Accurate identification of legal provisions is crucial for adjudicating criminal cases, but the complexity and volume of legal texts pose significant challenges for legal professionals. This paper addresses these challenges by introducing a novel legal provision selection framework that transforms the task from a simple classification problem into a sophisticated system combining semantic matching with causal relationship learning. Leveraging large language models, our approach enhances the understanding and interpretation of legal language, by extracting nuanced features from legal texts for deeper (...) contextual comprehension. Additionally, integrating causal learning aligns with the inherent causality in legal reasoning, improving model interpretability and mitigating data bias. Our method demonstrates superior accuracy and robustness through extensive experiments on the CAIL2018 dataset and its subsets. How might attention intersect with normative issues and the psychology surrounding them? I provide an empirically grounded framework integrating three attentional phenomena: salience, vigilance (or broadly attunement) and attentional character. Using this frame, I review recent philosophical work on attention and norms. -/- Section 1 establishes a common ground conception of attention no more controversial than the established experimental paradigms for attention. This conception explicates the concept of a bias, which explains core features of action and attention, one that intersects (...) biological, psychological and philosophical concerns. I emphasize historical biases associated with learning and experience. Section 2 presents an analysis of automaticity and control, concepts needed to fully characterize action. Historical biases are revealed as automatic. Specifically, the automatization of attention is central to acquiring skills and excellence in light of normative standards for a practice. Section 3 argues that salience involves the deployment of attention, while Section 4 characterizes vigilance not merely as a disposition but as an active orientation to attend. Vigilance is one type of attunement, and the set of attunements constitutes the agent’s varied orientations to deploy attention, part of their attentional character. As discussed in Section 5, shaping this character is a goal of a normatively sensitive upbringing where appropriate attention is automatized through proper practice. Section 6 examines a common epistemic bias in academia and subsequent attempts to debias. I conclude with an example of acquired epistemic skill to give hope that attentional excellence is achievable. (shrink)

Most recently, two distinctions—echoing the cross-disciplinary critique of the teleological and “quantitative” approach of human arts and sciences at the expanse of the “qualitative”—have been foregrounded by Amzallag (Philosophy and Technology 34, 785–809, 2021) and Crease (2011), respectively, between the modern understanding of “technology” (as technopraxis) and the “forgotten dimension/phase of technology” (called technopoiesis) and between the ontic and ontological measurement. Pace gently the denotation of technopoiesis as a juvenile phase of technological development and the “ontological measurements” as logical and (...) practical impossibility in the modern, mathematized metroscape, the paper reexamines the relevancy of the distinctions (ontic/ontological and po[i]etic/practical, both recalling Heidegger’s “hermeneutical” critique of Husserl’s phenomenology) in non-Platonic/Aristotelian contexts and, in the process, seeks to refine the vital notion of technopoiesis by looking at the intersection of these fuzzy domains. In particular, the ancient Chinese measurements and their understudied onto-poietic dimension in the shifting econ-political contexts may offer an alternative approach to the otherwise elusive presence of technopoiesis and its ontological roots. Arguing that the techno-onto-poiesis does not necessarily belong to the foregone Arcadian past, the paper proposes refined “signals” for recognizing the technopoietic as well as new “forms” of its presence—“interactive emergence” (the cross-stimulating agonistic interactions between techniques of different “stages”) and “poietic clusters” (poietic ideas and/or implements that survive as “cluster” into the future), calling for future investigation of technical inventiveness (even in modern times) that reveal the process of how technopoietic elements enter the lives of technology through least expected embodiment. In this commentary, I take up Kammerer and Frankish's (this issue) project of exploring the space of possible and actual introspection. Focusing on human introspection where we lack concrete psychological models, I identify three types of introspection: (1) simple introspection of perceptual experience, (2) introspection of mental action, and (3) complex introspection of phenomenology. Drawing on psychological capacities which we empirically understand, I show how each type relies on various forms of attention to guide introspective response and raise questions about (...) introspective reliability drawing on the proposed architecture. I conclude with some preliminary remarks on how to map these three forms within Kammerer and Frankish's conceptual space and the requisite dimensions needed to do so. (shrink)

