One felt the need to separate objective truths and fabulous accounts on the basis of a modern-oriented comparatist approach which was especially suspicious of Aelian’s De Natura Animalium and the so-called paradoxographic tradition. At that time, classicists were also keen to [End Page 532] see Severan literature as a scarcely original (and relatively uninteresting) digest of earlier writings—a faithful mirror of the beginning of the end.Steven Smith’s book on Aelian’s “literary imagination” and its culturally embedded use of animal figures is paradigmatic of the notable progress of scholarship in both such fields of research—the role of animals as revealing symbolic constructs and the intellectual life of Severan Rome. Throughout his well-structured survey, Smith offers new insights into Aelian’s worldview as a profoundly Hellenized Roman writer creatively combining biological notions and literary mirabilia, socio-political patterns, and sophistic aesthetics. On the one hand, the book clearly situates itself in the flourishing area of cultural and animal studies, making the most of both well-known and newly emerging theoretical frameworks (from Michel Foucault to Donna Haraway, from Derrida and Deleuze to Giorgio Agamben). Of course, the purpose of Smith as well as of other contemporary scholars interested in the ancient representation of animals is no longer to identify reliable “scientific” data as distinct from ancient folklore. Rather, it is the intersection of rhetorical, historical, and anthropological factors which seems to characterize most properly the Graeco-Roman discourse on animal life. On the other hand, however, Smith engages in an ambitious reconfiguration of Aelian’s (admittedly enigmatic) profile as an exponent of the Second Sophistic, at the same time indebted and alien to the milieu of the third century c.e. The multifaceted textual construction of Aelian’s animal narratives is shown to entail a critical (and at times ambiguous) reflection on such different issues as gender, religion, ethnicity, natural philosophy, and kingship.The book is composed of ten chapters, each one investigating a specific aspect of Aelian’s Weltanschauung on the basis of thematically connected passages. While the main focus is on De Natura Animalium (and thus on animal-related topics), two chapters (2 and 10, respectively) extend the scope of the inquiry to Aelian’s Rustic Letters and Varia Historia (VH). The monograph as a whole is framed by an introductory overview (starting with a fictional first-person speech by Aelian) and a conclusive note which sums up Smith’s most relevant theses. In addition, a more “philological” appendix discusses seventeen short fragments possibly pertaining to Aelian’s lost Katēgoria tou gunnidos (“The Indictment of the Little Woman”), a bitter invective against Elagabalus prudently written after the emperor’s death (cf. Philostr. Vit. Soph. 625).The question of Aelian’s elusive literary persona figures prominently in the general introduction and is the core subject of chapter 1. By qualifying the author of the De Natura Animalium (NA) as “independent” and “countercultural,” Smith does not mean to remove him from his social and political context. On the contrary, the evidence drawn from the NA itself (especially from the impressionistic self-portrait of the preface and the epilogue), together with the biographical sketches in Philostratus’ Lives of the Sophists and in the Byzantine Souda lexicon, is used to demonstrate that, though “inextricably bound up with and perhaps even unwittingly celebratory of urban Roman culture of the early third century c.e., Aelian nevertheless also fashions a literary persona that is critical of that same [End Page 533] cultural milieu” (16). This paper examines the role of performance in law and music as a structural means of their self-programming construction. Music and law are considered as parallel social practices or performative doings. The paper begins with a critical analysis of the special aesthetical features of present-day juridical practice as exemplified by legal trial and legal expertise. Drawing upon reflections on the modern discourse on aesthetics and art, the article then examines in greater detail the specific traits of performance in law and (...) jazz music. Performative processes move from representation to presentation, from a preoccupation with rules and controlling to induced self-programming. Both law and jazz regard the unknown future as a resource for present decisions by “inventing” new possibilities; both require, expand and promote a responsibility that does not follow from statutes nor can be expressed in a code of ethics. Finally, the article addresses the performance situation in jazz. Jazz being polyphonic and improvisational by nature, improvisation makes explicit tradition by staging the context dependency of its performance. It is mediated by the knowledge, the operational history and the communication of the participants. Jazz is an exercise in the possibilities of an “aesthetics of imperfection” which can open up new ways of seeing law and politics. (shrink)

