I argue that unfortunate formative circumstances do not undermine the warrant for either responsibility or blame. I then diagnose the tendency to think that formative circumstances do matter in this way, arguing that knowledge of these circumstances can play an essential epistemic role in our interpersonal interactions.

The article uses the Sissi trilogy as a case study to offer a new perspective on popular film in the 1950s in general and on Heimatfilm in particular. Rather than reading those films as the expression of a wilful collective amnesia, the article aims to show that, despite representing a sugar-coated world of royal romance, these films form a crucial part of people’s coping with the past. In adopting a phenomenological approach to cinematic representation, the article emphasises the (...) fact that realism is not to be sought in the fantastic setting of the costume spectacle but in narrative structure. The conventionality of narrative patterns and iconographies is brought out as an integral part of a social practice of narrativising, and thereby integrating, historical events within the private sphere of everyday experience. Within this familiar sphere, urgent issues of the 1950s such as gender relations and national identity were addressed and renegotiated. The argument culminates in the claim that it is only by suspending rash moral judgement and acknowledging this ‘privatisation’ as a necessary element in people’s narrative coping with the past that a new perspective on films like Sissi can emerge to provide us with a more complete picture of the 1950s. Over the past few years, individual competencies for sustainability have received a lot of attention in the educational, sustainability and business administration literature. In this article, we explore the meaning of two rather new and unfamiliar moral competencies in the field of corporate sustainability: normative competence and action competence. Because sustainability can be seen as a highly complex or ‘wicked’ problem, it is unclear what ‘normativity’ in the normative competence and ‘responsible action’ in the action competence actually mean. In (...) this article, we raise the question how both these moral competencies have to be understood and how they are related to each other. We argue for a virtue ethics perspective on both moral competencies, because this perspective is able to take the wickedness of sustainability into account. It turns out that virtue ethics enables us to conceptualize normative competence and action competence as two aspects of one virtuous competence for sustainability. (shrink)

Historical video games are uniquely tied to the scientific practices of professional historians, archaeologists, and many other experts. However, since video games are an interactive medium and the most common-sensical view of history is that the past is fixed, it is clear that, at least from a representationalist point of view, there is some unresolved tension. The article explores this predicament and draws heavily from contemporary historical non-representationalism – a position that shifts focus from the idea of representing the (...) real past to the close examination of historical discourse as a complex argumentative practice, relying on evidence and robust theoretical background. To complement the theoretical examination of the problem, the paper examines three examples from historical discourse (the Late Bronze Age collapse, cliodynamics, and Big History) and juxtaposes them against two examples of historical video games of a strategic genre that deal with related topics. It is argued that what makes video games historical is their complex relation to the ongoing historical discourse. (shrink)

Ethical problems in healthcare in Lithuania are identified, existing mechanisms that deal with them are analysed and policy implications are discussed. At least three groups of ethical problems exist in the Lithuanian healthcare system: problems in the healthcare reform process, in interprofessional interaction and in doctor–patient relationships. During the past 15 years, several diverse legal, political and administrative mechanisms have been implemented in Lithuania to tackle these problems. Despite major achievements, numerous problems persist, implying that the focus should (...) be shifted to different mechanisms and interventions. It is necessary to broaden the conceptual understanding of ethics in healthcare and focus on management ethics to tackle ethical problems in Lithuania or in other countries in transition. (shrink)

