Hip fractures are common and serious injuries in the geriatric population. Obtaining informed consent for surgery in geriatric patients can be difficult due to the high prevalence of comorbid cognitive impairment. Given that virtually all patients with hip fractures eventually undergo surgery, and given that delays in surgery are associated with increased mortality, we argue that there are select instances in which it may be ethically permissible, and indeed clinically preferable, to initiate surgical treatment in cognitively impaired patients under the (...) doctrine of presumed consent. In this paper, we examine the boundaries of the license granted by presumed consent and use the example of geriatric hip fracture to build an ethical framework for understanding the doctrine of presumed consent. The license to act under presumed consent requires three factors: patient incapacity, clinical urgency and clarity on the correct course of action. All three can apply to geriatric hip fracture. The typical patient frequently lacks capacity. Delays in initiating surgical treatment are associated with markedly increased mortality rates. Last, there appears to be consensus that surgery is the preferred treatment. Nonetheless, because there is a window of safe delay during which treating physicians can stabilize the patient, address reversible causes of cognitive impairment and identify surrogate decision makers, presumed consent should be invoked only as a method of last resort. A medical situation need not be characterized by risk of imminent and certain death for presumed consent to be relevant. Rather, there are two distinct windows that must be considered: the time interval in which action may be delayed without danger, and the time interval needed to obtain a better form of consent. Philosophers sometimes give arguments that presuppose the following principle: two theories can fail to be empirically equivalent on the sole basis that they present different “thick” metaphysical pictures of the world. Recently, a version of this principle has been invoked to respond to the argument that composite objects are dispensable to our best scientific theories. This response claims that our empirical evidence distinguishes between ordinary and composite-free theories, and it empirically favors the ordinary ones. In this paper, I ask whether (...) this response to the dispensability argument is tenable. I claim that it is not. This is because it presupposes an indefensible thesis about when two empirical consequences are distinct or the same. My argument provides some insight into what our empirical consequences are, and I conclude that empirical evidence is radically metaphysically neutral. This gives us some insight into the significant content of our scientific theories—the content that a scientific realist is committed to—and I show how this insight relates to questions about theoretical equivalence more broadly. Governments are increasingly using wellbeing frameworks as a primary way to measure economic and social progress. These frameworks aim to measure a population’s wellbeing in order to develop policies that improve its wellbeing. However, there’s strong disagreement as to what wellbeing consists in, both among philosophers and the general public. So, what is it exactly that governments should be trying to promote when they aim to measure and promote wellbeing? My method is to identify the primary conditions for an account (...) of wellbeing for wellbeing frameworks and find the account of wellbeing that best meets those conditions. When we do this, we find that no existing account of wellbeing used for this purpose is satisfactory. I describe an account of wellbeing that has not been used in wellbeing frameworks, which I call the Reflective Value account. I argue this account succeeds in meeting our conditions and so is the best account of wellbeing for this purpose. (shrink)

A standard framework for business ethics views the inquiry as an application of major ethical theories to specific issues in business. As these theories are largely presented as being principled, the exercise therefore becomes one of applying general principles to business situations. Many adopting this standard approach have thus resisted the implementation of the most prominent development in ethical theory in recent history: that of particularism. In this article, I argue that particularist thinking has much to offer to business ethics (...) and that standard resistance to particularist business ethics is based largely on misunderstandings. I do so by illustrating how the harbinger of particularism, W. D. Ross, countenances the practical wisdom of particularist ethics while being 1) invulnerable to standard objections to particularist business ethics and 2) compatible with the generalism of the standard approach. The Rossian business ethic is therefore one that the standard approach should be eager to include. (shrink)

In a recent response to Persson & Savulescu’s Unfit for the Future, Nicholas Agar argues that moral bioenhancement is dangerous. His grounds for this are that normal moral judgement should be privileged because it involves a balance of moral subcapacities; moral bioenhancement, Agar argues, involves the enhancement of only particular moral subcapacities, and thus upsets the balance inherent in normal moral judgement. Mistaken moral judgements, he says, are likely to result. I argue that Agar’s argument fails for two reasons. Firstly, (...) having strength in a particular moral subcapacity does not necessarily entail a worsening of moral judgement; it can involve strength in a particular aspect of morality. Secondly, normal moral judgement is not sufficiently likely to be correct to be the standard by which moral judgements are measured. (shrink)

