Over the past twenty-five years, thirty-seven states and the US Congress have passed mental health and substance use disorder (MH/SUD) parity laws to secure nondiscriminatory insurance coverage for MH/SUD services in the private health insurance market and through certain public insurance programs. However, in the intervening years, litigation has been brought by numerous parties alleging violations of insurance parity. We examine the critical issues underlying these legal challenges as a framework for understanding the areas in which parity enforcement is lacking, (...) as well as ongoing areas of ambiguity in the interpretation of these laws. We identified all private litigation involving federal and state parity laws and extracted themes from a final sample of thirty-seven lawsuits. The primary substantive topics at issue include the scope of services guaranteed by parity laws, coverage of certain habilitative therapies such as applied behavioral analysis for autism spectrum disorders, credentialing standards for MH/SUD providers, determinations regarding the medical necessity of MH/SUD services, and the application of nonquantitative treatment limitations under the 2008 federal parity law. Ongoing efforts to achieve nondiscriminatory insurance coverage for MH/SUDs should attend to the major issues subject to private legal action as important areas for facilitating and monitoring insurer compliance. The world as we experience it is full of colour. This book defends the radical thesis that no physical object has any of the colours we experience it as having. The author provides a unified account of colour that shows why we experience the illusion and why the illusion is not to be dispelled but welcomed. He develops a pluralist framework of colour-concepts in which other, more sophisticated concepts of colour are introduced to supplement the simple concept that is presupposed (...) in our ordinary colour experience. The discussion draws on philosophical and scientific literature, both historical and modern, but it is not technical, and will appeal to a broad range of philosophers, cognitive scientists and historians of science. We use normative reasons in a bewildering variety of different ways. And yet, as many recent theorists have shown, one can discern systematic distinctions underlying this complexity. This paper is a contribution to this project of constructive normative metaphysics. We aim to bring a black sheep back into the flock: the balancing model of weighing reasons. This model is threatened by a variety of cases in which distinct reasons overlap, in the sense that they do not contribute separate weight for (...) or against an option. Our response is to distinguish between derivative reasons and load-bearing reasons, only the latter of which contribute non-overlapping weight to an option. This distinction is close at hand for analyses of reasons in terms of the promotion of significant outcomes. But we also develop an account of this distinction for fundamentalist theories of normative reasons. (shrink)

This chapter examines other ways the Argument from Completeness might be attacked. It identifies two strategies that the realist might deploy in order to avoid the difficulties engendered by the applicability of the Completeness Theorem to the ideal theory. The first is to insist that the theory be cast in some non-first-order language which resists completeness. The second is to allow ideal theory to continue to be rendered in first-order form, but to argue for a semantics in which interpretations take (...) such a new shape that there is no longer any guarantee that any consistent theory has a model in the new sense. T. D. Barnes has recently impugned the authenticity of these verses and calls for a defence of their genuineness. Although I agree with Fergus Millar that ‘the problem of the Historia Augusta is one into which sane men refrain from entering’,2 yet I think we can at least counter Barnes's objections. Barnes musters four arguments which he naturally calls ‘quite conclusive’. He first points out that the verses are omitted in the epitome of Dio by Xiphilinus, who is our sole (...) source for Dio here, and claims that it is unlikely that Xiphilinus could have omitted such a ‘striking poem’. This is putting an extraordinarily high value on Xiphilinus, who is quite capable of omitting things of greater moment than five Latin verses which he would presumably have had to translate into Greek; as an epitomator of Dio, he is inferior to Zonaras, and his account of Hadrian's reign is particularly poor. Vulnerability does not mean much for our contemporary morality. It is antithetical to our emphasis on individualism and rationality; it requires that we attend to the body and to our feelings. Yet only by recognizing the depth and breadth of our vulnerability can we affirm our humanity.

