How should we understand the political morality of migration? Are travel bans, walls, or carrier sanctions ever morally permissible in a just society? This book offers a new approach to these and related questions. It identifies a particular vision of how we might apply the notion of justice to migration policy - and an argument in favor of expanding the ethical tools we use, to include not only justice but moral notions such as mercy.

The cornerstone of contemporary nursing practice is the provision of individualised nursing care. Sustaining and nourishing the stream of research frameworks that inform individualised care are the findings from qualitative research. At the centre of much qualitative research practice, however, is an assumption that experiential understanding can be delivered through a thematisation of meaning which, it will be argued, can lead the researcher to make unsustainable assumptions about the relations of language and meaning‐making to experience. We will show that an (...) uncritical subscription to such assumptions can undermine the researcher's capacity to represent experience at the high level of abstraction consistent with experience itself and to thus inform genuinely individualised care. Instead, using qualia as a touchstone for the possibilities of understanding and representing experience, we trace the ‘designative’ and ‘expressive’ distinction to language in order to raise critical questions concerning both these assumptions and common practices within qualitative research. Following the ‘expressive’ account of language, we foreground in particular the hermeneutic work of Gadamer through which we explore the possibilities for a qualitative research approach that would better seek the mot juste of individual experience and illuminate qualia in order to better inform genuinely individualised care. BackgroundAdvances in healthcare artificial intelligence (AI) are occurring rapidly and there is a growing discussion about managing its development. Many AI technologies end up owned and controlled by private entities. The nature of the implementation of AI could mean such corporations, clinics and public bodies will have a greater than typical role in obtaining, utilizing and protecting patient health information. This raises privacy issues relating to implementation and data security. Main bodyThe first set of concerns includes access, use and control (...) of patient data in private hands. Some recent public–private partnerships for implementing AI have resulted in poor protection of privacy. As such, there have been calls for greater systemic oversight of big data health research. Appropriate safeguards must be in place to maintain privacy and patient agency. Private custodians of data can be impacted by competing goals and should be structurally encouraged to ensure data protection and to deter alternative use thereof. Another set of concerns relates to the external risk of privacy breaches through AI-driven methods. The ability to deidentify or anonymize patient health data may be compromised or even nullified in light of new algorithms that have successfully reidentified such data. This could increase the risk to patient data under private custodianship.ConclusionsWe are currently in a familiar situation in which regulation and oversight risk falling behind the technologies they govern. Regulation should emphasize patient agency and consent, and should encourage increasingly sophisticated methods of data anonymization and protection. (shrink)

It is widely believed that Perelman and Olbrechts-Tyteca’s theory of argumentation is vulnerable to the charge of relativism. This paper provides a more charitable interpretation of Perelman and Olbrechts-Tyteca’s normative views, one that properly considers the historical trajectory of their work and a wider range of texts than existing interpretations. It is argued that their views are better characterized as a form of “contrastivism about arguments” than any kind relativism. This more accurate depiction contributes to ongoing efforts to revive interest (...) in Perelman and Olbrechts-Tyteca’s work as well as build bridges with trends in contemporary argumentation theory. Zizek insisted on the ‘temporal gap between the production of value and its actualization’ (Zizek, 2009b [2006], p. 52): ‘the temporality here is that of the futur antérieur: value “is” not immediately, it only “will have been,” it is retroactively actualized, performatively enacted’ (ibid.). His use of the word ‘gap’ calls to mind the psychoanalytic literature on which Zizek draws, which provides a way to understand the 2007 Global Financial Crisis (GFC) and its aftermath. This paper presents three key ideas (...) about the GFC. First, the GFC was a traumatic encounter with lack, in which global capitalism confronted a gap at the centre of its chain of signifiers. Whether the financial system is seen as a series of promises or a system for allocating and hedging risk, a gap or lack remained at the origin of its chain of signifiers. Secondly, many explanations of the crisis focus on ‘getting back to fundamentals’, which can be read as an attempt to paper over the lack. Finally, in the panic to re-establish the master signifier, global finance tossed aside core justifications for capitalism, and it is not yet clear what the results will be: re-establishment of the old regime, a return to a Primal Father, or a turn to the analyst’s discourse. State militaries have strong interests in developing enhanced warfighters: taking otherwise healthy service personnel (soldiers, marines, pilots, etc.) and pushing their biological, physiological, and cognitive capacities beyond their individual statistical or baseline norm. However, the ethical and regulatory challenges of justifying research into these kinds of interventions to demonstrate the efficacy and safety of enhancements in the military has not been well explored. In this paper, we offer, in the context of the US Common Rule and Institutional Review Board framework, (...) potential justifications for justifying research into enhancing warfighters on the grounds of (1) individual and group risk reduction, (2) protection of third parties such as civilians, and (3) military effectiveness. This paper contributes to the growing literature in social epistemology of diagnosing the epistemically problematic features of fake news. I identify two novel problems: the problem of relevant alternatives; and the problem of the degradation of the epistemic environment. The former arises among individual epistemic transactions. By making salient, and thereby relevant, alternatives to knowledge claims, fake news stories threaten knowledge. The problem of the degradation of the epistemic environment arises at the level of entire epistemic communities. I introduce the (...) notion of an epistemic environment, roughly the totality of resources and circumstances relevant to assessing the epistemically interesting statuses, such as knowledge. Fake news degrades our epistemic environment by undermining confidence in epistemic institutions and altering epistemic habits, thereby making the environment less conducive to achieving positive epistemic statuses. This is problematic even if the decrease in confidence and the altering of habits are rational. I end by considering solutions to these problems, stressing the importance of reproaching each other for proliferating fake news. I argue that we should reproach even faultless purveyors of fake news. This is because fake news typically arises in abnormal epistemic contexts, where there is widespread ignorance of, and noncompliance with, correct epistemic norms. (shrink)

