There are three main categories of rationale for withholding information or telling lies: if overwhelming harm can only be averted through deceit; complete triviality such that it is irrelevant whether the truth is told; a duty to protect the interests of others. Public health authorities are frequently having to form judgements about the public interest, whether to release information or issue warnings. In June 1992, routine surveillance detected patulin levels (a known carcinogen) in samples of apple juice exceeding safety threshold. (...) Remedial actions were promptly taken and it was planned to subsequently publish the information in the routine way. However, the media portrayed the handling of the problem as a conspiracy and there was a short term reduction in juice sales. In October 1995, the UK Committee on Safety of Medicines issued a warning about certain brands of the contraceptive pill, based on the interim results of three unpublished studies. The increased risk of thromboembolism was small, but the resulting scare led to an increase in unwanted pregnancies. The handling of the B.S.E. crisis in the U.K. also led to accusations of incompetence or conspiracy. Public health authorities have to handle uncertainty and frequently have to form judgements for public safety on the basis of evidence of poor quantity and quality. Their task is not helped by the sometimes conflicting agenda of scientists and media. The public also have differing perceptions and interpretations of risk. The series of scares and crises are having a detrimental effect on public confidence in public health authorities. (shrink)

If an agent believes that the probability of E being true is 1/2, should she accept a bet on E at even odds or better? Yes, but only given certain conditions. This paper is about what those conditions are. In particular, we think that there is a condition that has been overlooked so far in the literature. We discovered it in response to a paper by Hitchcock (2004) in which he argues for the 1/3 answer to the Sleeping Beauty problem. (...) Hitchcock argues that this credence follows from calculating her fair betting odds, plus the assumption that Sleeping Beauty’s credences should track her fair betting odds. We will show that this last assumption is false. Sleeping Beauty’s credences should not follow her fair betting odds due to a peculiar feature of her epistemic situation. (shrink)

How should we respond to evidence when our evidence indicates that we are rationally impaired? I will defend a novel answer based on the analogy between self-doubt and memory loss. To believe that one is now impaired and previously was not is to believe that one’s epistemic position has deteriorated. Memory loss is also a form of epistemic deterioration. I argue that agents who suffer from epistemic deterioration should return to the priors they had at an earlier time. Using files declassified and released to Great Britain's National Archives, this article shows how Britain's domestic spy agency, MI5, recruited Louis de Wohl (1903-61), a flashy Hungarian astrologer and Christian writer to create horoscopes for Adolf Hitler during World War II. De Wohl was a controversial figure. His origin story does not check out. His MI5 handlers found him showy. And recent journalists dismiss him as a ‘persuasive fake’. Yet his pre-war fictions were adapted for cinema, his later theological novels (...) remain bestsellers, and his personal story deserves greater attention if we are to better understand Christian historical fiction's popularity. Nurses practising in mental health are faced with challenging decisions concerning confidentiality if a patient is deemed a potential risk to self or others, because releasing pertinent information pertaining to the patient may be necessary to circumvent harm. However, decisions to withhold or disclose confidential information that are inappropriately made may lead to adverse outcomes for stakeholders, including nurses and their patients. Nonetheless, there is a dearth of contemporary research literature to advise nurses in these circumstances. Cognitive Continuum Theory presents (...) a single‐system intuitive‐analytical approach to examining and understanding nurse cognition, analogous to the recommended single‐system approach to decision‐making in mental health known as structured clinical judgement. Both approaches incorporate cognitive poles of wholly intuition and analysis and a dynamic continuum characterised by a ‘common sense’ blending of intuitive and analytical cognition, whereby cues presented to a decision‐maker for judgement tasks are weighed and assessed for relevance. Furthermore, Cognitive Continuum Theory promotes the importance of determining pattern recognition and functional relations strategies, which can be used to understand the operationalisation of nurse cognition. This article makes the political dimension of Gadamer's thought more explicit by examining the interplay of three concepts in his work: solidarity, friendship, and the other. Focusing primarily on certain post--"Truth and Method" writings, I argue that Gadamer's conception of solidarity has to do with historically contingent manifestations of bonds that reflect a civic life together of reciprocal co-perception. These bonds go beyond conscious recognition of observable similarities and differences and emerge from encounters among those who are, and remain, in (...) important ways other to each other. I make this case through an analysis of Gadamer's phenomenology of friendship and the crucial role of otherness in his accounts of both understanding and friendship. I suggest that Gadamer's political thought gives us a way of conceptualizing solidarity and otherness without making the other same or leaving the other completely other. (shrink)

