This article joins in and extends the contemporary debate on the right to privacy. We bring together two strands of the contemporary discourse on privacy. While we endorse the prevailing claim that norms of informational privacy protect the autonomy of individual subjects, we supplement it with an argument demonstrating that privacy is an integral element of the dynamics of all social relationships. This latter claim is developed in terms of the social role theory and substantiated by an analysis of the (...) role of privacy in intimate relationships, in professional relationships and in social interactions between strangers in public. We conclude by arguing that it is not always reasonable to assume a conflict between individual privacy on the one hand and society on the other. Legislators and participants in public debate also have to take into account the consequences of limiting privacy on social interaction and the integration of the society. (shrink)

Rising health insurance costs and the cost of living crisis are likely leading to an increase in unpaid health insurance bills in many countries. In Switzerland, a particularly drastic measure to sanction defaulting insurance payers is employed. Since 2012, Swiss cantons – who have to cover most of the bills of defaulting payers - are allowed by federal law to blacklist them and to restrict their access to medical care to emergencies.In our paper, we briefly describe blacklisting in the context (...) of the Swiss healthcare system before we examine the ethical issues involved in light of what is known about its social and health impacts. We found no evidence that blacklisting serves as an effective way of recovering unpaid health insurance contributions or of strengthening solidarity within the health insurance system. Furthermore, the ambiguous definitions of what constitutes an emergency treatment and the incompatibility of the denial of medical care with the obligation to provide professional assistance complicate the implementation of blacklists and expose care providers to enormous pressure.Therefore, we conclude that blacklists and the (partial) denial of medical care not only pose profound ethical problems but are also unsuitable for fulfilling the purpose for which they were introduced. Responding to bivalent stimuli slows subsequent performance. In prospective memory research, prospective memory targets can be considered as bivalent stimuli because they typically involve features relevant for both the prospective memory task and the ongoing task. The purpose of this study was to investigate how responding to a prospective memory target slows subsequent performance. In two experiments, we embedded the prospective memory task in a task-switching paradigm and we manipulated the degree of task-set overlap between the prospective memory task and (...) the ongoing task. The results showed consistent after-effects of responding to prospective memory targets. The specific trajectory of the slowing depended on the amount of task-set overlap. These results demonstrate that responding to prospective memory targets results in after-effects, a so far neglected cost on ongoing task performance. (shrink)

This new book by Beate Rossler is a work of real quality and originality on an extremely topical issue: the issue of privacy and the relations between the private and the public. Rossler investigates the reasons why we value privacy and why we ought to value it. In the context of modern, liberal societies, Rossler develops a theory of the private which links privacy and autonomy in a constitutive way: privacy is a necessary condition to lead an autonomous life. The (...) book develops a theory of freedom and autonomy which sees the ability to pose the "practical question" of how one wants to live, of what a person strives to be, at the centre of the modern idea of autonomy. The question of privacy is emerging as an increasingly important topic in social and political theory and is central to many current debates in law, the media and politics. In this 1999 study, Beat Wyss provides a critical analysis of Hegel's theories of art history. Analogous to his philosophy of history, Hegel viewed the history of art in dialectical terms: with its origins in the Ancient Near East, Western art culminated in Classical Greece, but began its decline already in the Hellenistic period. Yet, as Wyss posits, art refuses its programmed demise. He highlights the political dimension of this contradiction, showing the implication of theories which subordinate art to (...) the will of absolute rule. Wyss follows his analysis of Hegel's theories with a discussion of the work of four