Objectives To determine the frequencies and types of limitation of medical treatment performed by physician members of the German Society for Palliative Medicine and to analyse the findings with respect to clinical and ethical aspects of end-of-life practices. Design Cross-sectional postal survey. Setting Data collection via the secretary of the German Society for Palliative Medicine using the German language version of the EURELD survey instrument. Subjects All 1645 physician members of the German Society for Palliative Medicine. Main outcome measures Types (...) and frequencies of limitation of treatment and possible determinants. Results 901 physicians participated in the study (response rate 55.8%). Participants reported limitation of treatment in 69.1% of cases. These decisions most often affected artificial nutrition (19%), chemotherapy (14%), antibiotics (11%) and medication other than antibiotics (11%). In the majority of eligible cases, physicians estimated the life-shortening effect of limitation of treatment to be <7 days. However, estimations differ depending on the medical measures in question. Bivariate statistical analysis indicated that withholding of treatment was performed significantly more frequently for patients aged ≥65 years (p=0.019). In addition, there were significant associations between the incidence of limitation of treatment and the different diseases reported by respondents as the underlying cause of death. Conclusion The findings of this study provide information on the current state of an ethically and clinically challenging aspect of clinical practice and can serve as a starting point for further interdisciplinary research on normative and empirical aspects of treatment decision-making at the end of life. Wilson et al. focus on one class of AGL tasks: the cognitively demanding task of detecting non‐adjacent dependencies (NADs) among items. They provide a typology of the different types of NADs in natural languages and in AGL tasks. A range of cues affect NAD learning, ranging from the variability and number of intervening elements to the presence of shared prosodic cues between the dependent items. Having functional expected emotions regarding one’s future life as a teacher is important for student teachers to maintain their motivation to choose a career as a teacher. However, humans show several biases when judging their emotional experiences. One famous bias is the so-called peak-end effect which describes the phenomenon that overall affective judgments do not reflect the average of the involved emotional experiences but the most intense and the most recent of the involved emotional experiences. Regarding student teachers’ expected positive (...) emotions, such a bias would be functional since their motivation to become a teacher is enhanced. However, regarding student teachers’ expected negative emotions, such a bias would be dysfunctional since their motivation to become a teacher would be decreased. The aim of the present preregistered study was to examine whether student teachers’ expected future teaching-related emotions show a peak-end effect. Student teachers viewed 14 common events that could part of a typical everyday routine of a teacher and rated their expected emotional pleasure and discomfort for each of the events. Afterward, they were asked to rate their overall expected emotional pleasure and discomfort when looking at their future professional life as a whole. Results showed that expected pleasure was much larger than expected discomfort regarding both overall, peak, and average ratings. No peak-end effect was observed for overall expected discomfort which reflected the average expected discomfort across events. By contrast, overall expected pleasure was biased toward expected peak pleasure experiences. These findings indicate that student teachers judge their expected overall affect in a functional way: realistically when dealing with negative emotions but through rose-colored glasses when dealing with positive emotions. Previous findings indicate that the goals of teachers and their experienced emotions when interacting with students play an important role for their well-being. However, studies on the psychological impact of events have shown that the impact of bad events is stronger than the impact of good events. Thus, it may be that teachers’ goals and emotions for students showing undesirable behaviors contribute more to their well-being than teachers’ goals and emotions for students showing desirable behaviors, a distinction that has not (...) been made in previous research. To examine this question, we measured teachers’ goals and emotions for students showing desirable and undesirable behaviors, and their affective, evaluative, occupational, and psychological well-being. The results showed that teachers’ well-being was relatively strongly related to their goals and emotions for students showing undesirable behaviors: The higher the goals and the more positive the emotions, the higher the reported well-being. By contrast, the goals and emotions for students showing desirable behaviors were unrelated to teachers’ well-being. These results demonstrate that the principle of “bad is stronger than good” holds also for the influence of teachers’ goals and emotions on their well-being. (shrink)

I will argue for a novel variant of the knowledge norm for practical reasoning. In Sect. 2, I will look at current variations of a knowledge norm for practical reasoning and I will provide reasons to doubt these proposals. In Sects. 3 and 4, I develop my own proposal according to which knowledge is the norm of apt practical reasoning. Section 5 considers objections. Finally, Sect. 6 concerns the normativity of my proposed knowledge norm and its significance.

