From a psychological standpoint, communicating a severe diagnosis entails more than just naming a disease, it is a complex process with a number of stages: finding out what the patient already knows about the illness (some of which might be wrong, and thus psychologically detrimental), informing the patient while answering any questions (about the illness itself, the treatment, prognosis, recovery period, etc.) and last but not least, providing a minimum of psychological support depending on the patient’s reaction. Romanian law regarding (...) doctor-patient relationship and communication is modeled on the Anglo-Saxon model centered on patient autonomy and direct communication with the latter if the patient desires to know the truth about his condition. If this is not the case, the patient can name a proxy for doctor-patient communication. There are three legal documents that clarify these aspects: Law of Patient Rights, Medical Association’s Ethics Code and the Health Reform Law. The first two are conflicting on several aspects that we will discuss in this paper. The few studies on doctor-patient communication published in Romania reveal that there is no unitary methodology in this field. The doctors attest that often times the patient’s family, when faced with severe illness turn to the traditional model of communication, i.e. they desire to know the severe diagnosis first and pressure the physician to hide the truth form the patient, contrary to the letter of the law. The aim of this paper is to discuss the issue of communicating severe diagnosis in nowadays Romania in a very complex context: 1. The model of doctor-patient relationship and communication has changed after communist era (from paternalistic to partenerial); 2. Conflicting and missing issues in laws; 3. Laws based on patient’s autonomy principle in a traditional society based on another model of taking care (the patient is part of a family nucleus and the family wants to interfere into the medical communication process). Communication has only recently entered the curriculum of some medical schools in Romania. The doctors questioned as part of a study reveal that they‘ve learned to communicate a severe diagnosis by trial and error. This being said we recommend the inception of practical doctor-patient communication courses that could lead to improving doctor-patient relationships, communication of the diagnosis being their foundations. The revolution of artificial intelligence (AI), particularly generative AI, and its implications for human–robot interaction (HRI) opened up the debate on crucial regulatory, business, societal, and ethical considerations. This paper explores essential issues from the anthropomorphic perspective, examining the complex interplay between humans and AI models in societal and corporate contexts. We provided a comprehensive review of existing literature on HRI, with a special emphasis on the impact of generative models such as ChatGPT. The scientometric study posits that due to (...) their advanced linguistic capabilities and ability to mimic human-like behavior, generative AIs like ChatGPT will continue to grow in popularity in pair with human rational empathy, tendency for personification and their advanced linguistic capabilities and ability to mimic human-like behavior. As they blur the boundaries between humans and robots, these models introduce fresh moral and philosophical dilemmas. Our research aims to extrapolate key trends and unique factors in HRI and to elucidate the technical aspects of generative AI that enhance its effectiveness in this field compared to traditional rule-based AI systems. We further discuss the challenges and limitations of applying generative AI in HRI, providing a future research agenda for AI optimization in diverse applications, including education, entertainment, and healthcare. Anca Gheaus considers the reasons we owe our children a sustainable world.

The article has two aims. First, to show that a version of luck egalitarianism that includes relational goods amongst its distribuenda can, as a matter of internal logic, account for one of the core beliefs of relational egalitarianism. Therefore, there will be important extensional overlap, at the level of domestic justice, between luck egalitarianism and relational egalitarianism. This is an important consideration in assessing the merits of and relationship between the two rival views. Second, to provide some support for including (...) relational goods, including those advocated by relational egalitarianism, on the distribuenda of justice and therefore to put in a good word for the overall plausibility of this conception of justice. Common sense morality and legislations around the world ascribe normative relevance to biological connections between parents and children. Procreators who meet a modest standard of parental competence are believed to have a right to rear the children they brought into the world. I explore various attempts to justify this belief and find most of these attempts lacking. I distinguish between two kinds of biological connections between parents and children: the genetic link and the gestational link. I argue that the second (...) can better justify a right to rear. Recent corporate governance literature on gender diversity within boards has linked the effect of an increase in gender diversity to the firm’s corporate reputation. This paper analyzes the media impact of appointing new directors of Spanish companies at a particularly significant moment, during the period from 2007 to 2010, just a year before and 3 years after the Gender Equality Act was passed. By analyzing female and male board nominations in Spanish IBEX-35 companies, the paper examines whether appointing a female (...) does have greater visibility than appointing a male, and thus a potential signaling effect for corporate stakeholders and an effect on the firm’s reputation. Results indicate that the effect on press visibility of appointing a female versus a male is negligible, although there is significant media visibility for new executive directors, in particular for the case of the only woman nominated as an executive director during the period. The paper contributes to the existing literature on gender diversity in corporate governance, specifically its effect on corporate reputation. The paper also offers information relevant to policy making and in particular to the current debate over quotas for women on boards. (shrink)

