Since a couple of decades, the notion of a precautionary principle plays a central and increasingly influential role in international as well as national policy and regulation regarding the environment and the use of technology. Urging society to take action in the face of potential risks of human activities in these areas, the recent focus on climate change has further sharpened the importance of this idea. However, the idea of a precautionary principle has also been problematised and criticised by scientists, (...) scholars and policy activists, and been accused of almost every intellectual sin imaginable: unclarity, impracticality, arbitrariness and moral as well as political unsoundness. In that light, the very idea of precaution as an ideal for policy making rather comes out as a dead end. On the basis of these contrasting starting points, Christian Munthe undertakes an innovative, in-depth philosophical analysis of what the idea of a precautionary principle is and should be about. A novel theory of the ethics of imposing risks is developed and used as a foundation for defending the idea of precaution in environmental and technological policy making against its critics, while at the same time avoiding a number of identified flaws. The theory is shown to have far-reaching consequences for areas such as bio-, information- and nuclear technology, and global environmental policy in areas such as climate change. The author argues that, while the price we pay for precaution must not be too high, we have to be prepared to pay it in order to act ethically defensible. A number of practical suggestions for precautionary regulation and policy making are made on the basis of this, and some challenges to basic ethical theory as well as consumerist societies, the global political order and liberal democracy are identified. Global capitalism is a transnational “operational space” which is produced by the practices of states, policy- and issue-specific government networks, and private organizations such as transnational corporations, global law firms, and standard-setting agencies. This “operational space,” which I call the transnational constellation, works through and beyond distinct spatial settings, endowing them with a global financial capitalistic logic and limiting the scope of democratic self-determination. In the second section, I analyze political protest against this transnational constellation in terms of democratic theory. (...) Contrary to a widespread belief, this book establishes that ontological and epistemological reductionism stand or fall together.

Consider the hypothesis H that a defendant is guilty, and the evidence E that a majority of h out of n independent jurors have voted for H and a minority of k:=n-h against H. How likely is the majority verdict to be correct? By a formula of Condorcet, the probability that H is true given E depends only on each juror's competence and on the absolute margin between the majority and the minority h-k, but neither on the number n, nor (...) on the proportion h/n. This paper reassesses that result and explores its implications. First, using the classical Condorcet jury model, I derive a more general version of Condorcet's formula, confirming the significance of the absolute margin, but showing that the probability that H is true given E depends also on an additional parameter: the prior probability that H is true. Second, I show that a related result holds when we consider not the degree of belief we attach to H given E, but the degree of support E gives to H. Third, I address the implications for the definition of special majority voting, a procedure used to capture the asymmetry between false positive and false negative decisions. I argue that the standard definition of special majority voting in terms of a required proportion of the jury is epistemically questionable, and that the classical Condorcet jury model leads to an alternative definition in terms of a required absolute margin between the majority and the minority. Finally, I show that the results on the significance of the absolute margin can be resisted if the so-called assumption of symmetrical juror competence is relaxed. (shrink)

This paper presents a systematic account of ethical issues actualised in different areas, as well as at different levels and stages of health care, by introducing organisational and other procedures that embody a shift towards person centred care and shared decision-making (PCC/SDM). The analysis builds on general ethical theory and earlier work on aspects of PCC/SDM relevant from an ethics perspective. This account leads up to a number of theoretical as well as empirical and practice oriented issues that, in view (...) of broad advancements towards PCC/SDM, need to be considered by health care ethics researchers. We seem to learn and use concepts in a variety of heterogenous “formats”, including exemplars, prototypes, and theories. Different strategies have been proposed to account for this diversity. Hybridists consider instances in different formats to be instances of a single concept. Pluralists think that each instance in a different format is a different concept. Eliminativists deny that the different instances in different formats pertain to a scientifically fruitful kind and recommend eliminating the notion of a “concept” entirely. In recent years, (...) hybridism has received