This book investigates one of the oldest questions of legal philosophy---the relationship between law and legitimacy. It analyses the legal theories of three eminent public lawyers of the Weimar era, Carl Schmitt, Hans Kelsen, and Hermann Heller. Their theories addressed the problems of legal and political order in a crisis-ridden modern society and so they remain highly relevant to contemporary debates about legal order in the age of pluralism. David Lyons is one of the pre-eminent philosophers of law active in the United States. This volume comprises essays written over a period of twenty years in which Professor Lyons outlines his fundamental views about the nature of law and its relation to morality and justice. The underlying theme of the book is that a system of law has only a tenuous connection with morality and justice. Contrary to those legal theorists who maintain that no matter how bad the (...) law of a community might be, strict conformity to existing law automatically dispenses 'formal' justice, Professor Lyons contends that the law must earn the respect that it demands. Moreover, we cannot, as some would suggest, interpret law in a value-neutral manner. Rather courts should interpret statutes, judicial precedents, and constitutional provisions in terms of values that would justify those laws. Despite its many strengths, Engelhardt’s After God displays two surprising features: an affinity for voluntaristic ethics and a tendency to oppose Eastern Orthodoxy to philosophy. Neither of these is in keeping with the mainstream of Eastern Orthodox tradition. Here, I offer a modest corrective. I begin with the figure of Socrates as presented in the Apology and Phaedo, highlighting the role that faith plays for Socrates and the reasons why he was widely admired by the early Church. I then describe (...) more broadly the attitude of the Greek Church Fathers to philosophy, showing that, although they were cautious of its potential errors, they nonetheless embraced the ideal of philosophy as a way of life dedicated to the pursuit of wisdom. For many, in fact, Christianity is itself simply the true philosophy, an attitude that led many of the most eminent patristic and Byzantine theologians to draw extensively on philosophical sources. Mr. Cohen's political geography is unexpectedly topical. His conception of political philosophy is not so advanced; however Cohen's disposition is all for forward movement. Insisting perhaps too strongly upon the etymology of "political," Cohen would even have us cease doing "political philosophy"; for, he says, there are no longer any truly sovereign and autonomous states left in the world. The era of the nation-state has vanished quite as definitely into the past as the era of the city-state. We live in (...) a "polycentric" world community, under a regime of law, though the world community is not itself a sovereign state, nor are there any sovereign states that are a part of it. The members of the world community are people, obliged to support whatever international laws and agencies of international collaboration there are, and there are many of them. Is something true because we believe it to be so or because it is true? How can a culturally bound community achieve scientific knowledge when values, attitudes, and desires shape its beliefs? In this book an eminent philosopher considers various schools of thought on the nature of truth. David Weissman argues that truth exists in the correspondence between statement and fact: what can be said about our world can be measured against a reality that has a character and existence (...) independent of any property we ascribe to it. Weissman begins by evaluating the transcendental paradigm of Kant that has exercised enormous influence in the development of Western thought over the past two hundred years. He develops his critique of the Kantian model, in which value judgments underlie the perception or construction of truth, asserting that it is seriously flawed because it renders a determination of truth impossible. Weissman examines various value-driven perspectives on truth developed by such philosophers as Foucault, Derrida, and Rorty, for whom truth is only the set of affirmations, principles, and procedures sanctioned by power and value. However, says Weissman, truth is the required adjunct to desire. Knowing who we are, where we have been, and the consequences of what we have done is the essential preparation for choosing what to do next. This article offers a critique and reconstruction of the concept of medicalization. Most researchers describe medicalization as the redefinition of social problems as medical concerns, and track its spread by the proliferation of disease language and diagnostic categories. Forensic psychiatry and disorders like psychopathy are often cited in these debates. I argue that focusing on discourse overlooks how medical language can justify or mask