This essay presents a novel approach to specifying the meaning of the concept of populism, on the political position it occupies and on the nature of populism. Employing analytic techniques of concept clarification and recent analytic ideology critique, it develops populism as a political kind in three steps. First, it descriptively specifies the stereotype of populist platforms as identified in extant research and thereby delimits the peculiar political position populism occupies in representative democracies as neither inclusionary nor fascist. Second, it (...) specifies on this basis analytically–normatively the particular stance towards liberal representative democracy (in particular towards popular sovereignty and democratic legitimacy) that unifies populism’s political position and explains how populist politics can be compelling for democratic citizens. The normative core (populist ideology) turns out to require no more than two general principles of legitimizing political authority by elections. Surprisingly, it does not need a separate anti-pluralist or exclusionary commitment: it entails it. Third, this normative model allows a response to a contested question in the theoretical discussion, namely, whether populism (properly specified) can be democracy-enhancing. The article defends the negative answer in virtue of the normative core alone and does so as much vis-à-vis a minimal (purely electoral) as vis-à-vis a normatively ambitious (liberal) conception of democracy. The reconstruction of the normative core of populist ideology enables a novel argument to show that populism is incompatible with the continued democratic legitimation of political authority even in the normatively most austere conception of ‘electoral democracy’, not just with ‘liberal democracy’. Assuming a normatively more ambitious concept of democratic legitimation in terms of political autonomy, the model also produces an extremely direct argument showing that populists cannot fulfil their promise of ‘taking back control’ over political decision-making to the population. The ability to process center‐embedded structures has been claimed to represent a core function of the language faculty. Recently, several studies have investigated the learning of center‐embedded dependencies in artificial grammar settings. Yet some of the results seem to question the learnability of these structures in artificial grammar tasks. Here, we tested under which exposure conditions learning of center‐embedded structures in an artificial grammar is possible. We used naturally spoken syllable sequences and varied the presence of prosodic cues. The results (...) suggest that mere distributional information does not suffice for successful learning. Prosodic cues marking the boundaries of the major relevant units, however, can lead to learning success. Thus, our data are consistent with the hypothesis that center‐embedded syntactic structures can be learned in artificial grammar tasks if language‐like acoustic cues are provided. (shrink)

The past 20 years have seen dramatic rises in suicide rates in the United States and other countries around the world. These trends have been identified as a public health crisis in urgent need of new solutions and have spurred significant research efforts to improve our understanding of suicide and strategies to prevent it. Unfortunately, despite making significant contributions to the founding of suicidology – through Emile Durkheim’s classic Suicide (1897/1951) – sociology’s role has been less prominent in contemporary efforts (...) to address these tragic trends, though as we will show, sociological theories offer great promise for advancing our understanding of suicide and improving the efficacy of suicide prevention. Here, we review sociological theory and empirical research on suicide. We begin where all sociologists must: with Durkheim. However, we offer a more comprehensive understanding of Durkheim’s insights into suicide than the prior reviews provided by those in other disciplines. In so doing, we reveal the nuance and richness of Durkheim’s insights that have been largely lost in modern suicidology, despite being foundational to all sociological theories of suicide – even those that have moved beyond his model. We proceed to discuss broadly acknowledged limitations to Durkheim’s theory of suicide and review how more recent theoretical efforts have not only addressed those concerns, but have done so by bringing a larger swatch of sociology’s theoretical and empirical toolkit to bare on suicide. Specifically, we review how recent sociological theories of suicide have incorporated insights from social network theories, cultural sociology, sociology of emotions, and sociological social psychology to better theorize how the external social world matters to individual psychological pain and suffering. We conclude by making explicit bridges between sociological and psychological theories of suicide; by noting important limitations in knowledge about suicide – particularly regarding the roles of organizations, inequality, and intersectionality in suicide – that sociology is well situated to help address. I argue against Schroeder's explanation of pragmatic encroachment on knowledge. In section 1, I introduce pragmatic encroachment and point out that an explanation of it should avoid Pascalian considerations. In section 2, summarize the key aspects of Schroeder's explanation of pragmatic encroachment. In section 3, I argue that Schroeder's explanation faces a dilemma: it either allows for an objectionable form of Pascalian encroachment or it fails to be a fully general explanation of pragmatic encroachment.

