Soweit Engels' Position zum Geltungsanspruch der Naturwissenschaften seiner Zeit aus diesen Texten hervorgeht, kann man sie kaum als konsistent bezeichnen. Meanings are felt and lived by the human organism before they are articulated. Following insights from pragmatism and embodied cognition, this paper suggests that there is an ‘appropriate’ relationship between what is meant and was is expressed in words and actions that can be formulated as a hitherto neglected yet crucial validity claim, namely congruity. Congruity is what connects the meaningfulness implicit in living a life with the articulated meanings of symbolic communication. We distinguish between the intertwined aspects (...) of semiotic congruity, the fusion between sensual patterns and semiotic meanings, performative congruity, the freedom and ability to articulate qualitatively experienced meaningfulness, and hermeneutic congruity, the capability of achieving congruence between situational meanings and one’s entire being-in-the-world. Neodarwinian ethology, today above all represented by sociobiology, is conceived of by responsible exponents as a descriptive and explanatory theory that cannot include any normative declarations. Still other, indeed notable, authors belonging to the discipline in question, either underhand or frankly employ prescriptive or evaluative judgments, — or they claim (what is not an insight of natural science) that it is impossible to provide a rational foundation for prescriptive or evaluative judgments. (Michael Ruse and Edward O. Wilson even assert (...) the latter without relinquishing the former.) — Several functional explanations of normative validity claims advanced by Michael Ruse, Edward O. Wilson, Donald T. Campbell, Florian von Schilcher and Neil Tennant are designed to show that prescriptive or evaluative judgments cannot be justified. The reasonableness of this move is, however, dubious, because it implies strategies of raising oneself into a privileged status or of rendering the position of oneself immune from criticism by shifting it among the objects of the theory. Then Wilson's concept of 'evolutionary ethics' is thoroughly — and critically — analyzed. The suspicion that Wilson's fallacies in the transition from biological facts to moral norms are of exemplary nature is finally examined on the basis of tenets advanced by Herbert Spencer, Wolfgang Wickler, and Hans Mohr. Catchy acronyms such as are good mnemonics. However, they carry the danger of distracting us from deeper issues: how to sample populations, the validity of measuring instruments, the levels of processing involved. These need to be considered when assessing claims of universality regarding how the mind works – a dominant and highly rewarded drive in the behavioral and brain sciences.

Consider the following argument written on the board in room 227: 1 = 1. So, the argument on the board in room 227 is not valid. This argument generates a paradox. The aim of this paper is to present a resolution of this paradox and related paradoxes of validity, including a version of the Curry paradox. The proposal stresses the close connections between these validity paradoxes and paradoxes of truth and paradoxes of denotation. So a more general aim (...) is to provide a unified response to semantic paradox. The positive proposal is in part inspired by a brief, tantalizing suggestion of Gödel’s, that the paradoxes might appear “as something analogous to dividing by zero”—so that the concept of validity, for example, is everywhere applicable except for certain singular points or singularities. A second central claim is that ‘valid’ is a context-sensitive predicate. The key notions of this contextual-singularity theory are presented and applied to a variety of cases. Any purported solution to paradox must deal with the phenomenon of revenge, and a response to revenge is outlined. Injustice theory better serves the oppressed than theories of justice or ideal theory. Humanitarian injustice, political injustice, and legal injustice are distinguished by the rules they violate. Not all who claim political injustice have valid historical grounds, which include past oppression and its legacy. Social class, including culture as well as money, helps explain competing claims of political injustice better than racial identities. Claims of political injustice by the White Mass Recently Politicized (WMRP) are not valid given the history (...) of race relations in the United States. The WMRP’s substitution of white racial identity for class identity may obstruct their opportunities for upward socioeconomic mobility. Their current billionaire leaders are not organic leaders and they stoke racism because it is emotionally useful for getting votes. But too much emphasis on racist history by nonwhites can result in a collective Post Traumatic Stress Disorder (PTSD) that also obstructs progress. The problems of the WMRP may be their own responsibility, in ways still unexplored. (shrink)

