Transformer-based language models (TLMs) have widely been recognized to be a cutting-edge technology for the successful development of deep-learning-based solutions to problems and applications that require natural language processing and understanding. Like for other textual domains, TLMs have indeed pushed the state-of-the-art of AI approaches for many tasks of interest in the legal domain. Despite the first Transformer model being proposed about six years ago, there has been a rapid progress of this technology at an unprecedented rate, whereby BERT and (...) related models represent a major reference, also in the legal domain. This article provides the first systematic overview of TLM-based methods for AI-driven problems and tasks in the legal sphere. A major goal is to highlight research advances in this field so as to understand, on the one hand, how the Transformers have contributed to the success of AI in supporting legal processes, and on the other hand, what are the current limitations and opportunities for further research development. Notes on and excerpted quotations from Eugene Halton’s theory of the self (and mind) as continuous with and involved in its objective surroundings as extensions of the self. These notes provide evidence for Halton’s multiple works as the earlier basis for what Russell Belk later called "the extended self" in 1988, for which he got credit while Halton’s original ideas were marginalized or excluded. In addition, Halton also developed some of these ideas as "critical animism," (see (...) text) a predecessor to what is now termed, "the new animism." This paper summarizes the results of 11 separate studies of deaf children’s performance on standard tests of false belief understanding, the results of which combine to show that deaf children from hearing families are likely to be delayed in acquiring a theory of mind. Indeed, these children generally perform no better than autistic individuals of similar mental age. Conversational and neurological explanations for deficits in mental state understanding are considered in relation to recent evidence from studies of deaf, autistic, and (...) normally developing children with varied levels of access to talk about mental states at home with family members during the preschool years. This essay from 1999, republished in Notre Dame Magazine online in July 2023, explores how the 1950s were a time of fundamental transformations in American society, a time when the United States went fully megatechnic. The hugely increased power of military, corporate-industrial and “big science” institutions developed during the 1950s signaled the transformation to megatechnic America, with atomic bombs and nuclear testing, automobiles and televisions as key symbols of that transformation. Figures such as J. Robert Oppenheimer and Edward Teller illustrated (...) the battle between national security dictates controlling nuclear bomb testing and responsible science. -/- Since the Second World War the United States has been problematically guided by a power-oriented culture, which, in the names of national security and convenience, has tended to reshape America toward an increasingly hierarchical model of society based on the system requirements of a machine. This same era gave birth to a generalized economic prosperity in the United States, to the civil rights movement, to feminism, literary and artistic innovations, and to other openings of public equality and freedom. Yet the magnification of bureaucratic-corporate structures in that postwar, cold war prosperity has ultimately tended to restructure America against the basic requirements of democratic community. Across several disciplines there has been renewed interest in philosophical pragmatism in the past few years. What had been a body of thought reduced largely to the influence of George Herbert Mead in sociology, has reemerged with significance for semiotics, philosophy, literary criticism, and other disciplines. The reasons for a renewed interest in the thought of Charles Peirce, William James, John Dewey, and a revised George Herbert Mead can be found in the theory of meaning proposed by the pragmatists: a (...) theory of meaning that can include more phenomena within the realm of significance, and therefore a theory of meaning that can contribute to ongoing attempts to refashion social theory. Hyperscanning studies using functional Near-Infrared Spectroscopy have been performed to understand the neural mechanisms underlying human-human interactions. In this study, we propose a novel methodological approach that is developed for fNIRS multi-brain analysis. Our method uses support vector regression to predict one brain activity time series using another as the predictor. We applied the proposed methodology to explore the teacher-student interaction, which plays a critical role in the formal learning process. In an illustrative application, we collected fNIRS data of the (...) teacher and preschoolers’ dyads performing an interaction task. The teacher explained to the child how to add two numbers in the context of a game. The Prefrontal cortex and temporal-parietal junction of both teacher and