre of contemporary feminist critique, which has been heavily influenced by the writings of French genealogist Michel Foucault. The work of Foucault, despite focusing upon issues of power and sexuality that have long since been central to the radical feminist project, appears to offer (...) a stark alternative to the accompanying radical feminist emphasis upon grand-scale theories of domination and gender-based victimization. Highlighting the points of divergence between Foucault and radical feminism, this article joins with much contemporary feminist commentary in heralding the Foucaultian position as a worthy alternative, capable of remedying the problems of essentialism and determinism that have plagued MacKinnon's arguments. Unlike much contemporary feminist commentary, however, this article also seeks to highlight the similarities between the theoretical positions of MacKinnon and Foucault. With a particular focus upon Foucault's work on domination, this article charts the reinsertion of asymmetrical power relationships within the Foucaultian landscape, and highlights the impact of that development upon popular understandings of his thesis on micro-politics, bio-power and resistance. Locating the centrality of domination to Foucault's thesis on power, the article will re-establish the relevance of related aspects of that analysis for the purposes of contemporary feminist critique. On 18–19 May 2018, a symposium was held in the Research Institute of Irish and Scottish Studies at the University of Aberdeen to commemorate the tenth anniversary of the death of Ronald W. Hepburn (1927–2008). The speakers at this event discussed Hepburn’s oeuvre from several perspectives. For this book, the collection of the revised versions of their talks has been supplemented by the papers of other scholars who were unable to attend the symposium itself. Thus this volume contains contributions from (...) eighteen notable scholars of different disciplines, ranging from contemporary aesthetics and art theory through to philosophical approaches to religion, education and social anthropology. It also includes a bibliography of Hepburn’s writings. The essays were first published in two special issues of the Journal of Scottish Thought, vols. 10–11 (2018–2019). -/- Ronald William Hepburn was born in Aberdeen on 16 March 1927. He went to Aberdeen Grammar School, then he graduated with an M.A. in Philosophy (1951) and obtained his doctorate from the University of Aberdeen (1955). His tutor at Aberdeen was Donald MacKinnon (1913– 1994), a Scottish philosopher and theologian, the author of A Study in Ethical Theory (1957) and The Problem of Metaphysics (1974). Hepburn taught as Lecturer at the Department of Moral Philosophy at Aberdeen (1956–60), and he was also Visiting Associate Professor of Philosophy at New York University (1959–60). He returned from the United States as Professor of Philosophy at Nottingham University. In 1964, he was appointed as a Chair in Philosophy at the University of Edinburgh and between 1965 and 1968 he was also Stanton Lecturer in the Philosophy of Religion at the University of Cambridge. From 1975 until his retirement in 1996, he held the Professorship of Moral Philosophy at Edinburgh. He died in Edinburgh on 23 December 2008. His philosophical interests ranged from theology and the philosophy of religion through moral philosophy and the philosophy of education to art theory and aesthetics. Notably, Hepburn is widely regarded as the founder of modern environmental and everyday aesthetics as a result of the influence of papers in the 1960s which pioneered a new approach to the aesthetics of the natural world. There are broad commonalities between the projects of Donald MacKinnon (1913–1994) and Stanley Cavell (1926–) sufficient to make the claim that they struck an analogous pose in their respective contexts. This is not to discount their manifest differences. In the milieu of 1960s and 1970s Cambridge, MacKinnon argued in support of a qualified language of metaphysics in the service of a renewed catholic humanism and Christian socialism. At Harvard, Cavell articulated commitments that made him more at home in (...) the world of North American secular political liberalism. Where Nietzsche, Hume, Freud, Heidegger, Emerson and Thoreau were Cavell’s inspirations, Butler, Kant, G. E. Moore, Collingwood and the New Testament were MacKinnon’s. For all the stark differences, commonalities abound and the reason for this can be traced to a shared appreciation of Austin’s contribution to the ‘lingusitic turn’ together with Wittgenstein’s later work. They both developed projects obsessed with the problem of scepticism together with a commitment to a creative re-animation of moral discourse in light of it, with MacKinnon defending a qualified ‘moral realism’, and Cavell, ‘moral perfectionism’. Seen together, a distinctive post-Kantian and post-Wittgensteinian therapeutic moral philosophy is in evidence. (shrink)

