L’article a pour objet l’analyse des interactions verbales entre des adolescents polyhandicapés et des adultes ayant soins. L’objectif de l’étude est de montrer comment le phénomène de répétition qui se distribue nécessairement sur le plan interlocutoire engendre ou facilite le processus d’intercompréhension. Les résultats montrent que la répétition fonctionne comme un processus dialogique dont la dynamique intersubjective contribue à la construction et à l’accomplissement réussi de l’échange conversationnel. Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. This paper presents an introduction to the notions of incrementality and underspecification and update, drawing on the assumptions made by DS. It lays out the tools of the theoretical framework that are necessary to understand the accounts developed in the other contributions to the Special Issue. One major insight derived from the moral twin earth debate is that evaluative and descriptive terms possess different levels of semantic stability, in that the meanings of the former but not the latter tend to remain constant over significant counterfactual variance in patterns of application. At the same time, it is common in metanormative debate to divide evaluative terms into those that are thin and those that are thick. In this paper, I combine debates about semantic stability and the distinction (...) between the thin and the thick by presenting a new seamless inferentialist account of thin and thick evaluative terms which, despite subsuming them under the same metasemantic analysis, can nevertheless account for their varying levels of semantic stability. According to this position of ‘seamless metaconceptualism’, thin and thick evaluative terms do not belong to different categories, but are both understood as metaconceptual devices which do not differ in kind, but in scope. By providing the same analysis for both thin and thick terms, seamless metaconceptualism not only entails that the latter cannot shoulder the philosophical work that some have attributed to them, but also removes much of their surrounding intrigue. The paper draws its inspiration from the provocation which Merton offered sociology both to engage with empirical data and to perform analyses adequate to guide intervention beyond the particular case. Whilst contemporary STS is very different both in its models of theory and its forms of methodology, this paper suggests Merton's concerns with engagement and adequacy provide a useful way to interrogate current approaches. Specifically, the paper explores some recent anthropological conceptions of ethnographic fieldwork that have provided potent models for (...) the study of scientific and technological cultures. These multi-sited approaches have also provided the opportunity to develop new notions of intervention and explore alternative ways of making contributions to development of theory and practice. In the process of pursuing the goals of engagement and adequacy notions of ethnography have however become stretched. This sense of detachment from methodological canons accentuates the need for methodological debate and skill-sharing in STS. (shrink)

Sound moves us. Nowhere is this more apparent than in our responses to genuine emotional vocalizations, be they heartfelt distress cries or raucous laughter. Here, we present perceptual ratings and a description of a freely available, large database of natural affective vocal sounds from human infants, adults and domestic animals, the Oxford Vocal (OxVoc) Sounds database. This database consists of 173 non-verbal sounds expressing a range of happy, sad, and neutral emotional states. Ratings are presented for the sounds on a (...) range of dimensions from a number of independent participant samples. Perceptions related to valence, including distress, vocalizer mood, and listener mood are presented in Study 1. Perceptions of the arousal of the sound, listener motivation to respond and valence (positive, negative) are presented in Study 2. Perceptions of the emotional content of the stimuli in both Study 1 and 2 were consistent with the predefined categories (e.g., laugh stimuli perceived as positive). While the adult vocalizations received more extreme valence ratings, rated motivation to respond to the sounds was highest for the infant sounds. The major advantages of this database are the inclusion of vocalizations from naturalistic situations, which represent genuine expressions of emotion, and the inclusion of vocalizations from animals and infants, providing comparison stimuli for use in cross-species and developmental studies. This article presents the results of an evaluative research on the impacts of collaborative research in the evolution of the practices of researchers and associated teachers. It was a question of understanding how the collaborative approach was useful and relevant to the participants, how it enabled them to better take ownership of their role as an associate teacher, and how to transform their practices.