As practicing clinicians, physicians are expected to uphold the ethical norms of their profession, including fidelity to patients and respect for patients’ self-determination. At the same time, as individuals, physicians are moral agents in their own right and, like their patients, are informed by and committed to diverse cultural, religious, and philosophical traditions and beliefs. In some circumstances, the expectation that physicians will put patients’ needs and preferences first may be in tension with the need to sustain the sense of (...) moral integrity and continuity that grounds a physician’s personal and professional life. This article examines the implications for patients, physicians, and the medical profession when tensions arise between a physician’s professional commitments and his or her deeply held personal moral beliefs. It offers guidance on when a physician’s professional commitments should outweigh personal beliefs as well as when physicians should have freedom to act according to the dictates of conscience while still protecting patients’ interests. This paper examines self-fashioning in Aleksandar Hemon’s “Everything,” a story about a Sarajevo teenager’s journey through ex-Yugoslavia to the Slovenian town of Murska Sobota. His aim? “[T]o buy a freezer chest for my family” (39). While in transit, the first-person narrator imagines himself a rogue of sorts; the fictional journey he takes, meanwhile, is clearly within the quest tradition. The paper argues that “Everything” is an unruly text because by the end of the story the reader must jettison the conventional (...) reading traditions the quest narrative evokes. What begins as a comic tale about a minor journey opens out, in the story’s final lines, into a story about larger historical concerns, namely, the Yugoslav wars of the 1990s. By introducing contemporary history, Hemon points beyond the closed world of his short story, while rejecting the quest pattern he has established. (shrink)

A prominent argument for internalism appeals to the requirement that justified beliefs not be accidentally true from the subject’s perspective. Bergmann’s dilemma remains the most troublesome obstacle to those who defend internalism in this way. In a word, what is required for a belief to be non-accidental? If we require the subject to justifiably believe that one is aware of something counting in its favor, then a vicious regress results and one is never justified in believing anything. But we cannot (...) require less since beliefs can satisfy any lesser requirements and still be accidental. I argue here that phenomenal conservatism, which appeals to “seemings,” shows a way out of this dilemma. The key is that seemings, via their unique phenomenal character, make their content non-accidental for us simply by our being conscious of them and without our having to reflect on their significance. This is an important step in the larger project of re-envisioning traditional arguments for access internalism as supporting mentalism instead. (shrink)

