I very much appreciate Daniel Nathan’s thoughtful commentary on Aesthe- tic Creation. He describes my view accurately, with a full understanding of what is moving me, and with some sympathy for my methodological concerns, even if he thinks that I over emphasize some desiderata and even if he cannot endorse the particular aesthetic theory that I argue emerges from the methodological reflections. He makes a number of interesting criticisms. (A) Nathan worries about doodles being classified as art according the (...) aesthetic creation theory. Nathan says that this violates certain intuitions about the nature of art. I query this appeal to intuition. Whose concepts? Which intuitions? Why do such intuitions have evidential weight? We have intuitions abut the physical world: that the earth is flat not round. More to the point we have intuitions about kinds. For example, it is intuitive that a whale is a fish. But such intuitions may be mistaken. Similarly with intuitions about what is art and what is not art. With intuitions I say at least that there is, or should be, a question mark standing over them. We are interested in the world, not in our concepts or intuitions. The question is: what are these things? And the question about concepts is: which do we need to understand the things? Which concepts should we have? Not: which do we have? As Nathan notes, for me, explanation trumps extension if there is a conflict. Or perhaps rather, for me, extension is subsumed under explanation. It is true that there are avant garde works that I exclude that other theories include. And there also are doodles that I include and they exclude. The question is where we go from there. (B) Nathan worries about the success condition. I required that to some extent artists are right about aesthetic/nonaesthetic dependencies. Actually, I would not kill for the success condition. Perhaps aesthetic intent is enough1. A person might form an aesthetic intention but never get round to acting on it, in which case we do not have a work of art.. (shrink)

This book offers an account of Kant's theory of moral motivation that comprehends the most challenging and controversial aspects of Kant's theory of the will and human moral motivational psychology. It argues for a new approach to the question about the purity of the Kantian moral motive.

This paper argues that radical enactivism (RE) offers a framework with the required nuance needed for understanding of the full range of the various forms of pretense. In particular, its multi-storey account of cognition, which holds that psychological attitudes can be both contentless and contentful, enables it to appropriately account for both the most basic and most advanced varieties of pretense. By comparison with other existing accounts of pretense, RE is shown to avoid the pitfalls of representationalist theories while also (...) allowing us to combine the best elements of the praxeological enactivist (Weichold & Rucińska, 2021 ) and Langland-Hassan’s ( 2020, 2021 ) proposals about pretense, while avoiding their key shortcomings. I argue that there is a tension between two of the most distinctive theses of Sven Rosenkranz’s Justification as Ignorance: the central thesis concerning justification, according to which an agent has propositional justification to believe p iff they are in no position to know that they are in no position to know p and the desire to avoid logical omniscience by imposing only “realistic” idealizations on epistemic agents.

The duty to protect patient welfare underpins undergraduate medical ethics and patient safety teaching. The current syllabus for patient safety emphasises the significance of organisational contribution to healthcare failures. However, the ongoing over-reliance on whistleblowing disproportionately emphasises individual contributions, alongside promoting a culture of blame and defensiveness among practitioners. Diane Vaughan’s ‘Normalisation of Deviance’ provides a counterpoise to such individualism, describing how signals of potential danger are collectively misinterpreted and incorporated into the accepted margins of safe operation. NoD is an (...) insidious process that often goes unnoticed, thus minimising the efficacy of whistleblowing as a defence against inevitable disaster. In this paper, we illustrate what can be learnt by greater attention to the collective, organisational contributions to healthcare failings by applying NoD to The Morecambe Bay Investigation. By focusing on a cluster of five ‘serious untoward incidents’ occurring in 2008, we describe a cycle of NoD affecting trust handling of events that allowed poor standards of care to persist for several years, before concluding with a poignant example of the limitations of whistleblowing, whereby the raising of concerns by a senior consultant failed to generate a response at trust board level. We suggest that greater space in medical education is needed to develop a thorough understanding of the cultural and organisational processes that underpin healthcare failures, and that medical education would benefit from integrating the teaching of medical ethics and patient safety to resolve the tension between systems approaches to safety and the individualism of whistleblowing. Egalitarians often claim that well-off states’ immigration restrictions create or reinforce objectionable inequality. Standard defenses of this claim appeal to the distributive consequences of exclusion. This article offers a relational egalitarian defense of more open borders. On this view, well-off states’ immigration restrictions are problematic because they accord the citizens of well-off states a troubling form of asymmetric power over the disadvantaged. This creates an objectionably unequal relationship between affluent states’ citizens and disadvantaged immigrants. In a recent article, Elliot Sober responds to challenges to a counter-example that he posed some years earlier to the Principle of the Common Cause (PCC). I agree that Sober has indeed produced a genuine counter-example to the PCC, but argue against the methodological moral that Sober wishes to draw from it. Why do well‐functioning psychological systems sometimes give rise to absurd beliefs that are radically misaligned with reality? Drawing on signalling theory, I develop and explore the hypothesis that groups often embrace beliefs that are viewed as absurd by outsiders as a means of signalling ingroup commitment. I clarify the game‐theoretic and psychological underpinnings of this hypothesis, I contrast it with similar proposals about the signalling functions of beliefs, and I motivate several psychological and sociological predictions that could be used to (...) distinguish it from alternative explanations of irrational group beliefs. According to an influential recent view, S is propositionally justified in believing p iff S is in no position to know that S is in no position to know p. I argue that this view faces compelling counterexamples.

