The United Kingdom case R v Lee EWCA Crim 1404 resulted in a pharmacist being convicted for an inadvertent dispensing error and paved way for the decriminalisation of such errors by way of a due diligence defence enacted in 2018. In relation to Hong Kong, what is its legal position for dispensing errors, and can it follow the decriminalising steps of UK? The primary objective of this paper is to explore whether and how HK can reach the normative position for (...) a dispensing error legal regime: I posit that the normative position for healthcare professional liability for dispensing errors should prioritise the public interest of minimisation of future dispensing errors over the retribution of past wrongs; I illustrate HK’s current position for the liabilities of HCPs on dispensing errors, focusing analysis on the relatively controversial aspects of HK’s criminal liability, referencing the landmark cases Hin Lin Yee v HKSAR 13 HKCFAR 142 and Kulemesin v HKSAR 16 HKCFAR 195 to assist my analysis of the requisite mental element for relevant statutory offences; through comparison with UK’s development post-R v Lee and application of Rule of Law principles, HK’s current position is critiqued, coming to the conclusion that while there are compelling reasons for the decriminalisation of dispensing errors in HK, the prerequisite for this to happen is an overhaul of regulatory frameworks by significantly increasing levels of accountability. The division of labor in the global value chain has reshaped the competitive advantage of enterprises participating in the international market and has a significant influence on the distribution of their factor income. Based on the perspective of market choice, this paper uses China’s industrial enterprises’ data, Customs Statistical Data on Import and Export, Word Input and Output Database, and BACI database from 2000 to 2007 to analyze the effect of competitive strategy of a firm’s GVC participation on its labor (...) income share. Herein, the competition strategy is depicted by the quality and price of export goods. The empirical results show the following. Quality competition has a larger effect on labor income share than price competition. High-quality and high-price or high-quality and low-price strategies tend to have a significant negative effect on labor income share, while low-quality and low-price and low-quality and high-price strategies have a positive effect. The higher the target market GVC status, the lower the labor income share of exporting firms, and the target market GVC status amplifies that the high-quality and high-price strategies on firms’ labor income share the negative effect of high-quality and low-price strategies on exporters’ labor income share. High-quality and low-price strategies have a significant negative effect on exporters’ labor income share when competing with developing countries in developed country markets or with developed countries in developing country markets. However, the positive effect of low-quality and low-price strategies and low-quality and high-price strategies kept unchanged. The findings remain robust after controlling for endogeneity and accounting for the effects of firm heterogeneity, indicator measurement, and sample variation. (shrink)

A theory of planned behavior framework was employed to investigate the impact of corporate social responsibility perceptions on the job choice intentions of American, Chinese, and Lebanese college students. Attitudes toward CSR, subjective norm, and perceived behavioral control explained moderate levels of the variance in job choice intention in all three countries. Attitudes toward CSR, which entailed individual evaluations of CSR, were positively related to job choice intentions among Lebanese and American respondents, but not Chinese respondents. Subjective norm, the importance (...) accorded the views of significant others, was most strongly related to job choice intentions among Chinese respondents. Perceived behavioral control, the perceived degree of control over one’s actions and outcomes, had the strongest relationship to job choice intentions among American respondents. The authors concluded that respondents in the three countries did not differ in the extent to which they intend to work for socially responsible firms but tended to derive their intentions in different ways. Implications for tailoring CSR and recruitment efforts across countries are derived based on the findings. (shrink)

This study points out that families' support of perseverance in creative efforts will increase children's originality of creative drawing through children's persistence in information searching. Data analysis based on 134 Chinese young children's creative drawings and survey supports the above hypothesis. Moreover, children's exposure to COVID-19 pandemic positively moderates the relationship between supporting perseverance and children's search persistence, such that high exposure to COVID-19 pandemic will increase the positive relationship between support of perseverance and search persistence. And children's prosocial motivation (...) inhibits the influence of search persistence on originality. Contributions to the theory of children's creativity are discussed. (shrink)