With his influence on the development of physiology, physics and geometry, Hermann von Helmholtz – like few scientists of the second half of the 19th century – is representative of the research in natural science in Germany. The development of his understanding of science is not less representative. Until the late sixties, he emphatically claimed the truth of science; later on, he began to see the conditions for the validity of scientific knowledge in relative terms, and this can, in (...) summary, be referred to as hypothesizing. Already in the past century, HeImholtz made first approaches to an understanding of science, which were incompatible with his own former position and which pointed to the modern age to an astonishingly large extent. A comparison with Karl R. Popper's logic of research will illustrate how closely he nevertheless approached modern understanding of science. In Popper's logic of research, hypothesizing of scientific knowledge is definitely much more advanced than in Helmholtz's theory of science. What begins vaguely to emerge with Helmholtz has already become an explicitly formulated programme with Popper. Although HeImholtz and Popper are not on a direct line of epistemological development and Popper refers to HeImholtz only rarely and casually, there are in fact surprising points of contact which have not been taken notice of so far and which appear above all if one looks at Helmholtz's understanding of science against the background of Popper's logic of research. Im ersten Teil verorte ich den historischen Kontext des Umbruchprozesses der Wissenschaft des 19. Jahrhunderts im Hinblick auf die Physik. Vom Beginn der Neuzeit bis weit ins 20. Jahrhundert hinein war die Physik die Leitwissenschaft in den Naturwissenschaften. Der Wandlungsprozess der auf sie bezogenen Wissenschaftsauffassungen setzt im 19. Jahrhundert bislang unangetastete, von der Antike herrührende Geltungsansprüche außer Kraft. Im zweiten Teil vergleiche ich Nietzsches Charakterisierung der Wissenschaften exemplarisch mit der von Hermann von Helmholtz. Helmholtz kann als ein herausragender Vertreter der (...) Naturforschung des 19. Jahrhunderts angesehen werden. Er entwickelte seine erste bahnbrechende wissenschaftliche Leistung noch ganz im Rahmen einer auf Wahrheit und Einheit fokussierten Wissenschaftsauffassung. Im Verlauf seiner weiteren Arbeiten relativierten sich seine Geltungsansprüche zunehmend. In systematischer Hinsicht näherte sich Helmholtz damit nicht nur der Position an, die Nietzsche immer schon eingenommen hat, sondern er übertraf sie sogar in bestimmter Hinsicht. -/- Im dritten Teil setze ich mich kritisch mit einem Aspekt der Rezeption des historischen Verhältnisses von Nietzsche und Helmholtz auseinander. Helmholtz gehörte zu den wenigen repräsentativen Naturwissenschaftlern, von denen man annimmt, dass ihre Forschungen auf das Denken Nietzsches Einfluss hatten. This book offers a radically new account of the development and structure of the central arguments of Kant's Critique of Pure Reason: the defense of the objective validity of such categories as substance, causation, and independent existence. Paul Guyer makes far more extensive use than any other commentator of historical materials from the years leading up to the publication of the Critique and surrounding its revision, and he shows that the work which has come down to us is the (...) result of some striking and only partially resolved theoretical tensions. Kant had originally intended to demonstrate the validity of the categories by exploiting what he called 'analogies of appearance' between the structure of self-knowledge and our knowledge of objects. The idea of a separate 'transcendental deduction', independent from the analysis of the necessary conditions of empirical judgements, arose only shortly before publication of the Critique in 1781, and distorted much of Kant's original inspiration. Part of what led Kant to present this deduction separately was his invention of a new pattern of argument - very different from the 'transcendental arguments' attributed by recent interpreters to Kant - depending on initial claims to necessary truth. This paper deals with the simple paradoxes of validity and with the possibility of solving them in terms of Bradwardinian-Buridanian semantics. The paradoxes of validity as conceived here are cases of semantic pathology, which result due to the use of terms signifying the validity of inference. Semantic paradoxes are a semantico-epistemological phenomenon which is a symptom of the need to revise several apparently acceptable semantic assumptions. The analysis of possible solutions to the paradoxes focuses on Bradwardinian-Buridanian semantics (...) and as a result on the closed, token-based semantic theories that assume the existence of an implicit meaning of propositions. The key theses, as far as the solution to the paradoxes is concerned, are the principle of truth-implication which claims that every proposition expresses or implies its own truth and the closure principle which claims that every proposition asserts or expresses everything that follows from it logically. The present paper advances on recent research in claiming that (with certain reservations) the application of these principles can effectively solve inconsistency-paradoxes but not indeterminacy-paradoxes of validity. The problem analysed in this paper is whether we can gain knowledge by using valid inferences, and how we can explain this process from a model-theoretic perspective. According to the paradox of inference (Cohen & Nagel 1936/1998, 173), it is logically impossible for an inference to be both valid and its conclusion to possess novelty with respect to the premises. I argue in this paper that valid inference has an epistemic significance, i.e., it can be used by an agent to (...) enlarge his knowledge, and this significance can be accounted in model-theoretic terms. I will argue first that the paradox is based on an equivocation, namely, it arises because logical containment, i.e., logical implication, is identified with epistemological containment, i.e., the knowledge of the premises entails the knowledge of the conclusion. Second, I will argue that a truth-conditional theory of meaning has the necessary resources to explain the epistemic significance of valid inferences. I will explain this epistemic significance starting from Carnap’s semantic theory of meaning and Tarski’s notion of satisfaction. In this way I will counter (Prawitz 2012b)’s claim that a truth-conditional theory of meaning is not able to account the legitimacy of valid inferences, i.e., their epistemic significance. (shrink)

