Individuals of many animal species are said to have a personality. It has been shown that some individuals are bolder than other individuals of the same species, or more sociable or more aggressive. In this paper, we analyse what it means to say that an animal has a personality. We clarify what an animal personality is, that is, its ontology, and how different personality concepts relate to each other, and we examine how personality traits are identified in biological practice. Our (...) analysis shows that biologists often study specific personality traits, such as boldness, sociability or aggressiveness, rather than personalities in general. We claim that personality traits are best understood as dispositions and that they are operationally defined in terms of certain sets of behaviours, which are studied in specific experimental set-ups. Furthermore, we develop an integrative philosophical account that specifies and formalises three criteria for identifying personality traits, which are used in biological practice. For an individual animal to have a personality trait it must, first, behave differently than others. Second, these behavioural differences must be stable over a certain time, and third, they must be consistent in different contexts. (shrink)

If, as many suppose, pornography changes people, a question arises as to how.1 One answer to this question offers a grand and noble vision. Inspired by the idea that pornography is speech, and inspired by a certain liberal ideal about the point of speech in political life, some theorists say that pornography contributes to that liberal ideal: pornography, even at its most violent and misogynistic, and even at its most harmful, is political speech that aims to express certain views about (...) the good life, 2aims to persuade its consumers of a certain political point of view—and to some extent succeeds in persuading them. Ronald Dworkin suggests that the pornographer contributes to the ‘moral environment, by expressing his political or social convictions or tastes or prejudices informally’, that pornography ‘seeks to deliver’ a ‘message’ , that it reflects the ‘opinion’ that ‘women are submissive, or enjoy being dominated, or should be treated as if they did’, that it is comparable to speech ‘advocating that women occupy inferior roles’.3 Pornography on this view is political speech that aims to persuade its listeners of the truth of certain ideas about women, and of course ‘the government must leave to the people the evaluation of ideas’.4 Another answer offers a vision that is not grand and noble, but thoroughly reductive. Pornography is not politically persuasive speech, but speech that works by a process of psychological conditioning. This view seems common enough in the social science literature. Wilfrid Sellars [1962: 1] described philosophy as an attempt to ‘understand how things in the broadest possible sense of the term hang together in the broadest possible sense of the term’. But it is distinctive of philosophy that many of us are interested not only in how the world is but in ways that it could be. That is, philosophy is concerned with facts about modality. Some of the most important arguments in philosophy hinge on modal premises, and philosophers have (...) typically assumed special expertise in evaluating these modal premises. Replicating Goldvarg and Johnson-Laird’s [2000] study of modal illusions, we show that training in mathematics and not philosophy predicts success in overcoming such illusions (n = 395). This study is the first to test the modal expertise of professional philosophers directly. Our findings undermine claims to modal expertise. Philosophical training does not inoculate expert philosophers against basic mistakes in modal judgment. (shrink)

We refine the intuitively appealing idea that you are blameworthy for something if it happened because you did not care enough. More formally: you are blameworthy for X (where X may be an action, omission, or outcome) just in case there is the right causal-explanatory relation between your poor quality of will and X. First, we argue that blameworthiness for actions, omissions, and outcomes is concerned with negative differences: you are blameworthy for the fact that X occurred instead of X*, (...) where X is worse than X*. Second, we argue that the way in which your quality of will is poor has to fit what you are blameworthy for. With these refinements, the account already gives intuitively correct verdicts in cases of forgetting, making a negative difference to a nevertheless good result, and doing an action with runaway consequences. We then discuss what the right causal-explanatory relation is and suggest that it is simply causation, understood in the right way. Here, we draw on the account of causation developed in Touborg, The Dual Nature of Causation. According to this account, there are two necessary and jointly sufficient conditions for causation. Roughly, C causes E rather than E* iff (a) C is process-connected to E, and (b) C makes E more secure and E* less secure. With this account of causation, our account of blameworthiness now