This paper explores what is apparently a non-topic for Luhmann. Luhmann is preoccupied with decision-making rather than with judgment. The paper argues that Luhmann, attempting to find a way out of the dilemma between the fundamentalism of positivistic legal theory and the relativism of anti-foundationalist post-modern thinking, presents the epistemological–ethical doublet of a “self-binding” of the law. In this bootstrapping manoeuvre decision plays the central part. The paper begins by examining judgment in its relation to decision as considered by non-system-theoretical (...) thinking. Against that background it unfolds the distinction between distinction, form and decision in systems theory and in the system-theoretical observation of the law. The article then discusses Luhmann’s description of the functioning of decision(-making) within the legal system. The hypothesis is that Luhmann blends here cognitive with ethical aspects. Finally, the article addresses Luhmann’s polemics against alternative approaches to his own. The suggestion is that ‘judgment’, in Luhmann’s systems theory, re-enters by the back door as an ethical–theoretical imperative that commands theory’s responsibility for society and law. (shrink)

In this paper, I propose to use Johan Galtung’s notion of structural violence as aguide for linking society’s problems of processing social meaning to the very idea of law. At the heart of my interest is the discrepancy Galtung sees between real and possible social conditions. I will first focus on the specific character of violence as communication. I will then consider the consequences of the heterogeneity of the languages that law speaks. Law and everyday practice not only refer to (...) actions in different ways, but also constitute different actions through their references. Law thus acquires a double validity: an internal one, based on the consistency of its discourse, and an external one, derived from successful translations of practical certainties. While the former defies the assumption that law can be somehow resonant, the latter paves the way for a critical understanding of law. The final section argues that if practical reason aims to create just conditions, and law is meant to sustain life, its purpose cannot be the mere optimisation of the given. Law must address the totality of possible transformations, exploring contained but not yet realised models. (shrink)

The analysis of genetic and epigenetic mechanisms of the genotype–phenotypic connection has, so far, only been possible in a handful of genetic model systems. Recent technological advances, including next‐generation sequencing methods such as RNA‐seq, ChIP‐seq and RAD‐seq, and genome‐editing approaches including CRISPR‐Cas, now permit to address these fundamental questions of biology also in organisms that have been studied in their natural habitats. We provide an overview of the benefits and drawbacks of these novel techniques and experimental approaches that can now (...) be applied to ecological and evolutionary vertebrate models such as sticklebacks and cichlid fish. We can anticipate that these new methods will increase the understanding of the genetic and epigenetic factors influencing adaptations and phenotypic variation in ecological settings. These new arrows in the methodological quiver of ecologist will drastically increase the understanding of the genetic basis of adaptive traits – leading to a further closing of the genotype–phenotype gap. -/- . This article questions some assumptions in legal, moral and political theory regarding the law’s ways of functioning. As the constant revival of the topos ‘living law’ shows, underlying common models of law, and of the legitimacy of law, is, though often implicitly, the view that law is or should be particular, near to the facts, flexible, susceptible to realities, and as a consequence accessible to modernisations. However, this article proposes an immanent critique of similar hopes or fears, and it argues (...) that modern positive law can not be responsive to any other ‘order’ or context because it constitutes an order of its own. The article seeks to give an explanation of the specific character and forms of the juridical operating and to explain more specifically how decisions are produced. The article in this regard also investigates the importance and role of imagination, fiction and performativity. Underlining the fact that the juridical exceeds legal propositions by asserting itself as a distinct form of social communication, it calls for a shift from the representational to the performative analysis in the study of law. Previous research has underlined the significance of practical wisdom pertaining to corporate sustainability. Recent studies, however, have identified managing opposing but interlocked tensions related to environmental, social, and economic aspects as one of the most crucial future challenges in CS. Therefore, we apply the established link between wisdom and sustainability to the pressing topic of managing tensions in CS. We commence with a literature overview of tensions in sustainability management, which manifests our basic work assumption concerning the need for practical (...) wisdom in CS. We then discuss the threefold, mutual interconnectedness between practical wisdom and tension management in CS, which we illustrate in a conceptual model. Thereafter, we develop a set of propositions on how a practical wisdom approach influences CS in practice and how it differs from a business-case approach. In recognition of the conceptual character of our paper, we conclude by outlining potential practical applications and theoretical implications of the model and of the propositions. Limitations and avenues for further research are discussed. (shrink)

