In Epistles 3,7, Pliny the Younger gives a short account of the life of Silius Italicus, who had recently committed suicide at his Neapolitan villa. Scholarship has not only considered this letter as a rather critical and unsympathetic description of the epic poet’s vita, but has also read some of its information (for example Silius’ veneration of Vergil and his passion for antiquities) to Silius’ poetics in general. In this paper, I shall highlight one specific intertextual connection - not proposed (...) to date - between this epistle and the Capua episode in Book 11 of Silius’ „Punica“. I shall show that Pliny the Younger, concurring with Martial’s similar representation of Silius (Epigr. 4,14), has to some extent modelled Silius’ retirement in Campania upon Hannibal’s enervating winter in the luxurious city of Capua. This festschrift collects a number of insightful essays by a group of accomplished Christian scholars, all of who have either worked with or studied under Hendrik Hart during his 35-year tenure as Senior Member in Systematic Philosophy at the Institute for Christian Studies, Toronto, Canada.

The debate about the nature of the representational format of concepts seems to have reached an impasse. The debate faces two fundamental problems. Firstly, amodalists (i.e., those who argue that concepts are represented by amodal symbols) and modalists (i.e., those who see concepts as involving crucially representations including sensorimotor information) claim that the same empirical evidence is compatible with their views. Secondly, there is no shared understanding of what a modal or amodal format amounts to. Both camps recognize that the (...) two formats play essential roles in higher cognition, leading to an increasing number of hybrid proposals. In this paper, I argue that the existence of those fundamental problems should make us suspicious about a modal/amodal dichotomy. Also, I suggest that hybrid approaches, as they currently stand, do not provide suitable solutions to the impasse. Instead, we should overcome the dichotomy and treat the modal/amodal distinction as a graded phenomenon. I illustrate this hypothesis with an example of a cognitive-computational model of concepts based on the Predictive Processing framework. (shrink)

A new landscape of prenatal testing is presently developing, including new techniques for risk-reducing, non-invasive sampling of foetal DNA and drastically enhanced possibilities of what may be rapidly and precisely analysed, surrounded by a growing commercial genetic testing industry and a general trend of individualization in healthcare policies. This article applies a set of established ethical notions from past debates on PNT for analysing PNT screening-programmes in this new situation. While some basic challenges of PNT stay untouched, the new development (...) supports a radical individualization of how PNT screening is organized. This reformation is, at the same time, difficult to reconcile with responsible spending of resources in a publicly funded healthcare context. Thus, while the ethical imperative of individualization holds and applies to PNT, the new landscape of PNT provides reasons to start rolling back the type of mass-screening programmes currently established in many countries. Instead, more limited offers are suggested, based on considerations of severity of conditions and optimized to simultaneously serve reproductive autonomy and public health within an acceptable frame of priorities. The new landscape of PNT furthermore underscores the ethical importance of supporting and including people with disabilities. For the very same reason, no ban on what may be analysed using PNT in the new landscape should be applied, although private offers must, of course, conform to strict requirements of respecting reproductive autonomy and what that means in terms of counselling. Humans routinely make many decisions collectively, whether they choose a restaurant with friends, elect political leaders or decide actions to tackle international problems, such as climate change, that affect the future of the whole planet. We might be less aware of it, but group decisions are just as important to social animals as they are for us. Animal groups have to collectively decide about communal movements, activities, nesting sites and enterprises, such as cooperative breeding or hunting, that crucially affect their (...) survival and reproduction. While human group decisions have been studied for millennia, the study of animal group decisions is relatively young, but is now expanding rapidly. It emerges that group decisions in animals pose many similar questions to those in humans. The purpose of the present issue is to integrate and combine approaches in the social and natural sciences in an area in which theoretical challenges and research questions are often similar, and to introduce each discipline to the other’s key ideas, findings and successful methods. In order to make such an introduction as effective as possible, here, we briefly review conceptual similarities and differences between the sciences, and provide a guide to the present issue. Artificial Intelligence (AI) seems to be impacting all industry sectors, while becoming a motor for innovation. The diffusion of AI from the civilian sector to the defense sector, and AI’s dual-use potential has drawn attention from security and ethics scholars. With the publication of the ethical guideline Trustworthy AI by the European Union (EU), normative questions on the application of AI have been further evaluated. In order to draw conclusions on Trustworthy AI as a point of reference for responsible research (...) and development (R&D), we approach the diffusion of AI across both civilian and military spheres in the EU. We capture the extent of technological diffusion and derive European and German patent citation networks. Both networks indicate a low degree of diffusion of AI between civilian and defense sectors. A qualitative investigation of project descriptions of a research institute’s work in both civilian and military fields shows that military AI applications stress accuracy or robustness, while civilian AI reflects a focus on human-centric values. Our work represents a first approach by linking processes of technology diffusion with normative evaluations of R&D. (shrink)

