On 18–19 May 2018, a symposium was held in the Research Institute of Irish and Scottish Studies at the University of Aberdeen to commemorate the tenth anniversary of the death of Ronald W. Hepburn (1927–2008). The speakers at this event discussed Hepburn’s oeuvre from several perspectives. For this book, the collection of the revised versions of their talks has been supplemented by the papers of other scholars who were unable to attend the symposium itself. Thus this volume contains contributions from (...) eighteen notable scholars of different disciplines, ranging from contemporary aesthetics and art theory through to philosophical approaches to religion, education and social anthropology. It also includes a bibliography of Hepburn’s writings. The essays were first published in two special issues of the Journal of Scottish Thought, vols. 10–11 (2018–2019). -/- Ronald William Hepburn was born in Aberdeen on 16 March 1927. He went to Aberdeen Grammar School, then he graduated with an M.A. in Philosophy (1951) and obtained his doctorate from the University of Aberdeen (1955). His tutor at Aberdeen was Donald MacKinnon (1913– 1994), a Scottish philosopher and theologian, the author of A Study in Ethical Theory (1957) and The Problem of Metaphysics (1974). Hepburn taught as Lecturer at the Department of Moral Philosophy at Aberdeen (1956–60), and he was also Visiting Associate Professor of Philosophy at New York University (1959–60). He returned from the United States as Professor of Philosophy at Nottingham University. In 1964, he was appointed as a Chair in Philosophy at the University of Edinburgh and between 1965 and 1968 he was also Stanton Lecturer in the Philosophy of Religion at the University of Cambridge. From 1975 until his retirement in 1996, he held the Professorship of Moral Philosophy at Edinburgh. He died in Edinburgh on 23 December 2008. His philosophical interests ranged from theology and the philosophy of religion through moral philosophy and the philosophy of education to art theory and aesthetics. Notably, Hepburn is widely regarded as the founder of modern environmental and everyday aesthetics as a result of the influence of papers in the 1960s which pioneered a new approach to the aesthetics of the natural world. This paper suggests that pragmatism makes a distinctive contribution to the theory and practice of radical democracy. It investigates the relation ship between the renewal of interest in pragmatism and the recent attempts to develop radical democratic alternatives to political liberalism. With particular reference to the contemporary critical social theory of Habermas and Honneth, the paper outlines key dimensions of the civic republican, deliberative democratic and reflexive cooperative reconstructions of John Dewey's conception of democracy. These reconstructions are shown to have (...) explicated important pragmatist insights concerning public participation in civic associations, the discursive practices of deliberation, and the cooperative organization of the division of labour. However, it is argued that each of these reconstructions pre suppose some facet of the additional pragmatist understanding of the creativity of action and that the most distinctive contributions of pragmatism to radical democratic theory and practice derive from a notion of democracy as instituted and emergent meaning. Many anthropological explanations of magical practices are based on the assumption that the immediate cause of performing an act of magic is the belief that the magic will work as claimed. Such explanations typically attempt to show why people come to believe that magical acts work as claimed when such acts do not identifiably have such effects. We suggest an alternative approach to the explanation of magic that views magic as a form of religious behavior, a form of communication that (...) promotes or protects cooperative social relationships. We suggest that all forms of religious behavior involve persons communicating acceptance of a supernatural claim and that this act communicates a willingness to accept nonskeptically the influence of the person making such a claim. Thus, religious behavior communicates a willingness to cooperate with the claim maker and others who accept his or her influence. We suggest that magic, which can be distinguished by the communicated acceptance of the claim that certain techniques have supernatural effects, also promotes cooperation. Different types of magic, including sorcery, love magic, and curing magic, can be shown to communicate different types of messages, such as a threat to use violence to punish unsocial behavior, sexual desire, or concern for a person's well-being. Ethnographic examples are used to support this hypothesis. This approach requires no assumptions about whether the practitioners of magic do or do not believe that the magical acts work as claimed. It attempts only to account for the identifiable talk and behavior that constitute magical acts by examining the identifiable, and often important, effects of these acts on the behavior of others. The branch of evolutionary theory known as signaling theory attempts to explain various forms of communication. Social scientists have explained many traditional rituals as forms of communication that promote cooperative social relationships among participants. Both evolutionists and social scientists have realized the importance of trust for the formation and maintenance of cooperative social relationships. These factors have led to attempts to apply signaling theory to traditional cultural rituals in various ways. This paper uses the traditional ritual of mumming in small (...) Newfoundland fishing villages to evaluate alternative hypotheses about the connection between rituals, communication, trust, and cooperation. Mumming is found to be most consistent with the hypothesis that it is a ritual of trust wherein participants take a specific type of risk: the risk of harm at the hands of other participants. Individuals who take this risk actively signal their trust. Conversely, individuals who restrain themselves from inflicting harm on other participants actively signal their trustworthiness. (shrink)

