Across a number of countries including Venezuela, Colombia, Bolivia, Ecuador, Honduras, Costa Rica, and Nicaragua, incumbent presidents in Latin America have recently sought to amend their constitutions to eliminate or weaken presidential term limits. In some cases, these efforts to extend terms have been part of broader projects to consolidate power, weaken other state institutions, and tilt the electoral playing field in favor of incumbents. From a legal perspective, these cases are interesting because they highlight the limits of tools limiting (...) constitutional change, such as eternity clauses and the unconstitutional constitutional amendment doctrine, to constrain potentially anti-democratic or anti-liberal forms of constitutional change. Although constitutional texts in most of these cases gave courts ample ammunition to reject attempts to eliminate term limits or at least to force those changes down more demanding paths, courts did not stand in the way of most of these efforts and in some cases even used the doctrines to eliminate rather than protect term limits. The case studies highlight the extent to which the “superficial” spread of doctrines controlling constitutional change may fail to block, and indeed may promote, forms of constitutional change that threaten liberal democratic constitutionalism. It also suggests possibilities for deepening the effectiveness of transnational dialogue on these issues. (shrink)

This brief essay contrasts two modes of constitutional change: abusive constitutional projects that seek to erode democracy and restorative constitutional projects that aim to repair eroded democratic constitutional orders. Constitutional democracies are eroded and restored via the same mechanisms: formal processes of constitutional amendment and replacement, legislative amendment, changes to executive policies and practices (or respect for conventions), and processes of judicial decision-making. Under the right conditions, abusive uses of these mechanisms for antidemocratic ends can be reversed by prodemocratic or (...) restorative uses. The more difficult question is what kinds of political discourses are most likely to sustain successful processes of democratic rebuilding. In recent work, we have pointed to the role sometimes played by liberal democratic discourses as purported justifications for processes of abusive constitutional change: we label this the rise of “abusive constitutional borrowing.” Less well understood are the kind of discourses likely to sustain successful democratic healing or rebuilding. Often, the most popular discourse is a restorative one, which focuses on repairing damage caused by authoritarians and returning to a constitutional status quo ante. In this essay, we discuss the advantages and disadvantages of restorative constitutionalism as a response to prior episodes of democratic erosion. (shrink)

This paper presents a critique of David Benatar’s arguments on the badness of all human lives. I argue that even if Benatar is right that there is an asymmetry between the good and the bad in life so that each “unit” of bad is indeed more effective than each “unit” of good, lives in which there is a lot of good and only little bad are still overall good. Even if there are more unfulfilled than fulfilled desires in life, (...) a distinction should be drawn between desires to fulfill important goals and desires to fulfill trivial ones, and Benatar’s claim is untrue of the former. Benatar’s claim that we cannot really know that the quality of our own lives is good is problematic, but even if it were true, it would not show that we cannot estimate correctly the quality of other people’s lives, which is the point at issue. A recent claim that in quantum chromodynamics in the Landau gauge the gluon propagator vanishes in the infrared limit, while the ghost propagator is more singular than a simple pole, is investigated analytically and numerically. This picture is shown to be supported even at the level in which the vertices in the Dyson- Schwinger equations are taken to be bare. We offer a reconstruction of Richard Price’s intuition-based epistemology of normative essences, highlighting its key elements and showing how it differs from the approaches taken by other intuitionists such as Thomas Reid and G. E. Moore, as well as sentimentalists such as Francis Hutcheson and David Hume. While our analysis aims to shed light on Price’s moral epistemology, it also seeks to contribute to contemporary debates about the epistemology of essence, advancing a general intuition-based theory. These two goals are (...) related, for the former operates in the service of the latter. In this way, our discussion illustrates the role that historical research might play in contemporary inquiries into intuition. (shrink)

An important challenge for non-naturalistic moral realism is that it seems hard to reconcile it with the (purported) fact of our reliability in forming correct moral beliefs. Some philosophers (including Cuneo and Shafer-Landau) have argued that we can appeal to conceptual truths about our moral concepts in order to respond to this challenge. Call this “the conceptual strategy”. The conceptual strategy faces a problem: it isn’t clear that the relevant moral concepts are “extension-revealing” in the way that the conceptual (...) strategy needs them to be. A further problem stems from the tradeoff between the “extension-revealing” and the “authority-revealing” aspects of normative concepts. To underscore the import of these issues, I discuss a version of the reliability challenge that concerns authoritative normative facts in ethics (rather than moral facts). The problems I identify for the conceptual strategy carry over to versions of it that are used in response to a range of epistemological arguments in ethics that (like the reliability challenge) are tied to Street’s “Darwinian Dilemma” argument. These problems also bear on the prospects of the conceptual strategy for explaining our (purported) reliability in other domains (e.g., in epistemology, law, and politics). (shrink)