student were recorded. A multivariate regression model was built for each channel in each dyad, with the student’s signal as the response variable and the teacher’s ones as the predictors. We compared the predictions of SVR with the conventional ordinary least square predictor. The results predicted by the SVR model were statistically significantly correlated with the actual test data at least one channel-pair for all dyads. Overall, 29/90 channel-pairs across the five dyads presented significant signal predictions withthe SVR approach. The conventional OLS resulted in only 4 out of 90 valid predictions. These results demonstrated that the SVR could be used to perform channel-wise predictions across individuals, and the teachers’ cortical activity can be used to predict the student brain hemodynamic response. This book traces the development of British psychoanalyst Marion Milner's (1900-1998) autobiographical acts throughout her lifetime, proposing that Milner is a thinker to whom we can turn to explore the therapeutic potentialities of autobiographical and creative self-expression. Milner's experimentation with aesthetic, self-expressive techniques are a means to therapeutic ends, forming what Emilia Halton-Hernandez calls her 'autobiographical cure'. This book considers whether Milner's work champions this site for therapeutic work over that of the relationship between patient and analyst in the (...) psychoanalytic setting. This book brings to light a theory and practice which is latent and sometimes hidden, but which is central to understanding what drives Milner's autobiographical work. It is by doing this work of elucidation and organisation that Halton-Hernandez finds Milner to be a thinker with a unique take on psychoanalysis, object relations theory, creativity, and autobiography, working at the interstices of each. Divided into two fascinating sections exploring Milner's distinctive method and the legacy and influence of her work, this book will appeal to psychoanalysts, art therapists, philosophers, and art and literary researchers alike. Theory of Mind (ToM) is the cognitive achievement that enables us to report our propositional attitudes, to attribute such attitudes to others, and to use such postulated or observed mental states in the prediction and explanation of behavior. Most normally developing children acquire ToM between the ages of 3 and 5 years, but serious delays beyond this chronological and mental age have been observed in children with autism, as well as in those with severe sensory impairments. We examine data from (...) studies of ToM in normally developing children and those with deafness, blindness, autism and Williams syndrome, as well as data from lower primates, in a search for answers to key theoretical questions concerning the origins, nature and representation of knowledge about the mind. In answer to these, we offer a framework according to which ToM is jointly dependent upon language and social experience, and is produced by a conjunction of language acquisition with children's growing social understanding, acquired through conversation and interaction with others. We argue that adequate language and adequate social skills are jointly causally sufficient, and individually causally necessary, for producing ToM. Thus our account supports a social developmental theory of the genesis of human cognition, inspired by the work of Sellars and Vygotsky. How are we to decide whether to take reason to be an essentially private thing that can, however, turn on a public display when it chooses to do so, or, like conversing, to be an essentially social skill, which can, however, be retained a while through periods of solitary confinement? The problem of thought and language thus extends beyond the limits of natural science and becomes the focal problem of historical human psychology, i.e. of social psychology. From the very first days of the child's development his activities acquire a meaning of their own in a system of social behaviour and, being directed towards a definite purpose, are refracted through the prism of the child's environment. The path from object to child and from child to object passes through another person. Searching for Contract (Law) in Europe While investigating ways to Justifying Contract in Europe, Martijn Hesselink leaves it to the interrogated theories to define the scope of its very inquiry – the reach and significance of contract itself. This leaves the question of what Hesselink sets out to justify quite open for the reader, who at the same time gets the distinctive idea that this delimitation has normative significance in the author’s own views. To the extent that we do, as (...) a matter of justice, need to have contract law rules – then, these rules need to be just. The comment, thus, seeks to re-articulate Hesselink’s non-definition of (European) contract law, to try to delimit where we need such rules and test the boundaries of what rules we may in fact accept or even need as a matter of justice – what kind of rules we can, in Hesselink’s framework, ultimately set out to justify. This work extends some of the results reached by Beazer in [3] and [4].