also gives correct verdicts in omission, pre-emption, and switching cases, Frankfurt-style cases, and collective harm cases. Using an ethnographic case study based in a UK state school for 11- to 18-year-olds, this paper explores the tensions that arose when the senior leadership team (SLT) introduced a justice-based ethic-of-care that prioritized good grades and equal treatment for all pupils over a feminist ethic-of-care (preferred by most teachers in non-leadership roles) that accentuated individual pupil need and placed greater emphasis on a broader social education. Through highlighting the tensions between a feminist ethic-of-care and a more ‘masculine’ style, justice-based (...) approach to care-ethics, the paper extends the organisational care-ethics literature. We emphasise that such tensions occurred whether the different ethics were enacted by men, women, or non-binary individuals. In order to better understand the tensions between these two ethical approaches, we draw upon the theoretical work of Donald Winnicott, which highlights the importance both of maternal and paternal roles during infancy. We update Winnicott’s ideas, noting how maternal and paternal caring roles can be undertaken by people of varied gender identities. Building on Winnicott’s theory, we propose a new ‘Parentalist’ ethic-of-care, which has the potential to balance and hold together ideas of both a feminist ethic-of-care, and a justice-based ethic. A Parentalist ethic-of-care could support teachers yet recognize the context of the contemporary neo-liberal environment, where most children need to attain formal qualifications in a marketized world, and where such measures of success are highly valued. Eye gaze is a ubiquitous cue in child–caregiver interactions, and infants are highly attentive to eye gaze from very early on. However, the question of why infants show gaze-sensitive behavior, and what role this sensitivity to gaze plays in their language development, is not yet well-understood. To gain a better understanding of the role of eye gaze in infants' language learning, we conducted a broad systematic review of the developmental literature for all studies that investigate the role of eye gaze (...) in infants' language development. Across 77 peer-reviewed articles containing data from typically developing human infants in the domain of language development, we identified two broad themes. The first tracked the effect of eye gaze on four developmental domains: vocabulary development, word–object mapping, object processing, and speech processing. Overall, there is considerable evidence that infants learn more about objects and are more likely to form word–object mappings in the presence of eye gaze cues, both of which are necessary for learning words. In addition, there is good evidence for longitudinal relationships between infants' gaze following abilities and later receptive and expressive vocabulary. However, many domains are understudied; further work is needed to decide whether gaze effects are specific to tasks, such as word–object mapping or whether they reflect a general learning enhancement mechanism. The second theme explored the reasons why eye gaze might be facilitative for learning, addressing the question of whether eye gaze is treated by infants as a specialized socio-cognitive cue. We concluded that the balance of evidence supports the idea that eye gaze facilitates infants' learning by enhancing their arousal, memory, and attentional capacities to a greater extent than other low-level attentional cues. However, as yet, there are too few studies that directly compare the effect of eye gaze cues and non-social, attentional cues for strong conclusions to be drawn. We also suggest that there might be a developmental effect, with eye gaze, over the course of the first 2 years of life, developing into a truly ostensive cue that enhances language learning across the board. Some theories of personal identity allow some variation in what it takes for a person to survive from context to context; and sometimes this is determined by the desires of person-stages or the practices of communities.This leads to problems for decision making in contexts where what is chosen will affect personal identity.‘Temporal Phase Pluralism’ solves such problems by allowing that there can be a plurality of persons constituted by a sequence of person stages. As donor trust legitimises research, trust is vital for research in the fields of biomedicine, genetics, translational medicine and personalised medicine. For parts of the donor community, the consent signature is a sign of trust in research. Many consent processes in biomedical research ask donors to provide their data for an unspecified future use, which introduces uncertainty of the unknown. This uncertainty can jeopardise donor trust or demand blind trust. But which donor wants to trust blindly? To reduce this uncertainty, (...) we explore first, which future-proof actors donors could trust when signing a consent form. Second, we discuss the question Can we know if donor trust expires? and what prevents donor trust from expiring. Finally, we