Moses Isegawa's Abyssinian Chronicles sets out to rewrite history in that it corrects the distorted colonial vision by creating symbols for a new national identity—dealing with self-consciousness, loss of self-identity, and search for identity in coming to terms with the wreckage of war and independence. In Snakepit, Isegawa returns to his native Uganda haunted by greed and megalomania, a period when Idi Amin's dictatorship turned men in power into agents of deception, extortion, and murder. This article critically (...) analyzes the “postcolonial“ imagery in Snakepit as forms of resistance in the aftermath of colonialism and in the story “The Return of Shadow” in Viviane Sassen's collection of photographs Flamboya, and so challenge the way Western eyes have perceived the African continent. Snakepit and Flamboya thus both function as tools with which Africa's collective identity is redefined, the former coping with Uganda's post-European struggle for independence and fight against African corruption, the latter shedding light on the “darkness” Africa has been associated with by casting a post-European shadow on the image of Africa. The medical practice of declawing has received much political debate over the past few years. Yet, empirical and theoretical research on how this practice is maintained and the ethical positions of those who actually participate in this work is lacking. Drawing from 9 months of ethnographic fieldwork in a feline-specific veterinary hospital and open-ended interviews with veterinarians and staff, this study examines veterinary staff members' attitudes toward, and strategies for, dealing with the medical practice of declawing. Specifically, findings show that a number of staff felt uncomfortable with their participation in onychectomy and relied heavily on organizational support structures to cope both with these feelings and the moral ambiguity about the practice. Relying on these structures, the veterinarians and their staff are able simultaneously to define felines as subjects worthy of respect for their quality of life, protect their own self-identity as people who work toward the best interest of animals, and paradoxically support action toward felines that they find morally objectionable. The past year in bioethics in Australia has been relatively predictable. We continue to struggle with rising healthcare costs, though thankfully not on par with numerous other countries due to a relatively positive economic outlook. We are still fighting difficulties associated with higher medical indemnity costs, which have again caused many physicians to leave private practice, particularly in high-risk and specialty practice areas. In response, the federal government delayed the imposition of the medical indemnity levy for (...) physicians until mid 2005. In May, the Australian Law Reform Commission and the Australian Health Ethics Commission issued their final joint report on genetic testing entitled “Essentially Yours” and endorsed use of genetic tests by insurance companies, despite the concerns of some geneticists and many members of the public about their scientific reliability. However, they also advocated the establishment of the Human Genetics Commission of Australia to oversee such uses of genetic tests in terms of both scientific and actuarial reliability, and debates continue over the implementation of this and a number of their other recommendations. And state governments continue to phase in smoking bans in public places, with most implementing full bans in enclosed restaurants and cafes and planning to require provision of nonsmoking areas in all pubs within the next year. a. Michael Oakeshott shared the general concerns of British idealists and leaned heavily upon their conclusions. As with any mode of understanding, historv creates its own object of inquiry. History is an activity built upon postulates and capable of generating conclusions appropriate to itself. The past in history is different from any other past. It can only be evoked by means of subscription to the historical present in which each artifact is recognized as the vestige of a performance (...) which is transformed into circumstantial evidence of a past which has not survived. A great deal of what Oakeshott has to say, especially about coherence, continuity, and identity in difference, stands in sharp contrast to Collingwood's ideas on the reenactment of the past. A living past, relevant to the present or evocative of a future state of affairs, is modally irrelevant to history. (shrink)

