An online world exists in which businesses have become burdened with managerial and legal duties regarding the seeking of informed consent and the protection of privacy and personal data, while growing public cynicism regarding personal data collection threatens the healthy development of marketing and e-commerce. This research seeks to address such cynicism by assisting organisations to devise ethical consent management processes that consider an individual’s attitudes, their subjective norms and their perceived sense of control during the elicitation of consent. It (...) does so by developing an original conceptual model for online informed consent, argued through logical reasoning, and supported by an illustrative example, which brings together the autonomous authorisation (AA) model of informed consent and the theory of planned behaviour (TPB). Accordingly, it constructs a model for online informed consent, rooted in the ethic of autonomy, which employs behavioural theory to facilitate a mode of consent elicitation that prioritises users’ interests and supports ethical information management and marketing practices. The model also introduces a novel concept, the informed attitude, which must be present for informed consent to be valid. It also reveals that, under certain tolerated conditions, it is possible for informed consent to be provided unwillingly and to remain valid: this has significant ethical, information management and marketing implications. The purpose of this study was to understand the relationship between the coaches’ demographics (academic degree and/or coaching level and/or coaching experience) and young swimmers’ performance and technical ability. The sample was composed by 151 young swimmers (75 boys and 76 girls: 13.02 ± 1.19 years old, 49.97 ± 8.77 kg of body mass, 1.60 ± 0.08 m of height, 1.66 ± 0.09 m of arm span), from seven different clubs. Seven coaches (one per club) were responsible for the training (...) monitoring. Performance and a set of biomechanical variables related to swim technique and efficiency were assessed. The swimmers’ performance was enhanced according to the increase in the coaches’ academic degree (1: 75.51 ± 10.02 s; 2: 74.55 ± 9.56 s; 3: 73.62 ± 7.64 s), coaching level (1: 76.79 ± 11.27 s; 2: 75.06 ± 9.31 s; 3: 73.65 ± 8.43 s), and training experience (≤5-y training experience: 75.44 ± 9.57 s; >5-y training experience: 74.60 ± 9.54 s). Hierarchical linear modeling retained all coaches’ demographics characteristics as main predictors (being the academic degree the highest: estimate = -1.51, 95% confidence interval = -0.94 to -2.08, p = 0.014). Hence, it seems that an increase in the demographics of the coaches appears to provide them with a training perspective more directed to the efficiency of swimming. Defining moral competence using a virtue approach, this longitudinal study examined the prospective relationships between moral competence and externalizing behavior indexed by delinquency and intention to engage in problem behavior in a large and representative sample of Hong Kong Chinese adolescents. Starting from the 2009–2010 academic year, Grade 7 students in 28 randomly selected secondary schools in Hong Kong were invited to join a longitudinal study, which surveyed participating students annually during the high school years. The current study used data (...) collected in the first three years (Wave 1 to Wave 3) across junior secondary school stage (Grade 7 to Grade 9) with a sample of 3,328 students (Age = 12.59 ±.74 years and 52.1% boys at Wave 1). Cross-lagged panel path analyses were conducted to compare four models involving different hypothesized patterns of relationships between moral competence and externalizing behavior. Results revealed that the reciprocal effects model best fit the data, supporting reciprocal causal relationships between moral competence and externalizing behavior measures. Specifically, a higher level of moral competence significantly predicted a lower level of delinquency and problem behavioral intention over time. At the same time, a higher level of externalizing behavior also significantly predicted a lower level of moral competence one year later. As the magnitudes of the significant findings were not high, replications in different Chinese communities are needed. Nevertheless, the present findings provide important theoretical insights on how moral competence and externalizing behavior in adolescents are associated with each other. Practically speaking, the findings suggest that it is promising to reduce adolescent externalizing behavior by promoting their virtues through moral education programs, and guiding adolescents to behave in a good manner would help promote the development of their virtues. Adolescence is a developmental stage when adolescents are vulnerable to addictive behaviors, such as Internet addiction, which refers to pathological use of the Internet. Although there are views proposing that the links between IA and adolescent problem behavior may be bidirectional in nature, few studies have examined the reciprocal relationships between IA and other maladjustment indicators, and even fewer studies have simultaneously employed both emotional and behavioral maladjustment indicators in a single study. To address the above research gaps, the present (...) study investigated how IA is associated with both depression and delinquency among Chinese adolescents. Two waves of data were collected at two consecutive