the most attention and support. However, we are still lacking a cognitive-computational model for concept representation and processing that would underpin hybridism. The aim of this paper is to advance the understanding of concepts by grounding hybridism in a neuroscientific model within the Predictive Processing framework. This article examines the methodology of a core branch of contemporary political theory or philosophy: “analytic” political theory. After distinguishing political theory from related fields, such as political science, moral philosophy, and legal theory, the article discusses the analysis of political concepts. It then turns to the notions of principles and theories, as distinct from concepts, and reviews the methods of assessing such principles and theories, for the purpose of justifying or criticizing them. Finally, it looks at a recent debate (...) on how abstract and idealized political theory should be, and assesses the significance of disagreement in political theory. Predictive processing, an increasingly popular paradigm in cognitive sciences, has focused primarily on giving accounts of perception, motor control and a host of psychological phenomena, including consciousness. But higher cognitive processes, like conceptual thought, language, and logic, have received only limited attention to date and PP still stands disconnected from a huge body of research in those areas. In this thesis, I aim to address this gap and I attempt to go some way towards developing and defending a cognitive-computational approach (...) to higher cognition within the predictive processing paradigm. To test its explanatory potential, I apply it to a range of linguistic and conceptual phenomena. I proceed in three steps. First, I lay out an account of concepts and suggest how concepts are represented, how they can be context-sensitively processed, and how the apparent diversity of formats arise. Secondly, I propose how paradigmatic higher cognitive competencies, like language and logical reasoning, could fit into the PP picture. Thirdly, I apply the PP account of concepts and language to a range of linguistic-conceptual phenomena as test cases, namely: metaphor, the semantic paradox (specifically the Liar Paradox) and copredication. Finally, I discuss some challenges and objections to the PP framework as applied to higher cognition and in general. (shrink)

BackgroundAt the start of 2021, oncologists lacked the necessary scientific knowledge to adapt their clinical practices optimally when faced with cancer patients refusing or reluctant to be vaccinated against COVID-19, despite the marked vulnerability of these patients to severe, and even fatal forms of this new viral infectious disease. Oncologists at Foch Hospital were confronted with this phenomenon, which was observed worldwide, in both the general population and the population of cancer patients.MethodsBetween April and November 2021, the Ethics and Oncology (...) Departments of Foch Hospital decided to investigate this subject, through an empirical and interdisciplinary study in bioethics. Our scientific objective was to try to identify and resolve the principal bio-ethical issues, with a view to improving clinical practices in oncology during future major pandemics of this kind, from a highly specific bio-ethical standpoint. We used a mainly qualitative methodological approach based on questionnaires and interviews.ResultsIn April 2021, 29 cancer patients refused or were reluctant to be vaccinated. Seventeen of these patients said that making vaccination mandatory would have helped them to accept vaccination. In October 2021, only 10 cancer patients continued to maintain their refusal. One of the main reasons for the decrease in refusals was probably the introduction of the “pass sanitaire” in July 2021, which rendered vaccination indispensable for many activities. However, even this was not sufficient to convince these 10 cancer patients.ConclusionWe identified a key bio-ethical issue, which we then tried to resolve: vaccination policy. We characterized a major tension between “the recommendation of anti-COVID-19 vaccination” and “free will”, and the duty to “protect each other”. Mandatory vaccination, at least in France, could resolve this tension, with positive effects on quality of life, or survival, in cancer patients initially refusing or reluctant to be vaccinated, but only if collective and individual scales are clearly distinguished. Here we will examine one version of Margery William’s classic nursery tale The Velveteen Rabbit, or How Toys Become Real, where the theme of “real” and imaginary characters and worlds is construed both linguistically and pictorially. We will show how the theme is construed in both text and image, and how the two complement one another, together keeping the two worlds apart while at the same time representing the Velveteen Rabbit’s transformation from toy rabbit to real rabbit. This essay investigates the change in the Catholic attitude toward nuclear weapons as articulated by Pope Francis. Francis has generally followed the position of his immediate predecessors with regard to the Catholic teaching on just war. While the resort to armed force remains a morally justifiable option if the principles of just war have been met, the pope forcefully emphasises the tools of nonviolent peacebuilding. Recently, however, Francis made an original just war argument when he broke with the Church’s established (...) position on nuclear weapons. The pope declared both the use and possession of nuclear weapons “immoral” and, thus, abandoned the Church’s reluctant acceptance of nuclear deterrence that had survived the end of the Cold War. In this essay, I analyse the rationale behind Francis’s decision to break with nuclear deterrence, which is mainly grounded in the disillusionment about the failed promise of nuclear disarmament. Furthermore, I assess the impact of the new position with regard to Catholic soldiers serving in nuclear armed militaries. (shrink)

