People with mental illness are subjected to stigma and discrimination and constantly face restrictions in the exercise of their political, civil and social rights. Considering this scenario, mental health, ethics and human rights are key approaches to advance the well-being of persons with mental illnesses. The study was conducted to review the scope of the empirical literature available to answer the research question: What evidence is available regarding human rights and ethical issues regarding nursing care to persons with mental illnesses? (...) A scoping review methodology guided by Arksey and O’Malley was used. Studies were identified by conducting electronic searches on CINAHL, PubMed, SCOPUS and Hein databases. Of 312 citations, 26 articles matched the inclusion criteria. The central theme which emerged from the literature was “Ethics and Human Rights Boundaries to Mental Health Nursing practice”. Mental health nurses play a key and valuable role in ensuring that their interventions are based on ethical and human rights principles. Mental health nurses seem to have difficulty engaging with the ethical issues in mental health, and generally are dealing with acts of paternalism and with the common justification for those acts. It is important to open a debate regarding possible solutions for this ethical dilemma, with the purpose to enable nurses to function in a way that is morally acceptable to the profession, patients and members of the public. This review may serve as an instrument for healthcare professionals, especially nurses, to reflect about how to fulfil their ethical responsibilities towards persons with mental illnesses, protecting them from discrimination and safeguarding their human rights, respecting their autonomy, and as a value, keeping the individual at the centre of ethical discourse. Some philosophers object that Kant's respect cannot express mutual recognition because it is an attitude owed to persons in virtue of an abstract notion of autonomy and invite us to integrate the vocabulary of respect with other persons-concepts or to replace it with a social conception of recognition. This paper argues for a dialogical interpretation of respect as the key-mode of recognition of membership in the moral community. This interpretation highlights the relational and practical nature of respect, and accounts for (...) its governing role over other persons-regarding concepts. (shrink)

According to a widely accepted philosophical model, agent-regret is practically significant and appropriate when the agent committed a mistake, or she faced a conflict of obligations. I argue that this account misunderstands moral phenomenology because it does not adequately characterize the object of agent-regret. I suggest that the object of agent-regret should be defined in terms of valuable unchosen alternatives supported by reasons. This model captures the phenomenological varieties of regret and explains its practical significance for the agent. My contention (...) is that agent-regret is a mode of valuing: a way in which the agent expresses and confers value. (shrink)

The evolutionary maintenance of sexual reproduction is a case of explanatory pluralism of central importance to evolutionary biology. I analyze this pluralism from an epistemological perspective. My thesis is that the various explanations of sex are explanatory by virtue of local factors and hence are importantly distinct from one another and cannot be subsumed under a single unifying framework. A critic may argue that philosophical accounts of mechanism can provide just such a framework. I show that this attempt at unification (...) fails because the accounts of sex are not explanatory simply in light of being their being mechanistic; rather they are explanatory because they are particular kinds of mechanisms. The explanatory power of a mechanism is dependent on its epistemological context and the contexts of these mechanisms differ. (shrink)

The evolution of sexual reproduction is a striking case of explanatory pluralism, meaning that one needs to refer to more than one explanation in order to adequately account for it. I develop the concept a domain of phenomena in order to analysis this pluralism. Pluralism exists when a phenomenon can be included in more that one homogeneous domain or in a heterogeneous domain. I argue that in some cases domain partitioning can be used to decrease pluralism, but that in the (...) case of sex domains are overlapping and interconnecting, or in other words bear an orthogonal relationship to one another, and hence cannot be partitioned in such a way as to eliminate pluralism. During the scientific revolution reductionism and mechanism were introduced together. These concepts remained intertwined through much of the ensuing history of philosophy and science, resulting in the privileging of approaches to research that focus on the smallest bits of nature. This combination of concepts has been the object of intense feminist criticism, as it encourages biological determinism, narrows researchers’ choices of problems and methods, and allows researchers to ignore the contextual features of the phenomena they investigate. I argue that the (...) historical link between mechanism and reductionism is not a necessary one, that this link should be severed, and in many cases has already been severed. Teasing reductionism away from mechanism allows us to hold onto the mechanistic view that science should explain how things work, without mandating methods and approaches that reduce the objects of scientific investigation to their smallest parts. Mechanism without reductionism decenters reductive methods, and so creates intellectual space for a plurality of methods that may engage the world at a variety of levels of organization. This ensuing pluralism opens the door for a wide variety of approaches to research, including feminist and gender-sensitive science. (shrink)

