This article argues that the imaginary and the experienced body cannot fully be understood without an appreciation of the specific historical context in which they are formed. Offering a case study of military masculinity in Britain in the Second World War, the article examines the significance of the medical examination and subsequent physical classification of potential recruits to the Armed Forces in constructions of the male body. Individual responses, drawn from oral testimonies, are examined to explore the relationship between the (...) discursive and experienced body. These suggest the power of the social body in defining the meaning of the individual body. Nonetheless, despite the dominance of physical classification in the definition of hegemonic masculinity, individual experiences reveal that the concept and meaning of physical grading could be negotiated in ways which introduced less stable and more multiple meanings of the individual body and its relationship to the national body. The creation of biobanks depends upon people’s willingness to donate their samples for research purposes and to agree to sample storage. Moreover, biobanks are a public good that requires active participation by all interested stakeholders at every stage of development. Therefore, knowing public’s attitudes towards participation in a biobank and biobank management is important and deserves investigation.

Building on the computer science concept of _code smells_, we initiate the study of _law smells_, i.e., patterns in legal texts that pose threats to the comprehensibility and maintainability of the law. With five intuitive law smells as running examples—namely, duplicated phrase, long element, large reference tree, ambiguous syntax, and natural language obsession—, we develop a comprehensive law smell taxonomy. This taxonomy classifies law smells by when they can be detected, which aspects of law they relate to, and how they (...) can be discovered. We introduce text-based and graph-based methods to identify instances of law smells, confirming their utility in practice using the United States Code as a test case. Our work demonstrates how ideas from software engineering can be leveraged to assess and improve the quality of _legal_ code, thus drawing attention to an understudied area in the intersection of law and computer science and highlighting the potential of computational legal drafting. The proposal of the new criteria for the diagnosis of Alzheimer’s disease based on biomarker data is making possible a diagnosis of AD at the mild cognitive impairment or predementia/prodromal– stage. Given the present lack of effective treatments for AD, the opportunity for the individuals to personally take relevant decisions and plan for their future before and if cognitive deterioration occurs is one the main advantages of an early diagnosis. Advance directives are largely seen as an effective tool for planning (...) medical care in the event the subject becomes incompetent. Nevertheless, their value has been questioned with regard to people with dementia by scholars who refer to the arguments of personal identity and of patient’s changing interests before and after the onset of dementia. In this paper, I discuss the value of advance directives in Alzheimer’s disease and other kind of dementia. Despite critics, I argue that advance directives are especially advisable in dementia and provide reasons in favor of their promotion at an early stage of the disease as a valuable tool to respect patients’ values and preferences on medical treatment, including participation in research and end of life decisions. I mainly support advance directives that include both decisions regarding health care and the appointment of an attorney in fact. I conclude that patients with AD at a prodromal or early stage should be offered the opportunity to execute an advance directive, and that not to honor a demented individual’s directive would be an unacceptable form of discrimination towards those patients. An educational provision for young children with autism that offers intensive behavioural intervention based on the principles of Applied Behaviour Analysis (ABA), within an early years mainstream school setting in the UK, is described. The ABA Class at Westwood School is a collaborative project between the School of Psychology, Bangor University, two Local Education Authorities in North East Wales (Flintshire and Wrexham) and the local NHS Trust. Using two case examples, two important features of mainstream education for children with autism (...) are considered: access to the National Curriculum, and inclusion with peers in mainstream settings. Standardised test data on outcomes for these children over the initial 12 months of their educational placements are also provided. (shrink)

ArgumentDuring the eighteenth century, chemists in the Kingdom of Naples (the South of Italy) were very busy analyzing the chemical composition of ash from Mount Vesuvius. Undoubtedly, after a huge eruption this dusty phenomenon was the most important scientific object of debate. In fact, it was crucial to determine if there were dangerous elements in the ash so that the population could be warned about the potential hazards, such as polluted drinking water. This was not at all a simple issue, (...) as on the other hand there were scholars who realized that ash could be beneficial as a fertilizer, even as clouds of ash had obscured the sun. As chemical inquiries became more precise and the toxic concentration of many elements became known, this double life of Vesuvian ash as a scientific object gradually died. (shrink)