As AI systems become increasingly complex it may become unclear, even to the designer of a system, why exactly a system does what it does. This leads to a lack of trust in AI systems. To solve this, the field of explainable AI has been working on ways to produce explanations of these systems’ behaviors. Many methods in explainable AI, such as LIME, offer only a statistical argument for the validity of their explanations. However, some methods instead study the (...) internal structure of the system and try to find components which can be assigned an interpretation. I believe that these methods provide more valuable explanations than those statistical in nature. I will try to identify which explanations can be considered internal to the system using the Chomskyan notion of tacit knowledge. I argue that each explanation expresses a rule, and through the localization of this rule in the system internals, we can take a system to have tacit knowledge of the rule. I conclude that the only methods which are able to sufficiently establish this tacit knowledge are those along the lines of Olah : 4901–4911, 2017), and therefore they provide explanations with unique strengths. For several years now, Paul Guyer has been publishing articles on what he sees as numerous different strategies pursued by Kant in his attempt to deduce the objective validity of pure categories. In this very long, (...) extremely detailed book, he has brought together the results of much of that work, added to it extensively, and defended at length a comprehensive and highly controversial view of the Deduction. The book has five major parts: on Kant's early views, on the deduction from 178187, on the "principles of empirical knowledge" (most of which is devoted to an elaborate reconstruction of the Analogies argument), on the Refutation of Idealism, and on transcendential idealism in general. More broadly Guyer's central thesis has two parts. In the first he tries to show that the more well-known versions of the Deduction are disappointing failures. According to Guyer, Kant variously tried to deduce the objective validity of pure concepts from the assumption that we do possess a priori knowledge of objects, from the assumption of empirical knowledge of objects, for which a priori conditions must be found, from a claim about a priori knowledge of unity of the self, and from the a priori conditions of empirical self-knowledge. The first three attempts are said to fail, all for somewhat different reasons, but all in a way linked to an implausible (and, to a skeptic, question-begging) premise about "necessary connection" in experience. Moreover, given this premise, these strategies all involve a commitment to very strong views about experience (e.g., it is necessary that any possible manifold of experience be subject to the categories) and to an accompanying claim about the mindimposed unity of experience, considered by many the "dark side" of Kant's enterprise. It is the last strategy that for Guyer represents the most philosophically interesting tactic and that constitutes the second major claim he makes. In this version, Kant is trying to show that "time determination," whether of objects represented in consciousness, or of representations themselves, empirically apperceived, can be shown to presuppose the objective validity of, at least, the Analogies. Guyer claims that this last strategy, while it represents the "original" idea of a Deduction entertained by Kant in the first half of the Silent Decade, only emerges in the Cr/t/que in the Analogies and Refutation of Idealism, and is only fully explored by Kant after the Critique's publication. It involves only a "conditional" argument for the categories ("if there is to be experience there must be objectively valid categories"); the categories are thus valid for whatever in a manifold can be an object of a cognitive claim, and are not "necessarily" imposed on a manifold per se. Guyer's attack on what he regards as the standard reading of the Deduction is far too detailed to address point by point. I can merely note three difficulties with his approach. First, he attributes to Kant a premise that goes far beyond the "standard" beginning contrast between the "arbitrary representations of states of the self as such" and the "rule-governed representation of an object." According to Guyer, all commentators (somewhat surprisingly) have failed to see the following: that when Kant makes this contrast, and appeals to the object as "that in the concept of which the manifold of a given intuition is united" (B x37), he really means that the "object" is that in virtue of BOOK REVIEWS 139 which the representations of a manifold are necessarilyunited 0og). This attributes to Kant the very strange view that empirical judgments are necessary truths of some sort, and even though Kant often explicitly denies this (even once in the course of the Deduction, at B142, cited but dismissed by Guyer), Guyer claims that only by such a claim can Kant hope to deduce the objective validity of pure categories. By lopsided majorities, the U.S. Supreme Court, in a series of cases, persistently commanded the lower courts to condition the admission of proffered expert testimony on the demonstrated validity of the proponents’ claims of expertise. In at least one broad area – the so-called forensic sciences – the courts below have largely evaded the Supreme Court's holdings. This paper aims to try to explain this massive defiance by the lower courts in terms of social epistemology.