Paleoneuranatomy is an emerging subfield of paleontological research with great potential for the study of evolution. However, the interpretation of fossilized nervous tissues is a difficult task and presently lacks a rigorous methodology. We critically review here cases of neural tissue preservation reported in Cambrian arthropods, following a set of fundamental paleontological criteria for their recognition. These criteria are based on a variety of taphonomic parameters and account for morphoanatomical complexity. Application of these criteria shows that firm evidence for fossilized (...) nervous tissues is less abundant and detailed than previously reported, and we synthesize here evidence that has stronger support. We argue that the vascular system, and in particular its lacunae, may be central to the understanding of many of the fossilized peri‐intestinal features known across Cambrian arthropods. In conclusion, our results suggest the need for caution in the interpretation of evidence for fossilized neural tissue, which will increase the accuracy of evolutionary scenarios. Identifying genomic homology within and between genomes is essential when studying genome evolution. In the past years, different computational techniques have been developed to detect homology even when the actual similarity between homologous segments is low. Depending on the strategy used, these methods search for pairs of chromosomal segments between which either both gene content and order are conserved or gene content only. However, due to fact that, after their divergence, homologous segments can lose a different set of genes, these (...) methods still often fail to detect genomic homology. The role intellectual virtues play in scientific inquiry has raised significant discussions in the recent literature. A number of authors have recently explored the link between virtue epistemology and philosophy of science with the aim to show whether epistemic virtues can contribute to the resolution of the problem of theory choice. This paper analyses how intellectual virtues can be beneficial for successful resolution of theory choice. We explore the role of virtues as well as vices in scientific inquiry and their (...) beneficial effects in the context of theory choice. We argue that vices can play a role in widening the set of potential candidate theories and support our claim with historical examples and normative arguments from formal social epistemology. We argue that even though virtues appear to be neither necessary nor sufficient for scientific success, they have a positive effect because they accelerate successful convergence amongst scientists in theory choice situations. This paper introduces Agreement Theorems to dynamic-epistemic logic. We show first that common belief of posteriors is sufficient for agreement in epistemic-plausibility models, under common and well-founded priors. We do not restrict ourselves to the finite case, showing that in countable structures the results hold if and only if the underlying plausibility ordering is well-founded. We then show that neither well-foundedness nor common priors are expressible in the language commonly used to describe and reason about epistemic-plausibility models. The static agreement (...) result is, however, finitely derivable in an extended modal logic. We provide the full derivation. We finally consider dynamic agreement results. We show they have a counterpart in epistemic-plausibility models, and provide a new form of agreements via public announcements. (shrink)

We analyse the computational complexity of comparing informational structures. Intuitively, we study the complexity of deciding queries such as the following: Is Alice’s epistemic information strictly coarser than Bob’s? Do Alice and Bob have the same knowledge about each other’s knowledge? Is it possible to manipulate Alice in a way that she will have the same beliefs as Bob? The results show that these problems lie on both sides of the border between tractability (P) and intractability (NP-hard). In particular, we (...) investigate the impact of assuming information structures to be partition-based (rather than arbitrary relational structures) on the complexity of various problems. We focus on the tractability of concrete epistemic tasks and not on epistemic logics describing them. (shrink)

Formal learning theory constitutes an attempt to describe and explain the phenomenon of learning, in particular of language acquisition. The considerations in this domain are also applicable in philosophy of science, where it can be interpreted as a description of the process of scientific inquiry. The theory focuses on various properties of the process of hypothesis change over time. Treating conjectures as informational states, we link the process of conjecture-change to epistemic update. We reconstruct and analyze the temporal aspect of (...) learning in the context of dynamic and temporal logics of epistemic change. We first introduce the basic formal notions of learning theory and basic epistemic logic. We provide a translation of the components of learning scenarios into the domain of epistemic logic. Then, we propose a characterization of finite identifiability in an epistemic temporal language. In the end we discuss consequences and possible extensions of our work. (shrink)

Most syntacticians, no matter their theoretical persuasion, agree that features are the most important units of analysis. Within Chomskyan generative grammar, the importance of features has grown steadily and within minimalism, it can be said that everything depends on features. They are obstacles in any interdisciplinary investigation concerning the nature of language and it is hard to imagine a syntactic description that does not explore them. For the first time, this book turns grammar upside down and proposes a new model (...) of syntax that is better suited for interdisciplinary interactions, and shows how syntax can proceed free of lexical influence. The empirical domain examined is vast, and all the fundamental units and properties of syntax are rethought. Ordinary common knowledge is formally expressed by strong probabilistic common belief. How strong exactly? The question can be answered by drawing from the similar equivalence, recently explored, between plain and probabilistic individual beliefs. I argue that such a move entails that common knowledge displays a double fragility: as a description of a collective state and as a phenomenon, because it can respectively disappear as group size increases, or more worryingly as the epistemic context changes. I argue that despite this latter (...) fragility, the effects of common knowledge on action are robust. Unfortunately, this in turn leads to a third fragility, that of the concept of common knowledge, which threatens to collapse on probabilistic common belief. This also reveals a disanalogy between the individual and the collective cases. I finally pinpoint the subtle difference entailed by the two concepts, expressed in terms of the attitude towards contrary evidence or of the agents’ awareness. As a result, common knowledge can be defended as a concept, which refers to a fragile yet distinct collective attitude. (shrink)

