RutledgeTwo very prominent scholars have asserted that oratory became more violent and aggressive during the early Principate, as delatores (professional accusers and informants) came to dominate the genre. 1 This assumption has a place in a number of studies on Roman history, culture, and literature which accept their premise. 2 However, such an assumption, before it is accepted, needs (...) to be set in the larger context of Roman oratory over the period from the Republic to the Empire. It is my object here to do just that, for I propose that the new style—one which is generally perceived as more violent—represents not so much a change as a continuity in Roman rhetorical practice, and that the perceived transformation is more a product of how our sources represent orators in the first century c.e. rather than oratory’s metamorphosis into something with a perceptibly more violent style. To that end my argument has two parts. First, we need to put professional accusers into their republican as well as imperial context. Professional accusers in [End Page 555] particular were by no means exclusive to the Empire, and even in Cicero’s time they were associated with a more violent style. 3 After we set them in their larger historical context, we may then set them in their rhetorical context: Roman rhetorical theorists expected prosecution, in which delatores specialized, to be more violent by its very nature—something generally overlooked by scholars. All of this is not to deny that rhetoric underwent a fundamental change between the Republic and Empire; that is indisputable. Rather, I suggest that given the nature of what delatores did, in and of itself, and given our sources, it is very difficult to conclude that the style of delatores was essentially more “savage and aggressive” than that of their predecessors under the Republic. It was the inherent nature of Roman oratory and the ever-competitive milieu of Roman politics—during both the Republic and the Empire—which worked in unison to create such continuity. It is the nature of our sources under the Empire, on the other hand, which has led scholars to a distorted impression of oratory in the first century c.e.Let us turn first to accusatio under the Republic. Accusation appears to have always been a morally dubious undertaking, and the revulsion felt by Tacitus and Pliny under the Empire at those who pursued it professionally was by no means unique to their age. Cicero, our main source for this activity during the late Republic, by all indica-tions felt accusation generally unethical and something to be avoided, for while he noted that it could indeed make a reputation, he also remarked that prosecution ought to be undertaken only in certain circumstances. 4 Pursuit of such activity, if it turned into a habit, could become [End Page 556] an embarrassment for the accuser’s family, as Cicero indicates it was for M. Brutus’: Isdem temporibus M. Brutus, in quo magnum fuit, Brute, dedecus generi vestro, qui, cum tanto nomine esset patremque optimum virum habuisset et iuris peritissimum, accusationem factitaverit (Brut. 130). But even if it was not the habit of an individual to accuse, it was necessary to justify at length the acceptance of a case for the prosecution, as Cicero illustrates in his apology, in Divinatio in Caecilium (passim), for taking up the accusation against Verres. That prosecution was an ethically questionable activity is by no means in doubt; we see an inherent bias against prosecution in Rome in Cicero’s day, one which was carried over into the Empire and which left its mark on our sources. 5This did not prevent orators, however, from habitually undertaking prosecutions. One of the initial indications that orators had started to specialize in accusation is found in Cicero’s Pro S. This paper takes a philosophical look at how the views of Gilbert Ryle and Kwasi Wiredu can be used to resolving the mind-body problem located in Rene Descartes’ philosophy. The common sense account of the mind-body theory was first systematically carried out by Descartes. To him, mind and body do not only exist, they also interact. Through his notion of clear and distinct ideas, Descartes infers the existence of the mind as a thinking substance. Unlike the mind, whose character is (...) thought, the body for Descartes is an extended thing. He insists that the point of interaction is the pineal grand, which God has worked out from the point of creation. Today, the view that body and mind interact has generated some controversies. Ryle argues that Descartes has made a category mistake by interpreting mind as a distinct substance. For Wiredu, in Akan thought system, mind does not go to constitute a person. Thus Ryle and Wiredu tend toward materialism when they argue that the source of consciousness is the brain, rather than the mind. This paper explores the claims of these philosophers: Descartes, Ryle and Wiredu. I stress that Ryle and Wiredu’s views do not resolve the Cartesian problem. The paper concludes that unless the problem of the source of consciousness is tackled, the mind-body problem cannot be adequately resolved. (shrink)

