It is not without a certain emotion that one opens this book devoted to the memory of a great scholar of medieval thought who worked and lived in the certainty that there cannot be a conflict between the Christian faith and science. In a significant essay, Benedict M. Ashley defends the idea of the philosophy of nature as continuous or identical with natural science. Ashley does allow, however, for so many divergences between philosophy of nature and natural science due to (...) later developments in science that this identification must be qualified. Steven E. Baldner points out some of the contradictions of Hartshorne's atomism: Hartshorne denies change and real causality. Anthony J. Celano recalls that Robert Kilwardby was very much aware that happiness as described by Aristotle is quite different from the beatitude promised by the Christian faith. The order of the divine entitative attributes in the Summa theologiae I, qq. 3-11 has baffled many a commentator. Lawrence Dewan connects it with some texts of Aristotle's Metaphysics. Jeremiah Hackett studies Roger Bacon's Moralis philosophia. Dealing with Luther's attitude toward St. Thomas, Denis R. Tanz accepts Erasmus's verdict that the weight given to Thomas in theology was an important factor in propelling Luther out of the Roman Catholic orbit. This opinion, however, confounds appearances with the real reason for leaving, namely, estrangement from several central positions of Catholic doctrine. It is a tribute to the Catholicity of Thomas that after 1519 Luther came to identify the Pope, the Church and all scholastic doctors with the Thomists and said that the Church had become the synagogue of the papists and the Thomists: Thomas had been made the arbiter of heresy. Mark F. Johnson stresses the sapiential character of the sacra doctrina. Mark D. Jordan wrestles with the question why Thomas wrote his Aristotelian commentaries. Arguing in the line of Owens's interpretation he reduces their importance with regard to Thomas's own positions. Jordan seems to think that Thomas's philosophy cannot be formulated without his theology, an explanation which is hardly satisfactory. Armand Maurer submits some reflections on St. Thomas's notion of presence. The question to what extent Albert the Great contributed to Aquinas's treatises of the morality of human acts and of natural law is examined by Ernest J. McCullough. Walter H. Principe points out how, according to Aquinas, food is assimilated into the veritas humanae naturae. Eric A. Reitan retraces Weisheipl's analysis of Aristotle's Physics and of St. Thomas' Commentary: the axiom, "whatever is moved, is moved by another" can be understood only within the context of the general science of nature. In his Liber de causis et processu universitatis Albert came to hold the same position as Thomas on the demonstrability of creation and of its beginning in time. Two final articles concern the difficulties underlying Aristotle's arguments in Physics 7 and 8, and Aquinas and Newton on causality: William Wallace connects Newton's universal gravitation with the axiom that nothing acts on itself. Pope Benedict XVI argued that it is "necessary and reasonable to raise the question of God through the use of reason" and to understand "theology, as inquiry into the rationality of faith." (Ratzinger 2006) The idea that faith per se can be reconciled with rationality per se presents a delicate analytical task for philosophy of religion, to consistently ground a belief system which is regarded by nonbelievers as inherently ungrounded and inconsistent, without negating any grounding postulates internal to the dogma. Focussing on Abrahamic theism, with special emphasis on Christianity, I interpret the Biblical narrative as a symbolic representation of a universal normative structure grounded in social ontology and the value-commitments intrinsic to agency. The goal of this chapter is to mount a critique of the claim that cognitive content (that is, the kind of content possessed by our concepts and thoughts) makes a constitutive contribution to the phenomenal properties of our mental lives. We therefore defend the view that phenomenal consciousness is exclusively experiential (or nonconceptual) in character. The main focus of the chapter is on the alleged contribution that concepts make to the phenomenology of visual experience. For we take it that if (...) cognitive phenomenology is to be found anywhere, it should be found here. However, we begin with a discussion of the question of cognitive phenomenology more generally, and we close by sketching how our argument might be extended into the domain of non-perceptual thought. A powerful reply to a range of familiar anti-physicalist arguments has recently been developed. According to this reply, our possession of phenomenal concepts can explain the facts that the anti-physicalist claims can only be explained by a non-reductive account of phenomenal consciousness. Chalmers (2006) argues that the phenomenal concept strategy is doomed to fail. This article presents the phenomenal concept strategy, Chalmers' argument against it, and a defence of the strategy against his.