Diversity of practice is widely recognized as crucial to scientific progress. If all scientists perform the same tests in their research, they might miss important insights that other tests would yield. If all scientists adhere to the same theories, they might fail to explore other options which, in turn, might be superior. But the mechanisms that lead to this sort of diversity can also generate epistemic harms when scientific communities fail to reach swift consensus on successful theories. In this paper, (...) we draw on extant literature using network models to investigate diversity in science. We evaluate different mechanisms from the modeling literature that can promote transient diversity of practice, keeping in mind ethical and practical constraints posed by real epistemic communities. Workplace incivility is under investigation for the last three decades, and it holds a central position in organizational behavior literature. However, despite the extensive investigations in the past, there exists a missing link between workplace incivility and knowledge hiding in academia. This study aims to tap this missing link for which data were collected from the universities staff. Data were collected in two waves to reduce the common method biases. In the first wave, questions were asked from the respondents regarding (...) their demographic characteristics and exposure to workplace incivility. At this stage, 400 questionnaires were floated and 355 completely filled responses were received back, while in the second wave, those respondents were approached for data collection who have completely filled questionnaires in the first wave. The time interval between the two waves was 1 month. In the second wave, questions related to distrust and knowledge hiding behavior were asked from the respondents. At this stage, 323 questionnaires were received back out of which 290 were filled and these were considered for final data analysis. Collected data were analyzed by applying structural equation modeling through SmartPLS. Results indicated that employees tend to hide knowledge when they experience incivility at workplace. Moreover, they develop a sense of distrust in response to workplace incivility which further triggers them to hide knowledge. Limitations and future directions are also discussed. (shrink)

Descartes’ often misread _Meditationes_—as a metaphor of an unlikely shape or structure for inducing the presence of the absent (e.g., memories of personal lives or ancient technology), the paper responds to Hoły-Łuczaj (Philosophy & Technology 36:19, 2023 )’s favorable and subtle touches in the Commentary on the recent study of ancient Eastern measurement and measuring thinking (Philosophy & Technology 36:22, 2023 ; Philosophy & Technology 34(4):785–809, 2021 ) by relating to the childhood experience of living with measuring tools and measuring/measured person(s) (_homō _-_mētiēns_/-_mēnsus_; to be distinguished from the Pythagorean formula of _homo_-_mensura _or man _as _the measure [of everything]). The principal–principal perspective suggests that controlling shareholders have excessive influence on corporate philanthropy and may direct corporate funds to charitable causes to support their personal interests. Analysis of a sample of Chinese private firms listed on the Shenzhen or Shanghai stock exchange between 2004 and 2011 shows that there is a significant and negative relationship between corporate giving and the share held by the largest shareholders, suggesting that controlling shareholders are opportunistic in directing corporate charitable contributions; there is a significant (...) and positive relationship between corporate giving and the political connections of the largest shareholders and their agents, suggesting compatibility between corporate contributions and the personal interests of the controlling shareholders; there is a stronger negative relationship between corporate giving and the share of the company held by the largest shareholders in politically connected firms, suggesting that political connections contribute to increased opportunistic corporate giving. Overall, our study provides important evidence for the “one dominant controlling shareholder” phenomenon by testing and extending the principal–principal framework and showing that the largest shareholders of Chinese firms appear to donate to charitable causes that ultimately serve their personal interests at the expense of minority shareholders. Collaboration requires agents to coordinate their behavior on the fly, sometimes cooperating to solve a single task together and other times dividing it up into sub‐tasks to work on in parallel. Underlying the human ability to collaborate is theory‐of‐mind (ToM), the ability to infer the hidden mental states that drive others to act. Here, we develop Bayesian Delegation, a decentralized multi‐agent learning mechanism with these abilities. Bayesian Delegation enables agents to rapidly infer the hidden intentions of others by inverse planning. (...) We test Bayesian Delegation in a suite of multi‐agent Markov decision processes inspired by cooking problems. On these tasks, agents with Bayesian Delegation coordinate both their high‐level plans (e.g., what sub‐task they should work on) and their low‐level actions (e.g., avoiding getting in each other's way). When matched with partners that act using the same algorithm, Bayesian Delegation outperforms alternatives. Bayesian Delegation is also a capable ad hoc collaborator and successfully coordinates with other agent types even in the absence of prior experience. Finally, in a behavioral experiment, we show that Bayesian Delegation makes inferences similar to human observers about the intent of others. Together, these results argue for the centrality of ToM for successful decentralized multi‐agent collaboration. (shrink)

