This important new book by one of the world's leading political theorists boldly questions the moral justification for organizing our world as a territorial states-system and proposes major changes to states' sovereign powers.

This paper argues that the function of moral education in the biomedical context should be exactly the same as in a general, philosophical framework: it should not provide ready-to-use kits of moral principles; rather, it must show the history, epistemology and conceptual structure of moral theories that would enable those who have to make decisions to be as informed and as responsible as possible. If this complexity cannot be attained, an incomplete product—i.e. bioethics or bioethical principles—should not be seen as (...) a viable substitute. This theoretical position is subsequently illustrated by a case study involving research ethics committees. It is argued that within these committees, that are carefully formed multidisciplinary bodies, what makes competent decision-making possible is not a bioethical theory, nor even a sound philosophical ethics, but the dynamics of the discussion of a number of experts coming from different disciplines. This multidisciplinary expertise is necessary and sufficient to undertake the challenges of complex decisions in the biomedical context. (shrink)

Many political theorists today deny that citizenship can be defended on liberal grounds alone. Cosmopolitans claim that loyalty to a particular state is incompatible with universal liberal principles, which hold that we have equal duties of justice to persons everywhere, while nationalist theorists justify civic obligations only by reaching beyond liberal principles and invoking the importance of national culture. In Liberal Loyalty, Anna Stilz challenges both views by defending a distinctively liberal understanding of citizenship. Drawing on Kant, Rousseau, and (...) Habermas, Stilz argues that we owe civic obligations to the state if it is sufficiently just, and that constitutionally enshrined principles of justice in themselves--rather than territory, common language, or shared culture--are grounds for obedience to our particular state and for democratic solidarity with our fellow citizens. She demonstrates that specifying what freedom and equality mean among a particular people requires their democratic participation together as a group. Justice, therefore, depends on the authority of the democratic state because there is no way equal freedom can be defined or guaranteed without it. Yet, as Stilz shows, this does not mean that each of us should entertain some vague loyalty to democracy in general. Citizens are politically obligated to their own state and to each other, because within their particular democracy they define and ultimately guarantee their own civil rights. The concept of “enhypostaton” was introduced into theological discourse during the sixth-century Christological debates with the aim of justifying the unitary subjectivity of Christ by reclassifying Christ’s human nature as ontically non-independent. The coinage of the term is commonly ascribed to Leontius of Byzantium. Its conceptual content has been recognized by contemporary scholarship as relevant to the core issues of Christology, as well as possessing significance for such philosophical questions as individuation and the nature of individual entityhood. Even so, despite (...) its role in the formation of classical Christological thought, the notion of “enhypostaton” is often regarded as obscure and not clearly defined. Les juristes ont trouvé en Internet, en particulier sur les blogs, un lieu d'information et d'échange où ils peuvent se dédier aux sujets qui les intéressent . Les multiples démarches qu'ils ont initiées au sein du Réseau ont (...) abouti à une mobilisation des moyens numériques, permettant de mieux communiquer et informer sur le système légal et judiciaire chinois. Leur utilisation d'Internet a-t-elle catalysé l'initiative personnelle des utilisateurs et mobilisé l'opinion publique ? Cet article s'attache à démontrer comment par le biais d'Internet les avocats ont pu être des acteurs du développement de la société civile et participer ainsi à l'émergence d'une « communauté de critères » relevant du droit.Nowadays, lawyers and jurists Chinese are very fond of the Internet. However, their use of the Internet has not yet been investigated. This article will provide a new perspective on the relationship between lawyers, surfers and Chinese civil society. Lawyers found in the Internet, especially on blogs, a place to exchange information and where they can devote themselves to topics that interest them . Multiple steps they have initiated within the network led to a mobilization digital means to better communicate and inform the Chinese legal and judicial system. Internet use did catalyzed users personal initiative and mobilized public opinion? This article aims to demonstrate how through Internet lawyers have been involved in development of civil society and thus contribute to the emergence of a "community standards" under the law. In this article I explore partial ectogenesis through the lens of choice in childbirth, framing it as a mode of delivery. In doing so, I refocus discussion about partial ectogenesis, ensuring that this centers upon the autonomy and rights of the birthing person—as the procedure required to facilitate external gestation will be performed upon their body. By drawing a critical comparison between “delivery by partial ectogenesis” and request cesarean sections, I argue that delivery by partial ectogenesis ought to be available (...) on the basis of the pregnant person’s request alone. We agree with van der Pijl et al that the question of how to ensure consent is obtained for procedures which occur during labour and childbirth is vitally important, and worthy of greater attention.1 However, we argue that the modified opt-out approach to consent outlined in their paper may not do enough to protect the choice and agency of birthing people. Moreover, while their approach reflects a pragmatic attempt to facilitate legal clarity and certainty in this context, this is not (...) necessarily responsive to the messy realities of decision-making during labour (and beyond). We outline some of our concerns with their proposals and demonstrate how these illuminate some broader, longstanding tensions around consent and medical law. The authors place significant focus on the particularities of labour, outlining six ways in which maternity care is ‘unlike the usual healthcare setting’ (van der Pijl M et al,1p4). We support the need for attentiveness to these particularities and the problematic nature of consent in this context. Recent scholarly attention on the possible ‘political, ethical and theoretical implications and meanings of birthing embodiment’ (Chadwick R,2p2) has invited more nuanced conversation about consent, agency and decision-making during labour. However, while recognising the embodied particularities of labour, we must also avoid essentialising the differences of labouring bodies and thereby reinforcing exclusionary norms of consent. Following media-theoretical studies that have characterized digitization as a process of all-encompassing cybernetization, this paper will examine the timely and critical potential of Günther Anders’s oeuvre vis-à-vis the ever-increasing power of cybernetic devices and networks. Anders has witnessed and negotiated the process of cybernetization from its very beginning, having criticized its tendency to automate and expand, as well as its circular logic and ‘integral power’, including disruptive consequences for the constitution of the political and the social. In this vein, Anders’s (...) works, particularly his magnum opus Die Antiquiertheit des Menschen [The Obsolescence of Man], sheds new light on the technologically organized milieus of the contemporary digital regime and also highlights a new form of cybernetic ‘conformism’. The goal of the essay is therefore, not only to emphasize the contemporary nature of Anders’s thought but also to use it to frame a critique of current neo-technocratic and, ultimately, post-political concepts, such as ‘algorithmic regulation’, ‘smart states’, ‘direct technocracy’, and ‘government as platform’. This essay argues that cybernetic capitalism is causing what Anders terms ‘ Unfestgelegtheit’ to disappear; that is, we are losing the originary possibility of technologically (re-)structuring our world in alternative ways, particularly given the determinist character of current technologies. This commentary argues that the question of metalanguage is a key issue in emotion research. Izard (2010) ignores this issue (and all the earlier literature relating to it, including the debate in Emotion Review, 2009, 1[1]), and thus falls into the old traps of circularity, obscurity, and ethnocentrism. This commentary rejects Izard’s claim that “emotion” defies definition, and it offers a viable definition of “emotion” formulated in simple and universal human concepts, using the English version of the universal conceptual lingua (...) franca called Natural Semantic Metalanguage (NSM). Once again, this commentary draws attention to the centrality of the question of language in emotion research. (shrink)