This review article focuses on David Copp's article 'Experiments, Intuitions, and Methodology in Moral and Political Theory'. Copp argues that recent developments in moral psychology challenge the common method in ethics, which infers moral truths from moral intuitions, as these intuitions are shown to likely be unreliable. Copp responds to the worry by arguing that even if moral intuitions cannot be trusted to indicate objective moral truths, the common method remains valuable for other reasons. ‘Internalism’ is used in metaethics for a cluster of claims which bear a family resemblance. They tend to link, in some distinctive way—typically modal, mereological, or causal—different parts of the normative realm, or the normative and the psychological. The thesis of this paper is that much metaethical mischief has resulted from philosophers’ neglect of the distinction between two different features of such claims. The first is the modality of the entire claim. The second is the relation between the items specified (...) in the claim. In part one I explain this distinction and the problems neglecting it may cause. In part two I show that it has been neglected, and has caused those problems, at least with respect to one version of internalism. That is judgment internalism, which claims that moral beliefs are necessarily related to pro- or con-attitudes; e.g., that if you believe you ought to x you must have some motivation to x. The considerations standardly adduced in favor of judgment internalism support only a version which lacks the metaethical implications typically attributed to it, at least so far as anyone has shown. Proponents and opponents of judgment internalism fail to realize this because of their neglect of the modality/relation distinction. I illustrate by considering discussions of judgment internalism by Russ Shafer-Landau, Simon Blackburn, James Dreier, David Brink, and others. (shrink)

Many of the arguments for and against robust moral realism parallel arguments for and against theism. In this article, I consider one of the shared challenges: the explanatory challenge. The article begins with a presentation of Harman's formulation of the explanatory challenge as applied to moral realism and theism. I then examine two responses offered by robust moral realists to the explanatory challenge, one by Russ Shafer-Landau and another by David Enoch. Shafer-Landau argues that the moral realist (...) can plausibly respond to the challenge in a way unavailable to theists. I argue that Shafer-Landau's response is implausible as it stands and that once revised, it will apply to theism just as well. I then argue that Enoch's response, to the extent that it is plausible, can be used to defend theism as well. (shrink)

According to contemporary moral realism a moral property, like goodness or badness, is either a natural property or a non-natural property of actions or situations. Contemporary moral naturalists like Richard Boyd, Nicholas Sturgeon, and David Brink are a group of philosophers who are often referred to as Cornell realists because of their connection with Cornell University. Frank Jackson is another contemporary moral naturalist who is one of the leaders of The Canberra Planners at the Australian National University with which (...) he is connected. Jackson defends “the most extreme form of naturalism.” Jackson’s view is considered extremeby those who disagree with him because he believes that moral properties are reducible or identical to natural properties. This view of Jackson is opposed by contemporary non-naturalists like Jonathan Dancy, Derek Parfit, and Russ Shafer-Landau for reasons which in my view are not successful. Despite Jackson’s reductionism about the ethical, the Cornell realists, nevertheless, agree with him that moral properties are natural properties. (shrink)

