The history of eugenics is getting tricky. Once regarded as an initially idealistic concept that degenerated into the monstrous Nazi race hygiene project or into an American sterilization assault against the disadvantaged and racially “inferior”, eugenics was deemed to have died after the Second World War, utterly discredited by better biological science and more enlightened social ideas. However recent research has shown that eugenics was more variegated than once thought — there were leftist and “reform” eugenists as well as “mainline” (...) or reactionary eugenists, with dedicated opposition coming more from liberal and religious quarters. Ingrained into contemporary structures and social issues such as demography, welfare, race and gender, eugenics proved more resilient and widespread than previously thought. Historians were slow to recognize its pervasive influence in Scandinavia, Latin America and Asia, where local variants evolved as adaptations to local culture and conditions. And it has persisted to the present day. In welfarist Scandinavia, eugenics has been repackaged as reproductive autonomy or “medical” measures.1 In Communist China it is alive and well in sterilization programmes and the one baby policy.2 More than this, critics allege, it has been resurrected in the “new genetics” of recent times. Geneticists have historically been strong supporters of eugenics as a way of scientifically improving the genetic quality of the human race. As I have argued in another place, during the inter-war period they failed properly to scrutinize methodologies and data used to support sterilization of mental defectives,3 and it is contendable that social and ideological factors have continued to play a role — alongside epistemic factors associated with the expansion of genetic knowledge — in. From a psychological standpoint, communicating a severe diagnosis entails more than just naming a disease, it is a complex process with a number of stages: finding out what the patient already knows about the illness (some of which might be wrong, and thus psychologically detrimental), informing the patient while answering any questions (about the illness itself, the treatment, prognosis, recovery period, etc.) and last but not least, providing a minimum of psychological support depending on the patient’s reaction. Romanian law regarding (...) doctor-patient relationship and communication is modeled on the Anglo-Saxon model centered on patient autonomy and direct communication with the latter if the patient desires to know the truth about his condition. If this is not the case, the patient can name a proxy for doctor-patient communication. There are three legal documents that clarify these aspects: Law of Patient Rights, Medical Association’s Ethics Code and the Health Reform Law. The first two are conflicting on several aspects that we will discuss in this paper. The few studies on doctor-patient communication published in Romania reveal that there is no unitary methodology in this field. The doctors attest that often times the patient’s family, when faced with severe illness turn to the traditional model of communication, i.e. they desire to know the severe diagnosis first and pressure the physician to hide the truth form the patient, contrary to the letter of the law. The aim of this paper is to discuss the issue of communicating severe diagnosis in nowadays Romania in a very complex context: 1. The model of doctor-patient relationship and communication has changed after communist era (from paternalistic to partenerial); 2. Conflicting and missing issues in laws; 3. Laws based on patient’s autonomy principle in a traditional society based on another model of taking care (the patient is part of a family nucleus and the family wants to interfere into the medical communication process). Communication has only recently entered the curriculum of some medical schools in Romania. The doctors questioned as part of a study reveal that they‘ve learned to communicate a severe diagnosis by trial and error. This being said we recommend the inception of practical doctor-patient communication courses that could lead to improving doctor-patient relationships, communication of the diagnosis being their foundations. In this article we present a new approach to practical artificial intelligence (AI) ethics in heavy industry, which was developed in the context of an EU Horizons 2020 multi partner project. We begin with a review of the concept of Industry 4.0, discussing the limitations of the concept, and of iterative categorization of heavy industry generally, for a practical human centered ethical approach. We then proceed to an overview of actual and potential AI ethics approaches to heavy industry, (...) suggesting that current approaches with their emphasis on broad high-level principles are not well suited to AI ethics for industry. From there we outline our own approach in two sections. The first suggests tailoring ethics to the time and space situation of the shop floor level worker from the ground up, including giving specific and evolving ethical recommendations. The second describes the ethicist’s role as an ethical supervisor immersed in the development process and interpreting between industrial and technological (tech) development partners. In presenting our approach we draw heavily on our own experiences in applying the method in the Use Cases of our project, as examples of what can be done. (shrink)

