O artigo procura investigar as correlações entre os temas da liberdade e da alteridade, no conjunto do pensamento de J. Paul-Sartre.

O texto investiga dimensões da linguagem enquanto abertura a novos espectros de significação para além da lógica das proposições na obra de E. Levinas, sugerindo interfaces possíveis entre a ética da alteridade e a hermenêutica.

Current developments in biomedicine are presenting us with difficult ethical decisions and raising complex policy questions about how to regulate these new developments. Particularly vexing for governments have been issues related to human embryo experimentation. Because some of the most promising biomedical developments, such as stem cell research and nuclear somatic transfer, involve such experimentation, several international bodies have drafted documents aimed to provide guidance to governments when developing biomedical science policy. Here I focus on two such documents: the Council (...) of Europe's Convention for the Protection of Human Rights and Dignity of the Human Being and the Additional Protocol to the Convention for the Protection of Human Rights and Dignity of the Human Being.I argue that by using human dignity as a criterion to determine the permissibility of particular human embryo research practices, these documents cannot aid in identifying research that would be contrary to human dignity. Thus, they fail to guide public policy on embryo experimentation. Their use of human dignity as a criterion makes their task of offering guidance unfeasible because the concept as used in these documents is too vague and is applied in contradictory ways. I discuss the main goals of these documents and their claims in relation to human embryo research. I then discuss how they have influenced public policy in several countries. Finally, I show that although these Council of Europe treaties attempt to serve as public policy guides in the area of embryo research, they fail to do so. (shrink)

Developed through a series of conceptual analyses (Edmund Husserl, Vilém Flusser, Ludwig Wittgenstein and Walter Benjamin) and case studies (Fernando Lopes’s Belarmino and Jeff Wall’s Mimic), this article delves into the relationship between gesture, attunement and atmosphere and how it unfolds in photographic works dealing with urban space. The first section focuses on the role played by photography in the film Belarmino, which raises questions about both the representation of urban phenomena and issues related to expression and gesture in boxing. The second section discusses Husserl’s thinking on image consciousness and his surprising reference to a “photograph” of a boxer, which reveals the relevance of his phenomenological approach when it comes to defining the aesthetic properties of gesture-images. The third section examines the principles of Flusser’s philosophy of gestures, focusing on the semantic field of attunement and its connection with various elements related to photography, gesture, moods and affects. The question of gesture in photography—both the gestures of the photographed and those of the photographer—can be articulated with the notions of attunement and atmosphere, which go beyond semiological, psychological and communicational approaches and are important for our understanding of aesthetic and artistic experiences. Finally, if photography is a privileged way of studying atmospheres and gestures (as suggested by the Benjaminian notion of optical unconscious) and their connection with the inner life of the subject, in relation to urban space this study often acquires an intersubjective, social and political dimension, as in Jeff Wall’s Mimic. Bringing together a genealogy of authors, concepts, and aesthetic case studies, this article aims to contribute to the discussion on ordinary aesthetics by focusing on the tensions that are intrinsic to walking as a fundamental embodied action in everyday urban life. These tensions concern the movement of walking itself and its relation to one’s surroundings, but it also concerns a certain complementarity between home (familiarity) and wandering. Experiencing space and thresholds that disrupt one’s relationship with home and the everyday can (...) be understood as part of a modern “anti-home” tendency that lies at the core of several artistic and aesthetic practices. On the other hand, the study of walking and its relationship with the ordinary has also been enhanced and complexified by the mediation of images and technologies of reproduction. Approaching the paradoxes and ambiguities of everydayness from the perspective of walking allows us to better understand the ordinary as an in-between concept composed of evidence and mystery, familiarity and strangeness. Walking itself, as an ordinary element of life, is an unstable stabilisation, an unconsciousness that may become awareness, an immersive action that knows interruptions, a way of repeating paths that can also lead to detours and discoveries. ABSTRACT This article focuses on the role that the concept of “presence of mind” (Geistesgegenwart) plays in Walter Benjamin’s thought, deepening lines of