This paper examines Moran’s argument for the special authority of the first-person, which revolves around the Self/Other asymmetry and grounds dichotomies such as the practical vs. theoretical, activity vs. passivity, and justificatory vs. explanatory reasons. These dichotomies qualify the self-reflective person as an agent, interested in justifying her actions from a deliberative stance. The Other is pictured as a spectator interested in explaining action from a theoretical stance. The self-reflective knower has authority over her own mental states, while the Spectator (...) does not. I highlight the implications of this construal for a theory of action, and call attention onto some other interesting normative relations between the self-reflective agent and the Other that escape both the first-person and the third-person approach. My contention is that the authority of self-reflection (and of reason) is best understood as a relation of mutual recognition between self and others, hence from a second-person stance. (shrink)

The evolution of sexual reproduction is a case of explanatory pluralism, meaning that there is more than one explanation for this phenomenon. I use the concept of a domain to more clearly explicate the various explananda that can be found in this case. I argue that although pluralism with respect to some types of domains can be decreased using van Fraassen’s pragmatics of explanation, there remains an important class of domain, an orthogonal domain, for which this is not the case.

In this paper I compare and contrast Natorp’s and Husserl’s philosophies as to their programmatic and systematic profiles. I will begin by giving an assessment of their relationship and mutual influence, something that many scholars believe had been done exhaustively in Kern’s initial study of 1964 on the relation between Husserl and Kant and the neo-Kantians. Indeed, this topic – in general, the relation between phenomenology and „critical“ philosophy – deserves a new look now that more material has appeared in (...) the Husserliana, forcefully demonstrating the „transcendental Husserl“ and the Kantian influence on his phenomenology, and given the overall growing interest in neo-Kantianism. I will show that, despite fundamental differences in their philosophical outlooks, Natorp and Husserl share the same principal premise as to the relation between life, science and philosophy, and thus the role of philosophy itself in the midst of „culture“ and „lifeworld“ respectively. Hence, the similarities between Natorp’s Marburg School neo-Kantianism and Husserl’s transcendental phenomenology outweigh the differences, opening up new avenues to pursue transcendental philosophy. Is philosophy of film without theory an oxymoron or a family of non-, anti-, and a-theoretical approaches with which to engage in film-involving philosophical scholarship and understanding? Na presente investigação, objetivou-se analisar, a partir do referencial teórico e metodológico pós-estruturalista, os conceitos de Ciência, Tecnologia e Sociedade na trama com a educação e o ensino de Ciências. Como substrato teórico são utilizadas obras de Michel Foucault, Gilles Deleuze e Felix Guattari, ofertando pistas para ampliar a discussão destes conceitos. Na reunião dos saberes investigados, afirma-se um pensamento científico que desenvolve a produção de sentidos para a educação. Diante do exposto, pensa-se em um ensino, que crie estratégias de (...) existências, que reivindique a trama de teorias e práticas, operando os conteúdos científicos na Sociedade. (shrink)

O objetivo deste trabalho é discutir o que significa ler e escrever no pensamento de Friedrich Nietzsche. Criticando a supremacia da subjetividade que coloca o corpo em segundo plano, o filósofo revela que escrever é mais do que formar sentenças. Junto com o escrever, há uma maneira artística de um autor mostrar os próprios impulsos e vivências. E também o leitor deve prestar atenção e reconhecer nos textos sua própria experiência de vida. O estilo nietzschiano não é sistemático. Isso já (...) prova que ele se preocupou mais com seus próprios instintos criativos do que com as regras impostas pela tradição, dando uma nova perspectiva às artes de escrever, ler, interpretar e criar. In symmetrical moral dilemmas, the agent faces a choice between two incompatible actions, which are equally justified on the basis of the same value. These cases are generally discounted as spurious or irrelevant on the assumption that, when there is no failure of commensurability, choice between symmetrical requirements is indifferent and can be determined by randomization. Alternatively, this article argues that the appeal to randomization allows the agent to overcome a deliberative impasse, but it does not really resolve the moral (...) dilemma. This is because randomization fails to provide the agent with a genuine reason for action. The argument is based on an account of arbitrariness as a threat to the agent’s authorship on action. By focusing on lack of authorship, rather than on failure of commensurability, we gain the adequate perspective to assess the philosophical significance of moral dilemmas, their impact on the agential integrity, and their consequences for ethical theory. Kathleen Higgins (2012) claims that emotional responses to music are mostly social constructs, derived from the cultural transmission of musical knowledge. I agree with this general idea, but question Higgins’ ethnocentric and narrow view, which reduces music mainly to the art of combining sounds to produce beauty of form and expression of emotion. Instead, I propose that the distinctive and unique behavior of active music-making evolved culturally to serve a range of adaptive functions in the social environments humans used to (...) live in before the age of playback. Consequently, emotions perceived and induced via music should be studied in such “original” contexts. (shrink)