This article deals with the material presence of the past and the recent call in the human sciences for a " things." This renewed interest in things signals a rejection of constructivism and textualism and the longing for what is "real," where "regaining" the object is conceived as a means for re-establishing contact with reality. In the context of this turn, we might wish to reconsider the status of relics of the past and their function in (...) mediating relations between the organic and the inorganic, between people and things, and among various kinds of things themselves for reconceptualizing the study of the past. I argue that the future will depend on whether and how various scholars interested in the past manage to modify their understanding of the material remnants of the past, that is, things as well as human, animal, and plant remains. In discussing this problem I will refer to Martin Heidegger's distinction between an object and a thing, to Bruno Latour's idea of the agency of things and object-oriented democracy, and to Don Ihde's material hermeneutics. To illustrate my argument I will focus on some examples of the ambivalent status of the disappeared person in Argentina, which resists the oppositional structure of present versus absent. In this context, the disappeared body is a paradigm of the past itself, which is both continuous with the present and discontinuous from it, which simultaneously is and is not. Since there are no adequate terms to analyze the "contradictory" or anomalous status of the present-absent dichotomy, I look for them outside the binary oppositions conventionally used to conceptualize the present-absent relationship in our thinking about the past. for this purpose I employ Algirdas Julien Greimas's semiotic square. The article deals with the problematic aspects of the concept of identity, the analysis of which helps to point out and to overcome the paradoxes of the “diachronic identity”, the identity of the human person (as identity of its inner cell) and “plural, flexible identity”, and also to clarify the conditions of the legitimate use of these concepts in contemporary philosophy and social science. The article examines two paradigms of identity: the substantive, when the identity of a thing is (...) sought in an invariable property, which provides its synchronous identity, and the formal, when the identity is sought in a form, a structure of the language, which provides its duration in time and helps to understand the diachronic identity. The article shows the importance of the use of “criteria of identity”, introduced by analytical philosophers to find out the way of duration in time of beings which they try to identify, from the material objects to the collective beings, including the identity of the human person. The problem of subjective identity is pointed out as a separate problem. Two main approaches to it are differentiated: mentalist and expressivist. The first is focused on the inner world of the human being, its memories and feelings, creating paradoxes of the «identity for itself» which is not the «identity for the others», whereas the second lets include the social world in the definition of the subjective identity and facilitates the reconsideration of the boundaries of the internal and the external in determining the human self. The article analyses contemporary use of the concept of identity in social science and public discourses and demonstrates the contradiction of the concept of “plural, heterogeneous identity”, which formulates but doesn’t solve the problem of the subjective identity as the identification of an individual with different social groups. The last time I had attempted to manage such a problem delivery was almost twenty years earlier when I had been a Navy Lieutenant fresh out of my surgical internship on temporary assignment to a Marine Corps battle group in the Philippines. David Albert explains why we can typically influence the future but not the past by appealing to an initial low-entropy state of the universe. And he argues that in the rare cases where we can influence the past, we cannot use this influence to knowingly gain future rewards: so it does not constitute control. I introduce an important new case in which Albert's account implies we can not only influence the past but control it: a case where (...) our actions in the present are reliably correlated with several events in the present and past. To deal with such cases, we need to appeal to epistemic conditions on deliberation: being agents requires our decisions being epistemically undetermined at the time we make them. In a world with the past-hypothesis, this implies that deliberation will typically come prior to decision. Once deliberation in this direction is established, correlations towards the past cannot then be exploited for control. To explain why we cannot effectively control the past, we need to appeal to deliberation, whether as part of a defence of Albert's account, or used independently to explain the asymmetry of control. This work, the most comprehensive treatment of alienation ever published, deals with the philosophical, sociological, psychological, religious, political, and literary aspects of the problem. Among the topics discussed are the lost self, the fragmented self, alienated leisure, measurements of social alienation, counterculture, anti-intellectualism, and cures for alienation.

In this contribution, the connection between redressing the past and doing justice in the present is explored by presenting the notion of 'paradox' as a response to 'binary thinking'. In this regard, 'paradox' denotes contradictory, yet interrelated aspects that exist simultaneously. 'Binary thinking' refers to either/or categorical aspects that cannot co-exist. Two paradoxes are explored as a response to increasing polarisation because of a struggle in redressing past injustices: the paradox of remembering and forgetting and the paradox of (...) difference and sameness. This is done by bringing the work of the South African practical theologian, Denise Ackermann, in conversation with the work of the Croatian systematic theologian, Miroslav Volf. From different origins and experiences, both offer a way forward, and a way to move on beyond the devastation that is caused by dealing with injustice, difference and memory in a polarising fashion. The contribution concludes with a reflection on the notion of 'ceding space' from a Trinitarian theological perspective. The ceding of space is proposed as act of transformation, as the outcome of the ideas proposed by Ackermann and Volf, and as a way to live together, 'after the locusts'. (shrink)