I outline a version of idealism that borrows from Humean Supervenience. The resulting theory is immune to what is often considered to be the most powerful anti-idealist argument, the gist of which is that the idealist can’t supply truthmakers (or an adequate supervenience base) for commonly accepted truths about the physical world. That charge has no purchase on Humean idealism.

It has often been noticed that Plato's metaphysical view of being is dipolar. The purpose of the present article is to detail what it means to say that being is dipolar in Plato. Further, I will explore the extent to which dipolarity in Whitehead is indebted to Plato and the extent to which Whitehead's dipolarity is different from Plato's. In this regard I will concentrate on Whitehead's recently published Harvard Lectures.

Law and the legal system through which law is effected are very powerful, yet the power of the law has always been limited by the laws of nature, upon which the law has now direct grip. Human law now faces an unprecedented challenge, the emergence of a second limit on its grip, a new “species” of intelligent agents (AI machines) that can perform cognitive tasks that until recently only humans could. What happens, as a matter of law, when another species (...) interacts with us, can be integrated into human minds and bodies, makes “real-world” decisions—not through human proxies, but directly—and does all this “intelligently”, with what one could call autonomous agency or even a “mind” of its own? The article starts from the clear premise that control cannot be exercised directly on AI machines through human law. That control can only be effected through laws that apply to humans. This has several regulatory implications. The article’s first discusses what, in any attempt to regulate AI machines, the law can achieve. Having identified what the law can do, the article then canvases what the law should aim to achieve overall. The article encapsulate its analysis in a list of both doctrinal and normative principles that should underpin any regulation aimed at AI machines. Finally, the article compares three transnational options to implement the proposed regulatory approach. (shrink)

It is widely believed that immigrants, after some time, acquire a claim to naturalize and become citizens of their new state. What explains this claim? Although existing answers (may) succeed in justifying some of immigrants' rights claims, they cannot justify the claim that immigrants are owed the opportunity to naturalize because these theories lack a sufficiently rich account of the purpose of citizenship. To fill this gap, I offer a novel egalitarian account of citizenship. Citizenship, on this account, partially protects (...) immigrants against social hierarchy by realizing social equality in a publicly accessible manner. This explains claims to naturalize. (shrink)

This book is a study of the philosophy of the early 18th century Irish philosopher George Berkeley in the intellectual context of his times, with a particular focus on how, for Berkeley, mind is related to its ideas. It does not assume that thinkers like Descartes, Malebranche, or Locke define for Berkeley the context in which he develops his own thought. Instead, he indicates how Berkeley draws on a tradition that informed his early training and that challenges much of the (...) early modern thought with which he is often associated. Specifically, the book indicates how Berkeley's distinctive treatment of mind (as the activity whereby objects are differentiated and related to one another) highlights how mind neither precedes the existence of objects nor exists independently of them. This distinctive way of understanding the relation of mind and objects allows Berkeley to appropriate ideas from his contemporaries in a manner that transforms the issues with which he is engaged. The resulting insights--for example, about how God creates the minds that perceive objects--are only now starting to be fully appreciated. (shrink)

This book offers a broad reconstruction of the modern notion of sovereignty, a comprehensive critique of state-inflicted violence, and a concept of non-coercive law for our contemporary world society.

The aim of this paper is to examine Francis Glisson’s theory of perception insofar as it concerns the lowest class of living beings: plants. Plants have a special status, they are located between inanimate objects and animals in the hierarchy of being. Unlike the former, they are organic, but unlike the latter they are unconscious. Peculiar to Glisson is the claim that vegetative organization requires self-referential perception. In light of traditional epistemology, this claim may sound puzzling, because we tend to (...) associate self-representation with conscious thought. In order to make sense of Glisson’s self-referential, but unconscious perceptions, the first part of the paper investigates the role of perception in the vegetative process of organization. The second part is a comparative study on two ways of drawing the distinction between unconscious perceptions and conscious sensations. The first one is the Cartesian approach as outlined by Antoine Arnauld in the early 1680s, the second one is Glisson’s theory. In light of the comparison it is argued that Glisson’s is a higher order theory of sensation in which the phenomenon of consciousness requires the delimitation of the all-inclusive, self-referential nature of perception.