years, respectively, with 1year apart, from 3,010 students in four junior high schools in mainland China. These students completed the same questionnaire containing measures of IA, depression, and delinquency at each wave. The proposed cross-lagged panel model fitted the data very well, and there were significant positive reciprocal effects between IA and depression as well as delinquency after controlling for background socio-demographic factors. Gender differences were also observed in multi-group comparisons. Specifically, IA showed a stronger longitudinal impact on delinquency among boys than among girls. While depression significantly predicted IA in 1year among boys, such a prediction was not significant among girls. These findings delineate the bidirectionality of the associations between IA and emotional and behavioral maladjustment indexed by depression and delinquency, respectively. The findings also suggest that researchers and practitioners have to take gender differences as well as different developmental indicators in understanding the bidirectional influences between IA and adolescent behavioral and emotional development. This study formed the second wave of a longitudinal research project examining bullying from the students? perspective. A sample of 877 Swedish 13?year?olds filled out a questionnaire regarding the definition of bullying, reasons for why some students are bullied and the experience of adults? response to bullying. In their definitions, girls were more likely than boys to include the victims? experience of bullying, whereas boys were more likely than girls to mention bullying as an imbalance of power and a set (...) of repeated actions. Assigning responsibility for the bullying to the bully was more common among girls and bullied adolescents than among boys and non?bullied adolescents. Furthermore, among bullied adolescents, 23% had not told anyone about the bullying and 35% had not received any help. (shrink)

Ira Daniel Aldridge is a case in point-a promising lad who in his formative years lacked sustained contact with his father, a celebrated touring black actor whose peripatetic career in the British Isles and later on the European continent kept him away from home for long periods. When the boy rebelled as a teenager, his father sent him (...) abroad, forcing him to make his own way in the world. Ira Daniel settled in Australia, married, and had children, but he found it difficult to support a family. Eventually, he turned to crime and wound up spending many years in prison. In the philosophy of language, conceptual role semantics (hereafter CRS) is a theory of what constitutes the meanings possessed by expressions of natural languages, or the propositions expressed by their utterance. In the philosophy of mind, it is a theory of what constitutes the contents of psychological attitudes, such as beliefs or desires. CRS comes in a variety of forms, not always clearly distinguished by commentators. Such versions are known variously as functional/causal/computational role semantics, and more broadly as use-theories of (...) meaning. Nevertheless, all are united in seeking the meaning or content of an item, not in what it is made of, nor in what accompanies or is associated with it, but in what is done with it, the use it is put to. Roughly, according to CRS, the meaning or propositional content of an expression or attitude is determined by the role it plays in a person’s language or in her cognition. Currently, many view CRS as the main rival to theories that take notions such as truth or reference as central (for example, Davidson 2001), although the relationship between the two is not straightforward. The following outlines the main varieties of CRS, provides a cursory survey of its history, introduces the central arguments offered in its favor, and provisionally assesses how the variants fair against a number of prominent criticisms. There has recently been a focus on the question of statue removalism. This concerns what to do with public history statues that honour or otherwise celebrate ethically bad historical figures. The specific wrongs of these statues have been understood in terms of derogatory speech, inapt honours, or supporting bad ideologies. In this paper I understand these bad public history statues as history, and identify a distinctive class of public history-specific wrongs. Specifically, public history plays an important identity-shaping role, and bad (...) public history can commit specifically ontic injustice. Understanding bad public history in terms of ontic injustice helps understand not just to address bad public history statues, but also understand the value of public history more broadly. (shrink)

