John Rawls’s thesis that a certain package of basic liberties should be given lexical priority is of great interest for legal and political philosophy, but it has received relatively little defense from Rawls or his supporters. In this paper, I examine three arguments for the thesis: the first is based on the two ‘moral powers’; the second, on the social bases of self-respect; and the third, on a Kantian notion of autonomy. I argue none of these accounts successfully establishes 1) (...) the distinct claim of lexical priority, 2) for the complete package of basic liberties, on the basis of reasons that are appropriately public. In turn, I propose an alternative argument, in support of those two claims, based on the social or ‘relational’ conception of equality. (shrink)

This concise overview of the perception of Islam in eight of the most important German thinkers of the eighteenth and nineteenth centuries allows a new and fascinating investigation of how these thinkers, within their own bodies of work, often espoused contradicting ideas about Islam and their nearest Muslim neighbors. Exploring a variety of 'neat compartmentalizations' at work in the representations of Islam, as well as distinct vocabularies employed by these key intellectuals, Ian Almond parses these vocabularies to examine the (...) importance of Islam in the very history of German thought. Almond further demonstrates the ways in which German philosophers such as Hegel, Kant, and Marx repeatedly ignored information about the Muslim world that did not harmonize with the particular landscapes they were trying to paint – a fact which in turn makes us reflect on what it means when a society possesses 'knowledge' of a foreign culture. In recent years, a distinction between two concepts of equality has been much discussed: 'distributive’ equality involves people having equal amounts of a good such as welfare or resources, and ‘social’ or ‘relational’ equality involves the absence of social hierarchy and the presence of equal social relations. This contrast is commonly thought to have important implications for our understanding of the relationship between equality and justice. But the nature and significance of the distinction is far from clear. I examine several (...) accounts of this issue and argue none are entirely satisfactory. In turn, I offer an alternative proposal. Relational equality, on my account, involves a concern with each person having an equal 'civic status'. Healthcare workers who are on the front line of coronavirus disease 2019 and are also undergoing shift schedules face long work hours with few pauses, experience desynchronization of their circadian rhythm, and an imbalance between work hours effort and reward in saving lives, resulting in an impact on work capacity, aggravated by the lack of personal protective equipment, few resources and precarious infrastructure, and fear of contracting the virus and contaminating family members. Some consequences are sleep deprivation, chronic insomnia, stress-related (...) sleep disorders, and post-traumatic stress disorder. These sleep alterations critically affect mental health, precipitating or perpetuating anxiety, stress, and depression, resulting in the inability to regulate positive and negative emotions. Pre-existing sleep disorders are an important risk factor for the development and maintenance of PSTD when individuals are exposed to an important stressor such as a COVID-19 pandemic. At the same time, how an individual regulates the emotion associated with worries during daytime functioning impacts nighttime sleep, precipitating and perpetuating difficulties in sleeping. All of these changes in sleep and emotional regulation also alter the immune system. Sleep deprivation is commonly associated with chronic inflammatory diseases, due to the desynchronizations in circadian rhythms, causing possible psychophysiological disorders and impaired neuroimmune-endocrine homeostasis. From this perspective, we clarify in this article how sleep disorders affect the immune system and emotional regulation, explaining their phenomenological and neurobiological mechanisms, and discussing elements of cognitive and behavioral coping for health professionals to adopt and manage a healthier sleep pattern in the COVID-19 outbreak. How can pain complaints be elicited and analyzed so as to increase the empathic bond between patient and clinician? I will argue that though Wierzbicka’s approach to this question is useful—an exploration of certain abstract dimensions of pain’s meaning—it fails to examine key aspects that are the most useful and crucial for cultural analysis and for building empathic bonds between the clinician and patient. Not just a grammar of pain is needed; rather a biological philology of pain.

