La plupart des approches développées en philosophie adop-tent la notion de représentation pour expliquer la relation entre l’esprit, le langage et le monde. L’idée générale est que les pensées représentent les faits du monde via des concepts et que le langage sert d’intermédiaire entre les deux en exprimant les pensées. Le lien est tissé par la signifi-cation. Certains pensent que la signification peut être analysée en termes des pensées des locuteurs. Comme pareilles pensées sont essentiellement intentionnelles, on explique la signification (...) à partir de l’intentionnalité et donc le langage à partir de l’esprit. Pour d’autres, l’esprit et le langage sont interdépendants. La structure de la pensée est déterminée en ana-lysant la structure profonde du langage. Les agents lient les contenus propositionnels au monde lorsqu’ils pensent ou parlent. Par contre, certains philosophes sont opposés aux deux conceptions antérieures. Ils refusent l’idée d’expliquer la signification en termes de pensées inten-tionnelles. Ils l’expliquent en termes de comportement langagier, mais sans pour autant faire référence au mental. Le langage est alors possible sans la pensée. Le but général de ce travail est de montrer pourquoi les approches philosophiques traditionnelles ont misé sur l’idée de représen-tation ou de signification pour expliquer l’interaction entre l’esprit, le langage et le monde. Plus particulièrement, j’explique pourquoi la théorie des actes de discours adopte une approche intermédiaire. Selon elle, l’esprit fonde le langage. Il y a donc primauté de la pensée sur le langage. Mais le principe d’exprimabilité exige une interdépendance entre pensée et langage. (shrink)

Le problème métaphysique central en philosophie de l’esprit concerne la relation entre l’esprit et le corps des agents. Quand on tente d’expliquer, par exemple, le rapport entre les pensées et les actions humaines, on est alors immédiatement confronté avec la difficulté, apparemment insurmontable, d’expliquer la causalité mentale. On doit répondre à la question : nos états de pensée causent-ils effectivement ce que l’on fait? Bien sûr, nos croyances, nos intentions et nos désirs sont à la base de notre comportement, dira (...) le sens commun et une longue tradition philosophique. Cependant, certains philosophes ont récemment manifesté des doutes à propos du rôle réel de nos pensées sur nos actions. Pour contrer ce scepticisme, il nous faut expliquer comment des états de pensée peuvent exercer leur rôle causal dans un monde fondamentalement physique. Je vais donner ici les raisons pour lesquelles je crois que les états de pensée sont indispensables à l’explication complète de nos actions. Pour ce faire, je procéderai à une analyse approfondie de la relation entre la causalité mentale ou intentionnelle et la causalité physique. Je mettrai en perspective deux approches importantes sur la causalité mentale : celle de John Searle, qui défend la réalité des états mentaux et semble résister au réductionnisme, et celle de Jaegwon Kim, qui montre le péril auquel l’approche de Searle est exposée : la surdétermination causale! Selon Searle, le mental est un trait du monde physique . Aux yeux de Kim cette stratification en niveaux n’apporte aucune solution au problème de la causalité mentale. Kim a-t-il raison? (shrink)