Three studies test eight hypotheses about (1) how judgment differs between people who ascribe greater vs. less moral relevance to choices, (2) how moral judgment is subject to task constraints that shift evaluative focus (to moral rules vs. to consequences), and (3) how differences in the propensity to rely on intuitive reactions affect judgment. In Study 1, judgments were affected by rated agreement with moral rules proscribing harm, whether the dilemma under consideration made moral rules versus consequences of choice salient, (...) and by thinking styles (intuitive vs. deliberative). In Studies 2 and 3, participants evaluated policy decisions to knowingly do harm to a resource to mitigate greater harm or to merely allow the greater harm to happen. When evaluated in isolation, approval for decisions to harm was affected by endorsement of moral rules and by thinking style. When both choices were evaluated simultaneously, total harm -- but not the do/allow distinction -- influenced rated approval. These studies suggest that moral rules play an important, but context-sensitive role in moral cognition, and offer an account of when emotional reactions to perceived moral violations receive less weight than consideration of costs and benefits in moral judgment and decision making. There exists a family of views concerning the foundations of epistemic normativity that all travel under the heading “epistemic instrumentalism”. These views are unified by their attempt to explain epistemic normativity in terms of instrumental normativity. Very roughly, they all say that we have reason to respond to truth-related considerations when forming and maintaining doxastic attitudes since regulating our doxastic attitudes in this way helps us satisfy our aims, interests, or goals. Thus, according to epistemic instrumentalists, truth-related considerations constitute reasons (...) for belief, but they only do so because regulating our beliefs on their basis is an effective way to satisfy our ends. I will first try to clarify the question that epistemic instrumentalism is supposed to answer. I will then identify a plausible normative commitment and show that the main varieties of epistemic instrumentalism fail to vindicate it. I will conclude by arguing that this provides us with prima facie grounds for rejecting epistemic instrumentalism. (shrink)

Recently, a view I refer to as “hypothetical continuism” has garnered some favour among philosophers, based largely on empirical research showing substantial neurocognitive overlaps between episodic memory and imagination. According to this view, episodically remembering past events is the same kind of cognitive process as sensorily imagining future and counterfactual events. In this paper, I first argue that hypothetical continuism is false, on the basis of substantive epistemic asymmetries between episodic memory and the relevant kinds of imagination. However, I then (...) propose and defend an alternative form of continuism, according to which episodic memory is continuous with a capacity I call “actuality-oriented imagination.” Because of the deep epistemic affinities between episodic memory and actuality-oriented imagination, it makes sense to think of them as cognitive processes of the same kind. Historically, academic journals have served a different purpose than the Academy itself. Journals (from the Anglo-Fr. jurnal , "a day," from O.Fr. jornel , "day, time; day's work," hence the journalist as writer of the news of the day ) have served as privileged sites for the articulation and concretization of specific modes of knowledge and control (insemination of those ideas has been formalized in the classroom, in seminar). In contrast, the academic journal is post-partum and has been an old-boys club, an insider trading network in which truths are (re)circulated against themselves, forming a Maginot Line against whatever is new, or the distinctly challenging. All in a Jurnal’s Work will discuss (in part) the ramifications of cheap start-up publications that are challenging the traditional ensconced-in-ivory academic journals and their supporting infrastructures. The panel will be seeking a questioning (as a challenging) towards the discipline of knowledge production/fabrication (of truth[s]) and the event of the Academy (and its publications) as it has evolved and continues to (d)evolve. Issues to be discussed will revolve around the power of academic publishing and its origins, hierarchical versus horizontal academic modules (is there a place for the General Assembly in academia?) and the evolving idea of the Multiversity as a site(s) of a (BABELing) multivocality in the wake of the University of Disaster. A CONTINUOUS ACT Nico Jenkins In Pierre Hadot’s extraordinary book, Philosophy as a Way of Life , the practices of philosophy—that is the exercise of what we can term pre-institionalized love of wisdom, what Philo of Alexandria described as a training towards wisdom—are described as, following the Stoics, “a continuous act, permanent and identical with life itself, which had to be renewed at each instant.” This renewal of thinking, this coming to be of being itself —meeting itself on its own ground, concerns the way philosophy is practiced, and more often, taught, or rather not taught. Hadot continues his thinking with a description of what happens to the structure of thought in the medieval ages as it becomes adopted—co-opted— by the university, and by extension, by the institution of the church. Philosophy becomes no longer a way of living, no longer a praxis as such but becomes a condition that is locked in a theoretical construct, one which was literally removed from life (and in life we read then love, wisdom, being etc, also the home, the market, the field, the street) and secured behind the high walls of the monastery (which were shortly replaced by the high walls of the Academy) where thinking unfortunately rests for the most part today. Hadot writes further that this dangerous movement of removal reduces thinking to a theoretical practice akin to the mythical Ouroborous; “education was thus no longer directed toward people who were to be educated with a view to becoming fully developed human beings, but to specialists, in order that they might