As lifestyle diseases put a heavy burden on health care expenditures, voices are raised and win in sound to hold people responsible for their unhealthy lifestyle. Most of the arguments in favour of responsibility are backward-looking. In this article, we describe the distributional consequences of these backward-looking measures and show that they are very harsh on those who regret a past unhealthy lifestyle. We demonstrate that it is possible to take policy measures which respect individual responsibility but which are at (...) the same time able to grant fresh starts to individuals who regret their past unhealthy lifestyle (which is an application of Fleurbaey (2005)). This ‘forgiving’ policy is confronted with a moral hazard problem, however. In general the regulator does not observe whether individuals really regret their past choices or they just pretend to have changed preferences in order to enjoy the compensatory measures for regretful people. In this article, we argue that the health setting offers interesting opportunities to move beyond this moral hazard problem and offer a solution through the use of redistributive instruments that are conditional on lifestyle changes. From the 1981 “Sexuality and Solitude” to the 1982 “Le combat de la chasteté” to the 1984 History of Sexuality, Volume 2, Michel Foucault’s published works have long recognized the influence of the historian of late antiquity, Peter Brown. With the 2018 publication of Foucault’s draft of Les Aveux de la chair (Confessions of the Flesh) bearing no mention of Brown, the depth of this influence requires further elaboration. Despite Brown not appearing in the “Index of Modern Authors,” Confessions of (...) the Flesh reflects Foucault’s debt to Brown for his readings of Augustine of Hippo and his conceptualizations of sexuality and subjectivity. Analyzing archival evidence alongside biographical narratives helps us better understand Brown’s vital influence as Foucault was shifting his History of Sexuality project, his archival practices, and his genealogy of subjectivity. Appreciating the textual and conceptual engagement between Foucault and Brown thus illuminates not only Confessions of the Flesh as Volume 4 in the History of Sexuality series but also the conceptual and methodological developments of both scholars in their disciplinary intersections. Thanks to his unsurpassed eye and his fearless willingness to take a stand, Clement Greenberg (1909 1994) became one of the giants of 20th century art criticism a writer who set the terms of critical discourse from the moment he burst onto the scene with his seminal essays Avant Garde and Kitsch (1939) and Towards a Newer Laocoon (1940). In this work, which gathers previously uncollected essays and a series of seminars delivered at Bennington in 1971, Greenberg provides his most (...) expansive statement of his views on taste and quality in art, arguing for an esthetic that flies in the face of current art world fashions. Greenberg insists despite the attempts from Marcel Duchamp onwards to escape the jurisdiction of taste by producing an art so disjunctive that it cannot be judged that taste is inexorable. He argues that standards of quality in art, the artist's responsibility to seek out the hardest demands of a medium, and the critic's responsibility to discriminate, are essential conditions for great art. The obsession with innovation the epidemic of newness leads, in Greenbergs view, to the boringness of so much avant garde art. He discusses the interplay of expectation and surprise in aesthetic experience, and the exalted consciousness produced by great art. Homemade Esthetics allows us particularly in the transcribed seminar sessions, never before published to watch the critics mind at work, defending (and at times reconsidering) his theories. In November 1996, Catherine Clément and Julia Kristeva began a correspondence exploring the subject of the sacred. In this collection of those letters Catherine Clément approaches the topic from an anthropologist's point of view while Julia Kristeva responds from a psychoanalytic perspective. Their correspondence leads them to a controversial and fundamental question: is there anything sacred that can at the same time be considered strictly feminine? The two voices of the book work in tandem, fleshing out ideas and blending together (...) into a melody of experience. The result is a dialogue that delves into the mysteries of belief -- the relationship between faith and sexuality, the body and the senses -- which, Clément and Kristeva argue, women feel with special intensity. Although their discourse is not necessarily about theology, the authors consider the role of women and femininity in the religions of the world, from Christianity and Judaism to Confucianism and African animism. They are the first to admit that what they have undertaken is "as impossible to accomplish as it is fascinating." Nevertheless, their wide-ranging and exhilarating dialogue succeeds in raising questions that are perhaps more important to ask than to answer. (shrink)

