The pressure on companies to practice corporate social responsibility (CSR) has gained momentum in recent times as a means of sustaining competitive advantage in business. The pharmaceutical industry has been acutely affected by this trend. While pharmaceutical product recalls have become rampant and increased dramatically in recent years, no comprehensive study has been conducted to study the effects of announcements of recalls on the shareholder returns of pharmaceutical companies. As product recalls could significantly damage a company's reputation, profitability and brand (...) integrity, this paper investigates the effect on shareholder wealth and the extent to which the adoption of CSR practices by pharmaceutical companies in the United Kingdom (U.K.) and the United States (U.S.), the two largest markets for pharmaceutical products in the world, affected market reactions surrounding product recall announcements. The analysis of product recall announcements from 1998 to 2004 compiled from The Pharmaceutical Journal and U.S. Food and Drug Administration enforcement reports revealed marked differences in the way market participants in the two countries responded to news of product recalls. U.S. investors penalised firms according to the severity of product defects while U.K. investors were indifferent. While U.K. investors rewarded product recalls by firms which were not usually CSR-active, U.S. investors punished non-CSR active firms that performed recalls. These observations could pose strategic challenges to pharmaceutical firms operating in both countries. (shrink)

Thousands of youth suffering from acquired brain injury or other early-life neurological disease live, mature, and learn with only limited communication and interaction with their world. Such cognitively capable children are ideal candidates for brain-computer interfaces. While BCI systems are rapidly evolving, a fundamental gap exists between technological innovators and the patients and families who stand to benefit. Forays into translating BCI systems to children in recent years have revealed that kids can learn to operate simple BCI with proficiency akin (...) to adults. BCI could bring significant boons to the lives of many children with severe physical impairment, supporting their complex physical and social needs. However, children have been neglected in BCI research and a collaborative BCI research community is required to unite and push pediatric BCI development forward. To this end, the pediatric BCI Canada collaborative network was formed, under a unified goal to cooperatively drive forward pediatric BCI innovation and impact. This article reflects on the topics and discussions raised in the foundational BCI-CAN meeting held in Toronto, ON, Canada in November 2019 and suggests the next steps required to see BCI impact the lives of children with severe neurological disease and their families. The Rights of War and Peace is the first fully historical account of the formative period of modern theories of international law. Professor Tuck examines the arguments over the moral basis for war and international aggression, and links the debates to the writings of the great political theorists such as Hobbes, Locke, Rousseau, and Kant. The book illuminates the presuppositions behind much current political theory, and puts into a new perspective the connection between liberalism and imperialism.

Richard Tuck traces the history of the distinction between sovereignty and government and its relevance to the development of democratic thought. Tuck shows that this was a central issue in the political debates of the seventeenth and eighteenth centuries, and provides a new interpretation of the political thought of Bodin, Hobbes and Rousseau. Integrating legal theory and the history of political thought, he also provides one of the first modern histories of the constitutional referendum, and shows the importance (...) of the United States in the history of the referendum. The book derives from the John Robert Seeley Lectures delivered by Richard Tuck at the University of Cambridge in 2012, and will appeal to students and scholars of the history of ideas, political theory and political philosophy. In October 2016, the White House, the European Parliament, and the UK House of Commons each issued a report outlining their visions on how to prepare society for the widespread use of artificial intelligence. In this article, we provide a comparative assessment of these three reports in order to facilitate the design of policies favourable to the development of a ‘good AI society’. To do so, we examine how each report addresses the following three topics: the development of a ‘good (...) AI society’; the role and responsibility of the government, the private sector, and the research community in pursuing such a development; and where the recommendations to support such a development may be in need of improvement. Our analysis concludes that the reports address adequately various ethical, social, and economic topics, but come short of providing an overarching political vision and long-term strategy for the development of a ‘good AI society’. In order to contribute to fill this gap, in the conclusion we suggest a two-pronged approach. (shrink)