non-medical practices and outcomes, and lead researchers to identify medicalization where it has not occurred. Building on (...) other critiques of medicalization and recent studies of medical and legal expertise, I propose an alternative conception based on conditions for the performance of medical practice and other forms of expert labor. I distinguish the participation or intervention of medical practitioners from the medicalization of expert practice and identify several institutional factors that facilitate the latter. I illustrate this approach using a critical historical case: the first adult penal psychiatric clinic in the United States, founded by the eminent psychopathologist Bernard Glueck at New York’s Sing Sing Prison in 1916. Glueck’s extensive writings reveal little evidence of medicalization: psychopaths were largely defined and diagnosed according to penal rather than medical criteria, and they received additional punishment rather than treatment. A review of recent research confirms that psychopathy remains primarily a penal rather than medical condition. I conclude that focusing studies of medicalization on practice rather than discourse clarifies the concept and avoids reifying the notion of a medicalized society. (shrink)

This paper is not an article in a regular sense. It is a dialogue between François-David Sebbah, one of the two editors of this topical collection, and Jean-Luc Nancy, one of the most eminent representatives of the contemporary French Thought. This dialogue took place in the first half of 2022 in a written form, because of the sanitary restrictions related to the COVID-19 pandemic and because Nancy was heavily sick. Sebbah sent to Nancy a text, corresponding to Section 2.1, (...) and Nancy responded to it with another text, corresponding to Section 2.2. Unfortunately, Nancy died on August 23, 2022, and could not revise his own text nor pursue the dialogue, as it was originally planned. For this reason, an introductory clarification by Sebbah, corresponding to Section 1, has been added. The purpose of such clarification is to introduce the reader to Nancy’s philosophy of technology—although technology never had a central role in Nancy’s reflections. In Section 2.1, Sebbah proposes a distinction between “French Theory,” “French Thought,” and “French Philosophy.” He also proposes a list of twelve possible intersections between the French Thought and the philosophy of technology. In Section 2.2, Nancy criticizes the use of expressions such as “French Thought.” He also insists, in a Heideggerian vein, on the fact that Technology (with a capital “T”) does not depend on human ends but has its own ends. Of recent time, there has been a proliferation of concerns with ethical leadership within corporate business not least because of the numerous scandals at Enron, Worldcom, Parmalat, and two major Irish banks – Allied Irish Bank (AIB) and National Irish Bank (NIB). These have not only threatened the position of many senior corporate managers but also the financial survival of some of the companies over which they preside. Some authors have attributed these scandals to the pre-eminence of a focus on (...) increasing shareholder value in Western business schools and/or to their failure to inculcate ethical standards. In this paper, we challenge these accounts and the aetiological view of knowledge from which they derive but are grateful for the consensus that they convey regarding the importance of business ethics. The author has in fact selected Dewey, Russell and Whitehead as three stallions to draw a chariot. The precise nature of this "chariot" is indicated in the chapter entitled "The Philosopher as Educator Today" appearing at the end of the book: My intention throughout has been to suggest a way out of the current impasse in the philosophy ofeducation by reopening a conversation regarding a more productive role for philosophers to play, rather than merely analyzing concepts and policing arguments. My claim has been that philosophers of education can learn from their past, that we can see in Dewey, Russell and Whitehead instances of a productive approach to educational problems through thought and action. (P. 105) Having said this, the structure and contents of Hendley's book fall squarely into place. Chapter One, entitled "The Reconstruction of the Philosophy of Education", argues that there is a crisis in the current state of educational philosophy. The ensuing three chapters are devoted individually to Dewey, Russell and Whitehead. The concluding chapter, resting upon the strength of the examples given of three constructive contributors to the field, suggests new directions for the philosophy of education. It is clear that Hendley's book is more than an interesting account of the practical and theoretical educational activities of three of the most influential philosophers of the twentieth century. Dewey, Russell and Whitehead are