In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

Cette recherche apporte des repères majeurs pour mieux saisir la place de Nietzsche dans une phénoménologie de la vie, tout en éclairant le rapport des deux philosophes à la Grèce et au christianisme. Si Nietzsche est tout particulièrement l’auteur qui sert de point d’appui à M. Henry pour remettre en question l’approche grecque de la phénoménalité, c’est parce que le philosophe allemand incarne précisément le retour à la Grèce tragique de l’époque archaïque, si bien que l’exception que ce dernier représente (...) dans la philosophie occidentale tient au fait qu’il met en œuvre des présupposés phénoménologiques différents de ceux de la Grèce idéaliste. Kafka’s works very often work as parables in which the lesson has been lost; or at least is ingeniously obfuscated from immediate understanding from the reader. His short story “In the Penal” Colony is no exception: the Traveller visits a penal colony with an unusual take on capital punishment as a sophisticated machine, built by the former commandant, inscribed unto the flesh of the criminals the law whose violation has resulted in their excruciating painful death. Our proposal is that the (...) story is a clear reference of a very commonplace Jewish ritual of laying “tefillin”, i.e. phylacteries containing certain commandments and to be affixed to one’s head and arm every morning, and that such preoccupation of ensuring the transmission of the law by physical inscription unto the mind and the flesh. Perhaps more than any philosophy written in the past few centuries, the work of Friedrich Nietzsche has given rise to controversy, misunderstanding, and dissent. Today Nietzsche is remembered as the revolutionary author of such polemical ideas as the death of God, the revaluation of values, the will to untruth, and the Übermensch. Yet is Nietzsche’s philosophy as atheistic, relativistic, nihilistic, and immoral as some commentators have claimed? Or ought we perhaps to give more credence to Nietzsche’s own assertion that one (...) writes books “precisely to conceal what one harbors” (BGE, 9, 289)? If “whatever is profound loves masks” (BGE, 2, 40) then might Nietzsche’s more daring claims be interpreted as clever masks behind which he conceals a deeper philosophy and on which he reveals a hidden truth? Is it not possible that the standard readings of Nietzsche are in fact misreadings—that his work invites misreading, that it is intentionally unclear, deceptive, disguised? The goal of this volume is to reread Nietzsche for all that he shows and all that he hides. It is to dig deeper into his work in order to challenge misreadings of old and invite misreadings anew—as, indeed, his work itself calls for and demands. (shrink)

The Coronavirus Disease 2019 pandemic, now a global health crisis, has surprised health authorities around the world. Recent studies suggest that the measures taken to curb the spread of the COVID-19 outbreak have generated issues throughout the population. Thus, it is necessary to establish and identify the possible risk factors related to the psychosocial and psychophysiological strain during the COVID-19 outbreak. The present extensive literature review assesses the social, psychological, and physiological consequences of COVID-19, reviewing the impact of quarantine measures, (...) isolation, vast human loss, social and financial consequences in the family’s economies, and its impact on the psychological health of the population. We also discussed the effect of psychophysiological factors, considering the impact of physical inactivity and modifications in nutritional habits, at psychological and physiological levels. The present review includes an actualized to date bibliography, articles for which were methodologically analyzed to verify they met the standards of quality and scientific accuracy. Authors understand the pandemic as a multifactorial event for which only a profound and extensive analysis would lead to better compression and efficient intervention in the near future. (shrink)

