The hospital's clinical ethics committee sought to gauge health-care professionals’ level of knowledge and usage of the Mental Capacity Act 2005 within the hospital trust. The hospital's personnel were asked to complete a 10 part questionnaire relating to the basic contents of the Act. Four hundred questionnaires were distributed and 249 (62%) were returned completed and valid for analysis. A ‘pass-mark’ of 70% (7/10) was assumed; the results showed that 48% of respondents scored ≤50% (≤5/10), 74% of respondents scored <70% (...) (<7/10) and only 24% of respondents scored ≥70% (≥7/10). It was concluded that the Mental Capacity Act 2005 was not being effectively implemented within the Trust. Measures to increase the awareness and usage of the Act have subsequently been instigated. We believe that these measures will improve the awareness and knowledge of the Mental Capacity Act 2005 within the hospital Trust lead to its better utilization. (shrink)

Following his recently expanded _The Problem of the Essential Indexical and Other Essays,_ John Perry develops a reflexive-referential' account of indexicals, demonstratives and proper names. On these issues the philosophy of language in the twentieth century was shaped by two competing traditions, descriptivist and referentialist. Oddly, the classic referentialist texts of the 1970s by Kripke, Donnellan, Kaplan and others were seemingly refuted almost a century earlier by co-reference and no-reference problems raised by Russell and Frege. Perry's theory, borrowing (...) ideas from both traditions as well as from Burks and Reichenbach, diagnoses the problems as stemming from a fixation on a certain kind of content, coined referential or fully incremental. Referentialist tradition is portrayed as holding that indexicals contribute content that involves individuals without identifying conditions on them; descriptivist tradition is portrayed as holding that referential content does not explain all of the identifying conditions conveyed by names and indexicals. Perry reveals a coherent and structured family of contents — from reflexive contents that place conditions on their actual utterance to fully incremental contents that place conditions only on the objects of reference — reconciling the legitimate insights of both traditions. Philosophers and logicians use the term “indexical” for words such as “I”, “you” and “tomorrow”. Demonstratives such as “this” and “that” and demonstratives phrases such as “this man” and “that computer” are usually reckoned as a subcategory of indexicals. (Following [Kaplan, 1989a].) The “context-dependence” of indexicals is often taken as a defining feature: what an indexical designates shifts from context to context. But there are many kinds of shiftiness, with corresponding conceptions of context. Until we clarify what we mean by (...) “context”, this defining feature remains unclear. In sections 1–3, which are largely drawn from [Perry, forthcoming(a)], I try to clarify the sense in which indexicals are context-dependent and make some distinctions among the ways indexicals depend on context. This paper examines the historical rise of both cardiopulmonary resuscitation and the do-not-resuscitate order and the wisdom of their continuing status in U.S. hospital practice and policy. The practice of universal presumed consent to CPR and the resulting DNR policy are the products of a particular time and were responses to particular problems. In order to keep the excesses of technology in check, the DNR policies emerged as a response to the in-hospital universal presumed consent to CPR. We live with (...) this historical concretion, which seems to perpetuate a false culture that the patient's wishes must be followed. The authors are critical of the current U.S. climate, where CPR and DNR are viewed as two among a panoply of patient choices, and point to UK practice as an alternative. They conclude that physicians in the United States should radically rethink approaches to CPR and DNR. (shrink)

This study draws on stakeholder management theory and the resource-based view of the firm to determine the factors affecting a facility’s decision to implementenvironmental management systems and practices. Four levels of environmental commitment to the natural environment are proposed including whether a facility has an EMS, whether a facility has a person responsible for environmental issues, whether a facility is ISO 14001 certified and the comprehensiveness of a facility’s EMS as measured by the number of practices undertaken. This book proposes a philosophical framework, based on the work of John Dewey, to develop a new model for community colleges in the 21st century.