Developments in Soviet ethics have been largely, but not exclusively, determined by the official ideology. Since 1917 philosophers have debated four successive models of morality. In the first, morality was regarded as tool of the exploiting classes and thus was superseded by communism. This attitude in fact fostered moral nihilism and anarchism. In the second period of ethical reflection, morality was contrued as a social, class-relative, phenomenon, conceived in utilitarian terms. With respect to Communist morality whatever serves socialism (...) as defined by the Communist Party acquires the force of a moral imperative. It is important to understand whether this perspective is true to Marx''s views. Whereas classical ethics assumed an extraworldy foundation for morality Marx adopted the humanist, immanentist perspective, according to which morality has a pragmatic sense as an ideal, the goal of activity. Soviet ethical theory of the Stalin era did not deviate from this perspective, for which reason ethics as a professional science was entirely subordinated to Party decrees about socialism as an ideal. In the third period beginning in the mid-fifties, a new view came to the fore which was codified in the 1961 Party program: moral values are now regarded as having a specific quality, social development involves a moral dimension, and moral values exhibit an all-human import. During this period the leading issue among philosophers is the question of the essence and specificity of morality as distinct from other forms of social consciousness. Just prior to the era of perestrojka beginning in 1985 a fourth model emerged which in fact prepared in most essential respects the actual new thinking in morality. The matters under consideration had to do with the global dimensions of moral problems given the common experience and fears of humanity. For this reason morality was now seen as superseding politics. Presently, this reorientation has not only enabled abandoning attitudes favoring class morality, but thrown into relief the tragic consequences of this attitude within Soviet history.The new image of morality corresponds to abstract humanism with its stress on the person and universal values. The task before Soviet ethicians is to provide theoretical and methodological foundations for their research by which they can improve the professional quality of their work and provide the discipline with a new identity over and against Marxism. 이 논문은 북한의 도덕규범을 소학교용「공산주의 도덕」 교과서를 중심으로 분석하고 통일교육에 주는 시사점을 도출하였다. 이 연구는 북한 도덕규범의 실체를 실증적으로 분석하고 있으며,「공산주의 도덕」교과서에 기술된 사례를 근거로 통일교육의 내용적 기초를 확대하는 의미가 있다. 북한의 「공산주의 도덕」교과서에 나타난 도덕규범은 7가지 범주로 구성되어 있다. 그것은 ① 수령·당·인민에 대한 충실성, ② 사회생활에서의 혁명적 의리와 동지애, ③ 사회공동생활을 위한 공민의 도덕, ④ 사회주의 우월성, ⑤ 조국애, ⑥ 반제·반미·반일·반한, ⑦ 개인생활 도덕규범 등이다. 이러한 규범에서 나타나는 특징은 교조주의적 성격, 집단주의적 성격, 정치사상교양의 성격 등이었으며, 이러한 특징은 한 마디로 (...) ‘수령 중심의 체제유지를 위한 수단적 도덕규범’으로 요약된다. 통일교육에 주는 시사점으로는 첫째, 북한의 도덕규범은 결코 ‘도덕적’이라 할 수 없으며, 인권과 사회정의와 같은 도덕교육의 본질적 가치도 찾아볼 수 없다. 둘째, 교과서는 북한 교육의 이념에 충실하고 있는 매개체일 뿐이어서, 남북한 도덕 교과서의 통합 및 수렴 논의는 제한적인 의미를 가질 뿐이다. 셋째, 여전히 냉전 인식에 기초하고 있는 북한 도덕규범의 실상을 감안할 때, 북한에게 국제사회 변화의 추세와 남한 사회의 객관적인 실상을 제대로 알게 하는 정책적 접근이 중요하다. 넷째, 북한의 도덕규범에서 나타나는 전통가치 규범의 민족 동질성은 제한적일 뿐이며, 따라서 통일교육의 초점은 그보다는 보편가치의 중요성에 맞추는 것이 필요하다. This article reflects one scholar's attempt to locate herself within emerging ethical methodologies given a specific concern with cross-cultural women's moral praxis. The field of comparative ethics's debt to past debates over methodology is considered through a typology of three waves of methodological invention. The article goes on to describe a specific research focus on U.S. Catholic and Iranian Shii women that initiated a search for a distinct method. This method of comparative ethics, which focuses on the (...) production of ethical knowledge through the interaction of discursive logics of various moral agents, is described. The conclusion turns to how methodological invention can itself become a constructive project through the way it (1) locates the scholar in relation to her subject of study and (2) allows for isolation of tactics within specific moral discourses. In order to consistently and effectively overcome attempts at revisionist vulgarization of revolutionary theory, which now pursue an active parasitic existence on the process of cognition of the essence and consequences of the revolution in science and technology, great importance should be attached to a correct understanding of the objective logic of the origin and development of contemporary revisionist conceptions. Analysis of the right-wing and "left-wing" revisionist deviations that the communist movement encounters shows that revisionist thought goes through a (...) number of stages in its development. However, whether the issue is one of economic, political, ethical, or any other revisionist conception, each of these necessarily involves replacement of the dialectical materialist method of cognition of a given sphere of phenomena by metaphysics and idealism, i.e., it always includes philosophical revisionism. Therefore, the problem of criticism of any revisionist conception is at the same time a problem of demonstrating the untenability of the methodology of revisionist analysis. (shrink)