The growing interest in dual‐inheritance models of human evolution has focused attention on culture as a means by which ancestors transmitted acquired phenotypic characteristics to their descendants. The ability of cultural behaviors to be repeatedly transmitted from ancestors to descendants enables individuals to influence their descendant‐leaving success over many more generations than are usually coclusive fitness. This essay proposes that traditional stories, or myths, can be seen as a way in which ancestors influence their descendant‐leaving success by influencing the behavior (...) of many generations of their descendants. The myth of Oedipus is used as an example of a traditional story aimed at promoting proper behavior and cooperation among kin. This interpretation of the Oedipus myth is contrasted with Freudian and structuralist interpretations. (shrink)

In this article we review the emerging literature on the self-transcendent emotions. We discuss how the self-transcendent emotions differ from other positive emotions and outline the defining features of this category. We then provide an analysis of three specific self-transcendent emotions—compassion, gratitude, and awe—detailing what has been learned about their expressive behavior, physiology, and likely evolutionary origins. We propose that these emotions emerged to help humans solve unique problems related to caretaking, cooperation, and group coordination in social interactions. Andrew Cooper presents the first systematic study of Kant's account of natural history. Cooper contends that Kant made a decisive contribution to one of the most explosive and understudied revolutions in the history of science: the addition of time to the frame in which explanations are required, sought, and justified in natural science. Through addressing a wide range of Kant's works, Cooper challenges the claim that Kant's theory of science denies a developmental conception of nature and argues (...) instead that it establishes a method by which natural historians can genuinely dispute historical claims and potentially come to consensus. This method, Cooper argues, can be used to expose serious flaws in Kant's own historical reasoning, including the formation and defence of his racist views. The book will be valuable to philosophers seeking to discern both the power and limitations of Kant's theory of science, and to historians of science working on the fractured landscape of eighteenth-century Newtonianism. For several years the research group at our Dialogue Systems Lab has been involved in the development of the information state update approach to the building of dialogue systems and in particular Issue based dialogue management developed in Staffan Larsson's PhD thesis and based on Jonathan Ginzburg's gameboard approach to dialogue, focussing on the notion of questions (or issues) under discussion. Larsson's computational approach to information state updates involves a large collection of update rules which fire when certain conditions in (...) the information state are met in a regime determined by a general control algorithm. An utterance by a dialogue participant will in general unleash a whole chain of such updates and part of the power of the approach lies in the fact that we can define very general update rules which have small effects on the information state and which are not necessarily linked to any particular form of utterance. It gives us a much finer grain on update rules than thinking in terms of single monolithic updates associated with speaker utterances. (shrink)

This article considers what the implications of decertification would be for single-sex services such as domestic and sexual violence support. Some reform options attached to decertification could (re)allocate authority away from the state to organisations or individuals to determine gender criteria. What would the consequences of such re-allocation be in determining eligibility to receive or access services or excluding people on the basis of a characteristic protected under equality law? Engaging with this in the context of domestic and sexual violence (...) support service provision raises a number of questions. Firstly, does the existence of gender-based violence and/or of the effects it produces require a stable category in order to address them? What benefits may emerge from providing single-sex spaces that could not be replicated in other settings? And finally, what criteria of exclusion and inclusion are currently used to determine access to spaces beyond legal gender status? (shrink)