not gathered together between the. same covers in order to explore or present a detailed analysis of their theoretical similarities or who may have influenced Reviews 219 whom. Instead, one gathers that the author has selected them on the basis of his own admiration and preference rather than for any shared theories which connect them. The point is made, however, that the strongest common element, and the most significant one, is that each man had ideas about education, each was a philosopher, and each attempted to exert some practical influence upon the educational institutions and practices of the day. In short, Dewey, Russell and Whitehead were theorists who were prepared to get their hands dirty. Hendley argues that after the death of John Dewey in 1952 educational philosophy was neglected and· philosophers tended to pay less attention to education. The author goes on to suggest some renewed interest in the field on the grounds of contributions made to the fifty-fourth Yearbook of the National Society for the Study of Education in 1955 under the theme "Modern Philosophies and Education", a special issue of the Harvard Education Review published in 1956; the publication of Israel Scheffler's edited collection of readings entitled Philosophy and Education in 1958; and R. S. Peters' Inaugural Address given at London in 1963, and his publication of Ethics and Education in 1966. According to this argument, we witness a general lapse after the death of Dewey, a rekindling in the mid-1950S and a broader resurgence in the 1960s. On the basis of the author's own account, I think that it is very difficult to argue that Dewey's death initiated any period of calm or disinterestedness. Furthermore, it is very problematic to point to various yearbooks or publications as indicators. The point is that with the death of Dewey there were numerous contenders to fill his position as the pre-eminent American philosopher of education. The extent to which anyone has been able to do so is a different matter. What I believe Hendley is really trying to say here is implicit in his argument, namely, that after the death of Dewey, no philosopher of equal stature took his place. Moreover, how could a professional philosopher or theologian seriously contend that two contradictory statements are simultaneously true, one due to natural reason, and the other through the authority of faith? Therefore, the matter seemed settled and the file definitely closed: the double truth is nothing more than a “legend.” Yet the Italian medievalist Luca Bianchi’s in-depth critical analysis of the pseudo-historical evidence has now changed this. Without wanting to propose an entirely new interpretation of the historical ins and outs of this famous doctrine, Bianchi carries out a re-examination of the subject through a meticulous study of certain key texts that he has read in the light of a three-fold question: What impact did passages from Tempier’s decree on the “double truth” have on the medieval scholars themselves? Wanting to ensure the pre-eminence of faith-based teachings over all forms of human rationalization, Luther came to subscribe to a certain form of the double truth, since he claimed that what is absolutely true according to faith can be false and impossible from the perspective of philosophy. About a year before the pandemic struck, personal archives of Anton Sovre (1885–1963) were rediscovered, and they eventually made their way to the National and University Library in Ljubljana. During the fifties, Anton Sovre was the undisputed éminence grise of the field of classics in Slovenia and among the new sources now available to researchers is an essay on “Perspective Development of Classical Philology” from 1959. The document was written in the tradition of the Five-Year Plans, and its rhetoric is (...) often amusing. Its content, however, was written mainly by Sovre’s best student. At that time, Kajetan Gantar (1930–2022) had already defended his PhD thesis on Homer. Due to political reasons, he was initially blocked from getting a university position. However, the situation changed somewhat during the thaw in the sixties, when he could finally get the position of lecturer, and he eventually became the leading classical scholar and translator in the country and Sovre’s successor. His proposal for the future of the discipline shows strategic thinking, which was confirmed by the decades that followed. (shrink)