What is a plan, program, plot, platform, concept, conception, or even «meta-project»? Is a project or projection necessarily an «architectural matter»? Is it a prototypically Western or European procedure of specific use of time and space (literally, throwing forth into space/time)? According to Brehm's intensity of emotion theory, if an emotion has motivational properties, its intensity should be non-monotonically affected by factors similar to those determining the intensity of motivational states. These factors are called deterrents. In the case of emotion, one category of deterrents consists of factors that can potentially interfere with feeling the emotion, such as reasons for not feeling the emotion. Two experiments were carried out to examine whether happiness is a motivational state and, thus, if its intensity (...) is non-monotonically determined by the importance of reasons for not feeling happy. We expected happiness to be reduced by a low importance reason for not feeling happy, to remain high in the presence of a moderately important reason, and to be reduced or eliminated by a very important reason. Both experiments supported the cubic function that results from these expectations, and when the results of the two studies were combined, each of the individual legs of the cubic function was found to be reliable along with the cubic function itself. There is a widespread belief that, conceptually, justice cannot require what we cannot achieve. This belief is sometimes used by defenders of so-called ‘non-ideal theories of justice’ to criticise so-called ‘ideal theories of justice’. I refer to this claim as ‘the feasibility constraint on the concept of justice’ and argue against it. I point to its various implausible implications and contend that a willingness to apply the label ‘unjust’ to some regrettable situations that we cannot fix is going to enhance (...) the action-guiding potential of a conception of justice, by providing an aspirational ideal. This is possible on the condition that, at all times, we cannot specify with certainty the limits of what is feasible for us collectively. The rejection of the feasibility constraint entails that there can be injustice without perpetrators; this is a theoretical price worth paying. (shrink)

Three claims about love and justice cannot be simultaneously true and therefore entail a paradox: (1) Love is a matter of justice. (2) There cannot be a duty to love. (3) All matters of justice are matters of duty. The first claim is more controversial. To defend it, I show why the extent to which we enjoy the good of love is relevant to distributive justice. To defend (2) I explain the empirical, conceptual and axiological arguments in its favour. Although (...) (3) is the most generally endorsed claim of the three, I conclude we should reject it in order to avoid the paradox. (shrink)

Rationing health care by ordeals is likely to have different effects on women and men, and on distinct groups of women. I show how such putative effects of ordeals are relevant to achieving gender justice. I explain why some ordeals may disproportionately set back women’s interest in discretionary time, health and access to health care, and may undermine equality of opportunity for positions of advantage. Some ordeals protect the interests of the worse-off women yet set back the interests of better-off (...) women in equal opportunities. I suggest how we can use ordeal design to advance particular aims of gender justice. (shrink)

There is a growing pro-emotional consensus in contemporary literature on the relationship between emotions and practical rationality. Its proponents argue that emotions exhibit the properties of strategically rational states, i.e. that they can positively influence the cognitive mechanism of rational deliberation and lead an individual to choose an action based on its practical utility. In this paper, we will analyse the main claims of this consensus and examine their plausibility in light of three critical objections to the strategic rationality thesis. (...) We will demonstrate that emotions, despite their tendency to trigger episodes of impulsivity and selfdeception, can rightly be described as strategically rational, with the caveat that proponents of the pro-emotional consensus must exercise caution when attempting to support their beliefs with the thesis of the modularity of emotions and the evolutionary explanations for their practical utility. The evaluation of labour markets and of particular jobs ought to be sensitive to a plurality of benefits and burdens of work. We use the term 'the goods of work' to refer to those benefits of work that cannot be obtained in exchange for money and that can be enjoyed mostly or exclusively in the context of work. Drawing on empirical research and various philosophical traditions of thinking about work we identify four goods of work: 1) attaining various types of (...) excellence; 2) making a social contribution; 3) experiencing community; and 4) gaining social recognition. Our account of the goods of work can be read as unpacking the ways in which work can be meaningful. The distribution of the goods of work is a concern of justice for two conjoint reasons: First, they are part of the conception of the good of a large number of individuals. Second, in societies without an unconditional income and in which most people are not independently wealthy, paid work is non-optional and workers have few, if any, occasions to realize these goods outside their job. Taking into account the plurality of the goods of work and their importance for justice challenges the theoretical and political status quo, which focuses mostly on justice with regard to the distribution of income. We defend this account against the libertarian challenge that a free labour market gives individuals sufficient options to realise the goods of work important to them, and discuss the challenge from state neutrality. In the conclusion, we hint towards possible implications for today’s labour markets. (shrink)