In this paper we theorize that cognitive ethical orientations play an influential role in the beliefs of consumers when faced with different ranges of moral dilemmas. We examine this proposition in transitional Eastern Europe and results from a sample of 210 Romanian consumers suggest that Romanians are faced with a moral situation where low levels of Machiavellianism and high levels of idealism appear to relate to a higher ethical concern about passively benefiting at the expense of others.

Ethics of social consequences as a form of satisficing non-utilitarian consequentialism can be one of the methodological basis of bioethics education. The primary values in ethics of social consequences are humanity, human dignity and moral rights, which are developed and realized in correlation with positive social consequences. Secondary values in ethics of social consequences include justice, responsibility, moral duty and tolerance. The author analyses human dignity and humanity as principles of bioethics education.

In this essay the author examines Sartre's attitude toward Marxism as related to his existentialism and his approach to history. Existentialism, from a methodological point of view, has been of much avail as an “ideology” rooted in personal freedom. Still, judging it from a Marxist point of view, Sartre has criticized existentialism for a) its theoretical limits (it is abstract, nonhistorical, non-dialectic); and b) its ethical and political “faults,” since it is self-defeating and almost exclusively leaning toward privacy. And yet (...) one has to note how Sartre neglected to point out that existentialism's theoretical limits are due not only to its non-dialectical foundations but also to its nonscientific character and its hidden religiousness. Moreover, Sartre has not properly considered its historical value as a struggle against metaphysical thought and against a farfetched use of science. Basically — and apart from the views stated in such articles as “Les Communistes et la paix” — Sartre's Marxism is, from a political and ideological standpoint, strongly biased toward Soviet Marxism and socialism, since its main emphasis is anti-dogmatic and humanistic. Above all, this basic attitude could be explained by the negative influences of some historical and political events of the ‘40’s and ‘50’s on the development of his thought. As a matter of fact, his Marxism grew up against the background of Soviet politics in the Stalin and post-Stalin eras. Therefore, he refuses to accept any dogmatic and deterministic images of Marxism; instead of dogma he affirms the relevance of problems; in lieu of given truths, a concern for moral demands. In so doing, Sartre has based his Marxism more on the subjective praxis than on nature and history naturalistically viewed. (shrink)

The study examines the research methodology of more than 200 empirical investigations of ethics in personal selling and sales management between 1980 and 2010. The review discusses the sources and authorship of the sales ethics research. To better understand the drivers of empirical sales ethics research, the foundations used in business, marketing, and sales ethics are compared. The use of hypotheses, operationalization, measurement, population and sampling decisions, research design, and statistical analysis techniques were examined as (...) part of theory development and testing. The review establishes a benchmark, assesses the status and direction of the sales ethics research methodology, and helps inform researchers who need to deal with increasing amounts of empirical research. The investigation identified changing sources of publication with the Journal of Business Ethics and the Journal of Personal Selling & Sales Management maintaining their position as the main conduit of high quality empirical sales ethics research. The results suggest that despite the use of theoretical models for empirical testing, a greater variety of moral frameworks and wider use of marketing exchange theory is needed. The review highlights many sound aspects about the empirical sales ethics research statistical methodology but also raises concerns about several areas. Ways in which these concerns might be addressed and recommendations for researchers are provided. (shrink)