Monitoring the environment for visual events while performing a concurrent task requires adjustment of visual processing priorities. By use of Bundesen's (1990) Theory of Visual Attention (TVA), we investigated how monitoring for an object-based brief event affected distinct components of visual attention in a concurrent task. The perceptual salience of the event was varied. Monitoring reduced the processing speed in the concurrent task, and the reduction was stronger when the event was less salient. The monitoring task neither affected the temporal (...) threshold of conscious perception nor the storage capacity of visual short-term memory nor the efficiency of top-down controlled attentional selection. This paper deals with Keynes’s distinction between entrepreneurship and speculation, regarding business people in general and especially investors’ behaviour. Based on Keynes’s thoughts about financial markets, it analyses how different motivations influence the decision-making process of investors and its consequences for stock markets and the real economy and clarifies that Keynes’s considerations are still useful for understanding contemporary developments and risks in the financial system. Furthermore, it points out that Keynes’s theories and policy recommendations should be understood in the context (...) of his moral considerations, especially relating to individual responsibility of investors. The Global Financial Crisis is acknowledged to be the most severe economic downturn since the 1930s, and one that is unique in its underlying causes, its scope, and its wider social, political and economic implications. This volume explores some of the ethical issues that it has raised.

Given a regular cardinal $\kappa $ such that $\kappa ^{<\kappa }=\kappa $, we study a class of toposes with enough points, the $\kappa $ -separable toposes. These are equivalent to sheaf toposes over a site with $\kappa $ -small limits that has at most $\kappa $ many objects and morphisms, the topology being generated by at most $\kappa $ many covering families, and that satisfy a further exactness property T. We prove that these toposes have enough $\kappa $ -points, that (...) is, points whose inverse image preserve all $\kappa $ -small limits. This generalizes the separable toposes of Makkai and Reyes, that are a particular case when $\kappa =\omega $, when property T is trivially satisfied. This result is essentially a completeness theorem for a certain infinitary logic that we call $\kappa $ -geometric, where conjunctions of less than $\kappa $ formulas and existential quantification on less than $\kappa $ many variables is allowed. We prove that $\kappa $ -geometric theories have a $\kappa $ -classifying topos having property T, the universal property being that models of the theory in a Grothendieck topos with property T correspond to $\kappa $ -geometric morphisms into that topos. Moreover, we prove that $\kappa $ -separable toposes occur as the $\kappa $ -classifying toposes of $\kappa $ -geometric theories of at most $\kappa $ many axioms in canonical form, and that every such $\kappa $ -classifying topos is $\kappa $ -separable. Finally, we consider the case when $\kappa $ is weakly compact and study the $\kappa $ -classifying topos of a $\kappa $ -coherent theory, that is, a theory where only disjunction of less than $\kappa $ formulas are allowed, obtaining a version of Deligne’s theorem for $\kappa $ -coherent toposes from which we can derive, among other things, Karp’s completeness theorem for infinitary classical logic. The IOC and WADA have announced their ambition to develop control program in order to detect athletes' illegitimate use of genetic technology for enhancing performance. Although it is far from clear what such uses should be counted as illegitimate, as well as to what extent the idea of control programs for such things is a feasible idea, I will assume that such programs will concern so-called somatic genetic modifications that aims at altering the athlete's initial bodily biochemistry in a way (...) that may enhance performance without the presence of any medical reason for undertaking such modifications. This means that the envisioned control-program will have to make use of the method of genetic testing in order to detect the possible presence (or non-presence) of various genetic variants within the athlete. As a consequence of this, several ethical issues familiar within the field of genetic testing for health purposes are suddenly actualised within the area of doping control. These issues concern primarily how to handle and communicate the information about the athlete that is uncovered by such testing. However, due to the ways in which gene doping may be performed, in the case of atheletic control programs, issues of medical safety and the question of what hardships it is reasonable to require of athletes to endure also become paramount. As a consequence, one may ask whether or not sporting ethics will have to consider applying the rule of informed consent in connection to testing programs of the kind here discussed. (shrink)