The goal of this article is to outline a new account of the virtue of patience. To help build the account, we focus on five important issues pertaining to patience: (i) goals and time, (ii) emotion, (iii) continence versus virtue, (iv) motivation, and (v) good ends. The heart of the resulting account is that patience is a cross-situational and stable disposition to react, both internally and externally, to slower than desired progress toward goal achievement with a reasonable level of calmness. Arguments on legal evidence rely on generalizations, that link a certain circumstance to a certain hypothesis and warrants the claim that the circumstance makes the hypothesis more probable. Some generalizations are acceptable and others are unacceptable. A generalization can be unacceptable on at least four different grounds. A false generalization is unacceptable because membership in the reference class does not increase the probability of the hypothesis. A non-robust generalization is unacceptable because it uses a reference class that is too heterogeneous. (...) A biastriggering generalization is unacceptable because decision makers are inclined to overestimate the evidentiary value of membership in the reference class. We consider the implications for the ethical evaluation of research programs of two fundamental changes in the revised research ethical guideline of the Council for International Organizations of Medical Sciences. The first is the extension of scope that follows from exchanging “biomedical” for “health‐related” research, and the second is the new evaluative basis of “social value,” which implies new ethical requirements of research. We use the example of antibiotic resistance interventions to explore the need to consider the instances of what (...) we term the pragmatic risks of such interventions to evaluate the social value of certain kinds of health‐related research. These (pragmatic) risks severely threaten the social value of interventions in every area where human and social responses significantly impact on their effectiveness. Thus, the social value of health‐related research needed to demonstrate its effectiveness depends on the extent and successful management of such risks. Research designed to take into account the management of pragmatic risks also gives rise to similar types of risks, and the potential for social value in light of those risks needs to be considered in ethical reviews based on the new guidelines. We argue that, to handle this new expanded task, the international system of research ethical review addressed by the guidelines needs institutional development. (shrink)

A counterexample to Bell's theorem is presented which uses a pair of photons instead of spin-1/2 particles used in our previous counterexamples. A locally causal protocol is provided for Alice and Bob, which allows them to simulate observing photon polarizations at various angles, and record their results as A=+/-1 in S^3 and B=+/-1 in S^3, respectively. When these results are compared, the correlations are seen to be exactly those predicted by quantum mechanics; namely cos 2(alpha - beta), where alpha and (...) beta are the angles of polarizers. The key ingredient in our counterexample is the topology of 3-sphere, which remains closed under multiplication, thus preserving the locality condition of Bell. (shrink)