Decision making is the physician's major activity. Every day, in doctors' offices throughout the world, patients describe their symptoms and com plaints while doctors perform examinations, order tests, and, on the basis of these data, decide what is wrong and what should be done. Although the process may appear routine-even to the physicians in volved-each step in the sequence requires skilled clinical judgment. Physicians must decide: which symptoms are important, whether any laboratory tests should be done, how the various items (...) of clinical data should be combined, and, finally, which of several treatments (including doing nothing) is indicated. Although much of the information used in clinical decision making is objective, the physician's values (a belief that pain relief is more important than potential addiction to pain-killing drugs, for example) and subjectivity are as much a part of the clinical process as the objective findings of laboratory tests. In recent years, both physicians and psychologists have come to realize that patient management decisions are not only subjective but also prob abilistic (although this is not always acknowledged overtly). When doc tors argue that an operation is fairly safe because it has a mortality rate of only 1 %, they are at least implicitly admitting that the outcome of their decision is based on probability. In this study Steven Wall presents and defends a perfectionist account of political morality that takes issue with many currently fashionable liberal ideas but retains the strong liberal commitment to the ideal of personal autonomy. He begins by critically discussing the most influential version of anti-perfectionist liberalism, examining the main arguments that have been offered in its defence. It is contended that Jurgen Habermas's (1972, 1984) attempts to overcome the problems that positivist thought has caused for theorizing rationality has actually exacerbated positivism's negative effects on conceptualizing rational thought. An overview of Hilary Putnam's (1981) examination of logical positivism's understanding of rationality is presented, emphasizing that positivist approaches toward theorizing rationality are essentially self-refuting in nature since they utilize a metaphysical perspective. Potential objections to the delineation of logical positivism's account of rationality as self-refuting are addressed. Habermas' analysis (...) of positivism's influence on rationality & his concept of communicative competence are then reviewed. Examination of Habermas' attempt to establish a "universal pragmatics" & his contention that validity claims are rationalized through argumentative discourse is performed, leading to the conclusion that such theorizing of rationality is ultimately metaphysical in nature. Treatments of rationality that attempt to impart a comprehensive account of rationality are deemed unintelligible; consequently, it is maintained that all-encompassing delineations of rationality should be avoided in order to produce viable theories of rational thought. The public must make assessments of a range of health-related issues. However, these assessments require scientific know-ledge which is often lacking or ineffectively utilized by the public. Lay people must use whatever cognitive resources are at their disposal to come to judgement on these issues. It will be contended that a group of arguments—so-called informal fallacies—are a valuable cognitive resource in this regard. These arguments serve as cognitive heuristics which facilitate reasoning when knowledge is limited or beyond the grasp of (...) reasoners. The vast expressive power of language is made possible by two principles: the arbitrary soundmeaning pairing underlying words, and the discrete combinatorial system underlying grammar. These principles implicate distinct cognitive mechanisms: associative memory and symbolmanipulating rules. The distinction may be seen in the difference between regular inflection (e.g., walk-walked), which is productive and open-ended and hence implicates a rule, and irregular inflection (e.g., come-came, which is idiosyncratic and closed and hence implicates individually memorized words. Nonetheless, two very different theories have (...) attempted to collapse the distinction; generative phonology invokes minor rules to generate irregular as well as regular forms, and connectionism invokes a pattern associator memory to store and retrieve regular as well as irregular forms. I present evidence from three disciplines that supports the traditional word/rule distinction, though with an enriched conception of lexical memory with some of the properties of a pattern-associator. Rules, nonetheless, are distinct from patternassociation, because a rule concatenates a suffix to a symbol for verbs, so it does not require access to memorized verbs or their sound patterns, but applies as the "default," whenever memory access fails. I present a dozen such circumstances, including novel, unusual-sounding, and rootless and headless derived words, in which people inflect the words regularly (explaining quirks like flied out, low-lifes, and Walkmans). A comparison of English to other languages shows that contrary to the connectionist account, default suffixation is not due to numerous regular words reinforcing a pattern in associative memory, but to a memory-independent, symbol-concatenating mental operation. Combining techniques of the first author and Shelah with ideas of Magidor, we show how to get a model in which, for fixed but arbitrary finite n, the first n strongly compact cardinals κ 1 ,..., κ n are so that κ i for i = 1,..., n is both the i th measurable cardinal and κ + i supercompact. This generalizes an unpublished theorem of Magidor and answers a question of Apter and Shelah.

This paper examines a common misreading of the mechanics of Malebranche's doctrine of divine causal agency, occasionalism, and its roots in a related misreading of Malebranche's theories. God, contrary to this misreading, is for Malebranche constantly and actively causally engaged in the world, and does not just establish certain laws of nature. The key is in understanding just what Malebranche means by general volitions'.