Considering the value of archives for dealing with the past processes, especially for the establishment of collective memory and identity, this paper discusses the role of archives in situations of conflicting memories such as in the case of the official Turkish denial of the Armenian genocide. A crucial problem of Turkish-Armenian reconciliation are the divergent perceptions of what to consider as proper ‘evidence’, i.e. as objective, reliable, impartial or trustworthy sources of knowledge in order to prove the (...) Armenian genocide. The aim of this paper is to show how in a general atmosphere of distrust or prejudiced credibility judgments, even technically reliable archival records will be perceived as unreliable and biased, lacking any evidentiary status to factually prove a genocide which is categorically denied. Therefore, this working paper discusses how claims to reliability, objectivity and other similar scientifically and epistemically relevant attributes are understood in archival science as well as memory studies, and emphasizes the problems related to their instrumentalization by political actors within the context of genocide denialism. The Turkish-Armenian context promises many important empirical as well as theoretical insights on the uses and misuses of these attributes, suggesting that measures ought to be taken beforehand to decrease intergroup prejudice and distrust toward the ‘other’, so that archives can be effective in the truth-finding process. This paper mainly addresses the following issues: how Buddhists deal with future existence, the difference between yogic perception and the cognition of ordinary people with regard to future entities, and how Buddhists resolve the contradiction between the theory of momentariness and that of action and its fruit. According to the Sarvāstivādins, a future entity exists in reality as long as there is cognition that has this entity as its object. According to the Sautrāntikas, however, that theory does not (...) hold true. A future entity is just what will occur hereafter, and it is never the case that such an entity exists at present. Śāntarakṣita and Kamalaśīla do not directly negate an opponent’s argument that the distinction between past and future entities is made by yogic perception, but implicitly accept it. They state that because a future entity is situated in a causal stream, yogis can cognize it through purified worldly cognition. As for an effect that will occur in the future, Buddhists do not seem to follow the model that one and the same agent of action will necessarily receive the fruit of past action, which is often seen in other schools such as the Naiyāyikas and Mīmāṃsakas. Rather, Buddhists adopt the theory of the uninterrupted succession of cause and effect. (shrink)

There is a new objection to the Consequence Argument for incompatibilism. I argue that the objection is more wide-ranging than originally thought. In particular: if it tells against the Consequence Argument, it tells against other arguments for incompatibilism too. I survey a few ways of dealing with this objection and show the costs of each. I then present an argument for incompatibilism that is immune to the objection and that enjoys other advantages.

This text analyses how generative AI systems are being employed in current artistic practice to question certain historical visual narratives, creating representations that challenge some conventional perceptions of the past and thus opening up new perspectives on the experience of temporality. In this regard, special emphasis will be placed on some artistic projects based on generative historical photography practices. These are works that develop new ways around ‘archival aesthetics’ (Sekula in October 39:3–64 1986; Buchloh in Deep storage. collecting, storing (...) and archiving in art [Exhibition catalog]. P.S.1, Nueva York, 1999; Guasch in Arte y archivo, 1920-2010. Genealogías, tipologías y discontinuidades. Akal, Madrid, 2015, etc.) by producing visual archives that do not exist or are alternatives to others. We will therefore analyse works that critically examine how these generative systems can contribute to a revision and re-evaluation of the past, as well as to the problematisation of the ways in which photography has been used for the historical record. These poetics invite subtle reflections on the role of the visual archive in the processes of shaping subjectivity and personal and communal identity. In the final part of the text, we will deal with the study of some artists who, through appropriationist strategies and remakes assisted by generative AI models, revise artistic works from the past, specifically from the photoconceptualism of the 1970s. In these strategies, the thematisation of the relations between photographic register and temporality also plays a leading role. (shrink)

