The paper presents three strong arguments advocating for the exclusion of the table of Ptolemy’s own planetary terms from the original text of the Tetrabiblos. This table was vastly used by Renaissance astrologers, and much work on its rationale and its manuscript variant readings has been published recently. The author argues that the table was the product of the systematic analysis of Ptolemy’s instructions for the terms in the late antique commentary on the Tetrabiblos edited by Wolf in (...) 1559, and that it entered the direct transmission of Ptolemy’s text in the Byzantine period, probably in the 11th century through cod. Laur. 28,34. The absence of the table in the original Tetrabiblos would explain Ptolemy’s recourse to a probably invented manuscript find and his limited account of the system’s workings. (shrink)

Bringing the meta-mathematics of Hero of Alexandria and Claudius Ptolemy into conversation for the first time, I argue that they employ identical rhetorical strategies in the introductions to Hero’s Belopoeica, Pneumatica, Metrica and Ptolemy’s Almagest. They each adopt a paradigmatic argument, in which they criticize the discourses of philosophers and declare epistemological supremacy for mathematics by asserting that geometrical demonstration is indisputable. The rarity of this claim—in conjunction with the paradigmatic argument—indicates that Hero and Ptolemy participated (...) in a single meta-mathematical tradition, which made available to them rhetoric designed to introduce, justify, and bolster the value of mathematics. Abstract:In his Descriptio urbis Romae, Leon Battista Alberti provides step-by-step instructions for how to draw the outlines of Rome. The image transmitted through Alberti’s text is so accurate that it is justly described as the first “map” of Rome after the Forma Urbis (3rd c. CE). Alberti's idea was sparked by the renewed reading of the works of Claudius Ptolemy: the Geography, but also—as I argue for the first time—the Almagest. Ekphrasis is familiar as a rhetorical tool for inducing enargeia, the vivid sense that a reader or listener is actually in the presence of the objects described. This book focuses on the ekphrastic techniques used in ancient Greek and Roman literature to describe technological artifacts. Since the literary discourse on technology extended beyond technical texts, this book explores 'technical ekphrasis' in a wide range of genres, including history, poetry, and philosophy as well as mechanical, scientific, and mathematical works. Technical authors (...) like Philo of Byzantium, Vitruvius, Hero of Alexandria, and Claudius Ptolemy are put into dialogue with close contemporaries in other genres, like Diodorus Siculus, Cicero, Ovid, and Aelius Theon. The treatment of 'technical ekphrasis' here covers the techniques of description, the interaction of verbal and visual elements, the role of instructions, and the balance between describing the artifact's material qualities and the other bodies of knowledge it evokes. In the Roman time, Azania and its capital Rhapta had cultural and economic connections with diverse civilizations of the world, including those in the Mediterranean basin, the Middle East, India, the Far East, and the deep interior of Africa. Information about Azania was first provided by the Romans – Pliny the Elder, Claudius Ptolemy, and sources such as the Periplus of the Erythraean Sea. Apart from the Romans, other people of the Middle East, including the Homerites or Himyarites, (...) were found to have lived and traded in Azania. Pliny the Elder reported that Azanian received spices from the Far East and sent them to the Great Lakes’ region where they were ferried via the Nile to the Mediterranean basin. The Periplus also reported other exported and imported trade goods. Indian and Chinese records provided evidence of connections with Azania. The most recent evidence of these connections is archeological. Materials recovered include beads and ceramics from Rome, the Middle East, and India. Archeology of submerged Rhapta also uncovered architectural remains of Roman technology. Material remains from the deep interior of Africa have been found on the coast of Azania. Roman connections with the deep interior of Africa are believed to have created caravan routes that facilitated cultural and technological exchanges. (shrink)