Figurative drawing is a skill that takes time to learn, and it evolves during different childhood phases that begin with scribbling and end with representational drawing. Between these phases, it is difficult to assess when and how children demonstrate intentions and representativeness in their drawings. The marks produced are increasingly goal-oriented and efficient as the child’s skills progress from scribbles to figurative drawings. Pre-figurative activities provide an opportunity to focus on drawing processes. We applied fourteen metrics to two different datasets (...) (_N_ = 65 and _N_ = 344) to better understand the intentional and representational processes behind drawing, and combined these metrics using principal component analysis (PCA) in different biologically significant dimensions. Three dimensions were identified: efficiency based on spatial metrics, diversity with color metrics, and temporal sequentiality. The metrics at play in each dimension are similar for both datasets, and PCA explains 77% of the variance in both datasets. Gender had no effect, but age influenced all three dimensions differently. These analyses for instance differentiate scribbles by children from those drawn by adults. The three dimensions highlighted by this study provide a better understanding of the emergence of intentions and representativeness in drawings. We discussed the perspectives of such findings in comparative psychology and evolutionary anthropology. (shrink)

In this article, I will discuss possible differences between ecosystems and organisms on the basis of their intrinsic complexity. As the concept of complexity still remains highly debated, I propose here a practical and original way to measure the complexity of an ecosystem or an organism. For this purpose, I suggest using the concept of logical depth (LD) in a specific manner, in order to take into account the difficulty as well as the time needed to generate the studied object. (...) I illustrate this method with fully controlled Daisyworld simulations (i.e., simulations based on the Gaia hypothesis) that have often been proposed to mimic living systems. The method consists of the following sequential stages: (1) identification of the shortest program able to numerically model the studied system (also called the Kolmogorov–Solomonoff complexity); (2) running the program, once if there are no stochastic components in the system, several times if stochastic components are there; and (3) computing the time needed to generate the system with LD complexity. This measure is supposed to estimate the system complexity. It appears in this study that LD estimations fit well with the intuition we have of complex systems, with higher complexities being found for more realistic Daisyworlds. With such a method of capturing the time needed to build a system, we expect to detect in future studies any quantified differences between complex ecosystems and organisms. (shrink)

Major depression is associated with a decrease of 1st person visual perspective in autobiographical memory, even after full remission. This study aimed to examine visual perspective in healthy never-depressed subjects presenting with either genetic or psychological vulnerability for depression. Sixty healthy participants performed the Autobiographical Memory Test with an assessment of visual perspective. Genetic vulnerability was defined by the presence of at least one S or LG allele of the polymorphism of the serotonin-transporter-linked promoter region . Psychological vulnerability was defined (...) by high scores of harm avoidance measured by the Temperament and Character Inventory. Life stress exposure, depressive mood, rumination, and familial history of depression were assessed through standardized procedures. Visual perspective for positive memories was independently predicted by both harm avoidance and a gene by environment interaction between the 5-HTTLPR polymorphism and life stress exposure. Visual perspective and vulnerability for depression may share some biological bases. (shrink)

In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us to solve (...) all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. The theory is illustrated on ontological issues on the nature of structural universals and informational entities. (shrink)

The authors present the preliminary publication of seven hitherto unpublished inscriptions from the Roman colony at Philippi in the province of Macedonia. These inscriptions make known a number of new notables who were active in the colony during the 1st and 2nd centuries AD. Amongst them is a soldier from Philippi who had pursued a career in the cohortes vigilae in Rome, as well as several municipal magistrates and seviri augusti from Philippi. All the inscriptions connected with the institutions of (...) the colony, and also those mentioning members of the senatorial and equestrian orders and soldiers, will shortly be included in the first volume of the Corpus of Greek and Latin Inscriptions of Philippi. The assembling of the epigraphic material relating to the municipal and imperial administration of Philippi, enriched by numerous unpublished inscriptions, will enable us to renew our acquaintance with the social and political structures of the colony. ABSTRACT:This paper argues that, although stakeholder engagement occurs within the context of power, neither market-centered CSR nor the deliberative model of political CSR adequately addresses the specter of power asymmetries and the inevitability of conflict in stakeholder relations, particularly for powerless stakeholders. Noting that the objective of stakeholder engagement should not be benevolence toward stakeholders, but mechanisms that address power asymmetries such that stakeholders are able to protect their own interests, I present a framework of stakeholder engagement based on agonistic (...) pluralism that seeks to structure and utilize discord rather than reduce or eliminate it. I then propose arbitration as an agonistic mechanism to address power asymmetries in stakeholder engagement and explore its implications. (shrink)

Recent years have witnessed an increased number of game-theoretic approaches to social norms, which apparently share some common vocabulary and methods. We describe three major approaches of this kind (due to Binmore, Bicchieri and Gintis), before comparing them systematically on five crucial themes: generality of the solution, preference transformation, punishment, epistemic conditions and type of explanation. This allows us to show that these theories are, by and large, less compatible than they seem. We then argue that those three theories struggle (...) to account for three phenomena pertaining to social norms (namely context-dependence, conflicting norms and self-evidence), with which any complete game-theoretic account should in principle be able to deal.