The crisis of metaphysics has many roots. One of them is recognized to be a kind of semantic failure. It lies in the fact that the meaning and reference of metaphysical propositions as well as metaphysical terms seems to be problematic. This diagnosis was first established by I. Kant and then repeated by some of the XXth century philosophers. In this paper I will show what role is played by what I called the Requirement of Reference (RR) in the analysis (...) of the metaphysical discourse. I will argue that the RR draws the limitations for the conceptual and propositional schemata of metaphysics and, at the same time, prevents metaphysics from making de re assertions and utterances. I shall also examine in this light some of Ludwig Wittgenstein's theses from Tractatus and Philosophical Investigations in order to argue that two sorts of metaphysical considerations are possible despite of the above-mentioned criticism. One of them is the analysis of what might be shown but cannot be expressed in language. The other is the deep analysis of the conceptual schemata that constitute the foundations of human thought. Zusammenfassung: Aktuelle Debatten zu gesellschaftspolitischen Folgen der Corona-Pandemie zeigen, dass Intellektuelle wie Giorgio Agamben und Roberto Esposito den Begriff „Biopolitik“ ins Treffen führen, um Regierungsmaßnahmen zur Eindämmung des Virus zu analysieren. Seit Michel Foucaults Überlegungen zur Funktionsweise und Genealogie der Biopolitik birgt der Begriff jedoch eine gewisse Problematik: Aufgrund strukturell bedingter Mechanismen der Inklusion und Exklusion menschlichen Lebens gelingt es den biopolitischen Modellen nach Agamben und Esposito nicht – so die These –, ein zentrales Element des Politischen zu beschreiben. Unberücksichtigt (...) bleibt die Möglichkeit des Widerstands und der Kritik an Regierungsmaßnahmen; eine Möglichkeit, die gerade die Heterogenität politischer Ordnungsstrukturen anzeigt. Im Zuge der Analytik moderner Machttechniken verschiebt Foucault anders als Agamben und Esposito den Fokus von der Biopolitik hin zu einem umfassenderen Paradigma des „Regierens“, der Gouvernementalität. Infolgedessen lässt sich die Biopolitik als Regierungsweise thematisieren, mit der immer schon Formen widerständigen Handelns einhergehen. Um dieser Perspektive Rechnung zu tragen, argumentiert mein Beitrag mit Foucault gegen die primär strukturale Auffassung politischer Ordnungen nach Agamben und Esposito. (shrink)

Some contemporary philosophers, notably B. Williams and S. Wolf, argue that moral perfection is not just an unsustainable ideal, but also an unreasonable one in that it thwarts and demotes all the various elements that contribute to personal well-being. More importantly, moral perfection seems to imply the denial of an identifiable personal self; hence the paradox of moral perfection. I argue that this alleged paradox arises because of a misunderstanding of the role of moral ideals, of their overridingness, and of (...) the way they relate to well-being. (shrink)

Au carrefour de la phénoménologie française contemporaine Depuis la fin des années ’90, la réflexion sur l’événement a permis de compter Claude Romano parmi les protagonistes de la phénoménologie française contemporaine. Sa proposition phénoménologique s’est ensuite nouée (grâce à l’endurante lecture des romans de Faulkner) à l’inouï débordement de l’événement de la vie que le récit est censé redonner, pour ainsi dire, "en elle-même" et à l’abri de toute sorte de réduction. L’enjeu de ces pages – consacrées à l’ouvrage de (...) Claude Romano paru en 2010, Au cœur de la raison, la phénoménologie – sera la même répétition de la phénoménologie que Romano nous a livrée dans cet ouvrage. En effet, notre avis est que Romano, en 2010, a pratiqué une Wiederholung de la phénoménologie et qu’il l’a fait situant celle-ci au centre d’un carrefour où confluent les questions historiques (Husserl, Heidegger), les libres variations de la phénoménologie en France (Sartre, Merleau-Ponty, Levinas), la philosophie analytique. Or par cette répétition il s’est installé au carrefour de la phénoménologie française contemporaine , et cela pour deux raisons : premièrement, parce qu’il a donné une contribution décisive à l’alternative "réduction vs intentionnalité" qui ne cesse de représenter l’alternative de la réception française de la phénoménologie. Deuxièmement, parce que par sa répétition il a ouvert aussi un chemin nouveau et original qui maintenant demande à être phénoménologiquement questionné. (shrink)

El pensador esloveno Slavoj Žižek, cuya obra se ha difundido mundialmente traducida a muchas lenguas, sostiene que sus proposiciones teóricas, en particular las políticas, se fundan sobre la obra de Hegel. El presente estudio examina esta relación de Žižek con Hegel: qué aspectos del sistema, del método, de los conceptos hegelianos figuran en los libros de este contemporáneo; qué tratamiento, qué interpretación reciben, cuáles son las funciones principales que estos elementos desempeñan en la manera de pensar de Žižek.