It is often assumed that graphemes are a crucial level of orthographic representation above letters. Current connectionist models of reading, however, do not address how the mapping from letters to graphemes is learned. One major challenge for computational modeling is therefore developing a model that learns this mapping and can assign the graphemes to linguistically meaningful categories such as the onset, vowel, and coda of a syllable. Here, we present a model that learns to do this in English for strings (...) of any letter length and any number of syllables. The model is evaluated on error rates and further validated on the results of a behavioral experiment designed to examine ambiguities in the processing of graphemes. The results show that the model (a) chooses graphemes from letter strings with a high level of accuracy, even when trained on only a small portion of the English lexicon; (b) chooses a similar set of graphemes as people do in situations where different graphemes can potentially be selected; (c) predicts orthographic effects on segmentation which are found in human data; and (d) can be readily integrated into a full-blown model of multi-syllabic reading aloud such as CDP++ (Perry, Ziegler, & Zorzi, 2010). Altogether, these results suggest that the model provides a plausible hypothesis for the kind of computations that underlie the use of graphemes in skilled reading. (shrink)

Some recent commentators have acquiesced in the efforts of some religious groups to co-opt concepts of morality, thus leading many—inappropriately, I believe—to think we must keep all morality out of our civic life and especially out of the reasoning in our legal system. I review examples of the confusion in characterizing the 2003 Lawrence v. Texas decision as a conflict between constitutional rights and religious moral precepts. I argue that this approach capitulates to particular views of morality as religious morality. (...) I consider the appeals to morality in the dissent and the ensuing confusion among commentators about the significance ofthis opinion. I review alternate readings of the Lawrence majority opinion, including proposals that it be considered from the perspectives of the ethicalframeworks of Locke, Mill, or Kant. (shrink)

Increasingly, voices in the growing neurodiversity movement are alleging that individuals who are neurologically divergent, such as those with conditions related to bipolar disorder, autism, schizophrenia, and depression, must struggle for their civil rights. This movement therefore raises questions of interest to scholars in the humanities and social sciences, as well as to concerned members of the general public. These questions have to do with such matters as the accessibility of knowledge about mental health; autonomy and community within the realm (...) of the mentally ill; and accommodation in civil society and its institutions. Perry argues that certain sorts of indexicals are 'essential', in the sense that they cannot be eliminated in favor of descriptions. This paper also introduces the influential idea that certain sorts of indexicals play a special role in thought, and have a special connection to action.

We prove a finite model theorem and infinitary completeness result for the propositional -calculus. The construction establishes a link between finite model theorems for propositional program logics and the theory of well-quasi-orders.

It is shown that over any countable first-order structure, IND programs with dictionaries accept exactly the Π 1 1 relations. This extends a result of Harel and Kozen 118) relating IND and Π 1 1 over countable structures with some coding power, and provides a computational analog of a result of Barwise et al. 108) relating the Π 1 1 relations on a countable structure to a certain family of inductively definable relations on the hereditarily finite sets over that structure.

Many approaches to dignity endorse the Human Scope Thesis (HST), according to which almost all humans and almost only humans have dignity. I argue that justifications for this thesis are doomed to fail. Proponents of the HST can be broadly divided into two camps, according to how they defend this thesis against the Scope Challenge. This challenge states that there is no non-arbitrary way of restricting the scope of dignity that includes almost all and almost only humans. Naturalistic Accounts attempt (...) to find a property which roughly matches the HST, while Conventionalist Accounts attempt to explain why endorsing the HST is necessary to achieve coherence with the human rights project. I argue that neither strategy overcomes the Scope Challenge. I then draw out the important implications of this. Even as dignity retains relevance to all humans, it must move beyond the mere human, so as to include nonhuman animals. (shrink)

While his analysis focuses on religious morality, Perry's argument applies to morality generally. It is hardly difficult to imagine writing about critical phenomenology and walking. One might pause over the method of critical phenomenology as a meta-odos, a thinking of the path. Or consider the steps critical phenomenology takes and the unique pitch of its gait as it traverses the borderlands between phenomenology and critical theory. One might query how these two have the capacity to walk so well side by side, so much so that they can become as one, barely distinguishable against (...) an open sky. Such an inquiry would no doubt track how it is that phenomenology walks toward things, through things, into things, suspending the eye of the natural attitude and proceeding ever so carefully and yet bluntly in search of what springs toward it. But such an inquiry would also track how that very process is a scripted processual, notwithstanding all the suspensions upon which it steps. Who and what writes and rewrites the script of what appears, when, and how? What inscriptions define appearances in advance and diaeretically cut them clean from one another? And what are the unscripted forces still at work? Ferreting out the work of scripts and inscriptions, such an inquiry would pause over the hidden structures that constrict what might feel like a free flight of the mind, a bit of unfettered rambling in the fields of consciousness. Thinking critical phenomenology as walking, then, means tracking the two moving in tandem. Phenomenology pulls toward the horizon of experience, while critical theory veers toward structural analyses. Together, they tread a uniquely illuminating path. (shrink)