In this paper, we argue that in order for the study of arts education to continue to advance, we must delineate the effects of particular forms of arts education, offered in certain contexts, on specific domains of children’s socioemotional development. We explain why formulating precise hypotheses about the effects of arts education on children’s socioemotional development requires a differentiated definition of each arts education program or activity in question, as well as a consideration of both the immediate and broader contexts (...) in which that program or activity occurs. We then offer the New Victory Theater’s Schools with Performing Arts Reach Kids program as an illustrative example of how these considerations allow for the refinement of hypotheses about the impact of arts education on children’s socioemotional development. Rooting, defined as a spectator’s demonstrative encouragement of a contestant’s effort, ideally has the morally positive aspects of benevolent concern and helpfulness but in practice strains against reasonable standards of conduct by being rude, excessively biased, exploitative, fanatical, and superstitious. Rooting may activate an atavistic, morally cogent sense of fighting for one’s group that is at odds with the universalism of civilized morality. The ‘merely play’ excuse can cut both ways, deflecting moral objections but also removing moral credit from rooting. (...) Although rooting is often not humane, humane rooting can occur and is supported by humane commentary by sports participants, broadcasters, and journalists. Humane rooting supports the premise of benevolence theories (Mengzi, Hutcheson) that morally ideal benevolence has a foothold in an innate general benevolence – seen in this area especially in benevolence toward efforts. Being partisan, excited, and demonstrative, rooters cannot perfectly embody ‘universal calm benevolence’, but they can consciously minimize the inhumane aspects of rooting and achieve a more fully prosocial satisfaction. How do societies improve over time? This paper demonstrates one means through which the independent actions of individuals can produce country-level social change. We explain how institutional governance norms, specifically those surrounding rule of law, are transmitted to developing countries through migrants and their remittances. We develop and test an empirical model using a panel dataset of 49 developing countries from 2001-2010. Results suggest that migrants and their remittances matter, but their impact depends on where both reside abroad. Some recent work in the philosophy of quantum mechanics has suggested that quantum systems can be thought of as non-separable and therefore non-individual, in some sense, in Bell and E.P.R. type situations. This suggestion is set in the context of previous work regarding the individuality of quantal particles and it is argued that such entities can be considered as individuals if their non-classical statistical correlations are understood in terms of non-supervenient relations holding between them. We conclude that such relations are (...) strongly non-supervenient in Cleland's sense and note a possible connection between this idea and the realist quantum logic programme. (shrink)

The Renaissance development of science fulfilled the ancient ideal of integrating quantitative and qualitative thinking, but failed to recognize valuational thinking and thus deprived moral, aesthetic, and political thought of cognitive status. The task of this book is to reconstruct the concept of thinking in order to exhibit valuation, not reason, as the foundation for thinking and to integrate valuational with quantitative and qualitative modes. Part I explains the broad thesis, interpreting the problem of the foundations for thinking and providing (...) a general theory of value. Part II explains the role of valuation at the imaginative level of thinking with discussions of synthesis, perception, form, and art. How do women's sexual interests change across their ovulatory cycles? This question is one of the most enduring within the human evolutionary behavioral sciences. Yet definitive, agreed-upon answers remain elusive. One empirical pattern appears to be robust: Women experience greater levels of sexual desire and interest when conceptive during their cycles. But this pattern is not straightforward or self-explanatory. We lay out multiple possible, broad explanations for it. Based on selectionist reasoning, we argue that the conditions that give rise to (...) sexual interests during conceptive and non-conceptive phases are likely to differ. Because conceptive and non-conceptive sex have distinct functions, the sexual interests during conceptive and non-conceptive phases are likely to have different strategic ends. We discuss provisional evidence consistent with this perspective. But the exact nature of women's dual sexuality, if it exists, remains unclear. Additional empirical research is needed. But perhaps more crucially, this topic demands additional theory that fruitfully guides and interprets future empirical research. (shrink)

Some critics argue that Marx has conflicting models of history: a "continuist" model that interprets history as a unified, evolutionary movement, and a "discontinuist" model that sees capitalist society as a break from all preceding social formations. I argue that Marx in fact does have multiple models of history, but that these are not incompatible or contradictory. Rather, Marx adopts a "perspectival" or "contextualist" approach that employs different models to gain different perspectives on the historical process.
