This case study appeared in full in the last issue of Research Ethics Review (2006; 2(3): 108). It concerned the supervision of Simon Shaw, a senior radiographer undertaking an MSc, whose research focused on the professional and parental response to fetal tissue abnormalities.

Bioethicists are often interested mostly in national standards and institutions, but state governments have historically overseen a wide range of bioethical issues and share responsibility with the federal government for still others. States ought to have an important role. By allowing for multiple outcomes, the American federal system allows a better fit between public opinion and public policies.

In 1992, the Joint Commission on the Accreditation of Healthcare Organizations (JCAHO) passed a mandate that all its approved hospitals put in place a means for addressing ethical concerns.Although the particular process the hospital uses to address such concernsmay vary, the hospital or healthcare ethics committee (HEC) is used most often. In a companion study to that reported here, we found that in 1998 over 90% of U.S. hospitals had ethics committees, compared to just 1% in 1983, and that many (...) have some and a few have sweeping clinical powers in hospitals. Conceived as a solution to clinical dilemmas, and now required by organizations for hospital accreditation, ethics committees have been subject only to small-scale studies. The wide use of ethics committees and the diverse roles they play compel study. In 1999 the University of Pennsylvania Ethics Committee Research Group (ECRG) completed the first national survey of the presence, composition, and activities of U.S. healthcare ethics committees (HECs). Ethics committees are relatively young, on average seven years in operation. Eighty-six percent of ethics (...) committees report that they play a role in ongoing clinical decision making through clinical ethics consultation. All are engaged in developing institutional clinical policy. Although 4.5% of HECs write policy on managed care, 50% of HEC chairs feel inadequately prepared to address managed care. The power and activity of ethics committees parallels the composition of those committees and the relationship of members to their institutions. The role of ethics committees across the nation in making policies about clinical care is greater than was known, and ethics committees will likely continue to play an important role in the debate and resolution of clinical cases and clinical policies. Long-standing theoretical education frameworks and methodologies have failed to provide space for the role mental health can play in mediating educational consequences. To illustrate the need for such space, Ebony McGee and David Stovall highlight the voices of black undergraduates they have served in the capacities of teacher, researcher, and mentor. Building from the theoretical contributions of intellectual giants like Frantz Fanon and W. E. B. Du Bois, the authors attempt to connect oppressive social systems to the psyche (...) of the oppressed in a way that is relevant to black students. McGee and Stovall pose a challenge to the current research trend of attributing the survival of black students at traditionally white institutions primarily to grit, perseverance, and mental toughness, noting that research on the aforementioned qualities often fails to properly acknowledge multiple forms of suffering. Utilizing the lens of Critical Race Theory, the authors also challenge the construct of grit to consider the extent to which the mental health concerns of black students go undetected. Although critical race theorists have unmasked and attacked the racial trauma experienced at all levels of the educational system, the connection of CRT to mental health and wellness research is in its embryonic stages. For these reasons, McGee and Stovall argue that CRT scholars need to incorporate praxis to address mental health and wellness in order to address a fuller spectrum of black students' racialized worlds. Ultimately, they seek interdisciplinary perspectives that can help identify and foster strategies to support black students in the project and process of healing from multiple forms of racialized trauma they experience within and beyond their educational encounters. This book uses real-life experiences of diverse people to illustrate that, if not understood and addressed, situational minorities at school or work are unlikely to perform at their highest potentials.