The relationship between bilingual language control and domain-general cognitive control has been a hot topic in the research field of bilingualism. Previous studies mostly examined the correlation between performances of bilinguals in language control tasks and that in domain-general cognitive control tasks and came to the conclusions that they overlap, partially overlap, or are qualitatively different. These contradictory conclusions are possibly due to the neglect of the moderating effect of second language proficiency, that is, the relationship between bilingual language control (...) and domain-general cognitive control might vary with the L2 proficiency of bilinguals. To examine this hypothesis, we recruited 36 unbalanced Chinese-English bilinguals to perform the Simon task, Oxford Placement Test, and picture naming tasks in single-and dual-language contexts. We find that Simon scores positively predicted switching costs in bilinguals with low L2 proficiency, but not in bilinguals with high L2 proficiency. Furthermore, Simon scores positively predicted mixing costs in bilinguals with high L2 proficiency, but not in bilinguals with low L2 proficiency. These results verify the moderating effect of L2 proficiency on the relationship between bilingual language control and domain-general cognitive control, that is, bilinguals with more proficient L2 rely on domain-general cognitive control less for local language control and more for global language control. This may imply a shift from local to global for the dependency of bilingual language control on domain-general cognitive control during the L2 development of bilinguals. (shrink)

In response to numerous recent cases involving materially misstated financial information arising from fraudulent financial reporting, companies, auditors, and academics have increased their focus on strengthening internal controls as a means of deterring such unethical behaviors. However, prior research suggests that stronger controls may actually exacerbate the very opportunistic behavior the controls are intended to curb. The current study investigates whether the efficacy of an implemented control is conditioned on not only the strength of the control, but also on how (...) the firm frames the purpose for implementing the control. A monitoring purpose frames controls as reducing managers’ opportunities to engage in self-interested behavior, while a coordinating purpose frames controls as facilitating coordination between the firm and its managers. We posit that the efficacy of stronger controls to reduce unethical fraudulent reporting depends on the control frame. Using an experiment, this study investigates the interactive effect of control strength and control frame on managers’ fraudulent reporting decisions. As predicted, our results show that when controls are framed for monitoring purposes, stronger controls result in less fraudulent reporting than weaker controls. Conversely, when controls are framed for coordinating purposes, stronger controls result in more fraudulent reporting than weaker controls. Our results suggest that an inconsistency between the firm’s choice of the control strength and the control frame reduces the efficacy of the implemented control to curb unethical reporting behaviors. Furthermore, supplemental analysis shows that managers’ rationalization helps explain the interactive effect of control strength and communicated control purpose on fraudulent reporting. (shrink)

The positive or negative impacts corporate social responsibility (CSR) may have on business performance have drawn research interest. In recent years, the focus of research has shifted toward the link between CSR and corporate competitive advantage. Corporate competitive advantage is a multifaceted and holistic concept that captures more than just corporate financial performance. Building on the resource-based view (RBV), corporate competitive advantage construct theory, and CSR behavior theory, we explore how a firm's CSR engagement shapes its corporate competitive advantage. Our (...) analysis of a panel dataset of 64 companies with a top-100 CSR development index in China and 704 firm-year observations over the sample period from 2009 to 2019 reveals an inverse U-shaped relationship between CSR and corporate competitive advantage. This signifies that corporate competitive advantage first increases with CSR engagement but declines as it reaches a threshold level where CSR activities are beyond the affordability of the firm. We also examine how behaviors at various CSR engagement levels influence different dimensions of corporate competitive advantage. These results support a curvilinear relationship, explaining why many CSR strategies have been ineffective in the past. The findings may help guide corporate decisions and government policymaking on CSR. (shrink)