Successful transitions to a sustainable bioeconomy require novel technologies, processes, and practices as well as a general agreement about the overarching normative direction of innovation. Both requirements necessarily involve collective action by those individuals who purchase, use, and co-produce novelties: the consumers. Based on theoretical considerations borrowed from evolutionary innovation economics and consumer social responsibility, we explore to what extent consumers’ scope of action is addressed in the scientific bioeconomy literature. We do so by systematically reviewing bioeconomy-related publications according to (...) the extent to which consumers are regarded as passive vs. active, and different domains of consumer responsibility. We find all aspects of active consumption considered to varying degrees but observe little interconnection between domains. In sum, our paper contributes to the bioeconomy literature by developing a novel coding scheme that allows us to pinpoint different aspects of consumer activity, which have been considered in a rather isolated and undifferentiated manner. Combined with our theoretical considerations, the results of our review reveal a central research gap which should be taken up in future empirical and conceptual bioeconomy research. The system-spanning nature of a sustainable bioeconomy demands an equally holistic exploration of the consumers’ prospective and shared responsibility for contributing to its coming of age, ranging from the procurement of information on bio-based products and services to their disposal. For most observers of economics from both inside and outside the science, the term ‘economics’ is synonymous with neoclassical economics. It is the methodology of neoclassical economics that defines the discipline of economics. ‘Mainstream economics’ is neoclassical economics and anyone entering the discipline today who wishes to obtain an appointment at one of the leading universities of the world is well advised to master its techniques. The fact that virtually every winner of a Nobel prize from Paul Samuelson up to (...) his student Joseph Stiglitz has been a practitioner of neoclassical economics is ample proof of the methodology’s triumph. Despite the dominance of this methodology, however, neoclassical economics has been subject to a steady stream of criticisms and proposals for alternative methodological approaches throughout its life. This article focuses on two relatively recent challenges to the neoclassical orthodoxy that seem to have taken hold of a non-negligible minority of the profession, some of whom can be found at leading universities. These two challenges come from behavioural economics and evolutionary economics. The article describes the strengths and weaknesses of both of these methodological approaches and contrasts them with that of neoclassical economics. It concludes that all three methodologies have something positive to contribute to the study of human behaviour. Key Words: neoclassical economics • behavioural economics • evolutionary economics. Die rasanten technischen Fortschritte in der Genomforschung ermöglichen heute schon die Sequenzierung des einzelnen menschlichen Genoms in wenigen Tagen und zu vertretbaren Kosten. In der Krebsforschung ermöglicht die genetische Sequenzanalyse, zunehmend die Defekte zu identifizieren, die für das Tumorwachstum bei jedem einzelnen Patienten verantwortlich sind. Auf dieser Basis können zielgerichteter Therapien entwickelt werden. Diese Forschung wirft jedoch auch neue, ethische Fragen auf. Diesen normativen Fragen widmet sich in Heidelberg das interdisziplinäre EURAT Projekt mit dem Ziel, ethisch und rechtlich informierte Lösungen (...) zu formulieren und zu etablieren.Dieser Beitrag gibt zum einen einen Überblick über die ethischen und klinischen Fragen, die für den Aufklärungs- und Einwilligungsprozess in die biobankbasierte Genomforschung relevant sind. Zum anderen wird als organisationsethische Antwort auf die Frage, wie eine Forschungsinstitution den verantwortungsvollen Umgang mit genetischen Informationen in Biobanken über die verschiedenen Berufsgruppen und beteiligten Institute hinweg sichern kann, ein Verhaltenskodex vorgestellt. Eine gut begründete, informierte Zustimmung und ein Verhaltenskodex sind beides Elemente einer „Best Practice Leitlinie“ und sollen den verantwortlichen Umgang aller beteiligten Mitarbeiter mit sensiblen genetischen Daten prägen. This is a two tiered investigation. On the one hand, the author presents a systematic account of the philosophy of Hilary Putnam. Being the first comprehensive account to be published in the German-speaking world, the author traces the development of Putnam's