Max Weber ist ein Klassiker der Kultur- und Sozialwissenschaften. Sein Werk gehört weltweit zum Kernbestand von Forschung und Lehre, und dies gilt besonders für seine methodologischen Schriften, denen auch 100 Jahre nach ihrer Publikation nachhaltige Aufmerksamkeit beschieden ist. Allerdings gibt es immer noch kein einvernehmliches Verständnis von Webers Position. Der Grund dafür liegt in der mangelnden Aufarbeitung der Quellen. Viele wichtige Autoren, deren Werke Weber rezipierte, sind in Vergessenheit geraten. Sie in Erinnerung zu rufen, ist dringend notwendig, um seine Wissenschaftslehre (...) in ihrer ganzen Komplexität zu verstehen. 0Das vorliegende Sammelwerk leistet einen Beitrag zur Schließung dieser Forschungslücke. Es rekonstruiert den Denkraum des späten 19. und frühen 20. Jahrhunderts, in dem sich Weber bewegte, und zeigt anhand von Studien zu ausgewählten Autoren, wie umfassend und interdisziplinär sein Denken tatsächlich war. Dabei werden nicht nur Autoren aus den Kultur- und Sozialwissenschaften berücksichtigt, sondern auch solche aus den Naturwissenschaften, denn Weber war mit dem Fortschritt dieser Disziplinen ebenfalls vertraut. The ancient virtue of practical wisdom has lately been enjoying a remarkable renaissance in management literature. The purpose of this article is to add clarity and bring synergy to the interdisciplinary debate. In a review of the wide-ranging field of the existing literature from a philosophical, theological, psychological, and managerial perspective, we show that, although different in terms of approach, methodologies, and justification, the distinct traditions of research on practical wisdom can indeed complement one another. We suggest a conciliatory conception (...) of the various features of practical wisdom in management. This we take as a point of departure for a discussion of the significant implications of the subject for the theory and practice of management and for the direction of further research in the field. Nicolai Hartmann hat philosophische Studien zur Erkenntnistheorie, Ontologie, Ethik, Philosophie des Geistes und Naturphilosophie geschrieben. Die Beiträge des Bandes gehen davon aus, dass seine Arbeit auf all diesen Feldern im Zeichen der Verabschiedung der Systemphilosophie sowie der Begründung einer Konzeption systematischen Philosophierens steht. Im Zentrum von Hartmanns Denken steht das "Kategorienproblem", d. i. die Frage nach den elementaren Strukturen der Wirklichkeit und der menschlichen Erkenntnis. In seinem Bezug auf die philosophische Tradition und seiner Hinwendung zu den Natur- und Sozialwissenschaften unter (...) Einbeziehung auch der alltäglichen Erfahrung macht Hartmann deutlich, dass er an dem Anspruch festhält, die Phänomene der Lebenswelt, Wissenschaft und Geschichte in einem einheitlichen "Aufbau der realen Welt" zu integrieren, ohne ihre Heterogenität und Selbständigkeit zu leugnen. Die Beiträge konzentrieren sich daher auf das Konzept einer "Neuen Ontologie", das Programm der "Kategorienforschung", den Wissenschaftsbezug von Hartmanns Denken, dessen Relevanz für die philosophische Anthropologie und die Problematik des geistigen Seins, der Freiheit sowie der Geschichte. Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

Suetonius says that court jesters put slippers on Claudius’ hands while he napped during Caligula's dinner parties so that he would rub his face with them when he awoke. Since touching someone with the sole of a shoe was an insult, the joke is that Claudius insulted himself when he unwittingly rubbed his own face with the slippers.