Why do gardens matter so much and mean so much to people? That is the intriguing question to which David Cooper seeks an answer in this book. Given the enthusiasm for gardens in human civilization ancient and modern, Eastern and Western, it is surprising that the question has been so long neglected by modern philosophy. Our concept of disorder is changing. This causes problems for projects of descriptive conceptual analysis. Conceptual change means that a criterion that was necessary for a condition to be a disorder at one time may cease to be necessary a relatively short time later. Nevertheless, some conceptually based claims will be fairly robust. In particular, the claim that no adequate account of disorder can appeal only to biological facts can be maintained for the foreseeable future. My ultimate purpose here is to examine, discuss, and interpret a difficult excerpt in Stobaeus’ 5th c. AD anthology, alleging to report—uniquely, it appears—a distinction Chrysippus drew between three different applications of the term stoixe›on or element (i.e., physical element).1 Stobaeus lists this passage as giving opinions specifically of Chrysippus “about the elements out of substance” (per‹ t«n §k t∞w oÈs€aw stoixe€vn), though in holding them he says Chrysippus was following Zeno, the leader of his sect. Hermann Diels (1879) identified (...) this selection as an excerpt (his fr. 21) from Arius Didymus’ late first century BC Epitome of Physical Doctrines.2 I print a translation below, with the text in an Appendix, as it is given in von Arnim (1903). The text is not without its problems, and I indicate in footnotes to the text which of the principal editors’ textual interventions I accept and follow in my translation. Whether this text presents a single, continuous excerpt from Arius Didymus, or instead some compilation of Stobaeus (or an earlier anthologist whose work Stobaeus employed) from dispersed passages of.. No writer or public intellectual of our era has been as sensitive to the role of faith in the lives of ordinary Americans as Robert Coles. Though not religious in the conventional sense, Coles is unparalleled in his astute understanding and respect for the relationship between secular life and sacredness, which cuts across his large body of work. In articulating a theological account of Christian hope faithful to its objective character, Pope Benedict XVI summons the authority of Thomas Aquinas, citing his comments on faith and hope as those terms occur in Hebrews 11:1. Benedict sets off Aquinas's understanding of hope-filled faith's objectivity by placing it in contrast with Luther's apparently more subjective interpretation of faith in Hebrews 11:1 as conviction. Closer analysis of both Aquinas and Luther, however, suggests a greater overlap in their exegetical conclusions, opening the (...) way for a more nuanced appreciation of a virtue whose living possession and exercise, as the rest of Spe Salvi confirms, involves both objective and subjective dimensions. In this paper I return to Hegel's dispute with Kant over the conceptual ordering of external and internal purposiveness to distinguish between two conceptions of teleology at play in the contemporary function debate. I begin by outlining the three main views in the debate (the etiological, causal role and organizational views). I argue that only the organizational view can maintain the capacity of function ascriptions both to explain the presence of a trait and to identify its contribution to a current (...) system, for it is the only view that considers teleology as a natural cause. To establish how teleology can be considered as a natural cause, advocates of the organizational view return to Kant's analysis of internal purposiveness. However, while Kant identifies the requirements that an object must meet to satisfy the demands of teleological judgment, I suggest that he denies that we can know whether they are truly met. I argue that Hegel's philosophy of nature is better equipped to determine how internal purposiveness can be considered as a natural cause, for it grounds organization in a form of purposiveness that is more fundamental than a designer's intention. In Selfless Cinema?, Sarah Cooper maps out the power relations of making, and viewing, documentaries in ethical terms. The ethics of filmmaking are often examined in largely legalistic terms, dominated by issues of consent, responsibility, and participantse(tm) or film-makerse(tm) rights, but Cooper approaches four representative French film-makers e" Jean Rouch, Chris Marker, Raymond Depardon, and Agns Varda e" in a far less juridical way, drawing on the ethical philosophy of Emmanuel Levinas. She argues that, in spite of Levinase(tm)s (...) iconoclastic, anti-ocular thinking, his concept of visage is richly applicable to film, and especially to documentary. (shrink)