The standard of proof in criminal trials should require that the evidence presented by the prosecution is robust. This requirement of robustness says that it must be unlikely that additional information would change the probability that the defendant is guilty. Robustness is difficult for a judge to estimate, as it requires the judge to assess the possible effect of information that the he or she does not have. This article is concerned with expert witnesses and proposes a method for reviewing (...) the robustness of expert testimony. According to the proposed method, the robustness of expert testimony is estimated with regard to competence, motivation, external strength, internal strength and relevance. The danger of trusting non-robust expert testimony is illustrated with an analysis of the Thomas Quick Case, a Swedish legal scandal where a patient at a mental institution was wrongfully convicted for eight murders. Der Beitrag beschäftigt sich mit kulturanthropologischen und literarischen Reflexionen auf den Bewegungsmodus des Gehens. Er diskutiert die Frage, inwieweit das Gehen in diesen Diskursen als Linienpraxis aufgefasst wird. Ausgangspunkt ist die Beobachtung, dass die Kulturanthropologie, die dem aufrechten Gang eine Schlüsselfunktion für die Anthropogenese zuweist, diesen zugleich als Produkt eines ›Begradigungsprozesses‹ markiert und an die dichotomische Gegenüberstellung von Natur und Kultur koppelt. In literarischen Texten, aber auch in neueren ökoanthropologischen Ansätzen wird die Natur-Kultur-Opposition und die damit verbundene Privilegierung der geraden (...) Linie kritisch hinterfragt. Setzt die literarische Peripatetik mithin eine alternative Form der Beziehung zwischen Mensch und Umwelt in Szene? Entwirft sie eine Ökologie des Denkens und Wahrnehmens, die sich jenseits der Natur-Kultur-Dichotomie bewegt? Diese Fragen werden an ausgewählten Fallbeispielen beleuchtet. The essay deals with the peripatetic mode of movement as reflected in cultural anthropology and literature. It asks to what extent these discourses view walking as a practice of line-making. The point of departure is the observation that cultural anthropology ascribes a key role to the upright gait within anthropogenesis while associating it with a process of rectilinearization on the one hand and a sharp dichotomy between nature and culture on the other hand. Certain literary texts and recent approaches in ecologically oriented anthropology have, however, challenged the validity of this dichotomy and the concomitant privilege of the straight line. Does literary peripatetics thus propose an alternative way to grasp the relationship between human beings and the environment? Does it outline a new ecology of the mind that supersedes the binary relation between nature and culture? These questions are discussed with reference to selected case studies. (shrink)

This chapter provides a brief overview of recent work in psychology on virtue, with a focus on the implications of that research for business. It begins by characterizing what is involved in having a virtuous character trait. It then reviews some of the claims made in two of the leading research traditions on traits in psychology: situationism and the Big Five model. Finally it ends with an application of research on the Big Five trait of conscientiousness to the business environment.

Phänomenologie als praktische Philosophie - diese schon fast ketzerische These wird in dieser Untersuchung verteidigt. Obwohl die von Edmund Husserl entwickelte phänomenologische Methode zu Recht als sehr abstrakt gilt, birgt sie nämlich ein immenses Potential für das Verständnis der alltäglichen Lebenspraxis. Erst die Weiterentwicklung des nur theoretisch fruchtbaren phänomenologischen Entwurfs Husserls durch Martin Heidegger und dann vor allem durch den tschechischen Husserl-Schüler Jan Patočka brachte die Möglichkeiten der Phänomologie zur Entfaltung. Indem Patočka nämlich existenziales und dialektisches Gedankengut für eine Revision (...) der Phänomenologie nutzte, gelang es ihm, das Konzept einer Philosophie der Praxis auf phänomenologischer Grundlage zu entwerfen. We investigate Kerr–Newman black holes in which a rotating charged ring-shaped singularity induces a region which contains closed timelike curves (CTCs). Contrary to popular belief, it turns out that the time orientation of the CTC is oppo- site to the direction in which the singularity or the ergosphere rotates. In this sense, CTCs “counter-rotate” against the rotating black hole. We have similar results for all spacetimes sufficiently familiar to us in which rotation induces CTCs. This motivates our conjecture that perhaps (...) this counter-rotation is not an accidental oddity particular to Kerr–Newman spacetimes, but instead there may be a general and intuitively comprehensible reason for this. Previous studies with adult participants have investigated reasoning from one or two uncertain premises with simple deductive arguments. Three exploratory experiments were designed to extend these results by investigating the evaluation of the plausibility of the conclusion of "combined" arguments, i.e. arguments constituted by two or more "atomic" standard arguments which each involved the same conclusion and one uncertain premise out of two. One example is "If she meets Nicolas it is very improbable she will go to the swimming pool; (...) if she meets Sophie it is very probable she will go to the swimming pool; she meets Nicolas; she meets Sophie". With two conflicting arguments, one supporting and one unfavourable, participants chose a compromise stance (Exp. 1), unless the thematic content of the premises allows one to consider one argument as more important than the other (Exp. 3). With two favourable arguments and rather unfamiliar materials, two typical behaviours appeared. One consisted in choosing a degree of plausibility of the conclusion that is intermediate between the modals asserted in the premises, and the other in choosing a more favourable degree than the most favourable modal (Exp. 1). The plausibility of the conclusion increased when the number of supporting atomic arguments increased from one to three, and decreased when the number of unfavourable arguments increased (Exp. 2). This view will provide further and better arguments for the following view about long-standing interpretative debates: first, Aristotle provides a substantive account of the unity of the composite substance (although he also briefly addresses the unity of the form); second, neither Aristotle’s conception of matter nor his account of form changes between H.1–5 and H.6; and third, H does not rely on (...) and is not completed by book Θ in any significant way. This book explores the influence of ubuntu on South Africa’s post-apartheid transitional justice mechanism, the Truth and Reconciliation Commission, and—in contrast to ethnophilosophy—takes differences, historical developments, and social contexts seriously.