Had Galileo not been silenced there would have been no impetus for Descartes to have developed a metaphysical argument; natural-philosophical [End Page 49] arguments would have sufficed.3 Thus, in the words of Gaukroger, Descartes’ project of metaphysical legitimation was “a task which he never even contemplated before the condemnation of Galileo in 1633, and... was a direct response to that condemnation.”4 If we are to believe Adam and Gaukroger, then, Descartes was first and foremost a natural philosopher whose extended venture into metaphysics was primarily a strategic response to the events of 1633.Despite the many merits of this line of interpretation, I believe it is trouble-some insofar as it isolates Descartes’ reaction to the condemnation from both his criticisms of Galileo’s science and his views on the relation between science and theology. In doing so, it overstates the degree to which Cartesian science can itself be isolated from Cartesian metaphysics. In what follows, then, I will contextualize Descartes’ reaction to the Galileo affair by examining his comments on Galileo’s scientific work and the relation of his own views on science and theology to those of Galileo. Two results will emerge. First, we will see that if we fail to take Descartes’ search for metaphysical foundations as having a genuinely scientific motivation, not only will we render his criticisms of Galileo’s science unintelligible, but we will fail to understand the distinctive nature of his science vis-à-vis Galileo’s. This will become clear as we examine the work of each on motion and the fall of bodies. Second, we will see that it is only by taking Descartes’ metaphysical commitments as integral to his science that we can make sense of the divergent ways in which he and Galileo resolved the question of the relation of science to theology. Many theists believe both (1) that Heaven will be infinitely or maximally good for its residents and (2) that most humans will, eventually, reside in Heaven. Further, most theists believe (3) that human procreation is often all-things-considered morally permissible. I defend three novel arguments for the impermissibility of procreation predicated on the possibility of heavenly overpopulation. First, we shouldn’t be rude to hosts by bringing more people to a party than were invited, which we do if we continue to procreate. (...) Second, justice requires that the goods of Heaven be supremely good for those for whom heavenly existence is (even partially) compensatory, but if Heaven has a fixed and finite number of goods, each successful act (or enough acts) of procreation lowers the expected goodness for those persons and threatens to undermine justice. The federal government is funding a sea change in health care by investing in interventions targeting social determinants of health, which are significant contributors to illness and health inequity. This funding power has encouraged states, professional and accreditation organizations, health care entities, and providers to focus heavily on social determinants. We examine how this shift in focus affects clinical practice in the fields of oncology and emergency medicine, and highlight potential areas of reform.

Among the most striking features of the political arrangements on this planet is its division into sovereign states.1 To be sure, in recent times, globalization has woven together the fates of communities and individuals in distant parts of the world in complex ways. It is partly for this reason that now hardly anyone champions a notion of sovereignty that would entirely discount a state’s liability the effects that its actions would have on foreign nationals. Still, state sovereignty persists as (...) a political fact. The number of states has increased enormously due to upheavals of the 20th century, and there is nothing in principle morally wrong with the existence of states - or so we will assume.2 What must be explored, then, are the limits of normatively plausible sovereignty. How bad does a government have to be for outsiders to be allowed to interfere? What responsibilities does a country incur because of its contribution to global warming? What obligations arise through trading? In this paper, we explore another pertinent question: to what extent is a country allowed to influence who lives on its territory by regulating immigration? The angle from which we approach this question continues to be neglected even now that questions of global justice are receiving much attention. Immigration amounts to a change in political relationships as immigrants alter their standing within one community and acquire a status elsewhere. Yet it also amounts to an alteration in physical relationship, since they acquire a relationship to a territory, making a life for themselves with the resources offered by a part of the earth.3 We base our exploration of.. This chapter argues that considerations arising from queer oppression can furnish support for pacifist positions. The first consideration concerns the nature and strength of the moral presumption against violence. Violence undermines a victim’s agency, coercing them to betray their identities, not unlike “reparative therapy.” The second consideration concerns the moral presumption against conscription. Current conscription policies are cisgender-normative, threaten to coerce queer citizens to fight for unjust states that oppose their basic rights, and coerce queer citizens to risk their lives (...) and welfare on behalf of queerphobic citizens. Physicians play a critical role in preventing and treating firearm injury, although the scope of that role remains contentious and lacks systematic definition. This piece aims to utilize the fundamental principles of medical ethics to present a framework for physician involvement in firearm violence. Physicians' agency relationship with their patients creates ethical obligations grounded on three principles of medical ethics — patient autonomy, beneficence, and nonmaleficence. Taken together, they suggest that physicians ought to engage in clinical screening and treatment related (...) to firearm violence. The principle of beneficence also applies more generally, but more weakly, to relations between physicians and society, creating nonobligatory moral ideals. Balanced against physicians' primary obligations to patient agency relationships, general beneficence suggests that physicians may engage in public advocacy to address gun violence, although they are not ethically obligated to do so. A fourth foundational principle — justice — requires that clinicians attempt to ensure that the benefits and burdens of healthcare are distributed fairly. (shrink)