The paper argues that the depiction of the Mediterranean coast of Africa in Ptolemy’s Geography was based on a source similar to the Stadiasmus of the Great Sea. Ptolemy’s and the Stadiasmus’ toponymy and distances between major points are mostly in good agreement. Ptolemy’s place names overlap with those of the Stadiasmus by 80%, and the total length of the coastline from Alexandria to Utica on Ptolemy’s map deviates from the Stadiasmus data by only 1% or (...) 1.5%. A number of serious disagreements between Ptolemy’s map and the Stadiasmus regarding the length of particular coastal stretches can be explained by assuming that Ptolemy had to tailor the distance data derived from periploi to his other sources, especially, to the longitudes of the key reference points, such as Cape Phyces, Cyrena, Berenica, Aesporis, Thena, and Carthage. A notable stretching and the subsequent contraction of the coast between Alexandria and Cyrenaica, as are exhibited by Ptolemy’s map relative to the Stadiasmus’ data, can be explained by assuming that several points on this coast were tied to the position of Crete, which was moved to the west being pushed by the westward shift of Rhodes. A sharp contraction of the two coastal stretches of the Great Sirte, oriented along the north-south direction, can be explained by Ptolemy’s erroneously underestimated value for the circumference of the Earth. The analysis of this contraction, as well as of the east-west stretching of the coast between Alexandria and Cyrene in angular terms relative to the modern map, makes it possible to assess the magnitude of Ptolemy’s error and to determine the length of his stade. This analysis shows that Ptolemy’s value for the circumference of the Earth must have been underestimated by approximately 20–27%, and Ptolemy’s stade must have been approximately 175–185 m length. Comparison of the Stadiasmus distance data with the modern map shows that the average length of the stade was close to 179 m or to the “common” stade of 185 m for the stretch between Alexandria and Berenice. This paper examines the role of performance in law and music as a structural means of their self-programming construction. Music and law are considered as parallel social practices or performative doings. The paper begins with a critical analysis of the special aesthetical features of present-day juridical practice as exemplified by legal trial and legal expertise. Drawing upon reflections on the modern discourse on aesthetics and art, the article then examines in greater detail the specific traits of performance in law and (...) jazz music. Performative processes move from representation to presentation, from a preoccupation with rules and controlling to induced self-programming. Both law and jazz regard the unknown future as a resource for present decisions by “inventing” new possibilities; both require, expand and promote a responsibility that does not follow from statutes nor can be expressed in a code of ethics. Finally, the article addresses the performance situation in jazz. Jazz being polyphonic and improvisational by nature, improvisation makes explicit tradition by staging the context dependency of its performance. It is mediated by the knowledge, the operational history and the communication of the participants. Jazz is an exercise in the possibilities of an “aesthetics of imperfection” which can open up new ways of seeing law and politics. (shrink)

This paper explores what is apparently a non-topic for Luhmann. Luhmann is preoccupied with decision-making rather than with judgment. The paper argues that Luhmann, attempting to find a way out of the dilemma between the fundamentalism of positivistic legal theory and the relativism of anti-foundationalist post-modern thinking, presents the epistemological–ethical doublet of a “self-binding” of the law. In this bootstrapping manoeuvre decision plays the central part. The paper begins by examining judgment in its relation to decision as considered by non-system-theoretical (...) thinking. Against that background it unfolds the distinction between distinction, form and decision in systems theory and in the system-theoretical observation of the law. The article then discusses Luhmann’s description of the functioning of decision(-making) within the legal system. The hypothesis is that Luhmann blends here cognitive with ethical aspects. Finally, the article addresses Luhmann’s polemics against alternative approaches to his own. The suggestion is that ‘judgment’, in Luhmann’s systems theory, re-enters by the back door as an ethical–theoretical imperative that commands theory’s responsibility for society and law. (shrink)

In this paper, I propose to use Johan Galtung’s notion of structural violence as aguide for linking society’s problems of processing social meaning to the very idea of law. At the heart of my interest is the discrepancy Galtung sees between real and possible social conditions. I will first focus on the specific character of violence as communication. I will then consider the consequences of the heterogeneity of the languages that law speaks. Law and everyday practice not only refer to (...) actions in different ways, but also constitute different actions through their references. Law thus acquires a double validity: an internal one, based on the consistency of its discourse, and an external one, derived from successful translations of practical certainties. While the former defies the assumption that law can be somehow resonant, the latter paves the way for a critical understanding of law. The final section argues that if practical reason aims to create just conditions, and law is meant to sustain life, its purpose cannot be the mere optimisation of the given. Law must address the totality of possible transformations, exploring contained but not yet realised models. (shrink)