Living labs are interdisciplinary and participatory initiatives aimed at bringing research closer to practice by involving stakeholders in all stages of research. Living labs align with the principles of participatory research methods as well as recent insights about how participatory ways of generating knowledge help to change practices in concrete settings with respect to specific problems. The participatory, open, and discussion‐oriented nature of living labs could be ideally suited to accompany ethical reflection and changes ensuing from reflection. To our knowledge, (...) living labs have not been explicitly trialed and reported in ethics literature. In this discussion paper, we report and discuss four initial issues that marked the process of setting up a living lab in ethics: (1) determining the goals and expected outcomes of an ethics living lab; (2) establishing operational procedures; (3) selecting communities and defining pilot projects; and (4) adopting a lens to tackle emerging questions and challenges. We explain these four issues and present the paths taken based on the novel and specific orientation, that is, living ethics, at the basis of this project. In alignment with living ethics and É‐LABO, we approach challenges as learning opportunities to ask not only “how” questions but also “why” questions. We hope that this discussion paper informed by our experience helps to clarify the theoretical, methodological, and practical approaches necessary to successfully adopt and employ living labs in ethics. Foundations of Set Theory discusses the reconstruction undergone by set theory in the hands of Brouwer, Russell, and Zermelo. Only in the axiomatic foundations, however, have there been such extensive, almost revolutionary, developments. This book tries to avoid a detailed discussion of those topics which would have required heavy technical machinery, while describing the major results obtained in their treatment if these results could be stated in relatively non-technical terms. This book comprises five chapters and begins with a discussion of (...) the antinomies that led to the reconstruction of set theory as it was known before. It then moves to the axiomatic foundations of set theory, including a discussion of the basic notions of equality and extensionality and axioms of comprehension and infinity. The next chapters discuss type-theoretical approaches, including the ideal calculus, the theory of types, and Quine's mathematical logic and new foundations; intuitionistic conceptions of mathematics and its constructive character; and metamathematical and semantical approaches, such as the Hilbert program. Scheid new york: oxford university press, 2016. 264 pp. $31.95Published shortly after the first encyclical to focus on the environment (Pope Francis's Laudato Si'), Daniel Scheid's first book is a significant advance in Christian ethics and religious ecology. Scheid argues that resources in (...) Catholic social thought and other religious traditions can move one to an appreciation of a common good that includes the "more than human world" (xiv). In particular, he "aim[s] (1) to extend Catholic social thought ecologically, and (2) to extend Catholic ecological ethics comparatively" (8).The argument begins by broadening the notion of the common good into a "Catholic cosmic common good," which "emphasizes the centrality of God, the goodness of creation, and humanity's dignified and privileged but contextualized role within the story of creation" (32). This vision is then informed by Augustine, Aquinas, and Thomas Berry. Next, Scheid widens solidarity, a virtue that (per John Paul II) involves "commit[ting] oneself to the common good" (86), into "Earth solidarity," which attends to all ecosystems and species, particularly those most impacted by environmental damage. Solidarity cannot be exercised without respecting others' rights, and Scheid contends that these include "Earth rights" of biota, abiota, and ecosystems. Finally, in order to really "test the potential for the cosmic common good as a ground for interreligious ecological ethics" (124–25), he turns to three non-Abrahamic traditions that each support, augment, and challenge elements of his vision. A Hindu dharmic ecology is theocentric and blurs the line between humans and nonhumans, Buddhist traditions are nontheistic and highlight how all are [End Page 197] interrelated, and American Indians (specifically the Lakota) condemn individualism and demonstrate certain advantages of a more spatial (rather than simply temporal) perspective.The Cosmic Common Good covers an impressive range of thought in under two hundred pages of main text. While the argumentation is intricate, the logical ordering of chapters, the repetition of important points, and some vivid examples assist the reader in following along. The case for Earth rights is especially bold and well argued; Scheid considers objections to them and shows that they can be intelligibly grounded (as prima facie and proportionately weighted) in self-governance and creaturely dignity. This is a very promising development in Catholic social thought, as recent key magisterial teachings do not explicitly affirm that animals have dignity (or rights) but limit themselves to the notion that harming animals is "contrary to human dignity" (see Laudato Si', §§ 92, 130, quoting Catechism of the Catholic Church, § 2418).While the book is generally comprehensive, there are a few surprising lacunae. First, although Scheid himself recognizes that "a properly Catholic ecological ethics would certainly not dismiss the centrality of the Bible" (198n16), there is very little reference to it. The author briefly alludes to the Psalms' portrayal of the natural world (47, 