Computational explanations focus on information processing required in specific cognitive capacities, such as perception, reasoning or decision-making. These explanations specify the nature of the information processing task, what information needs to be represented, and why it should be operated on in a particular manner. In this article, the focus is on three questions concerning the nature of computational explanations: What type of explanations they are, in what sense computational explanations are explanatory and to what extent they involve a special, “independent” (...) or “autonomous” level of explanation. In this paper, we defend the view computational explanations are genuine explanations, which track non-causal/formal dependencies. Specifically, we argue that they do not provide mere sketches for explanation, in contrast to what for example Piccinini and Craver :283–311, 2011) suggest. This view of computational explanations implies some degree of “autonomy” for the computational level. However, as we will demonstrate that does not make this view “computationally chauvinistic” in a way that Piccinini or Kaplan :339–373, 2011) have charged it to be. (shrink)

Those giving birth within modern maternity systems are recognised as facing a number of barriers to person-centred care. In this paper, I argue that in order to best facilitate the conditions for positive change, work needs to be done to provide a more granular articulation of the specific barriers. I then offer a nuanced and contextually aware articulation of one key component of the overall failure to ensure person-centred care: medical authority and the expectation of conformity. Articulating these barriers with (...) increased specificity is valuable, as it creates a stronger foundation from which to challenge existing problems which serve to constrain the autonomy of birthing individuals. The analysis offered in this paper also underscores the need for change at an institutional, rather than individual, level. (shrink)

