That evening, one of the feasters recalled that this was the man who had written the foremost theological defense of the Royal Supremacy: the following morning, when Gardiner asked for vessels and vestments to say Mass before proceeding on his way, they were refused him, as to an excommunicate or a schismatic. This incident is (...) significant for a number of reasons: it shows that, whatever anyone else might have thought, Gardiner certainly thought he was a Catholic. The ambiguity of that label, and how far exactly it extended, is also quite evident. Some explanation of the difficulty and some consistency of usage in the text of the biography would have been welcome. The text itself appears to have a number of editorial flaws: p. 201 begins in the middle of a paragraph, and the opening lines are omitted. In the second paragraph of p. 176, numbers are transposed so that what is printed as 1534 should read 1543 (in the context, a significant difference). The book is, on the whole, a contribution to scholarship that is long overdue. That a man who was so powerful (not to say feared) during his own lifetime should wallow in oblivion is confusing. Redworth 's biography, for all its incompleteness, is of great value in piecing together the life of this leader, both political and ecclesiastical, who sought to fashion the emerging English Church and nation into a recognizably Catholic form. The religious order of the Dominicans (Order of Preachers) was founded in the thirteenth century by St. Dominic with the specific purpose of preaching the Gospel or " ministry of the Word." With the Franciscan Order it shared in the creative, artistic impulse that produced the medieval cathedrals. It is often said that the great Summa Theologiae of St. Thomas Aquinas, for all its intellectual rigor, is also a work of art comparable to the gothic masterpiece of Chartres cathedral. Dominicans and Franciscans thought that the Gospel should find expression not only in words, but in poetry, music, architecture, and BOOK REVIEWS 165 the plastic arts. Among the artists who were members of the Dominican Order are the recently beatified Fra Angelico (BL Giovanni da Fiesole ), Bartolommeo della Porta, an important influence on Raphael and other High Renaissance painters, Juan Mayno the gifted Spanish contemporary of El Greco, Pere Couturier, the advocate of modern church art and friend of Matisse, and the American sculptor, Thomas McGlynn. Carrying on this Dominican tradition, Angelico Rinaldo Zarlenga (1919-1986), a native of Italy, worked in the United States from 1949 until his death. The present work, edited by his brother Vincent, also a member of the Order, makes available a chronological catalogue of his paintings, sculptures, and designs in glass, with many illustrations in full color, along with a biography and critical appreciations by others, including Cardinals Joseph Bernadin and Mario Luigi Ciappi. It is an important contribution to the history of Catholic religious art in the United States. The noted German theologian Hans Urs von Balthasar built his whole theology not on the goodness and truth of God, but on His beauty, or in biblical terms, God's "glory." According to St. Thomas Aquinas, " beauty " is the " radiance of truth," that is, it is truth as truth is related well to our knowing powers. Like the fit between the key and the lock, beauty is the fit between known and the knower. That is why a landscape on a cloudy day looks dull and uninteresting, but when the sun comes out it appears strikingly beautiful. David Hume’s arguments against believing reports of miracles are shown to be very weak. Laws of nature, I suggest, are best seen not as exceptionless rules but as context-dependent realizations of natural powers. In that context miracles transcend the natural order not as "violations" but as intelligible realizations of a divine supernatural purpose. In particular, he "aim[s] (1) to extend Catholic social thought ecologically, and (2) to extend Catholic ecological ethics comparatively" (8).The argument begins by broadening the notion of the common good into a "Catholic cosmic common good," which "emphasizes the centrality of God, the goodness of creation, and humanity's dignified and privileged but contextualized role within the story of creation" (32). This vision is then informed by Augustine, Aquinas, and Thomas Berry. Next, Scheid widens solidarity, a virtue that (per John Paul II) involves "commit[ting] oneself to the common good" (86), into "Earth solidarity," which attends to all ecosystems and species, particularly those most impacted by environmental damage. While the argumentation is intricate, the logical ordering of chapters, the repetition of important points, and some vivid examples assist the reader in following along. The case for Earth rights is especially bold and well argued; Scheid considers objections to them and shows that they can be intelligibly grounded (as prima facie and proportionately weighted) in self-governance and creaturely dignity. This is a very promising development in Catholic social thought, as recent key magisterial teachings do not explicitly affirm that animals have dignity (or rights) but limit themselves to the notion that harming animals is "contrary to human dignity" (see Laudato Si', §§ 92, 130, quoting Catechism of the Catholic Church, § 2418).While the book is generally