181), but more integration of the Old and New Testaments would have been illuminating. And while The Cosmic Common Good makes a commendable last-minute effort to incorporate insights from Laudato Si', Francis's predecessor Benedict XVI (often dubbed "the Green Pope") receives too-short shrift. Benedict's ecological views are referenced only on one page, perhaps because they are somewhat more anthropocentric than the "Earth-centered or cosmos-centered" ethic developed by Scheid (24). Regardless, the former pope's frequent calls for environmental responsibility to the poor, future generations, and animals would surely lend some healthy support to the cosmic common good. But these omissions do not detract much from the merits of this book, which should be read "not as a definitive conclusion but as an invitation to generate greater interreligious dialogue and cooperation on an issue that demands extensive and immediate action" (11). Pharmaceutical industry marketers are confronted with specific ethical issues linked to the tension between the economic interest being pursued and the health mission of this sector. Indeed this dual mission could be problematic for them when the two objectives contradict each other. We use the concept of moral dissonance to examine how marketers in the pharmaceutical industry perceive the profit/health tension inherent in their sector and how they deal with it. Based on narratives of 18 marketers working in the pharmaceutical (...) sector, our qualitative study identifies ethical conflicts of varying intensity that generate differing degrees of moral dissonance among marketers. To cope with this moral dissonance, they use the following strategies: (1) minimize the sensitivity of their activity; (2) invoke the benefits to patients; and (3) avoid behaviors that conflict with their values. When an agent suffers in their capacity as a knower, they are a victim of epistemic injustice. Varieties of epistemic injustices have been theorised. A salient feature across these theories is that perpetrators and victims of epistemic injustice belong to different social groups. In this paper, I argue for a form of epistemic injustice that could occur between members of the same social group. This is a form of epistemic injustice where the knower is first a victim of historical and (...) continuing oppression. Secondly, they internalise and appreciate the systems that harm them as a knower. This is possible because the victim subscribes to perniciously formed epistemic systems. This form of epistemic injustice is a valuable explanatory tool for non-standard and obscure instances of epistemic injustice where the victim a) accepts and appreciates the injustice they experience and b) is even the seeming perpetrator of the injustice against themselves. The human microbiome is the bacteria, viruses, and fungi that cover our skin, line our intestines, and flourish in our body cavities. Work on the human microbiome is new, but it is quickly becoming a leading area of biomedical research. What scientists are learning about humans and our microbiomes could change medical practice by introducing new treatment modalities. This new knowledge redefines us as superorganisms comprised of the human body and the collection of microbes that inhabit it and reveals how (...) much we are a part of our environment. The understanding that microbes are not only beneficial but sometimes necessary for survival recasts our interaction with microbes from adversarial to neighborly. This volume explores some of the science that makes human microbiome research possible. It then considers ethical, legal, and social concerns raised by microbiome research. Chapters explore issues related to personal identity, property rights, and privacy. The authors reflect on how human microbiome research challenges reigning views on public health and research ethics. They also address the need for thoughtful policies and procedures to guide the use of the biobanked human samples required for advancing this new domain of research. In the course of these explorations, they introduce examples from the history of biomedical science and recent legal cases that shed light on the issues and inform the policy recommendations they offer at the end of each topic's discussion.This volume is the product of an NIH Human Microbiome Project grant. The “gift exchange theory” articulated by Marcel Mauss, along with his core concept of a threefold obligation, is the dominant theoretical framework used to explain the majority of gift issues in marketing. This perspective assumes that some interest always lies behind gifts, such that a gift always implies a counterpart of receiving something in return. Despite the relevance of this approach in understanding the day-to-day consumer behavior, this paper presents empirical cases where the consumer is also able to give freely, (...) that is to say without implying a counterpart or even expecting it. To explain those empirical cases, we mobilize a key teaching of the Catholic Church: the “gratuitous gift” and then introduce the concept of the “need to give.” We show that gratuitousness is a relevant concept to understand most of gifts made by consumers, and we develop the normative aspect of gratuitous gift for ethical marketers. We also show that Catholic Social Teaching offers an appropriate anthropology to understand consumer behaviors motivated by this need for gratuitousness. William Abraham studied Philosophy at the University of Ghana, and even more Philosophy at Oxford University. Thereafter, he gained permission to take part in the competitive examination and interview for a fellowship at All Souls' College. The examination was once described, with some exaggeration, as 