Before attempting to use as a historical source the Lucknow Lunatic Asylum case notes of the British colonial period in India, it is necessary to determine which methodological approach is most viable. The approach of historians, who attempt retrospectively to diagnose the patients of the past from the clinical details of case notes, does not satisfactorily deal with the criticism that data on medical case notes is less a series of objective observations and more a product of the (...) power relations of the period. In contrast, medical and postcolonial historians treat the information on the case notes as a set of discursive constructions rather than a series of objective observations. By tracing the discourses in operation during construction of the Lucknow case notes, this paper identifies the ways in which the notes can be read as a series of colonial and medical discursive representations rather than as a set of clinical data. The computational program for theoretical neuroscience initiated by Marr and Poggio (1977) calls for a study of biological information processing on several distinct levels of abstraction. At each of these levels — computational (defining the problems and considering possible solutions), algorithmic (specifying the sequence of operations leading to a solution) and implementational — significant progress has been made in the understanding of cognition. In the past three decades, computational principles have been discovered that are common to a wide range (...) of functions in perception (vision, hearing, olfaction) and action (motor control). More recently, these principles have been applied to the analysis of cognitive tasks that require dealing with structured information, such as visual scene understanding and analogical reasoning. Insofar as language relies on cognition-general principles and mechanisms, it should be possible to capitalize on the recent advances in the computational study of cognition by extending its methods to linguistics. Because of the recent rapid transition in Britain from an elite system of higher education to one in which a much larger propor tion of the population is intended to participate, many students—whose social backgrounds would previously have precluded their involvement in HE—experience strangerhood within academia in a particularly acute form. This paper deals with the experiences of members of an one particular HE course, especially designed for students over 21 years old—such "mature" students are a group who has (...) not been traditionally found in large numbers in British HE Such students describe dramatic changes in their sense of self and in their relationships with others—to the extent that their biographical continuity with their own past becomes problematical.The applicability of an idea touted by certain postmodern writers, "the new selfconsciousness," is considered. Since Plato’s massive critique of the Sophists rhetoric’s ill repute runs through the history of western philosophy denunciating methods of rhetoric as in large part dishonest persuasion strategies which are at most marginally interested in dealing with truths. This judgement falls way too short insofar as it distorts the historically grown stock labeled “rhetoric” not only in the Aristotelian work. With reference to Olaf Müller’s philosophical book addressing the “controversy” between Goethe and Newton about the nature of (...) light, I will study the different rhetorical models and methods used by Newton and Goethe and also Müller himself. It becomes apparent that even works attempting to decide who was right in the long run do far more than trying to evoke true “representations” of facts or truths in the reader. The specific use of language patterns provides deeper insight into an author’s mindset towards the subject area discussed in his work and generally speaking the investigation of the rhetoric of science and philosophy leads to a better understanding of different epistemic cultures both in philosophy and science. The focus of this essay is on how we overcome the past by dealing with it. In this setting, the analysis is of the relationship between ‘moral transactions’ concerning blame, guilt, responsibility, apology and forgiveness and the possibility of transition away from states of trauma. The first section draws on previous work to set out a position on human love as the basis for an understanding of guilt and the ‘moral grammar’ of justice. The second section considers (...) Martha Nussbaum’s claim in Anger and Forgiveness that the idea of transition should be prioritized at the cost of a moral transactional analysis that would engage the moral grammar of blame, guilt, responsibility, apology and forgiveness. The latter is seen as potentially obstructing the transition to a better world. I suggest to the contrary there are grounds for thinking that a successful transition requires relevant moral transactions. (shrink)

The reality is that nurses are human, and some form of implicit bias is inevitable. In my own experience, this issue has reared its head on several occasions. My nursing background is prominently in (...) cardiac and intensive care. Seeing patients at their most vulnerable has become a regular part of my practice. Among some of the most challenging cases for me have been when I assume care of a patient withdrawing from alcohol. As an adult child with close alcoholic family members, many instances of abuse and pain stick with me today and these are brought to the surface when I care for patients with alcohol use disorder. In most cases, I easily find a healthy balance between remaining an understanding-and-empathetic provider and protecting my emotional and mental health as I navigate ethical and moral issues. However, with this patient population, walking that fine line is especially challenging. How do I navigate and manage intensely personal emotions and biases while providing the high-quality care I vowed to deliver regardless of my patient's life choices, addictions, and illnesses? How do I maintain an appropriate level of neutrality and clarity as this patient's behavior and attitude spark emotional triggers? In other words, how do I take care of someone I don't like?Mrs. H was a middle-aged Hispanic woman, barely coherent, but speaking clearly enough that I could understand her slurred speech. Immediate dread washed over me as I realized my assignment included a patient withdrawing from alcohol. The patient's affect, incoherence, and aggression were all too reminiscent of a traumatic past I still work to heal from. My coworkers couldn't understand her insults and obscenities and were therefore unphased except for noting her unruly and erratic behavior. On the other hand, I could understand much of what she was yelling at me and any other staff who bravely walked into her room. My immediate thoughts were that this woman clearly did not want our help. My every attempt to enter her room, speak with her, and provide care were met with an all too familiar rejection and denial that she even had a problem. Yet here she was in a hospital room, and I was her nurse. She verbalized denial of drinking too much when told that she was being treated for alcohol withdrawal. She stated this denial more to herself than to the health care providers in the room, and it was reminiscent of the denial I have seen in my loved ones. This was ironic, I always thought, as the need for such self-deception in and of itself points to the fact that something may be wrong and worth addressing.But denial or not, today, this patient—Mrs. H, was entrusted into my care. She refused treatments and medications, and this put me in a complex ethical predicament—treating a patient that I do not like for the personal issues she reminds me of, and the treatment of a patient against their refusal, as she was deemed incapable of making her own decisions. The latter of these two issues was easiest to put aside. Legally, this patient needed to be treated through her alcohol withdrawal. Once her mental status cleared up, she could sign out against medical advice or choose to remain until a safe discharge plan was in place. There was a protocol and legal guidelines for this situation. However, no guidelines [End Page 10] truly exist when it comes to the management of a patient that you simply do not like. The result can be a near-instantaneous dread each time you must answer that patient's bed alarm, call light, or most basic needs. A negative bias takes over, and it would be an understatement to say that this affects the quality of care. Patients in situations like this—with providers who judge them as I have been guilty of—can easily become subject to derogatory remarks, health inequities, and biased labeling... (shrink)