comprehensive, there are a few surprising lacunae. First, although Scheid himself recognizes that "a properly Catholic ecological ethics would certainly not dismiss the centrality of the Bible" (198n16), there is very little reference to it. The author briefly alludes to the Psalms' portrayal of the natural world (47, 181), but more integration of the Old and New Testaments would have been illuminating. And while The Cosmic Common Good makes a commendable last-minute effort to incorporate insights from Laudato Si', Francis's predecessor Benedict XVI (often dubbed "the Green Pope") receives too-short shrift. Benedict's ecological views are referenced only on one page, perhaps because they are somewhat more anthropocentric than the "Earth-centered or cosmos-centered" ethic developed by Scheid (24). Regardless, the former pope's frequent calls for environmental responsibility to the poor, future generations, and animals would surely lend some healthy support to the cosmic common good. But these omissions do not detract much from the merits of this book, which should be read "not as a definitive conclusion but as an invitation to generate greater interreligious dialogue and cooperation on an issue that demands extensive and immediate action" (11). In The Apocalypse of Wisdom: Louis Bouyer's Theological Recovery of the Cosmos, he offers the English-speaking world for the first time a monograph (...) on the thought of the Oratorian Louis Bouyer. Bouyer is undoubtedly one of the theological giants of the twentieth century. Born in Paris in 1913, he was ordained a Lutheran pastor in 1936. After only three years as a Lutheran clergyman, he was received into the Catholic Church at the Benedictine Abbey of Saint Wandrille. Then ordained as an Oratorian priest in 1944, he taught from 1946 to 1962 at the Institut Catholique de Paris and abroad for the three decades following.1 He is most well-known for his work on the liturgy both before and after the Second Vatican Council. With fifty books to his name, including a nine-part synthesis on Christian doctrine, the breadth of his theological vision and work is astounding. In France he is considered one of the four preeminent theologians of the post-World War II era, and his theological contemporaries in Europe, such as Hans Urs von Balthasar and Joseph Ratzinger / Benedict XVI, always held the Oratorian in high regard.2 Yet, in the English-speaking world, much of his work has gone without comment.3 Thankfully, into the void steps this excellent work by Lemna. [End Page 1353]Anyone familiar with the Bouyerian corpus knows the challenge of approaching it. With its vast array of subject matter, ranging from biblical to liturgical to historical to spiritual to speculative theology, one wonders whether there is any one thread woven throughout the varied strands, a single theme around which the whole sprawling corpus can be understood. In fact, there is, and Lemna has deftly identified it. For Bouyer, the fundamental question of theology is the world's relation to God.4 The structure of the first six books of his nine-part treatise on systematic theology attest to the priority of the question with the first three works addressing the question of the world, or the economy of creation and salvation, and the latter three works addressing the question of God, or theology properly speaking: the doctrine of the Trinitarian God. Interestingly, though Bouyer's work on theological cosmology, Cosmos, is the third book in the series, it was, in fact, the last of the six to be written. In this sense, as Lemna points out, "Cosmos is a capstone monograph... summarizing in important ways the decisive first six volumes" (xiv). Theological cosmology fully illuminates the God–world relation as Bouyer sees it, and since this relation sits at the heart of his thought, Cosmos is for Bouyer both his "most personal, as well as most speculative work" and indeed, "opens up the meaning of his other writings" beyond the dogmatic sphere (25). One could, then, scarcely choose a better entry point into the wide theological world of this "mind with a very special character," as Joseph Ratzinger saw him.5The Apocalypse of Wisdom is an expansive commentary on Bouyer's cosmology at the heart of which is a liturgical, even nuptial, vision of the whole of creation known and loved in the mind of God from all eternity, as the uncreated Wisdom of God. This culture possessed its own institutions, traditions, and rituals that connected its members across borders and religious divides. A professor from Lisbon, a librarian from Hanover, and a schoolmaster from Turku would all speak nearly the same language and wear nearly the same clothing. They would (...) share many of the same dreams, celebrate many of the same heroes, and have similar memories from their youth and adult life. They were convinced that they belonged to the same cultural group and were normally willing to make personal and economic sacrifices when called upon by members of this group. Long before the emergence of European nation-states, the community of scholars formed what Benedict Anderson has called an imagined community, united by the forces of language, culture, and writing.1From around 1500, the community of scholars went by the name respublica litteraria—the Republic of Letters. Italian humanists already used the metaphor in the early fifteenth century, and with Erasmus