Le présent ouvrage collectif contient les Actes d'un colloque international bilingue sur l'action, les attitudes et la décision que nous avons organisé en hommage à notre regretté collègue J.-Nicolas Kaufmann à Trois-Rivières du 3 au 5 octobre 2002. L'ouvrage présente et discute d'hypothèses, d'enjeux et de théories contemporaines sur l'action, les attitudes, la rationalité et la décision. La première partie intitulée Pensées, actions et engagements contient des contributions de John Searle, Daniel Vanderveken, Candida Jaci de Sousa Melo et (...) Raimo Tuomela traitant de problèmes généraux de la philosophie de l'esprit et de l'action. Dans la deuxième partie de l'ouvrage intitulée Phénoménologie, ontologie et philosophie de l'esprit, nous avons regroupé, autour d'un texte de Nicolas Kaufmann, quatre études qui traitent diversement de la contribution de la phénoménologie classique, principalement de la phénoménologie de Husserl, à des questions centrales de la philosophie contemporaine dans les domaines de la philosophie de l'esprit, de la théorie de l'action et de l'ontologie formelle. La troisième partie de l'ouvrage, Causalité et naturalisme, réunit trois contributions qui portent sur des questions centrales de la philosophie contemporaine. Daniel Laurier se penche sur la question de savoir si le normativisme sémantique est compatible avec le naturalisme sémantique, alors qu'André Leclerc et Wilson Mendonça s'intéressent à la notion de causalité mentale et examinent différents arguments qui contestent le bien-fondé de cette notion. La dernière partie de l'ouvrage intitulée Rationalité et décision réunit trois contributions logico philosophiques de Storrs McCall, Mathieu Marion et Michel Paquette qui traitent de la rationalité des agents lors de leurs prises de décision et délibérations. Transformer-based language models (TLMs) have widely been recognized to be a cutting-edge technology for the successful development of deep-learning-based solutions to problems and applications that require natural language processing and understanding. Like for other textual domains, TLMs have indeed pushed the state-of-the-art of AI approaches for many tasks of interest in the legal domain. Despite the first Transformer model being proposed about six years ago, there has been a rapid progress of this technology at an unprecedented rate, whereby BERT and (...) related models represent a major reference, also in the legal domain. This article provides the first systematic overview of TLM-based methods for AI-driven problems and tasks in the legal sphere. A major goal is to highlight research advances in this field so as to understand, on the one hand, how the Transformers have contributed to the success of AI in supporting legal processes, and on the other hand, what are the current limitations and opportunities for further research development. This paper summarizes the results of 11 separate studies of deaf children’s performance on standard tests of false belief understanding, the results of which combine to show that deaf children from hearing families are likely to be delayed in acquiring a theory of mind. Indeed, these children generally perform no better than autistic individuals of similar mental age. Conversational and neurological explanations for deficits in mental state understanding are considered in relation to recent evidence from studies of deaf, autistic, and (...) normally developing children with varied levels of access to talk about mental states at home with family members during the preschool years. ABSTRACT: In the logical tradition of analytical philosophy, to understand the meaning of an utterance is to understand its truth conditions. In the tradition of natural language analysis, meaning is related to language use. Since Grice, meaning is linked to speakers’ attitudes and actions. Following Austin, Searle, and Vanderveken, to mean is to use words with the intention of performing illocutionary acts. Such acts have felicity conditions instead of truth conditions. The aim of my work is to clarify the nature of meaning in the second tradition. In my view, to mean something is mainly to attempt to perform illocutionary acts. Hyperscanning studies using functional Near-Infrared Spectroscopy have been performed to understand the neural mechanisms underlying human-human interactions. In this study, we propose a novel methodological approach that is developed for fNIRS multi-brain analysis. Our method uses support vector regression to predict one brain activity time series using another as the predictor. We applied the proposed methodology to explore the teacher-student interaction, which plays a critical role in the formal learning process. In an illustrative application, we collected fNIRS data of the (...) teacher and preschoolers’ dyads performing an interaction task. The teacher explained to the child how to add two numbers in the context of a game. The Prefrontal cortex and temporal-parietal junction of both teacher and student were recorded. A multivariate regression model was built for each channel in each dyad, with the student’s signal as the response variable and the teacher’s ones as the predictors. We compared the predictions of SVR with the conventional ordinary least square predictor. The results predicted by the SVR model were statistically significantly correlated with the actual test data at least one channel-pair for all dyads. Overall, 29/90 channel-pairs across the five dyads presented significant signal predictions withthe SVR approach. The conventional OLS resulted in only 4 out of 90 valid predictions. These results demonstrated that the SVR could be used to perform channel-wise predictions across individuals, and the teachers’ cortical activity can be used to predict the student brain hemodynamic response. Searching for Contract (Law) in Europe While investigating ways to Justifying Contract in Europe, Martijn Hesselink leaves it to the interrogated theories to define the scope of its very inquiry – the reach and significance of contract itself. This leaves the question of what Hesselink sets out to justify quite open for the reader, who at the same time gets the distinctive idea that this delimitation has normative significance in the author’s own views. To the extent that we do, as (...) a matter of justice, need to have contract law rules – then, these rules need to be just. The comment, thus, seeks to re-articulate Hesselink’s non-definition of (European) contract law, to try to delimit where we need such rules and test the boundaries of what rules we may in fact accept or even need as a matter of justice – what kind of rules we can, in Hesselink’s framework, ultimately set out to justify. What Solidarity? A Look Behind the Veil of Solidarity in ‘Corona Times’ Contractual Relations The article uses three prominent examples from the Dutch context to problematize the relationship between contractual and social solidarity during the coronavirus crisis. In this paper we use Hobby's duality for semi-De Morgan algebras, to characterize those algebras having only principal congruences in the classes of semi-De Morgan algebras, demi-pseudocomplemented lattices and almost pseudocomplemented lattices. This work extends some of the results reached by Beazer in [3] and [4].