When Claudius came to power in January 41 he did not hesitate to distance himself from his predecessor's behaviour and policies, and among other measures, Suetonius reports, he abolished all Gaius' acta. The precise implications of this move are not made clear. Certainly, the extremely unpopular taxes introduced in Rome near the end of Gaius' reign were annulled, several people convicted of maiestas were set free, and the monies previously confiscated from negligent, and possibly corrupt, road commissioners were returned. (...) But if the abolition of the acta was as sweeping as Suetonius seems to imply, a number of popular and useful measures must inevitably have been abrogated at the same time, and as a matter of routine they would need to be reintroduced by Claudius. The arrangements with the client kings may well have belonged to this general category, and if we assume that this was indeed the case we shall have an explanation for a number of apparent inconsistencies in the literary sources. It should be observed that in the early part of his principate Gaius went out of his way to be a ‘constitutional’ ruler. The appointment of the client kings would have been handled so as not to seem like the arbitrary exercise of power. Certainly, when the three sons of the murdered king of Thrace, Polemo, Cotys and Rhoemetalces received new kingdoms in 38, Dio stresses that the act was legitimised by a formal senatorial decree. If client kings had generally been established by a formal and legal process their appointments could quite well have come to an end with the abolition of the acta in January 41. (shrink)

On 15 March 46 Claudius published at Baiae an edict enfranchising the Anauni, Tulliasses and Sinduni. The citizenship of these tribespeople in the Italian Alps had previously been uncertain: they were attached to the nearby municipium of Tridentum, which already enjoyed Roman citizenship, but were themselves no more than de facto Roman citizens. Claudius now confirmed their legal status as Romans.

The utterances of Claudius were celebrated, or rather notorious. Suetonius, like Tacitus himself, points out that he could be eloquent but that, especially when he spoke impromptu or added unrehearsed remarks to a prepared speech, he revealed that he had no sense of what was appropriate to his dignity as Princeps, or to the time, place and audience. The biographer cruelly collected various examples of his subject's verbal ineptitude.

The purpose of this paper is to reconsider the principal lines of approach which have been taken to the career of Appius Claudius Caecus in the hope of formulating a view of the censor which is neither over-dramatized nor, on the other hand, so muted as to deny recognition to those aspects of his political behaviou which so greatly exercised his contemporaries. In so doing, I will argue that previous studies of Appius' career have sought in the wrong places (...) for an explanation of the political rivalry between him and his opponents and I will offer an interpretation of his censorial acts—and of one of them in particular—which, I believe, may account for this rivalry. Claudius Marius Victor , a rhetor of Marseilles , composed in the first half of the fifth century a metrical paraphrase of Genesis from the creation of the world up to the destruction of Sodom. The work, which amounts to something over 2,000 lines and is supposedly unfinished, is entitled Alethia, seasoned with occasional discussion of philosophic or other matter, and written with the expressed hope of improving the minds of the young. The text depends on a single ninth-century (...) Paris manuscript , which contains errors that are numerous but in general rudimentary and susceptible of convincing emendation. The first serious edition—for the edition of J. de Gagny , though it offered many useful emendations, was too full of licentious alterations, excisions, and additions, to rank as such—was that of G. Morel . The next editor, G. Fabricius , in spite of his awareness of Morel's edition, did little more than reproduce the depraved text of Gagny. (shrink)

The career of the father of Claudius Etruscus is of special importance in the history of the Imperial administration in the first century A.D. In the course of a long life he rose from slave status under Tiberius to be head of the Imperial financial administration and to equestrian status under Vespasian. He was one of the most important, wealthy, and influential of the Imperial freedmen in the first century when their influence was at its peak; he is one (...) of the best documented of their number outside the pages of Tacitus; yet we do not know his personal name—he has to remain simply ‘the father of Claudius Etruscus’ —and even his nomen gentilicium and the date of his appointment to be the secretary a rationibus are subject to disput. In the Classical Quarterly of April, 1914, I ventured to call in question the explanation of this well-known difficulty put forward by Dr. E G. Hardy in his Roman Laws and Charters. Dr. Hardy has done me the honour of replying to my article in the October Quarterly, but his lengthy argument entirely fails to convince me.