A longstanding orthodoxy holds that the Mohists regard the promotion of li (benefit, 利) as their ultimate normative criterion, meaning that they measure what is yi (just, 義) or buyi (unjust, 不義) depending on whether it maximizes li or not. This orthodoxy dates back at least to Joseph Edkins (1859), who saw Mozi as a utilitarian and an ally of Bentham. In this paper, we will argue that this orthodoxy should be reconsidered because it does not square with several passages (...) from the Mozi. That the Mohists place a strong weight on the promotion of ‘li for the whole world (tianxia zhi li, 天下之利)’ is uncontroversial. We argue, however, that in certain cases the Mohist moral calculus diverges in its rationale or outcome from li-promotionalism. This position rejects the orthodoxy by showing that Mohism and li-promotionalism are not entirely coterminous. (shrink)

Corporate governance is increasingly becoming an issue of global concern, not least because we are more and more living in a corporate world that transcends international boundaries. The main purpose and motivation of this study is to determine how the international community should motivate businesses in fostering exemplary corporate governance, therefore eliminating obstacles to ethically exemplary behavior. The empirical approach utilized here has been applied to 161 businesses, both listed and over-the-counter (OTC) companies, with the results indicating that ethical considerations, (...) corporate governance and organizational performance are inextricably linked and, to an extent, demonstrably proportional. This study also indicates a major finding that family management is a significant mediating variable of the ethical considerations of corporate governance and organizational performance. Finally, this study has developed an operational model of ethical considerations of corporate governance as a consultancy aid for businesses that wish to implement and/or boost their performance in respect to corporate governance. In this paper we investigate whether independent directors’ attendance at board meetings enhances investor protection using a difference-in-difference approach. We find that independent directors’ attendance alleviates tunneling. This effect is more pronounced in non-state-owned enterprises than in state-owned enterprises. The reinforcement of external supervision substitutes for the role of independent directors’ attendance and this substitution effect is more significant in non-SOEs. Together, these results imply that independent directors’ attendance at board meetings can play an important role in protecting investors, especially (...) in non-SOEs and when external supervision is weak. This paper sheds new light on independent directors’ function in corporate governance, and has implications for institutional improvements. (shrink)

The article discusses the features of interaction and mutual influence of the art of woodcut of China and the USSR. Chinese woodcut and Soviet engraving reveal the greatest mutual influence and rich genre palette in the middle of the XX century. Chinese woodcut gave a creative impulse, enriched the visual possibilities, brought new ideas to the Soviet art of woodcut. It served as an impetus for the rise of graphics, which realized and asserted its specificity. In this regard, it seems (...) relevant to identify common features of Chinese woodcut and Soviet engraving of the mid-20th century, as well as to identify differences in the development of this art form in the two countries. The article analyzes the works of famous woodcuts of two countries: Chen Yanqiao, Yang Han, Qi Baishi, V. A. Favorsky, A. A. Ushin. As a result of the analysis, the common features of Chinese woodcut and Soviet engraving of the mid-20th century were revealed, for example, similar plots and themes, as well as a special dynamic, lively and pulsating rhythm of the works. In addition, differences in the development of this type of art in both countries have been established, largely due to the preservation of their own national style by graphic artists. It is claimed that Soviet graphics contributed to the variety of Chinese woodcuts. In turn, Soviet artists adopted the subtleties of filigree technique from Chinese woodcuts. (shrink)