'the hardest exam in the world!' It included a three-hour essay. Following his success in becoming the first African fellow of All Souls, his interest in African politics quickly developed into a Pan-African perspective. The (...) Mind of Africa, written while he was still at All Souls, was a fruit of that enlarged perspective. After several years as a Fellow, he had occasion to visit Ghana in 1962. There Kwame Nkrumah, then President of Ghana, successfully persuaded him to return to Ghana to teach at the University of Ghana, Legon and he subsequently resigned from All Souls. In 1968, he went to the United States as a visiting professor. This was followed by invitations to teach at various academic institutions there, including Berkeley and Stanford. He subsequently settled in California, where he continued to teach and research philosophy in the University of California at Santa Cruz until his retirement. The Mind of Africa appeared at a time when a number of African countries were obtaining, or fighting for, their political freedom from their colonial rulers and becoming independent nations and expecting to build new societies in accordance with their own visions and conceptions, though not necessarily jettisoning all the features of their colonial heritage. Building new societies requires appropriate ideologies and philosophies fashioned within the crucible of their cultural and historical experiences. Thus, the relation between ideology and society is taken up at the very outset of the book... The Mind of Africa is important for Africa's future and identity. (shrink)

My concern here is to motivate some theses in the philosophy of mind concerning the interpersonal character of intentions. I will do so by investigating aspects of shared agency. The main point will be that when acting together with others one must be able to act directly on the intention of another or others in a way that is relevantly similar to the manner in which an agent acts on his or her own intentions. What exactly this means will become (...) clearer once we understand what it is to act directly on one’s own intentions. But I take it to be a fundamental assumption of the prevailing individualism of the theory of action— one at the core of its conception of the separateness of individuals— that one person cannot act directly on another’s intention. I agree that there is an important way in which we are or can be separate and autonomous thinkers and agents. But the way the individualist tries to capture this separateness is misguided. (shrink)

Sometimes individuals act together, and sometimes each acts on his or her own. It's a distinction that often matters to us. Undertaking a difficult task collectively can be comforting, even if only for the solidarity it may engender. Or, to take a very different case, the realization (or delusion) that the many bits of rudeness one has been suffering of late are part of a concerted effort can be of significance in identifying what one is up against: the accumulation of (...) grievances (no doubt well catalogued) is seen, not as an unfortunate coincidence of affronts stemming from various quarters, but as itself a product of a unified exercise of agency. A paranoid conspiracy theorist is not usually to be taken seriously. But he does get right that it certainly would be awful, for example, if everyone were out to get him and were working together to do so. After all, the stability and impact of agency that's shared can be expected to be more serious than the effects of a mere collection of individual acts.[1.. (shrink)

Au centre des fêtes patronales de la haute vallée d’Ossau, celles de Laruns et Bielle plus particulièrement, forment une manifestation que le visiteur est tenté de qualifier de folklorique : des danses traditionnelles, exécutées sur la place centrale par des hommes et des femmes vêtus d’un costume également traditionnel. Ce costume, particulièrement celui des femmes, est très valorisé localement. Le but de cet article est de comprendre les raisons de cette valorisation. On y montre que le processus de folklorisation des (...) coutumes de la vallée, qui commence dès le milieu du xixe siècle et a été une des conditions de leur conservation, n’a pas ôté tout sens social au costume de fête : les femmes, ou une partie d’entre elles, ne le mettent pas seulement pour offrir un beau spectacle aux touristes venus voir les danses ossaloises mais parce qu’il cristallise l’histoire familiale et locale. The effects of mental fatigue on both cognitive and physical performance are well described in the literature, but the recovery aspects of mental fatigue have been less investigated. The present study aimed to fill this gap by examining the persistence of mental fatigue on behavior and electrophysiological mechanisms. Fifteen participants performed an arm-pointing task consisting of reaching a target as fast as possible, before carrying out a 32-min cognitively demanding task [Time Load Dual Back task], and immediately, 10 and 20 (...) min after completion of the TLDB task. During the experiment, electroencephalography was continuously recorded. The significant increase in mental fatigue feeling after the TLDB task was followed by a decrease during the 20 min of recovery without returning to premeasurement values. Brain oscillations recorded at rest during the recovery period showed an increase in both theta and alpha power over time, suggesting a persistence of mental fatigue. Arm-pointing movement duration increased gradually over time during the recovery period, indicating that behavioral performance remained impaired 20 min after the end of the cognitively demanding task. To conclude, subjective measurements indicated a partial recovery of mental fatigue