Her desire to ψ and 2. Her belief that, were she to φ, she would promote her ψ‐ing. Here, to ψ could be to eat an ice cream, and to φ could be to walk to the ice cream vendor. Adherents (...) of belief‐desire explanation, often labelled “Humeans”, standardly assume that appeals to such belief‐desire pairs sufficiently explain many human and animal actions, and also that all actions are explainable thus, at least in so far as they are guided by the agent’s intentions. Humeans take their lead from David Hume’s famous dictum that “Reason...is only to be the slave of the passions, and can never pretend to any other office than to serve and obey them.” In its original context, this passage from the Treatise is naturally taken to convey the thesis that mental states subservient to epistemic rationality – such as beliefs – are never in themselves sufficient to motivate action. Thus, an appeal to an agent’s beliefs is never in itself sufficient to lay bare her motivations and explain her actions, but must be supplemented by an appeal to “passions” such as desires. Many philosophers, so‐called Anti‐Humeans, have sharply disagreed. Some have pointed to certain beliefs with alleged motivational force in isolation from desires, most commonly evaluative beliefs. Others have argued that belief‐desire psychology fails to cut up mental space in a way fruitful to action explanation. Instead, only appeals to other types of mental state will adequately explain many types of intentional action. Dilthey’s moral writings have received scant attention over the years, perhaps due to his apparent tendency toward relativism. This essay offers a unified look at Dilthey’s moral writings in the context of his Kantian-styled “Critique of Historical Reason.” I present the Dilthey of the moral writings as an observer of reason in the spirit of Kant, watching practical reason devolve into error when it applies itself beyond the bounds of possible experience. Drawing on moral writings from across Dilthey’s corpus, I (...) retrace Dilthey’s argument that moral theories from Kantianism and utilitarianism to natural law theory suffer significant motivational problems because of the way they transcend the “synthesis” of moral perception. Dilthey’s argument suggests that abstract moral theory is always bound to seem unmotivating and unreal from the standpoint of lived experience, and perhaps that, to avoid this, moral philosophy should confine itself to more situated, case-specific judgments. It is shown how a diagram on the reverse of a Greek coin of Aegina of the fifth century b.c.e., is simply constructed with the help of Proposition 36 of Euclid’s Book on Divisions [of Figures], and it is conjectured in the absence of contemporary evidence that, since Euclid expressly designated this proposition to be the last in the book, he may have had in mind the diagram, which, some 200 years after its appearance on the coinage, may still have (...) played a significant role in geometry. Consequentialism is often criticized for failing to accommodate impersonal constraints and personal options. A common consequentialist response is to acknowledge the anticonsequentialist intuitions but to argue either that the consequentialist can, after all, accommodate the allegedly recalcitrant intuitions or that, where accommodation is impossible, the recalcitrant intuition can be dismissed for want of an adequate philosophical rationale. Whereas these consequentialist responses have some plausibility, associational duties represent a somewhat different challenge to consequentialism, inasmuch as they embody neither impersonal constraints nor (...) personal options, but rather personal constraints. Our intuitions about associational duties resist capture within the intellectual net of consequentialism, and such duties do admit of a philosophical rationale at least as plausible as anything the consequentialist has to offer. This article argues that Voltaire’s supposed letter to ’s Gravesande of 1741 was written for publication after ’s Gravesande’s death. It is thus Voltaire’s reply to David Boullier’s critique of the Lettres philosophiques. The willingness of Voltaire scholars to mistake this for a genuine letter results from a naïve desire to avoid acknowledging Voltaire’s habit of falsifying the historical record. An appendix argues that Letter Twenty-Five of the Lettres philosophiques, on Pacal, was influenced by a reading of Pope’s Essay (...) on Man. (shrink)

It is common to regard love, friendship, and other associational ties to others as an important part of a happy or flourishing life. This would be easy enough to understand if we focused on friendships based on pleasure, or associations, such as business partnerships, predicated on mutual advantage. For then we could understand in a straightforward way how these interpersonal relationships would be valuable for someone involved in such relationships just insofar as they caused her pleasure or causally promoted her (...) own independent interests. But many who regard love, friendship, and other associational ties as an important part of a happy or flourishing life suppose that in many sorts of associations—especially intimate associations—the proper attitude among associates is concern for the other for the other's own sake, not just for the pleasure or benefits one can extract from one's associates. It is fairly clear how having friends of this sort is beneficial. What is less clear is how being a friend of this sort might contribute to one's own happiness or well-being. Even if we can explain this, it looks as if the contribution that friendship makes to one's happiness could not be the reason one has to care for friends, for that would seem to make one's concern for others instrumental, not a concern for the other for her own sake. David Alexander has argued that “weak inferential internalism” (WII), a position which amounts to a qualified endorsement of Richard Fumerton’s controversial “principle of inferential justification,” is subject to a fatal dilemma: Either it collapses into externalism or it must make an arbitrary epistemic distinction between persons who believe the same proposition for the same reasons. In this paper, I argue that the dilemma is a false one, for weak inferential internalism does not entail internalism simpliciter. Indeed, WII is compatible (...) with modest externalism, and so is consistent with what Armstrong calls “Type II justification,” the rejection of which leads to the arbitrary epistemic distinctions to which he rightly objects. In this supplement to a work co-authored with André Cresson, David Hume, sa vie, son œuvre, left untranslated until now, Deleuze lays the groundwork for what he will later develop as an “ethics without morality.” Contrary to morality, ethics engenders its general rule for action out of the immanence that grants it the power to affect and to be affected, that is, to increase or decrease its capacity to compose new empowering relations between beings, and between beings and the (...) world. The power to act is synonymous with the capacity to imaginatively create relations, in order to exist. In this way, the imagination reveals its ontological significance. Here we discern Deleuze’s Humean impulse encountering a fundamental Nietzscheanism. The translator’s introduction attempts to make explicit his specific philosophical motive, at this point only formative but, eventually, foundational for his later thought. (shrink)