interpretation that are connected to other relevant concepts such as “attention” (Aufmerksamkeit) and “now-time” (Jetztzeit). It examines elements of Benjamin’s work that develop the philosophical importance of presence of mind, emphasizing its corporeal dimension and its aesthetic and critical relevance. The analysis covers fve lines of interpretation that intersect in different ways: (i) presence of mind is a (...) form of thought/action that should be cultivated as a way of dealing with the experience of shock; (ii) having presence of mind is an attitude that can be exercised; (iii) “seizing the day” involves the body and presupposes an experience of intensive time; (iv) the conceptual framework of presence of mind integrates elements related to play; and (v) by valuing the present, presence of mind implies a relationship between danger and a critical gesture – in Benjamin’s historical and political reflection, this gesture intertwines the individual and the collective dimensions. The lack of public support for climate change policies and refusals to vaccinate children are just two alarming illustrations of the impacts of dissent about scientific claims. Dissent can lead to confusion, false beliefs, and widespread public doubt about highly justified scientific evidence. Even more dangerously, it has begun to corrode the very authority of scientific consensus and knowledge. Deployed aggressively and to political ends, some dissent can intimidate scientists, stymie research, and lead both the public and policymakers to oppose (...) important public policies firmly rooted in science. -/- To criticize dissent is, however, a fraught exercise. Skepticism and fearless debate are key to the scientific process, making it both vital and incredibly difficult to characterize and identify dissent that is problematic in its approach and consequences. Indeed, as de Melo-Martín and Intemann show, the criteria commonly proposed as means of identifying inappropriate dissent are flawed and the strategies generally recommended to tackle such dissent are not only ineffective but could even make the situation worse. -/- The Fight Against Doubt proposes that progress on this front can best be achieved by enhancing the trustworthiness of the scientific community and by being more realistic about the limits of science when it comes to policymaking. It shows that a richer understanding of the context in which science operates is needed to disarm problematic dissent and those who deploy it. This, the authors argue, is the best way forward, rather than diagnosing the many instances of wrong-headed dissent. (shrink)

O presente artigo tem como principal objetivo compreender de que modo as concepções de família, levantada por deputados religiosos, tem influenciado nos debates acerca das propostas de ação da Comissão de Direitos Humanos no Brasil. Para tal, parte da análise discursiva das falas proferidas pelo então presidente da Comissão de Direitos Humanos e Minorias, no período de março a julho de 2014, publicados pela mídia virtual. Os resultados demonstram que nos discursos proferidos pelo então presidente da Comissão são sustentados por (...) uma perspectiva heteronormativa que entende a família a partir de papéis pré-concebidos, hierarquizados, ignorando qualquer possibilidade de arranjo familiar que fuja desse padrão. Toma como base justificativas essencialistas, com teor conservador, e de cunho religioso, mesmo diante de um Estado que, em tese, deveria ser laico. Tal fato remonta a necessidade de se pensar mecanismos para desconstruir essas concepções e horizontalizar a multiplicidade de experiências de arranjos familiares, legitimando-as perante o Estado. Resumo: Analisando o papel desempenhado pela questão da técnica no pensamento de Walter Benjamin, o artigo debruça-se sobre a transformação dos valores estéticos, na modernidade. As técnicas de reprodução/registo inventadas nos séculos XIX e XX, como a fotografia e o cinema, obrigaram a uma revisão das articulações entre arte, técnica e história, articulações que Benjamin desenvolveu em diversos sentidos. Contudo, não encontramos, nos seus textos, uma filosofia da técnica de princípios claramente estabelecidos. Portanto, o presente artigo visa estabelecer uma constelação (...) de temas, os quais, brotando dos seus textos, nos permitem clarificar como a técnica influencia a transformação e a criação de valores estéticos, sendo estes entendidos como eixos em torno dos quais se dão a produção e a crítica dos fenómenos estéticos. A fotografia, constituindo um momento de viragem incisivamente estudado pelo autor, é o fio condutor das diferentes leituras. Historicidade da percepção; dimensão política da arte; sua relação com a memória; elemento de jogo: são estes os quatro eixos em torno dos quais se procura clarificar e, sempre que possível, prolongar a proposta benjaminiana.: Analyzing the role played by the question of technology in Walter Benjamin's thought, this article delves into the transformation of aesthetic values in modernity. The technologies of reproduction and recording invented during the 19th and 20th centuries, such