Porter Eric Voegelin (1901-1985) is not as well known among historians as he is among political theorists, yet he has had a continuing influence on both German Social Democrat and Christian Democrat political leaders. His early life is very much a reflection of both the intellectual developments and (...) the chaos of Germany and Austria between the wars. Voegelin's analysis of Nazism is worth revisiting by historians because it delineated the Nazi rationale for the Holocaust in the early 1930s, even if the Nazis themselves had yet to move towards mass murder early in the regime. Voegelin was not prescient enough to predict the extent of the Holocaust, but he understood that the ideological rationale of Nazi violence was unlimited. Furthermore, his description of political extremism as Gnosticism in 1952 is valid for explaining why an individual might support the Nazis and then voluntarily commit extraordinarily vicious acts to try to realize the dream-world of the Third Reich.The political, economic, and social chaos in Austria after World War I was the catalyst for the young Eric Voegelin's studies of the essence of ideologies and the ideologists who promoted them from both the left and right wing. As National Socialism grew, so did his experiences with and understanding of extremist political ideologies. Contemporary intellectual debates between neo-Kantian and existentialist methodology, however, did not help penetrate to the essential causes of political extremism. His experiences in America in the mid-1920s were essential for his development away from what he characterized as narrow methodological provincialism to an empiricism open to philosophic questions, including spiritual questions. By 1938 he had theorized that ideologies were political secular religions that substituted the state for divine reality.Because of this interpretation, Voegelin's approach to totalitarianism has been characterized as an outdated ersatz religion model, better suited for the Cold War. 1 The ersatz religion model worked reasonably well to describe similarities [End Page 151] the National Socialist movement had with religions, but Voegelin recognized that it did not penetrate to the essence of ideologies. His understanding of ideologies matured after World War II into his theory that ideologies were Gnostic quests for absolute certainty that caused alienation from reality.Voegelin thought that the search for certainty ultimately required excluding any evidence to the contrary of the ideology; therefore, ideologies limited the individual's view of human reality to the immediate world. Furthermore, although ideologies are founded on a kernel of truth—e.g., proletarians are sometimes oppressed—ideologists become quickly alienated from reality as a consequence of their own quest for certainty about meaning in existence. The consequences of alienation are that ideologists pursue the perceived immanent good and try to eliminate the perceived immanent evil, thereby rationalizing criminality and even murder. Violence is inherent to extremist political ideologies. Background and Influences: Weber, Kraus, University, and America Eric Voegelin was born in 1901 and grew up in Vienna. After the war Austria was convulsed by political and social crises ranging from attempted reactionary and Communist coups to constant food shortages. In the first post-war election Voegelin's political and social inclinations led him to vote for the Social Democratic Party (SDP), but he was aggravated by the uncompromising Marxist rhetoric of the SDP leadership. In this atmosphere Voegelin began his long journey toward understanding ideologies, but first he had to work through many different political and philosophic problems before he arrived at an adequate understanding. The intellectuals that influenced him during this long process were diverse, but they shared a hostility to ideologies.The first important academic influence on Voegelin was Max Weber. 2 Weber encouraged intellektuelle Rechtschaffenheit (intellectual honesty) with others and especially with oneself. The pluralism of methodologies and severe time constraints pose important challenges to pedagogy in clinical ethics. We designed a step-by-step student handbook to operate within such constraints and to respect the methodological pluralism of bioethics and clinical ethics. The handbook comprises six steps: Step 1: What are the facts of the case?; Step 2: What are your obligations to your patient?; Step 3: What are your obligations to third parties to your relationship with the patient?; Step 4: Do (...) your obligations converge or conflict?; Step 5: What is the strongest objection that could be made to the identification of convergence in step 4 or the arguments in step 4? People with dementia have previously not been active participants in research, with ethical difficulties often being cited as the reason for this. A wider inclusion of people with dementia in research raises several ethical and methodological challenges. This article adds to the emerging debate by reflecting on the ethical and methodological issues raised during an interview study involving people with dementia and their spouses. The study sought to explore the impact of living with dementia. We argue that there is support (...) for the inclusion of people with dementia in research and that the benefits of participation usually far outweigh the risks, particularly when a `safe context' has been created. The role of gatekeepers as potentially responsible for excluding people with dementia needs further consideration, with particular reference to the appropriateness of viewing consent as a primarily cognitive, universalistic and exclusionary event as opposed to a more particularistic, inclusive and context relevant process. Despite the fundamental and administrative difficulties associated with cross-cultural research the rewards are significant and, given an increasing