The idea that women qua women can be dehumanized has been dismissed by feminist philosophers, like Kate Manne, and by philosophers of dehumanization, like David Livingstone Smith. Against these skeptics, I argue that we can and should use dehumanization to explain an important strand of misogyny. When they are dehumanized, women are represented simultaneously as human and as inhuman embodiments of the natural world. They therefore appear as magical, contaminating, sexualized threats towards whom violence is acceptable or even necessary. Misogynistic (...) dehumanization is important to understanding atrocities like the early modern European witch-hunts, but also contemporary phenomena like incel violence. (shrink)

One of the key insights of Simone de Beauvoir’s The Second Sex is the idea that gender-based subordination is not just something done to women, but also something women do to themselves. This raises a question about ethical responsibility: if women are complicit, or actively implicated in their own oppression, are they at fault? Recent Beauvoir scholarship remains divided on this point. Here, I argue that Beauvoir did, in fact, ethically criticize many women for their complicity, as a sign of (...) what she called “bad faith”. I challenge recent accounts by Nancy Bauer and Manon Garcia, who both read Beauvoir as exonerating complicit women. According to this reading, women emerge as human “freedoms” within a social world where a “destiny” of inferiority is already prepared for them. Their self-subordination is then an inevitable product of acting in a patriarchal world. I argue, however, that this interpretation generates a crucial tension, leading Bauer and Garcia to call on women to stop being complicit, while also claiming they cannot avoid complicity. I propose instead a different interpretation, on which feminine complicity is often fueled by criticizable ethical attitudes that are far from inevitable. By revisiting Beauvoir’s notion of “bad faith”, I show that this account is compatible with recognizing the limitations imposed on women’s agency and I show that this feminist ethical criticism is itself an important part of a collective project of social transformation. The therapeutic misconception has been seen as presenting an ethical problem because failure to distinguish the aims of research participation from those receiving ordinary treatment may seriously undermine the informed consent of research subjects. Hence, most theoretical and empirical work on the problems of the therapeutic misconception has been directed to evaluate whether, and to what degree, this confusion invalidates the consent of subjects. We argue here that this focus on the understanding component of informed consent, while important, might be (...) too narrow to capture the ethical complexity of the therapeutic misconception. We show that concerns about misplaced trust and exploitation of such trust are also relevant, and ought to be taken into account, when considering why the therapeutic misconception matters ethically. Este trabalho apresenta algumas considerações do pensador italiano Gianni Vattimo acerca da religião na idade contemporânea. O referido filósofo tem como base de suas reflexões a ideia de uma filosofia pós-moderna que se caracteriza pela desconstrução da metafísica da tradição moderna. Nesse sentido, o autor visualiza nas filosofias de Nietzsche e Heidegger a inauguração de uma nova orientação do pensamento ocidental, marcada por esse rompimento com as filosofias totalizantes e pela consideração do ser como resultado das circunstancias eventuais que compõem (...) a experiência existencial. A religião, por sua vez, não acompanhou tal movimento, mas conservou um pensamento marcado ainda pela estrutura da metafísica tradicional, por isso, não se encontra em condições de responder às atuais demandas deste mundo plural. O autor sinaliza para a necessidade da abdicação das estruturas dogmáticas e dos fundamentalismos da religião como meio para a abertura ao diálogo inter-religioso e intercultural. (shrink)