Drawing on Austin’s speech act theory, many influential scholars view hate speech in terms of speech acts, namely acts of subordination (MacKinnon 1987; Langton 1993, 2012, 2014; Hornsby and Langton 1998; McGowan 2003, 2004; Kukla and Lance 2009; Langton, Haslanger and Anderson 2012; Maitra 2012; Kukla 2014). Austin’s distinction between illocutionary and perlocutionary acts offers a way to set apart speech that constitutes subordination, and speech that merely causes subordination. The aim of my paper is to address the main (...) objection to accounts of hate speech in terms of illocutionary speech acts, that is the Authority Problem. In particular I will claim that what is missing from previous proposals is attention to the broader social context in which ordinary instances of hate speech are embedded, and in particular, attention to the social status of both the speaker and the audience. While the social position of the speaker has been examined by several approaches, the social position of the audience has too often been neglected. I will show that not only must the speaker have a certain kind of standing or social position in order to perform speech acts of subordination, but also the audience must have a certain kind of standing or social position in order to either license or object to the speaker’s authority, and her acts of subordination. Rape is an important topic in feminist philosophy and the real world. This paper argues that three influential feminists understate the gravity and brutality of rape. They are Andrea Dworkin, Catharine MacKinnon, and Rae Langton. I also propose an alternative analysis of rape that captures its appalling nature. Dworkin and MacKinnon construe rape as something that actors in pornography, with notoriously poor acting skills, can portray as pleasurable. Langton construes rape as a kind of sex act: as sex (...) that is “unwanted,” “unconsensual,” “refused,” or “forced.” I argue that rape and sex are categorically distinct. Rape is an act of violence, not an act of sex. I argue that rape occurs when 1) the genitals, fingers, or hands of one subject, or a foreign object, penetrate the genitals or anus of another subject and 2) one subject (the victim): (a) refuses to penetrate the other’s genitals or anus with one’s genitals, (b) refuses to have one’s genitals or anus penetrated by the other’s genitals, fingers, or hands, or a foreign object; or (c) is incapable of thus refusing (e.g., because one is unconscious, dissociating, or suffering debilitating fear). What MacKinnon offers here is a provocative and original analysis of the meaning of the word "true." His applications are in the areas of statements in general, scientific theories, and theological propositions. One reason for the interest of the book can be found in MacKinnon’s intellectual odyssey. Setting out from a starting-point of standard neo-scholastic textbook philosophy and theology, MacKinnon has come to a highly personal synthesis to which he is willing at least tentatively to apply the (...) label, "ontological pragmatism." Stages along the way—and elements in the synthesis—include Bernard Lonergan’s transcendental Thomism, Wilfrid Sellars’ neo-Kantian version of analytical epistemology, and much detailed work of MacKinnon’s own in analytical philosophy of science. The provocative character of Truth and Expression is likely to bring criticism of the author for misuse of his sources. Wittgensteinian philosophical therapists are likely to bemoan MacKinnon’s relapse into ontologism, even if he qualifies it as a "pragmatic" version. Sellars is likely to object to being lumped with Lonergan, and the latter would probably be upset with the uses to which his former student has put his insights. It may also be worthwhile here to express a demur or two with respect to MacKinnon’s use of his Thomistic sources, e.g., concerning his theory of meaning. It seems that MacKinnon has accepted too naively what might best be called "textbook Thomism." It is true that Aquinas offers a mentalist view, and true also that both Aristotle and Aquinas speak of words as signs of concepts. While this can give rise to a private-language mentalism of the kind Wittgenstein would criticize, it must be recalled that Aristotle and Aquinas were writing not only before Wittgenstein but also before Kant. Whatever can be said of Aquinas’ "mentalism," it is certainly true that in other contexts Aquinas has a social theory of learning that is, at least on the surface, incompatible with a private language theory. Again, with respect to theological truth it seems likely that MacKinnon has been misled by Thomistic manuals, at least when he claims that what Aquinas offers is "a geometrically ordered deductive system" in which "the primacy of Jesus as a revelation of God does not fit." Historical studies of the function of his Summa Theologiae in Aquinas’ scheme for theological education do not support the view of Aquinas as a theological deductive system builder. Nor is it true, as MacKinnon seems to hold, that Aquinas’ view of theological truth is more Aristotelian than biblical. Aside from these qualifications on his use of sources, MacKinnon’s book offers an abundance of critical thinking, analytical