of Rotterdam's Antibar-barorum liber, it became commonplace within Europe.2 To Erasmus and his [End Page 421] circle the Republic of Letters signified the natural community between all students of creation, divine reason, and Greek and Roman antiquity. It gathered scholars across space and time and set them apart from the hordes of ignorant barbarians. To most early modern scholars, however, respublica litteraria signified much more than a community of reason and knowledge. They used the metaphor to describe every aspect of the culture of scholarship that connected its members and demarcated them from surrounding society. Universities, academies, and secret societies were talked about as parts of the Republic of Letters. Scholarly letters and conversations tête-à-tête, books, lectures and seminars, rituals and traditions were all included. The metaphor demarcated invisible borders between learned and lay, tacitly known to insiders but rarely strictly defined.3The Republic ChallengedDuring the last decades of the seventeenth century the metaphor of the Republic of Letters lost much of its force and elasticity. Scholars used and debated the metaphor more than ever before, but these heated and emotional discussions were not necessarily—as is assumed in much of the work on the eighteenth century4 —a sign that the metaphor and the culture it represented had gained ground. The discussions were, much rather, a symptom of crisis. The end of the great religious wars and the emergence of modern centralized states forced scholars to rethink their role in society and their relationship to the new military and administrative elites. Philosophical skepticism and philological criticism threatened established academic teachings and methods.5 Debates about the Republic of Letters reveal the scholars' efforts to answer these political and intellectual challenges. In her studies of learned Huguenots who, after 1685, were spread across Europe, Anne Goldgar has described how the alienated community of scholars at the turn of the eighteenth century came increasingly under pressure.6 The Huguenots felt marginalized in their adopted [End Page 422] homes, lost income and patronage, and suffered a decline in social prestige. According to Goldgar, these external pressures resulted in stronger internal bonds, as exiled scholars rallied around the ideal of the borderless Republic of Letters. But already before Louis XIV's revocation of the Edict of Nantes, Huguenot scholars defined a French version of the republic—La République des Lettres—in strong opposition to the forces suppressing the Protestant minority. In 1684 Pierre Bayle defiantly declared from his Dutch refuge,It is not a matter of religion, but of science: therefore one should put an end to all boundaries that divide men into different camps, and consider only that which unites them, namely their rank as noblemen in the Republic of Letters. Any theoretically savvy discussion of nations or of societies of any sort must cite it for its fundamental insight that nations and, as Anderson points out, "all (...) communities larger than primordial villages of face-to-face contact (and perhaps even these) are imagined" [6]. In retrospect, it seems obvious that nationality, nationness, and nationalism "are cultural artifacts of a particular kind" [4], but this had previously been obscured by intellectuals' sense that nationalism was above all an atavistic passion, an often noxious prejudice of the unenlightened. Imagined Communities both argued that we had better seek to understand it, since "nation-ness is the most universally legitimate value in the political life of our time" [3], and gave us a constructivist way of thinking about the phenomenon of nationalism, which becomes more interesting and intellectually more acceptable when we ask how it is created, what discursive, imaginative activities bring particular nationalisms into being and give them their distinctive form. When nationalism was vulgar passion provoked by empirically occurring nations, it was vulnerable to the objection implicitly or explicitly mounted against it: why should I feel more affinity with people who happen to inhabit the country I live in than with others, more like-minded, who happen to have been born in other nations? Anderson neatly turned the tables on us by taking this as a serious question. Why indeed do we feel such affinities? How to explain the fact that people are more willing to make great sacrifices for others of the same nation whom they have never met (and whom they might dislike if they did) than for worthy and unfortunate people elsewhere?Read today, the introduction to Imagined Communities has the rightness and efficiency of a classic ("why hadn't anyone realized this before?"), as it guides us into the paradoxes of the modern world of nationalism: nations are objectively recent but subjectively antique, even eternal; nations may be messianic, but no nation's citizens imagine that everyone should eventually join their nation. Already here Anderson displays what I take to be the key to his appeal to the nonspecialist: his ability concretely to show us the strangeness of the familiar by judicious comparisons. Try to imagine a "Tomb of the Unknown Marxist or a Cenotaph for fallen Liberals," he suggests. But a Tomb of the Unknown Soldier does not seem risible. Why? "Many different nations have such tombs