present possible measures that can help to nurture trust in the far future. In this article, we draw on our previous research on trust in biomedical research, on trust in the broader healthcare system and Niklas Luhmann’s and Anthony Giddens’ trust theories. Our findings suggest that, in the far future, researchers will need to consider donor autonomy, as well as societal norms and values of the time period in which the data were donated. They will need to find mechanisms where possible to publicly announce the use of old data sets. However, foremost researchers will need to treat the data respectfully. It remains vital that professionals and the society continue to elaborate on the norms and values that shape the common understanding of what is morally right and wrong when researching data. Corporations are spending a substantial and increasing amount of money on corporate social responsibility. However, little is known about the effects on key stakeholders of these activities. This study investigates if CSR activities have an effect on employees’ affective commitment. Two models test to what extent employees’ CSR perception, involvement in decision processes, and demographic variables are related to their AC relative to their perception of positive organizational support. The analysis is based on a sample of 512 employees from 4 (...) Scandinavian companies; 3 Norwegian and 1 Swedish, randomly selected from a population of 6,710 mostly Norwegian and Swedish employees in those 2 countries. The results indicate that CSR perception is a significant predictor of AC, although how employees feel that the company cares about them has stronger explanatory power on AC. Contrary to the few other studies addressing AC and CSR, gender was not found to be a significant variable in the model. (shrink)

The current experiments examine mental health clinicians’ beliefs about biological, psychological, and environmental bases of the DSM‐IV‐TR mental disorders and the consequences of those causal beliefs for judging treatment effectiveness. Study 1 found a large negative correlation between clinicians’ beliefs about biological bases and environmental/psychological bases, suggesting that clinicians conceptualize mental disorders along a single continuum spanning from highly biological disorders (e.g., autistic disorder) to highly nonbiological disorders (e.g., adjustment disorders). Study 2 replicated this finding by having clinicians list what (...) they thought were the specific causes of nine familiar mental disorders and rate their bio–psycho–environmental bases. Study 3 further found that clinicians believe medication to be more effective for biologically based mental disorders and psychotherapy to be more effective for psychosocially based mental disorders. These results demonstrate that even expert mental health clinicians make strong distinctions between psychological and biological phenomena. (shrink)

Understanding the link between brain evolution and the evolution of distinctive features of modern human cognition is a fundamental challenge. A still unresolved question concerns the co-evolution of tool behavior (i.e., tool use or tool making) and language. The shared neurocognitive processes hypothesis suggests that the emergence of the combinatorial component of language skills within the frontal lobe/Broca's area made possible the complexification of tool-making skills. The importance of the frontal lobe/Broca's area in tool behavior is somewhat surprising with regard (...) to the literature on neuropsychology and cognitive neuroscience, which has instead stressed the critical role of the left inferior parietal lobe. Therefore, to be complete, any version of the shared neurocognitive processes hypothesis needs to integrate the potential interactions between the frontal lobe/Broca's area and the left inferior parietal lobe as well as their co-evolution at a phylogenetic level. Here, we sought to provide the first elements of answer through the use of the massive deployment framework, which posits that evolutionarily older brain areas are deployed in more cognitive functions (i.e., they are less specific). We focused on the left parietal cortex, and particularly the left areas PF, PGI, and anterior intraparietal (AIP), which are known to be involved in tool use, language, and motor control, respectively. The deployment of each brain area in different cognitive functions was measured by conducting a meta-analysis of neuroimaging studies. Our results confirmed the pattern of specificity for each brain area and also showed that the left area PGI was far less specific than the left areas PF and AIP. From these findings, we discuss the different evolutionary scenarios depicting the potential co-evolution of the combinatorial and generative components of language and tool behavior in our lineage. ABSTRACT Since the seventeenth century, scholars have been accusing each other of ‘dogmatism’. But what exactly did this mean? In exploring this question, this article focuses on philosophy and Biblical scholarship in nineteenth-century Germany. Scholars in both of these fields