There is a broad philosophical consensus that both children’s and prospective parents’ interests are relevant to the justification of a right to parent. Against this view, I argue that it is impermissible to sacrifice children’s interests for the sake of advancing adults’ interest in childrearing. Therefore, the allocation of the moral right to parent should track the child’s, and not the potential parent’s, interest. This revisionary thesis is moderated by two additional qualifications. First, parents lack the moral right to exclude (...) others from associating with the child. Second, children usually come into the world as part of a relationship with their gestational mother; often, this relationship deserves protection. (shrink)

I distinguish between three different ideas that have been recently discussed under the heading of 'the intrinsic goods of childhood': that childhood is itself intrinsically valuable, that certain goods are valuable only for children, and that children are being owed other goods than adults. I then briefly defend the claim the childhood is intrinsically good. Most of the chapter is dedicated to the analysis, and rejection, of the claim that certain goods are valuable only for children. Knowing the level of quality from which the context is no longer valuable in a Context-Aware Data Mining (CADM) system is an important information. The main goal of this research is to study the variations of the predictions in case of different levels of noise and missing context data in practical scenarios for predicting soil moisture. The research has been performed on two locations from the Transylvanian Plain, Romania and two locations from Canada. The values predicted for the soil moisture (...) were compared in mixed scenarios that vary the quantity of noise and missing context data. The studied behavior was performed using Deep Learning, Decision Tree and Gradient Boosted Tree machine learning algorithms. It has been shown that when using the air temperature as context for predicting soil moisture, variations of noise and missing data do not influence the results proportionally with the levels of noise and missing data applied. Also, Gradient Boosted Tree algorithm proves to be the best algorithm from the ones studied, to be considered when predicting soil moisture with the CADM approach. (shrink)