modern successors - Nordau, Spengler, Sedlmayr and Lukacs - all of whom adapted Hegel's dialectical model, in an effort to demonstrate the central contradictions of twentieth-century aesthetics. Recent findings in different areas of psychology and cognitive science have brought the unconscious mind back to center stage. However, the unconscious mind worry remains: What renders unconscious phenomena mental? I suggest a new strategy for answering this question, which rests on the idea that categorizing unconscious phenomena as “mental” should be scientifically useful relative to the explanatory research goals. I argue that this is the case if by categorizing an unconscious phenomenon as “mental” one picks out explanatorily relevant similarities (...) to a corresponding paradigmatically mental conscious phenomenon. his monograph examines the metaphysical commitments of the new mechanistic philosophy, a way of thinking that has returned to center stage. It challenges a variant of reductionism with regard to higher-level phenomena, which has crystallized as a default position among these so-called New Mechanists. Furthermore, it opposes those philosophers who reject the possibility of interlevel causation. Contemporary philosophers believe that the explanation of scientific phenomena requires the discovery of relevant mechanisms. As a result, new mechanists are, in the main, concerned (...) solely with epistemological questions. But, the author argues, their most central claims rely on metaphysical assumptions. Thus, they must also take into account metaphysics, a system of thought concerned with explaining the fundamental nature of being and the world around it. This branch of philosophy does indeed matter to the empirical sciences. The chapters investigate the nature of mechanisms, their components, and the ways in which they can bring about different phenomena. In addition, the author develops a novel account of causation in terms of activities. The analysis provides the basis for many further research projects on mechanisms and their relations to, for example, the mind-body problem, realization, multiple realization, natural kinds, causation, laws of nature, counterfactuals, and scientific levels. How should scientists carve up cognition to generate good predictions, explanations, and models of cognition? This chapter argues that cognitive categories should be constructed the same way that biological categories are: in terms of homology. The chapter adapts a developmental account of trait identity from evolutionary-developmental biology to make sense of the notion of “cognitive homology.” The consequence is that both brain structures and the organism’s ongoing interactions with the environment are crucial for individuating cognitive homologies, and thus for cognitive (...) ontology. Although legitimacy theory provides strong arguments that environmental, social and governance disclosure and performance can help mitigate firm-specific risks, this relationship has been repeatedly challenged by conceptual arguments, such as ‘transparency fallacy’ or ‘impression management’, and mixed empirical evidence. Therefore, we investigate this relationship in the revelatory case of initial public offerings, which represent the first sale of common stock to the wider public. IPOs are characterised by strong information asymmetry between firm insiders and society, while at the same time (...) suffering from uncertainty in firm legitimacy, culminating in amplified financial risks for both issuers and investors in aftermarket trading. Using data from the United States, we demonstrate that voluntary ESG disclosure reduces idiosyncratic volatility and downside tail risk and higher ESG ratings have lower associated firm-specific volatility and downside tail risk during the first year of trading in the aftermarket. We provide theoretical arguments for the relationships observed, suggesting that companies striving for ESG performance and communicating their efforts signal their compliance with sustainability-related norms, thus acquiring and upholding a societal license to operate. ESG performance and disclosure help companies build their reputation capital with investors after going public. We also report that ESG disclosure is a more consistent proxy for ex-ante uncertainty as an indicator of aftermarket risk, thereby replacing some of the more conventional measures, such as firm age, offered in the existing literature. ZusammenfassungDas Verhältnis zwischen Ethikkonsultation und der bspw. in psychiatrischen Arbeitsfeldern und im Palliativbereich etablierten psychologischen Supervision ist bisher wenig untersucht. Dieser Vergleich und