trend toward globalisation, the move away from singular location studies to more comparative research is to be encouraged. In order to facilitate this research process it is imperative, however, that considerable attention is given to the methodological issues that can beset cross-cultural research, specifically as these issues relate to the primary domain or discipline of investigation, which in this instance is research on (...) business ethics. Utilising the experience of a four country comparative study of both Asian and Western cultures in the field of business ethics, the following presents a discussion of methodological concerns under the three broad areas of operationalising culture, operationalising business ethics, and data interpretation. BackgroundVulnerability is a key concept in traditional and contemporary bioethics. In the philosophical literature, vulnerability is understood not only to be an ontological condition of humanity, but also to be a consequence of contingent factors. Within bioethics debates, vulnerable populations are defined in relation to compromised capacity to consent, increased susceptibility to harm, and/or exploitation. Although vulnerability has historically been associated with older adults, to date, no comprehensive or systematic work exists on the meaning of their vulnerability. To fill this (...) gap, we analysed the literature on aged care for the meaning, foundations, and uses of vulnerability as an ethical concept.MethodsUsing PRISMA guidelines, we conducted a systematic review of argument-based ethics literature in four major databases: PubMed, Embase®, Web of Science™, and Philosopher’s Index. These covered biomedical, philosophy, bioethical, and anthropological literature. Titles, abstracts, and full texts of identified papers were screened for relevance. The snowball technique and citation tracking were used to identify relevant publications. Data analysis and synthesis followed the preparatory steps of the coding process detailed in the QUAGOL methodology.ResultsThirty-eight publications met our criteria and were included. Publication dates ranged from 1984 to 2020, with 17 publications appearing between 2015 and 2020. Publications originated from all five major continents, as indicated by the affiliation of the first author. Our analyses revealed that the concept of vulnerability could be distinguished in terms of basic human and situational vulnerability. Six dimensions of older adults’ vulnerability were identified: physical; psychological; relational/interpersonal; moral; sociocultural, political, and economic; and existential/spiritual. This analysis suggested three ways to relate to older adults’ vulnerability: understanding older adults’ vulnerability, taking care of vulnerable older adults, and intervening through socio-political-economic measures.ConclusionsThe way in which vulnerability was conceptualised in the included publications overlaps with distinctions used within contemporary bioethics literature. Dimensions of aged care vulnerability map onto defining features of humans, giving weight to the claim that vulnerability represents an inherent characteristic of humans. Vulnerability is mostly a value-laden concept, endowed with positive and negative connotations. Most publications focused on and promoted aged care, strengthening the idea that care is a defining practice of being human. (shrink)

In the present article, we introduce an ethical evaluation methodology for clinical cases. Although rejecting proceduralism as a system, we develop a procedure that eventually could be formalized as a flow chart to help carry out an ethical evaluation for clinical cases. We clarify the elements that constitute an ethical evaluation: aim, integration, and how the action is performed. We leave aside the aspect of intentions, focusing on the object of a medical action, arguing that the internal aim of (...) a clinical action carries a moral value per se. Our evaluation system takes into account only objects and circumstances and their intrinsic morality, since we are dealing with the evaluation of a clinical case, and not with a personal and complete clinical action. We take kelp as material entities immersed in a multitude of relations with other creatures (for whom kelp serves as both nourishment and shelter) and inorganic elements of the milieu it resides in, on the one hand, and as a figuration: a material-semiotic “map of contestable worlds” that encompasses entangled threads of “knowledge, practice and power” (Haraway 1997, 11) in its local and global sense, on the other. While drawing on our field notes from the congress and feminist posthumanities and (...) environmental humanities literatures (e.g. Alaimo 2016; Åsberg & Braidotti 2018; Sandilands & Erickson 2010; Iovino & Opperman 2014) – with a special focus on the so-called blue humanities/oceanic humanities (e.g. DeLoughrey 2019) – that unpack human/nonhuman relations in the context of the current environmental crisis and the accompanying “slow violence” (Nixon 2011), we mobilise a reflection on and make a proposal for “thinking with kelp” as a multi-faceted methodology of transversal and transdisciplinary knowledge production and practices: situated (Haraway 1988), enfleshed, transcorporeal (Alaimo 2010), collaborative, and committed to an ethics of multispecies response-ability (Haraway 2008). A major approach to the ethics of artificial intelligence is to use social choice, in which the AI is designed to act according to the aggregate views of society. This is found in the AI ethics of “coherent extrapolated volition” and “bottom–up ethics”. This paper shows that the normative basis of AI social choice ethics is weak due to the fact that there is no one single aggregate ethical view of society. Instead, the design of social (...) choice AI faces three sets of decisions: standing, concerning whose ethics views are included; measurement, concerning how their views are identified; and aggregation, concerning how individual views are combined to a single view that will guide AI behavior. These decisions must be made up front in the initial AI design—designers cannot “let the AI figure it out”. Each set of decisions poses difficult ethical dilemmas with major consequences for AI behavior, with some decision options yielding pathological or even catastrophic results. Furthermore, non-social choice ethics face similar issues, such as whether to count future generations or the AI itself. These issues can be more important than the question of whether or not to use social choice ethics. Attention should focus on these issues, not on social choice. (shrink)

This study considers major problems involved in seeking to build a post–communist ethical infrastructure for business transactions in Bulgaria. After an analysis of the basic economic and political realities of the present transition period, some recent empirical findings are presented concerning the emerging ethics and business culture, concluding with practical recommendations for the future. Today local, national and international ethics committees have become an effective means of social regulation in many European countries. Science itself is an important precondition for the development of bioethical knowledge and ethics expertise. Cultural, social, historical and religious preconditions can facilitate different forms and methods of ethics expertise in each country. Ukrainian ethics expertise has some methodological problems connected with its socio-cultural, historical, science and philosophy development particularities. In this context, clarification of some common legitimacies (...) or methodological approaches to ethics committee (EC) phenomena such as globalization, scientization and the prioritization of an ethics paradigm are very important. On the other hand, elaborate study and critical analysis of international experience by Ukraine and other Eastern European countries will provide the integration of their local and national ethics expertises into a world bioethics ethos. Bibliometric science mappings, such as co-citation analysis and bibliographic couplings, can be used as systematic literature reviews pre-structured though citation-related clusters, which can help better understand the inner logic of a research field. We conduct these two science mappings on the field of ethical leadership and integrate the primary results in a research framework that presents a comprehensive overview of the theoretical foundations, antecedents, and effects of ethical leadership, showcasing voice behavior as a current focal research theme. Research on sexual violence is fraught with ethical and methodological challenges due to its sensitive nature. This paper describes the ethical and methodological challenges encountered in planning and conducting two exploratory studies on sexual violence that included in-depth interviews of eight female adolescent rape survivors in Ibadan and four married women in Lagos Nigeria who were raped, forced to perform sexual acts and sexually deprived. The first challenge encountered was an Institutional Review Board (IRB) requirement to obtain parental permission from (...) adolescents, when such a requirement may place the adolescent at risk if a parent was a perpetrator of sexual violence. Using arguments emphasizing the Council for International Organization for Medical Sciences guidelines helped convince the IRB to provide a waiver of parental consent. Second, the privacy required to conduct in-depth interviews for rape survivors was difficult to achieve because five of the rape survivors were apprentices who work in public settings which are typically used to conduct business in the informal sector. To overcome this challenge, interviews were conducted in safe locations, investigator's offices and homes of survivors. The culture of silence associated with sexual violence posed a challenge because it encourages perpetration of violence with impunity causing rape survivors to suffer in silence. None of the affected adolescents had sought judicial redress for rape despite availability of stringent punishment for this behaviour. Referral information was provided on where survivors could seek care. Interviews with the women could not be recorded on audio-tapes because of concerns that their partners might identify their voices from the tapes and punish them for this. Although research on sexual violence poses ethical