My intention is to demonstrate how Hobbes’ attempts to adapt two ancient institutions from Roman Law to his own time and knowledge of theology and philosophy. Treason could be quite significant within the context of Hobbes’ understanding of the figure of the sovereign and sovereignty. The central part of the text is an endeavor to ascertain the source and unconditional condition for treason as such, within the framework of Hobbes’ theory of representation which he writes about in Chapter 16 of (...) the Leviathan. The act or performance in which we could perhaps recognize a traitorous gesture could be found in the so-called paradox of representation. The “traitor” breaks the chain of the transfer of power and empowerment, thus stops representation, and puts an end to speaking in the name of the other. If it is possible to discover whether this is possible and whether speaking and acting in one’s own name always carries elements of treason, then we can conclude that differing forms of “direct” speech and action are “acts of treason.” In that case, what interests me is whether “treason” is found within the heart of representative democracy, and thus if it is de facto an integral part of a democratic order and society. Forgiveness is a compelling Christian ideal. By contrast, to many philosophers it is not clear that forgiveness should be endorsed as a moral requirement; some argue that unconditional forgiveness is morally wrong. Those who are required to exercise forgiveness can feel that their own dignity and moral worthiness is diminished by such requirement if insignificant recognition was given to the harms they suffered as victims. This is particularly significant when thinking about women’s lives. Forgiveness and justice occasion particularly painful quandaries (...) in feminist ethics. However, an important stream of feminist ethics—namely the ethics of care—can make a convincing case in favor of forgiveness. A main goal of an ethics of care is preserving relationships for which, in the less than ideal conditions of human life, forgiveness is essential. Thus, the ethics of care casts additional light on the tension between pursuing forgiveness and justice. By spelling out these various dilemmas, I illustrate how a feminist ethics and a feminist philosophy of religion can be fruitful intellectual allies. A feminist ethics will benefit from cautious reliance on religious wisdom, concomitantly acknowledging the need for forgiveness and qualifying the requirements of forgiveness such that this ideal does not become, once again, oppressive for women. And a feminist philosophy of religion should be to some extent informed by feminist ethical goals, helping to unveil religious resources that give credit to our ongoing need for forgiveness, without however overlooking the importance of (gender) justice. The text aims to explore one peculiar practice of translation manifested in the transformation of passion for knowledge into passion for life. More precisely, the issue at stake is the modification of libido sciendi, which occurred during the 20th century, notably in writings inspired by ‘DS’, the shorthand Hélène Cixous uses to refer to ‘sexual difference/différence sexuelle’. The Latin words in the title serve as markers in interpreting politics/poetics of writing, which actively include forms of expression that belong to different (...) disciplines such as philosophy, psychoanalysis and above all, literature. Special attention is paid to Cixous’s early text, Révolutions pour plus d’un Faust, written in 1975, and its attempt to transform/translate energies of destruction into life-respecting creativity. The paper gives an overview of recent doctrines of legal interpretation that can be subsumed under the common name “institutional turn” in theories of legal interpretation. Among the reviewed theoretical positions are the ones from Jeremy Wаldron, Victoria Nourse, Cass Sunstein, Adrian Vermeule, Scott Shapiro. It is concluded that the institutional turn in legal interpretation offers some significant insights into legal interpretation and interesting perspectives on the appropriate interpretative methodologies. The turn, however, does this by eschewing parts of traditional accounts (...) of legal interpretation that are arguably worth preserving in any theory of legal interpretation. (shrink)

John Dewey, one of the most important thinkers of pragmatism, elaborated a specific conception of law partially and gradually in the long course of his intellectual career. This part of his broader philosophical outlook is analyzed here through one of its most important segments - application of law - and interpreted in its historical, social and cultural background. The first part of the article concentrates on the 'objective' reasons for giving emphasis to the application of law in his legal philosophy. (...) This domination of the application of law in his legal thought is derived from the needs of a rapidly changing structure of the American society in the first half of the XX century, and theoretically has its place in an all around phenomenon in American intellectual history in general that Morton White terms antiformalism. The second part of the article analyses his legal conceptions and their connection with the general philosophical position of this pragmatist. Dewey formed his conception of application of law as an integral part of his broader philosophical standpoint, and especially on the basis of his radical reinterpretation of logic and truth. Since his understanding of the legal process has roots in his experimentalist conception of logic that encompasses the apprehension of the process of experimentation as the only warrant for the validity of propositions, he regards application as conditio sine qua non of the legality of norms in general. This leads us to the last part of the article that scathes possible lines of critical approach to Dewey's work in this field. The view that the legality of norms is derived from their application is in legal theory often regarded as sociologism, inasmuch as it disregards the normative aspects of the legal process and emphasizes the social ones to the point of making it void of the normative aspects in the totality of the process itself. The proper understanding of possible lines of criticism of Dewey's standpoints in legal philosophy guides us back again to confront his conceptions with their cultural background, with which the article begins. Zamisljen kao uvodno ispitivanje filozofsko-pravne problematike u Djuijevoj filozofiji, clanak u prvom dijelu razmatra odnos njegove filozofije prava i americkog kulturnog konteksta. U drugom dijelu je izlozeno Djuijevo shvatanje primjene prava i konfrontirano je s njegovim opstim filozofskim tezama, u prvom redu s koncepcijom logike kao 'ispitivanja ispitivanja'. Trying to reconstruct the specific definition of the noetic act from some excerpts of the fifth and seventh Treatises (Enneads, V, 9 and 4), one manages to circumscribe the operations by which Plotinus establishes in the context the unity between the intellect, the act of thinking, some form of «prime intelligibility» and the other, multiple, intelligibilities. Plotinus is striving to avoid several pitfalls in order not to endanger the unity of the noetic hypostasis and consequently to imperil the only possible (...) way of thinking the One. At least four ways of bypassing possible impediments detectable in the context mentioned can be summarised : (i) averting the idea that the noetic act can be identified to the form and can thus be defined as «the thinking of forms» ; (ii) establishing that the precession of being as an «object of thought» is an a posteriori act of thought, and not the actual and necessary preeminence of the being on the noetic act ; (iii) debunking any temptation of considering thought as a mediation between the first and the second hypostasis ; and finally (iv) avoiding a definition of the noetic act through a sine qua non recourse to power, by establishing a specific statutary order of the noûs according to which the act and the power determine, or not, the possibility of intellection. An analysis of the texts will bring us to reconsider the so‑called theory of the two complementary acts and its Aristotelian origins, and also to recall the debates around Plotinus’ «idealism», demonstrating the appositeness and the specificities of that conception. The aim of this paper is to explore the relation between democratic values and emotions. The author argues that democratic values and emotional judgments are inter-reducible: political agents use emotional judgments to reflexively evaluate normative paradigms of political life. In the first part of the paper, the author describes the state of emotions in contemporary political philosophy and identifies Charles Stevenson?s ethical conception of emotivism as the first comprehensive attempt to neutrally conceptualize emotions in moral and political thinking. The second (...) part of the paper explores the shortcomings of emotivism and finds an adequate alternative in Martha Nussbaum?s concept of emotional judgment as the one that contains beliefs and values about social objects. In the final part of the paper, the author identifies that moral and political disagreements emerge in democracies from ranking of the importance of political objects. The evaluation criteria for this type of ranking is derived from democratic values which are reducible to agents? emotional judgments. (shrink)