abstractBackground: Evidence shows both a tendency for research participants to conflate research and clinical care and a limited public understanding of research. Conflation of research and care by participants is often referred to as the therapeutic misconception. Despite this evidence, few studies have explicitly asked participants, and especially minors, to explain what they think research is and how they think it differs from regular medical care. Methods: As part of a longer semistructured interview evaluating assent and parental permission for research, (...) adolescent research participants (n = 177), including adolescents with illnesses and healthy volunteers, and their parents (n = 177) were asked to describe medical research in their own words and say whether and how they thought being in medical research was different from seeing a regular doctor. Qualitative responses were coded and themes were identified through an iterative process. Results: When asked to describe medical research, the majority described research in terms of its goals of helping to advance science, develop treatments and medicines, and help others; fewer described research as having the goal of helping particular research participants, and fewer still in terms of the methods used in research. The majority of teen and parent respondents said being in research is different than seeing a regular doctor and explained this by describing different goals, different or more procedures, differences in the engagement of the doctors/researchers, and differences in logistics. Conclusions: Adolescents participating in clinical research and their parents generally describe medical research in terms of its goals of advancing science and finding new medicines and treatments, sometimes in combination with helping the enrolled individuals. The majority perceive a difference between research and regular medical care and described these differences in various ways. Further exploration is warranted about how such perceived differences matter to participants and how this understanding could be used to enhance informed consent and the overall research experience. Vulnerability in research is often understood as a diminished ability to protect one's own interests, manifested by a compromised capacity to give informed or voluntary consent. Certain groups of people are thought to be more vulnerable than others and therefore are at risk of being exploited or mistreated in research. Accordingly, the federal regulations call for additional safeguards to protect vulnerable groups.There remains some ambiguity and contradiction, however, regarding what groups are vulnerable in research and why,3 since the available codes (...) of research ethics and regulations describe many groups as vulnerable. When so many groups are considered vulnerable, but no specification is offered as to how they are vulnerable or what particular protections are appropriate, the possibility of meaningful safeguards is diminished. In addition, current concepts of vulnerability are usually applied to whole groups of people, without distinguishing between individuals in a group who might truly have a compromised capacity to protect their own interests from those who do not. This paper starts off from what seems to be a difficulty of ethics in African Business today. For several years now Transparency International has placed some African countries high on its list of most corrupt countries of the world. The conclusion one draws from this assessment is that either African culture has no regard or concern for ethics, or that there has been a gradual loss of the concept of the ethical and the moral in contemporary African society. Equally problematic (...) is the teaching and promotion of Business ethics in organizations. Western philosophical theories and systems alone have not succeeded in providing access to ethical life of people in modern Africa. This paper is an attempt to inject an orientation that takes into account African manners and customs, their religious convictions and their understanding of the world as a whole, in the teaching of Business Ethics. East and Central Africa have been selected due to their common lingua franca, Kiswahili, and the fact that the author has more teaching experience within that region. (shrink)

The invocation of large-scale social unities - states, societies, empires, cultures, civilizations - is a long-established and pervasive practice among sociologists, anthropologists, historians, political scientists and so on. This article examines the treatment of such unities as defined or held together by shared understandings and values, and as independent, boundary-maintaining social systems. We argue that both the ideational and the systemic presumptions at work here are dependent on what Foucault calls the figure of man: the first as an inescapable consequence (...) of that figure, the second as a tempting, but by no means necessary, one. Our first major argument concerns the remarkable persistence of concepts, such as ‘culture’, which designate unities that are ideational in character. We use the case study of anthropology to suggest that this is a consequence of the constitutive role of the figure of man within the human sciences. Human scientists and others critical of the stress on sameness resulting from the concern with ideational unities - cultures, ideologies, discourses and so on - as shared across a population, will find it well-nigh impossible either to modify significantly or to jettison altogether such concepts; as long as they rely on some version of the figure of man, scholars are committed irrevocably to the use of these concepts. Our second major argument concerns the conception of society as a systemic unity, a conception which we see as reflecting the influence of the figure of man in the field of governmental reason. In this part of the article we follow Foucault’s argument that the liberal rationality of government leads to a view of social life as traversed by numerous self-regulating spheres of social interaction. However, we dispute his further suggestion that the concept of society itself, as designating a self-regulating sphere of this kind, can be seen as a product of the liberal critique of police. This essay examines the reconfiguration of the racial and sexual contracts underpinning democratic theory and practice in the transition to independence in India. Drawing upon the work of Carole Pateman and Charles Mills, Keating argues that the racialized fraternal democratic order that they describe was importantly challenged by nationalist and feminist struggles against colonialism in India, but was reshaped into what she calls a postcolonial sexual contract by the framers of the Indian Constitution.