Ce vestige est l'une de nos meilleures sources d'information - et la seule qui soit interne a l'ecole peripateticienne - (...) sur la vie d'Aristote. Elle permet de reconstituer les liens entre Aristote et le pouvoir macedonien - Philippe, Alexandre le Grand et le general Antipatros - ainsi que l'emancipation progressive d'Aristote a l'egard de Platon. C'est aussi notre seul temoignage sur la premiere edition, dans l'Antiquite, des ecrits savants du Philosophe. The analysis of genetic and epigenetic mechanisms of the genotype–phenotypic connection has, so far, only been possible in a handful of genetic model systems. Recent technological advances, including next‐generation sequencing methods such as RNA‐seq, ChIP‐seq and RAD‐seq, and genome‐editing approaches including CRISPR‐Cas, now permit to address these fundamental questions of biology also in organisms that have been studied in their natural habitats. We provide an overview of the benefits and drawbacks of these novel techniques and experimental approaches that can now (...) be applied to ecological and evolutionary vertebrate models such as sticklebacks and cichlid fish. We can anticipate that these new methods will increase the understanding of the genetic and epigenetic factors influencing adaptations and phenotypic variation in ecological settings. These new arrows in the methodological quiver of ecologist will drastically increase the understanding of the genetic basis of adaptive traits – leading to a further closing of the genotype–phenotype gap. -/- . Max Weber ist ein Klassiker der Kultur- und Sozialwissenschaften. Sein Werk gehört weltweit zum Kernbestand von Forschung und Lehre, und dies gilt besonders für seine methodologischen Schriften, denen auch 100 Jahre nach ihrer Publikation nachhaltige Aufmerksamkeit beschieden ist. Allerdings gibt es immer noch kein einvernehmliches Verständnis von Webers Position. Der Grund dafür liegt in der mangelnden Aufarbeitung der Quellen. Viele wichtige Autoren, deren Werke Weber rezipierte, sind in Vergessenheit geraten. Sie in Erinnerung zu rufen, ist dringend notwendig, um seine Wissenschaftslehre (...) in ihrer ganzen Komplexität zu verstehen. 0Das vorliegende Sammelwerk leistet einen Beitrag zur Schließung dieser Forschungslücke. Es rekonstruiert den Denkraum des späten 19. und frühen 20. Jahrhunderts, in dem sich Weber bewegte, und zeigt anhand von Studien zu ausgewählten Autoren, wie umfassend und interdisziplinär sein Denken tatsächlich war. Dabei werden nicht nur Autoren aus den Kultur- und Sozialwissenschaften berücksichtigt, sondern auch solche aus den Naturwissenschaften, denn Weber war mit dem Fortschritt dieser Disziplinen ebenfalls vertraut. This article questions some assumptions in legal, moral and political theory regarding the law’s ways of functioning. As the constant revival of the topos ‘living law’ shows, underlying common models of law, and of the legitimacy of law, is, though often implicitly, the view that law is or should be particular, near to the facts, flexible, susceptible to realities, and as a consequence accessible to modernisations. However, this article proposes an immanent critique of similar hopes or fears, and it argues (...) that modern positive law can not be responsive to any other ‘order’ or context because it constitutes an order of its own. The article seeks to give an explanation of the specific character and forms of the juridical operating and to explain more specifically how decisions are produced. The article in this regard also investigates the importance and role of imagination, fiction and performativity. Underlining the fact that the juridical exceeds legal propositions by asserting itself as a distinct form of social communication, it calls for a shift from the representational to the performative analysis in the study of law. Previous research has underlined the significance of practical wisdom pertaining to corporate sustainability. Recent studies, however, have identified managing opposing but interlocked tensions related to environmental, social, and economic aspects as one of the most crucial future challenges in CS. Therefore, we apply the established link between wisdom and sustainability to the pressing topic of managing tensions in CS. We commence with a literature overview of tensions in sustainability management, which manifests our basic work assumption concerning the need for practical (...) wisdom in CS. We then discuss the threefold, mutual interconnectedness between practical wisdom and tension management in CS, which we illustrate in a conceptual model. Thereafter, we develop a set of propositions on how a practical wisdom approach influences CS in practice and how it differs from a business-case approach. In recognition of the conceptual character of our paper, we conclude by outlining potential practical applications and theoretical implications of the model and of the propositions. The ancient virtue of practical wisdom has lately been enjoying a remarkable renaissance in management literature. The purpose of this article is to add clarity and bring synergy to the interdisciplinary debate. In a review of the wide-ranging field of the existing literature from a philosophical, theological, psychological, and managerial perspective, we show that, although different in terms of approach, methodologies, and justification, the distinct traditions of research on practical wisdom can indeed complement one another. We suggest a conciliatory conception (...) of the various features of practical wisdom in management. This we take as a point of departure for a discussion of the significant implications of the subject for the theory and practice of management and for the direction of further research in the field. Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

Nicolai Hartmann hat philosophische Studien zur Erkenntnistheorie, Ontologie, Ethik, Philosophie des Geistes und Naturphilosophie geschrieben. Die Beiträge des Bandes gehen davon aus, dass seine Arbeit auf all diesen Feldern im Zeichen der Verabschiedung der Systemphilosophie sowie der Begründung einer Konzeption systematischen Philosophierens steht. Im Zentrum von Hartmanns Denken steht das "Kategorienproblem", d. i. die Frage nach den elementaren Strukturen der Wirklichkeit und der menschlichen Erkenntnis. In seinem Bezug auf die philosophische Tradition und seiner Hinwendung zu den Natur- und Sozialwissenschaften unter (...) Einbeziehung auch der alltäglichen Erfahrung macht Hartmann deutlich, dass er an dem Anspruch festhält, die Phänomene der Lebenswelt, Wissenschaft und Geschichte in einem einheitlichen "Aufbau der realen Welt" zu integrieren, ohne ihre Heterogenität und Selbständigkeit zu leugnen. Die Beiträge konzentrieren sich daher auf das Konzept einer "Neuen Ontologie", das Programm der "Kategorienforschung", den Wissenschaftsbezug von Hartmanns Denken, dessen Relevanz für die philosophische Anthropologie und die Problematik des geistigen Seins, der Freiheit sowie der Geschichte. Ptolemy I set aside his eldest son Ptolemy Ceraunus and instead made his younger son Ptolemy (by Berenice) his successor. Various explanations have been advanced, but none is compelling. In this article, I put forward two hitherto unexplored avenues: first, Ptolemy’s relations with Eurydice and Berenice, and second, Ceraunus’ own ambitions as they pertained to mastery of Greece and Macedonia. The latter especially led Ptolemy, motivated by his own failures in trying to secure Greece and (...) how they compromised the security of his rule, to view Ceraunus as overly ambitious, and so prefer the less military-minded younger Ptolemy.