Theological interpretation of the Bible is one of the most significant debates within theology today. Yet what exactly is theological reading? Darren Sarisky proposes that it requires identification of the reader via a theological anthropology; an understanding of the text as a collection of signs; and reading the text with a view toward engaging with what it says of transcendence. Accounts of theological reading do not often give explicit focus to the place of the reader, but this work seeks (...) to redress this neglect. Sarisky examines Augustine's approach to the Bible and how his theological insights into the reader and the text generate an aim for interpretation, which is fulfilled by fitting reading strategies. Interpreting the world through a social lens is a central characteristic of human cognition. Humans ascribe intentions to the behaviors of other individuals and groups. Humans also make inferences about others’ emotional and mental states. This capacity for social attribution underlies many of the concepts at the core of legal and political systems. The developing scientific understanding of the neural mechanisms used in social attribution may alter many earlier suppositions. Secured to a table in my living room is an antique apple peeler—a cast iron 19th century mechanical contrivance that I gave my wife for her birthday some years ago. This thing is not art. At the very least, I do not believe it is art. Yet my wife and I do not use it as an apple peeler; we use it as art. Indeed, my living room is filled with things that we are using as art—some artifacts, some natural (...) objects—but my living room is not filled with art. This is not, I think, all that unusual a phenomenon. Indeed, I believe this is a widespread phenomenon occurring at the blurry line between art and non-art, especially in the home. However, exactly what it means to use a thing as art without thus believing it is art, and without it being art, is not a straightforward matter, especially given the many functions of art today, and their functional overlap with non-art. In this essay, I investigate the notion of using a thing—specifically a non-art thing, whether an artifact or otherwise—as art, and the importance of this notion both inside and outside of philosophy.. Whether metacognitive experiences should be considered evidence for or against cognitive phenomenology is controversial. In this paper I analyze one metacognitive experience, having a word at the tip of one’s tongue, and argue that this experience is an instance of cognitive phenomenology. I develop what I call a Cognitive view of tip-of-the-tongue (TOT) experience, supported by examining the prominent psychological explanation of tip-of-the-tongue states emerging from the science of language production, showing how psychological data suggests that the phenomenal character of (...) tip-of-the-tongue experiences is constituted in part by conceptual representations, from which it follows that tip-of-the-tongue experiences are instances of cognitive phenomenology. This view contrasts with metacognitive embodied affect views of tip-of-the-tongue experiences, and I provide several clarifications and challenges that defenders of these views would have to address to situate their views within the cognitive phenomenology debate. Ultimately, I conclude that the Cognitive view of TOT is better supported by empirical data, and comports better with introspection, in comparison to embodied affect views. (shrink)

If you ought to do something, does it follow that you are able to do it? The Kantian thesis that ought-implies-can seems intuitive and is widely accepted. Nevertheless, there are several powerful purported counterexamples. In this paper I will apply an independently motivated contextualism about ‘ought’ to make sense of the intuitions on both sides of the argument. Contextualism explains why ought-implies-can seems compelling despite being false in many contexts. Large prospective biobanks are being established containing DNA, lifestyle and health information in order to study the relationship between diseases, genes and environment. Informed consent is a central component of research ethics protection. Disclosure of information about the research is an essential element of seeking informed consent. Within biobanks, it is not possible at recruitment to describe in detail the information that will subsequently be collected because people will not know which disease they will develop. It will also be difficult (...) to describe the specific research that will be performed using the biobank, other than to stipulate categories of research or diseases that are not included. Potential subjects can only be given information about the sorts of research that will be performed and by whom. Organisations responsible for biobanks usually argue that this disclosure of information is adequate when seeking informed consent, especially if coupled with a right to withdraw, as it would not be feasible or it would be too expensive to seek consent renewal on a regular basis. However, there are concerns about this ‘blanket consent’ approach’. Consent waivers have also been proposed in which research subjects entrust their consent with an independent third party to decide whether subsequent research using the biobank is consistent with the original consent provided by the subject. People who suffer survivor’s guilt reason that, if they survived while others didn’t, then this must be because of the choices that they made, and that others did not make. People with survivor’s guilt feel just the way they would feel if they did not really believe in luck.