In recent years, online “involuntary celibate” or “incel” communities have been linked to various deadly attacks targeting women. Why do these men react to romantic rejection with not just disappointment, but murderous rage? Feminists have claimed this is because incels desire women as objects or, alternatively, because they feel entitled to women’s attention. I argue that both of these explanatory models are insufficient. They fail to account for incels’ distinctive ambivalence toward women—for their oscillation between obsessive desire and violent hatred. (...) I propose instead that what incels want is a Beauvoirian “Other.” For Beauvoir, when men conceive of women as Others, they represent them as simultaneously human subjects and embodiments of the natural world. Women function then as sui generis entities through which men can experience themselves as praiseworthy heroes, regardless of the quality of their actions. I go on to give an illustrative analysis of Elliot Rodger’s autobiographical manifesto, “My Twisted World.” I show how this Beauvoirian model sheds light on Rodger’s racist and classist attitudes and gives us a better understanding of his ambivalence toward women. It therefore constitutes a powerful and overlooked theoretical alternative to accounts centered on objectification and entitlement. (shrink)

While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

Theory of Mind (ToM) is the cognitive achievement that enables us to report our propositional attitudes, to attribute such attitudes to others, and to use such postulated or observed mental states in the prediction and explanation of behavior. Most normally developing children acquire ToM between the ages of 3 and 5 years, but serious delays beyond this chronological and mental age have been observed in children with autism, as well as in those with severe sensory impairments. We examine data from (...) studies of ToM in normally developing children and those with deafness, blindness, autism and Williams syndrome, as well as data from lower primates, in a search for answers to key theoretical questions concerning the origins, nature and representation of knowledge about the mind. In answer to these, we offer a framework according to which ToM is jointly dependent upon language and social experience, and is produced by a conjunction of language acquisition with children's growing social understanding, acquired through conversation and interaction with others. We argue that adequate language and adequate social skills are jointly causally sufficient, and individually causally necessary, for producing ToM. Thus our account supports a social developmental theory of the genesis of human cognition, inspired by the work of Sellars and Vygotsky. How are we to decide whether to take reason to be an essentially private thing that can, however, turn on a public display when it chooses to do so, or, like conversing, to be an essentially social skill, which can, however, be retained a while through periods of solitary confinement? (Annette Baier, The Commons of the Mind, p. 5). The squirrel does not infer by induction that it is going to need stores next winter as well (Wittgenstein, On Certainty§ 287). The problem of thought and language thus extends beyond the limits of natural science and becomes the focal problem of historical human psychology, i.e. of social psychology. Consequently, it must be posed in a different way (Vygotsky, Thought and Language, p. 51). From the very first days of the child's development his activities acquire a meaning of their own in a system of social behaviour and, being directed towards a definite purpose, are refracted through the prism of the child's environment. The path from object to child and from child to object passes through another person. This complex human structure is the product of a developmental process deeply rooted in the links between individual and social history (Vygotsky, Mind in Society, p. 30). (shrink)

The lack of public support for climate change policies and refusals to vaccinate children are just two alarming illustrations of the impacts of dissent about scientific claims. Dissent can lead to confusion, false beliefs, and widespread public doubt about highly justified scientific evidence. Even more dangerously, it has begun to corrode the very authority of scientific consensus and knowledge. Deployed aggressively and to political ends, some dissent can intimidate scientists, stymie research, and lead both the public and policymakers to oppose (...) important public policies firmly rooted in science. -/- To criticize dissent is, however, a fraught exercise. Skepticism and fearless debate are key to the scientific process, making it both vital and incredibly difficult to characterize and identify dissent that is problematic in its approach and consequences. Indeed, as de Melo-Martín and Intemann show, the criteria commonly proposed as means of identifying inappropriate dissent are flawed and the strategies generally recommended to tackle such dissent are not only ineffective but could even make the situation worse. -/- The Fight Against Doubt proposes that progress on this front can best be achieved by enhancing the trustworthiness of the scientific community and by being more realistic about the limits of science when it comes to policymaking. It shows that a richer understanding of the context in which science operates is needed to disarm problematic dissent and those who deploy it. This, the authors argue, is the best way forward, rather than diagnosing the many instances of wrong-headed dissent. (shrink)