learn how to train other specialists.” Thought then is trapped behind the walls of the academy, and with the exception of such thinkers as Spinoza, Descartes, and Liebnitz as well as others who think from an outside in, thought remains, in the form of Kant, Fichte, Hegel, a practice reduced or removed from life and restricted to what Schopenhauer will call “mere fencing in front of the mirror.” This is of course the tendency today and philosophy remains, for the most part, a discourse produced and thought inside the academy and disseminated, in seminated through university presses and of course the academic journal. It seems necessary to me that we have to have a place, a return, to a thinking which is closer to the Stoics, closer to the pre-Socratics, to a thinking which is a practice of becoming, a training to think, to live, to die. this is not south romantic than imperative . This thinking is one of a deep ir responsibility because it is not known, it is not figured out. It requires a risk and what Heidegger calls a leap (for there is no bridge to it). I call it irresponsible because for too long sanctioned thought has had as its premise the idea that thinking has a goal, a direction, a telos ; that it is not an activity but a process which gives a product; that the responsibility of thinking in turn demand an answer. In my mind, only freed from that goal can thinking, in contrast, bask in its own thinking, bask in a state in which the unknown can remain unknown, that mystery can rest as mystery. This is not to say that the world needs no answers, or to promote a Whitmanesque “leaning and loafing” as the only valid practice. It is only to say that for too long, thinking has been validated by the academy, by the answerable, by the already decided. To me, this requires—as an answer— the ir responsibility of thought, what Nancy calls, “a world for which all is not already done (played out, finished, enshrined in a destiny), nor entirely still to do (in the future for always future tomorrows).” This is a thinking not sanctified by the academy, made sacred by the church or the palace but rather it takes place on the périphérie , beyond the ring road, in alleyways behind the marketplace, in cafes stained with the syphilitic patina of irresponsible talk, of loose talk, the kind of talk made loose not only by the tankard and the goblet by the practice and training of attuned thinking. continent. was formed as a collective of thinkers coming out of the European Graduate School (also known as the University of Disaster) three years ago, in an effort to combat, or challenge, the dominant paradigm which isolates thinking from the street, from life, from where perhaps wisdom tends to emerge. We feel that not only is the university herself no longer the privileged site of where true thinking takes place—and where only official thought can take place—but that the very artificiality of the academy denies thinking—at times—authentic, thought. Our goal at continent. is to create a media agnostic publication which is rigorous in its intellectual underpinnings but which will remain permanently beyond and out of reach of the academy. Though many of us butter our bread with academic paychecks (maid!) we attempt to keep continent. as a refuge—and a refugee—from the University in ruins, from the University as a site of preformed and institutionalized pre-set dialogues. In concert with other publications-both cyber and print—as well as various blogs we are attempting to re-dialogize the dialogue of thinking. We are attempting both to speak to— as well as with and against —the university as a site of accreted knowledge. We have not been utterly successful and continue to attempt to define what that role of being perpetually beyond is (while still trying to maintain rigorous intellectual standards) but it is just that, a goal, which is perpetually opening, perpetually unanswered, perhaps even by design, perpetually unanswerable. There are two likely paths for philosophers to follow in their encounters with Artificial Life: they can see it as a new way of doing philosophy, or simply as a new object worthy of philosophical attention using traditional methods. Is Artificial Life best seen as a new philosophical method or a new phenomenon? The authors examined how a perceiver’s identification of a target person’s actions covaries with attributions of mind to the target. The authors found in Study 1 that the attribution of intentionality and cognition to a target was associated with identifying the target’s action in terms of high-level effects rather than low-level details. In Study 2, both action identification and mind attribution were greater for a liked target, and in Study 3, they were reduced for a target suffering misfortune. In Study (...) 4, it was again found that action identification and mind attribution were greater for a liked target, but like that for the self or a liked other, positive actions were identified at higher levels than negative actions, with the reverse being true for disliked others. It has recently been suggested that realism about some subject matter is best construed as the claim that the facts pertaining to this subject matter are essentially independent from the mind, in a sense to be explained, and not as the admittedly weaker claim that they are modally independent from the mind. In this paper, I argue that this proposal is liable to trivialize the realist's position and is biased against his irrealist opponent.

Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public (...) space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland. A thorny question surrounding the meaning of ought concerns a felt distinction between deontic uses of ought that seem to evaluate a state of affairs versus those that seem to describe a requirement or obligation to perform an action, as in and, respectively. There ought not be childhood death and disease. You ought to keep that promise. Various accounts have been offered to explain the contrast between “agentive” and “non-agentive” ought sentences. One such account is the Agency-in-the-Prejacent theory, which traces (...) the difference to a particular kind of ambiguity in the prejacent. This theory has been criticized as linguistically unviable. Indeed, I level a few novel complaints against AIP myself in the present paper. But AIP has a kernel of genuine insight which allows us to explain the contrast—that the distinction between agentive and non-agentive ought sentences owes in part to the way natural language encodes information about agency. I develop this idea into a novel account that, like AIP, traces the contrast to an ambiguity in the complement of the modal. However, according to the view I propose, the Coercion View, a linguistically-motivated coercion operation produces the necessary grammatical conditions for agentive ought, which in turn allow a kind of variadic function operator in the style of to produce the semantic effect we see on display in agentive readings of ought. Having explained the mechanism by which we get this structure, I show that it corroborates some of the central intuitions underwriting agentive ought. I submit that the Coercion View offers an explanation of agentive ought to take at least as seriously as any of its competitors. (shrink)

A downward-entailing context has the property that the replacement of the predicate in the context by a stronger predicate preserves truth. So, for instance, presuppositions aside, the context after “every” in (1) where the NPI “ever” appears is downward entailing.

While solid organ transplantation for patients with substance use issues has attracted ethical discussion, a typology of the ethics themes has not been articulated in the literature. We conducted a scoping review of peer-reviewed literature on solid organ transplantation and substance use published between January 1997 and April 2016. We aimed to identify and develop a typology of the main ethical themes discussed in this literature and to identify gaps worthy of future research. Seventy articles met inclusion criteria and underwent (...) inductive content analysis. Four main ethical themes were identified: (1) personal responsibility; (2) utility; (3) moral character; and (4) fairness. Each theme had multiple sub-themes and there was substantial overlap between themes. This scoping review identified a disproportionate emphasis in the literature regarding personal responsibility, which was referenced by each of the other themes, and a narrow focus on alcohol and liver. We recommend future research further investigate these connections between ethical themes and focus on ethical issues associated with transplants from organ groups other than liver for patients who use substances other than alcohol. Developments in genetics, cyber-technology, nanotechnology, biotechnology, artificial intelligence, and other areas hold the promise – and the peril – of redefining what it means to be human. In addition to hedonism or a desire for self-improvement, the possibilities of these technologies plus the rational concern of falling behind a potential adversary produce a classic security dilemma. These competitive pressures among states, firms, and emerging “super-empowered individuals” encourage the development and dissemination of these technologies, and already the possibilities are being explored (...) by actors in conflict. This security dilemma, plus the nature of the technologies themselves, makes it virtually certain that attempts at regulation will fail. Instead, we should expect “arms races” of quantity and quality of improvements, complicated by differing conceptions of what improvement means. This paper explores these pressures and outcomes, as well as general consequences of the potential modification of “human nature” for global and human security. It finds that whatever forms or enhancements we possess, in a transhuman or posthuman future politics will not be transcended. Critical problems of security will continue to challenge ourselves and our descendants. (shrink)