Dreaming is a communicative activity between the most sensitive archive of the enregistered experience of life on the earth, the brain, and the most plastic medium for the discovery and practice of meaning, the mind or culture. Both love and war have been made on the basis of dreams, not to mention scientific discoveries. In ancient Greece dreams were medicinal parts of curative sleeping or "incubation" rites in the temple of Aesculapius, and many psychoanalytic physicians today still consider dreams as (...) possessing therapeutic potential. The ethnographic literature gives ample testimony to the great significance accorded to dreams by all of the world cultures. Dreams form a rich store of ethnographic evidence, and their indigenous interpretations can often illuminate the central issues and conflicts of a people otherwise hidden from obvious view. Given these facts, plus the physiological facts that the dream process itself involves deeply-rooted material brain functions, and that rapid eye movement, or REM, sleep, which is the key indicator of human dreaming, is shared by all mammals, it remains strange how little attention is given to dreaming as a formative aspect of human evolution and culture. -/- This essay addresses dreaming as a formative aspect of human evolution and culture by viewing dreaming as a borderland between biology and culture, a thoroughly social, yet private experience. Dreaming not only highlights the "cultic" roots of culture—the spontaneous impulse to meaning—but also illustrates one of the ways in which the technics of the biosocial human body itself form the primary source of culture. I show why dreaming, although private, is a thoroughly cultural, biological, communicative activity. -/- Culture and biology are often treated by social scientists as though they were oil and water, not to be mixed. I should inform the culture theorist at the start that I am fully aware of the assumed nature-culture dichotomy, and that I reject it. I do so not because I am a sociobiologist, quite the contrary, rather because I am a semiotician, and my studies of signs have led me toward a critical reconstruction of the concepts of nature and culture. This early article in The University of Chicago Magazine, coauthored with Mihaly Csikszentmihalyi, was one of the first publications deriving from Eugene Halton’s dissertation research on the meanings of household possessions for a sample of over 300 three-generation Chicago area families. In addition to empirical findings reported in Halton’s dissertation and later in the book coauthored with Csikszentmihalyi, The Meaning of Things, the article introduces Halton’s distinction of two kinds of materialism: instrumental materialism and terminal materialism.

Pour d’autres, l’esprit et le langage sont interdépendants. La structure de la pensée est déterminée en ana-lysant la structure profonde du langage. Les agents lient les contenus propositionnels au monde lorsqu’ils pensent ou parlent. Par contre, certains philosophes sont opposés aux deux conceptions antérieures. Ils refusent l’idée d’expliquer la signification en termes de pensées inten-tionnelles. Ils l’expliquent en termes de comportement langagier, mais sans pour autant faire référence au mental. Le langage est alors possible sans la pensée. Le but général de ce travail est de montrer pourquoi les approches philosophiques traditionnelles ont misé sur l’idée de représen-tation ou de signification pour expliquer l’interaction entre l’esprit, le langage et le monde. Plus particulièrement, j’explique pourquoi la théorie des actes de discours adopte une approche intermédiaire. Selon elle, l’esprit fonde le langage. Il y a donc primauté de la pensée sur le langage. The tendency in semiotics toward unnecessary abstractionism and antinaturalism is criticized. More broadly, a transformation is proposed from abstractionism, with its fetishism of signs, to an animism of signs in which the imagination and the signs it gives birth to not only reconnect with the biocultural heritage, but also animate an idea of culture as involving living purpose, not simply inert code. See the revised version of this chapter in my book, Meaning and Modernity.