After an initial consideration of the three main positions discernible within the current literature on the question of the relationship between mystical experience and its interpretation, attention is focused on a new model of this relationship. by utilizing wittgenstein's notion of "seeing-as" in conjunction with a more complex theory of the nexus between experience and interpretation, it is argued that there are varieties of mystical experience. on the other hand, it is maintained that there is a limiting case of mystical (...) experience, the essence of which is its undifferentiated or contentless nature. it is suggested that the contemplative method, while producing a variety of content-filled mystical experiences, nonetheless is most conducive to the attainment of this "pure" contentless mystical state. Paul Ekman is an American psychologist who pioneered the study of facial behaviour. Bringing together disciplinary history, life study, and history of science, this paper focuses on Ekman’s early research during the twenty-year period between 1957 and 1978. I explicate the historical development of Ekman’s semiotic model of facial behaviour, tracing the thread of iconicity through his life and works: from the iconic coding of rapid signs; through the eventual turn from classifying modes of iconic signification using gestalt categories to (...) classifying modes of producing iconic sign-functions using minimal units; to the role and importance of iconicity for the study of the facial expression of emotion, both in terms of the similarities between iconic and analogue signs as well as the differences between facial coding and linguistic signification. In this intellectual genealogy, I argue not only that Ekman relied extensively upon conceptualizations and terminologies from semiotic thought for the creation of the Facial Action Coding System (FACS), but also that the question of iconicity is the pivotal problem across the many discoveries and innovations in what I term ‘Ekmanian faciasemiotics’. Older adults were considered a vulnerable group for the COVID-19 infection and its consequences, including problems with sleep.AimTo evaluate the prevalence of sleep disorders in older adults, to describe their sleep patterns, as well as to analyse if there were any changes in comparison with the period pre-pandemic.Materials and MethodsOnline survey used for data collection received answers from 914 elderly age range 65–90 years, from April to August 2020. Results: 71% of the sample reported a pre-existent sleep disorder, and some (...) of them worsened during the pandemic, especially Insomnia in women and Obstructive Sleep Apnea in men. No difference in sleep duration before and during the pandemic was found, although there was a worsening of some aspects related to sleep, such as sleep quality, sleep efficiency, awakening quality, sleep latency and nocturnal awakenings, especially in the female gender. Educational level influenced sleep latency, indicating higher sleep latency among those with primary education when compared with the ones with Ph.D.ConclusionThe pandemic had influenced sleep patterns among the elderly, as well as worsening of pre-existent sleep disorders. Female gender and low educational level were considered risk factors for sleep alterations, and high educational level, on its turn, appeared to be a protective factor. (shrink)

Fontane Effi Briest by the German director Rainer Werner Fassbinder is arguably one of the greatest adaptations from literature to screen, and the best Effi Briest adaptation. Although the first reception of the movie, when it appeared in 1974, was not without unmixed reviews, most scholars nowadays share the conviction that it is a masterpiece. Elke Siegel defines the film as a success both at the Berlinale and at the box office. Kreft Wetzel, however, in an interview with Fassbinder in (...) 1974, refers to the ambivalent attitude of the critics abroad at the time of the movie‘s release, to which Fassbinder replies that Fontane‘s language is the foundation of the movie and, hence, the film works to its full extent only in German. Forty years after this interview and judging from the scholarly work carried out on Fassbinder in general and Fontane Effi Briest in particular, it is plausible to claim that Fassbinder‘s art has moved beyond the language barriers and appeals to an audience beyond the German culture and language. A philosophical analysis of the pessimistic and nihilistic conditions of the existential possibilities for blackness and antiblack racism in 21st Century America.