realism and philosophy of language and their connections from the early 1950's to 2000. Contrary to the popular view of the discontinuity of Putnam's philosophy, he demonstrates that Putnam maintains certain semantic, pragmatic and epistemological foundations for the rational confirmability, (...) fallibility and self-corrigibility of theoretical knowledge in the empirical sciences as a constant around which many other philosophical assumptions are allowed to vary under critical examination. The resulting view of Putnam's philosophical "position" is decidedly "anti-metaphysical" (contrary to the common association of his philosophy of language with e.g. Kripke's understanding of realism), but not fully "deflationary" (contrary to the reclamation of his criticism of realist metaphysics as Quinean or Rortyan skepticism). On the other hand, the author generalizes, in the second and third parts of the book, Putnam's now famous theory of meaning and reference to develop a framework for the pragmatics of semantic continuity and discontinuity, as well as conceptual change within general terms in empirical settings, like natural kind terms, theoretical terms in natural sciences and commonsense classifications. The third part presents, develops and defends the basic normative premisses as a pragmatic alternative to both, metaphysical (Kripke, Devitt) and sceptical approaches (Quine, Kuhn). The main result here is that many (if not all) preconditions for the semantic bahvior of 'rigid' general terms are not, as usually assumed, ontological in nature, but can be usefully framed as part of the pragmatics of general terms in epistemic practices counting with rational revisability. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. To the chorus of Corinthian women, she presents herself as a woman like any other, but with fewer resources; to Jason in the agōn she speaks as if man to man, articulating her claim to the appropriate returns of charis and philia. Even when she addresses herself, in the great (...) monologue, two distinct voices appear, that of the pitiful mother who loves her children and, opposed to this, the voice of the heroic warrior who demands revenge.1 The subject of this article will not be the versatility of Medea's speech, per se. Rather, I will consider the narrower but related issue of how—with what words and weapons—Medea enacts her revenge on Jason.Christopher Gill recently has argued that Medea's revenge is the final episode in the series of exchanges of charis between husband and wife.2 The exchanges began long ago in the mythical past, when Medea first helped Jason obtain the Golden Fleece.3 My argument, building on that of Gill's, is that the language of charis extends in this play to the material medium of the heroine's revenge. The "textiles" given by Medea to Creon's daughter are, I suggest, a significant component in the play's construction of Medea's agency and her participation in relations of philia.4 What can the objects that Medea uses as instruments of vengeance tell us about the identity of this heroine and the active role she [End Page 471] creates for herself?5 Why, more specifically, does Medea use gifts—a crown (plokos) and a robe (peplos)—to kill Creon and his daughter?6 By reading the gifts themselves in relation to the preceding agōn and Aegeus episode we will arrive at a more complete picture of the issues at stake in Medea's revenge.7To do this we will need to take into account several preliminary considerations. First of all, gifts are not given in isolation.8 There is always some reference to past acts of generosity as well as to future obligation when an offer is made. In Medea's case, the plokos and peplos—gifts given to her by her grandfather, Helios—are implicated in her own genealogy and, as I will argue, in her history with Jason. Standing as symbols of the autonomous power that Medea once used to give herself away in marriage, these objects are called upon once again, in this play, in order to punish Jason for his violation of philia.Secondly, the giving of gifts and the revenge take place in the context of two marriages: the marriage of Jason to Medea, and subsequently, his marriage to the princess of Corinth. In the final section of this article I will argue that Medea manipulates wedding gifts and imagery in such a way that the fulfillment of her revenge is conditional upon (and coextensive with) the unraveling of both of these marriages. The approach I am taking toward Medea's revenge therefore raises the important issue of female subjectivity in Greek tragedy, especially in the context of marriage. Recently, Victoria Wohl, Kirk Ormand, and Nancy Rabinowitz have given subtle and thorough consideration