Even though the concept of a 'validity claim' is central to Habermas's theory of communicative action, he has never given a precise definition of the term. He has stated only that truth is a type of validity claim, and that rightness and sincerity are analogous to truth. This paper explores the basis of this analogy, arguing that rightness and sincerity must share at least two characteristics with the truth predicate: each must be the designated value in (...) an appropriate system of logic, and each must serve as the 'central notion' in a theory of meaning for some corresponding class of speech acts. It is these two characteristics that establish the internal connec tion between understanding and justification that Habermas's more general project requires. However, there is an unnoticed tension between these two characteristics, since the relative autonomy of linguistic meaning from specific contexts of use appears to require that speech acts be governed by a uniform logic, and thus by a single validity claim. Sāṃkhya, in its commentary Yuktidīpikā, responds to the Buddhist claim that a means of valid cognition (pramāṇa) and a valid cognition (pramā), its result (phala), are identical. The response of Sāṃkhya was pioneering: it is one of the two earliest responses to the Buddhists in the lively polemic on the relationship between a pramāṇa and its result. (The other of these two earliest responses is in the Ślokavārttika by Kumārila Bhaṭṭa.) Sāṃkhya’s voice in this polemic is earlier than that (...) of Nyāya, which is, as well as Mīmāṃsā, the main rival of the Buddhists in addressing this issue. This study provides a translation and detailed reconstruction of the Yuktidīpikā’s polemic with the Buddhist opponent, which has not been researched before, as well as a critical assessment of the Sāṃkhya position. The Yuktidīpikā polemicizes against Dignāga. It aptly questions the standpoint of the Buddhist opponent and presents an alternative standpoint, contrasting its own view with that of the opponent. Though the Sāṃkhya position formulated in the Yuktidīpikā evokes several critical remarks, the Yuktidīpikā’s response is an important contribution to Indian thought. (shrink)

In this paper, the author shows how one can independently prove, within the theory of abstract objects, some of the most significant claims, hypotheses, and background assumptions found in Kripke's logical and philosophical work. Moreover, many of the semantic features of theory of abstract objects are consistent with Kripke's views — the successful representation, in the system, of the truth conditions and entailments of philosophically puzzling sentences of natural language validates certain Kripkean semantic claims about natural language.

My primary aim in this paper is to outline a quasi-realist theory of aesthetic judgement. Robert Hopkins has recently argued against the plausibility of this project because he claims that quasi-realism cannot explain a central component of any expressivist understanding of aesthetic judgements, namely their supposed ‘autonomy’. I argue against Hopkins’s claims by contending that Roger Scruton’s aesthetic attitude theory, centred on his account of the imagination, provides us with the means to develop a plausible quasi-realist account of aesthetic judgement. Indem er sich in seiner Kritik an den ontologischen Annahmen des Mechanismus auf die Wissenschaftsgeschichte beruft, steht er einer heutigen realismuskritischen Argumentation nahe. Andererseits mißt er den hypothesenfreien Theoriebestandteilen einen Geltungscharakter zu, der in seinem Wahrheitsanspruch durchaus mit einer heutigen realistischen Behauptung (...) theorieübergreifender Bestände der wissenschaftlichen Erkenntnis vergleichbar ist. This article attempts to present a typology for evaluating religious truth claims in light of epistemological and metaphysical categories.Beginning with a distinction between “strong” and “weak” epistemological and metaphysical categories, it argues that a strong metaphysical set of beliefs need not be rooted in strong epistemological claims in order to be valid. Rather, it is possible to ground a “strong” set of metaphysical assertions within a “weak” epistemological framework, which, within its own framework, may be viewed to be presumptively true. (...) Such a position, the article concludes, has the potential to provide a valid grounding for religious beliefs while allowing room for discourse across belief systems in a pluralistic society. At the heart of Jürgen Habermas's explication of communicative rationality is the contention that all speech acts oriented to understanding raise three different kinds of validity claims simultaneously: claims to truth, truthfulness, and normative rightness. This paper argues that Habermas presents exactly three distinct, logically independent arguments for his simultaneity thesis: an argument from structure; an argument from criticizability/rejectability; and an argument from understanding/reaching understanding. It is further maintained that the simultaneity thesis receives cogent support only from the Argument (...) from understanding/reaching understanding, and only if the notion of 'understanding' is expanded to that of 'agreement'. Havstad (2022) argues that the argument from inductive risk for the claim that non-epistemic values have a legitimate role to play in the internal stages of science is deductively valid. She also defends its premises and thus soundness. This is, as far as we are aware, the best reconstruction of the argument from inductive risk in the existing literature. However, there is a small flaw in this reconstruction of the argument from inductive risk which appears to render the argument (...) invalid. This flaw is superficial, and a small amendment to it rescues the claim of validity. (shrink)

What is a valid measuring instrument? Recent philosophy has attended to logic of justification of measures, such as construct validation, but not to the question of what it means for an instrument to be a valid measure of a construct. A prominent approach grounds validity in the existence of a causal link between the attribute and its detectable manifestations. Some of its proponents claim that, therefore, validity does not depend on pragmatics and research context. In this paper, (...) I cast doubt on the possibility of a context-independent causal account of validity (what I call unconditional validity). I assess several versions, arguing that all of them fail to judge the validity of measuring instruments correctly. Because different research purposes require different properties from measuring instruments, no account of validity succeeds without referring to the specific research purpose that creates the need for measurement in the first place. Subliminal perception occurs when prime stimuli that participants claim not to be aware of nevertheless influence subsequent processing of a target. This claim, however, critically depends on correct methods to assess prime awareness. Typically, d9 (‘‘d prime’’) tasks administered after a priming task are used to establish that people are unable to discriminate between different primes. Here, we show that such d9 tasks are influenced by the nature of the target, by attentional factors, and by the delay between (...) stimulus presentation and response. Our results suggest that the standard d9 task is not a straightforward measure of prime visibility. We discuss the implications of our findings for subliminal perception research. (shrink)

