This article defends the normative relevance of the representation of non-citizens in democracies. I argue that representation within nation-states constitutes a realistic institutionalisation of the All-Affected Principle, allowing justificatory practices towards non-citizens and establishing political institutions that can realise the ideal of inclusion of all externally affected individuals. I defend electoral, non-electoral and surrogate forms of representation of affected interests that satisfy both the cosmopolitan concern for the equal consideration of interests and the statist defence of the importance of a (...) territorially and civically bounded demos. I assess piecemeal implementations of representation practices, namely reciprocal representation, ombudspersons, self-appointed representatives and deliberative and advocacy groups. Gradual and pluralised means of representation constitute necessary and feasible first steps to consider affected interests and offer an alternative route to an all-or-nothing defence of inclusion as national enfranchisement. Il invente une pensée de l'animal regardant l'homme. A une vision verticale, Montaigne substitue une relation horizontale entre les hommes et (...) les bêtes, faite de solidarités réciproques. Les animaux ne rappellent-ils pas aux hommes le respect de la nature? La réflexion de Montaigne le conduit encore à réhabiliter le rôle de la sensibilité dans la compréhension du monde. The cinematographic medium has contributed to building with him an imaginary of disaster against the backdrop of a pandemic. We will show the adequacy of the zombie with a collective imagination for which the world to come is inscribed under the sign of zombie collapse.

The concept of hospitality has seen a strong revival in the literature on migration and among pro-migrant activists. However, its meaning, its scope, and the nature of the obligations it imposes remain contested. Open-border advocates see hospitality as a moral principle of openness that should trump nationalist arguments for closure, while nationalists tap into the home analogy and compare the state to a household welcoming migrants as guests, whose stay should accordingly be temporary and marked by gratitude. Some consider hospitality (...) a virtue that should translate into a personal responsibility to open one’s doors to others, while some politicise the concept to apply it to borders and state duties towards migrants. This paper unpacks the various literal and metaphorical meanings of the age-old concept of hospitality, and the shortcomings of its rhetorical uses. It then argues for a conception of hospitality as a principle of care towards displaced people. Hospitality alleviates ordinary obstacles that prevent a functional life in a new environment and allows for home-making practices. It is triggered by the vulnerability created by displacement, i.e., the material, emotional and political harms resulting from the loss of a home. (shrink)

This article argues for reading the Algerian-French sociologist Abdelmalek Sayad (1933–1998) as a political theorist of migration. Various contributions have recently called to move away from the court-like assessment of claims by host states and foreigners and to engage more frankly with empirical work more attentive to concrete experiences and power relations. I contend that Sayad’s sociological work constitutes a substantial empirical and normative resource for ethical and political theory of migration, pointing to the persistence of ‘state thought’ and presenting (...) original normative perspectives on emigration, inclusion in democracy, naturalization or postcolonial relationships. Such a reading of Sayad from a political theory perspective would then constitute a prime example of the cross-fertilization of empirical and normative approaches. (shrink)

For all their various disagreements, one point upon which rights theorists often agree is that it is simply part of the nature of rights that they tend to override, outweigh or exclude competing considerations in moral reasoning, that they have ‘peremptory force’, making ‘powerful demands’ that can only be overridden in ‘exceptional circumstances’, Philosophical Foundations of Human Rights, Oxford University Press, Oxford, 2016, p. 240). In this article I challenge this thought. My aim here is not to prove that the (...) traditional view of rights’ stringency is necessarily false, nor even that we have no good reason to believe it is true. Rather, my aim is only to show that we have good reason to think that the foundation of the traditional position is less stable than we might have otherwise supposed and that an alternative conception of rights—one which takes the stringency of any given right as particular to the kind of right it is—is both viable and attractive. In short, to begin to move us towards a more ‘particularist’ conception of rights’ standing in moral reasoning and judgement. (shrink)

The language of linear temporal logic can be interpreted on the class of dynamic topological systems, giving rise to the intuitionistic temporal logic ${\sf ITL}^{\sf c}_{\Diamond \forall }$, recently shown to be decidable by Fernández-Duque. In this article we axiomatize this logic, some fragments, and prove completeness for several familiar spaces.