I was optimistic of a new beginning in an open society when I came to America in 1999. Since then, I have indeed benefited from many aspects of American life. I have learned a lot – especially through my experience with small farms and farmers. But now, it's time to move on. And it was reading Debt and Dispossession, a book about American agriculture and human values, that crystallized in me why I wanted to leave. By telling the story of (...) the 1980s farm crisis through the words of the residents of a Minnesota town, the book prizes open many of the contradictions of American society. The 1970s were boom times for mid-western farms; farmers took advantage of “easy” farm credit to finance expansion. By the 1980s, the boom burst and slump loomed. Lenders wanted their money back and thousands of farmers were dispossessed. Debt and Dispossession probes beneath the surface of a community apparently united in protest against the dispossessions. Underneath, it finds a tangled picture of a society at war with itself, pitting farmer against farmer in a fratricidal struggle. The book let me glimpse the paradox of American individualism, all-American contradictions centering on government and consumerism, frugality and morality. Just like my experience of American agriculture and farmers as a whole, Debt and Dispossession helped me see the best side of America, but also revealed the fragility of life in a one-on-one society. Background On December 2017 the Italian Parliament approved law n. 219/2017 “Provisions for informed consent and advance directives” regarding challenging legal and bioethical issues related to healthcare decisions and end-of-life choices. The law does not contain an explicit reference to Ethics Committees (ECs), but they could still play a role in implementing the law. Methods A questionnaire-based survey was performed among the ECs of the Italian Institute for Research and Care belonging to the Network of neuroscience and neurorehabilitation, with the (...) aim of (1) knowing whether the ECs participated and, if so, how in the process of implementation of law n. 219/2017 in the referring institutes; (2) investigating the point of view of the ECs regarding their possible involvement in the process; (3) exploring the contribution ECs can provide to give effective implementation to the law principles and provisions. Results Seventeen ECs out of thirty took part in the survey; the characteristics of the responding and non-responding committees are similar, so the responding ECs can be regarded as representative of all ECs in the Network. Nine ECs did not discuss the law in anyway: the main reason for this is that the referring institutions (6) and the health care professionals (3) did not ask for an EC intervention. Nevertheless, the large majority of the ECs believe that their involvement in the implementation of the law as a whole is appropriate (8) or absolutely appropriate (6), while 3 of them are neutral. No EC believes that the involvement is inappropriate. The aspect of the law on which the 14 ECs converge in considering the EC involvement appropriate/absolutely appropriate is the one related to the health facilities obligation to guarantee the full and proper implementation of the principles of the law. Conclusions Our survey confirms that ECs believe they can play a role in the implementation of law n. 219/2017, although this does not entirely correspond to what the committees have actually done in reality. This role could be better exercised by ECs specifically established for clinical practice, which would have a composition, functioning and a mandate better suited to the purpose. This supports the call for a national regulation of ECs for clinical practice. (shrink)

Three principles must be taken into account in assessing the social responsibilities of international business firms in developing areas. The first is an awareness of the historical and institutional dynamics of local communities. This influences the type and range of responsibilities the firm can be expected to assume; it also reveals the limitations of any universal codes of conduct. The second is the necessity of non-intimidating communication with local constituencies. This requires the firm to temper its power and influence by (...) recognizing and responding to local concerns in the pursuit of its own objectives. The third is the degree to which the firm's operations safeguard and indeed improve the social and economic assets of local communities. At issue is the question of adequate compensation for the inevitable disruptions that an international business brings to a local community. Beneficial returns must be shared and sustained over the long term in an equitable manner. The nine studies in this special edition illustrate in different ways the importance of these three principles. (shrink)