as photography and cinema, led to a reformulation of the relationship between art, technology, and history, which Benjamin examined in various ways. However, we do not find in his texts a philosophy of technology with well-defined principles. Therefore, this article aims at establishing a constellation of themes emerging from his texts, that allows us to clarify the way technology promotes the transformation and creation of aesthetic values. These values are here understood as axes around which the production and the critique of aesthetic phenomena occur. Photography, as a turning point that was incisively studied by the author, is the leading thread in the different readings of his work. The historicity of perception; the political dimension of art; its relation with memory; the element of play: these are the four axes around which a clarification and, whenever possible, an expansion, of Benjamin's ideas are discussed. Nosso objetivo com este artigo é apresentar a interculturalidade crítica como ferramenta pedagógica que deve ser central na constituição dos cenários e contextos em Educação Infantil. Utilizamos referenciais teóricos de outros estudiosos da interculturalidade e da Educação Infantil, como Candau, Sarmento, Walsh, Tomazzeti, Santiago, Akkeri e Marques, entre outros. Situamos a Educação Infantil enquanto etapa fundamental na formação ética e intercultural das crianças, pensando a função social da educação como formação para a democracia. O trabalho pedagógico com as diferenças culturais (...) na Educação Infantil é amparado legalmente pelas Diretrizes Curriculares Nacionais para a Educação Infantil e por outras políticas de identidade, como a Lei 11.645 de 2008, que institui a obrigatoriedade do ensino de cultura e história indígena e afro-brasileira desde a Educação Infantil. No entanto, essas legislações também são confrontadas por interesses neoliberais que invadem as políticas educacionais. Diante disso, apresentamos algumas possibilidades e desafios para a construção de práticas interculturais nessa etapa da escolarização, incluindo algumas discussões sobre práticas cristalizadas, preconceitos e discriminações, formação de professores, o professor da infância enquanto pesquisador reflexivo, a monocultura do saber, os currículos e a diferença como vantagem pedagógica. Como conclusão, apontamos que um dos principais desafios da educação na atualidade é construir práticas e contextos que tratem as diferenças desde um viés político, visando a construção de uma sociedade mais democrática, considerando o direito à diferença. Construir práticas interculturais na Educação Infantil significa abrir mão da monocultura do saber, da homogeneização em favor da heterogeneidade, do epistemicídio pela construção de outras alternativas de pensamento. A growing number of jurisdictions hold that gamete donors must be identifiable to the children born with their eggs or sperm, on grounds that being able to know about one's genetic origins is a fundamental moral right. But the argument for that belief has not yet been adequately made.

In recent years, online “involuntary celibate” or “incel” communities have been linked to various deadly attacks targeting women. Why do these men react to romantic rejection with not just disappointment, but murderous rage? Feminists have claimed this is because incels desire women as objects or, alternatively, because they feel entitled to women’s attention. I argue that both of these explanatory models are insufficient. They fail to account for incels’ distinctive ambivalence toward women—for their oscillation between obsessive desire and violent hatred. (...) I propose instead that what incels want is a Beauvoirian “Other.” For Beauvoir, when men conceive of women as Others, they represent them as simultaneously human subjects and embodiments of the natural world. Women function then as sui generis entities through which men can experience themselves as praiseworthy heroes, regardless of the quality of their actions. I go on to give an illustrative analysis of Elliot Rodger’s autobiographical manifesto, “My Twisted World.” I show how this Beauvoirian model sheds light on Rodger’s racist and classist attitudes and gives us a better understanding of his ambivalence toward women. It therefore constitutes a powerful and overlooked theoretical alternative to accounts centered on objectification and entitlement. (shrink)