In lieu of an abstract, here is a brief excerpt of the content:184 THE ECONOMIC THOUGHT OF DAVID HUME David Hume's views on economics are expressed in his Essays, Moral, Political and Literary, Part II (1752). He was a contemporary of Adam Smith and read Smith's The Wealth of Nations shortly before his death. Some commentators have suggested that Hume exercised some influence over Smith's views on economics; others are not so sure. Hume's commentators over the last 200 (...) years have emphasized his theory of knowledge, doctrine of causality and belief, theory of morals and historical writing. His views on economics have been relatively neglected. The purpose of this essay is to summarize and clarify Hume's views on economics. Commerce and Trade Hume's essay "Of Commerce" is an extension of his view of property rights. Just as government should not impair property rights, it should not impair commerce, which is the freedom to contract between consenting parties. But Hume was not a 'pure' advocate of laissez-faire. He supported the infant industry argument: A tax on German linen encourages home manufacturers, and thereby multiplies our people and industry. A tax on brandy encreases the sale of rum, and supports our southern colonies. The bulk of workers are employed either in argiculture or manufacturing. In the more primitive societies, almost everyone is employed in agriculture (husbandry), and as agricultural techniques are improved, the land becomes able to support more nonagricultural workers, including artisans and providers of luxuries as well as manufacturers. Some of these 185 surplus (i.e., nonagricultural or manufacturing) workers are sometimes appropriated by the sovereign for use in the army or navy (OC 256), which prevents them from producing luxury goods and services, and leads to a different kind of state than would exist if their labor were not so appropriated. Increases in industry, the arts and trade generally increase both the power of the sovereign and the happiness of the people (OC 260). Trade is something that is mutually beneficial -- both parties gain. Hume spends a great deal of time refuting the idea that one nation's gain is another's trade loss. Thus, trade is a win-win rather than a win-lose situation, as some modern-day mercantilists (such as Thurow fThe Zero Sum Gamel and Batra G The Great Crash of 1989l)would have us believe. Hume views everything in the world as purchased by labor, and sees labor as being caused by people's passions (OC 261). In modern language, one could say that wealth is produced either from physical or mental labor, and that it is individual incentive that causes the human action to begin in the first place. Of course, this view overlooks the fact that labor does not exist in a vacuum, but is mixed with land and perhaps capital (which can be seen as the result of accumulated labor). Exchange occurs when producers of a commodity produce more than they can consume. At that point, they trade their surplus for other goods and services (OC 261). In peacetime, the farmers' surplus goes toward the acquisition of manufactures or the cultivation of the liberal arts. In war, the surplus can go toward the support of an army or navy. The state becomes more powerful as it can produce increasingly beyond subsistence, what Hume refers to as employment beyond mere necessities (OC 186 262). But rather than encouraging the increase in state power by force, such increase is best accomplished by allowing individuals to produce as much as they want, which they will do automatically in the absence of coercion, and then appropriate part of the surplus: It is a violent method, and in most cases impracticable, to oblige the labourer to toil, in order to raise from the land more than what subsists himself and family. Furnish him with manufactures and commodities, and he will do it himself. Afterwards you will find it easy to seize some part of his superfluous labour, and employ it in the public service, without giving him his wonted return. Philosophy has long been fascinated by miracles, and with good reason. Where, however, the problem of the miracle once offered unparalleled insight into the inner workings of natural laws and of human knowledge, today, the attention commanded by it is essentially political. The sovereign’s miraculous suspension is the most well studied of these political dimensions, but this formulation is, in fact, ill-suited to the complexities inherent in the concept of the miracle. Political theology understands the miracle poorly, for it captures (...) only the inaugural movement of exception; it knows nothing of the social and political conditions it inspires. A key claim defended in this article is that the miracle possesses continuing interest for philosophy precisely because it lies in the heart of contemporary political formations, instituting a bond that tethers a collective to its present. It is thus more interesting as a figure of inception than of exception. The miraculous is uniformly distinguished as the unengendered, the neutral point of equilibrium against which any distribution of beings is measured. This is the meaning given the miraculous in the thought of Gilles Deleuze and Félix Guattari, and this article frames the political aspect of that theme by developing their concept of miraculation, which foregrounds the movement of inception. The article works out a conceptual genealogy, tracing the descent of the miracle back from Deleuze and Guattari to Baruch Spinoza and David Hume. Each contributes an element essential for the constitution of miraculation. It is argued that the miracle has always bound ‘desire and the social’, though in diverse ways. (shrink)

In a paper that has recently attracted discussion, David Shaw has attempted to criticize the distinction the law has drawn between withdrawing and withholding life-sustaining measures on the one hand, and euthanasia on the other, by claiming that the body of a terminally ill patient should be seen as akin to life support. Shaw compares two cases that we might, at least at first, regard as distinct, and argues that they are not. In the first case, Adam, who is (...) dying of lung cancer, is connected to a ventilator and requests to be disconnected. In the second case, Brian, also dying of cancer, is not connected to anything, and so he requests his doctor to provide him with a lethal injection. In the first case, Shaw contends, Adam is being kept alive by a ventilator. In the second case, Brian is being kept alive by his body. (shrink)

I defend a formulation of the Ramsey Test with a condition for accepting negations of conditionals. It is implicit in the assumptions of the triviality theorems of Gärdenfors, Harper, and Lewis; and it allows for a unified proof of those theorems, from weaker assumptions about belief revision. This book is a defense of modal realism; the thesis that our world is but one of a plurality of worlds, and that the individuals that inhabit our world are only a few out of all the inhabitants of all the worlds. Lewis argues that the philosophical utility of modal realism is a good reason for believing that it is true.