Evald Ilyenkov’s last book, Leninist Dialectics and the Metaphysics of Positivism, was published in 1980 shortly after the author’s tragic demise. In it he celebrated the 70th anniversary of Lenin’s still controversial Materialism and Empirio-criticism (1909). Like Lenin’s own book, this final contribution by Ilyenkov is often dismissed as mere polemic. But as Lev Naumenko noted in the original preface: “the fires of the ideological struggle have not weakened”. Under the protective shield of “Leniniana”, as Lev Naumov called it, Ilyenkov (...) set out his approach to materialist dialectics as both the science of logic and the logic of revolution. I discuss the nature of Ilyenkov’s motives, the place of Leninist Dialectics within his philosophical oeuvre and why the original manuscript was censored by the Politizdat publishers. I draw on memoirs by Ilyenkov’s close colleague and friend Felix Mikhailov and intended co-author, Grigori Vodolazov. Their testimonies make evident that Ilyenkov’s challenge to the myth of “two Lenins” was a thinly disguised attack on the technocratic anti-humanistic ideology that prevailed in the late 1970s Soviet Union. I propose that Lenin was inspired by Hegel’s dialectic throughout his life through Russian writers as well as Marx and Engels. Ilyenkov explains how Lenin’s EmpirioCriticism embodied dialectical concepts that cannot be described as crude materialism. Finally I suggest that Ilyenkov’s cri de coeur still stands as a call to the future as a foundation demanding further exploration towards a contemporary theory of knowledge. (shrink)

I present an argument that encapsulates the view that theory is underdetermined by evidence. I show that if we accept Williamson's equation of evidence and knowledge, then this argument is question-begging. I examine ways of defenders of underdetermination may avoid this criticism. I also relate this argument and my critique to van Fraassen's constructive empiricism.

Flow is a gratifying state of deep involvement and absorption that individuals report when facing a challenging activity and they perceive adequate abilities to cope with it. The flow concept was introduced by Csikszentmihalyi in 1975, and interest in flow research is growing. However, to our best knowledge, no scoping review exists that takes a systematic look at studies on flow which were published between the years 2000 and 2016. Overall, 252 studies have been included in this review. Our review (...) provides a framework to cluster flow research, gives a systematic overview about existing studies and their findings, and provides an overview about implications for future research. The provided framework consists of three levels of flow research. In the first “Individual” level are the categories for personality, motivation, physiology, emotion, cognition, and behavior. The second “Contextual” level contains the categories for contextual and interindividual factors and the third “Cultural” level contains cultural factors that relate to flow. Using our framework, we systematically present the findings for each category. While flow research has made progress in understanding flow, in the future, more experimental and longitudinal studies are needed to gain deeper insights into the causal structure of flow and its antecedents and consequences. In der theologischen Reflexion dieser Praxis pietatis werden Bedingungen und Möglichkeiten gegenwärtiger Erfahrungen mit dem Heiligen, die zentrale Bedeutung der Fähigkeit zur Unterscheidung der Geister und die Verhältnisbestimmung von Rechtfertigung und Heiligung als Grund (...) und Ziel christlichen Lebens thematisiert. Die Erfordernisse geistlicher Beratung werden ebenso bedacht wie das Problem von Anfechtungen. Abschließend werden exemplarisch Methoden und Medien christlicher Spiritualität vorgestellt. SummaryDavid Hartley's Observations provides an example from the history of medicine of the bearing of theories of the relationship between body and mind on the problem of morality and free will. Further, Hartley's solution requires a distinction between two understandings of what it means for morality to be rationally grounded. The kind of ethics which can be established for moral agents on the basis of medical knowledge alone (and for which Hartley's “Rule of Life” presents but one historical example) has (...) been termed ‘therapeutic’ It leads to a viewpoint in which it is difficult, if not impossible, to distinguish between the kinds of reasons for supporting morals and the kinds of reasons for supporting good teeth. The kind of ethics which requires additional grounds entering into the motivation of the agent himself has been termed “rational.” This distinction between therapeutic and rational ethics rests on the more basic distinction between general and particular grounds on which to establish a rational system of ethics. As a result, the initial problem of how any account of the body-mind relation might allow for the possibility of ethics leads to the more interesting problem of how a therapeutic interpretation of ethics, which is possible on the grounds of medical knowledge, might be reconciled with a fully rational interpretation of ethics which we require on philosophical grounds. “Medical ethics” has traditionally been viewed as the application of concepts from philosophical ethics to the specific problems presented in medical practice. In consequence of the second problem exposed here, it would be useful to extend the domain of medical ethics from the level of concepts and cases to the level of interpreting the rational grounds for those concepts. Otherwise one may fail to distinguish a medical view of ethics from an ethical view of medicine. (shrink)
