El concepto clásico de observación en la astrofísica contemporánea ha sufrido cambios considerables debido, en gran parte, a ciertas observaciones llevadas a cabo a través de simulaciones computacionales. Al considerarse la evolución que ha tenido esta noción en las últimas décadas, se analizarán diferentes reflexiones filosóficas acerca de la observabilidad. Se mencionará la dicotomía teórico-observacional, el debate realismo-antirrealismo y aquellos tratamientos actuales más afines a las prácticas científicas, aludiendo a la distinción entre entidades observables e inobservables. En este trabajo se (...) abordará, mediante un estudio de caso, la problemática en torno al rol de la validación externa en este ámbito disciplinar. Teniendo en cuenta los datos adquiridos tanto por la vía tradicional u observacional, como por aquélla lograda mediante modelos de simulación, se analizarán los diferentes mecanismos de producción de datos y su eventual reducción en astroinformática. A propósito, se desarrollará la propuesta ofrecida por Reiss (2019), examinando los argumentos a favor y en contra de la validación externa. Así, se identificarán aquellas estrategias vigentes de validación en modelos de datos diferentes, estableciendo los vínculos necesarios para una valoración cuantitativa y cualitativa de observaciones y de simulaciones. A partir del inter-juego entre estas últimas se mostrará el estatus y la conformación de la evidencia disponible y su dependencia con el diseño de las observaciones actuales. Se concluirá que la interacción entre modelos de observación y de simulación no sólo contribuyen al desarrollo de guías heurísticas, sino que permiten una retroalimentación favorable en los procesos de validación externa de ambos modelos. El presente trabajo presenta la idea de un gobierno mundial propuesta por Dante Alighieri. Sus argumentos defienden, en primer lugar, la conveniencia de este tipo de gobierno para asegurar la paz entre todos los hombres y garantizar a la vez el ejercicio pleno de la libertad de los individuos. En segundo lugar, defienden la legitimidad del Imperio Romano, como la fiel realización de dicho tipo de gobierno, en razón de que el Imperio Romano fue sancionado por la voluntad divina. (...) Finalmente, defienden la dependencia directa de Dios de dicho tipo de gobierno y, por tanto, la autonomía respecto del poder del Romano Pontífice. Señala, sin embargo, la subordinación de aquél respecto de este último, atendiendo la finalidad de la existencia humana. En el presente trabajo, además, se hacen algunas observaciones que surgen de la comparación del gobierno mundial de Dante con las ideas políticas de Hegel. Se señalan finalmente algunas diferencias radicales con las ideas políticas contractualistas modernas. (shrink)

De Monarchia representa una de las obras de Dante que más influjo político ha ejercido. Probablemente movido a escribirla, hacia 1313. Con ella, Dante quiere contribuir a erradicar la anarquía imperante de su época, en Italia y, concretamente, en su ciudad florentina. Sueña con un orden social que establezca la paz universal. El tono de la obra, netamente gibelino, muestra a un Dante que ha evolucionado intelectualmente. Dante se muestra aquí como un intelectual a caballo entre (...) la escolástica y el florecimiento de un estilo nuevo. Hay en él toda una serie de giros, expresiones, alegorías, imágenes y simbolismos claramente medievales, pero también un conjunto de ideas que, contra corriente, contribuyeron a cambiar el modo de interpretar el mundo. Su De Monarchia ha de considerarse una obra innovadora porque, aunque el texto ciertamente recogió tradiciones legales, jurídicas, políticas y teológicas precedentes, su mayor mérito radicó en la elaboración de una densa, brillante y novedosa teoría, según la cual, el emperador no sólo debía su poder a la elección directa de Dios —con lo que su investidura no devenía un mero oficio de la Iglesia— sino que, además, la institución imperial resultaba superior a la pontificia. Por tanto, hay que plantearse si «De Monarqchia» es una obra que precederá algunas de las principales tesis que posteriormente defenderá la Reforma protestante en cuestiones políticas. (shrink)

Dante's Convivio, composed in exile between 1304 and 1307, is a series of self-commentaries on three of Dante's long poems. These allegorical love poems and philosophical verse become the basis for philosophical, literary, moral, and political exposition. The prose is written in Italian so that those who were not educated in Latin could take part in what Dante called his 'banquet of knowledge'. In this edition, eminent Dante translator-scholar Andrew Frisardi offers the first fully annotated translation (...) of the work into English, with an extensive introduction, making Dante's often complex writings accessible to scholars and students. The parallel Italian text is also included for the first time in an English translation of the Convivio. Readers of this work can gain a strong understanding of the philosophical themes across Dante's work, including the Divine Comedy, as well as the logic, politics and science of his time. (shrink)

For centuries, various disciplines have tried to tackle the topic of how legitimate it is to use violence in order to solve social problems. One of the most recent interdisciplinary approaches, most successful in present-day Latin America, is the so-called "Ethics of Liberation," designed by Enrique Dussel. Based on the Theology of Liberation, this theory goes beyond the limits of theology as a discipline and pleads for three ethical criteria that every political revolution must fulfill to use violence in a (...) legitimate way. The first is a formal criterion, which basically takes after the ideal dialogue situation endorsed by Karl-Otto Apel and Jürgen Habermas, and purports to be rooted in yet another discipline, linguistics. The second is a material criterion, defined as the upshot of an acceptable welfare for all citizens, thus intimately linked with the discipline of economics and political philosophy. The third is a criterion of feasibility, which makes a revolt legitimate if, and only if, it has a reasonable possibility of succeeding; hence strategic issues take a leading role. This essay contends that each of these criteria is conceptually incompatible with violence. Hence, Dussel's arguments involve multiple contradictions as he aims to justify the use of violence precisely with these interdisciplinary criteria. (shrink)