This study examined the influence of two organizational context variables, codes of conduct and supervisor advice, on personnel decisions in an experimental simulation. Specifically, we studied personnel evaluations and decisions in a situation where codes of conduct conflict with supervisor advice. Past studies showed that supervisors’ advice to prefer ingroup over outgroup candidates leads to discriminatory personnel selection decisions. We extended this line of research by studying how codes of conduct and code enforcement may reduce this form of (...) discrimination. Eighty German managers evaluated and selected candidates from an applicant pool including Germans (ingroup members) and foreigners (outgroup members). Supervisor advice to prefer ingroup members lowered suitability ratings of outgroup members as well as their chances to be selected for an interview. Ethical codes of conduct referring to equal opportunities limited this form of discrimination, but only when codes were enforced by sanctions and integrated into organizational every-day practice. This paper addresses a worry about backwards time travel. The worry is that there is something mysteriously inexplicable about the combination of commonplace events that will inevitably conspire to prevent the time traveler from doing something impossible such as killing her younger self. The worry is first distinguished from other problems for backwards time travel concerning its alleged impossibility or improbability. It is then shown that the worry is misplaced: there is in fact no real problem here. Yet the worry (...) has been widely expressed—so a suggestion is also made as to why it is so easy to get into the position of thinking that there is a genuine problem here, when in fact there is not. Finally, in light of the resolution of the inexplicability worry, a new way of dealing with the other two problems for backwards time travel—concerning its alleged impossibility and improbability—is proposed. One of the strongest arguments for the incompatibility of divine foreknowledge and human free action appeals to the apparent fixity or necessity of the past. Two leading responses to the argument—Ockhamism, which denies a premiss of the argument, and the so-called “eternity solution”, which holds that strictly speaking God does not have foreknowledge—have both come under attack on similar grounds. Neither response, it is alleged, is adequate to the case of divine prophecy. In this paper I shall first state (...) the argument in question and the two responses to it. First, she proposes a novel reading of John Locke's well-known discussion of personal identity and, second, she suggests a way of surmounting difficulties she sees both Lockean view and (...) psychological continuity theories have in dealing with the notion of nonconscious experiences.The criticism that she makes on contemporary theorists basing their view on Locke's work on personal identity (in terms of psychological continuity) seems by and large valid. Schechtman aptly points out that by concentrating on memory as the main constituent of personal identity, they are compelled to appeal to intuitions that are the very target of Locke's criticism (Schechtman 2005, 9) and she proposes that we should focus on Locke's original contention that consciousness is the unifying feature of personal identity. In her reading, this is spelled out as self-referential intelligibility, as capacity to understand oneself as a coherent "process." As far as I can see this description certainly gives a truer reading of Locke than a memory-based account.The second line of reasoning concerns the seeming dilemma she faces when accounting for "unconscious experiences" impact on personhood, as they clearly are "part of our psychological lives" (Schechtman 2005, 16). Here she suggests that developing "Locke's insight in a more satisfying way" is possible in terms of "self-understanding view." She points out how this experiential intelligibility is threatened by in everyday life prevalent bafflement on some of the feelings we have and acts we do. Following Descartes and Freud's examples, this (apparent) unintelligibility is dealt by hypothesizing unconscious "memories or desires or motivations," which then impact our "psychological lives."A question arises here: Is Schechtman's account of personal identity really threatened by the notion of "unconscious experience"? As I see it, a certain streak of psychologism in her writing makes her otherwise coherent account vulnerable in this respect. When assuming that "experiences of which we are not conscious can be a part of our psychological lives" (Schectman 2005, 16), she effectively equates being a person with "psychological being" or being a "psychological subject" (Schechtman 2005, 17). But what work is the notion "psychological" doing here? As far as I can see it, Schechtman could account for Lockean conception of "personal identity" in terms of "consciousness" solely in terms of "process of self-understanding." Of course psychological accounts of personal identity or consciousness are readily available, but the suggested description of the logic of these concepts does [End Page 25] not necessitate them—any such an account is in a sense extraneous to the logic of these concepts.What is suggested here does not basically contradict Schechtman's account of the relation of unconscious to personal identity but only suggests that this account is superfluous. Further, her (mainstream) reading of Freud misses some interesting features of Freud's problematic. In his paper "Psychoanalysis and the personal," Morris Eagle (1988) proposes interpreting Freud's distinction between conscious and unconscious psychological phenomena as the distinction between what is experienced as belonging to one's person and what is experienced as alien in this respect—in terms of "ownership and disownership of mental contents" (Eagle 1988, 92) and concludes that Freudian psychoanalytic theory can be read as being primarily concerned with the problems a person encounters in trying to keep his experience of himself as a person coherent.This reading of Freud has implications for Schechtman's reinterpretation of Locke's conception of personal identity as self-understanding, as the question on the impact of nonconscious phenomena on personal identity would seem to lose its significance here. A more deep going probing into the logic of the Freudian concept of unconscious would be warranted in this context.All in all, Schechtman's account of "personal identity" clearly moves into a sound direction. Increased scrutiny of corporate legitimacy has sparked an interest in “historic corporate social responsibility”, or the mechanism through which firms take responsibility for past misdeeds. Extant theory on historic CSR implicitly treats corporate engagement with historical criticism as intentional and dichotomous, with firms choosing either a limited or a high engagement strategy. However, this conceptualization is puzzling because a firm’s engagement with historic claims involves organizational practices that managers don’t necessarily control; hence, it might materialize differently (...) than anticipated. Furthermore, multiple motivations could jointly affect managers’ approach to organizational history, especially when dealing with conflicting stakeholder demands, rendering it difficult to historicize consistently. Examining the relationship between the legitimacy of critical historic claims, corporate engagement with these claims and corporate legitimacy, the present paper performs a historical case study of the Hudson’s Bay Company’s (HBC) long term use of history in stakeholder relations. The data suggest that under conflicting internal and external pressures, the HBC’s engagement with historical criticism became “sedimented” over time, involving both open and stakeholder-inclusive practices of “history-as-sensemaking” and instrumental “history-as-rhetoric”. Enriching understanding of corporate-stakeholder interaction about the past, this finding may stimulate its generation of social value and corporate legitimacy. (shrink)