In section one, I briefly review the Harman/Doris argument and outline the most promising response. Then in section two I develop what I take the real challenge to virtue ethics to be. The final section of the chapter suggests two strategies for beginning to address this challenge.

The English whaler William Scoresby, Jr. (1790–1857) made use of his annual voyages to the Greenland Sea for distinguished scientific work, detailed records and the production of amazing maps. Due to his intensive contacts to scientists as Robert Jameson and politicians as Joseph Banks and John Barrow his research achieved a great deal of attention and set a benchmark for at least half a century. Scoresby combined (...) the adventurous world of Arctic fishery with academic sciences. He attained the northernmost point anybody reached in his time, he extended the cartographic knowledge and forced the conquest and utilisation of the oceans for commercial fishing. But his biography enquires also about who got an opportunity for research and for what. Especially it demonstrates the strong impact practical knowledge of a whaler could have on geographic research and Arctic cartography. (shrink)

The IOC and WADA have announced their ambition to develop control program in order to detect athletes' illegitimate use of genetic technology for enhancing performance. Although it is far from clear what such uses should be counted as illegitimate, as well as to what extent the idea of control programs for such things is a feasible idea, I will assume that such programs will concern so-called somatic genetic modifications that aims at altering the athlete's initial bodily biochemistry in a way (...) that may enhance performance without the presence of any medical reason for undertaking such modifications. This means that the envisioned control-program will have to make use of the method of genetic testing in order to detect the possible presence (or non-presence) of various genetic variants within the athlete. As a consequence of this, several ethical issues familiar within the field of genetic testing for health purposes are suddenly actualised within the area of doping control. These issues concern primarily how to handle and communicate the information about the athlete that is uncovered by such testing. However, due to the ways in which gene doping may be performed, in the case of atheletic control programs, issues of medical safety and the question of what hardships it is reasonable to require of athletes to endure also become paramount. As a consequence, one may ask whether or not sporting ethics will have to consider applying the rule of informed consent in connection to testing programs of the kind here discussed. (shrink)

This study analyses to what extend and under what circumstances layoffs are accepted in Germany. Principles of distributive justice and rules of procedural justice form the theoretical framework of the analysis. Based on this, hypotheses are generated, which are tested empirically in a telephone survey conducted between East and West Germans in 2004 (n = 3036). The empirical analysis accounts for the different points of views of implicated stakeholders and impartial spectators. Key findings are: (1) The management of a company (...) can increase the acceptance of layoffs if the employees get some participation rights. (2) For impartial spectators generous compensation for those made redundant leads to a higher degree of perceived fairness. But job alliances are not even preferred to layoffs without measures to soften the blow of job loss. (3) Implicated stakeholders accept job alliances and perceive wage cuts as more fair than layoffs.