In 1926, C. E. Ayres, a young assistant editor of The New Republic, had completed a draft of his first book, Science: The False Messiah. His publishers, Bobbs-Merrill, were enthusiastic but also somewhat worried—the book, which was a blistering critique of the public understanding of science, was engagingly written and eminently readable, but it was also provocative. Bobbs-Merrill were concerned that Ayres’ “very saucy” approach might damage sales, especially given that he was a complete unknown as far as the general (...) public was concerned; and in order to boost Ayres’ credibility and, hence, future sales of the book, they felt that he needed an endorsement.1 Ayres thus dutifully set about writing to his friendly .. Several philosophers have argued, against the hypothesis of alternative logical mentalities, that it is not conceivable that there should be peoples who reject the law of non-contradictlon. In reply, I argue first that these philosophers are lending an unwarranted pre-eminence to this law, and second that their case is made to look stronger than it is by confusing different senses in which a logical law might be 'rejected'. As if I could read the darkness."Philosophical Investigations, §635We live, as we dream—alone."1 This, Marlow's most eminently quotable aphorism, encapsulates a theme central to the outlook of modernism: what Virginia Woolf called "the loneliness which is the truth about things."2 This loneliness derives not from the absence of others—Marlow is surrounded by friends when he makes this assertion. It is a deeper (...) condition brought about by recognizing the limits of selfhood, by confronting or being confronted by them. This condition is central to Marlow's narrative predicament: he attempts to fathom the enigmatic self that is Kurtz, to understand "the tempestuous anguish of his soul" (HoD, p. 246); he is led, by this attempt, to question the nature of his own self; and, finally, he tries to relay the impenetrable essence of both these selves to the "other minds" of his narratees on the yawl Nellie. As we shall see, Marlow concedes defeat in all three of these struggles. Heart of Darkness, then, is a novel beset by the limits of subjectivity.It is also a novel which foregrounds the limits of language. Marlow concludes that we live in isolation from one another after musing on the failure of language to communicate adequately, to facilitate intersubjective understanding: "it is impossible to convey the life-sensation of any given epoch of one's existence" (HoD, p. 172), he says. [End Page 409] Conveying the meaning of his narrative to others is repeatedly written off as unattainable, and on numerous occasions Marlow, presumably wrestling with sheer wordlessness, falls silent.3 Indeed, Marlow's narrative is peppered with words highlighting the limits of language: words like "inconceivable" and "unspeakable," which F. R. Leavis famously dismissed as "overworked."Leavis described Conrad's "adjectival insistence upon inexpressible and incomprehensible mystery" as "worse than supererogatory," "tending to cheapen the tone" to a point "little short of disastrous." He concluded that Conrad was "intent on making a virtue out of not knowing what he means."4 That Leavis—a critic who fetishized "the concrete presentment of incident, setting and image" through the concrete use of words—should have failed to grasp and to value the novel's brush with wordlessness, is unsurprising (Leavis, p. 208). Nor is it surprising that two of the episodes in the novel that most clearly encounter the limits of language—Kurtz's last words and Marlow's lie about them—were written off by Leavis as examples of Conrad having a "bad patch" (Leavis, p. 208). Yet it is nevertheless instructive that a novel that insists on its linguistic and communicative limits should thus have been misread.This article reads these two issues of the limits of language and the limits of subjectivity together. To do so is to invoke a philosophical position in which language, selfhood and worldhood are interrelated, and their limits coterminous—a position found in the early thought of Ludwig Wittgenstein.ILike Marlow, Wittgenstein also sees the self as essentially isolated from other selves, and language as demarcating its limits. In his Tractatus Logico-Philosophicus, the interconnected remarks "The limits of my language mean the limits of my world" and "I am my world" delineate Wittgenstein's rethinking of the "egocentric predicament" in which, to paraphrase Marlow, we all live alone.5 This position entails a close relationship with solipsism: as Wittgenstein says, "what the solipsist means is quite correct" (TLP, 5.62)—which is not, of course, to suggest that solipsism itself is correct. The grammar of Marlow's assertion encapsulates this point. The card-carrying solipsist would assert "I live alone," but the loneliness that Marlow and Wittgenstein envisage is a [End Page 410] condition of our subjectivity that we all have in common, but cannot share. This article considers one element within the long tradition of the church’s self-identification as a city. It focuses on England, c. 1450 to c. 1510, and considers how the civic rhetoric developed by Italian humanists, pre-eminently Leonardo Bruni, was refracted through an ecclesiastical lens and so appropriated for English clerical use. It describes how two useful elements were quarried from recent writings imported from