In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval notion (...) of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

Editorial introduction to the special issue of the European Journal of Analytic Philosophy.

The SynBioSecurity argument says that synthetic biology introduces new risks of intentional misuse of synthetic pathogens and that, therefore, there is a need for extra regulations and oversight. This paper provides an analysis of the argument, sets forth a new version of it, and identifies three developments that raise biosecurity risks compared to the situation earlier. The developments include a spread of the required know-how, improved availability of the techniques, instruments and biological parts, and new technical possibilities such as “resurrecting” (...) disappeared pathogens. It is first shown that the general argument from SynBioSecurity needs to be qualified and that many improvements to biosecurity have already been implemented, most notably in the United States. Second, I suggest a new strain of the argument: the situation that most branches of synthetic biology fall under the gene technology regulation in the European Union and that this regulation in its current form does not adequately address SynBioSecurity risks together provide a weighty reason to review and possibly refine the legislation as well as the supervisory practices. Ethically speaking, the rise in the relative risk of bioterrorism brings to the fore new extrinsic issues. (shrink)

Gilbert's kisceral argumentation is, roughly speaking, about arguing based on intuitions. In the forefront of such a (rhetorical) model are arguers and audiences, who resolve disagreements using kisceral arguments. Intuitions as reasons were more important in pre-modern law, when the law was not as explicit, precise, and determinate as today. Law influenced by religion or religious law was a typical example. In our much more secular modern era, intuitions are more or less subordinated to the (legal) logical mode of arguing. (...) However, in tough legal cases, when logic "runs out," it is values that decide them. Not surprisingly, neuroscience and cognitive psychology have shown a strong connection between values and intuition. (shrink)

We prove, by a probabilistic argument, that a class of ω-categorical structures, on which algebraic closure defines a pregeometry, has the finite submodel property. This class includes any expansion of a pure set or of a vector space, projective space or affine space over a finite field such that the new relations are sufficiently independent of each other and over the original structure. In particular, the random graph belongs to this class, since it is a sufficiently independent expansion of an (...) infinite set, with no structure. In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

The aim of this work is to show, first of all, how landscape cannot but stand out on the horizon of a cognitive flux that affects every aspect of our being in the world (or, better said, of our being in the world) world). A special role will be reserved for aesthetic mediation, to be understood as a n act that regulates the epistemic negotiation between what is in the center and what is ”in the surroundings”. In this sense, the (...) work will start from bio cognitive assumptions on the species specific ways in which an organism circumscribes and enriches its world, and will then finally arrive at considerations that should, in our hopes, demonstrate how aisthesis is, in fact, the conceptual category that best lends itself to describing this process, in virtue of the particular gnoseological value it assigns to the se nsitive body and its extension extension. Motivated by the analogy which holds within the context of discovery between mathematics and physics, we aim to show that there is a connection between two fields within the context of justification too. Based on the careful analysis of examples from science (especially within the domain of physics) we suggest that the logic of scientific research, which might appear as enumerative induction, is deduction, and we propose it to be universal generalization inference rule. Ovaj ogled razmatra kritiku Kjerkegorovog ucenja o egzistenciji, koju je izneo Teodor V. Adorno u svom habilitacionom spisu Kjerkegor. Konstrukcija estetskog. Polazeci od ove filozofije, Adorno iznosi osnovnu tezu da je Kjerkegor, suprotno svojoj osnovnoj nameri suprotstavljanja Hegelovoj ontologiji, upravo idealista i da sa njegovim radikalnim personalizmom idealisticka filozofija dolazi u poznu fazu dezintegracije. Kjerkegorovo ucenje o?unutrasnjosti bez objekta? pokazuje nerazresive protivrecnosti, ali u fazi?raspadanja? na figurativan nacin otkriva i svoju istorijsku istinu da je on duhovni izraz individualizma gradjanskog doba (...) i otudjenja coveka u modernom drustvu. To otudjenje Kjerkegor vidi kao gubitak?smisla?, koji se ponovo moze zadobiti jedino u veri. Adorno preokrece ovo stanoviste misleci da se Kjerkegorova filozofija najvise priblizava njenoj istini ne u religioznom iskustvu, nego u estetskom. Trazeni smisao se ne moze ponovo pronaci skokom u transcendentno, vec u estetskoj sferi, gde je on utopijski, jer nagovestava privid pomirenog stanja izmedju coveka i prirode. (shrink)