The interplay of philosophical ambitions and technical reality have given birth to rich and interesting approaches to explain the oft-claimed special character of mathematical and logical knowledge. Two projects stand out both for their audacity and their innovativeness. These are logicism and proof-theoretic semantics. This dissertation contains three chapters exploring the limits of these two projects. In both cases I find the formal results offer a mixed blessing to the philosophical projects. Chapter 1. Is a logicist bound to the (...) class='Hi'>claim that as a matter of analytic truth there is an actual infinity of objects? If Hume’s Principle is analytic then in the standard setting the answer appears to be yes. Hodes’s work pointed to a way out by offering a modal picture in which only a potential infinity was posited. However, this project was abandoned due to apparent failures of cross-world predication. I re-explore this idea and discover that in the setting of the potential infinite one can interpret first-order Peano arithmetic, but not second-order Peano arithmetic. I conclude that in order for the logicist to weaken the metaphysically loaded claim of necessary actual infinities, they must also weaken the mathematics they recover. Chapter 2. There have been several recent results bringing into focus the super-intuitionistic nature of most notions of proof-theoretic validity. But there has been very little work evaluating the consequences of these results. In this chapter, I explore the question of whether these results undermine the claim that proof-theoretic validity shows us which inferences follow from the meaning of the connectives when defined by their introduction rules. It is argued that the super-intuitionistic inferences are valid due to the correspondence between the treatment of the atomic formulas and more complex formulas. And so the goals of proof-theoretic validity are not undermined. Chapter 3. Prawitz (1971) conjectured that proof-theoretic validity offers a semantics for intuitionistic logic. This conjecture has recently been proven false by Piecha and Schroeder-Heister (2019). This chapter resolves one of the questions left open by this recent result by showing the extensional alignment of proof-theoretic validity and general inquisitive logic. General inquisitive logic is a generalisation of inquisitive semantics, a uniform semantics for questions and assertions. The chapter further defines a notion of quasi-proof-theoretic validity by restricting proof-theoretic validity to allow double negation elimination for atomic formulas and proves the extensional alignment of quasi-proof-theoretic validity and inquisitive logic.Abstract prepared by Will Stafford extracted partially from the dissertation. TanakaAs the title of my paper indicates, two features of my identity have become more vivid as the result of my participation in the International Buddhist-Christian Theological Encounter (IBCTE) sessions. The first of the two stemmed from my rude awakening that not everyone involved with our (...) sessions accepted the assumption that the other was a similarly valid soteriological path.In one of our sessions a few years back, the discussion moved to a topic of the nature of "ultimate path," which, as it turned out, began to raise some extremely sensitive issues. An unusually tense atmosphere hung over the discussion table, a rare turn of events for our usually jovial dialogue group composed mostly of liberal-minded members. One of the Christian members gave voice to her fundamental view that Jesus was the sole path through which one can be saved. It was clearly what anyone would regard as an exclusivist position. In asking for further clarification, she reiterated her view that her Christian faith necessitated that she took that position, and that I as a Buddhist was, therefore, not included in that soteriological scheme. I responded to her that I understood that I would not be in her scheme since I was not Christian, but would I nevertheless be saved? After some hesitation, in so many words, she replied that I would not be! Had she been a member of a more conservative group, it would have been easier to accept that kind of a response, but coming from an academic with liberal leanings, her comments caught me off guard. But on the other hand, I appreciated her honesty in being true to her understanding of the tradition, for it seemed to me that it was not an easy thing for her to say.This short encounter has been etched firmly in my mind and, ironically, remains for me the most memorable moment among all of the IBCTE sessions attended. I did not pursue the matter further at that time (aside from the fact that time had run [End Page 41] out for that particular session), since I was aware that such an exclusive position (as distinguished from those of inclusivism and pluralism) was common among Christians. I just happened to have encountered it in a rather unexpected circumstance and was not prepared with a comeback.This encounter forced me to inquire about my own position concerning the salvation of people other than Buddhists. Would I regard her as not being saved? After some probing and reflection on my part, I can say with little hesitation that I would never be able to say, "no, you are not." I have no basis on which to refute what her time-tested tradition promises. I am not in a position to negate the claims of her tradition or to question the sincerity of her commitment. From my Buddhist perspective there is no universal criterion on which to make judgments about others. The Oxford Calculator Roger Swyneshed put forward three provocative claims in his treatise on insolubles, written in the early 1330s, of which the second states that there is a formally valid inference with true premises and false conclusion. His example deployed the Liar paradox as the conclusion of the inference: ‘The conclusion of this inference is false, so this conclusion is false’. His account of insolubles supported his claim that the conclusion is false, and so the premise, referring to (...) the conclusion, would seem to be true. But what is his account of validity that can allow true premises to lead to a false conclusion? This article considers Roger’s own account, as well as that of Paul of Venice, writing some sixty years later, whose account of the truth and falsehood of insolubles followed Roger’s closely. Paul endorsed Roger’s three claims. But their accounts of validity were different. The question is whether these accounts are coherent and support Paul’s claim in his Logica Magna that he endorsed all the normal rules of inference. (shrink)