On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

Fetal surgery has been practised for some decades now. However, it remains a highly complex area, both medically and ethically. This paper shows how the routine use of ultrasound has been a catalyst for fetal surgery, in creating new needs and new incentives for intervention. Some of the needs met by fetal surgery are those of parents and clinicians who experience stress while waiting for the birth of a fetus with known anomalies. The paper suggests that the role of technology (...) and visualisation techniques in creating and meeting such new needs is ethically problematic. It then addresses the idea that fetal surgery should be restricted to interventions that are life-saving for the fetus, arguing that this restriction is unduly paternalistic. Fetal surgery poses challenges for an autonomy-based system of ethics. However, it is risky to circumvent these challenges by restricting the choices open to pregnant women, even when these choices appear excessively altruistic. (shrink)

The purpose of this phenomenological-hermeneutic study was to illuminate the meaning of being in ethically difficult care situations. The participants were 20 enrolled nurses employed in six intensive care units in Sweden. The results reveal a complex human process manifested in relation to one’s inner self and the other person, which transforms desolation into consolation through becoming present to the suffering other when perceiving fragility rather than tragedy. The main point of significance here is for all health professionals to create (...) an ethical work environment and strive for praxis that fosters ‘athomeness’, which renders us free to transform desolation into consolation. Consolation is of significance in ethics because it makes us available and helps us to fulfil the demands of life, while desolation makes us unavailable to others. (shrink)

While John Tomasi's Free Market Fairness is ambitious, provocative, and does much to reinvigorate debate about economic justice, his argument for market democracy is not compelling. I discuss two objections. First, I offer doubts about whether “thick” economic freedom is a condition of democratic legitimacy. While Tomasi raises the intriguing possibility that liberal commitments may justify a somewhat more expansive list of economic rights than traditionally recognized, he fails to give a well-worked-out account of these rights. Instead, he argues for (...) unfettered economic liberty without adequately connecting it to citizens' self-authorship, or showing how it could feasibly be protected alongside other basic liberties. Second, I argue that a concern for citizens' agency and economic self-authorship should lead us to endorse a social-democratic regime, not a market-democratic one. Market democracy leaves out or heavily revises key aspects of justice as fairness as developed by Rawls, including fair equality of opportunity and the fair value of the political liberties. Moreover, while Tomasi claims that social democracy rests on a perfectionist prioritizing of citizens' status over their agency, I argue that social democracy is best defended on agency-based grounds. From a socio-theoretical and media-theoretical perspective, this article analyses exemplary practices and structural characteristics of contemporary digital political campaigning to illustrate a transformation of the public sphere through the platform economy. The article first examines Cambridge Analytica and reconstructs its operational procedure, which, far from involving exceptionally new digital campaign practices, turns out to be quite standard. It then evaluates the role of Facebook as an enabling ‘affective infrastructure’, technologically orchestrating processes of political opinion-formation. Of special concern are various tactics (...) of ‘feedback propaganda’ and algorithmic-based user engagement that reflect, at a more theoretical level, the merging of surveillance-capitalist commercialization with a cybernetic logic of communication. The article proposes that this techno-economic dynamic reflects a continuation of the structural transformation of the public sphere. What Jürgen Habermas had analysed in terms of an economic fabrication of the public sphere in the 1960s is now advancing in a more radical form, and on a more programmatic basis, through the algorithmic architecture of social media. As the authors argue, this process will eventually lead to a new form of ‘infrastructural power’. (shrink)

Empathy is commonly regarded as an essential attribute for doctors and there is a conviction that empathy must be taught to medical students. Yet it is not clear exactly what empathy is, from a philosophical or sociological point of view, or whether it can be taught. The meaning, role and relevance of empathy in medical education have tended to be unquestioningly assumed; there is a need to examine and contextualise these assumptions. This paper opens up that debate, arguing that ‘empathy’, (...) as it is commonly understood, is neither necessary nor sufficient to guarantee good medical or ethical practice. (shrink)