habitually contrasted Dogmatismus with Kritik, to the point of emplotting the history of their field as a gradual triumph of critical thinking over dogmatic belief. The article shows that charges of dogmatism derived much of their rhetorical force from such progressive (...) narratives. Especially neo-Kantian philosophers and Biblical scholars of liberal Protestant persuasion liked to depict their opponents as clinging to long-superseded modes of thought, thereby implying that these colleagues harked back to a past from which modern Wissenschaft had emancipated itself. This ‘denial of coevalness’, as Johannes Fabian calls it, demonstrates to what extent the vice of dogmatism was imbued with normative visions of how the field or, more broadly, German intellectual life should develop. Humans can follow different social learning strategies, sometimes oriented toward the models’ characteristics. The goal of the present study was to explore which who-strategy is preferentially followed in the technological context based on the models’ psychological characteristics. We identified three potential who-strategies: Copy the pedagogue, copy the engineer, and copy the friend. We developed a closed-group micro-society paradigm in which participants had to build the highest possible towers. Participants began with an individual building phase. Then, they were gathered to discuss (...) the best solutions to increase tower height. After this discussion phase, they had to make a new building attempt, followed by another discussion phase, and so forth for a total of six building phases and five discussion rounds. This methodology allowed us to create an attraction score for each participant. We also assessed participants’ theory-of-mind skills, technical-reasoning skills, and prosocialness to predict participants’ attraction scores based on these measures. Results show that we learn from engineers because they are the most successful. Their attraction power is not immediate, but after they have been identified as attractors, their technique is copied irrespective of their pedagogy or friendliness. These findings open avenues for the study of the cognitive bases of human technological culture. (shrink)

Caroline Franks Davis provides a clear, sensitive, and carefully argued assessment of the value of religious experiences as evidence for religious beliefs. Much more than an 'argument from religious experience', the inquiry systematically addresses underlying philosophical issues such as the role of interpretation in experience, the function of models and metaphors in religious language, and the way perceptual experiences in general are used as evidence for claims about the world. The author examines several arguments from religious experience and, using (...) contemporary and classic sources from the world religions, gives an account of the different types of experience. To meet sceptical challenges to religious experience, she draws extenisvely on psychological and sociological as well as philosophical and religious literature, probing deeply into the questions whether religious experiences are merely a matter of interpretation, whether there is irreducible conflict among religious experiences, and whether psychological and other reductionist explanations of religious experience are satisfactory. She concludes that religious experiences, like most experiences, are most effective as evidence within a cumulative style of argument which combines evidence from a wide range of sources. (shrink)

Mitochondrial donation poses the latest regulatory challenge for policy-makers in the context of assisted conception. Since 2010 the Human Genetics Commission, the Human Fertilisation and Embryology Authority and the Nuffield Council on Bioethics have all considered the policy implications of permitting use of these techniques in treatment. The Nuffield Council on Bioethics reported its recommendations in June 2012 following a consultation on the ethical issues raised by these techniques; and a separate consultation by the Human Fertilisation and Embryology Authority in (...) conjunction with Sciencewise-ERC followed in September 2012. Matters for consideration included the potential relationships created by the use of three parties’ genetic material and the associated ramifications, eg whether or not there is a need to establish records of such donations and, if so, to whom should information later be provided? Thus, mitochondrial donation poses both novel and familiar questions about the ‘genetic family’, ‘parentage’ and ‘identity’. This article explores some of the ways in which mitochondrial DNA is constructed as relatively significant in recent Parliamentary debates, policy and consultation documents. It reflects on the ways in which the role of some genetic connections, or lack thereof, are mediated in law and policy. (shrink)