insight, and systematic ability. For instance, the reader interested in MacKinnon’s original approach to an adequate epistemology of science will here, in chapter three of Truth and Expression, find the best summary yet of his many contributions in that area. Whether or not, in the last analysis, MacKinnon’s synthesis will be historically significant remains to be seen. What seems likely now is that if it does, the ingredient elements of Lonergen, [[sic]] Sellars, Wittgenstein, Quine, etc., will be more muted, and MacKinnon’s own synthesis will stand on its own. Many liberal societies are deeply committed to freedom of speech. This commitment is so entrenched that when it seems to come into conflict with other commitments (e.g., gender equality), it is often argued that the commitment to speech must trump the other commitments. In this paper, we argue that a proper understanding of our commitment to free speech requires being clear about what should count as speech for these purposes. On the approach we defend, should get a special, technical sense, (...) different from its ordinary sense. We offer a partial characterization of this technical sense. Finally, we argue that if certain theorists (e.g., MacKinnon) are right about what (some) pornography does, then it should fall outside the scope of the free-speech principle. If so, then contrary to first appearances, pornography may not be a case in which our commitments to freedom and gender equality come into conflict. (shrink)

Groundbreaking (and in some cases controversial) works analyzing the cultures of rape, such as Susan Brownmiller’s Against Our Will and Peggy Sanday’s “The Socio-Cultural Context of Rape” (in which Sanday creates the concept of the rape-producing culture—a concept that is central to our argument in this essay), found immediate reception with feminist activists of the 1970s and early 1980s.2 Mary Koss’s work regarding the scope of rape in college settings is also foundational to our study of campus rape.3 Susan Estrich, Catharine MacKinnon, and other feminist theorists in the mid-1980s developed critical apparatuses to shift the understanding of rape, providing a feminist framework wherein rape is interpreted as violence committed against a woman—in opposition to the patriarchal argument that rape is caused by a woman’s actions or is the product of her distortion of events after the fact.4 Angela Davis and bell hooks were deeply influential in framing understandings of the racial and racist aspects of feminist discussions of rape, while legal scholar Sarah Deer has more recently broadened understandings of the racialized discourse of rape, and Lisa Wade has written on twenty-first century hookup culture and the ways that this social landscape promulgates rates of maleon -female rape that are significantly higher on college campuses than in the general population.5 2. The Copenhagen interpretation, which informs the textbook presentation of quantum mechanics, depends fundamentally on the notion of ontological wave-particle duality and a viewpoint called “complementarity.” In this paper, Bohr's own interpretation is traced in detail and is shown to be fundamentally different from and even opposed to the Copenhagen interpretation in virtually all its particulars. In particular, Bohr's interpretation avoids the ad hoc postulate of wave function ‘collapse' that is central to the Copenhagen interpretation. Interpretation of the classics in political theory seems to go in waves. For a while we had John Locke, the bourgeois thinker. Now we seem to be in a Locke-as-radical-democrat phase. Locke-the-bourgeois had problems of its own, but a radically democratic Locke -- not just the old Locke as liberal democrat but Locke as quasi-Leveller -- strains the interpretative imagination more than most; yet in recent years, several different kinds of argument have been advanced in support of it, both textual (...) and contextual. The most effective argument has proceeded by situating Locke in the context of radical Whig politics in the 1670s and '80s, the struggles over religious toleration and the royal succession, in particular the �Exclusion Crisis� of 1679-81. This contextual argument has been accompanied by various textual interpretations having to do with Locke's conceptions of property, consent, representation, the right of revolution and natural law. Among other things, these are supposed to show that while Locke had nothing explicit to say about the extent of the franchise, the weight of evidence suggests that he would have supported a fairly wide franchise, perhaps even something like the (almost) manhood suffrage advocated by the Levellers (at least according to some, and probably the most convincing, interpretations of their ideas). Most recently, in these pages, Martin Hughes, building on the work of James Tully and Richard Ashcraft in particular, has pushed the argument as far as it can probably go. His argument on taxation and suffrage has provided a motivation here for a wider exploration of Locke's views on representation, consent and the franchise. (shrink)