following a cognitively demanding task, whereas electrophysiological and behavioral markers suggested that the effects of mental fatigue persisted for at least 20 min. While the subjective evaluation of mental fatigue is a very practical way to attest the presence of mental fatigue, electrophysiological and behavioral measures seem more relevant to evaluate the time course of mental fatigue effects. This article presents, in a programmatic way, the histoire croisée approach, its methodological implications and its empirical developments. Histoire croisée draws on the debates about comparative history, transfer studies, and connected or shared history that have been carried out in the social sciences in recent years. It invites us to reconsider the interactions between different societies or cultures, erudite disciplines or traditions . Histoire croisée focuses on empirical intercrossings consubstantial with the object of study, as well as on the operations (...) by which researchers themselves cross scales, categories, and viewpoints. The article first shows how this approach differs from purely comparative or transfer studies. It then develops the principles of pragmatic and reflexive induction as a major methodological principle of histoire croisée. While underlining the need and the methods of a historicization of both the objects and categories of analysis, it calls for a reconsideration of the way history can combine empirical and reflexive concerns into a dynamic and flexible approach. Accepting a promise is normatively significant in that it helps to secure promissory obligation. But what is it for B to accept A’s promise to φ? It is in part for B to intend A’s φ-ing. Thinking of acceptance in this way allows us to appeal to the distinctive role of intentions in practical reasoning and action to better understand the agency exercised by the promisee. The proposal also accounts for rational constraints on acceptance, and the so-called directedness of promissory (...) obligation. Finally, the proposal, conjoined with Cognitivism about intentions, addresses recent criticism of Scanlon’s expectation-based view of promissory obligation. (shrink)

Why should we decolonise knowledge? One popular rationale is that colonialism has set up a single perspective as epistemically authoritative over many equally legitimate ones, and this is a form of...

Shared activity is often simply willed into existence by individuals. This poses a problem. Philosophical reflection suggests that shared activity involves a distinctive, interlocking structure of intentions. But it is not obvious how one can form the intention necessary for shared activity without settling what fellow participants will do and thereby compromising their agency and autonomy. One response to this problem suggests that an individual can have the requisite intention if she makes the appropriate predictions about fellow participants. I argue (...) that implementing this predictive strategy risks derailing practical reasoning and preventing one from forming the intention. My alternative proposal for reconciling shared activity with autonomy appeals to the idea of acting directly on another's intention. In particular, I appeal to the entitlement one sometimes has to another's practical judgment, and the corresponding authority the other sometimes has to settle what one is to do. (shrink)

A fair amount of the philosophical discussion about pain and unpleasantness has focused on providing a constitutive account of unpleasantness. These theories provide a more fundamental description of what unpleasantness is by appealing to other well-established notions in the architecture of the mind. In contrast, I address the nature of unpleasantness from a structural account. I will argue for how unpleasantness is built, rather than what unpleasantness is made of, as it were. I focus on the heterogeneity of experience, which (...) has been a somewhat neglected issue in the literature about unpleasantness: after careful introspection, there seems to be nothing phenomenal that all and only unpleasant experiences share. In order to address the heterogeneity of unpleasant experiences, I propose that the structure of the rich phenomenology of unpleasantness should be understood as a determinable property constituted by multiple essential dimensions. Decision-making concerning gender in dynamic modeling design is a gender and ethical issue that is important to address regardless of the system in which the dynamic modeling is applied. There are many dynamic modeling tools that operationally include the female population, however, there is an important distinction between females and women; it is the difference between biological sex and the social construct of gender, which is (...) fluid and changes over time and geography. The ethical oversight in failing to represent or misrepresenting gender in model design when it is relevant to the model purpose can have implications for model validity and policy model development. This paper highlights this gender issue in the context of feminist engineering ethics using a dynamic population model. Women are often represented in this type of model only in their biological capacity, while lacking their gender identity. This illustrative example also highlights how language, including the naming of variables and communication with decision-makers, plays a role in this gender issue. (shrink)