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

Na segunda unidade, apresenta-se a relação feita por Kuyper entre calvinismo, ciência e filosofia política. Por fim, na última unidade, expõe-se a articulação entre calvinismo, cultura e artes. (...) In this paper a view of self-deception is given which eliminates the paradox usually associated with self-deception.Self-deception is distinguished from ignorance, false belief, wishful thinking, and reluctance to believe. Through an analysis of ordinary language, the role of knowing and believing in self-deception is examined as well as the notion of the self-deceived person "persuading himself to believe." The role of intention and the function of "self" in "self-deception" is analyzed through a discussion of evidence and interpretation.It is shown that (...) the self-deceived person does not know or even believe p, but is, nevertheless, properly characterized as "self-deceived." It is argued that the self-deceived person believes not-p and does not know, or even believe, p. The paradox turns out to be more apparent than real. (shrink)

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. Cree que la clave es entender que las dos intuiciones centrales a esta noción imponen demandas independientes. Sostengo, por el contrario, la suficiencia de la condición anti-suerte. No solo respondo al argumento de Pritchard sino que desarrollo una línea alternativa inadvertida por él, pero implicada por supuestos suyos sobre la condición anti-suerte. Sostengo que una concepción evidencial de la seguridad (...) la hace dependiente de una condición de habilidad. Fortalezco la defensa de la epistemología anti-suerte minando dicha concepción. El nacionalismo ha sido una de las ideologías más características de la Modernidad, y ha reproducido en la tensión entre la “nación política” (Rousseau) y la “nación cultural” (Herder) la escisión típicamente moderna entre lo subjetivo y lo objetivo. Cuando estas categorizaciones filosóficas son puestas en cuestión por la crisis de la Modernidad típica de nuestro tiempo, ese cuestionamiento repercute en el nacionalismo subsidiario de ellas, y obliga a replantear qué sentido plausible pueda tener éste para nosotros. Mi investigación se (...) propone esbozar levemente en qué sentido iría una crítica hermenéutica a los dos tipos de nacionalismo moderno, y la propuesta que desde este mismo modo de pensar se ofrece para entender de un modo más adecuado la categoría de “nación”. La figura de Miguel de Unamuno nos sirve de hilo conductor como posible precursor de un modo de pensar hermenéutico asombrosamente actual sobre la crisis mencionada. (shrink)

The purpose of this paper is to analyze some of the thesis developed in the context of the Latin American critical thought in order to address the question of the crisis of modernity. We particularly consider the theories of two contemporary authors: Bolívar Echeverría and Enrique Dussel. Their theoretical positons are clearly different from the critique that had occurred in the postmodern discourse and they intend to account for the meaning of modernity in relation with certain phenomena that characterize it (...) structurally, which are represented by the development of capitalism and the consequent globalization. In this sense, albeit taking into consideration where these critical theories have been enunciated, that is, the particular experience of modernity in Latin America, their reflections have a global scope and try to explain the complex and contradictory characteristics of this civilization process. We analyze Bolívar Echeverría’s original proposal regarding the baroque ethos by which he identifies a particular way of modernity that tends to offer an alternative to the capitalist modernity. As regards Enrique Dussel, we underscore his trans-modernity concept that gives a new response to the Eurocentrism and colonization that marked the historical changes since modernity to the present. The car has become ubiquitous in late modern society and has become the leading object in the ordinary social relations of mobility. Despite its centrality to the culture and material form of modern societies, the relationship between the car and human beings has remained largely unexplored by sociology. This article argues that cars are combined with their drivers into an assemblage, the ‘driver-car’, which has become a form of social being that brings about distinctive social actions in modern society – (...) driving, transporting, parking, consuming, polluting, killing, communicating and so on. To understand the nature of this assemblage a number of theoretical perspectives that describe the interaction and collaboration between human beings and complex objects are explored; the process of driving, ‘affordance’, actor-network theory, and the embodied relationship between driver and car. This theoretical account of the driver-car is intended as a preliminary to the empirical investigation of the place of the driver-car in modern societies. (shrink)

The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

This paper explores the relationship between the corporate social performance (CSP) of subsidiaries and the transfer pricing policies at which multinationals trade with their subsidiaries. In this paper I develop a theoretical framework to propose that, to the extent to which those policies and practices shift income out of the subsidiary, transfer pricing policy may undermine the CSP of that subsidiary. In this way, the subsidiary may lose social legitimacy and incur in higher costs to acquire local resources.

Psychopathy is typically seen as a trait that is undesirable in any context, including the workplace. But several authors have suggested that people high in psychopathy might possess resources that preserve their ability to perform well in stressful contexts. We consider the possibility that primary psychopathy is adaptive—for the employee, if not for the organization—under conditions of abusive supervision. In particular, we draw from the multimotive model of interpersonal threat and the theory of purposeful work behavior to argue that high (...) primary psychopathy individuals possess characteristics that enable them to experience higher levels of well-being and lower levels of anger than their peers under abusive supervisors. Based on a scenario study and a time-lagged field study, we found support for a model in which abusive supervision moderates the relationships between primary psychopathy and positive work-related outcomes, such that these relationships are positive under conditions of abusive supervision and either diminished or negative under conditions of low abusive supervision. Abusive supervision also affected the relationship between primary psychopathy and anger in the field study such that high primary psychopathy individuals were less angry under more abusive supervisors. Thus, there appears to be some credence to the notion of a “psychopathic advantage” in that primary psychopaths do have access to greater psychological resources than their peers under abusive supervision. However, these findings also suggest that abusive supervisors may empower employees with characteristics that hold strong potential to damage the organization and its stakeholders. (shrink)