Italy: the first was the emphasis on the city and its buildings as a locus of virtue; (...) the second was that, because of its virtue, that city was under attack. The discussion begins with the time of social unrest in the mid-fifteenth century,in the wake of which Thomas Chaundler wrote his praise of Thomas Bekynton, bishop of Bath and Wells, and his building works in his episcopal city. It ends in the first years of the sixteenth century with the relations between Christopher Urswick, dean of Windsor, and Thomas Goldstone, prior of Christ Church, Canterbury. Their re-use of older texts, specifically the Speculum regis Edwardi III, which they assumed to be by Archbishop Simon Islip, and more recent humanist ones, by Celso Maffei and Goldstone’s predecessor as prior, William Sellyng, identified other enemies who attacked the church: invoking the name of Thomas Becket, they saw those oppressing them to be not rebels against authority but those in authority. This allows us to reflect on how a few English readers of humanist civic rhetoric found in it potentially radical force. (shrink)

J. N. (Jitendra Nath) Mohanty (1928–2023). -/- Professor J. N. Mohanty has characterized his life and philosophy as being both “inside” and “outside” East and West, i.e., inside and outside traditions of India and those of the West, living in both India and United States: geographically, culturally, and philosophically; while also traveling the world: Melbourne to Moscow. Most of his academic time was spent teaching at the University of Oklahoma, The New School Graduate Faculty, and finally Temple University. Yet his (...) preeminent work in Husserlian phenomenology developed alongside his eminent work in Indian philosophy: describing his interests as “a fusion of disparate horizons.” -/- J. N. Mohanty was born September 26, 1928, in Cuttack (Odisha, East India). After graduating from high school, he went on to study both Indian and Western philosophy in Calcutta, earning bachelor’s and master’s degrees. There he read Whitehead and Kant’s First Critique; although he wanted to include mathematics in his curriculum, he was led instead to include Indian philosophy and Sanskrit. On the shelves of his teacher, Ras Vihar Das, he came upon a copy of the English translation (Ideas I, 1931) of Edmund Husserl’s classic Ideen I (1913), which presented Husserl’s ground-breaking conception of phenomenology. In 1952–1954 he left India for the first time, reaching Göttingen to study mathematics and philosophy, which earned him a doctorate in mathematics and “philosophy of mathematical sciences” (in his own words). In Göttingen, Mohanty found the powerful mathematical world that Husserl himself had earlier interacted with, where several Husserl students had formed the Göttingen school of phenomenology. During these years Mohanty studied primarily mathematics, alongside Kant and also Vedic Sanskrit. From his friend Günter Patzig, interpreter of Aristotle and Frege, Mohanty was drawn to Frege in relation to mathematical logic. He attended lectures of Heidegger, intrigued by his ontological thinking. Yet, despite the Husserlian legacy, Mohanty was completely self-taught in his studies of Husserl (as he has reported). With a doctorate in mathematics, and ideas from Kant and Frege in his philosophical background, Mohanty set about crafting his own conception of philosophy grounded in phenomenology, drawing on Husserl’s extensive work, critically sifting through Husserl’s texts and their emerging concepts of intentionality, meaning, subject, intersubjectivity, and world. In between he wrote his first book-length study: on phenomenological insights in Nicolai Hartmann and A. N. Whitehead (1958). -/- Over many decades Mohanty formulated and argued, in analytical detail, for a conception of phenomenology and its place in philosophy, later presented in a clear and concise book titled Transcendental Phenomenology: An Analytic Account (1989). Over these very decades the same scholar explored classical and recent Indian philosophy, thinking through kindred ideas of consciousness, self, and knowledge drawn from the Indian philosophical contexts. While writing on Nyāya theory of truth, he also pondered whether the world and finite individual are illusory or real, and whether Marx, Arendt, Gandhi (whom he heard speak in Calcutta), or Vinoba Bhave (with whom he marched across India for the land-grant movement) could best navigate post-Independent India’s social and svarāj or self-rule reforms. The two Mohantys, thinking through a vision of self and world, turned out to be “non-different” or “non-dual” as they each practiced critical phenomenology from both inside and outside the respective philosophical and cultural traditions. Numerous students, fellows, and colleagues or collaborators have benefited immensely from this infusion and unified approach to diversity in philosophical thought. In the 2000s, moving into