Talk of gender identity is at the core of heated current philosophical and political debates. Yet, it is unclear what it means to have one. I examine several ways of understanding this concept in light of core aims of trans writers and activists. Most importantly, the concept should make good trans people’s understanding of their own gender identities and help understand why misgendering is a serious harm and why it is permissible to require information about people’s gender identities in public (...) life. I conclude that none of the available accounts meets these essential criteria, on the assumption that the gender norms of femininity and masculinity are unjustified. But we can, and should, pursue the feminist project without “gender identity”. Such feminism can include trans people because it is possible to account for the specific harm of misgendering without assuming a claim to the recognition of our gender identities. I conclude that we should eliminate the concept of “gender identity.” To understand the phenomena that are putatively captured by “gender identity,” we are better off employing other concepts, such as “sexual dysphoria,” (assigned or aspirational) “gender roles,” and (internalised or endorsed) “gender norms”. These concepts can usefully replace “gender identity” in an individual evaluation of each of the trans people’s claims to inclusion into particular spaces. (shrink)

This paper provides an answer to the question why birth parents have a moral right to keep and raise their biological babies. I start with a critical discussion of the parent-centred model of justifying parents’ rights, recently proposed by Harry Brighouse and Adam Swift. Their account successfully defends a fundamental moral right to parent in general but, because it does not provide an account of how individuals acquire the right to parent a particular baby, it is insufficient for addressing the (...) question whether and why there is a right to parent one’s biological child. Such a right is important because, in its absence, fairness towards adequate prospective parents who are involuntarily childless would demand a ‘babies redistribution’; moreover, in societies with entrenched histories of injustice there may be reasons of fairness for shuffling babies amongst all recent parents. I supplement the Brighouse-Swift account of fundamental parental rights by an account of how adequate parents acquire the right to parent their biological babies. I advance two arguments to this conclusion: by the time of birth, the birth parents will have already shouldered various burdens in order to bring children into existence, and are likely to have formed an intimate relationship with the future baby. Denying birth parents who would make at least adequate parents the right to keep their baby would be unfair to them and would destroy already formed parent-baby relationships which, I assume, are intrinsically valuable. Women continue to be in charge of most childrearing; men continue to be responsible for most breadwinning. There is no consensus on whether this state of affairs, and the informal norms that encourage it, are matters of justice to be tackled by state action. Feminists have criticized political liberalism for its alleged inability to embrace a full feminist agenda, inability explained by political liberals’ commitment to the ideal of state neutrality. The debate continues on whether neutral states can accommodate two (...) feminist demands: to enact policies aimed at dismantling the feminization of caregiving, especially childrearing, and to compensate women for some of the disadvantages they incur by being primary care-givers. I contribute to this debate with three arguments in support of policies meant to de-gender care-giving and compensate care-givers. The first appeals to equality of opportunity to positions of advantage and justifies policies that prevent or mitigate statistical discrimination and implicit biases. The second draws attention to a possible causal relationship between the specialization of women in early childcare and misogyny; since the latter is incompatible with political liberal justice, it yields the conclusion that political liberals ought to further investigate the causal hypothesis with the aim of establishing or refuting it. The third argument concludes that legitimate childrearing prohibits adults from socializing children or, at least girls, into gender norms; it justifies duties of justice on the side of parents, educators, and economic agents, and state policies meant to offset foreseeable breaches of some of these duties. This chapter argues that there is a collective responsibility to have enough children in order to ensure that people will not, in the future, suffer great harm due to depopulation. Moreover, if people stopped having children voluntarily, it could be legitimate for states to incentivize and maybe even coerce individuals to bear and rear children. Various arguments against the enforceability of an individual duty to bear and rear children are examined. Coercing people to have children would come at significant moral (...) cost; however, none of the arguments against enforceability seem decisive. The existence of a collective responsibility to have children bears on the question of whether parents and non-parents ought to shoulder the costs of childbearing and child rearing together. John Tillson argues, on grounds of children’s well-being, that it is impermissible to teach them religious views. I defend a practice of pluralistically advocating religious views to children. As long as there are no monopolies of influence over children, and as long as advocates do not use coercion, deceit, or manipulation, children can greatly benefit without having their rational abilities subverted, or incurring undue risk to form false beliefs. This solution should counter, to some extent, both perfectionist and antiperfectionist reasons (...) against initiating children into religions. (shrink)