Modularity is a key concept in building and evaluating complex simulation models. My main claim is that in simulation modeling modularity degenerates for systematic methodological reasons. Consequently, it is hard, if not impossible, to accessing how representational structure and dynamical properties of a model are related. The resulting problem for validating models is one of holism. The argument will proceed by analyzing the techniques of parameterization, tuning, and kludging. They are – to a certain extent – inevitable when building (...) complex simulation models, but corrode modularity. As a result, the common account of validating simulations faces a major problem and testing the dynamical behavior of simulation models becomes all the more important. Finally, I will ask in what circumstances this might be sufficient for model validation. (shrink)

Colleges of business rankings purport to address relative performance on programs such as sustainability. The primary criticism of rankings is that providers have not established reliability or validity of the ranking. This study examines whether The Global 100 sustainability ranking is sufficiently unique to claim that it is based on attributes not used for non-sustainability ranking (divergent validity) and whether it is appropriately related to independent characteristics expected to measure this attribute (convergent validity).

In this essay, I argue for a view that inclusive positivists share with Ronald Dworkin. According to the Moral Incorporation Thesis (MIT), it is logically possible for a legal system to incorporate moral criteria of legality (or “grounds of law,” as Dworkin puts it). Up to this point, the debate has taken the shape of attacks on the coherence of MIT with the defender of MIT merely attempting to refute the attacking argument. I give a positive argument for MIT. I (...) begin with an explanation of the logic of establishing possibility claims, such as MIT. At the outset, it is worth noting that the logic of establishing possibility claims is very different from the logic of establishing contingent descriptive claims or necessary claims. For this reason, some explication of the relevant features of the semantics of modal logic will be necessary here. Once the structural framework is adequately developed, the argument for MIT will be grounded on the strength of a thought experiment of a surprisingly simple kind. Indeed, the argument is inspired by a Razian argument for the possibility of a legal system without coercive enforcement machinery; on his view, a society of angels could still have a system of law without any coercive machinery. My argument will possess two theoretically important qualities that are also possessed by Raz’s powerfully simple, but ultimately unsuccessful, argument. (shrink)

This work presents two theoretical challenges to Conceptual Metaphor Theory (CMT). The first argument shows CMT’s foundational _Conceptual Claim—_that abstract concepts are necessarily structured by concrete concepts—entails the blurring of the literal–figurative distinction, which calls into question the legitimacy of standard methods of metaphor identification used in CMT. The second argument aims at the _Linguistic Claim—_that conceptual metaphors are necessary for metaphorical language—by showing that conceptual metaphors are neither necessary nor sufficient for linguistic metaphors and that, therefore, the (...) existence of conceptual metaphors cannot be validly inferred from the presence of their linguistic counterparts. In light of the arguments put forward, the CMT theorist is forced to accept one of four options: (A) hold on to both the Conceptual Claim and Linguistic Claim, by adequately addressing problems presented here, (B) discard the Conceptual Claim and give up the theory, (C) discard both claims and give up the theory, or (D) accept the Conceptual Claim but reject the Linguistic Claim and abandon the methods of discovering conceptual metaphors through analysis of figurative language. In this paper, I claim that two ways of defining validity for modal languages (“real-world” and “general” validity), corresponding to distinction between a correct and an incorrect way of defining modal valid- ity, correspond instead to two substantive ways of conceiving modal truth. At the same time, I claim that the major logical manifestation of the real- world/general validity distinction in modal propositional languages with the actuality operator should not be taken seriously, but simply as (...) a by-product of the way in which the semantics of such an operator is usually given. This paper argues that judges assessing the scientific validity and the legal admissibility of forensic science techniques ought to privilege testing over explanation. Their evaluation of reliability should be more concerned with whether the technique has been adequately validated by appropriate empirical testing than with whether the expert can offer an adequate description of the methods she uses, or satisfactorily explain her methodology or the theory from which her claims derive. This paper explores these issues within two specific contexts: (...) latent fingerprint examination and the use of breath tests for the detection of alcohol. Especially in the forensic science arena, I suggest courts have often been seduced by superficially plausible explanations and descriptions of a technique or method, and permitted these to serve as a substitute for empirical testing. Thinking through these two examples illustrates both why evaluating the extent of testing should be the most important method by which courts assess reliability, and why, when other forms of explanatory evidence are readily available, we may nonetheless elect to make use of them. This paper suggests that these descriptions and explanations may at times usefully supplement evidence of testing, but should not generally be substituted for it. Finally, this paper embraces a kind of evidentiary pragmatism, in which the quantum of evidence required to establish legal reliability is determined not in the abstract, but in relation to the evidence that is, or ought to be, available as a result of reasonable research and investigation. Until quite recently, the epistemology of logical laws has not been much discussed and neither has how one can be justified in claiming that a particular inference is valid. The transfer of warrant from premises to conclusion in modus ponens will be examined in the paper through assessing Paul Boghossian's inferentialist proposal of assuming 'blind reasoning'. It will be argued that merely being justified in inferring according to a logical law a priori is worthless unless one can also be justified (...) in claiming that the inference is valid. An alternative to Boghossian's solution will be presented which addresses this need as well as the needs Boghossian had identified previously. (shrink)