Libertarians propose that if agents are to act freely they must have alternative possibilities open to them and control over which possibility becomes actual. To secure alternative possibilities, libertarians must accept that our free actions are undetermined events. Proponents of the “luck objection” to libertarianism argue that undetermined events are not the sorts of things over which agents can have control. In what follows, I defend the luck objection against three of the more promising libertarian rejoinders.

In Recovering Hegel from the Critique of Leo Strauss, Sara MacDonald and Barry Craig provide a study unique in its focus on Leo Strauss’s reading of Hegel. While MacDonald and Craig find value in Strauss’s thought, they argue that his pessimism concerning modernity lies in a misunderstanding of both modernity’s greatest philosophical advocate, G.W.F. Hegel, and modernity’s virtues.

Núñez et al. (2019) argue that cognitive science has failed either “to transition to a mature inter‐disciplinary coherent field” (p. 782) or “to generate a successful [Lakatosian] research program” (p. 789). We argue that the former was never the intention of many early researchers within the field, while the latter is an inappropriate criterion by which to judge an entire discipline. However, we concur with Núñez et al. (2019) that the individual disciplinary balance within cognitive science has changed over time. (...) We discuss the development of cognitive neuroscience in terms of the tension between the greater sophistication in cognitive concepts and methods of the cognitive sciences and the increasing power of more standard biological approaches to understanding brain structure and function. There have been major technological developments in brain imaging and advances in simulation, but there have also been shifts in emphasis, with topics such as thinking, consciousness, and social cognition becoming fashionable within the brain sciences. There is by now broad consensus in the critical literature that neoliberalism and social conservatism have frequently coexisted in practice. Yet the alt-right fits none of the previously identified alliances: this is not the neoliberal neoconservatism of the Reagan and Bush years, nor the neoliberal communitarianism of the Third Way, nor even a form of neoliberal authoritarianism. Instead, the alt-right claims intellectual descent from economic libertarianism, on the one hand, and paleo- (as opposed to neo-) conservatism on the other. This (...) paper traces the contours of this ‘paleolibertarian’ alliance, first by following the volatile political trajectory of Murray Rothbard, the foremost philosopher of American libertarianism, and, second, by uncovering precedents in the longer history of the American far right. It will be argued that paleoconservatism makes for a uniquely powerful ally because it offers a workable response to libertarianism’s intrinsic contradictions. (shrink)

This article explores the challenge of developing a feminist law reform proposal to decertify sex and gender based on research conducted for the ‘Future of Legal Gender' project. Locating the proposal to decertify within a do-it-yourself, prefigurative approach to law reform, the article asks: Can a law reform proposal be both instrumental and radical? Can a proposal take shape as a viable legislative text and as a more subversive intervention to unsettle and reimagine gender’s relationship to law? This article explores (...) this at two levels. First, it considers the ontological challenges of developing a controversial law reform proposal in terms of its realness (or fictiveness), contours, and temporality, turning to ‘slow law' as a credible way of approaching radical reform. Second, it explores the design-based challenges of legal prototyping—foregrounding questions of legitimacy, participation, and purpose, which arise in designing a decertification law. At the heart of this discussion is the relationship between representation and enactment—between what a proposal presents and what its presentation does and does not accomplish. (shrink)

The pervasive use of contracts in healthcare is a source of unease for many healthcare ethicists and patient advocates. This commentary examines the use of such contracts with individuals in rehabilitation settings who have complex medical and behavioural issues. The goals of this paper are to examine the many factors that can lead to contract use, to discuss some legal and ethical implications of contract use, and to assess contract use in light of concerns about health equity.