In their 2010 paper, Dizadji-Bahmani, Frigg, and Hartmann argue that the generalized version of the Nagel–Schaffner model that they have developed is the right one for intertheoretic reduction, i.e. the kind of reduction that involves theories with largely overlapping domains of application. Drawing on the GNS, DFH presented a Bayesian analysis of the confirmatory relation between the reducing theory and the reduced theory and argued that, post-reduction, evidence confirming the reducing theory also confirms the reduced theory and evidence confirming the (...) reduced theory also confirms the reducing theory, which meets the expectations one has about theories with largely overlapping domains. In this paper, I argue that the Bayesian analysis presented by DFH faces difficulties. In particular, I argue that the conditional probabilities that DFH introduce to model the bridge law entail consequences that run against the GNS. However, I also argue that, given slight modifications of the analysis that are in agreement with the GNS, one is able to account for these difficulties and, moreover, one is able to more rigorously analyse the confirmatory relation between the reducing and the reduced theory. The article explores the specific conception of art developed by Danko Grlić, a prominent member of the Yugoslav Praxis School. Grlić conceptualised art beyond both aesthetic norms and technological determinism. Within the context of praxis philosophy, a distinct theory of the subject and a Marxist humanist approach, he reconceptualised art as a distinct type of praxis, a revolutionary and creative practice of changing existing living conditions. The article explains how his unique understanding of art leads Grlić to analyse, criticise and (...) refute various Marxist approaches to art: art as an ideology, art as a reflection of the objective world, art as sociological analysis. Moreover, while sharing many ideas and conceptions with Walter Benjamin’s materialist conception of art, Grlić reached the point where he became critical due to Benjamin’s belief in technology concerning processes of emancipation, which Grlić viewed with scepticism. In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It guides users through the assembly process and provides (...) explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

Background and Aims: The COVID-19 pandemic has led to radical and unexpected changes in everyday life, and it is plausible that people’s psychophysical health has been affected. This study examined the relationship between COVID-19 related knowledge and mental health in a Croatian sample of participants.MethodsAn online survey was conducted from March 18 until March 23, 2020, and a total of 1244 participant responses were collected. Measures included eight questions regarding biological features of the virus, symptoms, and prevention, the Hospital Anxiety (...) and Depression Scale, and Optimism-Pessimism Scale. According to the answers given on the questions on COVID-19 related knowledge, participants were divided in two groups: informed and uninformed on each question. They were then compared in the expressed levels of anxiety, depression, pessimism, and optimism. Full vs. partial mediation models with optimism/pessimism as a mediator in the relationship between anxiety/depression and the accuracy of responses for questions about handwashing and ways of transmission were estimated.ResultsParticipants who responded correctly on the question about handwashing had higher levels of anxiety, depression, and pessimism than those participants whose answer was incorrect, while participants who answered correctly on the question about the percentage of patients who develop serious breathing problems had higher levels of depression than those who answered incorrectly. Lower levels of anxiety and pessimism were observed in the participants who answered correctly about ways of transmission. Higher levels of pessimism were found in participants who scored incorrectly on questions about the efficiency of antibiotics, most common symptoms, and the possibility of being infected by asymptomatic carriers. Higher levels of knowledge about handwashing were predicted by higher levels of anxiety and pessimism. Higher levels of knowledge about ways of transmission were predicted by lower levels of anxiety and lower levels of pessimism. The examined relationships between anxiety/depression and knowledge were mediated by pessimism.ConclusionThe findings of this study suggest that knowledge about COVID-19 may be useful to reduce anxiety and depression, but it must be directed to the promotion of health behaviors and to the recognition of fake news. In their paper “Is psychopathy a mental disease?”, Thomas Nadelhoffer and Walter Sinnott-Armstrong argue that according to any plausible account of mental disorder, neural and psychological abnormalities correlated with psychopathy should be regarded as signs of a mental disorder. I oppose this conclusion by arguing that at least on a naturalistically grounded account, such as Wakefield’s ‘Harmful Dysfunction’ view, currently available empirical data and evolutionary considerations indicate that psychopathy is not a mental disorder.