Is there such a sub-discipline as “sociology of valuation and evaluation”? Identifying the main focus, the topics, and the analytical designs, i.e., reflecting on a theoretical profile of such an investigation, is far from complete. The main question is indeed—where to start when addressing the sociology of valuation and evaluation? Is it a specific area of research, analysis, and inquiry, with specific objects? Should we confine it to the many important qualitative and quantitative studies dedicated to the measure of market (...) performance, the efficiency of public policy, profitability of private investment, or identification of best practices in various areas ? What does evaluation mean? This article examines the evaluative process as a practical judgment that links a situation to a set of values in order to decide upon a course of action. It starts by discussing A. Sen’s “relational” and “comparative” account of evaluation, built in critical dialogue with J. Rawls’ deductive theory. Comparison, incompleteness, reality, and deliberation are the key principles of Sen’s approach, which, in some respects, echoes that of J. Dewey. The second part shows the relevance of (...) completing Sen’s approach with Dewey’s pragmatism, since Dewey’s emphasis on practical judgment is a useful counterbalance to Sen’s focus on evaluation as a cognitive process. Dewey introduces a shift from values to valuation and draws a distinction between prizing and appraising, which makes the logic of inquiry and the search for consistency between means and ends in a given situation the fulcrum of evaluation. The third part of this paper addresses the relationship between values and norms in evaluative processes. Neither Sen nor Dewey deals with this question in a systematic way, although norms, which are both similar and different from values, contribute to frame evaluations in different ways: as horizons, resources, or constrains. Bringing norms into the picture means completing the pragmatist account with an institutionalist perspective, as we suggest through the example of the evaluation of work. (shrink)

While Plantinga has famously argued that acceptance of neo-Darwinian theory commits one to the rejection of naturalism, Plantinga’s argument is vulnerable to an objection developed by Evan Fales. Not only does Fales’ objection undermine Plantinga’s original argument, it establishes a general challenge which any attempt to revitalize Plantinga’s argument must overcome. After briefly laying out the contours of this challenge, we attempt to meet it by arguing that because a purely naturalistic account of our etiology cannot explain the correlation between (...) our preference for simplicity and simplicity’s ability to serve as a veridical method of theory selection, the scientific realist is committed to the rejection of naturalism. Many researchers insist that computational methods will transform the historical profession, while an equally large number reject these claims as unwarranted hype. This study attempts to place the debate in historical and social context. The essay is divided into three parts. The first part offers a brief review of computational history. It asks whether the “computational turn” bears any resemblance to quantitative history and how it fits within the digital humanities. The second part describes the authors’ recent attempts to apply (...) computational methods to an existing project in the history of science using a standardized workflow. It demonstrates that each step of the workflow adds another layer of subjectivity. The third part reflects on what computational methods mean for the historical profession. It systematically reviews the positive aspects of computational history (open access, interdisciplinary collaboration, and new perspectives) as well as the negative aspects (inequality, fragility, and the threat of automation) and offers prescriptions based on the authors’ experiences. One important thesis Ásta defends in Categories We Live By is that social properties and categories are somehow dependent on our thoughts, attitudes, or practices—that they are inventions of the mind, projected onto the world. Another important aspect of her view is that the social properties are related to certain base properties; an individual is placed in a category when the relevant base properties are thought to hold of them. I see the relationship between the social and the base as (...) connected to the problem of explaining how the social properties are sufficiently stable so as to be taken seriously, both in theoretical endeavors as well as in practical matters of how we relate to each other. In this light, I identify stability constraints for an adequate account of social categories. I argue that certain distinctive aspects of Ásta's conferralist view of social categories, such as the radical contextualism in her account of gender, undermine the stability of categories and are at odds with taking social categories seriously. I end with the suggestion that a distinctive “sheltered” form of normativity might help us do justice to Ásta's insights while avoiding some of the destabilizing elements of conferralism. (shrink)

Despite the phenomena of internationalization and Europeanization, legal process remains essentially national in character. However, certain domains of law are already unified. Focusing mainly on the French tradition and its contribution to the construction of a European legal space, this paper: a) criticizes the traditional methods used to manage diversity in law – unifying the law and co-ordinating those legal codes likely to be conflictual; b) studies the debate between universalism and particularism in private international law, a discipline whose essential (...) object is the resolution of the difficulties derived from pluralism; and c) attempts to discern an appropriate path towards a 'renewed universalism' by pursuing a comparative approach which can open the way towards unification but must also be able to preserve the irreducible diversity of law.