and methodological challenges, it is not only desirable but also feasible to conduct such research in ways that ensure safety of participants. The scope of this essay is to introduce and explain the methodology underlying the Lanza Foundation Protocol for the analysis of clinical cases. The essay is divided in three parts. Part one examines the Protocol's methodology within the whole evolutionary framework of argumentation in bioethics. Particular attention is given to the most significant methodologies developed in European bioethics. Part two describes the system of argumentation which serves as a frame for both approaches, namely, the normative and the hermeneutical. (...) Finally, the third part presents in an analytic fashion the operations which define the Protocol itself. The Protocol is the result of an interdisciplinary effort and it provides a detailed grid for analyzing and tackling the ethical components of clinical cases. The Protocol is primarily directed toward Ethics Committees in their consulting activity, yet it has been proven of considerable importance at an educational level also, particular in continuing education programs for health care professionals. This chapter explores two central questions in the conceptual ethics of normative inquiry. The first is whether to orient one’s normative inquiry around folk normative concepts (like KNOWLEDGE or IMMORAL) or around theoretical normative concepts (like ADEQUATE EPISTEMIC JUSTIFICATION or PRO TANTO PRACTICAL REASON). The second is whether to orient one’s normative inquiry around concepts whose normative authority is especially accessible to us (such as OUGHT ALL THINGS CONSIDERED), or around concepts whose extension is especially accessible to us (such (...) as BETRAYAL). The ethical and bioethical thought is one of the recurrent areas of knowledge in the reflexive exercise of health professionals in Cuba. However, according to the observations of evaluated materials for their publication, in the exercises for the process of obtaining educational categories and in the presentation of postgraduate evaluations, inadequacies related with imprecision and lack of clarity are detected in the ethical-moral thought on the part of health professionals. Clinician-scientists play a valuable role in bridging the gap between patient care and clinical research. However, there are no clear guidelines that describe how to handle the day-to-day ethical and methodological questions that arise when navigating the competing responsibilities of practitioner and researcher—a situation that can easily leave the clinician-scientist confused and frustrated. This article outlines common ethical and methodological concerns for the clinician-scientist when developing, implementing, and analyzing research in practice, and offers practical suggestions to address these issues. Objectives—To assess the relationship between the approval of trials by a research ethics committee and the fact that informed consent from participants was obtained, with the quality of study design and methods.Design—Systematic review using a standardised checklist.Main measures—Methodological and ethical issues of all trials published between 1993 and 1995 in the New England Journal of Medicine, the Lancet, the Journal of the American Medical Association and the British Medical Journal were studied. In addition, clinical trials conducted in Spain and (...) published by at least one Spanish author during the same period in any other journal were also included.Results—We studied the published articles of 767 trials and found the following indicators of lower methodological quality to be independent predictors for failure to disclose REC approval or ICP: absence of concealment of allocation, lack of justification for unblinded trials, not using a treatment for the patients in the control group, absent information on statistical methods, not including sample size estimation, not establishing the rules to stop the trial, and omitting the presentation of a baseline comparison of groupsConclusion—Trials of higher methodological and scientific quality were more likely to provide information about their ethical aspects. Theory in the “Post” Era: A Vocabulary for the 21st-Century Conceptual Commons. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” its compelling presence “across (...) fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). In “Traveling Theory” (1983) and “Traveling Theory Reconsidered” (2000), Edward Said called attention to the migratory nature of contributions made, for instance, by Georg Lukács, whose theories moved across different European locales in this period. Although clinical ethics consultation has existed for more than 40 years in the USA and Europe, it was not available in Bulgaria until recently. In introducing clinical ethics consultation into our country, the Modular, Ethical, Treatment, Allocation of resources, Process (METAP) methodology has been preferred because of its potential to be used in resource-poor settings and its strong educational function. This paper presents the results of a METAP evaluation in a hospital palliative care ward in the town (...) of Vratsa. The evaluation was based on Beauchamp