in this article, we experience the exercise of a screen ethnocartography in agency with the film Beasts of the southern wild by the director Benh Zeitlin. We tested a film experimentation that led to a renewed writing ways of life. We bet on cinema and childhood as possibilities for creating cracks and a stutter of language for the creation of new worlds and ways of living. In cinema images less as a representation, and more as art that proposes incompleteness, fissure, (...) a hole in appearances. In childhood as an exercise of differentiation and resistance to dominant narratives in a given context. In childhood as a limiting experience of/in language, tirelessly exposing the human condition in front of the world. Thus, accompanying the main character of the plot, little Hushpuppy — a six-year-old resident of the “Charles Doucet Island”, experienced as “the Bathtub” —, we are shaken by the forms of life there, considered bestial and not recognized by city humans. Hushpuppy, his father and friends resist attempts to destroy their existence by the forms of the state that try to domesticate them, imbued with the logic that primitives must come to civilization, just as children must become adults. A new reprogenetic technology, mitochondrial replacement, is making its appearance and, unsurprisingly given its promise to wash off our earthly stains --or at least the scourges of sexual reproduction--, John Harris finds only reasons to celebrate this new scientific feat.1 In fact, he finds mitochondrial replacement techniques (MRTs) so “unreservedly welcome” that he believes those who reject them suffer from “a large degree of desperation and not a little callousness.”2 Believing myself to be neither desperate nor callous, but finding myself (...) also no closer at all – not even after reading his article—to following Harris in welcoming these technologies wholeheartedly, it seems appropriate to respond. Reprogenetic technologies, which combine the power of reproductive techniques with the tools of genetic science and technology, promise prospective parents a remarkable degree of control to pick and choose the likely characteristics of their offspring. Not only can they select embryos with or without particular genetically-related diseases and disabilities but also choose embryos with non-disease related traits such as sex. -/- Prominent authors such as Agar, Buchanan, DeGrazia, Green, Harris, Robertson, Savulescu, and Silver have flocked to the banner of reprogenetics. (...) For them, increased reproductive choice and reduced suffering through the elimination of genetic disease and disability are just the first step. They advocate use of these technologies to create beings who enjoy longer and healthier lives, possess greater intellectual capacities, and are capable of more refined emotional experiences. Indeed, Harris and Savulescu in particular take reprogenetic technologies to be so valuable to human beings that they have insisted that their use is not only morally permissible but morally required. -/- Rethinking Reprogenetics challenges this mainstream view with a contextualised, gender-attentive philosophical perspective. De Melo-Martín demonstrates that you do not have to be a Luddite, social conservative, or religious zealot to resist the siren song of reprogenetics. Pointing out the flawed nature of the arguments put forward by the technologies' proponents, Rethinking Reprogenetics reveals the problematic nature of the assumptions underpinning current evaluations of these technologies and offers a framework for a more critical and skeptical assessment. I argue here that critics of biological explanations of human nature are mistaken when they maintain that the truth of genetic determinism implies the end of critical evaluation and reform of our social institutions. Such a claim erroneously presupposes that our social values, practices, and institutions have nothing to do with what makes biological explanations troublesome. What constitutes a problem for those who are concerned with social justice is not the fact that particular behaviors might be genetically determined, but the (...) fact that our value system and social institutions create the conditions that make such behaviors problematic. Peut-on attribuer une finalité aux réalités les plus fondamentales et matérielles de la nature selon la téléologie aristotélicienne? La réponse est apparemment affirmative d’après le livre IV, 12 des Météorologiques d’Aristote. Ayant entamé une recherche sur les corps homéomères du point de vue de la forme – manifestée par leurs finalités en tant que ἔργoν –, ce texte affirme que les artefacts, les organismes et leurs parties anhoméomères tout comme les homéomères, et même les éléments, bref « tout est déterminé (...) par son ἔργoν ». Pourquoi Aristote emploie-t-il le terme ἔργoν, et quel est son sens dans le contexte de la téléologie naturelle? Dans cette étude, nous proposons de laisser de côté le sens véhiculé par la traduction courante « fonction », à savoir le rôle joué par une réalité, ou une partie, pour le bien d’un tiers ou pour une totalité, pour la raison évidente que la causalité de la fin chez Aristote est sans conteste immanente, à savoir la réalisation de la forme de la réalité naturelle elle-même. Ainsi, le sens proposé de la fin-ἔργoν sera non pas externe, mais plutôt celui de mise en usage de la réalité en processus elle-même, fondée sur la dualité téléologique τὸ oὗ et τὸ ᾧ, où la fin oὗ est comprise comme étant la constitution d’une réalité, tandis que la fin ᾧ n’a plus le sens de bénéficiaire externe, mais renvoie à l’aspect dynamique de la forme, c’est-à-dire comme étant le dernier accomplissement de l’essence de la réalité une fois constituée. Within the context of the contemporary heterogeneity of photographic practices, the present text describes some of the possibilities of understanding the temporality of photographs, giving an account of some important theoretical references. Bearing this in mind, describing photographs as sparks of reality is a way of expanding the Benjaminian proposal and avoiding the strict logics of causality. The strength of photography unfolds the technologically rooted paradox of photographs, whose contemporary relevance can be analysed in the intersection between aesthetics, history and (...) politics. The film 48, by the Portuguese filmmaker Susana Sousa Dias, explores this intersection by using and showing the cracks of the political prisoners’ mug shots. (shrink)