Dilthey’s moral writings have received scant attention over the years, perhaps due to his apparent tendency toward relativism. This essay offers a unified look at Dilthey’s moral writings in the context of his Kantian-styled “Critique of Historical Reason.” I present the Dilthey of the moral writings as an observer of reason in the spirit of Kant, watching practical reason devolve into error when it applies itself beyond the bounds of possible experience. Drawing on moral writings from across Dilthey’s corpus, I (...) retrace Dilthey’s argument that moral theories from Kantianism and utilitarianism to natural law theory suffer significant motivational problems because of the way they transcend the “synthesis” of moral perception. Dilthey’s argument suggests that abstract moral theory is always bound to seem unmotivating and unreal from the standpoint of lived experience, and perhaps that, to avoid this, moral philosophy should confine itself to more situated, case-specific judgments. I present evidence for a systematic complexity-coherence tradeoff in cognition. I show how feasible strategies for increasing cognitive complexity along three dimensions come at the expense of a heightened vulnerability to incoherence. I discuss two normative implications of the complexity-coherence tradeoff: a novel challenge to coherence-based theories of bounded rationality and a new strategy for vindicating the rationality of seemingly irrational cognitions. I also discuss how the complexity-coherence tradeoff sharpens recent descriptive challenges to dual process theories of cognition.

It is shown how a diagram on the reverse of a Greek coin of Aegina of the fifth century b.c.e., is simply constructed with the help of Proposition 36 of Euclid’s Book on Divisions [of Figures], and it is conjectured in the absence of contemporary evidence that, since Euclid expressly designated this proposition to be the last in the book, he may have had in mind the diagram, which, some 200 years after its appearance on the coinage, may still have (...) played a significant role in geometry. How should we understand the fundamental difference between objective and subjective theories of well-being? Authors typically presuppose some understanding of the divide but don’t do much to explain why that understanding is better than its rivals or gets at the heart of the distinction. We explicate criteria for a better account of the divide and use such criteria to critique extant understandings of the divide. We then propose and defend a new understanding of the divide, one that characterizes subjectivism in (...) terms of the normative role it grants to warrantless attitudes in grounding benefits to subjects. The advent of AI calls for an existential self-redefinition of humanity. It necessitates the establishment of a pluralistic global humanist culture that enables us to coexist in the new world of active media and autopoietic technology. In this paper, related philosophical questions give rise to the proposal of a novel metaculture that elevates human heritages and cultural memories to the plane of a digital AI- based infrastructure. I argue for a balanced and holistic approach to human-to-human and human–AI interactions and (...) metaculture that can be developed in the form of combinatorial “metagames” that reflect the potential of human consciousness, transcend the boundaries between technology, human embodiment and biology, the arts, sciences and humanities, and philosophy, and, finally, include the element of meaningful coincidence and spontaneity “in the second potency.” Hermann Hesse’s final novel, The Glass Bead Game, offers a key to understanding this basic idea. His vision is extremely relevant today. Based on this, the concept of cultivating global cultural memories through innovative aesthetic-epistemic “Glass Bead Games 2.0” is discussed further from a systematic angle. To complement this, reference is also made to Hesse’s own source of inspiration: Novalis’s “encyclopedist” approach interlinks aesthetic and epistemic productivity in a way that could become a major starting point to create a new holistic metaculture in the Age of AI. On one possible view of practical reason, that capacity is subject to a standard of correctness determined by independently obtaining facts. This view has recently come under attack, notably in Jeremy Fix’s ‘Intellectual Isolation’. The relevant view, he claims, treats practical reason as a species of theoretical reason and is unable to account for the role that practical reason plays in rational agency. His case relies, however, on a certain conception of theoretical reason: a contemplative conception according to which theoretical (...) reason is practically inert. By embracing that conception, he is led to suppose that exercises of a capacity with an external standard of correctness could not, by themselves, move a subject to act. But the contemplative conception is hardly compulsory. A view according to which practical reason is subject to an external standard need not take the shape, nor involve the corollaries, that Fix, and others, assume it must. Or so I argue. (shrink)