This book shows how political argument in terms of rights and natural rights began in medieval Europe, and how the theory of natural rights was developed in the seventeenth century after a period of neglect in the Renaissance. Dr Tuck provides a new understanding of the importance of Jean Gerson in the formation of the theories, and of Hugo Grotius in their development; he also restores the Englishman John Selden's ideas to the prominence they once enjoyed, and shows how (...) Thomas Hobbes's political theory can best be understood against this background. In general, the book enables us to understand more fully the characteristics of the natural rights theories available to the men of the Enlightenment, and thereby to appreciate the complexity and equivocal nature of modern right theories. This essay denaturalizes the taken-for-granted meaning of ‘access’ and interrogates its role and lived meaning in ableist social worlds, with a focus on spaces of higher education. I suggest that legalistic approaches to access need ‘cripping’ by a disability framework. Currently, these approaches (1) miss the intersubjective sociality of being-in-the-world; (2) they prioritize a narrow conception of access focused on ‘physical’ access and ‘physical’ space (a typology I contest); (3) they approach access as frozen in time, rather than as a (...) relational and temporally dynamic process (4); and, finally, they contribute to bureaucratizing and privatizing disability knowledge. I examine ‘access’ through the lens of belonging by asking how we orient ourselves in spaces shaped by oppressive social norms. I argue that ableist lifeworlds generate serious disorientations for disabled people that are lasting, structurally enforced, and harmful or debilitating. (shrink)

'What would happen if everyone acted that way?' This question is often used in everyday moral assessments, but it has a paradoxical quality: it draws not only on Kantian ideas of a universal moral law but also on consequentialist claims that what is right depends on the outcome. In this book, Alex Tuckness examines how the question came to be seen as paradoxical, tracing its history from the theistic approaches of the seventeenth century to the secular accounts of the present. Individuals diagnosed with conduct disorder (CD) in childhood and adolescence are at risk for increasingly maladaptive and dangerous behaviors, which unchecked, can lead to antisocial personality disorder (ASPD) in adulthood. Children with CD, especially those with the callous unemotional subgroup qualifier (“limited prosocial emotions”/dsm‐5), present with a more severe pattern of delinquency, aggression, and antisocial behavior, all markings of prodrome ASPD. Given this recognized diagnostic trajectory, with a pathological course playing out tragically at the individual, familial, and societal level, and (...) lack of effective remediation via current standards of care, we posit an alternate treatment approach; case‐specific compulsory moral habilitation aimed at rectifying the undeveloped affective domain of adolescents and young adults suffering from these disorders. We begin with a brief historical overview of response to mental illness, review CD and ASPD diagnostic criteria and treatment limitations, and posit a unique neurohabilitative approach that focuses on the absent affective moral development of these populations. Next, we invoke a public health safety argument to justify case‐specific compulsory moral habilitation, discuss neurotechnologies to be considered in treatment, and conclude with ethical considerations and suggestions for further research. Our study has two concerns. The first falls under the methodological aspect of collaborative research : how researchers and teachers introduce each other to the world of the other and at their respective referents? What are the characteristics of their interactions, how do they facilitate mutual understanding? The second falls within the terms of the partnership : how to negotiate the subject of mutual concern, that is to say what will become both object of research and object of training? This (...) study shows that professional development actors rooted in a negotiation - conversion process, through the involvement of bifacial objects. In this sense, collaboration takes shape around the same object, each actor takes care of one side of the bifacial object and needs the experience of the other to develop this side. We can then speak of reciprocal acculturation. This research shows that collaboration is established once it has acquired the characteristics of a work situation in which and by which the activity of each category of actors produces development. At healthcare facilities worldwide, women during childbirth undergo medical procedures they haven’t consented to and experience mistreatment and disrespect. This phenomenon is recognized as obstetric violence (OV), a distinct form of gender violence. The resulting trauma carries both immediate and long-term implications, making it vital to address for promoting women’s health. OV is partly shaped by a narrow, paternalistic conception of vulnerability. A flawed conception of the vulnerability of pregnant women and fetuses has opened the door to medical control and (...) coercion during childbirth. In this paper we examine what role notions of vulnerability play in perpetuating OV and consider recent attitudinal shifts in research ethics as a model for addressing it. (shrink)

Global challenge-led research seeks to contribute to solution-generation for complex problems. Multicultural, multidisciplinary, and multisectoral teams must be capable of operating in highly demanding contexts. This brings with it a swathe of ethical conflicts that require quick and effective solutions that respect both international conventions and cultural diversity. The objective of this article is to describe the process of creating a toolkit designed to support global researchers in navigating these ethical challenges. The process of creating the toolkit embodied the model (...) of ethical research practice that it advocates. Specifically, at the heart of ethical decision-making is consideration of the following: Place, solutions must be relevant to the context in which they are to be used; People, those impacted by the outcomes must be partners in co-creation; Principles, ethical projects must be guided by clear values; and Precedent, the existing evidence-base should guide the project and, in turn, the project should extend the evidence-base. It is the thesis underlying the toolkit that consideration of these 4Ps provides a strong basis for understanding ethical conflicts and allows for the generation of potential solutions. This toolkit has been designed in two phases of collaborative work. More than 200 researchers participated from more than 30 countries and more than 60 different disciplines. This allowed us to develop a model for contextual, dynamic analysis of ethical conflicts in global research that is complementary to traditional codes of ethics. It emphasizes the need to consider ethical analysis as an iterative, reflective, process relevant at all stages of the research journey, including, ultimately, in evaluating the legacy of a project. The toolkit is presented as an open access website to promote universal access. A downloadable “pocket guide” version is also now available in 11 languages. (shrink)