without feeling any need to specify the nationality of their absent occupants. What else could they be but Germans, American, Argentinians...?" [10]. We are in a sentence or two brought to appreciate the necessity of accounting for a social and cultural phenomenon that comparison and humor highlight.The second edition of Imagined Communities demonstrates, in a compelling if serendipitous way, just how much we need Anderson to provide such insights, as it takes up what he and his readers had failed to notice in the first edition. This article asks about the conditions of a sociological operationalization of the capability approach developed by Amartya Sen and Martha Nussbaum. Raising the question of freedom and social opportunities, the capability approach has so far mainly been discussed by economists and philosophers. In order to adopt this approach for a sociological and pragmatist perspective, it engages with methodological and theoretical issues. Whereas capabilities have until now mainly been studied within quantitative frameworks, the author opts for a qualitative method of inquiry (...) that draws on a pragmatist and configurational approach. Such a shift towards qualitative inquiry is a key condition for a better sociological understanding of notions like freedom and opportunities that stand at the core of the capability approach. I aim to explode a famous thesis about “the rise of fictionality,” argued in an essay of that title by Catherine Gallagher. I also have in mind related claims that the eighteenth or the nineteenth century first distinguished fiction from nonfiction or first differentiated literature from other modes of discourse. Gallagher places the rise of fictionality exactly where Ian Watt placed the rise of the novel—England, 1720 to 1740—and she connects it to the development of a credit economy. This article (...) argues that the relationship between fiction and credit goes deeper than this, insofar as fiction was classically theorized in relation to modal concepts like probability and as such had a direct relationship to what Aristotle called endoxa: what is believed by all or by most. Probability was understood in relation not to what happens but to what is thought to happen: that is, to a socially constituted sense of what and who is credible. The article takes account of the multiple disciplines in which fictionality was theorized in the premodern period, but it emphasizes the centrality of rhetoric and the dissemination of a model of fictionality through the early modern grammar schools. Finally, it reads Shakespeare’s Othello to show that probable fiction was not only an available concept but a crucial tool for the analysis of social life. In Othello, ideologies of race and gender define the unequal terms on which credibility is established. Probable fiction is directly tied to the work of making and unmaking social worlds. (shrink)

Background: The phenomenon of forceful physical restraint in pediatric care is an ethical issue because it confronts professionals with the dilemma of using force for the child’s best interest. This is a paradox. The perspective of healthcare professional working in pediatric wards needs further in-depth investigations. Purpose: To explore the perspectives and behaviors of healthcare professionals toward forceful physical restraint in pediatric care. Methods: This qualitative ethnographic study used focus groups with purposeful sampling. Thirty volunteer healthcare professionals (nurses, hospital aids, (...) physiotherapists, and health educators) were recruited in five pediatric facilities in four hospitals around Paris, France, from March to June 2013. The data were processed using NVIVO software (QSR International Ltd. 1999–2013). The data analysis followed a qualitative methodological process. Ethical Considerations: The research was conducted in compliance with the Declaration of Helsinki. Written informed consent was collected systematically from participants. Findings: This study provides elements to help understand why restraint remains common despite its contradiction with the duty to protect the child and the child’s rights. All participants considered the use of forceful physical restraint to be a frequent difficulty in pediatrics. Greater interest in the child’s health was systematically used to justify the use of force, with little consideration for contradictory or ethical aspects. Raising the issue of forceful restraint always triggered discomfort, unease and an outpour of emotions among healthcare professionals. The findings have highlighted a form of hierarchy of duties that give priority to the execution of the technical procedure and legitimize the use of restraint. Professionals seemed to temporarily suspend their ability to empathize in order to apply restraint to carry out a technical procedure. This observation has allowed us to suggest the concept of “transient empathic blindness.” Conclusion: Using physical restraint during pediatric care was considered a common problem by participants. This practice must be questioned, and professionals must have access to training to find alternatives to strong restraint. Conceptualizing this phenomenon with the concept of “transient empathic blindness” could help professionals understand what happens in their minds when using forceful restraint. (shrink)