An eighty‐six–year‐old woman has had lifelong obsessive‐compulsive disorder. At times, it has been so severe that she has lost touch with reality and been psychotic. She is actively followed by a community mental health nurse. Since she is physically frail, the nurse visits her at home and liaises with the attending psychiatrist, who adjusts medications as needed. Currently, the patient is stable, and there is no evidence of psychosis.The patient's home deteriorates, and several repairs are needed. The nurse questions the (...) patient about this, and the patient agrees to have her nephew arrange for the repairs and pay for them out of her bank account. The nurse asks how the nephew has access to the account. The patient mentions that he has power of attorney, but when asked to supply the document giving him this authority, she becomes confused and supplies a number of bank statements instead. The nurse is surprised to see several withdrawals for over ten thousand dollars each. When she questions the patient about these, the patient simply suggests that her nephew must have “needed the money” for something. The nurse questions her repeatedly about this matter, but she refuses to give further details. The patient becomes quite upset whenever the nurse brings it up and states, “This is my money, and he wouldn't take it unless he needed it to help me.”Should the nurse challenge the patient's right to make her own financial decisions in order to avoid a risk of exploitation by her family members? Does the patient have the right to refuse a capacity assessment, which could determine her decision‐making abilities in this area? (shrink)

This commentary examines several key points in David Horan’s paper “The Argu­mentative Unity of Plato’s Parmenides.” First, I discuss the general view of the paper, which engages with the first two hypotheses and in particular, the thought experiment passage in hypothesis 2 that is seen as a key to resolving the dilemma of participation. I consider the proposed view that hypothesis 1 takes up from its premise a strictly unitary, or non-multiple “one,” and hypothesis 2 takes up from its premise (...) a one that admits of multiplicity, not a non-multiple “one.” I argue for an alternative reading whereby the premise of hypothesis 1 is not “if one is one” and hypothesis 2 is “if one is not one,” but rather that both hypotheses fall under the premise “if one is.”. In the following article, I situate Daniel Bensaïd’s ‘Strategy and Politics’ within the different phases of his thinking about strategy as well as his own general theoretical background that informs parts of the text.

Contrasting institutionalism and sexual liberation is the essence of Black Mirror episode, Striking Vipers, which challenges the socially constructed boundaries imposed on sexual experiences in its consideration of how two conflicting lifestyles, traditional commitment and sexual openness, can cohabitate together. Through use of virtual eroticism, the episode takes the privileged standing of heteronormative monogamy and exposes its inadequacy as an institution without concluding that it must be jettisoned entirely. By contrasting real‐world intimacy with virtuality, it considers the meaningfulness of sexual (...) fantasies, thereby questioning the very definition of true intimacy. Striking Vipers ultimately explores the possibility that what is real may not always be what is most meaningful. Physical relationships can be just as artificial as fantasy, and imagination can be just as meaningful as reality. It concludes with the suggestion that neither heteronormative monogamy nor virtual escapism are fully satisfying. Instead, both romantic expressions may provide the necessary balance between monotonous devotion and unrestrained sexuality. (shrink)