O presente artigo coloca em evidência uma proposta sobre educação e os respectivos pressupostos para que ela aconteça no sujeito, tendo como referência a pedagogia da hospitalidade com base na filosofia da alteridade em Levinas. Nesse caso, a educação não é vista a partir do movimento do Eu em direção do Outro, mas sim, o contrário. Precisamente o Outro assume o protagonismo pedagógico já que o Eu se abre à possibilidade de acolhida do Outro sem nenhum critério preestabelecido, de forma (...) assimétrica. A partir disso, o texto apresenta a possibilidade de uma hospitalidade a partir da alteridade, tendo o Outro como base de uma relação ética em que o Eu é convidado a participar do convívio do Outro. Essa pedagogia rompe as barreiras de uma educação centrada tão-somente na capacidade do eu egoísta, mas se abre ao infinito das possibilidades da relação onde o Outro se revela com sua história, cultura, e o Eu se adequa às necessidades daquilo que se apresenta como diferente. O rosto do Outro revela ao sujeito o infinito e o valor dele como superação do próprio preconceito por meio da pedagogia da hospitalidade. (shrink)

O reconhecimento é uma das principais categorias da Teoria Crítica contemporânea. Nos movimentos sociais atuais, a centralidade da redistribuição material, nos moldes do socialismo, foi trocada pela luta por reconhecimento. Com tal mudança de foco, a cultura e a economia política foram colocadas em polos dissociados. Nancy Fraser, diante desse cenário, propõe conciliar as políticas de reconhecimento e redistribuição em uma ampla teoria de justiça. No entanto, a articulação de ambas se torna complexa diante de suas vinculações no âmbito da (...) filosofia moral. De um lado, a redistribuição está alinhada à moralidade kantiana, enquanto o reconhecimento parece pertencer ao âmbito da ética hegeliana. Nesse horizonte, o presente trabalho tenciona discutir a proposta de Fraser na questão do reconhecimento enquanto reivindicação de justiça, apresentando o percurso teórico adotado pela autora nesta defesa. Quando se fala em património cultural, uma área que costuma ficar na penumbra é a dos arquivos históricos. De entre estes, um dos conjuntos mais vulneráveis é o dos arquivos de editoras e outros agentes da edição. Este artigo propõe uma reflexão em torno do património arquivístico em geral e dos arquivos das editoras em particular, a nível internacional. Tal digressão analítica e problematizante serve, em boa medida, para ajudar a repensar o caso português, cujos atrasos e impasses urge solucionar, (...) sob pena de se perderem irremediavelmente fontes preciosas para o conhecimento da nossa contemporaneidade. Em complemento, e a partir de um encontro específico organizado pelo autor, segue-se um conjunto de reflexões de distintos agentes do meio cultural, da autoria de José Pacheco Pereira, João Corregedor da Fonseca e José Antunes Ribeiro. A pergunta fundamental na filosofia do humor é: o que nos faz rir? Neste artigo, defenderemos a chamada teoria da incongruência, segundo a qual o riso é provocado pela apresentação de aspectos inconsistentes em um proferimento. Para isso, analisaremos como a pragmática da linguagem fornece maneiras de apresentar incongruências em piadas escritas e faladas e, consequentemente, de provocar a diversão cômica em uma audiência. Nosso foco será em implicaturas conversacionais, atos de fala e pressuposições, e como eles são usados em (...) piadas. Esta não é uma análise exaustiva de todas as formas como incongruências são geradas em proferimentos cômicos; claro, há outros modos de apresentar desarmonias, tais como por meio aspectos semânticos. Por fim, discutiremos se piadas deveriam ser consideradas um tipo distinto de ato de fala, ao invés de só um uso parasitário da linguagem. (shrink)