The paper deals with the question of religious tolerance in Europe’s past and present. Tolerance within Christianity (and within the other so called “Abrahamitic” or “Biblical” Religions) is one of the main points. However, the reader is also invited to take a brief look at Europe’s pre-christian past. To some extent, the religious situation of the Roman Empire in particular rather seems to resemble our own experiences with pluralistic societies in today’s Europe than medieval and early (...) modern circumstances would do. Even the ancient problems with “religious freedom” can be linked with modern counterparts. So this paper will avoid long retrospectives at the well known facts of Europe’s Christian past such as inquisition and European religious wars in order to deal with some more hidden perspectives of European religious his- tory, which were often obscured by the main historiographical narrative. The emotions have long been an interest for those studying ancient Greece and Rome. But while the last few decades have produced excellent studies of individual emotions and the different approaches to them by the major philosophical schools, the focus has been almost entirely on negative emotions. This might give the impression that the Greeks and Romans had little to say about positive emotion, something that would be misguided. As the chapters in this collection indicate, there are representations of positive (...) emotions extending from archaic Greek poetry to Augustine, and in both philosophical works and literary genres as wide-ranging as lyric poetry, forensic oratory, comedy, didactic poetry, and the novel. Nor is the evidence uniform: while many of the literary representations give expression to positive emotion but also describe its loss, the philosophers offer a more optimistic assessment of the possibilities of attaining joy or contentment in this life.The positive emotions show some of the same features that all emotions do. But unlike the negative emotions, which we are able to describe and analyze in great detail because of our preoccupation with them, positive emotions tend to be harder to articulate. Hence the interest of the present study, which considers how positive emotions are described, their relationship to other emotions, the ways in which they are provoked or upset by circumstances, how they complicate and enrich our relationships with other people, and which kinds of positive emotion we should seek to integrate. The ancient works have a great deal to say about all of these topics, and for that reason deserve more study, both for our understanding of antiquity and for our understanding of the positive emotions in general. This paper examines how international law contributes to contemporary understandings of transitional justice with respect to reparations for victims of gross and systematic human rights abuses. The author surveys the jurisprudence of the Inter-American Court of Human Rights through 2003 to determine how the Court’s practice can be used to guide the formulation of reparatory policies during political transition. Recognizing that the direct application of Inter-American case law to situations of mass atrocity is not always viable in practice, the (...) author analyzes regional human rights jurisprudence, particularly that relating to compensation, to determine what role the Court’s rules can and cannot play as a reference for policymakers and societies faced with the challenge of designing a reparations program. He concludes that while landmark Court decisions like Velásquez Rodríguez provide general normative guidance, there are significant obstacles to extending to the transitional justice context many of the measures, amounts, and formulas relied upon by the Court in awarding compensation. The fairness of compensation outside the courtroom cannot be determined with reference to predetermined rules, but depends on the factual context in which the measures are adopted including the number of victims involved. A better source of comparative inspiration is found in the Court’s growing practice of adopting non-monetary reparations measures to deal with moral harm. (shrink)