This article concerns the nature and limits of individuals’ rights to privacy over information that they have made public. For some, even suggesting that an individual can have a right to privacy over such information may seem paradoxical. First, one has no right to privacy over information that was never private to begin with. Second, insofar as one makes once-private information public – whether intentionally or unintentionally – one waives one’s right to privacy to that information. In this article, however, (...) we suggest the moral situation is more complicated than this. Rather, we argue that there is a class of public information – namely, once-private information that individuals have made public unintentionally – which remains within the scope of an individuals’ right to privacy, even when it has passed into the public domain. Significantly, this class includes any information rights-holders were unaware could be inferred from information they have made public and which they would not otherwise have wanted to be in the public domain. As we show, as well as clarifying several everyday dilemmas with regards to individuals’ privacy rights, this finding has elucidates a number of problems in the ethics of Big Data. (shrink)

Peut-on penser l’accueil des migrants, le droit d’asile ou plus généralement l’immigration comme un devoir ou un droit d’hospitalité ? On comprend intuitivement qu’il y a un lien, mais on peine à voir pourquoi mobiliser une idée aussi datée et à la connotation plus religieuse que politique pourrait nous être utile. Cet article vise à comprendre le sens du retour manifeste à ce vocabulaire. Retour certes modeste, mais, nous le verrons, significatif. Car les apparitions historiques du concept d’hospitalité dans la (...) sphère publique ne sont jamais anodines. Puiser ainsi dans l’imaginaire moral de l’humanité, c’est chercher à résoudre un problème suffisamment grave pour que les concepts classiques de la politique nous semblent insuffisants. Ce problème, pour le dire brièvement, c’est celui d’une triple tension : tension entre l’ouverture et la fermeture des frontières, tension entre l’éthique et la politique de l’immigration, tension enfin entre l’accueil et l’intégration des étrangers. Or l’hospitalité a historiquement permis une articulation de ces tensions : elle offre une position relativement cohérente, où l’on rend possible l’ouverture contrôlée des frontières (par exemple, sous la forme de droit de passage), permise au nom d’une morale, généralement issue du droit naturel, mais limitée au seul accueil des étrangers – sous-entendu accueil temporaire, sans garantie de pouvoir rester, sauf à satisfaire aux critères potentiellement toujours plus exigeants de l’hôte, autrement dit un accueil sous forme d’une domination. Cette articulation ne va donc pas sans poser problème aujourd’hui. Il est alors important de comprendre comment l’hospitalité s’est constituée comme grammaire critique des lois répressives contre les migrants, tout en pointant les difficultés à raviver ses caractéristiques anti-modernes. The conjunction of sex and death is depicted through acts of paedophilia, rape, and murder of women and children. The study aims to elucidate the logic which is inherent to those acts of violence and which founds the reproduction of social domination mechanisms.

To say health is 'special' is to say that it has a moral significance that differentiates it from other goods (cars, say or radios) and, as a matter of justice, warrants distributing it separately. In this essay, I critique a new justification for the specialness thesis about healthcare (STHC) recently put forth by Engster. I argue that, regrettably, Engster's justification of STHC ultimately fails and fails on much the same grounds as have previous justifications of STHC. However, I also argue (...) that Engster's argument still adds something valuable to the debate around STHC insofar as it reminds us that the moral significance of healthcare may be wider than simply its effect on the incidence of disability and disease: one further reason we may think healthcare is morally significant is because it concerns the treatment and care of those who are already unwell. Our goal is to show how science fiction films have dealt with the augmentation of bodily and cognitive faculties. These cinematographic imaginaries allow us to question the interest of such innovations. They depict a world in which the artificialization and mechanization of many activities leads to a loss of control over them. This would mean that we would run the risk, in the long term, of being deprived of our human qualities. However, we will show that these films do not (...) question the viability of this type of society. Indeed, these fictions do not insist on the constraints that these transformations nevertheless impose on the environment. Faced with the ecological crisis, the hold of technological innovations on all societies, far from appearing as the solution, risks on the contrary being identified as part of the problem. (shrink)