English manuscript version of Afterword to German translation of Victor Turner's The Ritual Process. The Ritual Process is a pivotal book in the body of Victor Turner's works. The first three chapters, drawn from Turner's Henry Morgan lectures at the University of Rochester, reveal the richness and subtlety of his analysis of tribal ritual and social life. In the third chapter, he concentrates on the aspects of liminality and communitas found in Ndembu ritual and expands these in the remainder of (...) the book to universal categories of human experience. His masterful ethnography opens up to reveal the fundamental reality of the subjunctive mood in human affairs: the ritual process. In Turner's analyses of the Isoma and Wubwang'a rituals of the Ndembu of Northwestern Zambia, one sees the fantastic interplay between human affliction and symbolic renewal, between human communities and a natural environment teeming with signification. The Ndembu are revealed to be a people with a deep appreciation of the complexity of existence, and endowed with a sophisticated technics of meaning, a vast architectonic of felt, expressive forms through which to journey to those borderlands beyond human comprehensibility: death, the dead, the call of the mother-line, fecundity, transformation, the interstices of social structure. Turner reveals himself to be an initiate, not only to the rites revealed to him by the Ndembu, but to the centrality of ritual itself in tribal society and human affairs. Trained in the British structural-functionalist approach to social anthropology, Turner notes how the incessant call of the drums made him feel that he "was always on the outside looking in." Soon, however, Turner and his wife and collaborator Edith discarded their theoretical ear-plugs and answered the invitation of the drums. As observers and co-participants in Ndembu ritual the Turners' began to blaze a trail toward a new anthropology. (shrink)

J. David Lewis and Richard L. Smith provide a history of pragmatism and Chicago sociology based on the positions of realism and nominalism. This issue is indeed the key to understanding pragmatism’s foundations in Charles Peirce’s original formulation. Lewis and Smith claim that there are two pragmatisms, a realistic one characterized by Peirce and Mead and a nominalistic one (which Lewis and Smith claim has no value) illustrated by James and Dewey. They argue that Chicago sociology, including Herbert Blumer, was (...) under the influence of the nominalistic pragmatism, and that Mead exercised little influence during his lifetime. The argument is based on an ahistorical, a priori "metatheoretical" realism-nominalism distinction that claims to be based on Peirce's discussions of realism and nominalism. Yet the authors support their understanding of realism by appealing to Mead’s discussion of “contact experience,” and claim that Peirce’s realism must be based in non-symbolic “pure resistance.” Ironically, such a view represents the main tenet of nominalism, that only individual particulars are real, and amounts to a denial of Peirce’s category of Thirdness as reducible to the “pure resistance” of Secondness. Lewis and Smith attempt to correct the subjectivist tendencies of symbolic interactionism yet would problematically replace them with an equally subjective view of what constitutes objectivity: individual reaction with an object. American Sociology and Pragmatism tends to present a monistic universe hinging on a nominalistic interpretation of realism, a single-visioned view that places more emphasis on labels than on the substance and pragmatic import of a theorist's thoughts, resulting in serious distortions pro and con. Yet it also has opened up for serious questioning the whole foundations of symbolic interactionism and Mead's place within pragmatism and Chicago sociology. Though the authors claim to be "revisionists," it seems to me that they are also "fundamentalists" in safely preserving Mead at the center of a history they claim he did not significantly influence. In my opinion the ongoing controversy will result in a broader understanding of the antecedents of contemporary symbolic interactionism, one that will call for Mead's now dominating role as the sole representative of pragmatism for many American sociologists to be reevaluated and placed within the context of the quite substantial contributions of Peirce, James, and Dewey. Educational interventions are necessary to develop mathematical competence at early ages and prevent widespread mathematics learning failure in the education system as indicated by the results of European reports. Numerous studies agree that domain-specific predictors related to mathematics are symbolic and non-symbolic magnitude comparison, as well as, number line estimation. The goal of this study was to design 4 digital learning app games to train specific cognitive bases of mathematical learning in order to create resources and promote the use of (...) these technologies in the educational community and to promote effective scientific transfer and increase the research