Most nonviolent resistance is a species of collective political action and therefore a form of collective power. In many cases, the use of power in nonviolent action is best characterized as a kind of intelligently used coercion. How then should ethicists think about the norms that govern the use of coercion in nonviolent actions? This essay critically examines the answers provided by the early Reinhold Niebuhr and Paul Ramsey. Both analyzed nonviolent resistance in similar ways: they distinguished nonviolent action from (...) pacifism, noticed its coercive element demands justification, and sought to develop ethical norms to understand these forms of political action. Taken together, this essay suggests that Niebuhr and Ramsey can be interpreted as members of a non-pacifist tradition of theorizing nonviolence that suggests an unlikely convergence between theorists of nonviolent action and theorists sympathetic to just war thought. The main argument given for relevant alternatives theories of knowledge has been that they answer scepticism about the external world. I will argue that relevant alternatives also solve two other problems that have been much discussed in recent years, a) the bootstrapping problem and b) the apparent conflict between semantic externalism and armchair self-knowledge. Furthermore, I will argue that scepticism and Mooreanism can be embedded within the relevant alternatives framework.

In this article, I use the example of the novel Micro, authored by Michael Crichton and Richard Preston, to tease out the relationships between an author and his work and with other authors of that work. The case presents a complication for a number of contemporary views on authorship and co-authorship, which suggest that Crichton is either not an author of the novel or an author but not a co-author—both, I suggest, are counterintuitive views. After working through the leading views (...) on the topic, I present my own view of authorship, co-authorship, and multiple authorship, centrally resting on issues of power, responsibility, and creation. The paper examines the ethics of electronic monitoring for advertising purposes and the implications for Internet user privacy using as a backdrop DoubleClick Incs recent controversy over matching previously anonymous user profiles with personally identifiable information. It explores various ethical theories that are applicable to understand privacy issues in electronic monitoring. It is argued that, despite the fact that electronic monitoring always constitutes an invasion of privacy, it can still be ethically justified on both Utilitarian and Kantian grounds. From a (...) Utilitarian perspective the emphasis must be on minimizing potential harms. From a Kantian perspective the emphasis must be on giving users complete information so that they can make informed decisions as to whether they are willing to be monitored. Considering the Internet advertising industrys current actions, computer users and government regulators would be well advised, both practically and ethically, to move to a user control model in electronic monitoring. The independence problems for functionalism stem from the worry that if functional properties are defined in terms of their causes and effects then such functional properties seem to be too intimately connected to these purported causes and effects. I distinguish three different ways the independence problems can be filled out – in terms of necessary connections, analytic connections and vacuous explanations. I argue that none of these present serious problems. Instead, they bring out some important and over-looked features of functionalism.

In this article, I examine the textual underpinnings of participatory Confucian democracy and Confucian meritocracy and propose realist Confucian democracy as an alternative following a balanced reading of classic Confucianism. I argue that Confucian plebeian values do not square with the political meritocrats’ advocacy for meritocratic rule while Confucian elitist values undermine participatory democrats’ ardor for justifications of active democratic participation. A shared difficulty with both groups is that they tend to overuse one aspect of Confucianism while leaving the status (...) of other elements in limbo. The discussion of participatory democracy and meritocracy is followed by the introduction of an eclectic reading that strikes a dynamic balance between elitist and plebeian values in Confucianism, and which points to the wide gamut of realist democracy that combines democratic election with strong leadership. Sometimes we learn what the world is like, and sometimes we learn where in the world we are. Are there any interesting differences between the two kinds of cases? The main aim of this article is to argue that learning where we are in the world brings into view the same kind of observation selection effects that operate when sampling from a population. I will first explain what observation selection effects are ( Section 1 ) and how they are relevant (...) to learning where we are in the world ( Section 2 ). I will show how measurements in the Many Worlds Interpretation of quantum mechanics can be understood as learning where you are in the world via some observation selection effect ( Section 3 ). I will apply a similar argument to the Sleeping Beauty Problem ( Section 4 ) and explain what I take the significance of the analogy to be ( Section 5 ). Finally, I will defend the Restricted Principle of Indifference on which some of my arguments depend ( Section 6 ). (shrink)