die Abgrenzung von Ethikkonsultation stellen eine Forschungslücke dar. Anhand von zwei Fallvignetten aus der Praxis von EK und PS werden unter Kontrastierung mit dem jeweils anderen Ansatz Unterschiede und Gemeinsamkeiten im methodischen und praktischen Vorgehen sowie Kriterien der Unterscheidung analysiert. Als Ergebnis wird eine systematische Gegenüberstellung präsentiert, die folgende Merkmale umfasst: 1. Ziele jedes Ansatzes, 2. Einberufung, 3. (...) Gegenstand, 4. Fokus, 5. Methode/Prozess, 6. Rolle des Beraters, 7. Ergebnisse, 8. Dokumentation, 9. Bearbeiten von Emotionen, 10. Bearbeiten ethischer Fragestellungen. Trotz Überschneidungen der beiden Arbeitsformen erscheinen EK und PS nicht wechselseitig austauschbar; eine Vermischung wird nicht empfohlen. Als Fazit werden Hinweise zur Indikationsstellung von EK oder PS gegeben; dabei spielen auch die Motivation der Teilnehmenden und die zeitnahe Verfügbarkeit der Beratungsangebote eine Rolle. The philosophy and aesthetics of music have been shaped by the philosophy of life since the end of the 18th century. At the beginning of the 20th century, however, the relationship between the philosophy of music and the philosophy of life changed fundamentally – due to the development and popularization of various related cultural theories. From then on, the philosophy of life, the philosophy of music and cultural criticism formed a complex triangle. Many European and North American intellectuals availed themselves (...) of established concepts of the philosophy of life such as ‘non-rationality’, ‘organicity’ and ‘vitality’ as contrasting foils for their own cultural-pessimistic theories, which revolved around the ‘critique of technology’, ‘pessimism of progress’, ‘posthistoire’, ‘dehumanisation’, ‘the uncontrollable machine’ and the ‘hypertrophy of administration’. At the same time, cultural criticism transformed the philosophy of music having been shaped by the philosophy life. This chapter reconstructs the triangle by means of Theodor W. Adorno’s music philosophy, especially his theoremes on avant-garde music. It demonstrates how, in the middle of the 20th century, cultural-pessimistic and life-philosophical ideas mutually explained and questioned each other in light of the contemporary compositional techniques and the philosophical discourse on them. Against the backdrop of an aging world population increasingly affected by a diverse range of abilities and disabilities as well as the rise of ubiquitous computing and digital app cultures, this paper questions how mobile technologies mediate between heterogeneous environments and sensing beings. To approach the current technological manufacturing of the senses, two lines of thought are of importance: First, there is a need to critically reflect upon the concept of assistive technologies as artifacts providing tangible solutions for a specific (...) disability. Second, the conventional distinction between user and environment requires a differentiated consideration. This contribution will first review James Gibson’s concept of “affordances” and modify this approach by introducing theories and methods of Science and Technology Studies and Actor-Network Theory. Then, we present two case studies where we explore the relations between recent “assistive” app technologies and human sensory perception. As hearing and seeing are key in this regard, we concentrate on two specific media technologies: ReSound LINX2, a hearing aid which allows for direct connect with iPhone, iPad, or iPod Touch, and Camassia, an IOS app for sonic wayfinding for blind people. We emphasize the significance of dis-/abling practices for manufacturing novel forms of hearing and seeing and drawing on sources like promotional materials by manufacturers, ads, or user testimonials and reviews. Our analysis is interested in the reciprocal relationships between users and their socio-technical and media environments. By and large, this contribution will provide crucial insights into the contemporary entanglement of algorithm-driven technologies, daily practices, and sensing subjects: the production of techno-sensory arrangements. For many causal endeavors, such as measuring, predicting, and explaining, individuating causal systems plays a crucial role. In this chapter, we focus on the individuation of a specific type of causal systems, what we call cross-cutting systems. These are systems that lack natural boundaries and that are not restricted to the spatiotemporal region of the individuals to which they belong. Based on examples taken from cognitive science and behavioral ecology, we explore how scientists individuate such cross-cutting causal systems.