What exactly is reasoning? While debate on this question is ongoing, most philosophers seem to agree on at least the following: reasoning is a mental process operating on contents, which consists in adopting or revising some of your attitudes in light of others. In this paper, I argue that this characterisation is mistaken: there is no single mental phenomenon that satisfies both of these conditions. Instead, I characterise two distinct mental phenomena, which I call ‘deducing’, on the one hand, and (...) ‘reasoning’ or ‘inference’ on the other, to play each of these roles. Recognising this division of labour is essential to developing a better understanding of our rational economy. (shrink)

Psychopathy, executive functions, and neuropsychological data: a response to Sifferd and Hirstein.

According to current orthodoxy in the philosophy of action, intentional actions consist in intrinsically mindless bodily movements that stand in causal relations to appropriate mental states. This paper challenges this approach to intentional action, by arguing that there are not enough appropriate mental states around to ‘animate’ all of the bodily movements we intuitively count as intentional actions. In the alternative picture I suggest, the bodily movements that constitute our intentional actions are themselves to be thought of as cognitive events, (...) embodying our grasp of ways of acting. Recently it has been argued that certain neuropsychological findings on the decision-making, instrumental learning, and moral understanding in psychopathic offenders offer reasons to consider them not criminally responsible, due to certain epistemic and volitional impairments. We reply to this family of arguments, that collectively we call the irresponsibility of the psychopath argument. This type of argument has a premise that describes or prescribes the deficiencies that grant or should grant partial or complete criminal exculpation. The other premise contends that neuropsychological (...) evidence shows that psychopaths have incapacitates that are sufficient to ascribe complete or partially exculpatory deficiencies. The focus of our criticism is this latter premise. We argue that it requires that psychopathy should correlate significantly with certain rational incapacities that manifest across contexts. We show that the available neuropsychological data do not support the claim that psychopaths have such general exculpatory incapacities. (shrink)

The prediction error minimization framework denotes a family of views that aim at providing a unified theory of perception, cognition, and action. In this paper, I discuss some of the theoretical limitations of PEM. It appears that PEM cannot provide a satisfactory explanation of motivated reasoning, as instantiated in phenomena such as self-deception, because its cognitive ontology does not have a separate category for motivational states such as desires. However, it might be thought that this objection confuses levels of explanation. (...) Self-deception is a personal level phenomenon, while PEM offers subpersonal explanations of psychological abilities. Thus, the paper examines how subpersonal explanations couched in the PEM framework can be thought of as related to personal level explanations underlying self-deception. In this regard, three views on the relation between personal and subpersonal explanations are investigated: the autonomist, the functionalist, and the co-evolutionary perspective. I argue that, depending on which view of the relation between the personal and subpersonal is adopted, the PEM paradigm faces a dilemma: either its explanatory ambitions should be reduced to the subpersonal domain, or it cannot provide a satisfactory account of motivated reasoning as instantiated in self-deception. The “histone code” conjecture of gene regulation is our point of departure for analyzing the interplay between the (quasi)digital script in nucleic acids and proteins on the one hand and the body on the other, between the recorded and organic memory. We argue that the cell’s ability to encode its states into strings of “characters” dramatically enhances the capacity of encoding its experience (organic memory). The harm usually associated with psychopathy requires therapeutically, legally, and ethically satisfactory solutions. Scholars from different fields have, thus, examined whether empirical evidence shows that individuals with psychopathic traits satisfy concepts, such as responsibility, mental disorder, or disability, that have specific legal or ethical implications. The present paper considers the less discussed issue of whether psychopathy is a disability. As it has been shown for the cases of the responsibility and mental disorder status of psychopathic individuals, we argue that it (...) is undecided whether psychopathy is a disability. Nonetheless, based on insights from disability studies and legislations, we propose that interventions to directly modify the propensities of individuals with psychopathic tendencies should be balanced with modifications of the social and physical environments to accommodate their peculiarities. We also suggest how this social approach in some practical contexts that involve non-offender populations might be effective in addressing some of the negative effects of psychopathy. (shrink)