retirement, Mohanty wrote two long books devoted to his understanding of Husserl and phenomenology and the calling of philosophy itself. This two-volume study shows Mohanty himself thinking through Husserl, critically, in The Philosophy of Edmund Husserl: A Historical Introduction (2008), and Edmund Husserl’s Freiburg Years: 1916–1938. As Mohanty worked on Husserl, he carefully indicated where he agreed and where he rejected or changed ideas, all part of his practice in phenomenology of “description and interpretation.” It was the same pattern he used in addressing the thought of Husserl vis-à-vis Kant or Frege or even Quine. -/- As Mohanty developed his understanding of phenomenology over the years, he wrote books on theory of meaning and the concept of intentionality, developing a model of ideal meaning and its foundation in intentionality, drawing on Husserl’s results. He followed these with the book Husserl and Frege (1982), linking the thought of those foundational figures for the “continental” and “analytic” traditions, respectively, in twentieth-century Western philosophy. Over his long career Mohanty addressed both traditions in his clear and accessible writing style. While developing his views on phenomenology, Mohanty regularly looked to “Husserl and his others,” evaluating views in Heidegger, Sartre, Merleau-Ponty, Ricoeur, and then Derrida and others in the wake of Husserl. With his background in Kant, Mohanty also looked toward Heidegger and Hegel in relation to Husserl’s later work in the Crisis (1935–38). Similarly, he looked to contemporary analytic philosophers, adjudicating his own, oft-wise Husserlian views in relation to Frege, Nagel, and others. Amid his active scholarly career, Mohanty co-founded the journal Husserl Studies, and was editorial advisor to Philosophy & Phenomenological Research, Philosophy East & West, Journal of Indian Philosophy, Sophia, among others. -/- Yet all this while Mohanty was also thinking and writing about Indian philosophy and its relation to phenomenology. In his own retrospective, Indian philosophy is “the permanent background” of his Husserlian thinking, while Kant is the recurrent Western background of his Husserlian phenomenology. Mohanty’s form of “transcendental phenomenology” evolved, in his own perspective, against the background of his studies of Navya-Nyāya on logic and Vedānta on consciousness, in Indian philosophy, and against the background of Kant’s First Critique on the transcendental, in Western philosophy. Accordingly, Mohanty’s study of logical form and of the intentionality of consciousness seeks a fusion of East and West in the conception of transcendental phenomenology. (Cf. Mohanty’s apt response to critics in The Empirical and the Transcendental (2000).) Even in the context of North American Husserl scholarship, Mohanty has exercised an earnest fusion of East and West. For the so-called East Coast and West Coast interpretations of Husserl’s crucial notion of noema both find a sympathetic spirit in J. N. Mohanty’s careful and nuanced interpretation of Husserlian transcendental phenomenology. In the summer of 1914, Archduke Franz Ferdinand was assassinated in Sarajevo, an event which led to the horror of World War I and which many historians suggest marked the beginning of the twentieth century. In 1992, Sarajevo again lurched into prominence as the focal point of one of the century’s bloodiest civil wars. Yet Sarajevo at one point epitomized the dreams of the Enlightenment, a city where Christians, Jews, and Muslims peacefully coexisted. In the midst of Sarajevo’s recent decline (...) into chaos and destruction, Susan Sontag decided to produce Act I of Waiting for Godot, which, despite ever-looming danger, played to packed houses. Why? Why did this city of hope lie crushed at the end of the twentieth century? Why did Sontag stage an artistic production in the middle of such overwhelming tragedy? Why Waiting for Godot ? And, most important, why the appreciative, silent tears of audience members who risked their lives to attend a play in the middle of a war?These are the questions that guide David Toole’s theological reflections in Waiting for Godot in Sarajevo, where he seeks to come to terms with what it means to live a life of dignity in a world of undeniable suffering. Toole skillfully weaves together Friedrich Nietzsche’s views on nihilism with Michel Foucault’s analysis of power to produce a metaphysics of tragedy, or a “politics of dying.” Such politics are then used to shed new theological light on the Christian apocalypse and what it means to be alive at the end of the twentieth century. In making his argument, Toole draws innovative connections between such diverse figures as John Milbank, Alasdair MacIntyre, Euripides, John Howard Yoder, and Norman Maclean (author of A River Runs Through It and Young Men and Fire ), all the while using Beckett’s play as a compass for his direction.