The purpose of the Instruction Dignitas personae, issued by the Congregation for the Doctrine of the Faith, is not only to reaffirm the validity of the teaching laid out in Donum vitae (1987), with regard to both the principles on which it is based and the moral evaluations which it expresses, but to add needed clarification on reproductive technologies in the light of more recent developments. In addition to the reproductive technologies discussed in Dignitas personae, namely, homologous and heterologous artificial (...) insemination, in vitro fertilization, and intracytoplasmic sperm injection, the author also discusses other reproductive technologies, not covered by the Instruction, such as gamete intrafallopian transfer, zygote intrafallopian transfer, tubal embryo transfer, and pronuclear-stage embryo transfer. Wood, Kressel, Joshi, and Louie report that published, but not unpublished, studies of masculinity, dominance, symmetry, and health preferences show significant overall effects of cycle phase. They interpret this as evidence that reports of cyclic shifts in mate preferences are artifacts of publication bias. I will first discuss why these conclusions do not necessarily follow straightforwardly from their results. Knowledge of what it’s like to have perceptual experiences, e.g. of what it’s like to see red or taste Turkish coffee, is phenomenal knowledge; and it is knowledge the substantial or significant nature of which is widely assumed to pose a challenge for physicalism. Call this the New Challenge to physicalism. The goal of this paper is to take a closer look at the New Challenge. I show, first, that it is surprisingly difficult to spell out clearly and neutrally what (...) the New Challenge is in fact urging the physicalist to explain. What initially look like plausible or promising ways of making sense of it turn out to be either question begging or insufficient to generate a challenge to physicalism at all. I go on to suggest that what the New Challenge may be asking the physicalist to explain may be the fact that we come to token certain higher-order judgments about the significance of phenomenal knowledge. I end with a discussion of the implications of this interpretation of the New Challenge—which turns out to be as much a challenge for the anti-physicalist as it is for the physicalist. (shrink)

As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

Before presenting his own account of value in the Ethics, Spinoza spends much of EIAppendix and EIVPreface attempting to refute a series of axiological ‘prejudices’ that he takes to have taken root in the minds of his readership. In doing so, Spinoza adopts what might be termed a ‘genealogical’ argumentative strategy. That is, he tries to establish the falsity of imagined readership’s prejudices about good and bad, perfection and imperfection, by first showing that the ideas from which they have arisen (...) are themselves false. Many elements of this genealogy, however, remain unclear. First, both the nature of the metaethical prejudices Spinoza believes we have been labouring under, and the metaphysical prejudices that he takes to have given rise to them, continue to attract widespread disagreement. Although much less commented on, it is also not entirely obvious why Spinoza takes the one to have engendered the other. In this article, I attempt to clarify Spinoza’s reasoning in both of these respects, ultimately concluding that Spinoza offers us two accounts of how this process has occurred, the first beginning from an anthropocentric doctrine of divine providence, the second from more secular, perhaps more purely Aristotelian metaphysical tradition. In this article we aim to assess the ethical desirability of self-test diagnostic kits for influenza, focusing in particular on the potential benefits and challenges posed by a new, mobile phone-based tool currently being developed by i-sense, an interdisciplinary research collaboration based at University College London and funded by the Engineering and Physical Sciences Research Council. Our study adopts an empirical ethics approach, supplementing an initial review into the ethical considerations posed by such technologies with qualitative data from three focus (...) groups. Overall, we map a range of possible considerations both for and against the use of such technologies, synthesizing evidence from a range of secondary literature, as well as identifying several new considerations previously overlooked. We argue that no single consideration marks these technologies as either entirely permissible or impermissible but rather tools which have the potential to incur certain costs and benefits, and that context is important in determining these. In the latter stages of the article, we explain how developers of such technologies might seek to mitigate such costs and reflect on the possible limitations of the empirical ethics method brought out during the study. In this article I seek to establish what, if anything, might be morally troubling about morally enhancing oneself through biomedical means. Building on arguments by Harris, while simultaneously acknowledging several valid counter-arguments that have been put forth by his critics, I argue that taking BMEs necessarily incurs at least one moral cost in the restrictions they impose on our freedom. This does not necessarily entail that the use of BMEs cannot be overall justified, nor that, in certain cases, their costs (...) may not be forestalled. It does show, however, that their use is not morally neutral. There is a cost to such technologies and, as such, the onus will always be on their defenders to show that these costs can compensated for. (shrink)