In the paper, I examine the conditions that are necessary for the correct characterization of the phenomenon of self-deception. Deflationists believe that the phenomenon of self-deception can be characterized as a kind of motivationally biased belief-forming process. They face the selectivity problem according to which the presence of a desire for something to be the case is not enough to produce a self-deceptive belief. Intentionalists argue that the solution to the selectivity problem consists in invoking the notion of intention. According (...) to them, self-deception involves intentional distortion of one's own belief-forming process. In this paper, I defend the claim that intentionalists also face the problem of selectivity. Accordingly, I argue that this objection cannot be used to determine which theory of self-deception is superior. Furthermore, I argue that limiting folk-psychological explanations to reason-based explanations might be responsible for the resilience of the selectivity problem. In that context, as an additional explanatory factor, I emphasize personality traits that, along with motives, play an important role in the psychological explanation of human behavior. In the rest of the paper, I explore how such an expanded view of the folk-psychological explanation can be used to better capture individual cases of self-deception. (shrink)

In Prior Analytics 1.27–30, Aristotle develops a method for finding deductions. He claims that, given a complete collection of facts in a science, this method allows us to identify all demonstrations and indemonstrable principles in that science. This claim has been questioned by commentators. I argue that the claim is justified by the theory of natural predication presented in Posterior Analytics 1.19–22. According to this theory, natural predication is a non-extensional relation between universals that provides the metaphysical basis for demonstrative (...) science. (shrink)

Neste artigo, examinaremos a noção de juízo sensível, isto é, o aspecto judicativo que se pode encontrar nos atos da sensação, aspecto esse irredutível ao juízo intelectual. Usaremos como fio condutor uma comparação e contraste entre esse aspecto judicativo e aquele que se encontra na segunda operação do intelecto. Mostraremos que o sentido julga na medida em que reflete parcialmente sobre si mesmo, de modo proporcional àquele em que ocorre uma reflexão completa no complexo predicativo. Esses diferentes tipos de reflexão (...) determinam as diferentes maneiras pelas quais se diz que o intelecto é verdadeiro e que os sentidos são verdadeiros. Com isso, verificaremos que o juízo sensível é indissociável da apreensão sensível na medida em que é constitutivo da própria natureza cognitiva dos sentidos, pois é a fonte do que se pode chamar uma certa consciência sensível. This volume presents a Type Theory of Law (TTL), claiming that this is a unique theory of law that stems from the philosophical understanding of Jung's psychological types applied to the phenomenon of law. Furthermore, the TTL claims to be a universal, general and descriptive account of law. To prove that, the book first presents the fundamentals of Jungian psychological types, as they had been invented by Jung and consequently developed further by his followers. The next part of the book (...) describes how the typological structure of an individual determines their understanding of law. It then addresses the way in which inclusive legal theory can be understood based on this typology. Finally, the book describes the TTL in general and descriptive terms and puts it into context. All in all, the book shows how the integral or inclusive approach to understanding the nature of law is not only in tune with our time, but also relevant for presenting a more persuasive picture of law than the older exclusivist or dualist approaches of strict natural law and rigid legal positivism did. Helpless feeling caused by low self-confidence could turn an athlete using aggressive behavior as alternate behavior in the interaction with the opponent during a game. The level of the aggression can be seen in the injury rate in that particular sport. This research objective is to find out the relation between self-confidence and the appearance of the aggressive behavior in basketball player. It involves 64 athletes in West (...) Jakarta between 17 to 28 years old. Data that was measured by questionnaires has shown there is a negative association between self-confidence and aggressive behavior in basketball athlete.  . Which epistemic value is the standard according to which we ought to compare, assess and design institutional arrangements in terms of their epistemic properties? Two main options are agent development and attainment of truth. The options are presented through two authoritative contemporary accounts-agent development by Robert Talisse?s understanding in Democracy and Moral Conflict and attainment of truth by David Estlund?s treatment, most prominently in Democratic Authority: A Philosophical Framework. Both options are shown to be unsatisfactory because they are subject to (...) problematic risk of suboptimal epistemic state lock-in. The ability of the social epistemic system to revise suboptimal epistemic states is argued to be the best option for a comparative standard in institutional epistemology. nema. (shrink)