The question of who possesses the moral rights of creative works made using the assistance of artificial intelligence (AI) is not fully resolved. In particular, the relationship between moral rights and moral agency in the production of creative works has been under-investigated in the literature. I explore these topics and argue that moral agency, intentionality and values-based reasoning are crucial for the entitlement of moral rights and hence the assignment of authorship. I conclude that, despite their great power to produce (...) creative works, current generative AI systems cannot be the moral author of such works due to the absence of intentionality with values-based reasoning. Instead, the human end-user of a generative AI system is the moral author in most cases. (shrink)

Everyone suspects that nudging offends against the nudged’s autonomy. But it has proved rather difficult to say why. In this paper I offer a new diagnosis of the tension between even the best cases of nudging and the value of autonomy. Relying on the distinction between autonomy as sovereignty and autonomy as non-alienation, I show that nudging need not offend against either. But it does sever the tie between them, it undermines the possibility of achieving non-alienation *in virtue of* having (...) sovereignty. Analogies to common themes in virtue epistemology help to establish this point. If true, this diagnosis improves our understanding of nudging, of course, but it also improves our understanding of the value of autonomy—the full value of autonomy has the structure that is shared by many other achievements—that of an objective element, a subjective one, and the appropriate relations between the two. How should we assess systems whose mnemonic status is contested? There are, for instance, debates over whether immune memory is “really” memory, or akin to memory as ordinarily attributed to human cognition. In this paper, I challenge two arguments often given by detractors in this debate. The first is that the system does not exhibit errors exemplified in human memory. The second is that it can be described and explained in causal terms alone. I argue that our limited knowledge of (...) the causal basis of immunological phenomena and human memory undercuts our ability to conclude that one is merely causal while the other is not. By consequence, it is unclear why we should reject that the immune system exhibits these errors. With my challenges, I question whether we are consistent in assessing alleged mnemonic systems. Though we have schematic causal accounts of both systems, we have differing expectations of what we can conclude about them. Yet, it is unclear what might warrant appeals to these expectations. In recent work, Benjamin Ferguson and Sebastian Köhler take interest in the claim that permissible acts are always morally better than impermissible acts ( bop ). They argue that bop is both commonsensical and supported by powerful theoretical considerations. They then present a series of cases in which common moral claims appear to conflict with bop. In this paper, I first show that some of the conflicts Ferguson and Köhler identify are merely apparent, as they arise only given theoretical commitments (...) regarding the value of actions that supporters of the relevant claims can and do reject. In the second half of the paper, I address two other cases Ferguson and Köhler discuss. I argue that the conflicts with bop in these cases are genuine, but also to be expected, because these cases involve supererogation, and our best theories of supererogation are in tension with Ferguson and Köhler’s case for bop. In proof-theoretic semantics, model-theoretic validity is replaced by proof-theoretic validity. Validity of formulae is defined inductively from a base giving the validity of atoms using inductive clauses derived from proof-theoretic rules. A key aim is to show completeness of the proof rules without any requirement for formal models. Establishing this for propositional intuitionistic logic raises some technical and conceptual issues. We relate Sandqvist’s (complete) base-extension semantics of intuitionistic propositional logic to categorical proof theory in presheaves, reconstructing categorically the soundness and (...) completeness arguments, thereby demonstrating the naturality of Sandqvist’s constructions. This naturality includes Sandqvist’s treatment of disjunction that is based on its second-order or elimination-rule presentation. These constructions embody not just validity, but certain forms of objects of justifications. This analysis is taken a step further by showing that from the perspective of validity, Sandqvist’s semantics can also be viewed as the natural disjunction in a category of sheaves. (shrink)

The making of mistakes by organisms and living systems generally is an underexplored way of conceptualising biology and organising experimental research. We set out an informal account of biological mistakes and why they should be taken seriously in biological investigation. We then give an indirect defence of their importance by applying the concept of mistake-making to three kinds of activity: timing, calculation, and communication. We give a range of examples to show that mistakes in these kinds of behaviour can be (...) found across a diversity of scales and systems. We also suggest ideas for empirical research that naturally arise from these cases. The reality and potential for mistake-making across such a wide range of biological entities shows that it is not a purely human phenomenon. Getting it wrong seems to be central to biology as a whole, and to be a potentially productive organising principle for generating novel research questions and experimental hypotheses. (shrink)