The increasing pressure from different facets of society exerted on multinational companies to become more philanthropic and claim ownership of their impacts is now becoming a standard practice. Although research in corporate social responsibility has arguably been recent, the application of activities taking a voluntary form from MNCs seem to vary reflecting a plethora of factors, particularly one obvious being the backwater local communities of developing countries where most of the natural extraction projects are located. This chapter examines views of (...) two Papua New Guinea local communities hosting large-scale mining operations and explains the demands arising from situational relativities, which are becoming too conspicuous for mine developers not to ignore. The research undertaken with several assertions highlights the perceived imperativeness allowing companies to integrate the CSR into the essential management pursuits of running mines in PNG. Moral revolutions are rightly coming to be recognised as a philosophically interesting and historically important mode of moral change. What is less often acknowledged is that the very characteristics that make a moral change revolutionary pose a fundamental challenge to the possibility of moral progress. This is because moral revolutions are characterised by a diachronic form of deep moral disagreement: moral agents on either side of a moral revolution adopt different standards for assessing the merits of a moral argument, and (...) according to the standards they adopt, agents on neither side of the revolution ought to accept the arguments being put forward by those on the other. This threatens to undermine the progressive status of many of our most celebrated historical examples of moral revolutions: if a moral revolution only looks progressive in light of a change in evaluative standards it itself brought about, then moral progress seems relative to a particular historical perspective; if prior to a moral revolution taking place the moral arguments in its favour fall short of the relevant standards, moral revolutions can never be the outcome of rational argumentation. This apparent relativism and irrationality sits uncomfortably alongside our common-sense intuition that the moral revolutions upon which our contemporary moral worldview rests count as genuine moral progress. In this paper, I deepen currently popular Kuhnian-inspired accounts of moral revolution by incorporating Wittgensteinian ideas from _Philosophical Investigations_ and _On Certainty_. The result is an original way of thinking about deep moral disagreements, moral revolutions, and moral progress. (shrink)

Among Spinoza’s principal projects in the Ethics is his effort to “remove” certain metaethical prejudices from the minds of his readers, to “expose” them, as he has similar misconceptions about other matters, by submitting them to the “scrutiny of reason”. In this article, I consider the argumentative strategy Spinoza uses here – and its intellectual history – in depth. I argue that Spinoza’s method is best characterised as a genealogical analysis. As I recount, by Spinoza’s time of writing, these kinds (...) of arguments already had a long and illustrious history. However, I also argue that, in his adoption of such strategies, we have good reason to think Spinoza’s primary influence was Gersonides. Elucidating this aspect of Spinoza’s critique of his contemporaries’ axiologies brings a number of explicatory and historical boons. However, regrettably, it also comes at a cost, revealing a significant flaw in Spinoza’s reasoning. Towards the end of this article, I consider the nature of this flaw, whether Spinoza can avoid it and its ramifications for Spinoza’s wider philosophical project. (shrink)

This article asks about the conditions of a sociological operationalization of the capability approach developed by Amartya Sen and Martha Nussbaum. Raising the question of freedom and social opportunities, the capability approach has so far mainly been discussed by economists and philosophers. In order to adopt this approach for a sociological and pragmatist perspective, it engages with methodological and theoretical issues. Whereas capabilities have until now mainly been studied within quantitative frameworks, the author opts for a qualitative method of inquiry (...) that draws on a pragmatist and configurational approach. Such a shift towards qualitative inquiry is a key condition for a better sociological understanding of notions like freedom and opportunities that stand at the core of the capability approach.