Cet article se propose de montrer comment la présence récurrente de chevaux périlleux auprès de nombreux personnages de récits médiévaux et du folklore contemporain participe à la mise en lumière d’une fonction expiatoire conférée au destrier merveilleux. Il s’agit d’explorer la persistance de ce rôle dans le folklore régional français, afin de tracer un schéma d’un récit-type de la mise à l’épreuve et du tourment héroïques. La démarche retenue part de l’analyse du mythème chevalin dans le contexte du récit médiéval, (...) afin d’arriver à une mythanalyse d’un cheval-passeur que le folklore conserve et décline au gré des récits. Le propos s’appuie sur l’exemple de certaines chevauchées de La Queste del Saint Graal, que l’on mettra en relation avec des récits de tradition orale issus des collectes éditées par Alice Joisten et Christian Abry ou par Dominique Saur. Les déboires des élus du Graal auprès de chevaux terribles et merveilleux semblent bien ainsi constituer un topos de la remise en cause des vertus et des vices humains, dont la permanence se retrouve au sein de témoignages régionaux plus contemporains. The purpose of this paper is to evidence that the recurring presence of dangerous horses alongside many characters in medieval and contemporaneous folk narratives shed light on the atonement function of this marvel destrier. The permanence of this role in the French folklore will be emphasized in order to support a schema for a narrative type about the heroic test and torment. The approach proceeds from the analysis of the horse mytheme in the context of medieval narratives toward the mythanalysis of the ferry horse of souls, as a reputed psychopomp animal, which was ambient in folklore under various tokens. Finally, starting from specific horseback rides, typical riding raids found in The Grail Quest, their proximity with contemporaneous oral narratives edited by Alice Joisten and Christian Abry or by Dominique Saur will be recalled. The setbacks of the chosen of the Holy Grail faced to marvel and terrific horses seem to meet a topos, a challenge about virtues and vices whose permanence is attested in the most recent surveys in folkloristics. This paper aims at bridging a gap between the history of American animal behavior studies and the history of sociobiology. In the post-war period, ecology, comparative psychology and ethology were all investigating animal societies, using different approaches ranging from fieldwork to laboratory studies. We argue that this disunity in “practices of place” explains the attempts of dialogue between those three fields and early calls for unity through “sociobiology” by J. Paul Scott. In turn, tensions between the naturalist tradition and the (...) rising reductionist approach in biology provide an original background for a history of Edward Wilson’s own version of sociobiology, much beyond the William Hamilton’s papers usually considered as its key antecedent. Naturalists were in a defensive position in the geography of the fields studying animal behavior, and in reaction were a driving force behind the various projects of synthesis called “sociobiology”. The basic thesis of this essay is that the progressive development of any discipline is propelled by incessant constructive criticisms, creative emendation and articulate reconstruction of established positions and received opinions in the discipline. Accordingly, the essay argues that the method and canons of Conversational Philosophy are very significant to the progressive development of African philosophy. This is because they are fundamentally articulated to promote the constructive criticism, creative emendation, and articulate reconstruction of established positions or received opinions in African (...) philosophy. It buttresses this point using Mesembe Edet’s conversation with Innocent Onyewuenyi on the question of the African belief on reincarnation. This choice stems from the explicit admittance of Edet that his conversation with Onyewuenyi adopts the method of conversationalism and the method of conversationalism is undergirded by the canons of CP. Specifically, this essay explicates how the conscious adoption of conversationalism and adherence to the canons of CP enabled Edet to engage Onyewuenyi in a very critical and creative conversation on the African belief in reincarnation which eventually led to a novel reconceptualization of reincarnation in African philosophy. It unveils the significance of conversationalism and the canons of CP in practice. It is therefore a conversational, expository and argumentative essay. In line with public policies, the French Association of Paralyzed People (APF) promotes the social participation of people with disabilities. This objective can be achieved both through participation in activities and participation in decision-making processes. This dual categorisation raises questions about the compatibility of logics of support and program objectives across these two facets of participation. Arising from work conducted in the context of a PhD dissertation, this article is based on document analysis and 49 indepth interviews with employees, volunteers, (...) members and users of the APF. The results highlight a tension, from the point of view of professional supports, between participation in activities and participation in decision-making. For the sake of swift and tangible results, professionals are encouraged to offer activities and services to achieve faster and more effective social participation. However, this places them in a complex, or even inextricable, position when it comes to enhancing users’ participation in decision-making. (shrink)

The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. A sample of 703 Spanish psychologists completed an online survey containing 114 behaviors related to professional practice in different areas. The aim of the study was to learn which professional behaviors create ethical dilemmas most often for psychologists and how they respond to these issues. Findings suggest that psychologists who have actually faced a particular dilemma are less strict on judging the inappropriateness of a possible ethical transgression than those psychologists who have not experienced it. Second, I examine and clarify many difficult and fundamental issues raised by Rüdiger Vaas’ comments on Cosmological Artificial Selection.

Despite the fact that informal labour is a widespread phenomenon, the business ethics literature tends to describe it as a problem that needs to be overcome, rather than contemplating its merits. Informal labour is linked to poor working conditions, low-income and insufficient protection. However, it is also a survival strategy and upholds essential services, such as waste collection and recycling. Through the lens of postmodern ethics, we analyse 45 interviews with formal and informal waste management workers in Kinshasa. The study (...) explores the functioning and limits of recycling services in a metropolis, focusing on the experience of African workers and entrepreneurs. A complex picture of ethical challenges and individual business and survival strategies emerges from the analysis. Our findings demonstrate that labour decisions of voiceless people cannot be reduced to being rational or desperate choices, but that they reflect a careful elaboration of currently available options and strategies for the future. The study contributes to our understanding of entrepreneurship in a post-conflict context, the role of informal labour in the functioning of formal businesses in Africa and the contribution of postmodern theory to the study of businesses in non-Western societies. “Logic and Agon” is the text of a lecture given in Rome in 1958 by the German philosopher and mathematician Paul Lorenzen. In this inaugural text are laid the foundations of the dialogic logic, which represents an alternative approach to the question of meaning and logical truth, based on a dynamic formalism. Through the enrichment of the standard approach to logic with original tools, it allows a philosophical explanation of the foundations of the concept of formal validity.