This daily diary study examined the within-person coupling between four emotion regulation strategies and both subjective well-being and perceived stress in daily life of geriatric nurses. Participants ( N = 89) described how they regulated their emotions in terms of cognitive reappraisal and suppression. They also indicated their subjective well-being and level of perceived stress each day over 3 weeks. At the within-person level, cognitive reappraisal intended to increase positive emotions was positively associated with higher subjective well-being and negatively associated (...) with perceived stress. Suppression of the expression of positive emotions was negatively associated with subjective well-being and positively associated with perceived stress. However, cognitive reappraisal intended to down-regulate negative emotions and suppression as a strategy to inhibit the expression of negative emotions were not associated with daily well-being or perceived stress. Off-days were rated as days with higher subjective well-being and lower perceived stress in contrast to working days. At the between-person level, individuals who reported more daily negative affect reported increased suppression of positive emotions, corroborating the within-person findings. Moreover, findings indicated that nurses with more years of experience in the job reported higher subjective well-being and less perceived stress. These results provide insights into important daily emotional processes of geriatric nurses, both at workdays and in their leisure time. (shrink)

The concept of the ‘infodemic’ has become a popular explanation for the rejection of anti-COVID-19 crisis governance measures. In this paper, we argue that infodemic is an inherent property of society under free institutions misused to pursue an epistemically vicious political epistemology. Furthermore, we provide an alternative account of political epistemology of COVID-19 governance and popular resistance to it. Namely, we argue that 1) pandemics represent a complex problem, and some level of resistance to governance which restricts liberties while informed (...) by ongoing scientific and political learning processes is inevitable, and 2) the resistance is exacerbated by the history of technocratization of governance and the exclusionary socio-economic inequalities which condition political and epistemic deficiencies easily exploitable by the political entrepreneurs of right-wing populism, particularly under the conditions of social media which gamifies public discourse. Thus, we argue, the correct response to the cultures of rejection of anti-COVID-19 measures is to change the underlying political and economic conditions and not to limit speech or restrict franchise as the infodemic diagnosis suggests. Die Untersuchung gliedert sich in drei durch eine Einführung und eine Schlussbetrachtung eingerahmte Hauptkapitel. Im ersten Hauptkapitel geht es um Kants Raum- und Zeitkonzeption in seiner vorkritischen Phase unter Berücksichtigung seiner Reaktion auf die zeitgenössische Kritik an seiner Konzeption von 1770. Dabei wird Kants komplexer Denkweg hin zu seiner Wende zum Verständnis von Raum und Zeit als reinen Anschauungen thematisiert. Hieran schließt sich im zweiten Hauptkapitel die Behandlung der prominenteren, systematisch ausgereiften Raum- und Zeitkonzeption in der Kritik der reinen Vernunft (...) an, wobei zunächst die unterschiedlichen Argumente aus der transzendentalen Ästhetik sukzessive und unter Einschluss der Forschungsliteratur diskutiert werden und Raum und Zeit als formale Anschauungen in der transzendentalen Analytik sowie als Ideen der Vernunft in der transzendentalen Dialektik zur Sprache kommen. Ein dritter Hauptteil widmet sich Kants Verständnis von Raum und Zeit in der Kritik der Urteilskraft, wo Kants Lehre neue Impulse erfährt und im Kontext der philosophischen Ästhetik, der Kultur sowie des Erhabenen relevant wird. Abschließend wird auf Kants schwieriges Nachlasswerk hinsichtlich der Themen Raum und Zeit eingegangen, das auf die Werke Fichtes und Schellings vorausweist. (shrink)

In this paper, I develop an epistemological argument for freedom from poverty, building on Gerald Gaus’ work on political and moral disagreement in New Diversity Theory (NDT). NDT argues that diversity and disagreement are fundamental to political and moral learning. In this paper, I address Gaus’ central arguments in NDT, and focus on what I argue to be the key epistemological distinction of his account—namely, the argument that the relevant diversity, which is conducive to political and moral learning and should (...) therefore be protected by an institutional order, should not be defended or defined by reference to its performance with regards to discovery of true beliefs, but by reference to the independent epistemic value of protection of disagreeing, redundant and distant investigators. I develop a restatement of this argument from the perspective of institutional epistemology, and show that (along with constitutional liberties, polycentric self-governance and markets) freedom from poverty must be considered an institutional “device” conducive to such a conception of diversity. While Gaus rejects redistributive policies at the level of an institutional order, it is precisely his account of the epistemic powers of diversity and disagreement which provides the strongest defense of minimal redistribution.