Many system architects select their system methodologies without explicit consideration of the philosophical perspectives that impact their decisions. This paper describes how the concepts of ontology and epistemology apply in systems science. Ontology is how we specify terms of reference for existence, allowing us to understand the theory of existence via an ‘existence framework’. Epistemology, the theory of knowledge, allows us to explore new models and theories of knowledge acquisition so the best system-based methodologies can be deployed to solve complex (...) system problems. After introducing these concepts, the paper presents system science issues and assesses the impact of ontological, axiological and epistemological perspectives on system methodology selection, research, system design and deployment. An ontological viewpoint such as realism, as an objective view is contrasted versus nationalism, a personal perceptional view. An epistemological viewpoint is explored comparing knowledge as a product of sensory perception or rational reflection. Applied ethics is at a watershed. In all its domains a gulf between the theory of applied ethics and the practice of applied ethics is now being recognized. In medical ethics, for example, it has been observed that “practicing clinicians often feel let down by bioethics.” The disappointment of clinicians is attributed in part to their own unrealistic expectations but is also said to be a function ofthe extent to which bioethics as a discipline doesn't seem to be in possession (...) of the realities of practice. Bioethicists tend to leave the “facts” of clinical medicine to the doctors; their task is then to apply elegant and compelling arguments drawn from first principles of ethics … to these undisputed and indisputable facts. Unfortunately, when the relationship between clinical medicine and bioethics is conceived … [in this way], the result is a very sterile discourse. (shrink)

The practice of giving the wealthy perpetual control of their assets is re-emerging in an era of great wealth inequality, long after it had been banned in common law countries. The philosophical justification for such control rests on the claim that there are posthumous rights to wealth, and that such rights do not extend in problematic way to other goods, such as political suffrage. On the basis of such a claim, we give people freedom of testation, and deem them vulnerable (...) to posthumous harm. I present a short history of legally sanctioned posthumous control of property in common law, and I argue that its philosophical justification is untenable. No principled case for posthumous rights to wealth survives scrutiny, and the large and powerful institutions that enforce such rights are morally illegitimate. (shrink)

This article examines the legal and ethical challenges for the provision of healthcare in the metaverse. It proposes that the issues arising in the metaverse are an extension of those found in telehealth and virtual health communities, albeit with greater complexity. It argues that international collaboration between policymakers, lawmakers, and researchers is required to regulate this space and facilitate the safe and effective development of meta-medicine.

This paper proposes a novel response to Nancy Cartwright’s famous argument that fundamental physical laws, such as Newton’s law of gravitation, are ceteris paribus: construing forces instrumentally allows such laws to apply generally, eliminating the need for ceteris paribus clauses. The instrumental construal of forces is motivated, and defended against prominent recent objections. Further, it is argued that such instrumentalism in no way undermines the role of force-laws in scientific practise, and indeed, is compatible with a robust realism about force-laws.

This case study details a request from a patient family member who calls our service without an articulated ethical dilemma. The issue that arose involved the conflict between continuing further medical interventions versus transitioning to supportive or palliative care and transferring the patient home. Beyond the resolution of the ethical dilemma, this narrative illustrates an approach to ethics consultation that seeks practical resolution of ethical dilemmas in alignment with patient goals and values. Importantly, the family’s suffering is addressed through a (...) relationship driven, humanistic approach that incorporates elements of compassion, empathy and dialog. (shrink)

This article explores Socrates' long analysis of Simonides' "Ode to Scopas," found near the end of Plato's Protagoras. Socrates misinterprets the poem to suggest that virtue is akin to technical knowledge, whereas the poem suggests instead that a wholly virtuous life is impossible, and that the good life is divine, achievable only by the gods. The author argues that Socrates' exegesis dialectically opposes the idea that virtue is knowledge, along with his suggestion that the good life can be secured through (...) a hedonistic calculus, with the poem's emphasis on the insurmountable limitations to human flourishing. Socrates' misreading highlights the provisional and aporetic nature of philosophical accounts of virtue, suggesting that continuous inquiry in the face of misfortune is constitutive of human goodness. The article concludes by proposing that philosophical speech must be self-disclosive and poetic, indicating its own limitations, while engaging in a dialogical pursuit of truth. (shrink)