Philosophers of science have come to accept that contextual values can play unavoidable and desirable roles in science. This has raised concerns about the need to distinguish legitimate and illegitimate value influences in scientific inquiry. I discuss here four such concerns: epistemic distortion, value imposition, undermining of public trust in science, and the use of objectionable values. I contend that preserving epistemic integrity and avoiding value imposition provide good reasons to attempt to distinguish between legitimate and illegitimate influences of values (...) in science. However, the trust and the objectionable values concerns constitute no good reason for demarcation criteria. (shrink)

This article presents and discusses an innovative pedagogical device designed for training pre-service teachers on the nature of science. We endorse an approach according to which aspects of the nature of science should be explicitly discussed in order to be understood by learners. We identified quantum physics, and more precisely the principles of uncertainty and complementarity, as a rich topic suitable for such a discussion. Our training device consists in preparing and staging a new type of theater, the “scientific experimental (...) theater,” based both on the characteristics of Brecht’s theater and Kelly’ cyclic theory of learning. This device was implemented with a group of eight pre-service teachers. According to our observations, the approach favors their involvement and provides them with a frame for expressing their doubts and confronting their points of view. By analyzing their discussion, we identified several aspects of the nature of science that the pre-service teachers raised spontaneously: subjectivity, the social and cultural embeddedness of science, the construction and status of models, and the role of questioning in the development of science. The implemented device therefore appears as an interesting means for stimulating a rich discussion on the nature of science. This study opens new avenues for teachers’ and students’ training devices aimed at developing a critical and reflective stance on science. (shrink)

Quando se fala em património cultural, uma área que costuma ficar na penumbra é a dos arquivos históricos. De entre estes, um dos conjuntos mais vulneráveis é o dos arquivos de editoras e outros agentes da edição. Este artigo propõe uma reflexão em torno do património arquivístico em geral e dos arquivos das editoras em particular, a nível internacional. Tal digressão analítica e problematizante serve, em boa medida, para ajudar a repensar o caso português, cujos atrasos e impasses urge solucionar, (...) sob pena de se perderem irremediavelmente fontes preciosas para o conhecimento da nossa contemporaneidade. Gender seems to be everywhere in the norms governing our social world: from how to be a good friend and how to walk, to children’s clothes. It is not surprising then that a difficulty in identifying someone’s gender is often a source of discomfort and even anxiety. Numerous theorists, including Judith Butler and Charlotte Witt, have noted that gender is unlike other important social differences, such as professional occupation or religious affiliation. It has a special centrality, ubiquity and importance in (...) social practices. This observation moves us away from the classic philosophical question ‘what is gender?’ towards a more underappreciated one: ‘what is the role of gender’? To answer this question, I introduce the notion of social standing, which refers to our ability to enter into social relations. Social standing distinctions are an important feature of human societies. However, our existing philosophical tools do not adequately capture this notion: it is neither a moral distinction, nor is it reducible to hierarchy. I offer a conception of our entry into social relations as always conditioned by various shared representational assumptions about social subjects. When individuals are anomalous with respect to those assumptions, their social standing is in doubt. This explains important forms of uncommon and peculiar treatment across societies. I argue that forms of social devaluation on the basis of severe and visible disability in our society are central examples of diminished social standing. In our social context, being hard to recognize through the matrix of gender makes one representationally anomalous and imperils one’s social standing. Gender plays a fundamental role because gender legibility is a precondition for full social standing. Gender norms parallel ‘ability norms’ in this respect, linking notions of normalcy in scholarship on gender and in scholarship on disability. Social standing also explains two key phenomena about gender. Firstly, it tells us why our social practices and norms are pervasively gendered. Given the performative and relational nature of gendered positions, this is necessary for constant gender legibility. Secondly, social standing recognition accounts for social anxiety phenomena around gender ambiguity. These phenomena are reactions to anomaly as a threat to our social systems of meaning. In the final part of my dissertation, I consider some political consequences of my view. Understanding this special role of gender allows us to identify a distinct type of backlash to feminist social change that is particularly insidious. It is not driven by the hierarchical investments of the most gender-privileged, but rather by our collective investment in gender as a system of social coordination. I explore 2000s ‘raunch feminism’ to argue for this hypothesis. Gender’s role as a conditioning parameter of social standing puts systematic pressure on all would-be social subjects to be gender legible. This requires that individuals position themselves in recognizably gendered ways within social practices. But when gender differentiation is eroded, this positioning becomes tricky. This gives rise to a disorientation I call ‘meaning vertigo’. Meaning vertigo prompts attempts at reinstating a clear gendered system. In the process, gender equality suffers a serious set-back. To make substantial feminist progress, we must unseat gender from its central position in social domains like sexuality. I suggest that the best way to do this may be by foregrounding other aspects of social identity as systems of social coordination, instead of working on gender directly. (shrink)