In the process of China’s rapid development, the society has higher and higher requirements for educational reform. Different from other basic disciplines, design emphasizes practicality, which requires that in the process of design education reform, more attention should be paid to the stimulation of students’ subjective initiative and the improvement of students’ ability to solve problems in the face of setbacks. This paper methodically expounds on a more scientific manner of curriculum reform fit for China’s educational system, based on positive (...) psychology and consideration of grit. It performs research and analysis on the design education curriculum reform on the basis of positive psychology through field research, logical analysis, and other research methodologies. Designing education curriculum reform based on positive psychology orientation is more feasible than standard education curriculum reform and the role of grit in taking part in the educational curriculum reform oriented to positive psychology is considerably higher than that in the conventional educational curriculum reform, according to experimental study. One of the indicators that symbolize the success of an academic field is its academic publications in well-established citation indices. This article first explored the bibliometric characteristics of publications on “teachers' emotional labor” in the Social Sciences Citation Index and the Arts & Humanities Citation Index, two prestigious citation indices available in the Web of Science. Search with the term “teacher emotional labor” retrieved 173 publications that included this term in their titles, abstracts, or keywords in the WoS database between (...) 1900 and 2020. The bibliometric characteristics pertaining to numbers of publications, document types, research categories, research areas, authors, journals, universities, and countries were reported. Then, CiteSpace was utilized to visualize TEL research and to obtain insights into its research focuses and its future directions. The findings will contribute to TEL research by informing scholars in the fields of L2 research and psychology and others. (shrink)

The relevance of the presented research is due to the importance of familiarizing modern children with the culture of reading, in the context of which illustrations for children's books play an especially important role. Book illustrations attract the attention of a child and create the necessary focus in the perception of the information presented in books. The purpose of this article is to analyze the creativity of illustrators of children's literature and to study the modern trends in the art of (...) children's book illustration. During the study, the methods of theoretical and comparative analysis were used; in addition, special attention was paid to the study of the basic concepts of creating a children's book and the analysis of available research publications. The main trends in the development of the art of illustration of children's books were determined. The main vectors of illustration development were also defined. The applied value of this research work lies in identifying the main directions of the development of the art of children's book illustrations with the aim of the subsequent introduction of progressive methods for creating such illustrations that meet the requirements of the present day. In general, this study contributes to the formation of a coherent picture of the perception of the main trends in the work of modern illustrators and the formation of the art of book illustration. Food safety problems in China, such as deadly tainted milk, have attracted growing attention from a corporate social responsibility perspective. To examine the forces that potentially drive CSR behavior within the Chinese food industry, our study is organized as follows. First, a review is conducted on the unique history of CSR in China as well as some of the major Chinese food scandals that have taken place. The primary drivers of CSR in China that have been suggested in the literature (...) are then summarized. Next, new institutional theory perspectives are drawn upon to analyze three forces that potentially affect the behavior of Chinese firms: coercive isomorphism, mimetic processes, and normative pressures. Based on a questionnaire survey of 164 Chinese managers and employees, the CSR behavior of firms operating in the Chinese food industry is found to only be significantly affected by the institutional factor of normative pressures. Although accumulating evidence suggests the COVID-19 pandemic is associated with costs in mental health, the development of students' mental health, including the change from their previous levels of depression and anxiety and the factors associated with this change, has not been well-studied. The present study investigates changes in students' anxiety and depression from before the pandemic to during the lockdown and identifies factors that are associated with these changes. 14,769 university students participated in a longitudinal study with two time points (...) with a 6-month interval. Students completed the Anxiety and Depression subscales of the Symptom Checklist 90 before the COVID-19 outbreak, and the Self-rating Anxiety Scale and Self-rating Depression Scale during the pandemic. The prevalence of anxiety and depression symptoms were 1.44 and 1.46% at Time 1, and 4.06 and 22.09% at Time 2, respectively, showing a 181.94% increase in anxiety and a 1413.01% increase in depression. Furthermore, the increases in anxiety and depression from pre-pandemic levels were associated with students' gender and the severity of the pandemic in the province where they resided. This study contributes to the gap in knowledge regarding changes in students' mental health in response to the pandemic and the role of local factors in these changes. Implications for gender and the Typhoon Eye effect are discussed. (shrink)