Richard Rorty challenges Jurgen Habermas's belief that validity-claims raised within context-bound discussions contain a moment of universality validity. Rorty argues that immersion within contingent languages prohibits any neutral, context-independent ground, that one cannot predict the defense of one's assertions before any audience, and that philosophy can no more escape its contextual limitations than strategic counterparts. Alfred Schutz's phenomenological account of motivation, the reciprocity of perspectives, and the theoretical province of meaning can articulate Habermas's intuitions.Since any claim can (...) be analyzed from an observer's perspective for its because-motives, it can always be shown to be context-related; but to the participant involved in the in-order-to project of establishing a claim's validity, the claim appears objectively valid until counter-evidence surfaces. Rorty, even when explaining what it is to make a truth claim, resorts to the observer perspective and omits reference to the in-order-to perspective, within which alone unconditional validity becomes visible. Furthermore, the expectation that one's claim is universally valid depends not on an empirical prediction that one''s claim can survive hypothesized future possible audiences. Rather, because of the reciprocity of perspectives, making possible communication and a common life, theoreticians assume that others will recognize what they take to be objective or valid, independently of diverse biographical circumstances. Finally, within the theoretical province requiring relevances different from those of everyday life, philosophy articulates claims with a greater potential to arrive at universal validity than projects that aim less universally, in spite of the fact that its theoretical context is always susceptible to because motive analysis. Because of the misspecification of models and specificity of operationalizations, many studies produce claims of limited utility. We suggest a path forward that requires taking a few steps back. Researchers can retool large-scale replications to conduct the descriptive research which assesses the generalizability of constructs. Large-scale construct validation is feasible and a necessary next step in addressing the generalizability crisis.