This essay examines the possibilities of being/becoming an ethical researcher in the academy. It tackles this task through the lens of an ethics application by Mary [pseudonym], a PhD student in sociology whose research thesis was investigating the reasons why married men with children use prostitutes. Two analyses are offered of Mary's story. The first analysis presents the sort of critique that a university ethics committee might make of Mary's ethics application and uses the principles that are the basis of (...) regulatory research ethics frameworks around the world. From this starting point, the second analysis examines how the problems that an ethics committee would see in Mary's proposal might have come about. By way of explanation, I posit that an ethics of rational self-interest has asserted itself as a new moral economy among students, doctoral supervisors and within the management of universities. The co-existence of these two irreconcilable discourses of ethics ? principlism and rational self-interest ? has implications for being/becoming an ethical researcher and for the work of research ethics committees in the academy. This article begins with discussing challenges encountered while managing the epistemology of legal modes of thinking and social science, and the limits of relying on discipline-based methodologies for the advancement of empirical legal scholarship. In then discusses two approaches to empirical legal training employed in New York. Through this, it seeks to demonstrate the strengths of collaborative research with illustrations of a cross-national collaboration. Empirical research on law is a multi-method phenomenon. Ideally, empirical legal training means that students need and (...) can further foster a background in a broad range of social science methods and in a set of methods that can use triangulation or juxtaposition to capture the factors that explain law as a social phenomenon. Das Augenmerk gilt den partikularen Interessen, die politisch Mächtige verfolgen, wenn sie Künstler oder Gelehrte alimentieren: Repräsentation, Legitimierung von Herrschaftsansprüchen, Distinktion mit Hilfe von kulturellem Kapital lauten die gängigen Stichworte. Demgegenüber wird in diesem Band gezeigt, dass umgekehrt auch die Mächtigen von den Kulturschaffenden abhängig sind. The integral role of royal women in political systems structured by diplomatic marriage is revealed in a series of legal verdicts from a case that involved the rulers of Late Bronze Age Ugarit, Amurru, and Ḫatti. These verdicts adjudicate the divorce, loss of political status, and execution of a royal woman who was the wife of the king of Ugarit, the daughter and sister of two successive kings of Amurru, and the granddaughter and niece of two successive Hittite Great Kings. (...) The undoing of her multivalent political status destabilized the regional and imperial system in which she was enmeshed. Protracted negotiations were required to restore equilibrium to the system. Examination of the rhetorical and legal strategies through which these negotiations took place reveals the extent to which the relative power of royal men depended on their relationships to royal women. The interlocutors of Plato’s Cratylus agree that “it is far better to learn and to inquire from the things themselves than from their names”. Although surprisingly little attention has been paid to these remarks, at least some commentators view Plato as articulating a preference for direct, nonlinguistic cognitive access to the objects of inquiry. Another commentator takes Plato simply to recommend first-hand, yet linguistic, experience in addition to instruction from experts. This paper defends, in contrast to both interpretations, the view (...) that inquiry without names is dialectical, linguistic inquiry into metaphysical first principles. As such, inquiry without names is prior to inquiry from or through names. Inquiry without names is a form of transcendental metaphysics. (shrink)

The Cratylus contains Plato's most extensive study of the relation of language to reality and to the pursuit of wisdom. Yet the dialogue has remained relatively neglected in efforts to understand Plato's deepest metaphysical and epistemological commitments. The blame for such neglect lies largely in the dialogue's extensive, difficult, even mysterious etymological section. Recent attempts to make sense of the bulk of the Cratylus are shedding much welcome light on the important roles that the etymological analyses play in the dialogue (...) and in Plato's philosophy more generally. The article outlines three strategies of interpretation before concluding with the author's own proposal. (shrink)

Offenbar besteht Klärungsbedarf in Bezug darauf, ob und, wenn ja, wann Kritik ebenso wie ihre Zurückweisung berechtigt sind. Hierzu gilt es insbesondere den Zusammenhang eingehender zu betrachten zwischen dem universellen Recht auf Redefreiheit, dessen gesetzlicher Kodifizierung und den ethischen Anforderungen, denen Redebeiträge und deren Kritik unterstehen. In sieben Beiträgen wird aus (...) unterschiedlichen Blickwinkeln das Thema des Schwerpunkts „Redefreiheit und Kritik: Müssen wir alles tolerieren, was andere sagen?“ beleuchtet. This paper reviews the main pricing policies in Latin American countries, discussing their shortcomings. It also gives an overview of the most common pricing and reimbursement policies in Europe and describes in detail three well-established approaches — international price referencing, value-based pricing, including setting up of health technology assessment, and generic and biosimilar policies — building on country examples.

One factor that impedes medical students from speaking up about ethical situations is the lack of sufficient knowledge and skills in conflict resolution. This may also affect students’ decision and timing to intervene. This article will provide practical ways to effectively and efficiently address the medical student’s ethical case presented in August A. Culbert et al.’s “Navigating Informed Consent and Patient Safety in Surgery: Lessons for Medical Students and Junior Trainees.”.