There is a difference between acting with a probability of making a difference to who is harmed, and worsening someone’s prospect. This difference is relevant to debates about the ethics of offsetting, since it means that showing that emitting-and-offsetting has the first feature is not a way of showing that it has the second feature. In an earlier paper, we illustrate this difference with an example of a lottery in which you shake the bag from which a ball will be (...) drawn to determine the identity of the person who will suffer a harm. Thirteen years ago, commenting on the treatment of the human body and its cell lines as patentable commodities, Mary Taylor Danforth wrote:Research with human cells that results in significant economic gain for the researcher and no gain for the patient offends the traditional mores of our society in a manner impossible to quantify Such research tends to treat the human body as a commodity — a means to a profitable end. The dignity and sanctity with which we regard the human (...) whole, body as well as mind and soul, are absent when we allow researchers to further their own interests without the patient's participation by using a patient's cells as the basis for a marketable product.In his insightful article, David Resnik would have us travel further down the path of allowing the patenting of DNA in order to advance scientific research and the welfare of humankind. This chapter begins by examining and adapting a characterization of realism offered by Michael Devitt, settling on an initial formulation of realism about objects of kind K as the doctrine that objects of kind K exist objectively, and explaining objective existence in terms of intersubjective warrant. Since object realism is an inadequate framework for the discussion of some debates between realists and their opponents, the apparatus of situations and facts is invoked to do justice. However, the argument discussed in literature (...) reveals that the apparatus of situations is too fragile to bear any explanatory weight. The developing analysis can be freed from reliance on this apparatus by semantic ascent, where fact realism is supplanted by semantic realism. Realism is linked with a commitment to the applicability, across the field for which realism is maintained, of a concept of truth which is intersubjective, epistemically independent, and bivalent. When can we say that a debt crisis has been resolved fairly? An often overlooked but very important effect of financial crises and the debts that often engender them is that they can lead the crisis countries to increased dependence on international institutions and the policy conditionality they require in return for their continued support, limiting their capabilities and those of their citizens to exercise meaningful control over their policies and institutions. These outcomes have been viewed by many not merely (...) as extremely unfortunate and regrettable, but also as deeply unfair. And indeed, increasingly potent popular movements have pressured governments, financial institutions, and the financial community to seek what they take to be fairer solutions to debt crises. The merits of these programs and proposals for dealing more fairly with sovereign debt remain hotly disputed. In this essay, we try to take a step back from the political fray and examine some more fundamental considerations that seem relevant to assessing the fairness of current arrangements governing economic exchanges related to debt contracts and alternatives that have been proposed to them.Our discussion is organized into seven sections. First, we characterize briefly the concept of fairness and its role in social evaluation. Second, we clarify what sovereign debt is, and, third, the ethical statuses that particular sovereign debts can have. Fourth, we identify and describe the main features of current practices related to sovereign debt. Fifth, we describe an "ideal picture" of creditor/debtor relations. We argue that in such a scenario a broad range of ethical considerations can plausibly be invoked in support of practices that closely resemble those presently governing sovereign debt. Sixth, we draw attention to the many ways in which in reality the relations between sovereign debtors and their creditors differ markedly from the relationships between the creditor and debtor in the ideal picture. Because of this, many of the ethical considerations that would support present practices were relations between sovereign debtors and their creditors to resemble more closely those depicted in the ideal picture fail to do so under present circumstances. We conclude, moreover, that the remaining ethical considerations that might be advanced in support of the present system are at best quite inconclusive. Finally, we describe briefly specific reform proposals to current practices. While we will not attempt to show that these proposals would necessarily make the rules governing economic exchanges relevant to sovereign debt more fair, we conclude, in light of our earlier analysis, that they must be given much more serious consideration than they have so far received in policy circles. Indeed, there are strong prima facie reasons to believe that some combination of these proposed policies might prevent or mitigate some of the most ethically regrettable outcomes of present practices and norms by changing the incentives of sovereign borrowers and those who lend to them. Relations of transworld similarity play an essential role in Lewis's system. Analysis reveals that they involve the possibility of detailed transworld belief. Such belief is problematic within Lewis's framework. He has an answer to the problems raised, but it relies on a dubious distinction between natural and mere properties. Replacing that distinction with a respectable one undermines an essential part of his case against one of his chief opponents, the linguistic ersatzist.

Subtraction arguments support the view that there might have been nothing. The best-developed SA to date, due to David Efird and Tom Stoneham, is claimed by its authors to entail that there are worlds in which there are space-time points but no concrete objects: Efird and Stoneham hold that space-time points are not concrete and that a world made up from them alone contains nothing concrete. In this paper it is argued that whole space-times are concrete and subtractable, so that (...) a subtraction argument commits us to a bolder conclusion: namely, that there are worlds in which there is no space-time. This result has far-reaching consequences: it supports the view that there might have been no time; and constrains accounts of possible worlds. In the course of developing this revised subtraction argument, I counter suggestions that SAs are question-begging. (shrink)