Frisbee Sheffield argues that the Symposium has been unduly marginalized by philosophers. Although the topic, eros, and the setting at a symposium have seemed anomalous, she demonstrates that both are intimately related to Plato's preoccupation with the nature of the good life, with virtue, and how it is acquired and transmitted. For Plato, analyzing our desires is a way of reflecting on the kind of people we will turn out to be and on our chances of leading a worthwhile and (...) happy life. This article is part of the research project ‘Representação midiática da violação de direitos e da violência contra pessoas em situação de rua no jornalismo on-line’, associated with Red Latinoamericana de Análisis Crítico del Discurso de la Extrema Pobreza, and focuses upon the ways in which electronic news media represent homeless people in Brazil. The focus is a pair of texts, related through internal hyperlinks, about the controversy concerning the installation of a social center in a middle-class neighborhood in central (...) Sao Paulo. The texts are analyzed on the theoretical basis of critical discourse analysis and considering the following analytical categories: metaphor, representation of social actors and intertextuality. Analyses show a scenario of ‘invasion by unwelcome people’, who are not perceived as rights holders, but as a threat to the rights of others. (shrink)

Qual a influência exercida pela América Latina na construção do Relatório MacBride e na formulação das teses que embasaram a proposta de uma Nova Ordem Mundial da Informação e da Comunicação? A intenção deste trabalho é esclarecer o episódio histórico protagonizado pela UNESCO no ocaso da guerra-fria, ao focalizar as teses sobre a democratização da comunicação e discutir a significação daquela plataforma política na presente conjuntura internacional.

It is argued here that bioethicists might inadvertently be promoting genetic determinism: the idea that genes alone determine human traits and behaviours. Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. At the end of 2017, Kristen Roupenian’s short story, Cat Person, went viral. Published at the height of the #MeToo movement, it depicted a ‘toxic date’ and a disturbing sexual encounter between Margot, a college student, and Robert, an older man she meets at work. The story was widely viewed as a relatable denunciation of women’s powerlessness and routine victimization. In this paper, I push against this common reading. I propose an alternative feminist interpretation through the lens of Simone de (...) Beauvoir’s notion of narcissism: a form of alienation that consists in making oneself both the subject and the ultimate project of one’s life. Framing Margot as a narcissist casts her as engaging, not in subtly coerced, undesired sex, but rather in sex that is desired in a tragically alienated way. I argue that Beauvoir’s notion of narcissism is an important tool for feminists today – well beyond the interpretation of Cat Person. It presses us to see systematic subordination not just as something done to women, but also as something women do to themselves. This in turn highlights the neglected role of self-transformation as a key aspect of feminist political resistance. (shrink)