Written and set on the banks of the Neva, St Petersburg Dialogues is a startlingly relevant analysis of the human prospect in the twenty-first century. As the literary critic George Steiner has remarked, "the age of the Gulag and of Auschwitz, of famine and ubiquitous torture... nuclear threat, the ecological laying waste of our planet, the leap of endemic, possibly pandemic, illness out of the very matrix of libertarian progress" is exactly what Joseph de Maistre foretold. In the Dialogues Maistre (...) addressed a number of topics that are discussed briefly or not at all in his other works already available in English. These include an apologetic for traditional Christian beliefs about providence, reflections on the social role of the public executioner and the "divinity" of war, a critique of John Locke's sensationalist psychology, meditations on prayer and sacrifice, and a mini-course on "illuminism." The literary form is that of the "philosophical conversation" – one that allowed Maistre to be deliberately provocative and to indulge his taste for paradox, a "methodical extravagance" that he judged particularly appropriate for the eighteenth-century salon. Translator and editor Richard Lebrun provides a full scholarly edition of this classic work, complete with an introduction, chronology, critical bibliography, and generous explanatory notes. For forty years, beginning with the publication of the first modern English translation of the Dialogue Concerning the Two Chief World Systems, Stillman Drake was the most original and productive scholar of Galileo's scientific work of our age. During that time, he published sixteen books on Galileo, including translations of almost all the major writings, and Galileo at Work, the most comprehensive study of Galileo's life and works ever written. His collection Discoveries and Opinions on Galileohas remained in print (...) since its appearance in 1957 and has become the most widely read of all books on Galileo. In addition to his books, Drake published about 130 papers, of which nearly 100 are on Galileo and the rest on related aspects of the history and philosophy of science. This three-volume collection includes eighty of those papers. Drake's papers are an essential supplement to his translations and other books because it was in his papers that he wrote his most detailed technical studies of Galileo's scientific work. There is hardly a subject in Galileo's science that is not considered. Perhaps the most important is the series on mechanics and motion, in which Drake analysed Galileo's manuscript notes recording the experiments by which he discovered and confirmed the law of the acceleration of falling bodies. There are also papers on the notes in which Galileo recorded his discovery of Jupiter's satellites and on other aspects of Galileo's astronomy, including his defence of the Copernican theory. Other papers consider Galileo's life and scientific work in general, exploring what Drake calls the 'scientific personality' of Galileo along with his scientific method and philosophy of science. In addition to the papers on Galileo, there are a number of papers on medieval and early modern science, principally on mechanics, and on the philosophers A.B. Johnson and J.B. Several visual and emotional processes reflect similar underlying patterns of cortical activation. Characteristic individual perceptual style was measured by lateral attentional errors in a standard visual line-bisecting task. The direction of error indicates a predominance of activation in the contralateral prefrontal cortex. Individual differences in mood were measured by the self-endorsement of emotional adjectives. A total of 27 right-handed adults responded to the trait version of the Positive and Negative Affect Schedule (PANAS). As predicted, rightward errors in visual line bisecting (...) correlated positively and significantly with the Positive Affect subscale. The scale adjectives determined and strong had significant correlations with the visual bisecting measure. The negative affect subscale was correlated with neither the line bisecting measure nor the positive subscale. An extension from trait to state measures tested the self-description of current affect using related synonyms and antonyms in a subset of 22 of the participants. Active, dominant, mighty, powerful, and strong were significantly associated with rightward bisecting errors, whereas passive and cooperative were correlated with errors in the opposite direction. The results were incompatible with the valence model (positive-negative), direction model (approach-withdrawal), and movement model (approach-resistance) of the lateral prefrontal substrate of emotion. The action tendency model (active approach-passive yielding) was supported. (shrink)

Technological advancements in information systems over the past few decades have enabled firms to work with the major suppliers and customers in their supply chain in order to improve the performance of the entire channel. Tremendous benefits for all parties can be realized by sharing information and coordinating operations to reduce inventory requirements, improve quality, and increase customer satisfaction; but the companies must collaborate effectively to bring these gains to fruition. We consider two alternative methods of managing these interfirm supply (...) chain relationships in this article. The first, which we have named “dictatorial collaboration,” occurs when a dominant supply chain entity assumes control of the channel and forces the other firms to follow its edicts. We compare and contrast this method with “sustainable collaboration,” in which the parties share resources and engage in joint problem solving to improve the performance of the system as a whole. We use a virtue ethics lens to describe these methods of relationship management to suggest that sustainable collaboration is preferable to dictatorial collaboration both operationally and ethically in the long run. The purpose of this paper is to challenge what is often called the “Uniqueness” thesis. According to this thesis, given one’s total evidence, there is a unique rational doxastic attitude that one can take to any proposition. It is sensible for defenders of Uniqueness to commit to an accompanying principle that: when some agent A has equal epistemic reason both to believe that p and to believe that not p, the unique epistemically rational doxastic attitude for A to adopt with (...) respect to whether p is the suspension of judgment. In this paper, I offer a case wherein the agent has equal epistemic reason both to believe that p and to believe that not p, but the agent is not epistemically required to suspend judgment about whether p. Furthermore, the case is such that there seems to be no uniquely rational attitude for the agent to adopt. (shrink)

Although often neglected, An Examination of the Philosophy of Bacon is crucial to understand the epistemological basis for Maistre's critique of modern science as well as his criticisms of other aspects of Enlightenment thought. Given Maistre's stature in the history of conservative thought, his critique of Bacon remains significant for what it tells us about Maistre's own thought, what it reveals about attitudes toward science in his time, and what it contributes to issues that are still debated today. The work (...) also showcases Maistre's polemical skills and his powerful prose style. Richard Lebrun's annotated translation includes Maistre's complete text, an extensive introduction that places the work in context and provides a critical exposition and assessment of Maistre's criticisms of Bacon, biographical notes on persons cited or mentioned by Maistre, and a bibliography.