The notion of validity for modal languages could be defined in two slightly different ways. The first is the original definition given by S. Kripke, for which a formula φ of a modal language L is valid if and only if it is true in every actual world of every interpretation of L. The second is the definition that has become standard in most textbook presentations of modal logic, for which a formula φ of L is valid if and (...) only if it is true in every world in every interpretation of L. For simple modal languages, “Kripkean validity” and “Textbook validity” are extensionally equivalent. According to E. Zalta, however, Textbook validity is an “incorrect” definition of validity, because: (i) it is not in full compliance with Tarski’s notion of truth; (ii) in expressively richer languages, enriched by the actuality operator, some obviously true formulas count as valid only if the Kripkean notion is used. The purpose of this paper is to show that (i) and (ii) are not good reasons to favor Kripkean valid- ity over Textbook validity. On the one hand, I will claim that the difference between the two should rather be seen as the result of two different conceptions on how a modal logic should be built from a non-modal basis; on the other, I will show the advantages, for the question at issue, of seeing the actuality operator as belonging to the family of two-dimensional operators. Over fifteen years after first reporting to the State of New York, the Harvard Medical Practice Study continues to have a significant impact in medical malpractice policy debates. In those debates the HMPS has come to stand for four main propositions. First, “medical injury… accounts for more deaths than all other kinds of accidents combined” and “more than a quarter of those were caused by substandard care.” Second, the vast majority of people who are injured as result of substandard care (...) do not file a claim. Third, “a substantial majority of malpractice claims filed are not based on provider carelessness or even iatrogenic injury.” Fourth, “whether negligence or a medical injury had occurred… bore little relation to the outcome of the claims.”Medical malpractice researchers have long known that the HMPS provides far stronger support for the first two of these propositions than for the last two; the HMPS was not designed or powered to reach strong conclusions about the validity of medical malpractice claims. To what use can causal claims established in good studies be put? We give examples of studies from which inaccurate inferences were made about target policy situations. The usual diagnosis is that the studies in question lack external validity, which means that the same results do not hold in the target as in study. That’s a label that just repeats what we already knew. We offer a deeper analysis. Our analysis points to the need for interdisciplinarity and to the (...) demand to focus not on the study – as the expression ‘external validity’ invites you to do – but on the target. The call for interdisciplinary approaches to real life problems is common since it is widely acknowledged that what happens in the real world seldom falls under the auspices of any single research domain. Our focus is on one specific real life problem: how to use causal claims from good studies to help predict whether the policies tested will work in a new situation. Our analysis of what it takes to back up these predictions points up very specific stages in the process of prediction where we are bound to get it wrong if we do not diversify our concepts, our knowledge and our methods. We isolate two reasons inferences from study to target fail. First, policy variables do not produce results on their own; they need helping factors. The distribution of helping factors is likely to be unique or local for each study, so one cannot expect external validity to be all that common. Second, researchers often give too concrete a description of the cause in the study for it to carry over to the target.ion is necessary to get causes that travel. There is no sure-fire way to guard against these problems. But the unavailability of one perfect tool does not imply there are no second best contrivances. Two general pointers for Good Practice in policy advice follow from our diagnosis: focus on the concrete details in the target and use cross discipline heuristics that diversify background knowledge. In recent years, the healthcare field welcomed an emerging field of practices captured under the umbrella term ‘Big Data’. This term is surrounded with positive rhetoric and promises about the ability to analyse real-world data quickly and comprehensively. Such rhetoric is highly consequential in shaping debates on Big Data. While the fields of Science and Technology Studies and Critical Data Studies have been instrumental in elaborating the neglected and problematic dimensions of Big Data, it remains an open question how and (...) to what extent such insights become embedded in other fields. In this paper, we analyse the epistemological claims that accompany Big Data in the healthcare domain. We systematically searched scientific literature and selected 206 editorials as these reflect on developments in the domain. Through an interpretive analysis, we construct five ideal-typical discourses that all frame Big Data in specific ways. Three of the discourses frame Big Data in positive terms and disseminate a compelling rhetoric. Metaphors of ‘capturing’, ‘illuminating’ and ‘harnessing’ data presume that Big Data are benign and leading to valid knowledge. The scientist and critical-interpretive discourses question the objectivity and effectivity claims of Big Data. Metaphors of ‘selecting’ and ‘constructing’ data illustrate another political message, framing Big Data as limited. We conclude that work in the critical-interpretive discourse has not broadly infiltrated the medical domain. Ways to better integrate aspects of the discourse in the healthcare domain are urgently needed. (shrink)

Der Beitrag zeigt Ordnungsstrukturen in der Pluralität der Verwendungsweisen auf und begründet den aktuellen Geltungsanspruch traditioneller Begriffe im Bezug auf spezifische Erfahrungsweisen. Nach einer Einführung beginne ich (...) mit der Unterscheidung von wissenschaftlicher und nichtwissenschaftlicher Naturerfahrung, beziehe auf diese Differenz die Aufgaben der Naturphilosophie und gehe dann mit einer Klassifikation von Naturbegriffen zum exemplarischen Teil über. In diesem diskutiere ich am Beispiel bestimmter Aspekte der Naturbegriffe von Aristoteles und Descartes ihre für die Gegenwart typischen Bedingungen der Verwendung in nichtwissenschaftlicher Erfahrung sowie darüber hinaus vorkommender Verwendungen. All aesthetic judgements, whether descriptive, evaluative or some combination of the two, and whatever they might be about, whether works of art, artefacts of other kinds, or natural things, declare themselves to be, not mere announcements or expressions of personal responses to the objects of judgement, but claims meriting the agreement of others. Despite the frequent appeal in everyday life to the nihilistic interpretation of the saying ‘It's all a matter of taste’, the doctrine of aesthetic nihilism—the view that such (...) claims are never warranted—does not merit serious attention. What is needed is an articulation of the various kinds of content of aesthetic judgements, one that will reveal what their claim to intersubjective validity amounts to and enable an assessment of what the proper limits of the claim might be. This clarification is what I attempt to provide. After some introductory definitions and classifications, the principal focus of the first part of the paper is descriptive aesthetic judgements, and one issue that figures large is the proper understanding of those judgements of this kind which are expressed in sentences that are intended to be understood metaphorically. A short bridge passage identifies an aesthetic judgement whose content is indicative of the content of evaluative aesthetic judgements of all kinds, and in particular evaluative aesthetic judgements about works of art, which the second part of the paper focuses on. Real illumination of these requires an identification of the aim of art (as such): I offer an account of this aim, which I defend against certain objections that it is liable to attract, and I use it to throw light not just on singular but also on comparative judgements of artistic value. I conclude with some remarks about purely aesthetic value and specifically artistic value and about similarities and differences between evaluative aesthetic judgements of works of art and evaluative aesthetic judgements of works of nature.