When can we say that a debt crisis has been resolved fairly? An often overlooked but very important effect of financial crises and the debts that often engender them is that they can lead the crisis countries to increased dependence on international institutions and the policy conditionality they require in return for their continued support, limiting their capabilities and those of their citizens to exercise meaningful control over their policies and institutions. These outcomes have been viewed by many not merely (...) as extremely unfortunate and regrettable, but also as deeply unfair. And indeed, increasingly potent popular movements have pressured governments, financial institutions, and the financial community to seek what they take to be fairer solutions to debt crises. The merits of these programs and proposals for dealing more fairly with sovereign debt remain hotly disputed. In this essay, we try to take a step back from the political fray and examine some more fundamental considerations that seem relevant to assessing the fairness of current arrangements governing economic exchanges related to debt contracts and alternatives that have been proposed to them.Our discussion is organized into seven sections. First, we characterize briefly the concept of fairness and its role in social evaluation. Second, we clarify what sovereign debt is, and, third, the ethical statuses that particular sovereign debts can have. Fourth, we identify and describe the main features of current practices related to sovereign debt. Fifth, we describe an "ideal picture" of creditor/debtor relations. We argue that in such a scenario a broad range of ethical considerations can plausibly be invoked in support of practices that closely resemble those presently governing sovereign debt. Sixth, we draw attention to the many ways in which in reality the relations between sovereign debtors and their creditors differ markedly from the relationships between the creditor and debtor in the ideal picture. Because of this, many of the ethical considerations that would support present practices were relations between sovereign debtors and their creditors to resemble more closely those depicted in the ideal picture fail to do so under present circumstances. We conclude, moreover, that the remaining ethical considerations that might be advanced in support of the present system are at best quite inconclusive. Finally, we describe briefly specific reform proposals to current practices. While we will not attempt to show that these proposals would necessarily make the rules governing economic exchanges relevant to sovereign debt more fair, we conclude, in light of our earlier analysis, that they must be given much more serious consideration than they have so far received in policy circles. Indeed, there are strong prima facie reasons to believe that some combination of these proposed policies might prevent or mitigate some of the most ethically regrettable outcomes of present practices and norms by changing the incentives of sovereign borrowers and those who lend to them. This article analyzes the way in which individual moral commitment is treated in John Rawls's theory of justice. It starts with the central distinction between rational and reasonable and divides the notion of « compliance » into several components. Next to a minimal form of compliance, there is a weak form of adhesion and a strong one. Various maxims for individual behavior are discussed, corresponding to various degrees of moral demandingness. Most accounts of welfare aggregation in the tradition of Arrow's and Sen's social-choice-theoretic frameworks represent the welfare of an individual in terms of a single welfare ordering or a single scalar-valued welfare function. I develop a multidimensional generalization of Arrow's and Sen's frameworks, representing individual welfare in terms of multiple personal welfare functions, corresponding to multiple 'dimensions' of welfare. I show that, as in the one-dimensional case, the existence of attractive aggregation procedures depends on certain informational assumptions, specifically about the (...) measurability of welfare and its comparability not only across individuals but also across dimensions. I state several impossibility and possibility results. Under Arrow-type conditions, insufficient comparability across individuals leads to dictatorship of a single individual, while insufficient comparability across dimensions leads to dominance of a single dimension. Given sufficient comparability both across individuals and across dimensions, a range of possibilities emerges. I discuss the substantive implications of the results. (shrink)