: The status of Ibn 'Arabi and Derrida as thinkers is examined: their disagreements with rational/metaphysical thought on the basis of différance and what Ibn 'Arabi calls al-haqq or the Real. Advantage is taken of the fact that both writers speak of emancipatory projects in their work-the freeing of writing from the shackles of logocentric thought and of the unthinkably Divine (the Real) from the constructs of philosophers and theologians. Just as Ibn 'Arabi believes that no thinker can provide ''a (...) definition of the Real [al haqq],'' Derrida insists that no thinker can escape the history of metaphysics. In the work of both, the reaffirmation of something vital, inconstant, and elusive that defeats all attempts to discuss it plays a common role and evolves according to a common structure. If différance and the Real do seem uncannily analogous-sharing, for example, features like namelessness, radical otherness, intangibility/invisibility/unthinkability, and atemporality, not to mention their paradoxically generative functions-there are also a number of significant differences. Several philosophers argue for the ‘convergence thesis’ for positional goods: prioritarians, sufficientarians, and egalitarians may converge on favouring an equal (or not too unequal) distribution of goods that have positional aspects. I discuss some problems for this thesis when applied to two key goods for which it has been proposed: education and wealth. I show, however, that there is a variant of the thesis that avoids these problems. This version of the thesis is significant, I demonstrate, because it applies to (...) a person’s status as a citizen, which I suggest is the central concern of social or ‘relational’ egalitarianism. This paper examines the following distinctive republican claims: (1) goodwill and virtuous self-restraint are insufficient to realize freedom; and (2) suitable law is constitutive of freedom. In the contemporary literature, these claims are commonly defended in connection with the conception of freedom as nondomination. This account, however, is often rejected on the grounds that freedom as nondomination is moralized and impossible to realize. In response, I propose that the point of protecting people from domination is better understood not as realizing (...) freedom, but instead as giving persons a civic status as equals. Giving persons a civic status as equals, I claim, realizes an important form of social or 'relational' equality, and I distinguish this aim from giving persons a 'status as nondominated’, as some republicans require. I argue that this account vindicates alternative claims about the insufficiency of goodwill and constitutive importance of suitable law—understood in terms of equality rather than freedom—while avoiding the moralization and impossibility objections. I conclude by suggesting some further advantages of the proposed account versus the standard republican view. (shrink)

This article examines the question of the existence of non-Adamic persons-both terrestrial and extra-terrestrial-in early modern Europe. More particularly it looks at how the existence of non-Adamites seriously called into question the credibility of the central themes of the Christian story of the creation, fall and redemption in Jesus Christ in early modern Europe. It analyses the impact on the Christian view of history caused by the discovery of the inhabitants of the New World, speculations about the polygenetic origins of (...) the human race, and discussions about the plurality of worlds. It concludes with some reflections on the monogenetic and polygenetic accounts of the origin of humans in a post-Darwinian context. (shrink)

This article re‐examines a familiar essay of Benjamin’s, ‘The Task of the Translator’, from a Neoplatonic point of view. Beginning with a brief survey of various other Neoplatonic moments in Benjamin’s work , ‘The Task of the Translator’ is considered as a collection of metaphors on the act of translation – the translation as the ghost of the original, or its blossom, or its mantle. Drawing on varied examples from a diverse canon of Neoplatonists – Plotinus, Pseudo‐Dionysius, Eckhart, Nicholas of (...) Cusa, Ibn ‘Arabi – the article shows not just how each of Benjamin’s metaphors has an unexpectedly esoteric genealogy, but also how they conflict with one another to produce a surprisingly apophatic conclusion on the difficulty of translation. Tolerance is not neutrality, nor should tolerance in counselling be equated with a spiritual and emotional vacuum. Tolerance applies to style rather than stance, and a counsellor needs a conception of the ideal — broadly speaking, a moral position. Originally proclaimed against religious and political tyranny, the political ideal of tolerance has in the twentieth century become confused with permissiveness, and is thus sometimes charged with generating many of the ills of modern society, including crime and family breakdown. Counselling has (...) become the universal remedy, replacing punishment and compulsion. The counsellor needs (a) a view of human nature (b) a conception of what is good for those possessing that nature. Constants in the first mean there cannot be too much variation in the second. Society is varied and plural, so the counsellor must be non‐judgemental, but while this means accepting the person, it does not necessarily mean endorsing the conduct. A distinction is drawn between therapeutic and philosophical counselling; the latter considers a problem, where the former focusses on the client, but both may fall short of offering a holistic view. Counselling may also exacerbate some of the problems of modern life by too readily accepting the conditions which cause them. Some ethical problems raised by confidentiality and informed consent are discussed. It is concluded that the counsellor must be tolerant, but not morally ambivalent, nor a relativist. (shrink)

Some theorists argue that relational egalitarianism offers no guidance for questions of justice between non-overlapping generations because the relevant kinds of social relations do not exist. To assess this challenge, I distinguish two versions of relational egalitarianism: an interpersonal approach that focuses on particular kinds of dispositions and attitudes, and an institutional approach that focuses on the kind of status people hold under institutions. I argue that the institutional approach meets the challenge. To illustrate this claim, I discuss several cases (...) involving climate change, public debt, and paternalism.