This study in cross-cultural hermeneutics examines the role that modern, Western philosophy has played in the interpretation of Nagarjuna's Madhyamikakarika, a second-century Indian-Buddhist text. Tuck locates a structure of distinct phases or "styles" in modern, philosophical history. These phases, Tuck shows, exhibit discontinuous interpretive biases, as well as continuity of hermeneutic intention. Discovering in each philosophical era a chaacteristic attitude towards the text--whether privilege, objectivity, or neutrality--Tuck argues that the continual reinterpretation of earlier scholarly readings is in (...) fact at the core of fruitful hermeneutic pursuit. Religious faith and medicine combine harmoniously in Buddhist views, each in its own way helping Buddhists enjoy a more fruitful existence. Health care providers need to understand the spiritual needs of patients in order to provide better care, especially for the terminally ill. Using a recently reported case to guide the reader, this paper examines the issue of medical futility from a Buddhist perspective. Important concepts discussed include compassion, suffering, and the significance of the mind. Compassion from a health professional (...) is essential, and if medical treatment can decrease suffering without altering the clarity of the mind, then a treatment should not be considered futile. Suffering from illness and death, moreover, is considered by Buddhists a normal part of life and is ever-changing. Sickness, old age, birth, and death are integral parts of human life. Suffering is experienced due to the lack of a harmonious state of body, speech, and mind. Buddhists do not believe that the mind is located in the brain, and, for Buddhists, there are ways suffering can be overcome through the control of one’s mind. (shrink)