It is argued here that bioethicists might inadvertently be promoting genetic determinism: the idea that genes alone determine human traits and behaviours. Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. According to sparse modalism, the notion of essence can be analysed in terms of necessity and naturalness. In this paper, I develop and defend a version of sparse modalism that is equipped with a non-standard, relativized conception of naturalness. According to this conception, properties and relations can be natural to different degrees relative to different kinds of things, and relations can be natural to different degrees relative to different slots. I argue that this relativized version of sparse modalism can accommodate (...) various cases that the standard, non-relativized version can’t. The alternative version can accommodate cases where a relation is essential to a relatum but merely necessary to another, cases where a property is essential to an object but merely necessary to another, and cases where a less-than-perfectly natural property is essential to an object. It is argued here that bioethicists might inadvertently be promoting genetic determinism: the idea that genes alone determine human traits and behaviours. Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. The idea that women qua women can be dehumanized has been dismissed by feminist philosophers, like Kate Manne, and by philosophers of dehumanization, like David Livingstone Smith. Against these skeptics, I argue that we can and should use dehumanization to explain an important strand of misogyny. When they are dehumanized, women are represented simultaneously as human and as inhuman embodiments of the natural world. They therefore appear as magical, contaminating, sexualized threats towards whom violence is acceptable or even necessary. Misogynistic (...) dehumanization is important to understanding atrocities like the early modern European witch-hunts, but also contemporary phenomena like incel violence. (shrink)

One of the key insights of Simone de Beauvoir’s The Second Sex is the idea that gender-based subordination is not just something done to women, but also something women do to themselves. This raises a question about ethical responsibility: if women are complicit, or actively implicated in their own oppression, are they at fault? Recent Beauvoir scholarship remains divided on this point. Here, I argue that Beauvoir did, in fact, ethically criticize many women for their complicity, as a sign of (...) what she called “bad faith”. I challenge recent accounts by Nancy Bauer and Manon Garcia, who both read Beauvoir as exonerating complicit women. According to this reading, women emerge as human “freedoms” within a social world where a “destiny” of inferiority is already prepared for them. Their self-subordination is then an inevitable product of acting in a patriarchal world. I argue, however, that this interpretation generates a crucial tension, leading Bauer and Garcia to call on women to stop being complicit, while also claiming they cannot avoid complicity. I propose instead a different interpretation, on which feminine complicity is often fueled by criticizable ethical attitudes that are far from inevitable. By revisiting Beauvoir’s notion of “bad faith”, I show that this account is compatible with recognizing the limitations imposed on women’s agency and I show that this feminist ethical criticism is itself an important part of a collective project of social transformation. O presente artigo tem como objetivo articular um diálogo entre as propostas de Charles Taylor e Nancy Fraser acerca das políticas de reconhecimento e identidade. Nesta tarefa, apresentamos a ligação fundamental que Charles Taylor estabelece entre identidade e reconhecimento, a partir de uma dimensão dialógica que privilegia o contato significativo com os outros. Posteriormente, discutimos a concepção de um modelo de status como alternativa ao modelo de identidade na proposta de Nancy Fraser, que compreende o reconhecimento como uma questão de (...) justiça desvinculada de avaliações éticas. Por fim, são contrastadas as concepções de reconhecimento de ambos os pensadores em relação à centralidade da identidade e autorrealização nas políticas de reconhecimento, destacando como as críticas de Fraser a Taylor desconsideram a dimensão intersubjetiva da concepção de identidade do filósofo canadense. The article, as part of a broader reflection on the criticism of the right to development and its impact on the modes of legal and political subjectivation of children and adolescents, questions the child's condition as a subject without speech, or a speech conditioned to criteria of maturation, dictated by the adult referential, in a field, moreover, limited to what is said to be pertinent to their manifestation. Guided by the thought of exteriority, we return to the Foucauldian debate on (...) the relation between truth and justice, in light of the monstrous unspeakability of legal and judicial practices and the ubuesco of state power. We will analyze, through the contributions of classic cynicism, supported by Foucault, and Sloterdijk, Nieheus-Pröbsting, the resistant practices - beyond language – available to children and adolescents, and rethink these power struggles in the context of human rights and the possibility of justice, through the thought of Derrida, Rancière, Butler and Foucault. Our text will develop along the following axes of analysis: 1. Contextualizing the Foucaultian debate on truth and justice and the place of the “sayable”; 2. Considering the sayability at the heart of law, childhood and monstrosity; 3. Framing the struggle between ubuesco power and cynic resistance, and 4. Speculating on our notions of “child” and the possibility of justice. (shrink)