Traditionally, most philosophers saw childhood as a state of deficiency and thought that its value was entirely dependent on how successfully it prepares individuals for adulthood. Yet, there are good reasons to think that childhood also has intrinsic value. Children possess certain intrinsically valuable abilities to a higher degree than adults. Moreover, going through a phase when one does not yet have a “self of one’s own,” and experimenting one’s way to a stable self, seems intrinsically valuable. I argue that (...) children can have good lives, on several understandings of well-being – as a pleasurable state, as the satisfaction of simple desires or as the realization of certain objective goods. In reply to the likely objection that only individuals capable of morality can have intrinsic value, I explain why it is plausible that children have sufficient moral agency to be as deserving of respect as adults. Parenting involves an extraordinary degree of power over children. Republicans are concerned about domination, which, on one view, is the holding of power that fails to track the interests of those over whom it is exercised. On this account, parenting as we know it is dominating due to the low standards necessary for acquiring and retaining parental rights and the extent of parental power. Domination cannot be fully eliminated from child-rearing without unacceptable loss of value. Most likely, republicanism requires that (...) we minimise children’s domination. I examine alternative models of child-rearing that are immune to republican criticism. (shrink)

I review three existing arguments in favor of having some childcare done by nonparents and then I advance five arguments, most of them original, to the same conclusion. My arguments rely on the assumption that, no matter who provides it, childcare will inevitably go wrong at times. I discuss the importance of mitigating bad care, of teaching children how to enter caring relationships with people who are initially strangers to them, of addressing children's structural vulnerability to their caregivers, of helping (...) children and parents contain the ambivalent feelings of the child-parent relationship, and of distributing the responsibility of care and the ensuing blame for bad care more widely. The Unconscious as Space explores the experience of being and the practice of psychoanalysis by thinking of the unconscious in mathematical terms. Anca Carrington introduces mathematical models of space, from dimension theory to algebraic topology and knot theory, and considers their immediate psychoanalytic relevance. The hypothesis that the unconscious is structured like a space marked by impossibility is then examined. Carrington considers the clinical implications, with particular focus on the interplay between language and the unconscious as related topological spaces (...) in which movement takes place along knot-like pathways. In philosophy, there are two competitor views about the nature and value of childhood: The first is the traditional, deficiency, view, according to which children are mere unfinished adults. The second is a view that has recently become increasingly popular amongst philosophers, and according to which children, perhaps in virtue of their biological features, have special and valuable capacities, and, more generally, privileged access to some sources of value. This article provides a conceptual map of these views and their possible (...) interpretations, and notes their bearing on issues of population ethics and on the duties that we are owed during childhood.