Beyond the eras a dialogue seems to have been established between Bruegel the Elder (1525-1569) and Antonin Artaud (1896-1948). The poet’s wonder at the « painting of the North », both realistic and emblematic, reveals his deepest ideal as an artist : painting, a « magical » operation, deploys a power of expression based on signs and no longer on words, which the theatre is also called upon to seize. The juxtaposition of Bruegel’s Triumph of Death and a famous drawing (...) by Artaud, Le Théâtre de la cruauté [The Theatre of Cruelty], highlights the striking convergences between the two artists. Through their pictorial works, both of them renew over the centuries the funerary and mythical symbolism of death, inherited from the macabre scenes of medieval paintings, but also from ancient times. Studying the references to theatrical iconography in Bruegel’s painting, where carnival and crudity of death reinforce each other, allows us to deepen the meaning of these resonances. For the two artists, form and poetic momentum meet so that representation, as a structure common to painting and theatre, fixes a moment of the world, while animating that moment to infinity, thanks to signs conceived as « true hieroglyphs » (Artaud), a problem that Michel Foucault associated with the strongest truth that the experience of madness carries. Epigenetics reveals the biological mechanisms underlying the reproduction and even the transmission of social inequalities in health. It also emphasizes the complexity of factors involved in the development of some diseases. This complexity raises new difficulties for theories of justice. Is the equal opportunities theory the most appropriate to solve these difficulties? I demonstrate that epigenetics requires a multifactor model of justice—one that is grounded on principles of fairness, impartiality, and environmental and intergenerational justice. The preferred tool for conceptualizing, determining, and claiming relations of kinship, ancestry, and descent among humans are diagrams. For this reason, and at the same time to avoid a reduction to biology as transported by terms such as kinship, ancestry, and descent, we introduce the expression diagrammatics of relatedness. We seek to understand the enormous influence that especially tree diagrams have had as a way to express and engage with human relatedness, but hold that this success can only be adequately (...) understood by attending to what in fact are broader diagrammatic practices. These practices bring to light that diagrams of relatedness do not simply make visible natural connections, but create or deny relations in particular ways and for particular reasons. In this special section, contributors investigate diagrams of relatedness in genealogy, heredity, as well as biological and social anthropology. Conceiving of diagrams as techniques that transcend such binaries as ‘thought and action’ and ‘image and text’, we aim at an understanding of how they were constructed and how they functioned in particular epistemic, cultural, and political contexts. Despite general agreement within philosophy that peer review is indispensable, its fairness and reliability is often questioned. This article suggests that such worries can to a large extent be met by adopting the practice that reviews as well as earlier versions of papers are made publicly available when the final version of a paper is published. This suggestion combines the advantages of transparency with the merits of anonymity of reviewers. While there are obstacles to this suggestion, the article argues that (...) it would be worthwhile to implement it because it can help map patterns of conduct and secure confidence in the fairness and reliability of review procedures and journal editing within philosophy. This commentary is a call to action for researchers to create and use genome-wide association studies (GWASs) with previously missed age groups (e.g., infancy, elderly), which will improve our ability to ask important developmental questions using genetic data to trace pathways across the lifespan.

Several studies have demonstrated that individuals’ ability to perceive a speech sound contrast is related to the production of that contrast in their native language. The theoretical account for this relationship is that speech perception and production have a shared multimodal representation in relevant sensory spaces. This gives rise to a prediction that individuals with more narrowly defined targets will produce greater separation between contrasting sounds, as well as lower variability in the production of each sound. However, empirical studies that (...) tested this hypothesis, particularly with regard to variability, have reported mixed outcomes. The current study investigates the relationship between perceptual ability and production ability, focusing on the auditory domain. We examined whether individuals’ categorical labeling consistency for the American English /ε/–/æ/ contrast, measured using a perceptual identification task, is related to distance between the centroids of vowel categories in acoustic space and to two measures of production variability: the overall distribution of repeated tokens for the vowels and the proportional within-trial decrease in variability as defined as the magnitude of self-correction to the initial acoustic variation of each token. No significant associations were found between categorical labeling consistency and vowel contrast distance, between categorical labeling consistency and area of the ellipse, or between categorical labeling consistency and centering ratio. These null results suggest that the perception-production relation may not be as robust as suggested by a widely adopted theoretical framing in terms of the size of auditory target regions. However, the present results may also be attributable to choices in implementation that should be subject to further investigation. (shrink)