to the problems that arise in reading female subjectivity within the constraints of male authorship and the patriarchal systems of exchange of Greek tragedy. [End Page 472] I am for the most part in agreement with their description of marriage in tragedy as a homosocial institution: the exchange of women solidifies social and economic bonds between men—and therefore, should be read from this perspective.9Nevertheless, I believe that the Medea offers an interesting and significant challenge to this generalization. For it is precisely containment by a patriarchal system (and husband) that Medea seems to defy. Medea speaks a language of reciprocity that is usually spoken between men only, and she negotiates an uneasy balance for herself (in the agōn) between the roles of marital and aristocratic philia (as discussed below). The importance of self-interest at both the micro and macro levels of politics becomes clear once one looks not simply at the ?inputs? of a democracy but at its ?outputs? as well. The prevalence of interest (...) groups, the dysfunction of the United States tax code, the lobbying by unions for their members? self-interest, the earmarks in the Patriot Act, the numerous cases of corruption in Western democracies, and the dissatisfaction of citizens with their governments? failings all point to the importance of self-interest in politics. In this essay I want to consider three aspects of the interpretation, the account of Plato's ‘ideal numbers’ (section I), the account of Speusippus’ mathematical ontology (section II), and the account of the principles of that ontology (section III). International human rights law and international humanitarian law (IHL) contain few obligations for rebel groups, yet those groups are nonetheless under pressure to comply with their foundational international norms. This case study of the Kosovo Liberation Army (KLA) analyzes the evolution of its discourse and behavior related to human rights and IHL. It then compares changes in the group’s discourse to evidence of changes in behavior. The study finds that the KLA does significantly change its language, gradually incorporating such language (...) over time, but it also demonstrates that this change is not accompanied by improvements in human rights and IHL adherence in its behavior. The study considers whether greater adoption of these norms is better explained by a constructivist or a rationalist approach and, in particular, looks at the role of legitimacy. In addition, it offers insight into how groups may respond to future pressure to follow these norms. (shrink)

Marx’s theory of ground rent has been widely used to help understand the trinity of land, labor, and capital. However, limited attention has been paid to the role of water within the Marxian rent framework. This lack of attention proves troubling due to the role of surface waters as an essential means of production throughout capitalism. Here I restate Marxian ground rent in the form of water rent and discuss the function of water-rent in the two dominant surface water rights (...) doctrines of the United States—the riparian doctrine and the doctrine of prior appropriation. In doing so, I revise the distinction between differential rent 1 and differential rent 2 to provide more analytically useful categories. Paying special attention to issues of drought and scarcity, I fully articulate the function of Marxian rent and its four forms for both surface water rights doctrines, while clearly stating where they do and do not differ. Becoming is interpreted by various sciences. The exact sciences, physics, and chemistry, interpret this universal becoming or change of all things on the model of mathematical equations. In such an equation of quantities or magnitudes, one side always balances the other. We call such a process “circular”. Numbers may be subdivided or contracted, they may change their places or positions, but the sum total of the whole equation remains immutably the same. In this manner mechanics constructs change as a change (...) of positions of unchanging particles in a continuous but divisible space and in a continuous but divisible time. Chemistry constructs qualitative change as a change of unchanging elements in such a fashion that the sum total of the elements involved in such transactions is always completely accounted for. But in the twentieth century becoming entered these closed systems. There are no unchanging atoms now, and no unchanging chemical elements. Both the physical atom and the chemical element, thought immutable before, are now seen to disintegrate, to radiate, to change their character according to their position in the “field” of energy in which they occur.