and Childress’ four principles of biomedical ethics and involves implementation of specific instruments for clinical ethics decision-making. Research tasks emphasised analyses of ethics meetings in the ward. Data were processed by SPSS v.24 using descriptive statistical analysis. Altogether, 32 ethics meetings of an average duration 20.63 min were conducted on cases involving critically ill patients. Most of the participants (86.0%) expressed satisfaction with the ethics process. The principlist approach supported resolution of conflicts between autonomous patients and their relatives, clarified definitions of “medical benefit” and “social good,” and enabled assessments of the risk of unequal treatment. Even as the specific research tasks were achieved, further participant follow-up is necessary to identify any improvement in healthcare personnel’s ethical competence. METAP worked well in end-of-life care settings. Participants experienced several benefits, including improved team communication, better understanding of patient preferences, and confidence in the correctness of decisions. Despite the significant educational potential of METAP, the need for additional and ongoing ethics training of health professionals should not be underestimated. (shrink)

Currently, many scientific fields such as psychology or biomedicine face a methodological crisis concerning the reproducibility, replicability, and validity of their research. In neuroimaging, similar methodological concerns have taken hold of the field, and researchers are working frantically toward finding solutions for the methodological problems specific to neuroimaging. This article examines some ethical and legal implications of this methodological crisis in neuroimaging. With respect to ethical challenges, the article discusses the impact of flawed methods in neuroimaging research in cognitive and (...) clinical neuroscience, particularly with respect to faulty brain-based models of human cognition, behavior, and personality. Specifically examined is whether such faulty models, when they are applied to neurological or psychiatric diseases, could put patients at risk, and whether this places special obligations on researchers using neuroimaging. In the legal domain, the actual use of neuroimaging as evidence in United States courtrooms is surveyed, followed by an examination of ways that the methodological problems may create challenges for the criminal justice system. Finally, the article reviews and promotes some promising ideas and initiatives from within the neuroimaging community for addressing the methodological problems. (shrink)

Discussions on Marc Bloch usually focus on The Annales School, his comparative method, or his defence of a distinct historical science. In contrast, I emphasise his seldom-investigated ideas of what historical understanding should involve. I contend that Bloch distinguishes between three different ethical attitudes in studying people and ways of life from the past: scientific passivity; critical judgements; understanding. The task of the historian amounts to understanding other worlds in their own terms. In this book, Bryan W. Van Norden examines early Confucianism as a form of virtue ethics and Mohism, an anti-Confucian movement, as a version of consequentialism. The philosophical methodology is analytic, in that the emphasis is on clear exegesis of the texts and a critical examination of the philosophical arguments proposed by each side. Van Norden shows that Confucianism, while similar to Aristotelianism in being a form of virtue ethics, offers different conceptions of “the good life,” the (...) virtues, human nature, and ethical cultivation. Ethical problems are related to computer data bases, containing data on individuals and groups of persons, as well as to computer knowledge bases, containing general rules and elements of expert systems.In the present essay the following conclusions are made regarding computer data bases: privacy, security, and confidentiality of medical computer data bases should be ensured. This duty should rest with physicians in hospitals. The principle of informed consent should be applied to gathering information which is to be stored and processed (...) by computers. Information stored in computer data bases should not be used for purposes for which the subjects (patients as well as personnel) have not given their consent. In order to decrease the possibility of misuses of medical data bases containing information on individuals, these registers should not be linked to other central data bases. (shrink)

This article describes how nurses can use the Q methodology to include head and neck cancer patients in research. These patients are often excluded from participating in research based on temporary or permanent voiceless, disfigurement, or impaired communication. Q methodology is defined as the method for the study of subjectivity and related procedures seem to facilitate the participation of head and neck cancer patients. As so, this inclusive dimension should be taken into consideration in research project design also (...) as an ethical aspect of the study, in particular when involving these patients or others in similar conditions.