Parte do cinema brasileiro pensado e elaborado nos anos 2010 produziu gestos sintomáticos da corrida desenvolvimentista e imobiliária em grandes cidades brasileiras a partir de leituras temporais não-lineares. A partir de uma constelação de imagens acionadas por um grupo de cinco filmes, este artigo busca aproximar sequências a partir de três conceitos temporais distintos: a perspectiva ecobiótica andina de tempo (YAMPARA, 2010), o tempo espiralar em rituais do Congado (MARTINS, 2002) e o tempo Exu (SODRÉ, 2017). Com eles, é possível (...) percebemos parte do cinema brasileiro revelando, em suas cidades, a estrutura fóssil em projetos de futuro. (shrink)

Background: Conducting video-research in birth settings raises challenges for ethics review boards to view birthing women and research-midwives as capable, autonomous decision-makers. Aim: This study aimed to gain an understanding of how the ethical approval process was experienced and to chronicle the perceived risks and benefits. Research design: The Birth Unit Design project was a 2012 Australian ethnographic study that used video recording to investigate the physical design features in the hospital birthing space that might influence both verbal and non-verbal (...) communication and the experiences of childbearing women, midwives and supporters. Participants and research context: Six women, 11 midwives and 11 childbirth supporters were filmed during the women’s labours in hospital birth units and interviewed 6 weeks later. Ethical considerations: The study was approved by an Australian Health Research Ethics Committee after a protracted process of negotiation. Findings: The ethics committee was influenced by a traditional view of research as based on scientific experiments resulting in a poor understanding of video-ethnographic research, a paradigmatic view of the politics and practicalities of modern childbirth processes, a desire to protect institutions from litigation, and what we perceived as a paternalistic approach towards protecting participants, one that was at odds with our aim to facilitate situations in which women could make flexible, autonomous decisions about how they might engage with the research process. Discussion: The perceived need for protection was overly burdensome and against the wishes of the participants themselves; ultimately, this limited the capacity of the study to improve care for women and babies. Conclusion: Recommendations are offered for those involved in ethical approval processes for qualitative research in childbirth settings. The complexity of issues within childbirth settings, as in most modern healthcare settings, should be analysed using a variety of research approaches, beyond efficacy-style randomised controlled trials, to expand and improve practice-based results. In his contribution to this special issue, Hindriks considers the Security Principle, an account of pro tanto obligations based on our account of reasons (Gunnemyr and Touborg 2023a). According to the Security Principle, you have a pro tanto obligation not to perform an action that makes a harm more secure. Hindriks raises two objections to this account. First, that it is too flexible; second, that it gives wrong verdicts when agents are robustly unwilling to act in a certain way. Here, (...) we respond to Hindriks’ objections and argue that Hindriks’ account, the Threshold Principle, gives counterintuitive verdicts in preemption and low-probability cases. (shrink)

Le présent chapitre enrichit cette littérature, en montrant comment la construction de la catégorie légale de travail autorisé est productrice d'immigration « irrégulière ». En effet, la multiplication des conditions d'accès à l'autorisation de travail a pour effet de priver de droit au séjour des personnes autrement (...) en situation régulière. La France, située en tête de classement en matière d'obligations de quitter le territoire et en fin de classement en matière d'immigration professionnelle, représente un cas d'école parmi les pays de l'Union Européenne. En janvier 1783, deux musiciennes, Bianca Sacchetti et Andrianna Ferrarese, s’enfuirent de l’ospedale des Mendicanti, à Venise, pour tenter leur chance sur les scènes de théâtre. Formées dans l’une des quatre institutions vénitiennes destinées à recueillir les orphelins de Venise, elles étaient devenues des musiciennes hors pair, chantaient chaque jour dans la chapelle de l’ospedale et jouaient de plusieurs instruments. Le dossier consacré à leur fugue, qui se trouve toujours à l’Archivio di Stato de Venise, nous donne les circonstances et (...) les raisons