Constitutive mechanistic explanations are said to refer to mechanisms that constitute the phenomenon-to-be-explained. The most prominent approach of how to understand this constitution relation is Carl Craver’s mutual manipulability approach to constitutive relevance. Recently, the mutual manipulability approach has come under attack (Leuridan 2012; Baumgartner and Gebharter 2015; Romero 2015; Harinen 2014; Casini and Baumgartner 2016). Roughly, it is argued that this approach is inconsistent because it is spelled out in terms of interventionism (which is an approach to causation), whereas (...) constitutive relevance is said to be a non-causal relation. In this paper, I will discuss a strategy of how to resolve this inconsistency, so-called fat-handedness approaches (Baumgartner and Gebharter 2015; Casini and Baumgartner 2016; Romero 2015). I will argue that these approaches are problematic. I will present a novel suggestion of how to consistently define constitutive relevance in terms of interventionism. My approach is based on a causal interpretation of mutual manipulability, where manipulability is interpreted as a causal relation between the mechanism’s components and temporal parts of the phenomenon. Argentine tango has been investigated by scholars of various disciplinary backgrounds. A broad range of empirical methods has been used in this research. But little attention has been paid to the artefacts which participate in the practice of Argentine tango. Following the programmatic claims of the ‘practical turn’ in the social sciences and in cultural studies, practices are always linked with the materiality of the practising bodies and of the artefacts participating in practices. Thus materiality is indispensable for the analysis (...) of any practice. How materiality can be included into the generating of data and the analysis is little discussed in practice theories. High heels in Argentine tango are the example to demonstrate the necessary application of various qualitative research instruments to investigate the role of artefacts in practice. High heeled female dancing shoes as used in Argentine tango are analysed with respect to their gendered performative and symbolic impact. (shrink)

Immer mehr Menschen verbringen ihren Lebensabend in Einrichtungen der Altenpflege. Zusätzlich zur Sorge um physische, psychische und soziale Belange gilt es, deren spirituelle Bedürfnisse zu berücksichtigen. Ziel dieser Arbeit war es, die spirituellen Bedürfnisse von alten Menschen in Langzeitpflegeeinrichtungen zu erfassen. Gleichzeitig wurde untersucht, welche spirituellen Bedürfnisse Pflegende bei den ihnen anvertrauten Bewohner/-innen wahrnehmen. Dabei wurden Übereinstimmungen bzw. Unterschiede identifiziert. Daten aus 28 Einzelinterviews mit Bewohnerinnen und Bewohnern und 9 Fokusgruppeninterviews mit Mitarbeitenden wurden mittels Qualitativer Inhaltsanalyse ausgewertet und unter die (...) Kernkategorien „Sinn“, „Verbundenheit“, „Transzendenz“ kategorisiert. Die Kategorien beider Befragtengruppen wurden einem Vergleich unterzogen. Trotz zahlreicher Übereinstimmungen in den Aussagen beider Gruppen bleiben Defizite in der Wahrnehmung von Pflegenden. Aus den Ergebnissen der Arbeit werden Schlussfolgerungen für die Einbeziehung der spirituellen Dimension der alten Menschen in die pflegerische Arbeit im Seniorenheim gezogen und Empfehlungen ausgesprochen. Quel est le substrat de la conscience? Qu'est-ce qui la fait? Poser la question signifie ne pas se satisfaire de la position naturaliste qui affirme que c'est le cerveau qui produit la conscience. En fait, toute explication qui situe son substrat dans le monde objectif est confrontée à une forme de circularité à la fois ontologique (la conscience est dans le monde qui est dans la conscience) et épistémique (la conscience explique le monde qui explique la conscience). La phénoménologie transcendantale (...) n'échappe pas à cette circularité. Et le caractère circulaire d'une vision globale de la réalité s'avère rédhibitoire dès lors qu'on est prêt à considérer subjectivité et objectivité sur le même niveau de dignité ontologique. Reste alors l'option d'aborder, sans préjugés, la question du substrat comme problème philosophique. Il s'agit de concevoir le substrat de la conscience comme un domaine d'être à part, situé en amont de toute objectivation. Un tel substrat est transcendantal, puisqu'il est condition de possibilité de toute connaissance. (shrink)

Many authors have turned their attention to the notion of constitution to determine whether the hypothesis of extended cognition (EC) is true. One common strategy is to make sense of constitution in terms of the new mechanists’ mutual manipulability account (MM). In this paper I will show that MM is insufficient. The Challenge of Trivial Extendedness arises due to the fact that mechanisms for cognitive behaviors are extended in a way that should not count as verifying EC. This challenge can (...) be met by adding a necessary condition: cognitive constituents satisfy MM and they are what I call behavior unspecific. (shrink)