Recently, some have proposed moral bioenhancement as a solution to the serious moral evils that humans face. Seemingly disillusioned with traditional methods of moral education, proponents of bioenhancement believe that we should pursue and apply biotechnological means to morally enhance human beings. Such proposal has generated a lively debate about the permissibility of moral bioenhancement. We argue here that such debate is specious. The claim that moral bioenhancement is a solution – whether permissible or not – to the serious moral (...) problems that affect human beings is based on several problematic framing assumptions. We evaluate here three of such assumptions: the first rests on a contested understanding of morality, the second consist in a mistaken conception of human moral problems, and the third relates to problematic presuppositions grounding the interpretation of existent scientific evidence presented to defend moral bioenhancement. Once these framing assumptions are identified and critically evaluated, it becomes clear that the moral bioenhancement debate is misguided. (shrink)

This article presents original empirical data generated from the Crown Prosecution Service (CPS) Pilot Evaluation of pre-trial witness interviewing (PTWI) in England and Wales. Section 1 introduces the PTWI Pilot and describes the methodological strengths and limitations of our qualitative socio-legal study. Forming the richly documented empirical core of the article, Sections 2–5 identify the principal considerations which seemed to influence case selection for Pilot interviews. An overlapping collection of evidentiary, strategic and circumstantial factors encouraged prosecutors to resort to PTWI, (...) whilst other, countervailing considerations were apprehended as disincentives. Assessments of witness credibility were central to prosecutors’ attempts to balance these competing factors. Section 6 concludes by underlining the potential of qualitative socio-legal studies to promote more nuanced understandings of criminal process, and by extension to make practical contributions to evidence-based criminal procedure reform. Reprogenetic technologies, which combine the power of reproductive techniques with the tools of genetic science and technology, promise prospective parents a remarkable degree of control to pick and choose the likely characteristics of their offspring. Not only can they select embryos with or without particular genetically-related diseases and disabilities but also choose embryos with non-disease related traits such as sex. -/- Prominent authors such as Agar, Buchanan, DeGrazia, Green, Harris, Robertson, Savulescu, and Silver have flocked to the banner of reprogenetics. (...) For them, increased reproductive choice and reduced suffering through the elimination of genetic disease and disability are just the first step. They advocate use of these technologies to create beings who enjoy longer and healthier lives, possess greater intellectual capacities, and are capable of more refined emotional experiences. Indeed, Harris and Savulescu in particular take reprogenetic technologies to be so valuable to human beings that they have insisted that their use is not only morally permissible but morally required. -/- Rethinking Reprogenetics challenges this mainstream view with a contextualised, gender-attentive philosophical perspective. De Melo-Martín demonstrates that you do not have to be a Luddite, social conservative, or religious zealot to resist the siren song of reprogenetics. Pointing out the flawed nature of the arguments put forward by the technologies' proponents, Rethinking Reprogenetics reveals the problematic nature of the assumptions underpinning current evaluations of these technologies and offers a framework for a more critical and skeptical assessment. The aim of this paper is to show that critics of biological explanations of human nature may be granting too much to those who propose such explanations when they argue that the truth of genetic determinism implies an end to critical evaluation and reform of our social institutions. This is the case because when we argue that biological determinism exempts us from social critique we are erroneously presupposing that our social values, practices, and institutions have nothing to do with what (...) makes biological explanations troublesome. My argument is that what constitutes a problem for those who are concerned with social justice is not the fact that particular behaviours may be genetically determined, but the fact that our value system and social institutions create the conditions that make such behaviours problematic. Thus, I will argue that even if genetic determinism were correct, the requirement of assessing and transforming our social practices and institutions would be far from superfluous. Biology is rarely destiny for human beings and the institutions they create. (shrink)