The death of a loved one and the repatriation of the remains have become the double pain experienced by many Zimbabweans in South Africa. The double pain is caused by the cultural demand for burial to be conducted at the home country and the financial demands to do so. While previous studies on mission and theology have addressed the pain of death, only few have looked at the second pain of repatriation. The research gap calls for missiologists to seek ways (...) of addressing the double pain as caused by cultural and financial challenges. By conducting interviews with the Zimbabweans in South Africa, missiological ways of dealing with the double pain are sought through the participant observation method. The proposal is that 'a mission to the wounded' as a theoretical framework within missiology is able to deal with these challenges. In addition, there is a need to embrace alternative burial protocol and rethink cremation as an additional solution to financial challenges.CONTRIBUTION: This article revisits a theology of mission by suggesting 'a mission to the wounded' in light of death and repatriation. This monograph deals with the controversy about determinism versus freedom of will. The book is addressed to scholars, especially in the areas of philosophy and psychology, and also to thinking and serious-minded laypersons who are interested in the implications of being human. The book attempts to help the reader understand and resolve the dilemma of determinism. The solution offered by this book has not been previously offered by any other book, even though the literature on this topic is vast. (...) The deterministic position is that all events are effects of previous events and causes of future events, in inexorable cause-effect sequences, which leave no room for intervention of anything outside of the stream of causal relationships, such as free will, thus rendering moral responsibility meaningless. Libertarians believe in freedom of will which is, for them, indispensable for moral responsibility. This controversy can be resolved only by making a clear distinction between two kinds of freedom. In common parlance, freedom means freedom from constraint or compulsion, which can be designated as contra-constraintual freedom. The second meaning of freedom is freedom from causation, which has been referred to as contra-causal freedom, and this is the meaning that is inherent in the concept of freedom of will. If we have contra-causal freedom, we can choose or decide to act irrespective of antecedent conditions including our own past. The distinction between contra-causal freedom and contra-constraintual freedom is the key to the resolution of the controversy between determinism and libertarianism. The absence of contra-causal freedom prevails at the theoretical, conceptual, objective, abstract, or as-is level, whereas contra-constraintual freedom functions at the practical, behavioral, subjective, concrete, or as-if level. All we need for moral responsibility is contra-constraintual freedom, and not contra-causal freedom. At the as-is level, there is neither freedom nor dignity, neither morality nor accountability, and neither purpose nor meaning for human existence. It is only at the as-if level that these terms make any sense at all. In theory there is no choice from alternative courses of action in light of the absence of contra-causal freedom; in practice there is, in direct proportion to contra-constraintual freedom. (shrink)

It was so strong that even a photographic mission designed to record the essence of rural America could not help but capture the energy of urbanization too.