New York: Penguin, 1990. xx + 392 pp.As someone accustomed to reading religion through ethnography—a genre that approaches deities and saints in a largely contextualized manner, purportedly “grounded” in indigenous perspectives—writings that aim to link devotional figures from opposite sides of the globe make (...) me decidedly skittish. So near the beginning of Longing for Darkness, when Galland states that “intuition told me” that the Black Madonna at Einsiedeln, Switzerland, and the goddess Kali from a Varanasi temple in India are somehow “connected” (p. 57), I felt the urge to discredit the entire book. Yet as it happened, it was too late; by then I was irretrievably captivated by a vividly and passionately told tale, related by an intensely courageous and honest author. Rather than expecting—wrongly and perhaps unfairly—the writing to conform to my academic framework, I thus gladly tended to what seemed to be my own “genre problem.” Wanting to maintain the author’s credibility in my eyes—to take her leaps of faith for what they were—I let go of the inclination to frame the book as ethnography, or even history of religions, and construed it as something else, something no less valuable.Because of its deeply personal tone, Galland’s detailed portrayal of her visits to a half dozen countries reads somewhat like a travelogue, yet much of the account takes place at home as well—in only slightly exotic places such as Marin County, California, and southern Texas. Furthermore, Galland chronicles a journey that is as much an interior one as it is global, invoking a personal and spiritual process that she connects to her search for feminine models for God and human holiness. In many ways a pilgrim’s account, Longing for Darkness is perhaps most aptly described as spiritual autobiography, or in any case, it is from this angle that I find immense value in the work. This does not mean, however, that Galland’s account relies entirely on faith, “intuition,” or personal interpretation; she has most certainly done her scholarly homework. Peppered throughout by footnotes and capped by an extensive selected bibliography, the book gives good reason for some of us to be genre-confused.The point of entry Galland chooses for leading us on her spiritual journey is a high mountain trek in Nepal. The trip, meant to culminate in a moon ceremony at a mountaintop monastery, ends instead in disaster, a metaphor for the disastrous direction that her life is presently taking. Subsequently, while back at home, Galland reassesses and readjusts the course of her internal world, meanwhile taking herself and her reader back across the globe four and a half years later. She travels to Nepal and India two more times, aiming to learn more about the goddess Tara, women in Tibetan Buddhism, and furthering her own established commitment to the Buddhist tradition. Galland relates in striking visual and conceptual detail experiences and observations at various shrines and conversations with a vast array of people—including a meeting with the Dalai Lama. After her second trip to South Asia, the [End Page 224] author takes a detour to Einsiedeln, Switzerland, before returning home, thus beginning her exploration into the phenomenon of European Black Madonnas. In the last three decades, the consideration of whether non-human animals should be ascribed any moral status, and if so in what way it ought to be ascribed to them, has become of central philosophical, political and economic importance. Thus, given thecontemporary significance of what may be called (jar simplicity’s sake) the “animal issue,” it is worthwhile to examine in what way Ancient Greek philosophy might contribute to our understanding of the issue and to our philosophical response to it. With (...) this in mind,in this essay I examine the issue of the moral status of animals from a “critical” Aristotelian perspective, on the basis of which I shall attempt: (§I) to show how, unlike the Cartesian view of animal nature, Aristotle’s conception of the non-moral status of animals stillinforms the prevailing contemporary view of the animal, and (§II) to establish that Aristotle’s failure to ascribe moral status to animals should be rejected (a) given his admission that animals are, by nature, capable of suffering while they are unable to engage in rational deliberation, and (b) given his understanding of the connection between moral blameworthiness, natural disposition, and various kinds of acts, particularly un-chosen and chosen willing acts. In this way, we shall show that although the prevailing contemporary view of the animal’s moral status represents a slightly more “elevated” view than Aristotle’s, insofar as (typically) we do not explicitly claim, as Aristotle did, that animals are due no moral consideration, by critically appropriating the relevant Aristotelian texts, we nonetheless findrich philosophical evidence that permits us to further elevate our conception of the moral status of animals such that we are prepared to grant them genuine moral significance, not just in theory but also in practice. A growing body of work suggests that the presence of women and of independent directors on boards of directors is associated with higher corporate environmental performance. However, the mechanisms linking board composition to corporate environmental performance are not well understood. This study proposes and empirically tests the mediating role of sustainability-themed alliances in the relationship between board composition and corporate environmental performance. Using the population of public oil and gas firms in the United States as the sample, the study relies (...) on renewable energy alliances to measure sustainability-themed alliances and longitudinally analyzes lagged data for independent and control variables. The study found that the higher the representation of women on a firm’s board, the more likely the firm is to form sustainability-themed alliances, and the higher the representation of independent directors on a firm’s board, the more likely the firm is to form sustainability-themed alliances. Such alliances, in turn, positively contribute to corporate environmental performance. This paper discusses the study’s contributions to the board composition-social performance literature. (shrink)

The context of economic globalization has contributed to the emergence of a new form of social action which has spread into the economic sphere in the form of the new social economic movements. The emblematic figure of this new generation of social movements is fair trade, which influences the economy towards political or social ends. Having emerged from multiple alternative trade practices, fair trade has gradually become institutionalized since the professionalization of World Shops, the arrival of fair trade products in (...) the food industry, and the establishment of an official "fair trade" label. With the strength that this institutionalization has generated, fair trade can now be considered a real trade system that questions, as much as it renews, the traditional economic system. In parallel, this transformation has exacerbated the tensions within the movement, which can be characterized as a clash between a "radical, militant" pole and a "softer, more commercial" one. However, it is not the actual institutionalization of fair trade which is being debated among fair trade actors on either side of the fence, but rather the challenges inherent in finding an economic institutionalization acceptable to social economic movements. Therefore the institutionalization process of fair trade should not be seen as mere degradation of social action, but rather as typical of the institutionalization process of new social economic movements. If we need to worry about the highjacking and alteration of the fair trade movement by the dominant economic system, the opposite is no less likely, as new social economic movements contribute to an ethical restructuring of markets. Burt Hopkins's The Philosophy of Husserl presents a challenging and thoughtful elucidation of Husserl's phenomenology that pays special attention to important methodological aspects of Husserl's philosophy, and, thereby, to Husserl's characterization of phenomenology as a pure and transcendental philosophy. Unlike other texts that attempt to elucidate Husserl's philosophy, Hopkins carries out his project in an unusual fashion, by beginning with a consideration of the conflict between Plato and Aristotle regarding the meaning and status of the eide, and ending with a (...) systematic critique of two of Husserl's most fierce opponents, Heidegger and Derrida. This review essay gives an overview of Hopkins's book and offers some critical remarks. (shrink)