This paper critically evaluates central themes of values-based medicine (VBM). First, I discuss the 'non-descriptivist' conception of value judgments at the heart of VBM. According to it, no inferences can rationally be drawn from factual criteria to value judgments and the inferences that are naturally formed are a matter of human psychology. I argue, however, that it is an essential feature of value judgments that they are themselves subject to normative assessment. This implies an important role for an evaluatively rich (...) notion of psychology. Second, I discuss the role of 'dissensus' in VBM and argue that, although value judgments need not converge, the processes for exploring conflicting values must, themselves, be normatively assessable. One rationale policy-makers sometimes give for declining to fund a service or intervention is on the grounds that it would be ‘unaffordable’, which is to say, that the total cost of providing the service or intervention for all eligible recipients would exceed the budget limit. But does the mere fact that a service or intervention is unaffordable present a reason not to fund it? Thus far, the philosophical literature has remained largely silent on this issue. However, in this article, we (...) consider this kind of thinking in depth. Albeit with certain important caveats, we argue that the use of affordability criteria in matters of public financing commits what Parfit might have called a ‘mistake in moral mathematics’. First, it fails to abide by what we term a principle of ‘non-perfectionism’ in moral action: the mere fact that it is practically impossible for you to do all the good that you have reason to do does not present a reason not to do whatever good you can do. And second, when used as a means of arbitrating between which services to fund, affordability criteria can lead to a kind of ‘numerical discrimination’. Among Spinoza’s principal projects in the Ethics is his effort to “remove” certain metaethical prejudices from the minds of his readers, to “expose” them, as he has similar misconceptions about other matters, by submitting them to the “scrutiny of reason”. In this article, I consider the argumentative strategy Spinoza uses here – and its intellectual history – in depth. I argue that Spinoza’s method is best characterised as a genealogical analysis. As I recount, by Spinoza’s time of writing, these kinds (...) of arguments already had a long and illustrious history. However, I also argue that, in his adoption of such strategies, we have good reason to think Spinoza’s primary influence was Gersonides. Elucidating this aspect of Spinoza’s critique of his contemporaries’ axiologies brings a number of explicatory and historical boons. However, regrettably, it also comes at a cost, revealing a significant flaw in Spinoza’s reasoning. Towards the end of this article, I consider the nature of this flaw, whether Spinoza can avoid it and its ramifications for Spinoza’s wider philosophical project. (shrink)

In the debates on the roles of cultures in the ethics of human rights, one of them concerns Confucianism and Ubuntu, two prominent cultures in East Asia and Southern Africa, respectively. Some scholars assert that both cultures have values that are sharply different from the West, and conclude that the West should learn from these cultures. The aim of this paper is to philosophically investigate the roles of cultures in the ethics of human rights. I first introduce the works of (...) Bell, Metz and others on community values such as relationships and harmony in Confucianism and Ubuntu. I then argue that even if their interpretations were correct, their works still would not justify the conclusion they want. I show that it is better to use consequential evaluation rather than cultural evaluation to justify human rights. An example of human rights to health and privacy is discussed. This paper thus offers some preliminary but important philosophical investigations and addresses practical issues of consequential evaluation related to human rights. The study tests the hypothesis that conditional probability judgments can be influenced by causal links between the target event and the evidence even when the statistical relations among variables are held constant. Three experiments varied the causal structure relating three variables and found that (a) the target event was perceived as more probable when it was linked to evidence by a causal chain than when both variables shared a common cause; (b) predictive chains in which evidence is a cause of (...) the hypothesis gave rise to higher judgments than diagnostic chains in which evidence is an effect of the hypothesis; and (c) direct chains gave rise to higher judgments than indirect chains. A Bayesian learning model was applied to our data but failed to explain them. An explanation-based hypothesis stating that statistical information will affect judgments only to the extent that it changes beliefs about causal structure is consistent with the results. (shrink)