Unlike the question of whether self-deception can be understood on the model of other-deception, the relationship between the two phenomena at the level of practice is hardly ever explored. Other-deception can support self-deception and vice versa. Self-deception often affects not only the beliefs and behavior of the self-deceiving person but also the beliefs and behavior of others who may become accomplices of self-deception. As I will show, however, it is difficult to describe this supportive relationship between self-deception and the deception (...) of others without conceptual contradiction. While “deflationary” approaches offer a convincing way to avoid the so-called paradoxes of self-deception, they do not resolve the conceptual tensions that arise here. Abstractabstract There are estimated to be five million vegetarians in the United Kingdom and another four million in the United States. There are numerous vegetarians elsewhere in the world: around fifteen million, for instance, in India. Some of these vegetarians are parents. And some of the vegetarian parents will bring up their children to be vegetarian, too. Is this a permissible course of action? Or should vegetarian parents raise omnivorous offspring? In this article, I consider three arguments that aim to (...) show that a parent should not raise a child on a vegetarian diet. None of these arguments are convincing and I know of no better ones — so I conclude that it is permissible for a parent to raise her child as a vegetarian. (shrink)

For most people, animals are the most significant aspects of the nonhuman world. They symbolize nature in our imaginations, in popular media and culture, and in campaigns to preserve wilderness, yet scholars habitually treat animals and the environment as mutually exclusive objects of concern. Conducting the first examination of animals' place in popular and scholarly thinking about nature, Anna L. Peterson builds a nature ethic that conceives of nonhuman animals as active subjects who are simultaneously parts of both nature (...) and human society. Peterson explores the tensions between humans and animals, nature and culture, animals and nature, and domesticity and wildness. She uses our intimate connections with companion animals to examine nature more broadly. Companion animals are liminal creatures straddling the boundary between human society and wilderness, revealing much about the mutually constitutive relationships binding humans and nature together. Through her paradigm-shifting reflections, Peterson disrupts the artificial boundaries between two seemingly distinct categories, underscoring their fluid and continuous character. (shrink)

It is estimated that over 800 million people are hungry each day and two billion are suffering from the consequences of vitamin and mineral deficiencies. While a paradigm shift towards a multi-dimensional and multi-sectoral approach to food and nutrition insecurity is emerging, technical approaches largely prevail to tackle the causes of hunger and malnutrition. Founded in original in-depth field research among smallholder farmers in southwest Kenya, we argue that incorporating cultural or social dimensions in this technical debate is imperative and (...) that by systematically overlooking these dimensions, food insecurity cannot be accurately captured nor properly addressed. Based on a sub-location in rural southwest Kenya where the food plate is rapidly narrowing towards a high-calorie low nutrient diet and where over 80 % of households experience food shortages at least once a year, conclusions suggest that preferences, the local function of food, and the practices that emerge therefrom can affect the regularity of meals and their composition. The findings allow us to complement emerging research and program development with a more comprehensive and locally adapted approach to tackle food and nutrition insecurity. (shrink)

In this paper, I will explore ideas advanced by Bradshaw, Pence and others who have written on compassion in healthcare. I will attempt to see how and whether their assumptions about compassion can be justified, and explore the role compassion should play in a modern healthcare system. I will justify scepticism at the idea of attempting to incentivise compassion through metrics. The Francis Report raises important questions concerning the nature of a healthcare system that harms rather than helps patients. If (...) something is failing in modern healthcare, those in charge should naturally seek to remedy it. I will investigate whether this is due to the disappearance of compassion, and if so, what is it that is emerging to fill its place. I will consider whether we need to rehabilitate or enforce compassion in the system, or to acknowledge that our modern healthcare systems are incompatible with compassion and how we can make the best of what remains. Recent frameworks, models, and reports highlight the critical need to address social determinants of health for achieving health equity in the United States and around the globe. In the United States, data play an important role in better understanding community‐level and population‐level disparities particularly for local health departments. However, data‐driven decision‐making—the use of data for public health activities such as program implementation, policy development, and resource allocation—is often presented theoretically or through case studies in the literature. We sought to develop (...) a preliminary model that identifies the factors that contribute to data‐driven decision‐making in US local health departments and describe relationships between them. Guided by implementation science literature, we examined organizational‐level capacity and individual‐level factors contributing to using data for decision‐making related to social determinants of health and the reduction of county‐level disparities. This model has the potential to improve implementation of public health interventions and programs aimed at upstream structural factors, by elucidating the factors critical to incorporating data in decision‐making.