Cartwright et al. in European Journal for Philosophy of Science, 10 and the new mechanists agree that regular behaviors described in cp laws are generated by mechanisms. However, there is disagreement with regard to the two questions that Cartwright at al. ask: the epistemological question and the ontological question. Most importantly, Cartwright et al. argue that the explanation involved is a CL-explanation, while the new mechanists insist that mechanistic explanation and CL-explanation are competitors. In this reply, I will highlight some (...) worries regarding Cartwright et al.’s analysis of the relationship between mechanisms and cp laws and I will provide alternative answers to the two questions in line with the new mechanistic approach. When communal sharing relationships suddenly intensify, people experience an emotion that English speakers may label, depending on context, “moved,” “touched,” “heart-warming,” “nostalgia,” “patriotism,” or “rapture”. We call the emotion kama muta. Kama muta evokes adaptive motives to devote and commit to the CSRs that are fundamental to social life. It occurs in diverse contexts and appears to be pervasive across cultures and throughout history, while people experience it with reference to its cultural and contextual meanings. Cultures have evolved diverse practices, (...) institutions, roles, narratives, arts, and artifacts whose core function is to evoke kama muta. Kama muta mediates much of human sociality. (shrink)

The disagreement between defenders and opponents of extended cognition is often framed in terms of constitution. The underlying principle of this discussion is what I will call the co-location principle: cognition is located where its constituents are located. The crucial question is under which conditions something is to be counted as a constituent of cognition. I will formulate three criteria of adequacy that an account of constitution must satisfy to be applicable to the dispute on extended cognition. I will evaluate (...) different accounts of constitution as to whether they satisfy the criteria of adequacy. Three different accounts of constitution can be identified in the literature on extended cognition, which I will call property-based constitution, diachronic constitution, and mechanistic constitution. I will show that none of the accounts satisfies all three criteria. Thus, the search for the mark of constitution does not seem to be a promising strategy for defending extended cognition. I will briefly sketch a new strategy of how to deal with this situation. (shrink)

The processing, representation, and perception of bodily signals (interoception) plays an important role for human behavior. Theories of embodied cognition hold that higher cognitive processes operate on perceptual symbols and that concept use involves reactivations of the sensory-motor states that occur during experience with the world. Similarly, activation of interoceptive representations and meta-representations of bodily signals supporting interoceptive awareness are profoundly associated with emotional experience and cognitive functions. This article gives an overview over present findings and models on interoception and (...) mechanisms of embodiment and highlights its relevance for disorders that are suggested to represent a translation deficit of bodily states into subjective feelings and self-awareness. BackgroundCurrently, we are facing a demographic shift to an older population and its consequences worldwide: in the years to come, several older people will need nursing home care. The work culture is important for care quality in NHs. Some Norwegian municipalities have implemented the Joy of Life Nursing Home strategy, representing a resource-oriented health-promoting approach. Knowledge about how implementation of the JoLNH approach impacts the work culture is scarce.AimssWe hypothesized that the JoLNH strategy impacts positively on the work culture: when (...) comparing measurements at two time points and when comparing two municipalities, among which one has implemented the JoLNH and the other has not.MethodWith a 1-year interval, healthcare personnel in 43 NHs located in two large Norwegian municipalities responded to a survey in two waves. In total, 558 healthcare personnel participated at T1 and 515 at T2. Work culture was assessed by the Systematizing Person–Group Relations Instrument.FindingsThe municipality implementing the JOLNH strategy experienced significant increases in SPGR dimensions, representing positive orientations towards a better work culture, whereas those working in the non-JoLNH municipality reported an increase in SPGR dimensions, signifying a worsened work culture.DiscussionThe data indicate that the implemented JoLNH strategy has endorsed positive effects in the work culture. The JoLNH strategy emphasizes on the quality of patient care, which is what healthcare personnel, in general, are much concerned about. Furthermore, attention to task orientation and independent work seem to encourage a better work culture in NHs.ConclusionThis study suggests that the JoLNH strategy impacts positively on the work culture in Norwegian NHs.