de leur fugue, mais fournit également des informations précieuses et uniques sur les aspirations des « filles du choeur » à une vie meilleure. Des documents inédits illustrent les relations d’amitié qui pouvaient exister entre deux jeunes femmes recueillies par charité et suffisamment talentueuses pour avoir réussi à devenir deux des meilleures musiciennes de Venise. Retrouvées par les autorités, elles poursuivirent d’ailleurs une brillante carrière, l’une à l’opéra, l’autre au sein de l’ospedale, la Ferrarese créant même l’un des rôles du Così fan tutte de Mozart. À partir d’une enquête par entretiens menée dans la région nantaise avec des femmes mariées d’âges différents, on a pu mettre en évidence les évolutions qui se sont produites en l’espace de deux à trois générations dans la pratique du nom marital et le sens qui lui est donné par les femmes mariées. Il montre comment l’adoption du nom marital, autrefois automatique et vécue dans une relative indifférence, tend à devenir aujourd’hui un choix réfléchi et investi de sens pour les (...) femmes qui l’adoptent. Only a few studies explore the lifeworld of the spouses of persons affected by early-onset Alzheimer disease. The aim of this study is to explore the lifeworld of spouses when their partners are diagnosed with AD, focusing on spouses’ lived experience. The study employs an interpretative phenomenological framework. Ten in-depth interviews are performed. The results show that spouses’ lifeworld changes with the diagnosis. They experience an imprisoned existence in which added obligations, fear, and worry keep them trapped at home, both (...) physically and mentally. In their longing for freedom, new strategies and attitudes helps the spouses to create an extended “lived space” with their partner. The findings stress the importance of paying attention to the lifeworld of spouses and making clinical recommendations on this basis. Most importantly, the lifeworld perspective has implications for how we understand what care is. We hope to challenge all different healthcare professionals and invite them to discuss the deep meaning of care and the definition of being professional in encounters with vulnerable others from a lifeworld perspective. Liberals agree that free speech should be protected, where speech is understood broadly to include all forms of intentional communication, including actions and pictures, not merely the spoken or written word. A surprising view about free speech in some liberal and legal circles is that communications should be protected on free-speech grounds only if the communications are mentally mediated. By “mentally mediated communication” we mean speech which communicates its message in such a way that the message can be rationally evaluated (...) by hearers, and causes the hearers to believe it, when it does, through the mechanism of those hearers employing their rational capacity to judge that it is correct. The mental-mediation or persuasion principle, as it is sometimes called, has some important legal and public policy implications. It has been applied to argue that certain forms of expression, despite being forms of speech or expression, lack even a prima facie claim to protection on free speech grounds. -/- Our central aim is to show why the mental mediation principle is mistaken. Liberals should think that some speech which is not mentally mediated deserves protection for the very same reasons that speech which is mentally mediated is often thought to deserve protection. Background In this qualitative analysis we aimed to explore addiction physicians’ perspectives on safer injection education for people who inject drugs, especially: (1) on possible means of introducing safer injection education in the medical environment, (2) on the compatibility of safer injection education with each physician’s core values and goals, and (3) on possible reasons for the ethical dilemma in safer injection education. Methods We conducted semi-structured interviews with eleven physicians practicing addiction medicine in France in clinical and harm reduction (...) settings. Results All participants were in favor of educational interventions for people who inject drugs. Nonetheless, these interventions varied from simple advice to injection supervision and they were seen as less acceptable when they concerned the practical and material aspects of injection. Some participants found that physicians practicing in clinical settings, where patients consult mostly to stop their drug use, should not practice safer injection education. On the contrary, other participants claimed that safer injection education was essential in all settings and was not a choice but rather a duty for addiction physicians. The ethical dilemma of such intervention when delivered by medical staff was viewed as a complex phenomenon, related to the representations of intravenous drug use and to societal expectations from physicians. Conclusion Physicians’ views on safer injection education for people who inject drugs reveal an emotionally charged subject related to the structural organization of addiction management in France.