Drawing on the social exchange theory, this study adopted a cross-level framework to investigate the influence of consumer group communication on consumer product image perception and brand memory. In addition, this paper examined the moderating role of consumer group involvement in the cross-level relationship between consumer group communication and consumer product image perception. Based on a sample of 116 groups and 530 consumers, results revealed that consumer group communication has a significant positive influence on brand memory formation across levels. Consumer (...) product image perception plays a cross-layer mediated role between consumer group communication and brand memory. Group involvement plays a cross-level negative moderating role between consumer group communication and consumer product image perception, and moderates the mediating role of consumer product image perception between consumer group communication and consumer brand memory across different levels. In China, the increasing traffic pressure has created traffic policing problems such as the heavy workloads of traffic police, as well as more conflicts between traffic police and road users. The treatment of traffic policing as a semiotic practice provides both a new perspective in and a helpful approach to dealing with these problems, yet few studies have investigated how semiotic resources are used in traffic policing interactions. This article examines the supportive role of semiotic resources in traffic policing, and (...) draws upon genre and exchanges involved as an illustration. The data include three audio recordings of traffic accident handling cases in Shanghai, China. Through qualitative analysis of the data from the perspective of Systemic Functional Linguistics, this article identifies the genre stages in traffic accident handling and their logico-semantic relations, and situates the typical exchanges and moves used by traffic police in different stages. It also discusses the usefulness of semiotic resources for traffic policing and the implications of these resources in tackling the existing problems of traffic policing in China. (shrink)

Its psychometric properties were examined in terms of factor structure, convergent validity, discriminant validity, internal consistency, and test–retest reliability.ResultsDifferently from the seven-domain original QOLLTI-F, its Chinese version had only three domains including caregiver’s self-feelings, caregiver’s stress, and caregiver’s outlooks. The total variance explanation rate for the domains was 55.4%. The Chinese version fitted well with the structure model ; its comparative fit index was 0.971; Tucker–Lewis index was 0.954; and the root mean square error of approximation was 0.072. The success rate of its convergent and discriminant validity calibration test was 100%. Its Cronbach’s alpha coefficient of the whole questionnaire and three domains was from 0.650 to 0.874, and test–retest reliability was 0.836.ConclusionThe 3-domain QOLLTI-F-CV is a valid and reliable instrument for identifying QOL concerns of FCs of advanced cancer patients in China. The refactoring structure optimally matches Chinese culture and value system well. (shrink)

Background The Patient Right to Autonomy Act (PRAA), implemented in Taiwan in 2019, enables the creation of advance decisions (AD) through advance care planning (ACP). This legal framework allows for the withholding and withdrawal of life-sustaining treatment (LST) or artificial nutrition and hydration (ANH) in situations like irreversible coma, vegetative state, severe dementia, or unbearable pain. This study aims to investigate preferences for LST or ANH across various clinical conditions, variations in participant preferences, and factors influencing these preferences among urban (...) residents. Methods Employing a survey of legally structured AD documents and convenience sampling for data collection, individuals were enlisted from Taipei City Hospital, serving as the primary trial and demonstration facility for ACP in Taiwan since the commencement of the PRAA in its inaugural year. The study examined ADs and ACP consultation records, documenting gender, age, welfare entitlement, disease conditions, family caregiving experience, location of ACP consultation, participation of second-degree relatives, and the intention to participate in ACP. Results Data from 2337 participants were extracted from electronic records. There was high consistency in the willingness to refuse LST and ANH, with significant differences noted between terminal diseases and extremely severe dementia. Additionally, ANH was widely accepted as a time-limited treatment, and there was a prevalent trend of authorizing a health care agent (HCA) to make decisions on behalf of participants. Gender differences were observed, with females more inclined to decline LST and ANH, while males tended towards accepting full or time-limited treatment. Age also played a role, with younger participants more open to treatment and authorizing HCA, and older participants more prone to refusal. Conclusion Diverse preferences in LST and ANH were shaped by the public’s current understanding of different clinical states, gender, age, and cultural factors. Our study reveals nuanced end-of-life preferences, evolving ADs, and socio-demographic influences. Further research could explore evolving preferences over time and healthcare professionals’ perspectives on LST and ANH decisions for neurological patients.. (shrink)