Before presenting his own account of value in the Ethics, Spinoza spends much of EIAppendix and EIVPreface attempting to refute a series of axiological ‘prejudices’ that he takes to have taken root in the minds of his readership. In doing so, Spinoza adopts what might be termed a ‘genealogical’ argumentative strategy. That is, he tries to establish the falsity of imagined readership’s prejudices about good and bad, perfection and imperfection, by first showing that the ideas from which they have arisen (...) are themselves false. Many elements of this genealogy, however, remain unclear. First, both the nature of the metaethical prejudices Spinoza believes we have been labouring under, and the metaphysical prejudices that he takes to have given rise to them, continue to attract widespread disagreement. Although much less commented on, it is also not entirely obvious why Spinoza takes the one to have engendered the other. In this article, I attempt to clarify Spinoza’s reasoning in both of these respects, ultimately concluding that Spinoza offers us two accounts of how this process has occurred, the first beginning from an anthropocentric doctrine of divine providence, the second from more secular, perhaps more purely Aristotelian metaphysical tradition. In this article, we query binaries of mobility and immobility in language studies via an empirical focus on language/social practices in a site that bridges the global North and global South. To do so, we work from a Southern praxis perspective to analyze discourses/knowledges informing the performance of accounts from Cambodian men, interviewed about transactional same-sex relationship practices between (ostensibly immobile) local men and (ostensibly mobile) male tourists to Cambodia from the global North. The analysis focuses on a process in (...) which participants’ chronotopic awareness of language shapes a negotiation of power, knowledge, and action with respect to these relationships. Encompassing the discursive positioning of selves and others through the deployment of relevant and affective chronotopes, the talk from these Cambodian men allows us to challenge assumptions about (im)mobility, awareness, agency, sexuality, and power, and demonstrate how these are accessed in multiple ways at this site of North/South contact. Mitochondrial replacement therapy is a process whereby a child is created by combining the nuclear DNA of two people wishing to have a child with mitochondrial DNA donated by a third person. It poses a new question as to the extent of a person’s right to know the identity of those from whom their DNA is inherited. In commentary upon Turkmendag’s paper, I evaluate the consistency of UK regulation of this issue with the European Convention of Human Rights. Under UK (...) law, a person created using donated mtDNA is only entitled to information about the procedure which does not identify the donor. I argue that this approach is consistent with the previous European Court of Human Rights and UK judicial decisions on the rights of individuals to information about their identity and ancestry and with the deeper foundational principle which Kai Möller argues the Convention protects existential self-understanding. I conclude that, as mtDNA has not been proven to affect an individual’s life choices and outward characteristics to the extent that gamete donation does, it is acceptable to prioritize the interests that anonymous donation protects over the desire of the recipient to know the identity of their donor. A standard interpretation of Hume’s naturalism is that it paved the way for a scientistic and ‘disenchanted’ conception of the world. My aim in this paper is to show that this is a restrictive reading of Hume, and it obscures a different and profitable interpretation of what Humean naturalism amounts to. The standard interpretation implies that Hume’s ‘science of human nature’ was a reductive investigation into our psychology. But, as Hume explains, the subject matter of this science is not restricted (...) to introspectively accessible mental content and incorporates our social nature and interpersonal experience. Illuminating the science of human nature has implications for how we understand what Hume means by ‘experience’ and thus how we understand the context of his epistemological investigations. I examine these in turn and argue overall that Hume’s naturalism and his science of man do not simply anticipate a disenchanted conception of the world. (shrink)

Issues of methodology are central to the philosophy of moral progress. However, the idea that effective moral methodology, as well as being instrumental to progress, might also constitute progress has not been adequately explored. This paper will critically assess the merits of this idea – what I call ‘pure proceduralism about moral progress’ – taking Philip Kitcher's recent theory of ‘democratic contractualism’ (2021) as a test case. An epistemology of pure procedural moral progress will be sketched: namely, a naturalised epistemology (...) of paradigmatic instances of moral progress. Assuming an ideal procedure exists and has been at least approximately instantiated (an empirical claim), we learn about its form by studying paradigms of historical moral progress. From this epistemological method will be derived theoretical constraints on what can count as a theory of moral progress per se: it must capture the core semantic constraints on the term ‘moral progress,’ those features without which we would not recognise a change as moral progress. While this poses a tougher challenge for pure proceduralism than for more traditional approaches to moral methodology, it will be concluded that the potential of pure proceduralism as a viable metaethics of moral progress remains an exciting open question.