Resumo: A proposta é analisar a concepção de trabalho de Hesíodo em Os Trabalhos e Os Dias e abordar os referenciais de sua relação entre trabalho, virtude e justiça. A fonte é: Os Trabalhos e Os Dias e análise contemporânea de sua obra, já consagrada. Entende-se que as necessidades materiais, comuns e aceitas no mundo rural de então, motivaram-no a defender o trabalho como meio de transformação social e de superação do contexto desolador em que vivia o camponês. Seu interlocutor (...) explícito era Perses, com o qual estava em litígio de herança, mas os conselhos e ensinamentos morais, éticos e espirituais de exaltação do labor adquiriram dimensão coletiva. Ao desvendar a vida do trabalhador dos campos, com sua cultura e seu respeito pela natureza, Hesíodo retirou-o do anonimato e exaltou-o como um novo herói que, mediante o trabalho, dominava a natureza, colocando-a a seu favor. Com sua ‘pedagogia do ser e fazer’, desalojou o tradicional guerreiro aristocrata, que obtinha a honra e a glória nos campos de batalha, e cantou o novo herói do trabalho, ecoando uma voz que já não podia ser ignorada ou silenciada. Palavras-chaves: Hesíodo; Educação; Trabalho; Justiça; Virtude The ‘Pedagogy of being and doing’ in Hesiod’s Work and Days Abstract: Current paper analyzes the concept of work in Hesiod´s Works and Days and undertakes the relationship between work, virtue and justice. The source comprises Works and Days and the contemporary analysis of the already acknowledged masterpiece. It should be emphasized that common material needs accepted within the agricultural world of the time motivated him to defend work as a mean of social transformation and the overcoming of the desolating context in which the peasant lived. The poem´s overt interlocutor is Perses, with whom he was in conflict over an inheritance, but warnings and moral, ethical and spiritual teachings on the praise of labor attained a collective stance. Revealing the peasant´s life, with his culture and respect for Nature, Hesiod retrieved from anonymity and exalted the peasant as a novel hero who, through labor, dominated Nature and placed it in his favor. Through his ‘pedagogy of being and doing’, Hesiod replaced the traditional aristocratic warrior who obtained honor and glory in the battlefields, and sung the new worker hero, emitting a voice that would be neither ignored nor silenced. La ‘Pedagogía del ser y del hacer’ en Las Obras y los Días Resumen: El artículo analiza el concepto de trabajo en Los trabajos y los días de Hesíodo y emprende la relación entre trabajo, virtud y justicia. Nuestra fuente comprende Los trabajos y los días y el análisis contemporáneo de la obra ya reconocida. Cabe destacar que las necesidades materiales comunes aceptadas dentro del mundo agrícola de la época motivaron el autor a defender el trabajo como medio de transformación social y de superación del contexto desolador en que vivía el campesino. El interlocutor del poema es Perses, con quien estaba en conflicto por una herencia, pero las advertencias y las enseñanzas morales, éticas y espirituales sobre la alabanza del trabajo alcanzaron una postura colectiva. Revelando la vida del campesino, con su cultura y respeto por la Naturaleza, Hesíodo recuperó del anonimato y exaltó al campesino como un héroe novedoso que, a través del trabajo, dominó la Naturaleza y la colocó a su favor. A través de su ‘pedagogía del ser y el hacer’, Hesíodo reemplazó al guerrero aristocrático tradicional que obtenía honor y gloria en los campos de batalla, y cantó al nuevo héroe obrero, emitiendo una voz que no sería ignorada ni silenciada. Esse artigo apresenta parte do debate sobre Juventude no Brasil e em Portugal analisadas na pesquisa de doutoramento realizada na Universidade Federal da Bahia-Faculdade de Educação (UFBA) e na Universidade de Lisboa- Instituto de Ciências Sociais (ICS) entre os anos de 2013 e 2017 (MORAES, 2017). Problematiza as relações entre juventude negra, políticas públicas e educação em comunidades de Salvador e Lisboa tomando como referencial estudos da Sociologia da Juventude. Através de pesquisa qualitativa com inspiração etnográfica, o estudo de caso (...) contrasta narrativas de gestores de políticas de juventude, educadores sociais, assim como de jovens negros brasileiros, portugueses e cabo-verdianos participantes de projetos de educação social. Intenta ainda dar visibilidade a retomada de políticas públicas para juventudes negras no Brasil como estratégia de enfrentamento do Estado ao genocídio da população negra brasileira.