Condorcet’s voting paradox shows that pairwise majority voting may lead to cyclical majority preferences. In a famous paper, Sen identified a general condition on a profile of individual preference orderings, called triplewise value-restriction, which is sufficient for the avoidance of such cycles. This note aims to make Sen’s result easily accessible. We provide an elementary proof of Sen's possibility theorem and a simple reformulation of Sen’s condition. We discuss how Sen’s condition is logically related to a number of precursors. Finally, (...) we state a necessary and sufficient condition for the avoidance of cycles, and suggest that, although there is still some logical space between that condition and Sen’s sufficient condition, Sen’s condition cannot be further generalized in an appealing way. The ArgumentThis essay describes the emergence and stabilization in French and English experimental accounts, in second half of the seventeenth century, of the narrative sequence: X did (some process in the laboratory) and X saw (something happen), where X stands for a pronoun, I or we in English,je, nousoronin French. Focussing on the French case, it shows how the use of the collective pronounonin the experimental accounts registered in the files of the Académie des Sciences is directly related to the (...) will of this newly created institution to assert a collective authority on the production and legitimization of experimental matters-of-fact produced in the laboratory. It is argued, through the case of the discovery of the blind spot in the eye by Mariotte, that this new narrative form imbeds a construal of the experiment as a public spectacle, and of the proof as a witnessing event, which eludes the Academy's attempts to monopolize the process of fact validation and favors the diffusion and display of experiments in front of larger audiences. The question of whether a privileged witness such as the King of France who patronized the Academy could not have constituted by himself a suitable audience to ensure a full legitimization of experimental matters-of-fact while remaning within the bounds of academic practices is addressed. It is answered in the negative by providing evidence for the lack of interest of the absolute monarch in experiments. On the other hand, the outdoor practices of observation and measurement are shown to interfere in a constructive manner with the absolutist power and to capture the attention of the absolutist monarch, where laboratory experiments had failed. It is proposed that natural philosophers in the early modern period bear the burden of proof in buying credibility for the phenomena they try, by paying a tribute to the standing of the patrician elites that witness their experiments. This makes sense in a straightforward manner of the lack of interest of the King of France in a practice which exalts the power of the very group he is trying hard to control through the absolutist structure of power. A central problem of democracy is the aggregation of divergent individual inputs into overall collective decisions. Social-choice-theoretic impossibility results famously demonstrate the intractability of a large class of such aggregation problems. This paper develops a taxonomy of two concepts of agreement, agreement at a substantive level and agreement at a meta-level, and discusses the escape-routes these concepts open up from the impossibility problems of social choice. Specifically, two contexts of democratic aggregation are addressed: first, the familiar context of preferences, and (...) second, the largely unexplored context of sets of judgments over multiple interconnected propositions. Drawing on some recent developments in social choice theory and democratic theory, I will defend the view that, when agreement is conceptualized in democratic theory and when it is sought in democratic practice, more emphasis should be placed on agreement at a meta-level than is commonly done. Finally, I will address the more general question to what extent it is acceptable for the stability of institutions for democratic aggregation to be dependent on specific empirical contingencies. This paper argues that the question of the compatibility between competition and solidarity needs to be clarified by distinguishing a variety of possible normative frameworks. Using a core metaphor of a race between runners hired by stadiums, I develop and discuss three ethical frameworks: the emergentist perspective, which considers that competition is in itself the locus of solidarity; the social-democratic perspective, which views solidarity as the main counterweight to the abrasive effects of competition – without, however, calling into question the (...) system that generates this competition; and the oppositional perspective, which considers solidarity as an implication of the desire to assist the victims of asymmetrical social power, unfairly distributed through competition, and therefore sees ‘genuine’ solidarity as a means to subvert competitive logic itself. In each case, I deconstruct the fundamental ‘axioms’ that underlie the approach, and I gradually demonstrate why there are compelling ethical arguments for a radical subversion of the logic of competition within a framework of ‘genuine’ solidarity. Thus, while the social-democratic perspective trumps the emergentist perspective, it is in turn trumped by the oppositional perspective. The basic idea is that competition which is statically fair, tends to become dynamically unfair, revealing a deep-lying source of structural alienation. This requires a renewed view of the nature of agents’ rationality, however, and an abandonment of some cherished beliefs and prejudices concerning the alleged fairness of competition in market economies.