visibility. This study involved 193 preschoolers aged 57–79 months. A quasi-experimental design was carried out with 3 groups created after scores were obtained in a standardised mathematical competence assessment test, i.e., low-performance group, high-performance group, and control group. The results show that training with the 4 digital learning app games focusing on magnitude, subitizing, number facts, and estimation tasks improved the numerical skills of the experimental groups, compared to the control group. The implications of the study were, on the one hand, provided verified technological tools for teaching early mathematical competence. On the other hand, this study supports other studies on the importance of cognitive precursors in mathematics performance. (shrink)

The revolutionary outbreak in a variety of civilizations centered around 600 B.C.E., a period in which the great world religions as well as philosophy emerged, from Hebrew scriptures and the teachings of Buddha to the works of Greek and Chinese philosophers, has been named the Axial Age by Karl Jaspers. Yet 75 years earlier, in 1873, unknown to Jaspers and still unknown to the world, John Stuart Stuart-Glennie elaborated a fully developed and more nuanced theory of what he termed The (...) Moral Revolution to characterize the period. This book also brings to light the previously undiscussed ideas of D. H. Lawrence on the phenomenon from 20 years before Jaspers, the seldom mentioned contributions of Lewis Mumford, and proposes a new context for understanding the phenomenon. Halton rewrites the history of this fascinating theory and opens new ways of conceiving the meaning of The Moral Revolution for today. (shrink)

In this radical critique of contemporary social theory, Eugene Halton argues that both modernism and postmodernism are damaged philosophies whose acceptance of the myths of the mind/body dichotomy make them incapable of solving our social dilemmas. Claiming that human beings should be understood as far more than simply a form of knowledge, social construction, or contingent difference, Halton argues that contemporary thought has lost touch with the spontaneous passions—or enchantment—of life. The conditions of hunting and gathering through which one line of primates evolved into humans form the basis of what I term the wild self, a self marked by developmental needs of prolonged human neoteny and by deep attunement to the profusion of communicative signs of instinctive intelligence in which relatively “unmatured” hominids found themselves immersed. The passionate attunement to, and inquiry into, earth-drama, in tracking, hunting, foraging, rhythming, singing, and other arts/sciences, provided the trail to becoming human, and provide (...) external grammatical structures that became the basis of human language and animate mind. I outline my new philosophy of history as a progress in precision, counteracted by a regressive contraction of mind. The progress associated with history since the beginning of agriculturally-based civilizations can be considered as a regressive contraction from animate mind of our hunter-gatherer evolutionary past, to anthropocentric mind, and finally to the ghost in the machine world-view of mechanico-centric mind. Contemporary consumption culture represents an inversion of the original conditions of the human self, and indeed, targets aspects of developmental neoteny to condition conformity to its rational-mechanical system imperatives. The author criticizes ways in which academic disciplines can be viewed as skewed toward bureaucratized intellect and its requirements and rewards, rather than toward scholarly intellectual life and research. Drawing from the Chicago traditions of sociology and philosophical pragmatism, as well as his own experience of them, Halton goes on to appraise ways in which these traditions have tended to become contracted to limited textbook canons. Donald Levine’s Visions of the Sociological Tradition provides a case in which the broad (...) influences of European intellectual traditions, for example, Nietzsche, are included in his sociological history of European sociological traditions, whereas similar influences, such as Ralph Waldo Emerson, Thorstein Veblen, Jane Addams, Lewis Mumford, or even C. Wright Mills, are excluded from his account of the American and Chicago traditions. Admitting that academic disciplines represent skewed forms of bureaucratized intellect rather than progressive traditions allows one to admit those who are not members of the club into the dialogue of social thought and the social sciences. Drawing from Peircean semiotics, from the Greek conception of phronesis, and from considerations of bodily awareness as a basis of reasonableness, I attempt to show how the living gesture touches our deepest signifying nature, the self, and public life. Gestural bodily awareness, more than knowledge, connects us with the very conditions out of which the human body evolved into its present condition and remains a vital resource in the face of a devitalizing, rationalistic consumption culture.
